In the era of the “Sunnī Revival” and the couple of centuries following, scholars engaged in a large historiographical project aimed at rehabilitating the reputation of the Umayyad dynasty and Syria’s role in the early Islamic narrative. One of Ibn Kathīr’s historiographical missions in his history Kitāb al-Bidāya wa-l-nihāya was specifically the defense of the Companions of the Prophet. As such, the narrative of ʿAlī ibn Abī Ṭālib required some manipulation to answer Shīʿī narratives that cast some of the most (...) important Companions (especially those associated with the Umayyads and Syria) in a rebellious light. This article explores the literary-narrative strategies Ibn Kathīr employs to alter the narrative so as to counteract the implications of the pro-ʿAlīd versions of the story he found in his sources, especially al-Ṭabarī’s Taʾrīkh al-Rusul wa-l-mulūk. Nietzsche claims that we are fated to be as we are. He also claims, however, that we can create ourselves. To many commentators these twin commitments have seemed self-contradictory or paradoxical. The argument of this paper, by contrast, is that, despite appearances, there is no paradox here, nor even a tension between Nietzsche's two claims. Instead, when properly interpreted these claims turn out to be intimately related to one another, so that our fatedness emerges as integral to our capacity to (...) become self-creators. The paper also offers, in the course of undermining a false alternative that is deeply entrenched in the philosophical tradition, a reading of Nietzsche's doctrine of amor fati that actually – and perhaps uniquely – makes full sense of section 276 of The Gay Science, the chief source for this aspect of his thought. Timothy Williamson has argued that a person S ’s total evidence is constituted solely by propositions that S knows. This theory of evidence entails that a false belief can not be a part of S ’s evidence base for a conclusion. I argue by counterexample that this thesis (E = K for now) forces an implausible separation between what it means for a belief to be justified and rational from one’s perspective and what it means to base one’s beliefs on (...) the evidence. Furthermore, I argue that E = K entails the implausible result that there are cases in which a well-evidenced belief necessarily can not serve as evidence for a further proposition. (shrink)

There are passages in Nietzsche that can be read as contributions to the free will/determinism debate. When read in that way, they reveal a fairly amateurish metaphysician with little of real substance or novelty to contribute; and if these readings were apt or perspicuous, it seems to me, they would show that Nietzsche's thoughts about freedom were barely worth pausing over. They would simply confirm the impression—amply bolstered from other quarters—that Nietzsche was not at his best when addressing the staple (...) questions of philosophy. But these readings sell Nietzsche short. He had next to no systematic interest in metaphysics, and his concern with the question of freedom was not motivated by metaphysical considerations. Rather—and as with all of Nietzsche's concerns—his motivations were ethical. He was interested, not in the relation of the human will to the causal order of nature, but in the relation between freedom and the good life, between the will and exemplary human living. Read from this perspective, Nietzsche's remarks about freedom actually add up to something. And what they add up to is one aspect of his attempt to understand life after the model of art. Beauty, for Kant, was an image of the moral.1 For Nietzsche, by contrast—and the contrast can be hard to spell out—art was an image of the ethical.2 My hope here is to begin to explain why Nietzsche might have thought that the issue of freedom was relevant to that. In sections 1–3, I attempt to show why Nietzsche is not best read as a participant in the standard free will/determinism debate; in sections 4–6, I try to spell out the ethical conception of freedom that he develops instead. In this paper, I examine a puzzle that emerges from what J. P. Moreland has called the traditional realist view of quality instances. Briefly put, the puzzle is to figure out how quality instances fit into the overall structure of a concrete particular, given that the traditional realist view of quality instances prima facie seems incompatible with what might be called the traditional realist view of concrete particulars. After having discussed the traditional realist views involved and the puzzle that emerges (...) from their juxtaposition, I propose an alternative realist view of quality instances which resolves the puzzle. In short, the puzzle is solved by treating the distinction between a concrete particular and its quality instances as a distinction of reason, and by adopting the view that the individuating element of a concrete particular must also serve as its unifying element – a view which Moreland, one of traditional realism’s most stalwart contemporary defenders, rejects. Proponents of political liberalism standardly assume that the citizens of an ideal liberal society would be overwhelmingly reasonable. I argue that this assumption violates political liberalism's own constraints of realism—constraints that are necessary to frame the central problem that political liberalism aims to solve, that is, the problem of reasonable pluralism. To be consistent with these constraints, political liberalism must recognize that, as with reasonable pluralism, widespread support for unreasonable moral and political views is an inevitable feature of any liberal (...) society. I call this the fact of unreasonable pluralism. This fact threatens Rawlsian political liberalism's account of stability because an overlapping consensus cannot stably order a society pervaded by unreasonable views. My argument also raises questions about the coherence of Rawls's conception of ideal theory. (shrink)

