This article investigates what notions of “just health care” are found at three Swedish hospitals among health care personnel and whether these notions are relevant to what priorities are actually made. Fieldwork at all three hospitals and 114 in-depth interviews were conducted. Data have been subject to conceptual and ethical analysis and categorisation. According to our findings, justice is an important idea to health care personnel at the studied hospitals. Two main notions of just health care were found. The main (...) idea was the notion of “equal treatment according to need”, the basic idea being that differences in treatment should be justified by differences in needs. The competing idea that merit should affect the treatment received is occasionally encountered, the idea here being that patients, by acting irresponsibly, may no longer deserve to be treated strictly according to needs. In practice, priorities are made on grounds that only partly comply with the basic idea of justice in health care, as it is understood by staff at the studied hospitals. Exceptions are made due to regional differences, considerations of cost-effectiveness, economic incentives, tradition, the daily patient flow, research, private alternatives, patient influence and favouritism of health care personnel. Recent technological innovation has made video doctoring increasingly accessible. This has given rise to Deepfake Pornography, an emerging phenomenon in which Deep Learning algorithms are used to superimpose a person’s face onto a pornographic video. Although to most people, Deepfake Pornography is intuitively unethical, it seems difficult to justify this intuition without simultaneously condemning other actions that we do not ordinarily find morally objectionable, such as sexual fantasies. In the present article, I refer to this contradiction as the pervert’s dilemma. (...) I propose that the method of Levels of Abstraction, a philosophical mode of enquiry inspired by Formal Methods in computer science, can be employed to formulate at least one possible solution to the dilemma. From this perspective, the permissibility of some actions appears to depend on the degree to which they are abstracted from their natural context. I conclude that the dilemma can only be solved when considered at low levels of abstractions, when Deepfakes are situated in the macro-context of gender inequality. (shrink)

As private corporations and bioethicists build relationships with each other, bioethicists must ask themselves about the opportunities, the constraints, and the subtle shifts in attitude and focus that such ties might create.

The so-called "non-commutativity" of probability kinematics has caused much unjustified concern. When identical learning is properly represented, namely, by identical Bayes factors rather than identical posterior probabilities, then sequential probability-kinematical revisions behave just as they should. Our analysis is based on a variant of Field's reformulation of probability kinematics, divested of its (inessential) physicalist gloss.

The diagnosis of psychopathy is controversial largely because of two notions: first, that because of their defects, psychopaths cannot understand morality, and second, that these defects should thus excuse psychopaths from moral responsibility for their actions. However, it is not clear just what is involved in understanding morality. The argument that the psychopath is ignorant of morality in the same way that one might be ignorant of facts is difficult to sustain. However, a closer examination of the psychopath's peculiar deficiencies (...) reveals that the psychopath's understanding of morality might be impaired in other ways. This is a translation of the afterword of Legality and Legitimacy, rewritten by Carl Schmitt in 1958 for his collection Verfassungsrechtliche Aufsätze aus den Jahren 1924–1954. In the afterword, Schmitt once again describes the situation in Germany in the early 1930’s, and argues against the influential German lawyers who rejected his interpretation of the Weimar Constitution. He rejects the wide-spread opinion that he wanted a state of emergency in Germany to be introduced, and insists that this book was his (...) final attempt to rescue the presidential republic of Weimar Germany. Schmitt then demonstrates the weakness of legal positivism and specifically stops at the several key points in his argument. First, according to Schmitt, the positivists did not know that legality, an unopposed form of the manifestation of legitimacy, had originally been an essential part of Western rationalism. Second, it is necessary to distinguish between the law and the sanctions because of their different legal statuses. This distinguishing is important because the legislative state was gradually becoming the administrative state. As a result, the governing institutions are more powerful than the parliamentary laws. Any parliamentary decision providing executive bodies relevant authority cannot be executed without an effective parliamentary majority. Thirdly, Schmitt explores the question of the so-called “premiums” for the legal possession of power. The afterword concludes with a brief overview of the situation at the end of the January 1933. In a recent issue of The Lancet, the historian Roger Cooter predicted that the field of bioethics will soon die of self-inflicted wounds. “Conspiring against it,” he wrote, “is exposure of the funding of some of its US centres by pharmaceutical companies; exclusion of alternative perspectives from the social sciences; retention of narrow analytical notions of ethics in the face of popular expression and academic respect for the place of emotions; divisions within the discipline ; and collusion with, and appropriation (...) by, clinical medicine.” Cooter's prognosis? “Hardly wet behind the ears, bioethics seems destined for a short lifespan.”. To enlarge the discussion of scientific responsibility for research integrity, this paper offers two historico-philosophical observations. First, in the broad history of ideas, modern ethics replaces social role responsibility with appeals to abstract principles; by contrast, discussions within the scientific community of responsibility for research integrity constitute a rediscovery of the continuing vitality of role responsibility. This is a rediscovery from which philosophy itself may benefit. Second, within the context of scientists’ concerns, the idea of role responsibility has undergone significant (...) evolution from “collective responsibility” to the notion of responsibility resting with a “trans-scientific community.” Further challenges nevertheless remain in order to relate scientific role responsibility for scientific integrity to the relationship between science and society. To promote a notion of integrity not just in science but in the science-society relationship, it may be useful to think in terms of a “co-responsibility” for scientific integrity. (shrink)

