ELUCUBRAÇÕES SOBRE O CAOS JURÍDICO BRASILEIRO: E A CULPA, É DE QUEM?

Artificial intelligence (AI) systems are increasingly being used not only to classify and analyze but also to generate images and text. As recent work on the content produced by text and image Generative AIs has shown (e.g., Cheong et al., 2024, Acerbi & Stubbersfield, 2023), there is a risk that harms of representation and bias, already documented in prior AI and natural language processing (NLP) algorithms may also be present in generative models. These harms relate to protected categories such as (...) gender, race, age, and religion. There are several kinds of harms of representation to consider in this context, including stereotyping, lack of recognition, denigration, under-representation, and many others (Crawford in Soundings 41:45–55, 2009; in: Barocas et al., SIGCIS Conference, 2017). Whereas the bulk of researchers’ attention thus far has been given to stereotyping and denigration, in this study we examine ‘exnomination’, as conceived by Roland Barthes (1972), of religious groups. Our case study is DALL-E, a tool that generates images from natural language prompts. Using DALL-E mini, we generate images from generic prompts such as “religious person.” We then examine whether the generated images are recognizably members of a nominated group. Thus, we assess whether the generated images normalize some religions while neglecting others. We hypothesize that Christianity will be recognizably represented more frequently than other religious groups. Our results partially support this hypothesis but introduce further complexities, which we then explore. (shrink)

Most studies investigating the relationship between cultural constructs and ethical perception have focused on individual- and societal-level values without much attention to other type of cultural constructs such as social beliefs. In addition, we need to better understand how social beliefs are linked to ethical perception and the level of analysis at which social beliefs may best predict ethical perceptions. This research contributes to the cross-cultural ethical perception literature by examining the relationship of individual-level social cynicism belief, one of five (...) universally endorsed social beliefs, together with individual social dominance orientation and the perception of unethical behavior. By means of two studies, we examine these relationships across societies that significantly differ on societal-level social cynicism belief. Using 371 business students from Russia and the U.S. in Study 1 and 268 professionals from Portugal and the U.S. in Study 2, we found that individual-level social cynicism belief was positively associated with social dominance orientation. Social dominance orientation, in turn, mediated the relationship between individual social cynicism belief and the perception of unethical behavior. Although we found significant societal-level differences in social cynicism belief in both studies, the relationships between individual-level social cynicism belief, social dominance orientation, and the perception of unethical behavior were structurally equivalent across societies in both studies, suggesting that societal-level differences did not significantly affect these relationships. Implications for cross-cultural business ethics research and practice are discussed. (shrink)

This article tries to delineate the proposition that to Feuerbach nature is an autonomous and independent being that comes first in comparison to the spirit. To him, material nature, that exists in its qualitative differentness, independent from thinking, is the original source, the immediate, not deductible, uncreated fundament of all real existence, that exists and consists in itself, when put vis-a-vis the spirit. Feuerbach sets nature against the spirit, for it is his understanding that nature is not a pure other (...) that only through the spirit was set as nature, but as the first source, the objective material reality that exists outside reason and is given to man by means of his senses as fundament and essence of his life. Therefore, one is dealing first with that essence (light, air, water, fire, plants, animals etc) without which man does not exist or could be thought of as existing. To Feuerbach nature is all objects and essences put together. Under this condition it is possible to conceive nature as guarantor of externality itself as if it could exist independently from us, an entity that is unaware of itself and which exists in itself and by itself; for this reason it shall not be seen as something which it is not, i.e., neither divine nor human. Nature always existed, i.e., it exists in itself and has only meaning in itself; it is itself, i.e., it has no mystical essence, it