Black Feminist Sociology offers new writings by established and emerging scholars working in a Black feminist tradition. The book centers Black feminist sociology within the sociology canon and widens is to feature Black feminist sociologists both outside the U.S. and the academy. Inspired by a BFS lens, the essays are critical, personal, political and oriented toward social justice. Key themes include the origins of Black feminist sociology, expositions of BFS orientations to research that extend disciplinary norms, and contradictions of the (...) pleasures and costs of such an approach both academically and personally. Authors explore their own sociological legacy of intellectual development to raise critical questions of intellectual thought and self-reflexivity. The book highlights the dynamism of BFS so future generations of scholars can expand upon and beyond the book's key themes. (shrink)

“Vulnerability” is a key concept for research ethics and public health ethics. This term can be discussed from either a conceptual or a practical perspective. I previously proposed the metaphor of layers to understand how this concept functions from the conceptual perspective in human research. In this paper I will clarify how my analysis includes other definitions of vulnerability. Then, I will take the practical‐ethical perspective, rejecting the usefulness of taxonomies to analyze vulnerabilities. My proposal specifies two steps and provides (...) a procedural guide to help rank layers. I introduce the notion of cascade vulnerability and outline the dispositional nature of layers of vulnerability to underscore the importance of identifying their stimulus condition. In addition, I identify three kinds of obligations and some strategies to implement them. This strategy outlines the normative force of harmful layers of vulnerability. It offers concrete guidance. It contributes substantial content to the practical sphere but it does not simplify or idealize research subjects, research context or public health challenges. (shrink)

Amidst broad debates about the “New Green Revolution” in Africa, input-intensive agriculture is on the rise in some parts of Africa. This paper examines the underlying drivers of the recent and rapid adoption of herbicides and genetically modified seeds in the Burkina Faso cotton sector. Drawing on 8 months of ethnographic fieldwork in the Houndé region, this article contends that economic and cultural dynamics—often considered separately in analyses of technology adoption—have co-produced a self-reinforcing technological treadmill. On the one hand, male (...) farmers seek to increase cotton production in response to an economic squeeze. At the same time, broader cultural shifts toward individualism have created labor shortages as a result of families splitting apart, parents putting their children in school, and some women and young men refusing to provide free labor. Male cotton farmers thus increase production by turning to labor-saving inputs like herbicides, but these inputs create more debt, further locking farmers into intensive production. This article thus expands on the classic concept of the technological treadmill, demonstrating how economic and cultural processes intersect within a process of agrarian change to drive labor-saving agricultural technology adoption in the Burkinabè cotton sector. This expanded treadmill concept illuminates the complex dynamics compelling farmers’ choices to opt into input-intensive agriculture, and also helps explain rising farmer differentiation, as poorer farmers struggle to stay afloat and wealthier farmers expand. In this musing we consider how social distancing, the primary public health measure introduced to mitigate the spread of the COVID-19 virus, is creating social encounters characterized by a self-and-other-consciousness and an atmosphere of suspicion, leading to what we call “alienated embodied communication.” Whilst interaction rituals dominated by avoidance, fear and distrust are novel for many individuals who occupy positions of social privilege, Black and ethnic minority writers have demonstrated that the alienated bodily communication of COVID-19 social distancing is “nothing (...) new” for people who routinely experience marginalization as a result of racism. Our aim in this musing, then, is to reflect on how on-going experiences of stigma, shame, and marginalization can shape how social distancing is registered on an embodied and existential level, and therefore how social distancing may differentially impact individuals with lived experiences of racism. The concept of vulnerability is widely used in bioethics, particularly in research ethics and public health ethics. The traditional approach construes vulnerability as inherent in individuals or the groups to which they belong and views vulnerability as requiring special protections. Florencia Luna and other bioethicists continue to challenge traditional ways of conceptualizing and applying the term. Luna began proposing a layered approach to this concept and recently extended this proposal to offer two new concepts to analyze the concept (...) of vulnerability, namely understanding external conditions that trigger vulnerability and layers of vulnerability with cascading effects. Luna's conception of vulnerability is useful, which we demonstrate by applying her layered view and the new analyses in multiple contexts. We begin by outlining Luna's view and we use vignettes from healthcare involving transgender patients, the care of patients in psychiatric contexts, and research involving prisoners to illustrate how each part of Luna's concept elucidates important moral issues. In this article I examine several criticisms of the concept of vulnerability. Rather than rejecting the concept, however, I argue that a sufficiently rich understanding of vulnerability is essential to bioethics. The challenges of international research in developing countries require an understanding of how new vulnerabilities arise from conditions of economic, social and political exclusion. A serious shortcoming of current conceptions of vulnerability in research ethics is the tendency to treat vulnerability as a label fixed on a particular subpopulation. My (...) paper examines the role of this “label” metaphor in current statements of research ethics. In contrast to this prevailing “label” metaphor, my own positive account of vulnerability develops a dynamic way of understanding the structure of the concept of vulnerability based on the idea of “layers of vulnerability.” I examine several cases involving women, as they are sometimes labeled as a vulnerable population and sometimes not. My analysis demonstrates the essential role of this revised concept of vulnerability in bioethics and research ethics. (shrink)

