In her influential discussion of the plight of stateless people, Hannah Arendt invokes the ‘right to have rights’ as the one true human right. In doing so she establishes an aporia. If statelessness corresponds not only to a situation of rightlessness but also to a life deprived of public appearance, how could those excluded from politics possibly claim the right to have rights? In this article I examine Jacques Rancière’s response to Arendt’s aporetic account of human rights, situating this in (...) relation to his wider criticism of Arendt’s conception of the political. According to Rancière, Arendt depoliticizes human rights in identifying the human with mere life (zoë) and the citizen with the good life (bios politikos). For, in doing so, she takes the distinction between zoë and the bios politikos to be ontologically given whereas politics is typically about contesting how that distinction is drawn. For Rancière ‘the human’ in human rights does not refer to a life deprived of politics. Rather, the human is a litigious name that politicizes the distinction between those who are qualified to participate in politics and those who are not. In contrast to Arendt, Rancière’s approach enables us to recognize contests over human rights, such as that of the sans papiers, as part and parcel of social struggles that are the core of political life. The usual way of discussing normativity and naturalism is by running through a standard range of issues: the relations of fact and value, objectivity, reason and emotion, is and ought, and the so-called ‘naturalistic fallacy’. This is a naturalism that is virtually silent on nature. I outline an alternative approach that relates normativity to our nature as living beings, for whom specific things are good or bad for us. Our nature as evaluative beings is shown to be rooted in and (...) emergent from this biological normativity. There is also significant downward causation, such that our brain-bodies are continually modified by our experience and thoughts. Cultures, as emergent from the affordances of our brain-bodies, create further extensive, irreducible sources of normativity, albeit ones which do not wholly escape biological normativity and can impact back on it. This article considers how reconciliation might be understood as a democratic undertaking. It does so by examining the implications of the debate between theorists of ‘deliberative’ and ‘agonistic’ democracy for the practice of democracy in divided societies. I argue that, in taking consensus as a regulative idea, deliberative democracy tends to conflate moral and political community thereby representing conflict as already communal. In contrast, an agonistic theory of democracy provides a critical perspective from which to discern what is at stake (...) in the politics of reconciliation since it understands community as a contingent achievement of political action. As such, an agonistic account of democracy suggests the possibility of retrieving the concept of reconciliation from a statesanctioned project of nation-building for a democratic politics centred on the possibilities of self-determination and solidarity among citizens divided by a history of state violence. Alasdair MacIntyre’s After Virtue presented a reinterpretation of Aristotelian virtue ethics that is contrasted with the emotivism of modern moral discourse, and provides a moral scheme that can enable a rediscovery and reimagination of a more coherent morality. Since After Virtue’s publication, this scheme has been applied to a variety of activities and occupations, and has been influential in the development of research in accounting ethics. Through a ‘close’ reading of Chaps. 14 and 15 of AV, this paper considers and (...) applies the key concepts of practices, institutions, internal and external goods, the narrative unity of a human life and tradition, and the virtues associated with these concepts. It contributes, firstly, by providing a more accurate and comprehensive application of MacIntyre’s scheme to accounting than that available in the existing literature. Secondly, it identifies areas in which MacIntyre’s scheme supports the existing approach to professional accounting ethics as articulated by the various International Federation of Accountants pronouncements as well as areas in which it provides a critique and challenge to this approach. The application ultimately provides an alternative philosophical perspective through which accounting can be examined and further research into accounting ethics pursued. (shrink)

In this book, Andrew Inkpin considers the disclosive function of language—what language does in revealing or disclosing the world. His approach to this question is a phenomenological one, centering on the need to accord with the various experiences speakers can have of language. With this aim in mind, he develops a phenomenological conception of language with important implications for both the philosophy of language and recent work in the embodied-embedded-enactive-extended tradition of cognitive science. -/- Inkpin draws extensively on the (...) work of Martin Heidegger, Maurice Merleau-Ponty, and Ludwig Wittgenstein, showing how their respective conceptions of language can be combined to complement each other within a unified view. From the early Heidegger, Inkpin extracts a basic framework for a phenomenological conception of language, comprising both a general picture of the role of language and a specific model of the function of words. Merleau-Ponty’s views are used to explicate the generic “pointing out”—or presentational—function of linguistic signs in more detail, while the late Wittgenstein is interpreted as providing versatile means to describe their many pragmatic uses. Having developed this unified phenomenological view, Inkpin explores its broader significance. He argues that it goes beyond the conventional realism/idealism opposition, that it challenges standard assumptions in mainstream post-Fregean philosophy of language, and that it makes a significant contribution not only to the philosophical understanding of language but also to 4e cognitive science. This article distinguishes between a telic and a deontic version of Derek Parfit's influential Priority View. Employing the distinction, it shows that the existence of variations in how intrapersonal and interpersonal conflicts should be resolved fails to provide a compelling case in favour of relational egalitarianism and against all pure versions of the Priority View. In addition, the article argues that those variations are better understood as providing counterevidence to certain distribution-sensitive versions of consequentialism.

