Do UK community pharmacists encounter the high drama dilemmas of the medical ethics literature or is a 'morality of the mundane' more appropriate? This paper presents the findings of a qualitative study that asked a sample of UK pharmacists to describe their ethical issues and to establish whether these were ethical dilemmas as understood philosophically or ethical problems of a more legal or emotional nature. It emerged that although many pharmacists referred to 'dilemmas', these were often problems involving a (...) class='Hi'>conflict between an ethical value and a legal or procedural issue and often arose in the routine minutiae of dispensing prescriptions and selling medicines. Such ethical problems remained of concern for pharmacists and the commercial environment, corporate pharmacy ownership and pharmacists' subordination to doctors, all precipitated ethical problems. Law and ethics appeared to be understood synonymously but this may reflect a modernity that increasingly brackets out ethical experiences by encouraging reliance upon law and procedure. (shrink)

It is a surprising fact that moral philosophers have rarely examined the distinction between what I shall call ‘positive’ or ‘social’ morality on the one hand and ‘autonomous’ or ‘individual’ morality on the other. Accordingly, conceptual and moral issues of the greatest importance have been neglected. The distinction is, I take it, recognised by Hegel, when he contrasts Sittlichkeit with Moralität . However, the rival sides who give a conceptual or a moral preference to one concept over the other rarely (...) come to grips with one another, and the deep conflicts between them are concealed instead of being brought out into the open. Only in Burke's diatribe against Rousseau, Bradley's critique of Sidgwick , Hobhouse's crusade against Bosanquet , Prichard's attack on Green , Hart's criticism of Hare , and above all in Oakeshott's onslaught on Rationalism do we get a glimpse of one of the main issues of moral philosophy and of morality. For just as we have two concepts, so we have two moral conceptual schemes, each of which gives a central place to one concept at the expense of the other. Those who suppose that morality is or ought to be wholly or mainly a social concept may recommend submission to a tradition. Those, on the other hand, who suppose morality to be primarily an individual or independent concept will recommend independent decisions. I want in this paper, firstly, to explain the differences between the two concepts, secondly, to show that neither of them is conceptually illegitimate or degenerate, and lastly, to determine what place, if any, each ought to have in a rational morality. China’s extensive media presence in Africa aims to distinguish itself through the use of constructive journalism in contrast with the perceived dominance of conflict journalism by Western media outlets. However, many scholars have raised questions of consistency surrounding Chinese media’s use of constructive journalism in representing Africa (e.g. Marsh, Citation2016). With perspectives from Galtung’s (Citation1987, p. 1998) conflict and peace journalism, this research applies Critical Discourse Analysis to examine Chinese media’s representation of Africa to an international audience. Using (...) linguistic data from China Radio International’s Today, it challenges the distinctions among peace journalism, solutions journalism and constructive journalism. The findings show that China’s claim of constructive journalism strongly favors the coverage of China, yet is largely absent in the coverage of the African continent. It suggests that while Chinese state-sponsored media utilizes the so-called constructive journalism when presenting information about a specific region to that region, these representations are not consistent across their international coverage. Educational policy and discussion, in Britain and the USA, are increasingly dominated by the confused ideology of egalitarianism. David E. Cooper begins by identifying the principles hidden among the confusions, and argues that these necessarily conflict with the ideal of educational excellence - in which conflict it is this ideal that must be preserved. He goes on to criticize the use of education as a tool for promoting wider social equality, focussing especially on the muddles surrounding 'equal opportunities', (...) 'social mix' and 'reverse discrimination'. Further chapters criticize the 'new egalitarianism' favoured, on epistemological grounds, by various sociologists of knowledge in recent years and 'cultural egalitarianism' according to which standard criteria of educational value merely reflect parochial and economic interests. As the prospects for a negotiated two-state solution to the Israeli–Palestinian conflict have dwindled, Jewish scholars in the United States have increasingly invoked the concept of diaspora to counter a purported Jewish consensus regarding Zionism. In this essay, I critique prominent exponents of this approach from a diasporic standpoint. My concern is not that Butler and the Boyarins attack Israel publicly, endorse a binational solution to the Israeli–Palestinian conflict, and/or support the movement for Boycott, Divestment, and Sanctions—rather, it (...) is that they lack a compelling vision for diasporic politics. Their visions prove wanting because they contest Zionism on the terrain of Jewish identity. To loosen Zionism’s hold, Butler and the Boyarins recover alternative approaches to the attainment or grounding of Jewish identity. Yet when framed as an ethic of particular identity, diasporic thinking can neither rebut Zionism’s political arguments, nor can it develop alternative models of Jewish self-rule. Instead of theorizing Jewish identity, I argue, diasporic thinkers should envision Jewish political solidarity beyond the confines of the nation-state. (shrink)

