The present article presents brief notes on the "new thought" of the German philosopher Franz Rosenzweig, in the work The Star of Redemption, with the exposure of reason and its totalitarian and violent vocation, which, since Antiquity until Modernity, was based on the tireless search for knowledge of the All, in its essence, with the formulation of concepts, in a closed experience. In contrast, the philosopher from Kassel points out his proposal for a new philosophical system, with a vocabulary similar (...) to the one found in Jewish theology, even being confused with theological thought, which revealed an alternative analysis of experience (open, dynamic, relational and in time), the construction of a plural reason, admitting and respectingplurality. There is no systematic knowledge about how individuals with Locked-in Syndrome experience their situation. A phenomenology of LIS, in the sense of a description of subjective experience as lived by the ill persons themselves, does not yet exist as an organized endeavor. The present article takes a step in that direction by reviewing various materials and making some suggestions. First-person narratives provide the most important sources, but very few have been discussed. LIS barely appears in bioethics and neuroethics. Research on (...) Quality of Life provides relevant information, one questionnaire study explores the sense of personal continuity in LIS patients, and LIS has been used as a test case of theories in “embodied cognition” and to explore issues in the phenomenology of illness and communication. A systematic phenomenology of LIS would draw on these different areas: while some deal directly with subjective experience, others throw light on its psychological, sociocultural and materials conditions. Such an undertaking can contribute to the improvement of care and QOL, and help inform philosophical questions, such as those concerning the properties that define persons, the conditions of their identity and continuity, or the dynamics of embodiment and intersubjectivity. Since its emergence in the early 2000s, neuroethics has become a recognized, institutionalized and professionalized field. A central strategy for its successful development has been the claim that it must be an autonomous discipline, distinct in particular from bioethics. Such claim has been justified by the conviction, sustained since the 1990s by the capabilities attributed to neuroimaging technologies, that somehow ‘the mind is the brain’, that the brain sciences can illuminate the full range of human experience and behavior, and that (...) neuroscientific knowledge will have dramatic implications for views of the human, and challenge supposedly established beliefs and practices in domains ranging from self and personhood to the political organization of society. In this long-awaited book, Antony Duff offers a new perspective on the structures of criminal law and criminal liability. His starting point is a distinction between responsibility (understood as answerability) and liability, and a conception of responsibility as relational and practice-based. This focus on responsibility, as a matter of being answerable to those who have the standing to call one to account, throws new light on a range of questions in criminal law theory: on the question of criminalisation, which (...) can now be cast as the question of what we should have to answer for, and to whom, under the threat of criminal conviction and punishment; on questions about the criminal trial, as a process through which defendants are called to answer, and about the conditions (bars to trial) given which a trial would be illegitimate; on questions about the structure of offences, the distinction between offences and defences, and the phenomena of strict liability and strict responsibility; and on questions about the structures of criminal defences. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution through which a liberal polity defines a realm of public wrongdoing, and calls those who perpetrate (or are accused of perpetrating) such wrongs to account. In the 1960s and 1970s, scuba technology, underwater cameras, and documentarians revealed a long-hidden underwater world to the public. At this time oceanographic science was growing exponentially. Historians of the marine sciences have focused their studies of the period on institutional and military partnerships, and on the scientist-administrators who shaped oceanographic research institutions (such as the Scripps Institution of Oceanography, the Woods Hole Oceanographic Institution, and the British National Institute of Oceanography). Underwater habitat development during the 1960s and 1970s, however, (...) deserves greater attention than it has yet received, as it highlights a peculiar confluence of military, scientific, and popular interest, characteristic of the period, in the colonization of the seafloor. Existing accounts have focused on American habitats, notably Sealab and Tektite, since these were the largest and best funded. But this approach overemphasizes a Cold War narrative in which the sole protagonists of the habitat programs were the United States and the Soviet Union. At least 65 habitats were built between 1962 and 1991. Some were state-sponsored, with significant programs run by French, German, Japanese, and Canadian teams. This essay takes as a case study the Canadian Sublimnos habitat as well as the underwater exploration programs it helped launch in Newfoundland (Lora-I) and in the Arctic (Sub-Igloo). The Canadian case demonstrates that technological expertise and public enthusiasm for underwater exploration should not be solely understood with reference to Cold War interests of the two superpowers. Rather, the international range of habitat programs of the 1960s and 1970s reveals an expanding interest in the vertical underwater dimension that was fueled by numerous national scientific aims and territorial claims. Examina en los respectivos planteamientos el valor y el alcance metafísico de la potencia, de la articulación abstracta del tiempo y de la “entelécheia”.