does not hide behind it any absolute being whether human, divine, transcendental or ideal. Este estudo objetiva identificar os saberes específicos para o ensino de Língua Portuguesa de professores sem formação específica. Trata-se de uma pesquisa de abordagem qualitativa e biográfica, sendo de cunho exploratório, realizada a partir das histórias de vida. Utilizamos, para produção dos dados, os Ateliês Biográficos de Projetos proposto por Delory-Momberger. O corpus da pesquisa é composto pelas narrativas biográficas construídas nos encontros do ABP e empregamos a análise de conteúdo como técnica para análise dos dados. Assim, evidenciamos que os (...) professores revelaram saberes e não saberes advindos das relações sociais e de sua formação profissional. Constatamos, ainda, a existência de trajetórias marcadas por histórias de vida diferentes, mas que convergem na docência em Língua Portuguesa ; que estes professores aprendem nos caminhos da docência; que mesmo sem terem a formação específica conseguem ensinar. Dessa forma, percebemos os processos formativos a partir da perspectiva pedagógica presente na prática e da revelação de saberes e não saberes para o ensino de Língua Portuguesa, que contribuem para a construção de aprendizagens da docência. Neste trabalho apresentamos os resultados de uma pesquisa desenvolvida por uma aluna de graduação durante a realização de seu estágio docência. O objetivo da pesquisa foi investigar a relação entre trabalho e ensino de matemática em uma escola do campo na região sudeste do estado do Pará, na região norte do Brasil. A metodologia utilizada foi de inspiração etnográfica e os dados foram registrados no caderno de campo da pesquisadora. Também constitui material de análise as produções dos alunos e as (...) observações realizadas em sala de aula. Ao longo do texto apresentamos o contexto de realização da pesquisa, listando, de maneira breve, as principais características do curso de graduação no qual a pesquisadora está matriculada, bem como o contexto geográfico da comunidade onde está localizada a escola no qual a pesquisa foi realizada. Em seguida apresentamos nossa compreensão de duas noções centrais para nossa análise: conhecimento e trabalho. A primeira é tomada de um referencial teórico produzido no interior da Educação Matemática brasileira, conhecido como Modelo dos Campos Semânticos e a segunda é assumida em consonância com um referencial teórico marxista. Após o referencial teórico apresentamos a metodologia da pesquisa, destacando de modo geral as atividades que foram realizadas no estágio docência que se configurou como locus da produção dos dados da pesquisa. Nas análises, apresentamos as compreensões elaboradas pela pesquisadora a partir da articulação do referencial teórico com as atividades desenvolvidas durante o estágio. Colocamos em evidência que a compreensão de trabalho apresentada pelos alunos da escola investigada leva em consideração apenas o aspecto financeiro de algumas atividades realizadas por eles em seu dia a dia. Essa compreensão é colocada em contraste com a definição de trabalho apresentada pelos referenciais teóricos adotados. Por fim, tecemos algumas considerações sobre o uso de categorias tomadas da vida cotidiana nos processos de ensino e aprendizagem de Matemática. Apontamos que essa perspectiva teórica abre a possibilidade de uma ação didática que coloca em evidência a não centralidade da Matemática nos processos de produção de conhecimento, bem como viabiliza a utilização de outras categorias no processo de produção de conhecimento de modo não hierárquico em relação à ciência ocidental. In an entry of Papirer, located between the years 1842-1843 (IV C 100), entitled "On the concepts of Esse and Inter-Esse," Kierkegaard makes a fundamental methodological assertion: the various sciences should be ordered and built through the accent put on being (Vaeren - Esse). Thus, the ontology and mathematics, because they develop from a ground of elemental unity between thought and being, are a particular kind of science with epistemological well-defined characteristics. However, as Kierkegaard shows in Postscript, the same plea (...) can not be relied on what is named Inter-Esse. Thus, this paper aims to outline the general features of the concept of Inter-Esse as well as their connections with what, in that same entry, Kierkegaard calls "Existential Science" (Existentiel-videnskab). Esta pesquisa tem como temática as relações Interétnicas entre uma cigana Calón e uma brasileira evangélica na cidade de Jequié-Ba. Para a coleta dos dados utilizamos o método etnográfico. Como técnica de investigação utilizamos a observação participante de contato direto da pesquisadora com a pesquisadas e entrevistas semiestruturadas e o apoio do diário de campo.