This paper offers an account of Nietzsche's re-evaluation of values that seeks to satisfy two desiderata, both important if Nietzsche's project is to stand a chance of success. The first is that Nietzsche's re-evaluations must be capable of being understood as authoritative by those whose values are subject to re-evaluation. The second is that Nietzsche's project must not falsify the values being re-evaluated, by, for example, misrepresenting intrinsic values as instrumental values. Given this, five possible forms of re-evaluation are distinguished, (...) and, of these, four are argued both to satisfy the specified desiderata and to feature more or less prominently in Nietzsche's later work. The conclusion of the paper is therefore that Nietzsche's project has at least the right general shape to succeed, and that the reasons for this depend upon acknowledging the importance of the desiderata and of the distinctions to which the paper draws attention. Patent landscaping is the process of finding patents related to a particular topic. It is important for companies, investors, governments, and academics seeking to gauge innovation and assess risk. However, there is no broadly recognized best approach to landscaping. Frequently, patent landscaping is a bespoke human-driven process that relies heavily on complex queries over bibliographic patent databases. In this paper, we present Automated Patent Landscaping, an approach that jointly leverages human domain expertise, heuristics based on patent metadata, and machine learning (...) to generate high-quality patent landscapes with minimal effort. In particular, this paper describes a flexible automated methodology to construct a patent landscape for a topic based on an initial seed set of patents. This approach takes human-selected seed patents that are representative of a topic, such as operating systems, and uses structure inherent in patent data such as references and class codes to “expand” the seed set to a set of “probably-related” patents and anti-seed “probably-unrelated” patents. The expanded set of patents is then pruned with a semi-supervised machine learning model trained on seed and anti-seed patents. This removes patents from the expanded set that are unrelated to the topic and ensures a comprehensive and accurate landscape. (shrink)

Spurred by a severe shortage of cadaveric organs, there has been a marked growth in living organ donation over the past several years. This has stimulated renewed interest in the ethics of this practice. The major concern has always been the possibility that a physician may seriously harm one person while trying to improve the well-being of another. As Carl Elliott points out, this puts the donor's physician in a difficult predicament: when evaluating a person who volunteers to donate an (...) organ, “a doctor is in the position of deciding not simply whether a subject's choice is reasonable … but whether he [the doctor] is morally justified in helping the subject accomplish it.”1 This question has become even more difficult since the introduction of living donor operations that are more risky than living kidney donation and the suggestion that volunteers at added risk may sometimes be acceptable.2 So, how can we decide when the risk is too much? The phenomenological investigations of Siddhartha Gautama and Edmund Husserl arrive at the exact same conclusion concerning a fundamental and invariant structure of consciousness. Namely, that object-directed consciousness has a transcendental correlational intentional structure, and that this is fundamental -- in the sense of basic and necessary--to all object-directed experiences. This example of converging lines of evidence strongly suggests that phenomenology can indeed produce truths about consciousness, and thus that phenomenology has a rightful place in a science of consciousness. However, Siddhartha (...) challenges cognitive science's mainstream presuppositions concerning what the purpose of phenomenology is and what it means to study and understand consciousness. (shrink)

