Writing in the wake of the breakup of the Soviet Union and Yugoslavia, the moral philosopher Bernard Williams considers the opposing claims of Rawlsian liberalism, with its emphasis on pluralism and procedural fairness, and communitarianism, which instead promotes more or less culturally homogeneous societies formed around shared values. Williams shares the communitarians’ critique of Rawls’s theory as excessively abstract, questioning whether a rational commitment to pluralism as the most just social arrangement can serve as a sufficiently binding social force. (...) He simultaneously resists, however, the conservative tendencies of the communitarians, particularly their dismissal of ethically motivated social critique. Grounded in the late philosophy of Wittgenstein, communitarians reject foundationalism, the notion that beliefs can be philosophically justified, instead regarding ideologically driven social arrangements as the result of inherently particular historical and environmental conditions. This perspective precludes rational reevaluation of a society’s status quo; if a society’s adoption of values does not depend on philosophically grounded principles, neither can those values be altered through a process of collective moral reasoning. For Williams, however, because pluralism is a condition of modern life with which even culturally homogenous communities must contend, members of modern societies are aware of alternatives to their own social model, leaving a space for self-critical reassessment. Finally, Williams suggests that the desire of cultural minorities for separate states in the post-Soviet geopolitical landscape underscores the limits of both pluralism and communitarianism, limits that all of us will need to grapple with as we confront the immediate social and political realities of modernity. Bertrand Russell said more than once that he was uncomfortable about a conflict, as he saw it, between two things: the strength of the conviction with which he held his ethical beliefs, and the philosophical opinions that he had about the status of those ethical beliefs—opinions which were non-cognitivist, and in some sense subjectivist. Russell felt that, in some way, if he did not think that his ethical beliefs were objective, he had no right to hold them so passionately. This (...) discomfort was not something that Ayer noted or discussed in his account of Russell's moral philosophy and ethical opinions, at least in the book that he wrote for the Modern Masters series . Perhaps this was because it was not a kind of discomfort that Ayer felt himself. His own philosophical views about the status of ethics were at all periods at any rate non-cognitivist, and I think that he did not mind them being called ‘subjectivist’. He did indeed argue that the supposed difference between objectivism and subjectivism in ethics did no work, and that philosophers who took themselves to be objectivists could not achieve anything more than those who admitted they were subjectivists. Ayer based this mainly on the idea that the claims made by objectivists for the factuality, objective truth, and so forth of moral judgments added nothing to those judgments—so far as moral conclusions were concerned, the objectivist was saying the same as the subjectivist but in a louder voice. Since the advent of behaviorism the question of volition or "will" has been largely neglected. We consider evidence indicating that two identical behaviors may be quite distinct with respect to volition: For instance, with practice the details of predictable actions become less and less voluntary, even if the behavior itself does not visibly change. Likewise, people can voluntarily imitate involuntary slips they have just made. Such examples suggest that the concept of volition applies not to visible behavior per se, but (...) to the control system that guides behavior. Involuntary events include both automatisms and counter voluntary actions such as slips . An adequate theory of voluntary control must account for the entire set of such pairs of voluntary/involuntary contrasts. The problem of volition highlights core psychological issues. Voluntary acts are consistent with one′s current dominant goals. Volition and consciousness are intimately related. Consciousness of an action seems to recruit unconscious resources that help in planning, executing, and monitoring a voluntary act. Conversely, losing conscious access to an action seems to produce a loss of voluntary control. However, voluntary actions are not wholly conscious. It appears that we only need conscious access to nonroutine choice-points in the flow of control; routine aspects are handled unconsciously. The goals that guide voluntary acts often encounter conflict, either from reality or from other goals, and emotions are widely believed to result from appraisals of such conflicts . Finally, there is a close connection between countervoluntary slips and the symptoms of clinical pathology, which involve a loss of voluntary control over speech, action, feeling, imagery, or thought. A modern version of William James′ ideomotor theory is proposed, based on Global Workspace theory . The theory shows how a conscious goal image could activate unconscious plans and automatisms that shape a voluntary act. Conscious feedback from the act serves to communicate success or failure to many unconscious routines, which may then adapt cooperatively to shape future actions. (shrink)

Despite the efforts of some modern Jewish law scholars, it is difficult to apply models of secular jurisprudence (whether positivist or Dworkinian) to the Jewish legal system. Internal analysis suggests that the “secondary rules” of the system are far too fragile. Rather, the system appears to privilege trust over objectively determinable truth. (But perhaps trust is a concept to which greater attention should be paid also in secular jurisprudence, as a legal realism informed by semiotics might maintain.) The practical (...) implications of this difference are here illustrated both from research on reform of Jewish marriage law and recent developments in the area of law and religion, in the wake of Archbishop Rowan Williams’ advocacy in 2008 of a model of “transformative accommodation”. The term “analogy” stands for a variety of methodological practices all related in one way or another to the idea of proportionality. We claim that in his first substantial contribution to electromagnetism James Clerk Maxwell developed a methodology of analogy which was completely new at the time or, to borrow John North’s expression, Maxwell’s methodology was a “newly contrived analogue”. In his initial response to Michael Faraday’s experimental researches in electromagnetism, Maxwell did not seek an analogy with some physical system (...) in a domain different from electromagnetism as advocated by William Thomson; rather, he constructed an entirely artificial one to suit his needs. Following North, we claim that the modification which Maxwell introduced to the methodology of analogy has not been properly appreciated. In view of our examination of the evidence, we argue that Maxwell gave a new meaning to analogy; in fact, it comes close to modeling in current usage. (shrink)