Many explanations in physics rely on idealized models of physical systems. These explanations fail to satisfy the conditions of standard normative accounts of explanation. Recently, some philosophers have claimed that idealizations can be used to underwrite explanation nonetheless, but only when they are what have variously been called representational, Galilean, controllable or harmless idealizations. This paper argues that such a half-measure is untenable and that idealizations not of this sort can have explanatory capacities.

Formed in the wake of May 1968, the Prisons Information Group (GIP) was a radical resistance movement active in France in the early 1970's. Theorist Michel Foucault was heavily involved. This book collects interdisciplinary essays that explore the GIP's resources both for Foucault studies and for prison activism today.

In this paper an algebraic system of the new type is proposed (namely, a vectorial lattice). This algebraic system is a lattice for the language of Aristotle’s syllogistic and as well as a lattice for the language of Vasiľév’s syllogistic. A lattice for the language of Aristotle’s syllogistic is called a vectorial lattice on cap-semilattice and a lattice for the language of Vasiľév’s syllogistic is called a vectorial lattice on closure cap-semilattice. These constructions are introduced for the first time.

A common methodological adage holds that diverse evidence better confirms a hypothesis than does the same amount of similar evidence. Proponents of Bayesian approaches to scientific reasoning such as Horwich, Howson and Urbach, and Earman claim to offer both a precise rendering of this maxim in probabilistic terms and an explanation of why the maxim should be part of the methodological canon of good science. This paper contends that these claims are mistaken and that, at best, Bayesian accounts of diverse (...) evidence are crucially incomplete. This failure should lend renewed force to a long-neglected global worry about Bayesian approaches. (shrink)

Andrew Cooper presents the first systematic study of Kant's account of natural history. Cooper contends that Kant made a decisive contribution to one of the most explosive and understudied revolutions in the history of science: the addition of time to the frame in which explanations are required, sought, and justified in natural science. Through addressing a wide range of Kant's works, Cooper challenges the claim that Kant's theory of science denies a developmental conception of nature and argues instead that (...) it establishes a method by which natural historians can genuinely dispute historical claims and potentially come to consensus. This method, Cooper argues, can be used to expose serious flaws in Kant's own historical reasoning, including the formation and defence of his racist views. The book will be valuable to philosophers seeking to discern both the power and limitations of Kant's theory of science, and to historians of science working on the fractured landscape of eighteenth-century Newtonianism. The techniques that some large multinational corporations use to reduce their tax liability have come under increasing public scrutiny in recent years, alongside governmental investigations and international commitments aimed at curbing opportunities for tax avoidance. Although discussion of tax avoidance activities, and their regulatory responses, is often conducted with reference to moral concepts, philosophical analysis of the ethics of multinational tax avoidance remains limited. In particular, the virtue ethics tradition that emphasises the agent and the performance of specific roles has (...) not been considered in detail. This paper examines how the contemporary virtue ethics of Alasdair MacIntyre can be applied to the issue of multinational tax avoidance, and considers the role that accountants play in these activities. It argues, firstly, that MacIntyre’s approach provides a more useful philosophical analysis of the issue and, secondly, that the main parties involved are likely to agree with the main tenets of this approach. The paper also contributes by reconceptualising, using MacIntyre’s scheme, the issue of tax avoidance in relation to Donald Cressey’s ‘fraud triangle’. (shrink)

