The posthumous retrieval and use of gametes is socially, ethically, and legally controversial. In the countries that do not prohibit the practice, posthumous assisted reproduction is usually permitted only at the request of the surviving spouse and only when the deceased left written consent. This paper presents the recommendations of an ethics committee established by the Israeli Fertility Association. In its discussions, the committee addressed the ethical considerations of posthumous use of sperm—even in the absence of written consent from the (...) deceased—at the request of either the spouse or the deceased’s parents who wish to become the offspring’s parents or grandparents. It is concluded that under certain conditions, a request by the deceased’s parents to posthumously use the deceased’s sperm is justified and should be granted. (shrink)

La conciencia de ser y estar libres, depende de la autonomía de una voluntad para decidir y del deseo para elegir el sentido que debe orientar la vida en su presente y proyección futura. Niños y niñas estimulados con experiencias de este tipo, podrán llegar a ser ciudadanos y ciudadanas capaces de lograr la transformación de la sociedad desde una justicia, bien, equidad y paz, compartida por todos. En este trabajo se propone la interpretación de cuatro movimientos alternativos para repensar las ciencias sociales desde una episteme liberadora desde el Sur. Se trata, también, además de repensar, por supuesto, de recrear a partir de la filosofía inter- cultural, el otro logos científico del pensamiento socio-político latinoamericano. Para lograr estos fines, las alternativas se conciben a partir de: i) un proyecto epistémico que de cabida a la investigación complejaya la formación transdisciplinar de investigadores; ii) un proyecto ético que permita (...) fundar valores de convivencia pública y derechos de paz entre hombre y naturaleza; iii) un proyecto político que permita el desarrollo de estados interculturales a favor de la pluralidad de las identidades ciudadanas; y, finalmente, iv) un proyecto económico que parta de la crítica a la producción tecno-científica del consumo, a la vez que justifica el desarrollo de una economía de bienes necesarios. En este tiempo de crisis de los modelos de la racionalidad cartesiana, es en América Latina donde las praxis alternativas hacen posible descubrir esos orígenes insurgentes de la emancipación frente a la decolonialidad. Trata das possibilidades de uma teologia ecumênica das religiões tendo como eixo articulador a preocupação pela paz, pela justiça e pela integridade da criação. O objetivo é analisar temas de destaque para o cenário das análises sociais e teológicas como: a) O valor do humano e da ética social para o diálogo interreligioso, b) As possibilidades de uma unidade aberta, convidativa e integradora no âmbito das religiões; c) A importância pública das religiões; d) As religiões como códigos de comunicação; e) (...) O poder do império e o poder do diálogo das religiões. Para isso, vamos contar com as contribuições de Hans Küng, Jürgen Moltmann, Julio de Santa Ana, Xavier Pikaza e José Comblin respectivamente. A proposição é que a perspectiva ecumênica, uma vez articulada com as dimensões sociais, políticas, econômicas e culturais, dentro dos variados contextos históricos, pode oferecer densidade e amplitude para a reflexão teológica. Os esforços que valorizam a capacidade de diálogo e de sensibilidade ecumênica e aqueles que destacam a importância pública das religiões partem da concepção de que a perspectiva ecumênica, tanto em nível prático quanto em nível teórico-metodológico, requer e possibilita uma compreensão mais apurada da realidade, um aperfeiçoamento de visões dialógicas e o cultivo de maior sensibilidade para a valorização da vida e para a promoção da paz e da justiça. Ecumenismo.This paper focus on the possibilities of an ecumenical theology of religions, having as a its principal concern peace, justice and integrity of creation. It aims to analyze some central issues for the social and theological scenario, such as: a) humanity and social ethics for interreligious dialogue; b) the possibilities for an open, engaging and inviting interreligious unity; c) the public relevance of religions; d) religions as communicating codes; e) the imperial powers and the power of religious dialogue. We will take into account the contributions of Hans Küng, Jürgen Moltmann, Julio de Santa Ana, Xavier Pikaza and José Comblin. The study affirms that the ecumenical perspective, once articulated to social, political, economic and cultural dimensions, within the various theological contexts, can offer density and extension for the theological reflection. Efforts that value the capacity for dialogue and ecumenical sensibility and those that highlight the public importance of religions start from the conception that the ecumenical perspective, both in the practical and in the theoretical-methodological levels, requests and makes it possible for a deeper comprehension of the reality, an improvement of dialogic visions and the cultivation of more expressions of sensibility for the valorization of life and for the promotion of peace and justice. Causal approaches to explanation often assume that a model explains by describing features that make a difference regarding the phenomenon. Chirimuuta claims that this idea can be also used to understand non-causal explanation in computational neuroscience. She argues that mathematical principles that figure in efficient coding explanations are non-causal difference-makers. Although these principles cannot be causally altered, efficient coding models can be used to show how would the phenomenon change if the principles were modified in counterpossible situations. The problem is (...) that efficient coding models also involve difference-makers that, prima facie, cannot be characterized as non-causal in this sense. Mathematical principles always involve variables which have counterfactual relations between them. However, we cannot simply assume that these difference-makers are causal. They can also be found in paradigmatic non-causal explanations and therefore they must be characterized as non-causal in some sense. I argue that, despite appearances, Chirimuuta's view can be applied to these cases. The mentioned counterfactual relations presuppose the counterpossible conditionals that describe the modification of a relevant mathematical principle. If these conditionals are the hallmark of non-causal relations, then Chirimuuta’s criterion has the desired implication that variables in mathematical principles are non-causal difference-makers. This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

It is relevant to interpret the perception that students with disabilities, teachers, and managers have about an inclusive educational program, to identify and describe the facilitators and barriers during the training of those students; analyze the relevance of the inclusive program from the perceptions of the participating actors; and assess the program's supports from the perception of students with disabilities. This is a mixed investigation of sequential design and phenomenological approach carried out through surveys and in-depth interviews with the actors.

