This paper provides a detailed analysis of how, according to Kant, the moral badness of some third parties’ actions can be established with certainty (by anyone, not only by the agent’s own conscience or by God). This account helps clarify why Kant affirms that some forms of wrongdoing (of which there are a “multitude of woeful examples”) can be demonstrated to be immoral, while excluding the possibility of proving the moral goodness of any action. _Factory of Strategy_ is the last of Antonio Negri's major political works to be translated into English. Rigorous and accessible, it is both a systematic inquiry into the development of Lenin's thought and an encapsulation of a critical shift in Negri's theoretical trajectory. Lenin is the only prominent politician of the modern era to seriously question the "withering away" and "extinction" of the state, and like Marx, he recognized the link between capitalism and modern sovereignty and the need to (...) destroy capitalism and reconfigure the state. Negri refrains from portraying Lenin as a ferocious dictator enforcing the proletariat's reappropriation of wealth, nor does he depict him as a mere military tool of a vanguard opposed to the Ancien Régime. Negri instead champions Leninism's ability to adapt to different working-class configurations in Russia, China, Latin America, and elsewhere. He argues that Lenin developed a new political figuration in and beyond modernity and an effective organization capable of absorbing different historical conditions. He ultimately urges readers to recognize the universal application of Leninism today and its potential to institutionally--not anarchically--dismantle centralized power. (shrink)

The fiduciary nature of the patient-physician relationship requires clinicians to act in the best interest of their patients. Patients are vulnerable due to their health status and lack of medical knowledge, which makes them dependent on the clinicians’ expertise. Competent patients, however, may reject the recommendations of their physician, either refusing beneficial medical interventions or procedures based on their personal views that do not match the perceived medical indication. In some instances, the patients’ refusal may jeopardize their health or life (...) but also compromise the clinician’s moral responsibility to promote the patient’s best interests. In other words, health professionals have to deal with patients whose behavior and healthcare decisions seem counterproductive for their health, or even deteriorate it, because of lack of knowledge, bad habits or bias without being the patients’ free voluntary choice. The moral dilemma centers on issues surrounding the limits of the patient’s autonomy (rights) and the clinician’s role to promote the well-being of the patient (duties). In this paper we argue that (1) the use of manipulative strategies, albeit considered beneficent, defeats the purpose of patient education and therefore should be rejected; and (2) the appropriate strategy is to empower patients through patient education which enhances their autonomy and encourages them to become full healthcare partners as opposed to objects of clinical intervention or entities whose values or attitudes need to be shaped and changed through education. First, we provide a working definition of the concept of patient education and a brief historical overview of its origin. Second, we examine the nature of the patient-physician relationship in order to delineate its boundaries, essential for understanding the role of education in the clinical context. Third, we argue that patient education should promote self-rebiasing, enhance autonomy, and empower patients to determine their therapeutic goals. A statement of hyperarithmetic analysis is a sentence of second order arithmetic S such that for every Y⊆ω, the minimum ω-model containing Y of RCA0 + S is HYP, the ω-model consisting of the sets hyperarithmetic in Y. We provide an example of a mathematical theorem which is a statement of hyperarithmetic analysis. This statement, that we call INDEC, is due to Jullien [13]. To the author's knowledge, no other already published, purely mathematical statement has been found with this property (...) until now. We also prove that, over RCA0, INDEC is implied by [Formula: see text] and implies ACA0, but of course, neither ACA0, nor ACA 0+ imply it. We introduce five other statements of hyperarithmetic analysis and study the relations among them. Four of them are related to finitely-terminating games. The fifth one, related to iterations of the Turing jump, is strictly weaker than all the other statements that we study in this paper, as we prove using Steel's method of forcing with tagged trees. We defend, from a contractarian perspective, that the fair price of an insurance policy is the amount that the contracting parties agree when they are both equally uncertain about the insured event. Drawing on the approach developed by R. Sugden in _The Community of Advantage_, we answer two standard objections raised against contractarianism in the actuarial sciences: (1) people are not wise enough to assess their actuarial risks; (2) they are not rational enough to decide which insurance policy suits them (...) better. We show under which circumstances people can make fair actuarial agreements, without presupposing any objective risk or rationality benchmarks. (shrink)