Esta resenha versa sobre a obra Cidadania e Democracia Deliberativa de Catherine Audard que se refere à uma articulação rawlsiana entre uma teoria da justiça e as teses centrais do seu liberalismo político sobre o pluralismo razoável, democracia deliberativa, cidadania participativa, razão pública, direito dos povos e multiculturalismo.

O presente estudo propõe-se a analisar as medidas e os limites de precaução adotados pelos Poderes da República. Pretendem-se investigar as premissas em que estão fundamentadas as ações do Poder Judiciário, resultando no ativismo judicial. Ponderam-se, ainda, os limites do ativismo judicial e a harmonia entre Poderes. Ressaltam-se a importância atual da temática e a necessidade de exploração de suas repercussões para a construção social. A pesquisa, de viés qualitativo e de cunho exploratório, será lastreada em levantamento bibliográfico e dados (...) estatísticos obtidos através de fontes diversas. (shrink)

O pentecostalismo é a religião que mais cresce, em número de fiéis, no Brasil de acordo com a última contagem populacional do IBGE. Este crescimento não se deu somente através dos métodos de evangelismo pessoal e de massa já empregados há anos pelas igrejas pentecostais, mas também teve um importante acréscimo se forem analisados os efeitos secularizantes da modernidade e que inevitavelmente afetaram essas igrejas. Com o incremento do número de pentecostais, houve também alterações significativas de suas tradições doutrinárias. Sendo (...) a secularização promovedora de pluralismo religioso, as denominações pentecostais passam por um processo de secularização, notadamente com um pluralismo doutrinário a fim de manterem-se plausíveis em meio à sociedade secularizada. Este trabalho cita o caso da igreja Assembleia de Deus, principal denominação pentecostal do País por seu número de fiéis, por sua trajetória histórica e sua consequente secularização. Secularização.The author points out that according to the latest data from the IBGE (Instituto Brasileiro de Geografia e Estatística), Pentecostalism is the fastest growing religion in Brazil. One reason for this growth binds to different methods of evangelism, used for many years by the Pentecostal churches. Another possible reason for the fast growth of Pentecostalism is related to the effects produced by the process of secularization of modernity that inevitably have affected the churches. Along with the increase in the number of Pentecostals, there were also significant changes in their doctrinal traditions. Because secularism promotes religious pluralism, the Pentecostal denominations undergo a process of secularization, especially with a doctrinal pluralism in order to maintain themselves plausible amid a secularized society. This paper cites the case of the Assembly of God church, a leading Pentecostal denomination in Brazil in terms of number of followers, and because of its historical trajectory and its consequent secularization. Objective:A growing body of evidence supports the effectiveness of body-oriented interventions in educational contexts, showing positive influences on social-emotional competence. Nevertheless, there is a lack of systematization of the evidence regarding preschool years. This is a two-part systematic review. In this first part, we aim to examine the effects of BOI on preschoolers' social-emotional competence outcomes.Data Sources:Searches were conducted in Pubmed, Scopus, PsycInfo, ERIC, Web of Science, Portal Regional da BVS and CINAHL.Eligibility Criteria:English, French and Portuguese language articles published between (...) January 2000 and October 2020, that evaluated the effects of BOI implemented in educational contexts on social-emotional competence of preschool children. Only randomized controlled trials or quasi-RCT were included.Data Extraction and Synthesis:Two reviewers independently completed data extraction and risk-of-bias assessment. The level of scientific evidence was measured through the Best Evidence Synthesis.Results:Nineteen studies were included. There was strong evidence that BOI do not improve anger/aggression, delay of gratification and altruism. Nevertheless, there was moderate evidence that BOI effectively improve other social-emotional outcomes, such as empathy, social interaction, social independence, general internalizing behaviors, and general externalizing behaviors. The lack of scientific evidence was compromised by the methodological quality of the studies.Conclusion:BOI effectively improve specific social-emotional competences of preschool children.Systematic Review Registration:PROSPERO, identifier CRD42020172248. A literatura económica portuguesa