Basil Bernstein rarely had a good press in the forty-odd years in which he presented his developing theories to the public. Early admiration for his sociolinguistic 'discoveries' - of codes which regulate, at a deep-structural level, family beliefs and behaviours and relationships, as well as surface utterances - turned quite quickly into a suspicion that his description of social class difference amounted to a declaration of working class deficit. Although Bernstein's writings, particularly in the 1990s, became opaque to the (...) point of seeming to be purposefully obscurantist, they have always been enlivened by clear, pithy and punchy statements which left no room for ambiguity about the case he was making. The struggle to achieve an education system which would offer genuinely equal opportunities to children from all class and cultural backgrounds continued to underpin the writing and teaching of his later years. Our thesis is that there is no moral requirement to refrain from emitting reasonable amounts of greenhouse gases solely in order to enjoy oneself. Joyriding in a gas guzzler provides our paradigm example. We first distinguish this claim that there is no moral requirement to refrain from joyguzzling from other more radical claims. We then review several different proposed objections to our view. These include: the claim that joyguzzling exemplifies a vice, causes or contributes to harm, has negative expected value, (...) exceeds our fair share of global emissions, and undermines political duties. We show why none of these objections succeeds and conclude that no good reason has yet been proposed that shows why joyguzzling violates a moral requirement. (shrink)

Many people argue that we should practice conscientious consumption. Faced with goods from gravely flawed production processes, such as wood from clear-cut rainforests or electronics containing conflict minerals, they argue that we should enact personal policies to routinely shun tainted goods and select pure goods. However, consumers typically should be relatively uncertain about which flaws in global supply chains are grave and the connection of purchases to those grave flaws. The threat of significant uncertainty makes conscientious consumption appear to be (...) no better, or even worse, than an overlooked option. This overlooked option is consumption with relinquishment: disregarding each product’s possible connections with upstream grave flaws and using the time, money, and energy saved in this way to address grave flaws directly. Dale Jamieson has claimed that conventional human-directed ethical concepts are an inadequate means for accurately understanding our duty to respond to climate change. Furthermore, he suggests that a responsibility to respect nature can instead provide the appropriate framework with which to understand such a duty. Stephen Gardiner has responded by claiming that climate change is a clear case of ethical responsibility, but the failure of institutions to respond to it creates a (not unprecedented) political problem. In assessing the debate between (...) Gardiner and Jamieson, I develop an analysis which shows a three-part structure to the problem of climate change, in which the problem Gardiner identifies is only one of three sub-problems of climate change. This analysis highlights difficulties with Jamieson’s argument that the duty of respect for nature is necessary for a full understanding of climate ethics, and suggests how a human-directed approach based on the three-part analysis can avoid Jamieson’s charge of inadequacy. People with bad beliefs — roughly beliefs that conflict with those of the relevant experts and are maintained regardless of counter-evidence — are often cast as bad believers. Such beliefs are seen to be the result of, e.g., motivated or biased cognition and believers are judged to be epistemically irrational and blameworthy in holding them. Here I develop a novel framework to explain why people form bad beliefs. People with bad beliefs follow the social epistemic norms guiding how agents are (...) supposed to form and share beliefs within their respective communities. Beliefs go bad because these norms aren’t reliably knowledge-conducive. In other words, bad beliefs aren’t due to bad believers but due bad social epistemic norms. The framework also unifies different explanations of bad beliefs, is testable and provides distinct interventions to combat such beliefs. The framework also helps to capture the complex and often contextual normative landscape surrounding bad beliefs more adequately. On this picture, it’s primarily groups that are to be blamed for bad beliefs. I also suggest that some individuals will be blameless for forming their beliefs in line with their group’s norms, whereas others won’t be. And I draw attention to the factors that influence blameworthiness-judgements in these contexts. (shrink)

Although panpsychism has had a very long history, one that goes back to the very origin of western philosophy, its force has only recently been appreciated by analytic philosophers of mind. And even if many still reject the theory as utterly absurd, others have argued that it is the only genuine form of physicalism. This paper examines the case for panpsychism and argues that there are at least goodprima faciereasons for taking it seriously. In a second step, the paper discusses (...) the main difficulty the theory has to face, the ‘composition problem’. This is the problem of explaining how the primitive experiences that are supposed to exist at the ultimate level of reality could give rise to the unified experience of a human being. What assumptions as to the nature of experience generate the composition problem? Is mental composition impossible in principle or do we simply lack at present any understanding of phenomenal parts and wholes? (shrink)

Many suggest that we should look backward and measure the differences among various parties' past emissions of greenhouse gases to allocate moral responsibility to remedy climate change. Such backward-looking approaches face two key objections: that previous emitters were unaware of the consequences of their actions, and that the emitters who should be held responsible have disappeared. I assess several arguments that try to counter these objections: the argument from strict liability, arguments that the beneficiary of harmful or unjust emissions should (...) pay, and arguments from distributive justice. I argue that none of these successfully justify a backward-looking approach to the temporally remote portion of the climate burden. (shrink)