If how the state is imagined shapes social and political action, the politics of state imagining provides an important site for progressive reflection. Arguing that conceptual approaches which support critique may not necessarily prove the best frameworks for supporting change, this article takes a left poststructuralist conception as its starting point to explore the place of conflicting interests, beliefs and affect in the make-up of the state and in shaping its enactment within civil society. Seeking to re-imagine state form in (...) a way that enhances the state's relevance for progressive politics, the paper moves between (i) conservative Christian refusal to provide gay people with a service, as public sector staff and guesthouse owners; and (ii) feminist work in embodiment studies and on the intimate/impersonal, with its ways of thinking about, and imagining, a state that is oriented to encounters, dissonance, tension and change. Public health decisions made by the state involve considerable disagreements on the course of actions, uncertainties, and compromises that arise from moral tensions between the demands of civil liberties and the goals of public health. With such complex decisions, it can be extremely difficult to arrive at and justify the best option. In this article, we propose an ethical decision-making framework based on the philosophy of Ubuntu and argue that in sub-Saharan African settings, this approach provides attractive alternative conventions of (...) moral decision-making and a useful language for understanding moral reasoning and ethics. Through its emphasis on humanity, compassion, and social responsibility, Ubuntu (“I am because we are”) has the potential to facilitate solutions to and avert conflicts between individual rights and public health. The use of Ubuntu shifts the moral reasoning and ethics of decision-making from a field of philosophy shaped by the global north, to the everyday values, decision-making, and consequent practices of people in much of Africa. Using examples of Ebola, pandemic influenza, and tuberculosis, we illustrate how Ubuntu can be applied to tackle conflicting ethical problems in public health and medicine. (shrink)

Despite the reality of intersex individuals whose biological markers do not necessarily all point towards a traditional binary understanding of either male or female, the vast majority of sports divide competition into categories based on a binary notion of biological sex and develop policies and regulations to police the divide. In so doing, sports governing bodies (SGBs) adopt an imperfect model of biological sex in order to serve their particular purposes, which, typically, will include protecting the fundamental sporting value of (...) fair competition. Yet, one potential consequence of enforcing such an approach would seem to be the exclusion or marginalization of individuals whose biological development does not fit within the binary model, whether due to genetics or through a choice to undergo medical intervention to better represent a chosen gender identity. Any such exclusion or marginalization will inevitably tend to undermine another fundamental value of sport, that of inclusivity. In the context of those with differences of sex development, SGBs appear to be faced with a difficult problem: dealing with a conflict between two fundamental values of sport. Different approaches to this problem have been suggested, with some academics proposing that sports organisations, in general, ought to prioritise fairness above, while others suggest the need to ‘balance’ competing values or even to prioritise inclusion over fairness. However, it is argued that any of these approaches are, in principle, justifiable as any sport should be free to prioritise or balance its own values. What seems more important for any SGB is the need for a rational and transparent justification of regulations that pursue fair competition at the expense of inclusivity. Furthermore, where fair competition and inclusivity are fundamental values, any such justification would seem to demand adherence to some basic norms. First, the regulations should be built on (and articulate) a consistent and principled basis of what ‘fair competition’ means in a particular sport. Second, any regulations should only exclude or restrict participation to the minimum degree necessary to achieve the sense of fair competition so articulated. Third, SGBs should be transparent about what their values are and where their priorities lie so that participants and other stakeholders are able to make an informed choice as to whether they wish to participate in, support, or be associated with a particular sport. With reference to the adoption of the Eligibility Regulations for Athletes with Differences of Sex Development (the ‘DSD Regulations’) by the International Association of Athletic Federations (IAAF), this article seeks to evaluate whether the approach of the IAAF satisfied these basic requirements. Christians who affirm standard science and the biblical doctrine of creation often endorse theistic evolution as the best approach to human origins. But theistic evolution is ambiguous. Some versions are naturalistic (NTE)—God created humans entirely by evolution—and some are supernaturalistic (STE)—God supernaturally augmented evolution. This article claims that NTE is inadequate as an account of human origins because its theological naturalism and emergent physicalist ontology of the soul or person conflict with the Christian doctrine that God created humans for (...) everlasting life. Both the traditional Christian account of the afterlife and its modern Christian alternatives involve God's supernatural action and a separation (dualism) of person and body at death. STE can combine with several philosophical accounts of the body-soul relation to provide an adequate Christian account of original human nature. (shrink)