Las edificaciones con valor patrimonial son un testimonio excepcional del progreso de una comunidad y representan ejemplos innegables de la transferencia de conocimientos a lo largo de las generaciones. Es inevitable caminar por centro consolidado de Pasaje y no reconocer el legado cultural de muchas edificaciones. Sin embargo, también resulta fácil observar las alteraciones erróneas que sea han realizado a estas edificaciones con el objetivo de responder a las “nuevas exigencias” de la actualidad. La conservación de los bienes patrimoniales resulta (...) necesaria para la preservación de la integridad e identidad de la ciudad. La presente investigación posibilita entender el nivel de susceptibilidad que presentan las edificaciones consideradas como bienes patrimoniales, debido a que estás viviendas poseen un valor cultural. El objetivo de la investigación es el de identificar la susceptibilidad sísmica a las que están expuestas, para esto se utilizaron métodos de matrices de evaluación sísmica para medir el nivel de susceptibilidad en las edificaciones patrimoniales. Causation appears to present us with an interpretative difficulty. While arguably a redundant relation given fundamental physics, it is nevertheless apparently pragmatically indispensable. This chapter revisits certain arguments made previously by the author for these claims with the benefit of hindsight, starting with the role of causal models in the human sciences, and attempting to explain why it is not possible to straightforwardly ground such models in fundamental physics. This suggests that further constraints, going beyond physics, are needed to legitimate (...) such models. These supplementary constraints could be reified, but that would seem to conflict with the completeness of physics. A response is to emphasize the practical role of causal talk, and the author suggests that a fictionalist approach might be worth exploring. After clarifying fictionalism as a general approach, they carry out in some detail the project of clarifying what a fictionalist attitude to causation would involve. (shrink)

If personhood is the quality or condition of being an individual person, brainhood could name the quality or condition of being a brain. This ontological quality would define the `cerebral subject' that has, at least in industrialized and highly medicalized societies, gained numerous social inscriptions since the mid-20th century. This article explores the historical development of brainhood. It suggests that the brain is necessarily the location of the `modern self', and that, consequently, the cerebral subject is the anthropological figure inherent (...) to modernity (at least insofar as modernity gives supreme value to the individual as autonomous agent of choice and initiative). It further argues that the ideology of brainhood impelled neuroscientific investigation much more than it resulted from it, and sketches how an expanding constellation of neurocultural discourses and practices embodies and sustains that ideology. O impacto para a saúde mental dos filhos da gravidade da depressão materna (DM), em comorbidade com outros transtornos, carece de estudos. Objetivou-se comparar indicadores de saúde mental de escolares, considerando grupos diferenciados pela gravidade da DM com e sem comorbidade com Transtorno de Personalidade Borderline (TPB). Foram avaliadas 90 díades mães-crianças, distribuídas em três grupos, sistematicamente avaliados: Grupo Depressão (GD) - mães com indicadores de sintomas atuais de depressão e histórico de episódios anteriores, sem indicadores de TPB, Grupo Depressão (...) em Comorbidade com TPB (GD-TPB) - mães com sintomas depressivos atuais e histórico de episódios anteriores com comorbidade com indicadores de TPB, e Grupo de Comparação (GC) - mães sem histórico de sintomas depressivos nem indicadores de TPB. As crianças, de ambos os sexos, tinham idade entre seis e 10 anos. Procedeu-se às avaliações em sessões individuais: a) com as mães - Questionário Geral e Questionário Sobre a Saúde do Paciente, Entrevista Clínica TPB e Questionário de Capacidades e Dificuldades (SDQ); e b) com as crianças - Teste das Matrizes Progressivas Coloridas de Raven. Tratou-se os dados por procedimentos estatísticos (p ≤0,05). As crianças do GD-TPB apresentaram, com significância estatística, média maior que GD e GC quanto ao escore de problemas total, conduta, hiperatividade e problemas de relacionamento. Verificou-se associação da gravidade da DM com TPB com mais problemas de saúde mental infantil, caracterizando um grupo clínico preferencial para intervenções em saúde mental. (shrink)