Mainstream cognitive neuroscience typically ignores the role of quantum physical effects in the neural processes underlying cogni¬tion and consciousness. However, many unsolved problems remain, suggesting the need to consider new approaches. We propose that quantum theory, especially through an ontological interpretation due to Bohm and Hiley, provides a fruitful framework for addressing the neural correlates of cognition and consciousness. In particular, the ontological interpretation suggests that a novel type of 'active information', connected with a novel type of 'quantum potential energy', (...) plays a key role in quantum physical processes. After introducing the ontological interpretation we illustrate its value for cognitive neuroscience by discussing it in the light of a proposal by Beck and Eccles about how quantum tunneling could play a role in controlling the frequency of synaptic exocytosis. In this proposal, quantum tunneling would enable the 'self' to control its brain without violating the energy conservation law. We argue that the ontological interpretation provides a sharper picture of what actually could be taking place in quantum tunneling in general and in synaptic exocytosis in particular. Based on the notions of active information and quantum potential energy, we propose a coherent way of understanding how mental processes (understood as involving non-classical physical processes) can act on traditional, classically describable neural processes without violating the energy conservation law. In this paper, the aim is to explore how there can be a role for expression of affect in illocution, drawing upon some ideas about expression put forward by Karl Bühler. In a first part of the paper, I map some active discussions and open questions surrounding phenomena that seem to involve “expression of affect”. Second, I home in on a smaller piece of that larger puzzle; namely, a consideration of how there may be non-conventional expression of affect. I provide (...) some examples of what I take that to involve and set out some premises for approaching it. In a third section, I motivate such an interest by pointing to a question in speech act theory concerning ‘force conventionalism’. This is whether and how illocution can be performed non-conventionally—that is, whether (at least some) utterances can be communicated with illocutionary force without need of convention. I propose that where expression of affect may occur non-conventionally, it may in turn constitute one important route through which at least some kinds of illocution are achieved. In the fourth part of the paper, I sketch an account of such non-conventional expression of affect for the purposes of illocution, by exploring a broadly Bühlerian account of some affects; namely, that some affects are teleological in character, that coordinations may be involved in their satisfactional states, and that uptake of the expressed affect constitutes one subset of such satisfactional states. That exposition points to the contemporary relevance of the “action theory of expression” proposed by Bühler. (shrink)

This book represents part of an ongoing effort to understand the rules, practices, agencies and agents which shape and change the social construction of pedagogic discourse. It draws together and re-examines the findings of the author's earlier work.

A shared narrative in the literature on the evolution of cooperation maintains that social _learning_ evolves early to allow for the transmission of cumulative culture. Social _norms_, whilst present at the outset, only rise to prominence later on, mainly to stabilise cooperation against the threat of defection. In contrast, I argue that once we consider insights from social epistemology, an expansion of this narrative presents itself: An interesting kind of social norm — an epistemic coordination norm — was operative in (...) early and important instances of specialised social learning. I show how there’s a need for such norms in two key social learning strategies and explain how this need is constituted. In assessor-teaching (e.g. Castro et al., 2019b, 2021), epistemic coordination norms allow agents to coordinate around the _content_ of social learning, i.e., what is to be known and how this is to be done. These norms also allow agents to coordinate around the form of cultural learning in what’s sometimes called strategic social learning (Laland, 2004; Hoppitt & Laland, 2013; Heyes, 2018, Chap. 5) and elsewhere. Broadly speaking, this concerns how cultural learning is organised within the social group. The upshot is that the evolution of social learning and social norms are intertwined in important and underappreciated ways from early on. The above matters as it informs our views about the evolution of social norms more generally. Truly _social_ norms emerged to coordinate a plurality of complex behaviours and interactions, amongst them specialised social learning. I substantiate this view by contrasting it with Jonathan Birch’s views on the evolution of norms. What results is a general but cohesive narrative on the early evolution of social norms. (shrink)

Robert Nozick famously asks us whether we would plug in to an experience machine, or whether we would insist upon ‘living in contact with reality’. Felipe De Brigard, after conducting a series of empirical ‘inverted’ experience machine studies, suggests that this is a false dilemma. Rather, he says, ’…the fact is that people tend to prefer the state of affairs they are in currently,’ or the status quo. In this paper, I argue that these studies are a test case for (...) ‘experimental philosophy’ as such. Specifically, I argue that De Brigard offers a series of faulty studies, and so, reaches unfounded conclusions. More generally, I argue that certain philosophical thought experiments cannot be tested empirically at all, and this limits what experimental philosophy can do. (shrink)

