The aim of this paper is to propose a hermeneutics of the judicial text based on Paul Ricoeur’s philosophy. For this purpose, the paper will propose, firstly, how to approach the judicial decision as text; secondly, the paper will argue from Paul Ricoeur’s notion of “Hermeneutic Arc,” how explanation and understanding as a hermeneutic method are given in the judicial decision. Sin embargo, llama la atención que la mayoría de esos preocupados lectores no considera las rectificaciones que el autor hace a esa formulación. Examinar esas rectificaciones, en relación con los desplazamientos del pensamiento de Foucault, es el propósito de estas reflexiones e inflexiones.

This paper reports on an action research project about organizational change by a regional food bank in New York State’s southern tier. While the project team initially included a sociologist, food bank leadership and staff, it expanded to involve participants in food access programs and area college students. This paper combines findings from qualitative research about the food bank with findings generated through a collaborative inquiry about a ten-year process of organizational change. We ask how a regional food bank can (...) change its approach to address root causes of hunger. Acknowledging that narrow, pragmatic definitions of hunger promote charitable responses, our collaboration is grounded in structural understandings of poverty that refuse to blame the poor or treat poverty as an accident. Decades-long economic restructuring, deindustrialization and a rise in the service economy have resulted in growing inequality and long-term demand for “emergency” food in New York State. We outline critiques by scholars and practitioners of the emergency food regime. Description and analysis of the organizational change efforts of the Food Bank of the Southern Tier combine discourse analysis, collaborative inquiry, interviews, and participant observation. Discourse analysis of the agency’s strategic plans documents changes in aspirations, exposure to new epistemic communities and repertoires of actions. Interviews with participants evidence impacts of the organization’s advocacy and education programs on people with lived experience in poverty. Through a participatory process, we developed a collaborative chronology of phases of organizational change. Collaborative analysis of organizational changes demonstrates new definitions of the problem, a shift in service focus, changing outcomes and increased funding for advocacy. While recognizing substantial constraints, this project contributes to evidence that food banks may shift their discourse and practices beyond charity. (shrink)

El artículo de Bunge The concept of a problem, que pertenece a una serie de entregas más amplias titulada Inverse problems publicada en el primer volumen de Scientia in verba Magazine, concluye interesantemente la tesis de esta forma: «The problematics of a field is the set of ideas and procedures that, far from being above criticism, raise problems worth being investigated. The degree of maturity of a discipline may be estimated by the state of its problematics. A discipline with more (...) problems than achievements is immature, while one without problems is either embryonic or already spent. For example, accounting hardly raises any research problems, while quantum physics keeps sparking off interesting controversies. A practical spinoff of the preceding is this: those who need a voluminous to get or keep a job should work on unproblematic subjects, while those who look for intellectual stimulation should work on problematic». Aunque estoy de acuerdo por mucho con el uso de las fórmulas y el diagnóstico, sobre todo con respecto al vacío de literatura filosófica sobre el concepto de “problema” como tal y la necesidad de clarificación cuando consideramos las condiciones generales del concepto y las variedades de uso a través de varios campos, debo apartarme de algunos enunciados cuya severidad y precisión me hacen dudar de cualquier utilidad general en el texto como un todo. Firms face mounting pressure to appoint ethical leaders who will avoid unnecessary risk, scandal and crisis. Alongside mounting evidence that narcissistic leaders place organizations at risk, there is a growing consensus that women are more ethical, transparent and risk-averse than men. We seek to interrogate these claims by analyzing whether narcissism is as prevalent among women CEOs as it is among men CEOs. We further analyze whether narcissistic women CEOs take the same types of risk as narcissistic men CEOs. Drawing (...) on social role and token theories, we test hypotheses related to gender differences in the prevalence and impact of CEO narcissism on firm-level practices. Using a unique dataset that includes a large sample of CEOs of S&P 1500 companies from 1992 through 2014, we create a narcissism composite score for each CEO based on their photograph size in the annual report, and their cash earnings and non-cash earnings relative to the next highest paid executive. We find that women CEOs are less likely to exhibit narcissistic personality traits compared to men CEOs. Furthermore, we find that gender moderates the relationship between narcissistic CEOs and our outcome variables of risk-taking and questionable behaviors. (shrink)