Cantor’s proof that the powerset of the set of all natural numbers is uncountable yields a version of Richard’s paradox when restricted to the full definable universe, that is, to the universe containing all objects that can be defined not just in one formal language but by means of the full expressive power of natural language: this universe seems to be countable on one account and uncountable on another. We argue that the claim that definitional contexts impose restrictions on the (...) scope of quantifiers reveals a natural way out. (shrink)

Experiences of shame are not always discrete, but can be recurrent, persistent or enduring. To use the feminist phenomenologist Sandra Lee Bartky’s formulation, shame is not always an acute event, but can become a “pervasive affective attunement” (Bartky, 1990 : 85). Instead of experiencing shame as a discrete event with a finite duration, it can be experienced as a persistent, and perhaps, permanent possibility in daily life. This sort of pervasive or persistent shame is commonly referred to as “chronic shame” (...) (Pattison, 2000 ; Nathanson, 1992 ; Dolezal, 2015 ). Chronic shame is frequently associated with political oppression and marginalization. In chronic shame, it is the potentiality of shame, rather than the actuality, that is significant. In other words, the anticipation of shame (whether explicit or implicit) comes to be a defining feature of one’s lived experience. Living with chronic shame has important socio-political consequences. Thus far, chronic shame has eluded simple phenomenological analysis, largely because chronic shame often does not have a clear experiential profile: it is frequently characterised by the _absence_ rather than the _presence_ of shame. The aim of this article is to provide a phenomenology of chronic shame, drawing from Edmund Husserl’s formulation of the ‘horizon’ as a means a to discuss structural aspects of chronic shame experiences, in particular how chronic shame is characterised by structures of absence and anticipation. We develop an argument sketched by Luna (2011) based on the Pinocchio paradox, which was proposed by Eldridge-Smith and Eldridge- Smith (2010). We show that, upon plausible assumptions, the claim that mental states supervene on bodily states leads to the conclusion that some proposition is both paradoxical and not paradoxical. In order to show how the presence of paradoxes can be harnessed for philosophical argumentation, we present as well a couple of related arguments.

