Architecture, landscape architecture and urban design are seldom merely benign aesthetic propositions. With its victory in the Spanish-American War (1898), the United States unexpectedly found itself in possession of an empire. Within a volcanic climate of patriotic fervour, Washington’s new imperial status galvanized interest in improving the city in a manner commensurate with its enlarged role. On the strength of his work at the World’s Columbian Exposition (1893), celebrated architect Daniel Hudson Burnham took the lead in Washington’s transformation (1901–2) and (...) urban design became his medium for imperialist expression. This potent mechanism’s deployment would not be confined to the imperial hearth. The United States soon set its sights on modernizing, that is ‘Americanizing’, Manila, the antique capital of its newly-acquired Philippine colony, and similarly charged Burnham with the task (1904). Overtly emulating the British Raj in India, he was also to design a wholly new summer capital there. This essay canvasses Burnham’s work at the American and Philippine capitals, along with his vicarious hand in the design of a new model American town in the Panama Canal Zone, considering it through the lens of imperialism. The location and imperial purpose of these projects also reminds us that – at least from an antipodean perspective – in the early 20th century, Great Britain held no monopoly on empire. (shrink)

Powerful new social science data resources are emerging. One particularly important source is administrative data, which were originally collected for organisational purposes but often contain information that is suitable for social science research. In this paper we outline the concept of reproducible research in relation to micro-level administrative social science data. Our central claim is that a planned and organised workflow is essential for high quality research using micro-level administrative social science data. We argue that it is essential for researchers (...) to share research code, because code sharing enables the elements of reproducible research. First, it enables results to be duplicated and therefore allows the accuracy and validity of analyses to be evaluated. Second, it facilitates further tests of the robustness of the original piece of research. Drawing on insights from computer science and other disciplines that have been engaged in e-Research we discuss and advocate the use of Git repositories to provide a useable and effective solution to research code sharing and rendering social science research using micro-level administrative data reproducible. Shuman Questions of responsibility for serious harm are complex and potentially divisive. The way in which we frame these questions and the criteria by which we assess answers to them are colored, in part, by the lens though which we view them. I am a (...) law professor whose writings includes issues relating to criminal responsibility of person with mentally disabilities and I come to this commentary from that perspective. For me questions of moral responsibility raise psychological and philosophical, as well as legal, questions.Ciocchetti's (2003) paper addressees the criminal responsibility of the psychopathic offender. Not sure quite what the author meant by this label, I began to try to understand the concept of psychopathic offender by picking up my DSM-IV-TR and found no reference to such a diagnostic category. Absent a handy reference in the DSM, I looked in the paper for some other definition or recognition of the category of psychopathic offender and found no satisfactory grounding in any body of sound research. Left with the author's unsupported assertions that such a category of persons exists and that they behave in ways the author asks me to accept without support, my lawyer instincts cautioned me to proceed carefully. The psychopathic offender the author describes might well exist, but I am not persuaded of that, nor would be my legal colleagues, absent proof.Next, to the author's thesis that "[t]he offender must have the capacities necessary to understand relationships to justify holding that offender responsible" (p. 176) and that because psychopaths lack this capacity they should not be held criminally responsible. Is the author proposing a new test for criminal responsibility? Certainly no test for criminal nonresponsibility based on mental disability (i.e., insanity defense) in Anglo-American jurisprudence, or any other with which I am familiar, makes status (i.e., a diagnostic category) exculpatory for criminal responsibility. Rather, every test addresses the impact of a mental illness or disorder on the cognitive or volitional capacity of the offender at the time of the offense. The author offers no reason to reject the approach taken for the last several hundred years [End Page 193] by Anglo-American jurisprudence. Moreover, to the extent that status or diagnostic category is relevant in the insanity defense in Anglo-American jurisprudence, character or personality disorders (the genus to which I take it that psychopathy belongs) are often specifically excluded from consideration. For example, the Texas Penal Code (Tex. Penal Code Ann. § 8.01 (Vernon 1994)) states that:It is an affirmative defense to prosecution that, at the time of the conduct charged, the actor, as a result of a severe mental disease or defect, did not know that his conduct was wrong. The term "mental disease or defect" does not include an abnormality