The experiments Feldman and Levin suggest do not definitively test their proposed solution to the problem of selecting muscle activations. Their test of the movement directions that elicit EMG activity can be interpreted without regard to the form of the central commands, and their fast elbow flexion test is based on a forward computation that obscures the insensitivity of the predicted trajectory to the details of the putative commands.

In this long-awaited book, Antony Duff offers a new perspective on the structures of criminal law and criminal liability. His starting point is a distinction between responsibility (understood as answerability) and liability, and a conception of responsibility as relational and practice-based. This focus on responsibility, as a matter of being answerable to those who have the standing to call one to account, throws new light on a range of questions in criminal law theory: on the question of criminalisation, which (...) can now be cast as the question of what we should have to answer for, and to whom, under the threat of criminal conviction and punishment; on questions about the criminal trial, as a process through which defendants are called to answer, and about the conditions (bars to trial) given which a trial would be illegitimate; on questions about the structure of offences, the distinction between offences and defences, and the phenomena of strict liability and strict responsibility; and on questions about the structures of criminal defences. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution through which a liberal polity defines a realm of public wrongdoing, and calls those who perpetrate (or are accused of perpetrating) such wrongs to account. This introduction presents an overview of key concepts discussed in this book, which focuses on how citizenship is addressed in the context of education or, more specifically, learning, which is understood as central to the government of individuals and societies in Europe. Educational research has provided numerous critical responses to the citizenship education introduced in the UK and elsewhere. Governance is a form of governing commensurate with the decentralisation associated with neoliberalism, but articulated in terms of transparency, accountability, and social (...) justice in accordance with Third Way thinking. The concern with voice, narrative, and accounting for oneself in the name of democracy and social justice has become central to the discourses and practices of citizenship in the learning society. The active way in which individuals are asked to relate to their European heritage is measured as a form of participation, and therefore contributes evidence of active citizenship. (shrink)

The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. In a series of influential articles, Rae Langton has argued that Austinian speech-act theory can illuminate the way in which pornography contributes to the subordination of women. I will argue that Langton’s application of Austin is incorrect. In earlier work, I have argued against Langton’s view on the grounds that being subordinated is not the sort of condition that can be brought about through an illocutionary act. In this paper, however, I will set aside that objection and focus instead on (...) Langton’s claims about the type of illocutionary act pornography might be. I will argue, first, that Langton cannot say what she wants to say about the content of pornography and still have it that pornography is a verdictive or exercitive speech act, in Austin’s sense. Verdictive and exercitive speech acts do not, and cannot describe the states of affairs they bring about. Second, I will argue that pornography does not in any case satisfy the conditions necessary for a speech act to be verdictive or exercitive. Specifically, there do not exist accepted background conventions that would give the pornographer authority to render verdicts or to take executive action. This objection to Langton’s view has been made before; I’ll show that her response to the objection betrays a confusion of authority with power. (shrink)

The present article commences analyzing the origins and influences of the religious discourse on the configuration of the modern constitutional discourse and the contributions of the jus-positivism in the consolidation of this sacred-civil language. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. In ”Embodiment and Epistemology,” Louise Antony considers a kind of ”Cartesian epistemology” according to which, so far as knowing goes, knowers could be completely disembodied, that is, pure Cartesian egos. Antony examines a number of recent challenges to Cartesian epistemology, particularly challenges from feminist epistemology. She contends that we might have good reason to think that theorizing about knowledge can be influenced by features of our embodiment, even if we lack reason to suppose that knowing itself varies relative (...) to such features. She also argues that a masculinist bias can result in mishandling of cognitive differences in cases where they actually exist and she examines a number of the ways in which the maleness of philosophy has, according to feminists, distorted epistemology. Even if a Cartesian approach offers one indispensable part of a comprehensive epistemology, according to Antony, we still need an epistemology that answers questions raised by our everyday, embodied lives. Social scientists have paid insufficient attention to the role of law in constituting the economic institutions of capitalism. Part of this neglect emanates from inadequate conceptions of the nature of law itself. Spontaneous conceptions of law and property rights that downplay the role of the state are criticized here, because they typically assume relatively small numbers of agents and underplay the complexity and uncertainty in developed capitalist systems. In developed capitalist economies, law is sustained through interaction between private agents, courts (...) and the legislative apparatus. Law is also a key institution for overcoming contracting uncertainties. It is furthermore a part of the power structure of society, and a major means by which power is exercised. This argument is illustrated by considering institutions such as property and the firm. Complex systems of law have played a crucial role in capitalist development and are also vital for developing economies. (shrink)