The General Data Protection Regulation is a European Union regulation that will replace the existing Data Protection Directive on 25 May 2018. The most significant change is a huge increase in the maximum fine that can be levied for breaches of the regulation. Yet fewer than half of UK companies are fully aware of GDPR—and a number of those who were preparing for it stopped doing so when the Brexit vote was announced. A last-minute rush to become compliant is therefore (...) expected, and numerous companies are starting to offer advice, checklists and consultancy on how to comply with GDPR. In such an environment, artificial intelligence technologies ought to be able to assist by providing best advice; asking all and only the relevant questions; monitoring activities; and carrying out assessments. The paper considers four areas of GDPR compliance where rule based technologies and/or machine learning techniques may be relevant: Following compliance checklists and codes of conduct; Supporting risk assessments; Complying with the new regulations regarding technologies that perform automatic profiling; Complying with the new regulations concerning recognising and reporting breaches of security. It concludes that AI technology can support each of these four areas. The requirements that GDPR state for explanation and justification of reasoning imply that rule-based approaches are likely to be more helpful than machine learning approaches. However, there may be good business reasons to take a different approach in some circumstances. (shrink)

This paper explores how Wundt’s and Bühler’s respective conceptions of gestural expression have implications for how each conceives of what, in broad terms, may be understood as a ‘grammar of gestures’: that is, the rules for the formation and performance of gestures with and without speech. Unlike previous scholarship that has looked at the relationship of Wundt and Bühler, the aim here will be to give particular attention to the relevance of their respective accounts for current philosophical and linguistic research (...) on gesture. Building off of Bühler, we can offer an alternative to the psychologistic and solipsistic model of gestural expression that can be found in Wundt and that seems to be resurgent today in work by McNeil and others. Via Bühler’s notions of diacrisis and of the underlying functions that guide human communication, we propose an understanding of the relationship between gestures and speech that aims to render accurately both the highly contextualised and the highly structured conditions of their mutual employment. Summary Liberals, from Mill to Rawls see personal autonomy as paramount in civil society. They see human dignity to consist essentially in personal autonomy, that is, ?in the ability of each person to determine for himself or herself a view of the good life? (Taylor, C. (1992) p. 27). Multiculturalism and ?The Politics of Recognition? p. 57 (Princeton, Princeton University Press). This emphasis on personal autonomy underlies much of liberal emphasis on freedom of conscience, justice, rights and fairness. Its core (...) thesis is that a just society seeks not to promote any particular view of the good life, but enables its citizens to pursue their own ends consistent with a similar liberty for all others. Yet, when some citizens in America attempted to pursue their own view of the good life, they came up against head?on conflict with the liberal state. These groups saw civic education with its emphasis on individual choice, on reflecting and weighing of alternative viewpoints and on personal autonomy, as threatening to their way of life and to their fundamental religious beliefs, and consequently they challenged the state in the courts. What ensued raised profound educational problems for educating children, parental rights, and the right of the State in a liberal democratic society, which are discussed in this paper. (shrink)

Philosophical work on the concept of consent in the past few decades has got to grips with it as a rich notion. We are increasingly sensitive to consent not as a momentary, atomic, transactional thing, but as a complex idea admitting of various qualities and dimensions. In this paper we note that the recognition of this complexity demands a theoretical framework quite different to those presently extant, and we suggest that the enactive approach is one which offers significant value in (...) this regard. In consonance with arguments made by Laurie Penny about how consent is a continuous and dynamic process, we outline how an enactive approach identifies consent as temporally extended (rather than momentarily transactional), and as affected by the skilfulness of the agents involved, the fitness of community provided resources to negotiate the consensual relationship over time, and the unfolding of circumstances in the situation in which the joint action is taking place. We argue that the value of an enactive perspective on consent is in highlighting these complexities, and providing resources to articulate and theorise them in ways that are not open to other current approaches. The massive acoustic redundancy of minimally contrasting speech sounds, coupled with the auditory integration of psychoacoustically similar acoustic properties produces a highly invariant percept, which cannot be improved by top-down feedback from the lexicon. Contextual effects are also bottom-up but not all entirely auditory and may thus differ in whether they affect sensitivity or only response bias.

The success of political efforts to create a more open economy in Brazil over the past decade has depended crucially on support from the industrial sector, which long enjoyed the benefits of protection by the state from economic competition. Why businesses previously so sheltered would back neoliberal reform, and why opposition arose at times from sectors least threatened by free trade, are the puzzles this book seeks to answer. Drawing on more than one hundred interviews with industrialists and business association (...) representatives, as well as a wide range of other sources, Peter Kingstone argues that the key to understanding the behavior of industrialists lies in the impact of four factors on their preferences for reform: the effect of economic crisis on industrialists' perception of the viability of the earlier development model; the sectoral location of their firms in the economy and the advantages historically accruing therefrom; the adjustment options available to them given their position in the market; and the credibility of the government's promises about reform and its tactical choices for getting them implemented through the political system. The mix of these four factors, Kingstone shows, left business preferences relatively malleable and thus available for support of reform, even in the face of potentially high costs. Whether such support was forthcoming depended on industrialists' perceptions of the ability of government leaders to deliver on their promises. Widespread resistance to reform occurred when leaders lost their credibility. Under Fernando Collor's leadership, that credibility was never recovered; under Fernando Henrique Cardoso's, it was recovered through increasing concessions to industrialists on the character of the reform program.