Pragmatic Encroachment, Religious Belief and Practice engages several recent and important discussions in the mainstream epistemological literature surrounding 'pragmatic encroachment'. It has been argued that what is at stake for a person in regards to acting as if a proposition is true can raise the levels of epistemic support required to know that proposition. Do the high stakes involved in accepting or rejecting religious beliefs raise the standards for knowledge that 'God exists', 'Jesus rose from the dead' and other propositions? (...) Professor Rizzieri also examines whether or not knowledge and justification norms of belief and action undermine the pragmatic grounds for religious belief suggested by William James. Rizzieri argues that such norms favor an attitude of hope, as opposed to belief, under conditions of uncertainty. Finally, Rizzieri argues the connections between knowledge and rational action undermine radically externalist accounts of religious knowledge and proposes an alternative account of the justification of religious beliefs. This essay addresses the much discussed problem of archiving digital poetry. Digital media are labile, and several writers of digital poetry are incorporating the media’s ephemerality into their poetics. Rather than rehash arguments that have been taking place within the field of digital media and digital poetics for years, I turn to the field of contemporary art curation and preservation, a field in which curators and archivists are struggling with the very immediate concerns, ethical and otherwise, related to archiving works (...) that are made from ephemeral media. One particular digital poem that has recently broken, has recently become unreadable, is Talan Memmott’s Lexia to Perplexia. Memmott composed the poem in 2000, and he incorporated the poem’s inevitable obsolescence into the text of the poem itself. He has since refused to “fix” or “update” the poem, because he contends that that would make it something other than what it was intended to be. Rather, he is choosing to let the poem die because that is what the poem is supposed to do. This essay concludes with a discussion of the political implications of acknowledging the ephemerality of digital media, the resistant potential of the poem when its ephemerality is embraced, and some ways in which archivists can preserve the memory of the poem without necessarily preserving the poem itself. Some naturalistic conceptions of philosophical methodologies interpret the doctrine that philosophy is continuous with science to mean that philosophical investigations must implement empirical methods and must not depart from the experimental results that the scientific application of those methods reveal. In this paper, I argue that while our answers to philosophical questions are certainly constrained by empirical considerations, this does not imply that the methods by which these questions are correctly settled are wholly captured by empirical methods. Many historical cases (...) of successful answers to philosophical questions involve strategies and methods that allow the divergence from empirically established results. I develop this idea and then illustrate it with Frege's methodology in his Foundations of Arithmetic. (shrink)

Certain approaches to the meaning of utterances primarily characterize speakers' communicative intentions as the only source of meaning of a speaker's utterance. I show that a strict version of this position is difficult to maintain because the meaning of an utterance is partially due to the intentional attitudes of the audience to an utterance, including their reaction to the social identity of a speaker. This can result in a negotiation over meaning that can take place if the speaker and audience (...) do not agree on the significance of the utterance. The view is motivated if one takes an ameliorative approach to meaning which acknowledges that theories of meaning are constrained by normative concerns related to meaning and communication. It is commonly held that epistemic standards for S ’s knowledge that p are affected by practical considerations, such as what is at stake in decisions that are guided by that p . I defend a particular view as to why this is, that is referred to as “pragmatic encroachment.” I then discuss a “new argument against miracles” that uses stakes considerations in order to explore the conditions under which stakes affect the level of epistemic support that is required for (...) knowledge. In Heidegger on Concepts, Freedom, and Normativity, Sacha Golob criticizes and offers an alternative to the standard interpretation of intentionality in Being and Time. According to Golob, the dominant reading’s derivation of propositional intentionality from practical intentionality fails on textual and philosophical grounds, so he develops a different approach that involves deriving propositional intentionality from prototype intentionality. In this essay, I offer an overview of dominant reading of intentionality in Being and Time and Golob’s alternative account, and then I criticize (...) them both for attempting to derive propositional intentionality for some form of non-propositional intentionality. Finally, I offer my own ontological interpretation of intentionality by arguing that Heidegger’s aim in Being and Time is not to derive one form of intentionality from another but to describe the basic aspects of human existence that make any and all forms of intentionality possible. This article engages the current anti‐humanist or post‐human ethos from the point of view of Christology. Invoking Alain Badiou's claim that “the man of humanism has not survived the twentieth century”, it argues that the death of “the man of humanism” ushers in a situation in which the Christian proposal can be clarified in two crucial ways: Christology is the core of Christian anthropology, and therefore must be the first and last word of the Church's formulation of her answer to (...) the question that is every human life; there is no neutral “human” ground in which the Church can carry on a discourse about “humanism” or “natural law”. People tend to be biased and irrational about politics. Should this constrain what our normative theories of democracy can require? David Estlund argues that the answer is ‘no’. He contends that even if such facts show that the requirements of a normative theory are very unlikely to be met, this need not imply that the theory is unduly unrealistic. I argue that the application of Estlund’s argument to political irrationality depends on a false presupposition: mainly, that being rational about politics (...) is something people could easily do if they tried. Since the empirical evidence shows that being rational about politics is actually quite difficult, Estlund’s argument comes up short. Moreover, I argue that the argument cannot plausibly be extended to insulate normative theories of democracy from facts about political irrationality because of the need for constraints of realism to explain the crucial role that appeals to (reasonable) disagreement play within such theories. This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