Given Locke’s views on primary and secondary qualities, it seems he is committed to there being real underlying properties in objects, the arrangement and disposition of which underlies and produces the observed properties of that object. It might be natural to think that these primary qualities provide a general system for classifying objects into classes: that we could delineate the real kinds of objects in nature by looking at what their real primary qualities were. A list of the particular qualities (...) of some object would define that object perfectly precisely; by looking at which properties were shared or divergent between this object and others, we group the object with others in the same kind. These real kinds in nature can play several important theoretical roles. They can support real scientific understanding, including inductive inferences (iof things are of the same real kind, then observed properties of one support the inference to unobserved properties of the other); they can form the basis for our judgements about the powers and capacities of particular objects, based on the what other things of that type can do; and these real kinds can provide the meanings for general terms: the thought being that the meanings of class names are empty without real classes to which they correspond. Rather than entailing that a particular outcome will occur, many scientific theories only entail that an outcome will occur with a certain probability. Because scientific evidence inevitably falls short of conclusive proof, when choosing between different theories it is standard to make reference to how probable the various options are in light of the evidence. A full understanding of probability in science needs to address both the role of probabilities in theories, or chances, as well as the role of probabilistic (...) judgment in theory choice. In this chapter, the author introduces and distinguishes the two sorts of probability from one another and attempt to offer a satisfactory characterization of how the different uses for probability in science are to be understood. Reasoning from inconclusive evidence, or ‘induction’, is central to science and any applications we make of it. For that reason alone it demands the attention of philosophers of science. This Element explores the prospects of using probability theory to provide an inductive logic, a framework for representing evidential support. Constraints on the ideal evaluation of hypotheses suggest that overall support for a hypothesis is represented by its probability in light of the total evidence, and incremental support, or confirmation, indicated by (...) an increased probability given the evidence than otherwise. This proposal is shown to have the capacity to reconstruct many canons of the scientific method and inductive inference. Along the way, significant objections are discussed, such as the challenge from inductive scepticism and the objection that the probabilistic approach makes evidential support arbitrary. (shrink)

This paper introduces a conjecture that laws of nature may be of different kinds, in particular that there may, in addition to laws which constrain outcomes, be laws which empower systems to direct or select outcomes and laws which guide systems in such selections. The paper defends this conjecture by suggesting that it is not excluded by anything we know, is plausible, and is potentially of great explanatory power.

This chapter focuses on the work of Ralph Waldo Emerson and Henry David Thoreau, and their interpretation by Stanley Cavell. Cavell's philosophy has sought to reclaim the work of Emerson and Thoreau for and as philosophy, and particularly as American philosophy. In Cavell's Emersonian moral perfectionism, perfectionism is understood as ateleological, and not in terms of perfectibility. Cavell therefore seeks to distinguish this American expression of perfectionism from what he identifies as a dimension or tradition of the moral life that (...) spans the course of Western thought, found in teleological form in, for example, Plato and Aristotle. Emerson's essay expresses a disappointment in America's passive acceptance of its European inheritance and in the implications of this for citizenship and democracy. America, or American man, must undertake its own labour to produce its own knowledge of itself and the world. (shrink)