The human primate is a deeply cultural species, our cognition being shaped by culture, and cultural transmission amounting to an “epidemic of mental representations” (Sperber, 1996). The architecture of this aspect of human cognition has been shaped by our evolutionary past in ways that we can now begin to discern through comparative studies of other primates. Processes of social learning (learning from others) are important for cognitive science to understand because they are cognitively complex and take many interrelated forms; they (...) shape traditions, cultures and nonsocial aspects of cognition; and in turn they may be shaped by their cultural context. The study of primate social learning and culture has in recent years enjoyed a renaissance, providing a wealth of new findings, key aspects of which are reviewed. The focus is on cognitive issues, including learning about the consequences, sequential structure and hierarchical organization of actions; relating stored knowledge to the assimilation of new social knowledge; feedback guiding the construction of imitations; conceptual grasp of imitation; and the reciprocal relationship between social learning and culture. Neotraditional organizations are those that exist to sustain indigenous cultures, practices, and institutions as they compete in modern markets. This study examines how a single mechanism, leader transparency, influences change outcomes in neotraditional organizations. We predict that leader transparency will enhance employee cognition- and affect-based trust toward leadership during times of change, thereby supporting relational dynamics within the organization that enable a smooth transition. We also predict that leader transparency will elevate employee acceptance of new technology during change, thereby enhancing (...) desired functional adjustments within the organization. Finally, we predict that leaders who embrace the indigenous heritage of the firm while implementing change will benefit more from being transparent than leaders who ignore the indigenous heritage of the firm. We find overall support for our predictions. These results enhance our understanding of how leaders of neotraditional organizations can manage change successfully while preserving historical cultures, practices, and institutions. (shrink)

One of the key achievements of critical realism has been to expose the modernist myth of universal reason, which holds that authentic knowledge claims must be objectively ‘pure’, uncontaminated by the subjectivity of local place, specific time and particular culture. Wright aims to address the lack of any substantial and sustained engagement between critical realism and theological critical realism with particular regard to: (a) the distinctive ontological claims of Christianity; (b) their epistemic warrant and intellectual legitimacy; and (c) scrutiny of (...) the primary source of the ontological claims of Christianity, namely the historical figure of Jesus of Nazareth. As such, it functions as a prolegomena to a much needed wider debate, guided by the under-labouring services of critical realism, between Christianity and various other religious and secular worldviews. This important new text will help stimulate a debate that has yet to get out of first gear. This book will appeal to academics, graduate and post-graduate students especially, but also Christian clergy, ministers and informed laity, and members of the general public concerned with the nature of religion and its place in contemporary society. It argues that they too fail to offer an account of the connection with global theory that can (...) justify the explanatory power of an idealized local model, and consequently these accounts are unable effectively to distinguish explanatory from non-explanatory models. On the account proposed here, scientific explanation requires theoretical integration between the local model described in the explanation and a global theory with independent explanatory power. Sir Isaac Newton left a voluminous legacy of writings. Despite his influence on the early modern period, his correspondence, manuscripts, and publications in natural philosophy remain scattered throughout many disparate editions. In this volume, Newton's principal philosophical writings are for the first time collected in a single place. They include excerpts from the Principia and the Opticks, his famous correspondence with Boyle and with Bentley, and his equally significant correspondence with Leibniz, which is often ignored in favor of Leibniz's later (...) debate with Samuel Clarke. Newton's exchanges with Leibniz place their different understandings of natural philosophy in sharp relief. The volume also includes 'De Gravitatione', offered here in a corrected translation, which is crucial for understanding Newton's relation to his great predecessor Descartes. This paper discusses the idea that trade – the practice of regularised exchange of goods or services between nation-states for mutual advantage under an orchestrated system of rules – can generate moral duties, duties that exist between only participants in the activity. It considers this idea across three duties often cited as duties of trade: duties not to harm; duties to provide certain basic goods; and duties to distribute benefits and burdens fairly. The paper argues that these three duties seem (...) unlikely contenders for duties thought in some sense to supervene on trade, the former two because they seem to exist regardless of the existence of trade and the latter because it seems to apply to a group more widely conceived than to be coherently thought centred on trade. It concludes that, at least across these three duties, it is more plausible to think that they are duties which, although possibly having relevance for how trade is conducted, do not emerge from the practice and are, rather, grounded elsewhere. This study examines how heightened expectations of board responsibility and accountability affect the socio-cognitive decision-making of boards and their collective task performance. Using data from the directors of 60 boards who served before and after the enactment of Sarbanes–Oxley, this study provides insight into the potential negative impact that this tightened accountability environment can have on a board’s task performance. Examining several socio-cognitive elements of board decision-making, board authority is found to have a positive main effect on board task performance, (...) while relative CEO power and affective conflict have curvilinear relationships with board task performance. Cohesiveness also moderates the relationship between a board’s perceived uncertainty and affective conflict with board task performance. In sum, the model shows how a new era of director accountability can affect the social cognitions of board decision-making that underlie board task performance. (shrink)

Majority-Minority electoral districts, while increasing the number of minorities in legislatures, work to deepen divisions among racial groups, to exacerbate the systematic disadvantages of some individuals, and to impede effective representation. I examine another form of race-conscious districting that will increase marginalized minority presence in legislatures while avoiding these problems.