Lì presented to the campus health provider one month prior with fatigue, abdominal pain, and jaundice. He and his parents immigrated to the United States from China when he was a child. He was well aware that he had hepatitis B from what is termed (...) "vertical transmission." His mom unknowingly passed on this virus to him during her pregnancy. In most countries with a high prevalence of the virus, prenatal screening is routinely undertaken, and prophylaxis administered. I am not certain this occurred in Lì's case and at this point it did not matter. Lì knew he would live with this for the duration of his life. In fact, he told me he had gone his whole life to this point without any symptoms whatsoever. What is known about chronic hepatitis B infection is that in most people affected, it can be considered a chronic disease where most live a long full life. The risk of advancing to liver cirrhosis or cancer in general is low. This unfortunately was not the case with Lì.What transpired was what they most feared. As he was studying for his final exams, Lì endured days of worsening fatigue, malaise, and nausea. He noticed his skin was a tinge of yellow and he was having some itching that was unusual. He noticed his clothes fitting more loosely and found he had unintentionally lost twenty pounds. He visited the campus health center and after a series of tests and imaging studies, Lì was diagnosed with advanced hepatocellular carcinoma, an unfortunate sequela of this chronic infection. It was then that he put school on hold and returned home to get further care.I first met Lì in the hospital as a consultant for the palliative medicine service. "He won't listen." "He is so difficult." "He is in denial." These were examples of some of the care team's exasperated assessments of his demeanor as a patient. What I did not realize prior to visiting him the first time was that Lì was a pre-clinical medical student. When I first met him, he did not want to talk very much; he was preoccupied and distant. In retrospect, I can see that he was suffering on so many levels. His appearance was gaunt and cachectic. The lights in the room cast shadows in the concave areas of his temples and his collarbones were the most prominent feature of his torso through his hospital gown. He glowed yellow from jaundice. When I examined him on this first visit, I noticed that his liver, a now grossly enlarged hard and nodular structure, occupied most of his abdomen. I found that speaking to him as a colleague, even calling him "doctor," helped him feel respected and enabled me to build rapport with him. At one point, I described to him the findings I felt in his abdomen. "I can palpate the edge of your liver here, what seems to be eight centimeters below your costal margin. There are many palpable nodularities on the ventral surface." It was at this point I invited him to palpate what I was feeling. I gently guided his own hand over his abdomen and noticed him studying the features as if they were not his own, like a skilled diagnostician.Over the course of three weeks, I visited with Lì when I was on service. Traditional accounts of vulnerability tend to label entire populations as vulnerable. This approach is of limited utility. Instead, this article utilizes a layered approach to vulnerability, identifying multiple vulnerabilities that older people experience. It focuses on distinguishing the different layers of vulnerability that may be experienced by the elderly in middle-income countries of Latin America. In doing so, I show how the layered approach to vulnerability functions, and demonstrate why it is more interesting and useful than the traditional approach. The (...) article achieves three things. First, it unwraps the different potential layers of vulnerability that develop in old age and the multidimensionality aspects of aging. Second, it reestablishes the usefulness of the concept of vulnerability and explains its functioning. Finally, it shows how different policies can be designed in order to address each vulnerability layer. The layered account promotes a multifaceted approach to public policy analyses and design. In this sense, the layered concept of vulnerability is an appealing concept to consider in public health ethics. (shrink)

Legal norms serve as practical standards for individuals and officials. While this ‘normative aspect’ of law is widely acknowledged, its significance for theories of law remains contested. In this paper, I examine three views on the matter. First, that we should explain legal norms as reason-giving. Second, that we should explain legal discourse as being about reasons for action. Third, that we should explain law as capable of being reason-giving. I survey some challenges associated with each of these views. What (...) they have in common is an implicit assumption about the form that normative explanation must take: that it must be a linear, non-reductive explanation. There is an alternative model for normative explanation available, however. That model explains normative notions in terms of the practices and attitudes involved in recognizing, offering, and demanding them. I highlight the potentials, and limitations, of this practice-centered alternative. (shrink)