Making use of facilitating payments is a very widespread form of corruption. These consist of small payments or gifts made to a person – generally a public official or an employee of a private company – to obtain a favour, such as expediting an administrative process; obtaining a permit, licence or service; or avoiding an abuse of power. Unlike the worst forms of corruption, facilitating payments do not usually involve an outright injustice on the part of the payer as they (...) are entitled to what they request. This may be why public opinion tends to condone such payments; often they are assumed to be unavoidable and are excused on the grounds of low wages and lack of professionalism among public officials and disorganisation in government offices. Many companies that take the fight against “grand” corruption very seriously are inclined to overlook these “petty” transgressions, which are seen as the grease that makes the wheels of the bureaucratic machine turn more smoothly. Despite this, facilitating payments have a pernicious effect on the working of public and private administrations: all too often they are the slippery slope to more serious forms of corruption; they impose additional costs on companies and citizens; and in the long run they sap the ethical foundations of organisations. Although many articles on corruption mention facilitating payments, there have been no systematic studies from a company’s point of view. This article thus focuses on facilitating payments from the point of view of the company that makes the payment, either as the active partner (when it is the company that takes the initiative) or as the passive partner (when the official or employee is the instigator). This article serves as an introduction to the collection of papers in this monographic issue on “What the European tradition can teach about Corporate Social Responsibility” and presents the rationale and the main hypotheses of the project. We maintain that corporate social responsibility (CSR) is an ethical concept, that the demands for socially responsible actions have been around since before the Industrial Revolution and that companies have responded to them, especially in Europe, and that the content of CSR has evolved (...) over time, depending on historical, cultural, political, and socio-economic drivers and particular conditions in different countries and also at different points in time. Therefore, there is not – and probably cannot be – a unique, precise definition of CSR: one global standard for CSR is unlikely. (shrink)

Pour cela, il retrace le processus de migration des savoirs indigénistes depuis leur contexte d'origine au Mexique jusqu'au Brésil, et les transformations qu'ils connaissent au cours de leur trajectoire jusqu'à aujourd'hui, en s'appuyant sur la notion de « traditions de savoirs » pour la gestion des populations qui se sont développées à partir de l'époque coloniale. This paper introduces a formal concept of ideology and ideological system. The formalization takes ideologies and ideological systems to be situated in agent societies. An ideological system is defined as a system of operations able to create, maintain, and extinguish the ideologies adopted by the social groups of agent societies. The concepts of group ideology, ideological contradiction, ideological dominance, and dominant ideology of an agent society, are defined. An ideology-based concept of social group is introduced. Relations between the proposed formal (...) concept of ideology and the classical concepts of ideology elaborated in social sciences are examined. A computational notation is presented, to support the realization of ideological systems in computationally implemented agent societies. The adequacy of the approach for the formal modeling and analysis of ideological issues is illustrated through three case studies. (shrink)

This essay is an attempt to establish the relevance of conceptual analysis and explication to the understanding of classical chinese philosophy. It is suggested that an employment of the methodology brings out problems of philosophical interest.

Proposition 5.122 of Wittgenstein’s Tractatus has been the source of much puzzlement among interpreters, so much so that no fully satisfactory account is yet available. This is unfortunate, if only because the containment account of logical consequence has a venerable tradition behind it. Pasquale Frascolla’s interpretation of proposition 5.122 is based on a valid argument and one true premise. However, the argument explains sense containment only in an indirect way, leaving some crucial questions unanswered. Besides, Frascolla does not address the (...) issue of how to make sense containment notationally perspicuous, an essential theme in Wittgenstein’s reflections. In this paper, we elaborate on Frascolla’s account by looking at the issue through the Tractarian notion of logical space. Our analysis shows that, for containment to be fully appreciated, one should adopt a negative perspective on the notion of sense, in line with the exclusionary theory of conceptual content, as labelled by Ian Rumfitt. Besides this, we introduce and discuss two methods—one envisaged by Wittgenstein himself—for making sense containment notationally perspicuous. (shrink)