This chapter begins by providing some historical background to European integration. It draws attention to the way that history has been used to promote a European identity since the European Union and, with it, European citizenship were created in 1992. The framing of the relationship between globalisation and its socioeconomic challenges has made the need to attend to questions of citizenship, particularly through education, self‐evident. The shift in the mode of governance has not only entailed using education as a means (...) of educating citizens about Europe: in the current context, education, or specifically, learning, has become a central aspect of how citizenship is understood. Examples of recent educational and cultural policy highlight terms that are central to producing a particular mode of governance. These examples illustrate the practices of accountability that have emerged in recent years that require governments, institutions, organisations, and individuals to speak about themselves in particular ways. Educational research tends to conduct its analysis according to fixed identity categories and concepts, and in its concern for voice, empowerment, and inclusion, offers ways in which researchers can articulate an account of themselves and their practice. The researcher herself then can be seen as being constituted as a particular subject in the current context of the entrepreneurial lifelong learning citizen, whose virtues are evidenced through the continual accumulation of skills and competencies. The concern with social justice, representation, and ethics (...) found in methodological discussion effects a shoring up of identity and a process of risk management in the sense of a thorough audit of who the researcher is. Considerations of citizenship and of educational research then begin to become inseparable because the understanding of both citizenship and research is seen to entail a particular relationship to the self. This chapter provides examples of European and local programmes and policies deriving from the education and cultural policies, and focuses on the ecological subject. These examples further illustrate not only the way in which the citizen is addressed, but also the construction of citizenship in a particular relationship to space and time. To begin the analysis of space in the construction of European citizenship, the chapter focuses on Foucault's account of governmentality, which shows the historical shift in the object of (...) government from territory to population, and thus the emergence of liberalism. More recent accounts draw attention to the subsequent shift to environments. In light of the environmental self‐understanding of the active learning citizen, the chapter considers the relationship to history seen in the promotion of heritage in European cultural policy. In 1933, the year that Hitler took power in Germany, Martin Heidegger accepted the Rectorship of the University of Freiburg. Rectoral Address is selected for its pertinence to this period of European history, which remains so central to the understanding of what constitutes Europe's heritage. This chapter explores the relationship between the sociopolitical events that took place in Germany in 1933 and philosophical texts relating to them. It provides some contextualisation of the post‐war events that ensued from Heidegger's Address and (...) political decisions in terms of the re‐reading of his philosophy and the Heidegger affair. Karl Liowith's account gives a positive interpretation of Heidegger's work, in the sense of situating him within a lineage of European philosophers who responded to the decline of Europe, diagnosing and responding to its nihilism, during the nineteenth and early twentieth centuries. This is followed by an introduction to Heidegger's Being and Time and subjectivity. (shrink)

Plato's texts have been subject to re‐reading in recent years, reflecting new ways in which philosophy has sought to understand the relationship between the author, the reader, and the text. This chapter begins by restating the allegory of the Stanley Cavell in The Republic, before turning to Cavell's reading of this in relation to the opening of the text. It further illustrates the idea of education as a finding of voice, which Cavell articulates through Emersonian moral perfectionism with reference to (...) his work on philosophy as autobiography. The educative relationship to the self and to the other, and the responsibility one takes for one's voice, is then illustrated further by way of Michel Foucault's account of Socratic parrhesia, a practice evident in The Republic and in other texts of Plato to which Foucault refers. Cavell ventures the term sublimation in relation to his questioning of the allegory of the Cave. (shrink)

This chapter illustrates how the language of research, citizenship, and education operates in two particular ways. First, by highlighting the way in which the discourses identified in policy and practice are taken up in educational research, and then by indicating how the particular mode of subjectivation detailed thus far is evident in certain forms of educational research. Both have implications for the critique educational research might provide. As a first example, the way in which educational research has responded to the (...) introduction of citizenship education in England is illustrated in the chapter by a review of research, policy, and practice covering the period 1995‐2005, commissioned by the British Educational Research Association. The review is taken to exemplify the field of education policy sociology. This is followed by discussion, in a second example, of what might be termed a genre of educational research concerned with voice and social justice. (shrink)

This study proposes that Neoplatonism, while not a modern philosophy, is philosophy in the modern sense. Lloyd analyzes the key structures that underlie the dogmas of the Neoplatonic world picture, including the concept of emanation, the return of the soul to the One, the place of mystical knowledge, epistemology, and Porphyry's theory of predication, and shows that they rest on original but intelligible concepts and arguments.

Many researchers believe the tremendous industrial development over the past two centuries is unsustainable because it has led to unintended ecological deterioration. Despite the ever-growing attention sustainable supply-chain management has received, most SSCM research and models look at the consequences, rather than the antecedents or motives of such responsible practices. The few studies that explore corporate motives have remained largely qualitative, and large-scale empirical analyses are scarce. Drawing on multiple theories and combining supply-chain and business ethics literature, we purport that (...) instrumental, relational, and moral motives are behind a firm’s engagement in SSCM practices. Specifically, we examine the links between corporate motives, SSCM practices, and firm performance. Using a sample of 259 supply-chain firms in Germany, we empirically test five hypothesized relationships. Our results reveal that relational and moral motives are key drivers, and that firms exhibiting high levels of moral obligations tend to outperform those primarily driven by amoral considerations. Findings of this study contribute to multiple literatures espousing sustainability management and can help policy makers, stakeholder groups, and scholars develop more robust strategies for encouraging firms to practice SSCM.