The Metaphysical Society was founded in 1869 at the instigation of James Knowles (editor of the Contemporary Review and then of the Nineteenth Century) with a view to "collect, arrange, and diffuse Knowledge (whether objective or subjective) of mental and moral phenomena" (first resolution of the Society in April 1869). The Society was a private club which gathered together a latter-day clerisy. Building on the tradition of the Cambridge Apostles, they elected talented members from across the Victorian intellectual spectrum: Bishops, (...) one Cardinal, philosophers, men of science, literary figures, and politicians. The Society included in its 62 members prominent figures such as T. H. Huxley, William Gladstone, Walter Bagehot, Henry Edward Manning, John Ruskin and Alfred Lord Tennyson. The papers they produced are key primary sources which shed new light on the ideas of their authors on the burning subjects of the day, ranging from the existence and personality of God to the nature of conscience or the existence of the soul. They are a legacy of a period when intellectuals were wondering how, and what, to believe in a time of social change, spiritual crisis, and scientific progress. The dissolution of the Society in 1880 did not diminish the value of the papers: they illustrate a tradition of private, open discussion among famous men of the most widely varying views; they offer detailed insight into the evolution of the relationships between different schools of Victorian scientific and religious thought; and they bring to light heretofore under-represented points of conflict and harmony. My purpose in this paper is to argue that we are not vulnerableto inescapable wrongdoing occasioned by tragic dilemmas. I directmy argument to those who are most inclined to accept tragicdilemmas: those of broadly Nietzschean inclination who reject``modern moral philosophy'''' in favor of the ethical ideas of theclassical Greeks. Two important features of their project are todeny the usefulness of the ``moral/nonmoral distinction,'''' and todeny that what are usually classified as moral reasons always oreven characteristically ``trump'''' nonmoral reasons in (...) anadmirable agent''s deliberations.I show critics of modern moral philosophy such as BernardWilliams that their acceptance of tragic dilemmas underminestheir project of denying the moral/nonmoral distinction and thepriority of moral reasons. The possibility of tragic dilemmasrequires an account of practical deliberation in which moralreasons appear as already in-force obligations, with blame andguilt ready to be invoked, while nonmoral reasons appear as merereasons. This makes moral reasons importantly different fromnonmoral reasons in how they achieve their deliberative weight,and also makes them characteristically weightier. Thus,accommodating tragic dilemmas reinforces the moral/nonmoraldistinction and the priority of moral reasons, the very thingsthese critics want to deny. By accepting the possibility oftragic dilemmas, these critics are undermining their own project.The standard normative theories are dead set against tragicdilemmas, and the critics of modern moral philosophy shouldreject tragic dilemmas for the good of their project. I examine recent work on moral dilemmas and argue that there are no moral dilemmas which issue in inescapable wrongdoing . In the first three chapters I examine some important arguments for and against tragic dilemmas---arguments from deontic logic, Martha Nussbaum's view that vulnerability is essential to human values, Bernard Williams' argument from guilt , and the argument from the fragmentation of value---and show that these arguments for and against are inconclusive. ;In Chapter 4 I attempt to provide a (...) reason to reject tragic dilemmas which will have force for those most inclined to accept dilemmas---those, such as Williams and Nussbaum, who are engaged in a critique of modern moral philosophy. Central to their critique is their denial of the distinction between moral and nonmoral reasons and of the primacy of the moral. I show that an account of practical deliberation which can accommodate the possibility of tragic dilemmas has the effect, not of undermining the distinction between moral and nonmoral reasons and the primacy of the moral, but of strengthening that distinction and that primacy. This is because a picture of practical deliberation which can accommodate the possibility of tragic dilemmas makes moral reasons distinct from nonmoral reasons in how they achieve their deliberative weight. ;In Chapter 5 I present an alternative picture of practical deliberation which I commend to these critics. In my alternative picture, moral reasons have deliberative weight for an agent for the same reason nonmoral reasons do: because the agent sees things from a point of view from which such reasons are important. My picture takes seriously the critics' view that moral value is continuous with other sorts of value and is not overriding and supremely regulative; but my picture does not accommodate the possibility of tragic dilemmas. I conclude that their project of criticizing modern moral philosophy is better served by accepting my picture and thus rejecting the possibility of tragic dilemmas. (shrink)

Topics include personal identity, various critiques of moral theory, practical reasoning and moral motivation, truth (...) and objectivity, and the relevance of ancient Greece to modern life. It not only positions Williams among these important philosophical topics, but also with regard to the views of other philosophers, including prominent forerunners such as Hume and Nietzsche and contemporary thinkers such as, Nagel, McDowell, MacIntyre and Taylor.