da segunda metade de Oitocentos dedica particular atenção ao papel dos agentes económicos no processo de criação de riqueza e bem-estar. A reflexão então produzida procurou chamar a atenção para os problemas associados ao crescente progresso material e aos dilemas e sortilégios de uma civilização “perigosamente” moderna e paradoxalmente decadente. Em muitos casos, estes textos ultrapassaram a simples exposição doutrinária ou o propósito de divulgação, situando-se em aspetos concretos da realidade económica nacional, relativamente à qual se (...) revelou clara a intenção de diagnosticar os principais problemas e propor soluções, julgadas pelos seus autores como as mais adequadas. Temas como o mercado e o Estado, a liberdade e a justiça, a pobreza e a questão social ocuparam um lugar de destaque nestas reflexões, que eram movidas pela necessidade de encontrar equilíbrios económicos e sociais numa sociedade em que a cada dia era mais evidente o agravamento das condições de vida de uma camada cada vez mais extensa da população, ligada à indústria em desenvolvimento e às áreas urbanas. As páginas que se seguem procuram documentar as características marcantes destes textos, na convicção de que o seu estudo pode ser encarado como elemento fundamental para a compreensão do processo de divulgação e institucionalização da economia política junto de uma elite esclarecida. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. In this paper, we intend to offer an interpretation about the explanation of the (relative) idea of pure substance in general on John Locke’s philosophy, from Thomas Reid’s notion of ‘natural suggestion’. To achieve this aim, after contextualizing Locke’s notion of pure substance in general and distinguishing it from the idea of particular substance (section 1), we explicit that Locke’s words about the source of the idea of the former in the mind (either empirical or rational) are ambiguous and inconclusive (...) (section 2). Then, we argue that the parallels between this idea and that of ‘relation’, as well as of ‘power’ do not assist in that answer, due to some problems we identify on them (section 3). Finally, we argue that the Reidian explanation for the source of the idea of ‘mind’, from the notion of ‘natural suggestion’ allows us to i) avoid those problems and ii) inasmuch as, according to this interpretation, the idea of pure substance in general would have an empirical source, Lockian empiricism would remain intact (section 4). It is well known that Frege's system in the Grundgesetze der Arithmetik is formally inconsistent. Frege's instantiation rule for the second-order universal quantifier makes his system, except for minor differences, full (i.e., with unrestricted comprehension) second-order logic, augmented by an abstraction operator that abides to Frege's basic law V. A few years ago, Richard Heck proved the consistency of the fragment of Frege's theory obtained by restricting the comprehension schema to predicative formulae. He further conjectured that the more encompassing Δ₁¹-comprehension (...) schema would already be inconsistent. In the present paper, we show that this is not the case. (shrink)

Kant estruturou sua filosofia de modo a manter a possibilidade de afirmarmos que somos seres pertencentes ao mundo sensível e, enquanto tais, termos todos os nossos comportamentos explicados de um modo natural; todavia, ele também sustentou que somos seres com uma capacidade racional de representação de um dever ser do mundo, capacidade que nos permite termos todas as nossas decisões avaliadas de uma maneira que independe de como o mundo realmente é. Neste trabalho, examinaremos a posição de Kant em alguns (...) textos da primeira Crítica em que se diferencia a liberdade transcendental, ou liberdade como espontaneidade, da liberdade prática entendida como livre-arbítrio, que pode se determinar por representações da razão. Com base nos textos e em comentários de Allison (1982), veremos que a liberdade em sentido práticoé diferenciada da liberdade em sentido cosmológico, sendo, por um lado, compatívelcom o determinismo das causas naturais, que opera com a explicação dos fenômenos(e o livre-arbítrio humano não deixa de ser também um arbítrio sensitivo); mas, por outro lado, a concepção de Kant mantém ou subsume uma noção comum de liberdade humana, aquela da deliberação e decisão responsável, já que o livre-arbítrio não será patologicamente determinado por motivos sensíveis imediatos. “A questão em torno da liberdade transcendental concerne unicamente ao saber especulativo, e podemos pô-la de lado como totalmente indiferente quando estamos à volta com o [problema] prático”(CRP B 