Jonathan Weisberg claims that certain probability assessments constructed by Jeffrey conditioning resist subsequent revision by a certain type of after-the-fact defeater of the reasons supporting those assessments, and that such conditioning is thus “inherently anti-holistic.” His analysis founders, however, in applying Jeffrey conditioning to a partition for which an essential rigidity condition clearly fails. Applied to an appropriate partition, Jeffrey conditioning is amenable to revision by the sort of after-the-fact defeaters considered by Weisberg in precisely the way that he demands.

The psychopathic personality disorder historically has been thought to include an insensitivity to morality. Some have thought that the psychopath's insensitivity indicates that he does not understand morality, but the relationship between the psychopath's defects and moral understanding has been unclear. We attempt to clarify this relationship, first by arguing that moral understanding is incomplete without concern for morality, and second, by showing that the psychopath demonstrates defects in frontal lobe activity which indicate impaired attention and adaptation to environmental conditions (...) which are relevant to the formation of complex intentions. We argue that these frontal lobe defects can help to explain both the psychopath's apparent insensitivity to morality and his characteristic imprudence. (shrink)

Suppose that several individuals who have separately assessed prior probability distributions over a set of possible states of the world wish to pool their individual distributions into a single group distribution, while taking into account jointly perceived new evidence. They have the option of first updating their individual priors and then pooling the resulting posteriors or first pooling their priors and then updating the resulting group prior. If the pooling method that they employ is such that they arrive at the (...) same final distribution in both cases, the method is said to be externally Bayesian, a property first studied by Madansky . We show that a pooling method for discrete distributions is externally Bayesian if and only if it commutes with Jeffrey conditioning, parameterized in terms of certain ratios of new to old odds, as in Wagner , rather than in terms of the posterior probabilities of members of the disjoint family of events on which such conditioning originates. Several authors have made the argument that because blind evolutionary processes produced human intelligence on Earth, it should be feasible for clever human engineers to create human-level artificial intelligence in the not-too-distant future. This evolutionary argument, however, has ignored the observation selection effect that guarantees that observers will see intelligent life having arisen on their planet no matter how hard it is for intelligent life to evolve on any given Earth-like planet. We explore how the evolutionary argument might be salvaged (...) from this objection, using a variety of considerations from observation selection theory and analysis of specific timing features and instances of convergent evolution in the terrestrial evolutionary record. We find that, depending on the resolution of disputed questions in observation selection theory, the objection can either be wholly or moderately defused, although other challenges for the evolutionary argument remain. Despite all the attention to Big Data and the claims that it represents a “paradigm shift” in science, we lack understanding about what are the qualities of Big Data that may contribute to this revolutionary impact. In this paper, we look beyond the quantitative aspects of Big Data and examine it from a sociotechnical perspective. We argue that a key factor that distinguishes “Big Data” from “lots of data” lies in changes to the traditional, well-established “control zones” that facilitated clear (...) provenance of scientific data, thereby ensuring data integrity and providing the foundation for credible science. The breakdown of these control zones is a consequence of the manner in which our network technology and culture enable and encourage open, anonymous sharing of information, participation regardless of expertise, and collaboration across geographic, disciplinary, and institutional barriers. We are left with the conundrum—how to reap the benefits of Big Data while re-creating a trust fabric and an accountable chain of responsibility that make credible science possible. (shrink)

Building on research in anthropology and philosophy, one can make a distinction between type I and type II energy ethics as a framework for advancing public debate about energy. Type I holds energy production and use as a fundamental good and is grounded in the assumption that increases in energy production and consumption result in increases in human wellbeing. Conversely, type II questions the linear relationship between energy production and progress by examining questions of equity and human happiness. The type (...) I versus type II framework helps to advance public debates about energy that address broad questions of profitability, regulation, and the environment, and in the process poses fundamental questions about the reverence for energy growth in advanced technological societies. The automation of online social life is an urgent issue for researchers and the public alike. However, one of the most significant uses of such technologies seems to have gone largely unnoticed by the research community: religion. Focusing on Islamic Prayer Apps, which automatically post prayers from its users’ accounts, we show that even one such service is already responsible for millions of tweets daily, constituting a significant portion of Arabic-language Twitter traffic. We argue that the fact that a phenomenon (...) of these proportions has gone unnoticed by researchers reveals an opportunity to broaden the scope of the current research agenda on online automation.