It is in Sein und Zeit that Heidegger decrees the end of the Geisteswissenschaften and their tradition, when, as he is commenting on the Briefwechsel [exchange of letters] between Dilthey and Yorck von Wartenburg, he pays homage to the latter for “his full understanding of the fundamental character of history as virtuality [...] [which he] owes to his knowledge of the character of being of human Dasein itself.” Consequently, Heidegger continues, “the interest of understanding historicality” is confronted with the task (...) of an elaboration of the “generic difference between the ontic and the historical.” But he must part ways with Yorck when the latter, after having clearly established that difference, moves from virtuality to mysticism. If, on the other hand, once separated from the ontic, “the question of historicality shows itself to be an ontological question which inquires into the constitution of being of historical being”, it is once again towards Dilthey that one must turn, in spite of his confused vitalism. Heidegger effects two operations at once. On the one hand, he expels the Geisteswissenschaften from the position they occupied at the heart of metaphysics, as the inheritors of the Enlightenment and the outcome of Hegelianism. On the other hand, he brings to fulfillment the critical labor which had precisely shown its value in Dilthey’s historicism —acritical labor which develops the search for the meaning of historicity and allows one to move from the theory of objectivity to that of expression, from the acknowledgment of historiography in the context of the critique of cognition to its definition at the heart of the transcendental schematism. Historicity is then posited as an ontological dimension and leaves only its ontic residue for historiography. (shrink)

El presente ensayo indaga en el habitar como acción colectiva y su relación con la materia con que se construye el objeto habitado, proponiendo el término “xeno-metamórfico” para designar posibles estrategias que permitan nuevas formas de habitar basadas en la construcción en bahareque. En primer lugar, se hace una aproximación a los términos de espacio, territorio, lugar y paisaje como categorías que permiten clasificar aquello que habitamos para, en segundo lugar, indagar en cómo habitamos estas categorías. Este trabajo presenta los resultados preliminares obtenidos en la conformación del Atlas Iberoamericano en Bioética que ha desarrollado el Centro Anáhuac de Desarrollo Estratégico en Bioética (CADEBI) respecto a la identificación y análisis de las instituciones de Bioética existentes en la Región. Se realizó una revisión documental a través de motores de búsqueda, bases de datos, redes sociales y otras fuentes. La información obtenida se agrupó en seis diferentes categorías de acuerdo con la estructura, objetivos y actividades que desarrollan. De (...) esta manera, se realizó un diagnóstico inicial con base en las fuentes documentales disponibles en la Web. Como parte de los resultados, se identificaron 157 instituciones en 25 países; así como la variación en la densidad institucional, concentrándose principalmente en España (29 instituciones), México (26 instituciones), Argentina (17 instituciones), Brasil (13 instituciones), Chile (11 instituciones) y Colombia (8 instituciones). Además, se resalta la importancia de las comisiones nacionales de bioética en el desarrollo institucional, señalando la relación entre el avance científico y tecnológico de los países y el desarrollo de la bioética. El texto concluye con la propuesta de crear un Observatorio de la Red Iberoamericana de Bioética para documentar y promover el intercambio institucional y científico en la Región, así como algunas recomendaciones derivadas del desarrollo de este trabajo. This entails encountering the ontological dimension of communism, that is, the material tenor of this ontology, its residual effectiveness, the desire of human beings to go beyond capital, and the reality of the episode of statism.

This article shows the close relationship that exists between two fundamental concepts in the theological doctrine of Origen of Alexandria: “fullness” and“participation”. These two concepts have been the subject of many earlier studies. However, they treated the topic in a more restricted sense, exploring very specific aspects of Origenian theology. The originality of this study lies in demonstrating how both concepts recur frequently in his theological thinking, give it a framework and hold his thought together. Esse texto é um escrito que, ao final, é um termo médio entre um Artigo e um Ensaio. O objetivo é expor nossa compreensão sobre o sentido d“o material” e as implicações onto(epistemo)lógicas desta concepção no pensamento de Karl Marx. Em plano geral, primeiramente, nosso texto discorre sobre o que nomeamos de “a questão primeira”, qual seja: o que é “o material” no interior e no contexto dos escritos de Marx? Para cumprir essa tarefa procedemos com leituras de textos marxianos (...) visando identificar, neles, passagens importantes aonde o conceito de “material” é pressuposto, citado ou implicado. No segundo momento do texto, afirmamos que os resultados das análises do sentido d“o material” nos possibilitam induzir e/ou deduzir que o materialismo de Marx é dialético. Por fim, apresentamos algumas conclusões que decorrem do aceite da validade e veracidade da tese de que Marx pensa dialeticamente, de que seu materialismo é dialético. (shrink)