A common argument in support of a beginning of the universe used by advocates of the kalām cosmological argument (KCA) is the argument against the possibility of an actual infinite, or the “Infinity Argument”. However, it turns out that the Infinity Argument loses some of its force when compared with the achievements of set theory and it brings into question the view that God predetermined an endless future. We therefore defend a new formal argument, based on the nature of time (...) La instalación El archivo de los abuelos, 1995, es el resultado de un proyecto de investigación que el artista Christian Boltanski realizó junto con los estudiantes de la Universidad de Leuphana, Luneburgo (Alemania) en la misma institución. El archivo reúne efectos personales de los abuelos de los estudiantes de aquella generación. Se trata de una pieza significativa dentro de la obra del francés porque no se atiene a las características habituales de sus obras de archivo, a las que denomino «meta-archivos» (...) por su carácter posmoderno de desestabilización del concepto mismo de archivo, y consecuentemente, del de documento y del de historia. El proyecto hizo patente el silencio sobre el Tercer Reich imperante en la época dentro de las familias, e hizo que este pasado reprimido resurgiese. Asimismo, puso de manifiesto los orígenes nazis del campus universitario. Por estos motivos, pese a poder considerarse un «meta-archivo fallido», es una obra de arte relevante y pertinente a nivel socio-cultural, y dentro de la obra de Boltanski, al arrojar luz sobre sus tácitos modus operandi y objetivos habituales precisamente por no cumplirlos. En 1967, Helmuth Plessner publica en Merkur una síntesis de su pensamiento titulado «El ser humano como ser vivo». Este trabajo de investigación ha consistido en realizar una traducción, con un gran número de aparato crítico en forma de notas, y con un estudio introductorio. En el texto, Plesner expone el carácter diferencial del viviente humano en comparación con los demás animales, carácter por el que trasciende el ámbito de lo zoológico, permaneciendo no obstante en él. Por eso, el estudio (...) introductorio, se centra tras las cuestiones historiográficas pertinentes, en las condiciones antropológicas de posibilidad de la posicionalidad diferencial del ser humano ante la realidad, también la propia. The concept of vulnerability has been hotly debated in research ethics literature. Some critics considered it a useless concept. In 2009—against some of those criticisms—I defended the importance of understanding this concept in terms of layers instead of applying it as a label given to certain subpopulations. In this paper, I present some of the limits of this analysis and I also explore the similarities and differences this approach has when compared to using a taxonomy as another answer on how (...) to assess vulnerability. I present the notion of cascade vulnerability and underscore the dispositional character of layers and their relevance to identify and evaluate layers of vulnerability. Finally, I show how this layered account has been incorporated in important documents such as the new 2016 CIOMS-WHO Guidelines. (shrink)

This book investigates the concept of body shame and explores its significance when considering philosophical accounts of embodied subjectivity, providing phenomenological reflections on how the body is shaped by social forces.

To show that discrimination against the terminally ill is a real and worrisome phenomenon Reed presents four examples1. Here, I focus on the final two: right-to-try and right-to-die laws. I argue that they are not instances of discrimination, because they grant rights. Reed appears to have overlooked that rights differ from obligations in ways that leave his argumentation unsuccessful. According to the most prominent theory of rights, rights function to protect the personal interests of their holders.2 For that reason, strengthening (...) rights implies weakening discrimination. Granting women the right to vote by itself meant that they were being less discriminated against. Rights also fail to meet standardly accepted definitions of discrimination. As Reed explains, for discrimination to occur, it is necessary that a significant disadvantage is imposed on a socially salient group. Policies can impose disadvantages by being obligations. While rights sometimes enable disadvantages, they never impose them. More precisely, rights may entitle their holders to subject themselves to disadvantages. The right to try entitles the terminally ill to subject themselves to harms caused by investigational drugs. The right to die entitles the terminally ill to voluntarily subject themselves to the deprivation of life. Contrast this with a policy that requires the terminally ill to take investigational drugs. Such a policy would be discriminatory. Whether rights can nevertheless …. (shrink)

Research on the U.S. women’s movement has documented the difficulties of cross-racial work between White women and women of racial/ethnic minorities. Less understood is how racial/ethnic minorities do cross-racial work among themselves to construct a collective identity of “women of color” that encourages solidarity across race, class, and other statuses. Drawing on research from the reproductive justice movement, I examine how women of color organizations that strive for intersectional praxis negotiate sameness and difference. I identify two different logics at work (...) within women of color organizations: the first relies on a presumption of “same difference” that emphasizes similar experiences of gender and race oppression; the second accords greater recognition to the “difference-in-sameness” that structures constituents’ lived experiences. While the former can reproduce precisely those forms of silencing and exclusion that women of color organizations seek to challenge, the second remains a ongoing process. The article concludes that women of color organizations must strive continuously to actively negotiate, rather than assume, commonality if they are to avoid reproducing various forms of marginalization and inequality. In this article I focus on two issues concerning bioethics in Argentina: reproductive health and ethics in research. Although these topics are quite dissimilar, they share a particular feature: their special relationship with context.