manifested only by repeated criminal or otherwise antisocial conduct.The federal Insanity Defense Reform Act raises the same issue: The government relies on the legislative history of 18 U.S.C. § 17, which states: "The concept of severity was added to emphasize that non-psychotic behavior disorders or neuroses such as an 'inadequate personality,' 'immature personality,' or a pattern of 'antisocial tendencies' do not constitute the defense.".... One has a difficult time finding a wholly satisfactory collection of writings from Thomas Aquinas in a single volume. In different ways, the well-known collections of Mary Clark, Robert Goodwin, Thomas Gilby, Vernon Bourke, and Anton Pegis have their merits, hut they have their defects too-one of which is that they all came out twenty to forty years ago. Christopher Martin has recently produced a new collection of readings, and his selection is much different. Add to this that many of the texts in his work are rare or nonexistent in translation, and one begins to see why it is delightful to see this work appear. Christopher Martin has gathered a number of philosophical texts from Aquinas for those who have already cut their teeth in philosophy. (Hence, the uninitiated to philosophy will find things here hard going.) Texts were selected principally with an eye to interesting those students who are most familiar with philosophy in the analytic tradition. They are often unacquainted with theology and at a loss as to how to sort out Thomas's philosophical claims from his theological claims. The aim was to produce a volume which would help such students read Thomas fruitfully and show them that Thomas has many genuine philosophical insights. To this end, texts were chosen that presupposed no, or a minimal, understanding of theology. Not every side of Thomas's philosophical thought is reflected in this work, hut a number of important sides of it are, and an idea of the breadth of it comes through. The format of this work is something like that of Ralph Mclnerny's recent A First Glance at St. Thomas Aquinas. Each chapter begins with an essay that is closely tied to a Thomistic text or two given at the end of the chapter. In Martin's work, however, the emphasis lies more on the itexts than on the expository essays. Apart from the introduction, the 150 BOOK REVIEWS book is divided into five chapters: Aquinas on Logic; Aquinas on Metaphysics; Aquinas on God; Aquinas on Truth, Knowledge and the Mind; and Aquinas on Ethics. The chapters by design follow the major divisions and order of Anthony Kenny's Aquinas: A Collection of Critical Essays. The essays which begin each chapter and introduce the texts that follow are solid pieces. They make many references to Thomas's depend· ence on Aristotle and to parallels between Thomas's handling of a problem and recent discussions of the same. They also give guidance in reading the Thomistic texts and explain what is difficult in the doctrine found in the texts. Throughout these essays, the influence of Peter Geach's writings is evident (especially God and the Soul and Three Philosophers). At times it is just an example or the choice of a term, and at other times it is something more substantial. Though Martin's essays are quite accurate and helpful, a reader can find things to quibble with. Thomas's distinction, for example, between id a quo nomen imponitur ad significandum and id ad quod nomen imponitur ad significandum does not seem, as Martin suggests, to be Frege's distinction between sense and reference or Kripke's distinction between the reference of a name and the fixing of a reference. Rather, Thomas seems to be distinguishing more the etymology of a name from its meaning. Again, it will not do to say that the principle of individuation for individuals of the same kind is " distinct lumps of matter " and that the lumpiness of matter in turn is responsible for the individuation of forms. Abuse, when committed by spiritual authority figures, can have far-reaching consequences for church communities well after perpetrators have been removed and held accountable. In attending to survivors, a host of issues may come to light, including but not limited to, organizational complicity in abuse, institutional marginalization of the vulnerable, and the revelation that worship spaces can be traumatically triggering. The work of scholars like Michelle Panchuk, Elaine Heath, and Katharina von Kellenbach all point to the challenging reality that ecclesial repentance­ (...) may demand dramatic changes to restore a safe environment and righteous expressions of worship that honour God's intentions for all. Glen Kinoshita's ‘ministry of reconciliation’ and Dietrich Bonhoeffer's ‘preparing the way’ and ‘religionless Christianity’ are texts that on the surface address this type of process; however, it is not clear that either scholar fully reckons with the issue of a worshipping community or space that has been so marred by abuse as to become an impediment to a survivor's participation in liturgy. In this article, I modify Bonhoeffer's work to move beyond his claims and make recommendations for further steps towards repentance. (shrink)

In Rights Forfeiture and Punishment, Christopher Heath Wellman argues that those who seek to defend the moral permissibility of punishment should shift their focus from general justifying aims to moral side constraints. On Wellman's view, punishment is permissible just in case the wrongdoer has forfeited her right against punishment.