How precisely to understand and evaluate counterfactuals can be an intricate issue. The aim of this article is to examine a new set of difficulties for evaluating counterfactuals that arise in the context of the dynamical spacetimes described by the theory of general relativity. The initial value formulation provides us with a methodology to pin down the specific combination of features of the theory at the origin of the difficulties, namely, non-linearity and certain non-local aspects, in particular when combined with (...) the global and/or quasi-local character of physical quantities in general relativity. Finally, we connect the philosophical question about counterfactuals with concrete applied physical issues in general relativity about extracting meaningful predictions by constructing appropriate initial data sets, leading us to question the very suitability of the Cauchy approach to fully account for the explanatory power of the theory. The principle of beneficence directs healthcare practitioners to promote patients’ well-being, ensuring that the patients’ best interests guide treatment decisions. Because there are a number of distinct theories of well-being that could lead to different conclusions about the patient’s good, a careful consideration of which account is best suited for use in the medical context is needed. While there has been some discussion of the differences between subjective and objective theories of well-being within the bioethics literature, less attention has been (...) given to the questions of what work a theory of well-being needs to do in bioethics and which standards of success ought to be used in selecting a theory of well-being for use in medicine. In this article, I argue that traditional theories of well-being developed in philosophy are not well suited to meet the needs of the medical context. For the principle of beneficence to be most useful, the underlying account of well-being should satisfy two conditions: first, it needs to lead to a concrete, action-guiding determination of the patient’s good; and, second, any recommendations it offers need to be justifiable to patients. Standard accounts of well-being have difficulty satisfying both conditions. Exploring the limitations of these theories when applied to treatment dilemmas helps point the way toward the development of an account of well-being better suited to healthcare. (shrink)

Para ello, Grandes (...) propone una versión, subversión y parodia tanto de modelos masculinos como femeninos a la vez que exhibe la incapacidad de escapar al modelo femenino impuesto por el patriarcado. As traditional organizations using their websites for eCommerce transactions are increasing at an exponential rate, privacy concerns of users are also on the rise. To gain an insight into these concerns, existing policies and legislation, we conducted the research reported in this paper, in 2003. To augment the literature synthesis, a multiple case study analysis was conducted, based on six large organisations in Australia. Our research findings suggested that in the Australian context, an online privacy policy on the website which (...) complies with the Privacy Act, supported by few best practices are reasonably able to address online privacy concerns. However, these findings are restricted in time frame, indicative and relevant in the Australian context. Nevertheless, we hope to stimulate academic research enquiry and discussion forums through this research. (shrink)

Este artículo analiza los argumentos biologicistas a través de los cuales Paul Valéry interpreta el fenómeno de la vida. Para ello, se empieza por mostrar el poder creativo que revela la naturaleza en virtud de las leyes de estructuración y orden que comienzan a hacerse visibles a nivel de las estructuras moleculares que dan forma al universo. Después de eso, se estudia la redefinición que el autor hace del concepto de materia, a la luz de los hallazgos científicos alcanzados en (...) su época. Luego, son expuestas las características esenciales de la vida, determinadas por la integración complementaria entre la ley de conservación y la ley de transformación de la naturaleza. Asimismo, son presentados los planteamientos por los cuales el fenómeno de la muerte es tomado como una propiedad característica de la vida, al igual que los argumentos por los cuales la vida es considerada como producto del azar. Finalmente, se hace referencia a la precariedad y finitud de la vida, explicitadas por Valéry desde la teoría del evolucionismo. (shrink)