In recent years, scholars of Jewish politics have invested political hopes in the revival of “political imagination.” If only we could recapture some of the imaginativeness that early Zionists displayed when wrestling with questions of regime design, it is argued, we might be able to advance more compelling “solutions” to the Israeli-Palestinian conflict. Yet how does one cultivate political imagination? Curiously, scholars who rehearse the catalogue of regimes that Jews have historically entertained seldom pose this question. In this Article, (...) I revisit a historical episode—the appropriation of diasporic historical narratives by Zionists in mandatory Palestine—in an effort to cultivate a richer political imaginary. I analyze the labor Zionist deployment of Simon Dubnow’s influential master narrative, focusing on a 1926 speech in which David Ben Gurion depicts the autonomist regime that he advocates as a variation upon diasporic political practices. On my reading, this episode illustrates the dilemmas that confront thinkers who invest political hopes in regime design. To realize the promise that new political configurations may emerge from reflections upon Jewish history, I argue, we must develop a new account of political agency, once foundational assumptions of the nation-state have been suspended. Ender's tortured conscience is an illustration of the moral importance of following principles of just war theory—the “unspoken rules of manly warfare”—and their apparent tension with the demands of war and survival. In Minimal Morality, Michael Moehler justifies what he calls the weak principle of universalization as a principle of pure instrumental morality. This article addresses the application of this principle and problems associated with it. Specifically, the article focuses on the principle’s ability to protect the interests of the most vulnerable members of society: agents without primary moral standing, specifically non-human animals; and the weakest members of society, either as a result of their diminished relative bargaining power in certain cases of (...) conflict, or because of their present standing in society, made worse off by historical injustices. This paper explores conservative Christian demands that religious-based objections to providing services to lesbians and gay men should be accommodated by employers and public bodies. Focusing on a series of court judgments, alongside commentators’ critical accounts, the paper explores the dominant interpretation of the conflict as one involving two groups with deeply held, competing interests, and suggests this interpretation can be understood through a social property framework. The paper explores how religious beliefs and sexual orientation are attachments whose power (...) has been unsettled by equality law. But entangled with this property is another—that held in workers’ labour and public bodies’ resources. Arguing against the drive to balance competing interests, the paper uses social property to illuminate the agonistic character of the stakes. At the same time, it questions property as a normative framework for sexual orientation and religious beliefs. (shrink)

Avoiding whinges from various and potentially conflicting stakeholders is a major challenge for sustainable development and for the identification of sustainability scenarios or policies for biodiversity and ecosystem services. It turns out that independently complying with whinge thresholds and constraints of these stakeholders is not sufficient because dynamic ecological-economic interactions and uncertainties occur. Thus more demanding no whinge standards are needed. In this paper, we first argue that these new boundaries can be endogenously exhibited with the mathematical concepts of viability (...) kernel and viable controls. Second, it is shown how these no whinge kernels have components, such as harvesting of resources, that should remain within safe corridor while some other components, in particular biodiversity, have only lower conservation limits. Thus, using radar charts, we show how this no whinge kernels can take the shape of a tree that we name viability tree. These trees of viability capture the idea that the unbounded renewal potential of biodiversity combined with a bounded use of the different ecosystem services are crucial ingredients for the sustainability of socio-ecosystems and the design of no whinge policies reconciling the different stakeholders involved. This article analyses and systematises the repertoires of action and reaction within conflicts between corporations and adversarial campaigns. Particular attention is paid to the parameters that turn conflicts between corporations and their critics into productive or destructive exchanges. Are protest campaigns able to fulfil a function that goes beyond serving as a seismograph for civil society’s concern and discontent? Which are the circumstances that enable conflicts between protest campaigns and corporations to unfold their potential for correcting social deficiencies? The analysis (...) starts by outlining several typologies of confrontational and cooperative repertoires of action. Based on this starting point, a comprehensive analysis of more than 100 campaigns is presented, which systematises the dynamics of conflict between protest campaigns and corporations. An exemplary comparison of two particular conflicts completes the article in order to elaborate on the interplay between confrontation and cooperation. (shrink)

In this article I develop a big picture of the evolution of human cooperation, and contrast it to an alternative based on group selection. The crucial claim is that hominin history has seen two major transitions in cooperation, and hence poses two deep puzzles about the origins and stability of cooperation. The first is the transition from great ape social lives to the lives of Pleistocene cooperative foragers; the second is the stability of the social contract through the early (...) Holocene transition to complex hierarchical societies. The first of these transitions is driven, at least initially, by individual advantage: cooperation paid off for individual foragers, initially through mutualist interaction, then through reciprocation. This argument leads to a reanalysis of the role of violence and the nature of the freeriding threat to cooperation. But the conditions that select for cooperative individuals in the Pleistocene were eroded in the Pleistocene–Holocene transition. So we need an alternative account of the survival, and indeed the expansion, of cooperation in the Holocene. Group selection driven by intercommunal conflict really may well be central to this second transition. (shrink)