The notion of multiple location plays an important role in the characterization of endurantism. Several authors have recently offered cases intended to demonstrate the incoherence of multiple location. I argue that these cases do not succeed in making multiple location problematic. Along the way, several crucial issues about multiple location and its use by endurantists are clarified.

Moreover, these two purposes are often combined, and inherently (...) concern empirical, methodological, and conceptual challenges associated withpopularization,science communication, and thepublic understanding of science. It is in these areas that the notion of thedeficit modelemerged to designate a point of view and a mode of understanding, as well as a set of practical and theoretical problems about the relationship between science and the public. The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. I argue that any broadly dispositional analysis of probability will either fail to give an adequate explication of probability, or else will fail to provide an explication that can be gainfully employed elsewhere (for instance, in empirical science or in the regulation of credence). The diversity and number of arguments suggests that there is little prospect of any successful analysis along these lines.

Recently, many philosophers have been interested in using locative relations to clarify and pursue debates in the metaphysics of material objects. Most begin with the relation of exact location. But what if we begin instead with the relation known as weak location – the relation an object x bears to any region not completely bereft of x? I explore some of the consequences of pursuing this route for issues including coincidence, extended simples, and endurance, with an eye to evaluating the (...) prospects for taking weak location as our fundamental locative relation. I sketch a new constraint on chance, which connects chance ascriptions closely with ascriptions of ability, and more specifically with 'CAN'-claims. This connection between chance and ability has some claim to be a platitude; moreover, it exposes the debate over deterministic chance to the extensive literature on (in)compatibilism about free will. The upshot is that a prima facie case for the tenability of deterministic chance can be made. But the main thrust of the paper is to draw attention to the (...) connection between the truth conditions of sentences involving 'CAN' and 'CHANCE', and argue for the context sensitivity of each term. Awareness of this context sensitivity has consequences for the evaluation of particular philosophical arguments for (in) compatibilism when they are presented in particular contexts. (shrink)

Recently, Cody Gilmore has deployed an ingenious case involving backwards time travel to highlight an apparent conflict between the theory that objects persist by perduring, and the thesis that wholly coincident objects are impossible. However, careful attention to the concepts of location and parthood that Gilmore’s cases involve shows that the perdurantist faces no genuine objection from these cases, and that the perdurantist has a number of plausible and dialectically appropriate ways to avoid the supposed conflict.

This article discusses two arguments in favor of perdurance. The first is Sider’s argument from vagueness, “one of the most powerful” in favor of perdurantism. I make the observation that endurantists have principled grounds to claim that the argument is unsound, at least if endurance is formulated in locative rather than mereological terms. Having made this observation, I use it to emphasize a somewhat neglected difference between endurantists and perdurantists with respect to their views on material objects. These views, in (...) the case of endurantists, lead to a further, less than conclusive but nevertheless interesting argument against endurantism—the anti-fundamentality argument—which I discuss and tentatively endorse. That argument posits that endurantists must take location to be a fundamental relation, and that this has as a consequence the metaphysical possibility of some rather unwelcome scenarios. Perdurantists may avoid this consequence by denying that location is fundamental, perhaps by embracing supersubstantivalism. (shrink)

