Despite concerns about the relationships between health professionals and the medical device industry, the issue has received relatively little attention. Prevalence data are lacking; however, qualitative and survey research suggest device industry representatives, who are commonly present in clinical settings, play a key role in these relationships. Representatives, who are technical product specialists and not necessarily medically trained, may attend surgeries on a daily basis and be available to health professionals 24 hours a day, 7 days a week, to provide (...) advice. However, device representatives have a dual role: functioning as commissioned sales representatives at the same time as providing advice on approaches to treatment. This duality raises the concern that clinical decision-making may be unduly influenced by commercial imperatives. In this paper, we identify three key ethical concerns raised by the relationship between device representatives and health professionals: impacts on healthcare costs, the outsourcing of expertise and issues of accountability and informed consent. These ethical concerns can be addressed in part through clarifying the boundary between the support and sales aspects of the roles of device representatives and developing clear guidelines for device representatives providing support in clinical spaces. We suggest several policy options including hospital provision of expert support, formalising clinician conduct to eschew receipt of meals and payments from industry and establishing device registries. Social impact investing is transforming the availability of private capital for nonprofits and social enterprises, but demand is not yet meeting supply. This paper analyzes the perceived barriers faced by nonprofits in engaging with SII, arguing the need to assess differences using a policy field framework. Four parameters of a subsector are conceptualized as shaping participation in SII: the scale of investment required, embeddedness in place, the need for radical innovation, and the configuration of intermediaries. Based on 25 interviews with (...) leaders of nonprofits and intermediaries in affordable housing and community economic development in Canada, the study finds that significant barriers are a lack of knowledge of the market, inadequate financial literacy, and the challenges of measuring and valuing social impacts. In addition, nonprofits report that, in spite of the inherent importance of social impact in this form of investing, they currently make limited use of evaluation and impact metrics, and perceive that intermediaries and investors, particularly in affordable housing, still put a greater emphasis on financial over social returns. The development and deployment of medical devices, along with most areas of healthcare, has been significantly impacted by the COVID-19 pandemic. This has had variable ethical implications, two of which we will focus on here. First, medical device regulations have been rapidly amended to expedite approvals of devices ranging from face masks to ventilators. Although some regulators have issued cessation dates, there is inadequate discussion of triggers for exiting these crisis standards, and evidence that this may not be feasible. Given (...) the relatively low evidence standards currently required for regulatory approval of devices, this further indefinite reduction in standards raises serious ethical issues. Second, the pandemic has disrupted the usual operations of device representatives in hospitals, providing an opportunity to examine and refine this potentially ethically problematic practice. In this paper we explain and critically analyse the ethical implications of these two pandemic-related impacts on medical devices and propose suggestions for their management. These include an endpoint for pandemic-related adjustments to device regulation or a mechanism for continued refinement over time, together with a review of device research conducted under crisis conditions, support for the removal and replacement of emergency approved devices, and a review of device representative credentialling. Pursuing Justice in Africa focuses on the many actors pursuing many visions of justice across the African continent--their aspirations, divergent practices, and articulations of international and vernacular idioms of justice. The essays selected by editors Jessica Johnson and George H. Karekwaivanane engage with topics at the cutting edge of contemporary scholarship across a wide range of disciplines. These include activism, land tenure, international legal institutions, and post-conflict reconciliation. Building on recent work in sociolegal studies that foregrounds justice over and (...) above concepts such as human rights and legal pluralism, the contributors grapple with alternative approaches to the concept of justice and its relationships with law, morality, and rights. While the chapters are grounded in local experiences, they also attend to the ways in which national and international actors and processes influence, for better or worse, local experiences and understandings of justice. Loss aversion can occur in riskless and risky choices. We present novel evidence on both in a non-student sample (660 randomly selected customers of a car manufacturer). We measure loss aversion in riskless choice in endowment effect experiments within and between subjects and find similar levels of average loss aversion in both. The subjects of the within study also participate in a simple lottery choice task which arguably measures loss aversion in risky choices. We find substantial heterogeneity in both measures (...) of loss aversion. Loss aversion in riskless choice and loss aversion in risky choice are strongly positively correlated, but on average riskless loss aversion is higher than risky loss aversion. We find that in both choice tasks, loss aversion increases in age, income, and wealth, and decreases in education. Our results provide novel supportive input to the debate about the reality of loss aversion. (shrink)