831-832). A teoria de Rawls foi e é criticada às vezes como uma aceitação do status quo capitalista dominante: sua prioridade das liberdades básicas seria vazia numa sociedade marcada pela apropriação privada dos meios de produção e crescente concentração da riqueza produzida nas mãos dos proprietários. Essa crítica, porém, não é procedente para o caso de Rawls. Neste trabalho vou apresentar e discutir a idéia de justiça de fundo (background justice) como uma das respostas de Rawls a esta crítica. Com tal (...) idéia ele defende que os dois princípios da justiça como eqüidade, operando em conjunto e tendo como foco a estrutura básica da sociedade, afastam a teoria dos principais problemas alegados pelos críticos, além de sugerir que a produção de um contexto social eqüitativo desonera o ideal da justiça de sua aplicação abrangente. Søren Kierkegaard and John Henry Newman have starkly opposed formulations of the relation between faith and reason. In this essay I focus on a possible convergence in their respective understandings of the transition to religious belief or faith, as embodied in metaphors they use for a qualitative transition. I explore the ways in which attention to the legitimate dimension of discontinuity highlighted by the Climacan metaphor of the ‘leap’ can illuminate Newman's use of the metaphor of a ‘polygon inscribed in (...) a circle’, as well as the ways in which Newman's metaphor can illuminate the dimension of continuity operative in the Climacan appreciation of qualitative transition. We construct a weak second-order theory of arithmetic which includes Weak König's Lemma (WKL) for trees defined by bounded formulae. The provably total functions (with Σ b 1 -graphs) of this theory are the polynomial time computable functions. It is shown that the first-order strength of this version of WKL is exactly that of the scheme of collection for bounded formulae.

Levinas himself raises the question: "why would I feel responsible in the presence of the Face" since "we are separate ontological beings?" This questions the character of our response to the other--both in terms of agency and motivation. While the general reception of Levinas's thought has focused on his description of us as "hostage"--that is, on the moment of assignation (or assignment) by the other--I suggest that Levinas himself also, though not as directly, addresses (as he needs to) the correlative (...) moment, the moment of response. My essay reconstructs Levinas's implicit understanding of the character of our initiative in the light of his concept of Desire. I explore the different dimensions of Desire as appetite and generosity, and I argue that the "transition to moral consciousness" that Levinas wants to "justify" is one from complacent happiness to "non-complacent happiness" and can be illuminated by the notion of "passion seeking its downfall.". Much has been made of the Kierkegaardian flavour of Wittgenstein's thought on religion, both with respect to its explicit allusions to Kierkegaard and its implicit appeals. Even when significant disparities between the two are noted, there remains an important core of de facto methodological agreement between them, addressing the limits of theory and the dispelling of illusion. The categories of ‘nonsense’ and ‘paradox’ are central to Wittgenstein's therapeutic enterprise, while the categories of ‘paradox’ and the ‘absurd’ are central to much (...) of Kierkegaard's attempt to dispel religious illusion. Writing of how the ‘urge to thrust against the limits of language’ yields ‘nonsense’, Wittgenstein explicitly appealed to Kierkegaard: ‘Kierkegaard, too, recognized this thrust and even described it in much the same way ’. 1 I want to consider whether Kierkegaard's category of paradox of the absurd is assimilable to Wittgenstein's view of nonsense and paradox. I shall argue that a consideration of Wittgenstein's view of paradox can highlight contrasting strands in Kierkegaard's writings on religious faith, strands which take paradox more or less strictly – in particular, it can clarify several different opinions concerning the status of religious claims. My exploration will bring to the fore some implications of the attempt to make room, in the religious employment of language, for a ‘higher understanding’ of truths which we are said to be able to grasp but cannot express. Conscious experiences in infants remain poorly understood. In this NeuroView, Passos-Ferreira discusses recent evidence for and against consciousness in newborn babies. She argues that the weight of evidence from neuroimaging and behavioral studies supports the thesis that newborn infants are conscious.