In the late nineteenth century, French naturalists were global leaders in microbial research. Louis Pasteur advanced sterilization techniques and demonstrated that dust particles in the air could contaminate a putrefiable liquid. Pasteur’s discoveries prompted a new research program for the naturalists of the Talisman and Travailleur expeditions: to recover uncontaminated water and mud samples from the deep sea. French naturalists Adrien Certes and Paul Regnard both independently conducted experiments to address the question of whether microorganisms inhabited the oceans and whether (...) organic material in the deep sea was subject to decomposition. The experiments of Certes and Regnard have largely been omitted from histories of microbiology and marine science. However, an examination of their work is crucial for understanding the context in which marine microbiology first developed. At the end of the nineteenth century, marine microbiology emerged from the disciplinary melding of terrestrial microbial ecology, experimental physiology, and the then-nascent field of deep-sea biology. The concept of randomness has been unjustly neglected in recent philosophical literature, and when philosophers have thought about it, they have usually acquiesced in views about the concept that are fundamentally flawed. After indicating the ways in which these accounts are flawed, I propose that randomness is to be understood as a special case of the epistemic concept of the unpredictability of a process. The environmental complexity in which living organisms found themselves throughout evolution, most likely resulted in various encounters that would continuously challenge the organisms' ability to survive. Coping with this stress can prove energetically demanding and might require the proper coupling between mechanisms aimed at sensing external stimuli and cellular strategies geared at producing energy. In this issue of BioEssays, Lovejoy and Hogg hypothesize that preservation of this bifaceted coupling can be detected by the maintenance and evolution of stress response mechanisms (...) at the genomic, molecular and cellular levels. Through ancestry‐tracking, they identify a group of related G protein‐coupled receptor systems with intersecting stress‐modulating properties which might represent an essential part of a complex organism's coping mechanisms to stress, an attribute that they suspect may be affected in individuals suffering from mood disorders such as depression. I begin by discussing the ways in which a would‐be blamer's own prior conduct towards the person he seeks to blame can undermine his standing to blame her (to call her to account for her wrongdoing). This provides the basis for an examination of a particular kind of ‘bar to trial’ in the criminal law – of ways in which a state or a polity's right to put a defendant on trial can be undermined by the prior misconduct of the (...) state or its officials. The examination of this often neglected legal phenomenon illuminates some central features of the criminal law and the criminal process, and some of the preconditions for the legitimacy of the criminal law in a liberal republic. This article discusses contemporary social psychological approaches to the social relations and appraisals associated with specific emotions; other people’s impact on appraisal processes; effects of emotion on other people; and interpersonal emotion regulation. We argue that single-minded cognitive perspectives restrict our understanding of interpersonal and group-related emotional processes, and that new methodologies addressing real-time interpersonal and group processes present promising opportunities for future progress.

This article explores the connection between objective chance and the randomness of a sequence of outcomes. Discussion is focussed around the claim that something happens by chance iff it is random. This claim is subject to many objections. Attempts to save it by providing alternative theories of chance and randomness, involving indeterminism, unpredictability, and reductionism about chance, are canvassed. The article is largely expository, with particular attention being paid to the details of algorithmic randomness, a topic relatively unfamiliar to philosophers.

En este artículo intentamos recopilar las diferentes respuestas que se han dado al interrogante: ¿cuál es la naturaleza de la guerra en Colombia? Para ello, hemos estudiado seis formas de definir la violencia en Colombia: i) guerra anti/comunista; ii) conflicto agrario; iii) conflicto criminalizado; iv) guerra civil/guerra contra la sociedad; v) conflicto internacionalizado; vi) amenaza terrorista. Concluimos que los cambios de los actores armados, sus repertorios de violencia y del contexto internacional son respondidos por masas críticas con nuevas denominaciones. Las (...) denominaciones, así como la guerra misma, son dinámicas. Este artículo aporta una revisión de literatura sobre la naturaleza del conflicto y una perspectiva de análisis historiográfico útil para otras preguntas relacionadas con la guerra. (shrink)