It is also doubtful in the cases Pinker presents whether a denial will successfully cancel the conversational implicature –change the audience’s interpretation of speaker’s meaning. Since the emergence of Pakistan the history of Pak-Afghan relations can best be analyzed from conflict to cooperation. Some of the early problems are mainly responsible for conflict and cooperation in both countries relations. After the establishment of democratic setup in both states, different CBMs indicate positive sign in Pak-Afghan diplomatic relationship. The drawdown of US forces has created security concern for Pakistan and Afghanistan that the creation of power vacuum can push the country again into civil war (...) like situation. In such state of security Pakistan’s engagement to bring the Taliban to the negotiation table will smooth the way for a broad-based government in Afghanistan. Some of the Afghan domestic political issues also created mistrust i.e., the refugee’s problem, cross border militant’s infiltrations, drug problem and issue of the Taliban. However, the paper will highlight the measures to keep intact the reconciliation more effective and replace the mistrust by trust. How domestic political issues effect their bilateral relations and why various methods taken in the prescribe time not effective in bilateral relations of the two states. (shrink)

Interactions between state, international, transnational and intra-state law involve overlapping, and sometimes conflicting, claims to legitimate authority. These have led scholars to new theoretical explanations of sovereignty, constitutionalism, and legality, but there has been no close attention to authority itself. This book asks whether, and under what conditions, there can be multiple legitimate authorities with overlapping or conflicting domains. Can legitimate authority be shared between state, supra-state and non-state actors, and if so, how should they relate to one another? Roughan (...) argues that understanding authority in contemporary pluralist circumstances requires a new conception of relative authority, and a new theory of its legitimacy. The theory of relative authority treats the interdependence of authorities, and the relationships in which they are engaged, as critical to any assessment of their legitimacy. It offers a tool for evaluating inter-authority relationships prevalent in international, transnational, state and non-state constitutional practice, while suggesting significant revisions to the idea that law, in general or even by necessity, claims to have legitimate authority. The simple model of conflict-prone situations called Prisoner’s Dilemma is discussed. Whereas the best strategy for the model is to defect, in the case of its iterated version (Iterated Prisoner’s Dilemma—IPD) it is possible and more profitable to cooperate with the opponent.The simple strategy called Tit for Tat (TFT) which is easy to recognize, never defects first, punishes every defection but is also forgiving is presented. The TFT strategy is very successful being able to establish the cooperation with its (...) opponents. The possible outcome of the competition between the TFT strategy and non-cooperative strategies is considered. It turns out that even small number of TFT strategies can overcome the greater number of more “egoistic” strategies.The described model can give the better understanding of some psychological, sociological and biological processes as well as help to propagate the altruistic attitudes in the society. Private law and regulation are constantly involved in the evaluation of conflicts of interest, judging some of them salutary, with others requiring adjustment. Focusing on the question of conflicts of interest allows us to clarify our vision of when such adjustment is appropriate and, more specifically, when the law should supply an infrastructure for cooperative behavior. Thus, the prism of conflicts of interest provides a lens through which to view basic legal problems that turn on whether individual actors will (...) be deemed responsible to some joint interest or whether they will be at liberty to pursue their individual interests despite the adverse effects of such activity on others. This article proposes a conflicts of interest perspective for examining contract law and its immediate surroundings. It suggests a map of conflicts of interest along three axes: the remedial axis; the axis of positive duties to avoid conflicts; and the axis of the transition from independence to loyalty. Applying the map to contract doctrine, the article examines a number of contract doctrines including: remedies for breach of contract; modification; conditions; good faith in performance; and formation. The article goes on to apply the map of conflicts to two complex fact situations: corporate acquisitions and corporate bankruptcies. The analysis underscores the fact that conflicts of interest rules do not simply protect existing interests, but also contribute to the very constitution of those interests. Recognizing the constitutive role of legal rules raises questions about our ability to determine interests ex ante and thus calls for a more nuanced approach to gauging the incentive effects of a legal regime. Over the past few decades, cooperation between Korea and Japan has increased and deepened, but frictions continue to persist. Which direction is the relationship between Korea and Japan heading? This is the question that this article attempts to address.

This 1989 volume presents a theory of capitalist collective action and a case study of the pre-World War II American coal industry to which the theory is applied. The author examines the irony of capitalist firms that do not want to compete with each other, but often cannot avoid doing so. He then explains under what conditions businesses would be able to organize their competition and identifies the economic and political factors that facilitate or inhibit this organization. The case study (...) not only illustrates the theory, but demonstrates how the competitive relations of capitalist firms are critically important determinants of their political behavior. The author argues that the traditional Marxist concern with conflict between workers and capitalists should be supplemented with a concern for the competitive conflicts among capitalists. (shrink)