This article analyzes the relative effectiveness and limitations of companies’ voluntarily produced transparency reports in promoting change in firm and government behavior. Such reports are published by telecommunications companies and disclose how often and on what grounds government agencies compel customer data from these companies. These reports expose corporate behaviors while lifting the veil of governmental secrecy surrounding these kinds of compulsions. Fung, Graham, and Weil’s “targeted transparency” model is used to evaluate the extent to which these reports affect behavior. (...) From the analysis, it is evident that telecommunications companies’ transparency reports are only partially effective; while firms may modify their reports to present more information, these reports do not necessarily induce government to more broadly reveal its own activities. The article ultimately suggests that voluntarily produced transparency reports may become more comparable with one another as a result of either corporate reports evolving in consultation with external stakeholders or following a crisis that prompts government or industry to adopt a given standard. Such standards may positively influence the effectiveness of reports while concealing as much about firm behaviors as they purport to reveal. (shrink)

This representation ofBuddhism finds support in Buddhist texts, doctrines, and ritual practices, which often advocate ahimsa, nonharming or non-violence. The historical record, however, belies the portrayal (...) of Buddhism as a "religion of nonviolence." By reinterpreting early doctrines of ahimsa, Buddhist thinkers have legitimated violence in particular situations, practitioners have committed acts of violence, and Buddhist institutions have lent support to other institutions—social, political, and governmental —engaged in violence. In this paper I will examine Buddhist perpetration andjustifications ofviolence,1 with particularfocus on Japan, arguing that, historically, Buddhists' desire for institutional security has taken precedence over total rejection of violence. 1 I have restricted my discussion to the killing of other human beings. The first ofthe five moral precepts (panca silani) in Buddhism is ahimsa, and in the Dhammapada the historical Buddha purportedly states, All are afraid of the rod. Of death all are afraid. Having made oneself the example, One should neither slay nor cause to slay. (Ross 202) The Buddhaalso sketches the consequences ofhurting orharming (himsa): Who with a rod does hurt Beings who desire ease [of nibbana], While himself looking for ease— He, having departed, ease does not get. Theravadan monastic codes and practices, such as the uposatha biweekly confession of moral transgressions and recitation of the 227 rules in the Patimokkha (Skt. Pratimoksa), are closely tiedto ahimsa. One ofthe Patimokkha's four "offenses of defeat" (parajika dharmas), for which the punishment is immediate expulsion of the monk or nun from the order, is killing another human being (Prebish 11). Mahayana texts continue this exhortation against violence. For example, in the Dasabhimika-sutra we read that a Buddhist "must not hate any being and cannot kill a living creature even in thought."2 Early Buddhist texts include depictions ofthe ideal Buddhist king, the cakravartin-raja or "monarch who turns the wheel [of the Dharma],"3 as an exemplar of nonviolence. Contemporary Buddhist activist Sulak Sivaraksa expresses it, this king is a "an ideal ruler, a world-conquering monarch, who subdued the earth through righteousness rather than war" (Sulak 129), and whose ten main duties include striving for peace and ruling with nonviolent benevolence (129). His preoccupation with homonymy influences his approach to almost every subject that he considers, and it clearly structures the philosophical methodology that he employs both when criticizing others and when advancing his own positive theories. In the _Phaedrus_, Plato provides an intriguing dramatic detail immediately before Socrates's first speech. "I shall veil myself to speak," Socrates declares, "so that I may run through the speech as quickly as possible and may not be at a complete loss from a sense of shame as I look towards you." In this essay, I argue that Socrates's veiling illustrates how authors of dialogic literature about philosophical topics subtly use dramatic and literary details to suggest preferred philosophical takeaways.

Phenomenological psychology is shown as a means to examine implications of mass-commodity culture, through the presentation of a phenomenological analysis of a TV commercial. This advertisement plays upon the vicissitudes of fathers' experiences of their relationships with their pre-pubescent daughters. The findings disclose an image of a father's ambivalently lived inability to tolerate his daughter's first sexual attraction to another male, and his attempt to continue to control the satisfaction of his daughter's bodily desire through commodities. After acknowledging Wim Drees’s excellent contribution to the science-religion debate, this essay considers three ‘beyonds’ unhelpful to a response to the climate emergency. These are ‘beyond as sudden destruction’, stemming from an over-reliance on the apocalyptic texts of the New Testament; ‘beyond as up’, focussing on the release of the immortal soul from the material world; and ‘beyond time’, addressing the cosmological predictions of the ultimate end of the universe through God’s transformation of creation. The essay proposes in contrast that (...) the same event in the present can be viewed through four parallel lenses, of which eschatology is one. It draws on proposals from Drees’s Beyond the Big Bang and the detemporalised eschatology of Kathryn Tanner to propose an eschatology of the present moment, informed by divine judgment and longing, and the human vocation to respond to that judgment and longing with parallel longing, and with both action and consolation. This is the text of the 2022 Boyle Lecture. After some acknowledgements, it introduces the theological problem of the suffering of nonhuman creatures in the natural world as described by evolutionary science. It sets aside the neo-Cartesian objection that this suffering should not be considered real. The lecture then considers, and initially rejects, theodicies based on some form of fall event. An account is offered based on the premise that Darwinian evolution was the only way God could have given rise (...) to a biological world containing the sorts of values we observe. Although this remains the preferred basis for an evolutionary theodicy, consideration is finally given to the extent to which certain phenomena, such as parasitism, cancers, and viral infections, might be thought to exhibit a resistance to the divine will. The tentative suggestion is made that this resistance might derive from temptation by spiritual powers, thus incorporating into an overall only-way account an element of angelic fallenness. (shrink)