SummaryIn early and prehistoric times, human groups cooperated among themselves and competed viciously with other groups. Concepts of international relations, notably universal hegemony and exclusive nationalism, go back to the earliest recorded history. Only the ancient Greeks experienced inter-state relations somewhat analogous to those of modern Europe; and the first reflections on these may be found in Thucydides. The Greeks, and later the Romans, above all Cicero, developed a notion of cosmopolitanism. During the Latin Middle Ages, the papacy perpetuated the (...) idea of universal hegemony. The principle of state sovereignty was also formulated. The pre-modern Chinese empire was held to rule ‘all-under-Heaven’; Confucian ethics contributes the notion of humanity as the fundamental category. Muslims deepened the us–them distinction by claiming sole legitimacy for their religious community under the Caliph. Today, Muslims veer between this and a more Western approach to international relations. (shrink)

The paper begins with the plausible view that criminal responsibility should track moral responsibility, and explains its plausibility. A necessary distinction is then drawn between liability and answerability as two dimensions of responsibility, and is shown to underpin the distinction in criminal law between offences and defences. This enables us to distinguish strict liability from strict answerability, and to see that whilst strict criminal liability seems inconsistent with the principle that criminal responsibility should track moral responsibility, strict criminal answerability is (...) not. We must ask, therefore, whether, when and why strict criminal responsibility is unacceptable. (shrink)

Early work on the frequency theory of probability made extensive use of the notion of randomness, conceived of as a property possessed by disorderly collections of outcomes. Growing out of this work, a rich mathematical literature on algorithmic randomness and Kolmogorov complexity developed through the twentieth century, but largely lost contact with the philosophical literature on physical probability. The present chapter begins with a clarification of the notions of randomness and probability, conceiving of the former as a property of a (...) sequence of outcomes, and the latter as a property of the process generating those outcomes. A discussion follows of the nature and limits of the relationship between the two notions, with largely negative verdicts on the prospects for any reduction of one to the other, although the existence of an apparently random sequence of outcomes is good evidence for the involvement of a genuinely chancy process. Dispositional essentialists are typically committed to two claims: that properties are individuated by their causal role (‘causal structuralism’), and that natural necessity is to be explained by appeal to these causal roles (‘dispositional actualism’). I argue that these two claims cannot be simultaneously maintained; and that the correct response is to deny dispositional actualism. Causal structuralism remains an attractive position, but doesn’t in fact provide much support for dispositional essentialism.

Abstract The article addresses three aspects of the humanitarian intervention doctrine. It argues, first, that the value of sovereignty rests on the justified social processes of the target state ? the horizontal contract. In contrast, morally objectionable social processes (such as the subjection of women) are not protected by sovereignty (intervention, of course, may be banned for other reasons). In addition, tyrants have no moral protection against interventions directed at (...) them. Second, the article addresses the internal legitimacy of humanitarian intervention. It concludes that the liberal state may only use voluntary soldiers (either the voluntary army or mercenaries) to conduct humanitarian intervention. Conscription for that purpose is not permissible. The article shows that the long-standing criticism of mercenaries stems from a romantic prejudice and is thus unfair. Third, the article makes a distinction between intention (the determination to perform an action) and motive (a further goal that the agent seeks with that action) and shows that only intention is relevant for humanitarian intervention. A justified humanitarian intervention requires the intention to liberate the victims, but not necessarily a good further motive. It shows how mainstream doctrine has impermissibly confused the two concepts. (shrink)

L’histoire de la psychologie en tant que discipline autonome comporte non seulement des développements méthodologiques et institutionnels, mais aussi l’élaboration du concept même de psychologie et des représentations de sa place dans l’ordre des sciences. Si de telles représentations ne détenninent pas la constitution du champ professionnel ou la pratique concrète du psychologue, elles n’en expriment pas moins des idéaux épistémologiques et reflètent les changements qui s’opèrent au sein de la discipline. Nous donnerons d’abord une vue générale de la position (...) de la psychologie au XVIIe et au VXIIIe siècle, puis nous esquisserons l’histoire de sa place dans l’ordre des sciences de Destutt de Tracy à Jean Piaget. Après avoir été la science des sciences des classifications hiérarchiques, la psychologie s’intègre aux autres sciences dans des schémas moins linéaires, voire circulaires, sans pour autant toujours perdre la prééminence gnoséologique et pédagogique que lui attribuèrent en premier les « psychologues » du XVIIIe siècle.