China is a country with a long-standing and rich history. This rich history is also expressed in its cultural, religious and philosophical diversity. One of China’s most prominent and influential philosophical strands is Daoism, which is still practiced today despite the political turmoil of the 20th century. It came into existence at roughly the same time as Confucianism. This paper focuses on a particular work of the Daoist canon, which at the same time is one of its most prominent ones: (...) The Dao De Jing by Laozi. The purpose of this paper is to evaluate in how far the virtues described in the Dao De Jing are applicable in a business context. Thereby this paper presents a first draft to turn the Dao De Jing into a “virtue ethics for business” by a thorough and comprehensive analysis of all 81 chapters based on drawing on eight different translations. Deliberative Transformative Moments (DTM) is a new concept that serves as an amendment to the DQI. With this new concept it is easier to get at the quick give-and-take of discussions of small groups of ordinary citizens. As an illustration, we apply the concept to discussions about the peace process among Colombian ex-combatants, ex-guerrillas and ex-paramilitaries. Specifically, we show how personal stories can transform a discussion from a low to a high level of deliberation and how they can have the (...) opposite effect. To increase the level of deliberation in the general population, we recommend that good illustrations of DTM’s should be part of the school programs from an early age on, so that children learn how to discuss with others who have different opinions and values. This study examines what Social Studies teachers can learn from Gay-Straight Alliances (GSA) in terms of the content that club members examine and the queer pedagogical approaches they employ. Findings reveal how educators can borrow students’ queer teaching and learning practices, and integrate their insights within Social Studies classrooms to disrupt (hetero/cis)normativity. Data derived from semi-structured interviews with five Canadian high school GSA members were analyzed using the queer theoretical and pedagogical insights of Britzman (1995. Educational Theory, 45(2), 151–165 ; (...) 1998. Lost subjects, contested objects: towards a psychoanalytic inquiry of learning. New York, NY: State University of New York Press), Sedgwick (1990/2008. Epistemology of the closet. Berkeley and Los Angeles, CA: University of California Press.), and Shlasko (2005 Equity & Excellence in Education, 38(2), 123–134). Three prominent themes emerged: (1) GSAs’ queer educative role compensated for a void in LGBTQ curricular content. Although LGBTQ-inclusive content was evident within some Social Studies, English, and French classes participants called for their teachers to integrate more content that disrupts homophobia and transphobia; (2) the personal characteristics of GSA members provide insight into how Social Studies educators can mirror students’ drive to learn about and challenge preconceived and (hetero/cis)normative assumptions/beliefs; and (3) GSA's queer educational approaches differed from the (hetero/cis)normative teaching and learning practices of their educators. GSA members engaged in student-led dialogue, and spearheaded queer initiatives and events to contest anti-LGBTQ attitudes at their schools. It is argued that when educators follow the lead of GSA members they may enhance their approach to and engagement with LGBTQ topics, and expand the queer pedagogical potential of the Social Studies. This article explores the ethics of migrant marketers in Guangzhou. Data were collected from 357 migrant marketers who lived in Guangzhou. A model of Ethical Action has been developed to test the antecedents and outcomes of the ethical decision-making process. It measured moral intention using four ethical scenarios. The results show that the egoistic schema had a positive effect on their intention to act unethically, while the legislative schema exerted a negative effect. The results confirm that moral intention was a (...) strong predictor of an individual's subsequent actual behavior, and it fully mediated the influence of the legislative schema on actual behavior. This study adds to ethics literature by incorporating the construct of social identity and found a moderating effect between the legislative schema and moral intention. The relationships were stronger for individuals who were lower rather than higher in social identity. Analysis of these results lead to a discussion of the implications for marketing ethics in China. The U.S. health care system is ostensibly market based and therefore at least partially reliant on competition and consumer demand to regulate costs. Yet information about an essential feature of market transactions—costs—is typically obscure to patients until long after treatment. When discussing what must be disclosed for informed consent, the same list of required information is often mentioned regardless of the health care system in question, and information about costs rarely merits a place within this list. However, our assumptions about (...) what a moral principle requires need to be responsive to the realities of the health care system in which the principle is applied.This paper explores the moral foundations of disclosure and informed consent to argue that, in a market‐based system of the sort found in the United States, these same considerations support a requirement to disclose out‐of‐pocket costs before patients receive care. Next, I consider two objections to this view: first, that health care practitioners should focus solely on medical considerations in their encounters with patients and, second, that disclosing out‐of‐pocket costs would be too difficult to be mandated. I argue that medical and financial interests are inseparable within the U.S. health care system. If the difficulties in disclosing costs are deemed insurmountable, then the current system may prove unsustainable, both morally and financially, since we face the same practical impediments to implementing any meaningful consumer‐driven, market‐based health care reform. Finally, I explore some of the consequences of failing to disclose costs. The requirements of disclosing costs can be supported by the principle of respect for autonomy, regardless of the consequences, but in light of the consequences of the decision of whether to disclose, a concern about justice provides further support. Leaders play a critical role in setting the tone for ethical climate in organizations. In recent years, there has been an increased skepticism about the role played by corporate executives in developing and implementing ethics in business practices. Sales and marketing practices of businesses, particularly in the pharmaceutical industry, have come under increased scrutiny. This study identifies a type of leadership style that can help firms develop an ethical climate. Responses from 333 salespeople working for a North American subsidiary of (...) an international pharmaceutical company were used to analyze the impact of instrumental leadership on ethical climate. We also examined the effect of ethical climate on effort, satisfaction with the supervisor, and job satisfaction. Managerial implications are provided. (shrink)

The consequence argument for the incompatibility of free action and determinism has long been under attack, but two important objections have only recently emerged: Warfield’s modal fallacy objection and Campbell’s no past objection. In this paper, I explain the significance of these objections and defend the consequence argument against them. First, I present a novel formulation of the argument that withstands their force. Next, I argue for the one controversial claim on which this formulation relies: the trans-temporality thesis. This thesis (...) implies that an agent acts freely only if there is one time at which she is able to perform an action and a distinct time at which she actually performs it. I then point out that determinism, too, is a thesis about trans-temporal relations. I conclude that it is precisely because my formulation of the consequence argument emphasizes trans-temporality that it prevails against the modal fallacy and no past objections. (shrink)

Además del desafío propiamente jurídico que plantean la interamericanización del derecho y los proyectos que propugnan por un constitucionalismo transformador de las desigualdades sociales y políticas que aquejan a los países de la región, se plantean retos de naturaleza política. Sobresalen la inclusión social y la debida representación política. Dentro de los retos filosóficos se encuentra la depuración de conceptos que sofistiquen y precisen las categorías con las cuales describimos nuevos fenómenos en América Latina.

Se investiga el alcance y los límites de la concepción política de Jacques Rancière. En primer lugar, se hace una presentación esquemática de lo que el filósofo francés entiende por “política” (en donde se trata la distinción entre policía y política, el desacuerdo y la subjetivación). En segundo lugar, y tomando una disposición máscrítica, se busca evidenciar el alcance y los límites de esta concepción de la política como interrupción. Con ello se ponen de presente las ventajas y los problemas (...) del pensamiento político rancieriano. Por último, vinculando estas reflexiones con lahistoria y la memoria, se busca proponer una nueva concepción de la política como interrupción que supere los límites antes mencionados. (shrink)