ABSTRACTIf representative democracy is not about elected officials responding directly to voters’ preferences, and if the voters do a poor job of voting their interests in referendums, then what is democracy about? In our view, a satisfactory theory of democracy would focus normatively on the social identities and political interests of citizens rather than on their expressed policy preferences, and empirically on the ability of organized or attentive groups to get those identities and interests effectively recognized and acted on in (...) the governmental process. A group-theoretic version of democratic theory along these lines would dispense with the most important illusions of the conventional “folk theory” of democracy. However, much hard work remains to clarify how actual democracies make policy and to construct a wise normative standard—inspirational but not innocent—against which they can be judged. (shrink)

Such reciprocal ethical-political integration addresses problems of ideological complicity that may arise if freedom is discretely abstracted from history and power in political philosophy. Finally, the article roughly reconstructs a critical account of African identity from writings of Steven Biko to illuminate symptoms of 'meritocratic apartheid' in South Africa today which Thad Metz's influential pre-political conception of ubuntu obscures, by abstracting the figure of African personhood from politically significant historical conditions. Finally, the article roughly reconstructs a critical account of African identity from writings of Steven Biko to illuminate symptoms of 'meritocratic apartheid' in South Africa today which Thad Metz's influential pre-political conception of ubuntu obscures, by abstracting the figure of African personhood from politically significant historical conditions. Ideology criticism, like scepticism, calls into question the objective or justified status of beliefs. However, where scepticism only refutes, and never puts forward, a substantive claim about anything, the ideology critic must maintain some criterion for distinguishing ideas which support relations of domination from those that do not, in virtue of her criticism of a particular set of ideas as “ideological”. The trouble for the ideology critic is that the sceptical methods she deploys undermine any critical thesis, including her own. (...) Thus, the theory of ideology tends to undercut ideology criticism with a fundamental problem of self-implication. This paper draws on the epistemological problem of the criterion to explain and define a basic problem of justification for the theory of ideology. A problem of self-implication is introduced in part one. I argue that the basis for ideology criticism inevitably succumbs to the very doubt it puts forward. I draw on various criticisms of ideology criticism to formulate a specific account of the basic, fundamental problem for the theory of ideology. I show how norms for ideology criticism are vulnerable to an Ancient sceptical problem for epistemic criteria, which brings the ideology critic to a dilemma: either (i) find independent grounds for criticism, immune to ideology, or (ii) show how ideology is self-undermining. ABSTRACT The present study features an interview between a Royal Canadian Mounted Police (RCMP) officer and a female indigenous minor, who was reporting her own sexual assault. The study highlights how the child's interview with the officer appears to include gender-specific judgements. Thus far, few critical studies, underscoring interview techniques, feature power relations and ideologies in the discourse. This study identifies police negotiation with female assault complainants as discursive Yentling. Inspired by the term Yentl syndrome, where female health is often (...) underappreciated because it is judged from male prerogatives, the present study proposes that discursive Yentling emerges from victim blaming, perpetrator mitigation, and the sexualization of rape. Drawing attention to transcripts of an RCMP interview with a child complainant, this study asks (1) what power relations and ideologies manifest in the dialogue between the officer and the complainant? (2) Do the findings give evidence for discursive Yentling? Transitivity analysis and a discourse historical approach reveal ideological predispositions towards the complainant during the interview. The implications for this study hopefully provoke more considered police interview techniques for potential victims of sexual assault and inculcate a culture of feminist understanding in Canadian public services.