Recent just war thought has tended to prioritize just cause among the moral criteria to be satisfied for resort to armed force, reducing the requirement of sovereign authority to a secondary, supporting role: such authority is to act in response to the establishment of just cause. By contrast, Aquinas and Luther, two benchmark figures in the development of Christian thought on just war, unambiguously gave priority to the requirement of sovereign authority as instituted by God to carry out the responsibilities (...) of ensuring a just and peaceful order in the world. On this conception it is the sovereign, in deciding whether to resort to armed force, who must make sure to satisfy the other moral requirements of the jus ad bellum. This paper examines Aquinas and Luther on sovereign authority for use of armed force. Recapturing the importance of this conception is important both for the proper understanding of just war tradition and for working out its implications for such contemporary issues as humanitarian intervention and "regime change.". This study aims to develop systems of belief revision in which acquisition of knowledge and interactive aspects of meaning are captured as a set of questions and answers with respect to an initial set of assumptions expressed in the object language. This process is performed by a progressive deployment of hypothetical insights contained in a context of interaction of information received by an agent. This study also gives the opportunity to express interactive aspects of meaning in semantics tableaux. And thus (...) highlights the notions of speech acts by the connection between tableaux and dialogues in the context of belief revision. (shrink)

Our article aims to show, on the one hand, the preeminence of the interactive paradigm as a determining element in the process of constitution of logical meaning and, on the other hand, to examine the contents of the linguistic expressions of pragmatic semantics. To do this, we expose three major figures of the logic of mathematical obedience in particular those of Gottfreid Leibniz, George Boole and Gottlob Frege. If this approach to mathematical logic has seen meritorious progress, it should be (...) pointed out that it does not favor the emphasis on epistemic and interactive aspects in the notions of logical consequences and inference. Our contribution is therefore to demonstrate that these weaknesses can be solved with the revolutionary approach of Robert Brandom based on the framework that promotes the interactive game of supply and demand of reasons. This analysis leads to the idea that interactive play is the basis of contemporary logical approaches. (shrink)

Porphyry’s position in the ancient hermeneutic tradition should be considered separately from his place in the Platonic tradition. He shows considerable respect for allegorizing interpreters with links to Pythagoreanism, particularly Numenius and Cronius, prominent sources in On the Cave of the Nymphs. The language of Homer’s Cave passage is demonstrably distinctive, resembling the Shield passage in the Iliad, and such as to suggest an ecphrasis to early imperial readers. Ecphrasis in turn suggested deeper significance for the story. While largely content (...) to follow Numenian trends in interpreting Homer’s cave symbolically and in relation to multiple belief-systems, Porphyry shows occasionally signs of wanting to adhere more closely to Homeric evidence, resorting to symbolic interpretation mainly when no more straightforward truth is on offer. This paper reviews current psychological theories of syllogistic inference and establishes that despite their various merits they all contain deficiencies as theories of performance. It presents the results of two experiments, one using syllogisms and the other using three-term series problems, designed to elucidate how the arrangement of terms within the premises affects performance. These data are used in the construction of a theory based on the hypothesis that reasoners construct mental models of the premises, formulate informative conclusions about the (...) relations in the model, and search for alternative models that are counterexamples to these conclusions. This theory, which has been implemented in several computer programs, predicts that two principal factors should affect performance: the figure of the premises, and the number of models that they call for. These predictions were confirmed by a third experiment. Dans cet article sont passées en revue les théories psychologiques du traitement des syllogismes. Chapter 8 argues against the view that the moral rightness of an act is not a reason to perform it, and our reasons are instead the features that make the act right. Philosophers typically defend this view by noting that it seems redundant to take rightness to be an additional reason, once it has been acknowledged that the right-making features are already reasons. The author shows that this argument dramatically overgeneralizes, ruling out all cases in which two or more reasons (...) are arranged in relationships of metaphysical constitution. She then proposes an alternative way of thinking about these metaphysical hierarchies: Rather than assuming that at most one of the facts in each hierarchy is the “real” reason, bearing all the normative weight, it should be accepted that these facts can all be genuine reasons, whose normative weight is shared in virtue of the metaphysical relationships between them. Some tests are offered that can be used to determine which facts occur in metaphysical hierarchies with shared weight, and it is argued that the fact that an act is morally right passes the tests. The author then explains what she takes to be some kernels of truth underlying the redundancy argument, arguing that these phenomena are pragmatic, not metaphysical. (shrink)