Defendemos a necessidade de que se atue com rigor ético durante a pandemia do novo coronavírus e que não se afrouxem os padrões científicos e normativos nas pesquisas sobre possíveis medicamentos, em especial a Cloroquina, para a COVID-19. Argumentamos que, excepcionalmente, seria justificado pular algumas etapas na realização de testes clínicos ou tratamentos experimentais, mas que é inadequado fazer um uso indiscriminado de medicamentos off label para tratar pacientes enquanto os resultados das pesquisas não forem publicados em veículos de comprovada (...) reputação científica. Para sustentar essa posição, aplicamos princípios bioéticos e da ética médica. Defendemos que políticas públicas para o uso de Cloroquina durante a pandemia não devem ser implementadas até que sejam divulgados os resultados das pesquisas realizadas pela “Coalizão COVID Brasil” e pela Solidarity da OMS. This article discusses the use of nonhuman animals in three related aspects: 1) factual aspects about the treatment that we, humans, dispense to other animals, especially in meat and animal experimentation industries; 2) evaluative issues about the ethics of this treatment as we see in the ethical arguments pro (Singer; Regan) and contra (Naverson; Cohen); 3) some practical aspects about what we should to do. The ethical evaluation gives fundaments to the practical aspects that we conclude, with suggestions of actions, (...) in particular the replacement of animal experimentation (inherently harmful) for investigation with nonhuman subjects of research (inherently non harmful, or therapeutic). For example, given that at "the first origin (...) of society" (e4) our ancestors were obviously "ignorant and barbarous" (23), anxiously helpless in the face of threatening natural events--hence, obviously with neither the leisure nor the impulse nor the aptitude for serious reflection--it was obviously passionate fears and hopes, not reason, which motivated their beliefs. [5931 594 JOURNAL OF THE HISTORY OF PHILOSOPHY 33:4 OCTOBER 1995 In his account of the "propensity of human nature, which leads into a system, that gives them some satisfaction," Yandell admits that "no explanation is given of exactly what sort of satisfaction is in question," yet he goes on without a pause to speak of how "people accept different and various explanatory systems"; referring to a natural "propensity to understand," he concludes that "for Hume, we need not accept a religious system of explanation, but most of us in fact do so."s I suggest that Yandell's shift from "system" to "explanatory system," which is unheralded, is of crucial significance because the emphasis on explanation tends to call to a reader's mind just the sort of appeal which Hume decisively rejects. I shall argue that Hume draws our attention to and decisively excludes from his account a concept of explanation which actually does play an important role in other parallel accounts--namely, a concept which focuses on the integrity of a broad picture and an ultimate accounting; Hume points to such a concept in his references to the "frame of the universe," "final causes," and the "first rise of the visible system." Such a role might seem to elaborate Hume's appeal to common sense--after all, isn't the natural response to "unknown causes" to try to understand them, and isn't the attempt to understand them the same as looking for an "ultimate" explanation, however crude it might be at the outset? Although this might seem commonsensical to others (as we shall see), I want to argue that what Hume sees at work in the origin of religion is not a search for such an explanation, even a crude one. Rather, on Hume's view the only curiosity at work is a curiosity about how to cope: the propensity to a system is the propensity to the kind of determinacy which is expedient for control, and the only satisfaction the system provides is one in terms of a coping which is independent of truth-seeking... Neste trabalho, examinaremos a posição de Kant em alguns (...) textos da primeira Crítica em que se diferencia a liberdade transcendental, ou liberdade como espontaneidade, da liberdade prática entendida como livre-arbítrio, que pode se determinar por representações da razão. It suggests that Kierkegaard's ideas about love can be found in Works of Love, which contains a series of deliberations on the Judeo-Christian commandment to love one's neighbour as oneself. The chapter also discusses episodes of the story of human love in Kierkegaard's earlier works, his Either/Or, Fear and Trembling, and Philosophical Fragments. It also argues that Kierkegaard's philosophical, literary, and theological explorations reveal that love is filled with paradox.

Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice.