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. It is widely known that the main figures we target worked in different areas, which is a first piece of evidence for the plausibility of our main thesis. (shrink)

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. In the present article, we attempt to elucidate the conceptual rela- tionship between censorship and emotional development. We employ a framework from emotion regulation studies in order to clarify how censorship works and to ex- plain why it cannot affect emotional development in the same way as the remaining types of emotional regulation. Nevertheless, we argue that, by focusing on Plato’s ac- count of censorship, and specifically of its sociocultural function, one can find that it is not a useless device (...) for emotional development. Censorship affects relevant variables in the dynamics of contraposed emotional processes that compete for dominance. (shrink)

Much of the focus on Poincaré’s philosophy of science has been on the notion of convention, a crucial concept that has become distinctive of his position. However, other notions have received much less attention. That is the case of verifiable hypotheses. This kind of hypotheses seems to be constituted from the generalization of several observable facts. So, in order to understand what these hypotheses are, we need to know what a fact to Poincaré is. He divides facts into brute and (...) scientific facts. The characterization of this duality is not trivial at all, and leads us to the following questions that we will discuss in this paper: which the part of construction that exists in a scientific fact and which the part of translation, that is, what remains from the brute fact in the scientific one?; and when we conceive a generalized hypothesis, are we supposed to do it from scientific or from brute facts? The clarification of these questions could lead to distinguish the part of construction and the part of translation in the first steps of science, which is essential to get a better understanding of Poincaré’s conception of science. El presente trabajo analiza los sentidos que profesionales de la enfermería y el trabajo social elaboran acerca de sus prácticas de atención de la salud de la población travesti y trans. Se analiza un corpus de entrevistas en profundidad a enfermeras y trabajadoras sociales que se desempeñan en los partidos de José C. Paz, San Miguel y Malvinas Argentinas (Provincia de Buenos Aires, Argentina). Las entrevistas son analizadas en base a cuatro ejes analíticos: (a) las características que asume el encuentro (...) con la población trans; (b) las percepciones acerca de las barreras de acceso a la salud de dicha población; (c) las acciones desarrolladas para promover su acceso a la salud; y (d) los aspectos propios de la enfermería y el trabajo social que favorecen la atención de la salud de la población travesti y trans. En base a dichos ejes, se exploran una serie de hipótesis acerca de las potencialidades y desafíos que la enfermería y el trabajo social enfrentan para promover el acceso a la salud de la población travesti y trans en el marco de la Ley 26.743 de Identidad de Género. The controversy between Euclidean and non-Euclidean geometry arose new philosophical and scientific insights which were relevant to the later development of natural science. Here we want to consider Poincaré and Helmholtz’s positions as two of the most important and original ones who contributed to the subsequent development of the epistemology of natural sciences. Based in these conceptions, we will show that the role of philosophy is still important for some aspects of science.

Este artículo comenta una conferencia de Louis de Broglie de 1952 en la que se replantea sus ideas iniciales sobre la mecánica cuántica. Defenderemos la tesis de que, en ese trabajo, pese a la referencia al indeterminismo, el objetivo del físico francés es presentar una interpretación causal de esta teoría y no poner de manifiesto su indeterminismo. Así, analizaremos la noción de causalidad que presenta con el objetivo de separarla del determinismo. Estructuraremos la noción presentada por de Broglie en tres (...) partes y la conexión entre las mismas. Para separar causalidad de determinismo utilizaremos una definición no restrictiva de esta noción y presentaremos los problemas que tiene la noción de causalidad utilizada por de Broglie. Finalmente, defenderemos una interpretación de las ideas de de Broglie más como una concepción filosófica que científica y ofreceremos alternativas filosóficas a la misma. (shrink)

The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

Muita da literatura sobre a filosofia da ciência de Poincaré tem estado focada na noção de convenção, um conceito crucial que identifica a sua posição. No entanto, há outras noções que têm recebido menos atenção. Este é o caso das hipóteses verificáveis. Este tipo de hipótese parece ser constituído a partir da generalização de vários fatos observáveis. Assim, para compreender o que são estas hipóteses, temos de saber o que é um fato para Poincaré. Ele divide fatos em brutos e (...) científicos. A caracterização desta dualidade não é de tudo trivial, e nos leva às seguintes questões que discutiremos neste artigo: (1) qual a parte de construção que existe num fato científico e qual a parte de tradução? Isto é, o que permanece do fato bruto no fato científico? E (2) quando concebemos uma hipótese generalizada, a generalização é feita a partir dos fatos científicos ou dos fatos brutos? A clarificação destas questões pode levar a distinguir a parte de construção e a parte de tradução desde os primeiros passos da ciência, o que é essencial para conseguir uma melhor compreensão da concepção de ciência de Poincaré. Poincaré’s conventionalism has been interpreted in many writings as a philosophical position emerged by reflection on certain scientific problems, such as the applicability of geometry to physical space or the status of certain scientific principles. In this paper I would like to consider conventionalism as a philosophical position that emerged from Poincaré’s scientific practice. But not so much from dealing with scientific problems, as from the use of two specific methodologies proper to modern mathematics and the modern natural sciences: methodological (...) structuralism and the hypothetical-deductive method—thus, as a philosophical position which emerged from a way (or rather, two ways) ofdoingscience. With this approach, I try to deepen the analysis of connections between Poincaré’s scientific practice and his philosophy. (shrink)