What is it that we are doing when we make ethical claims and judgments, such as the claim that we morally ought to assist refugees? This dissertation introduces and defends a novel theory of ethical thought and discourse. I begin by identifying the surface features of ethical thought and discourse to be explained, including the realist and cognitivist (i.e. belief-like) appearance of ethical judgments, and the apparent close connection between making a sincere ethical judgment and being motivated to act on (...) it. I examine prominent attempts to explain these features, with a focus on recent ‘hybrid’ theories combining elements of expressivism and cognitivism. Despite their initial promise, I argue that extant hybrid theories are nevertheless committed to problematic semantic, metasemantic, or pragmatic assumptions. I then discuss what I take to be the strongest existing option, ethical neo-expressivism (Bar-On and Chrisman, 2009; Bar-On, Chrisman, and Sias, 2014), and develop it into an explicitly hybrid theory proposing that ethical judgments incorporate both motivationally-charged affective states and moral beliefs. I then supplement this account with a theory of the proper function (following Millikan, 1984) of ethical claims and judgments, arguing that they function simultaneously to track the morally salient features of social situations, and to coordinate our behavior around these features. Finally, I defend one of the cognitivist commitments of the theory – namely, that objective moral knowledge is possible – by applying recent work on the epistemology of fundamental or ‘core’ intellectual commitments (Lynch, 2012; Pritchard, 2016) to the moral realm. Current methods of forensic DNA profiling, based on Polymerase Chain Reaction amplifications of a varying number of Short Tandem Repeat loci found at different locations on the human genome, are regularly described as constituting the “gold standard for identification” in contemporary society. At a time when criminal justice systems in Europe and North America increasingly seek to utilize the epistemic authority of a variety of sciences in support of the apprehension and prosecution of suspects and offenders, genetic science and recombinant (...) DNA technology are often singled out for particular approbation. Indeed, the development and application of DNA profiling has been widely described as the “greatest breakthrough in forensic science since fingerprinting.”. (shrink)

Studies with captive fowl have revealed that they possess greater cognitive capacities than previously thought. We now know that fowl have sophisticated cognitive and communicative skills, which had hitherto been associated only with certain primates. Several theories have been advanced to explain the evolution of such complex behavior. Central to these theories is the enlargement of the brain in species with greater mental capacities. Fowl present us with a conundrum, however, because they show the behaviors anticipated by the theories but (...) do not have the expected changes in the brain. Consequently fowl present two challenges of interest to us here. One is a scientific challenge to explain their remarkable capabilities. The other is an ethical challenge regarding our treatment of animals with higher cognitive skills. (shrink)

This paper is an exercise in intellectual history, an attempt to understand how a specific term—”informal logic”— came to be interpreted in so many different ways. I trace the emergence and development of “informal logic” to help explain the many different meanings, how they emerged and how they are related. This paper is also, to some degree, an account of a movement that developed outside the mainstream of philosophy, whose origins lie in a desire to make logic useful (echoing Dewey).