Throughout this essay, I will consider an argument frequently used to justify paternalistic behavior toward a specific class of persons: illiterate people. The argument states that illiterate people are uneducated, lack information and understanding, and are thus unable to make decisions. Therefore, it is argued, paternalism in their case is justified. The conclusion is that illiterate persons cannot be autonomous. The justification for this view is based on an a priori attitude: since it is impossible to communicate, physicians should decide (...) which kind of treatment the illiterate patient should receive. This argument is frequently used even though its proponents may not be aware of its implications. Given the importance and uncritical acceptance this argument has in Argentina, and also in other Latin American countries, I think it is relevant to analyze carefully what it means. I propose a thorough analysis of this argument, of its implications and an evaluation of whether it is acceptable. (shrink)

Poincaré in a 1909 lecture in Göttingen proposed a solution to the apparent incompatibility of two results as viewed from a definitionist perspective: on the one hand, Richard’s proof that the definitions of real numbers form a countable set and, on the other, Cantor’s proof that the real numbers make up an uncountable class. Poincaré argues that, Richard’s result notwithstanding, there is no enumeration of all definable real numbers. We apply previous research by Luna and Taylor on Richard’s paradox, (...) indefinite extensibility and unrestricted quantification to evaluate Poincaré’s proposal. We emphasize that Poincaré’s solution involves an early recourse to indefinite extensibility and argue that his proposal, if it is to completely avoid Richard’s paradox, requires rejecting absolutely unrestricted quantification: Richard’s paradox provides a context in which paradox seems inescapable if unrestricted quantification is possible. In proposing his solution to the apparent conflict between Richard’s and Cantor’s results, Poincaré employs temporal expressions whose exact meaning he does not clarify. We suggest an interpretation of these expressions in terms of order of availability and briefly discuss its explanatory power in topics like paradoxes, limitation theorems and indefinite extensibility. This short article is a commentary to ‘Vulnerability in Research Ethics: A way forward’ from Margaret Meek Lange, Wendy Rogers and Susan Dodds. In their article they describe and accept my criticisms of the subpopulation approach to vulnerability and my analysis of vulnerability based on layers, but they suggest going beyond it using a taxonomy to classify layers of vulnerabilty. I argue that a) we do not need a taxonomy to classify vulnerabilities, b) the authors do not provide an adequate (...) or successful taxonomy, and c) they are unable to link their taxonomy to specific obligations. Thus I propose avoiding an approach that requires taxonomies, and suggest instead using some characteristics of layers of vulnerability. (shrink)

Jean-Paul Sartre's account of the Look in Being and Nothingness is not straightforward and many conflicting interpretations have arisen due to apparent contradictions in Sartre's own writing. The Look, for Sartre, demonstrates how the self gains thematic awareness of the body, forming a public and self-conscious sense of how the body appears to others and, furthermore, illustrates affective and social aspects of embodied being. In this article, I will critically explore Sartre's oft-cited voyeur vignette in order to provide a coherent (...) account of the Look and to illustrate the significance of intersubjectivity and self-consciousness in Sartre's work. Through considering Sartre's voyeur vignette and other examples of reflective self-consciousness, this article will examine epistemological, self-evaluative and ontological concerns in the constitution of reflective self-consciousness. It will be contended that Sartre's accounts of the Look and reflective self-consciousness within social relations can provide insight into the intersubjective nature of the shaping of the body and the significance of self-presentation within the social realm. Problematizing the production of gender -and specifically of the feminine in the school context- is particularly complex. For some time now, it has been the students themselves who have pointed out the disagreement with an educational system that persists in implementing both institutional and daily actions that shape and produce sexist differences in a significant way. The school has thus become a space of dispute and territory in conflict, where new perspectives of girls and young women coexist in relation to (...) the demands for rights, to make their voices heard and to publicly express their disagreement, in the current context of mobilizations that question the prevailing neoliberalism. From the above framework and context, ethnographies conducted in two educational establishments, during 2014-2018, will be analyzed. In them, it is possible to identify two relevant argumentative axes that account for the production of women as second-class subjects, accentuating the analysis in the crossing between the forms of economization of life in a neoliberal key, and the implications of this from a gender perspective.