Robert Card criticises our proposal for managing some conscientious objections in medicine. Unfortunately, he severely mischaracterises the nature of our proposal, its scope and its implications. He also overlooks the fact that our proposal is a compromise designed for a particular political context. We correct Card’s mischaracterisations, explain why we believe compromise is necessary and explain how we think proposed compromises should be evaluated.

Liberalism has a complicated and sometimes uneasy relationship with truth. On one hand, liberalism requires that truth be widely valued and widely shared. It demands that governments be truthful and that citizens have ready access to numerous truths. Some liberals even take facilitating the discovery and dissemination of truth to be part of the raison d’être of liberal institutions. On the other hand, liberalism is averse to proclaiming or enforcing truth. It detaches truth from political legitimacy and deems certain truths (...) unfit to serve as bases of government. Some liberals have even suggested that liberal theory must work “without the concept of truth.” How has liberalism come to both demand truth and eschew it? Graebe (Steubenville, OH: Emmaus Academic, 2021), 351 pp.Though Mary's undiminished virginity in giving birth (virginitas in partu) was long understood to be an event as miraculous and a teaching as authoritative as her virginity in conceiving (...) (virginitas ante partum), virginitas in partu underwent a kind of existential reinterpretation in the middle of the twentieth century. Authors such as Albert Mitterer and Karl Rahner suggested that, physically speaking, Jesus's birth might have happened like any other, rupturing the hymen, distending the birth canal, and causing Mary pain, albeit not in the spiritually disintegrating way common to postlapsarian humanity. These arguments effectively "unsettled" the traditional understanding of virginitas in partu, leading theologians of the highest stature to distinguish between the doctrine itself and the anatomical aspects attached to it over time. Fr. Brian Graebe has written a fine book arguing that the bodily dimensions of the virgin birth, including the physical "seal" of virginity, belong to the substance of the doctrine. This more inclusive understanding not only does better justice to the data of tradition, he argues, but illuminates the ecclesiology of the Second Vatican Council. The book impresses by its theologically reflective method, its clarity of exposition, [End Page 1106] and its depth of research—especially into the archival and antepreparatory sources of Vatican II.Vessel of Honor responds in effect to Rahner's argument that physical intactness is peripheral to the dogmatic core of Mary's virginity in partu. To show otherwise, Rahner contended, one would need to show that such a doctrine can be found directly in the apostolic teaching, or that it, "being implicitly contained therein, has grown out of the apostolic doctrine, by a legitimate historical, logical, and theological process, as its authentic development" (68–69). If the bodily aspects of this doctrine really belonged to the deposit of faith, in other words, one would need to show how they are implied in the traditio divino-apostolica, as well as how they cohere organically with the rest of the deposit. The two major parts of Vessel of Honor respond in turn to each aspect of Rahner's challenge.The first three chapters argue that Mary's bodily integrity in parturition belongs at least implicitly to the traditio divino-apostolica. Turning first to the postapostolic tradition, Fr. Graebe shows that—apart from the early exceptions of Origen and Tertullian—patristic sources either affirm or strongly imply a miraculous delivery. This constant witness culminates in the Lateran Council (649 AD), which, while not itself an ecumenical council, was received into the magisterium of Pope Martin and affirmed by the Third Council of Constantinople (680 AD). Its teaching that Mary "gave birth without corruption" (incorruptibiliter... genuisse) would be defended by Paschasius, Ratramnus, Thomas Aquinas, and others. This consensus remained undisturbed until the eve of Vatican II.Even at Vatican II, Fr. Graebe argues in the next chapter, the Council Fathers intended to reaffirm the more inclusive idea of virginitas in partu against those who would marginalize its bodily dimensions. Here he really breaks new ground, delving deep into the antepreparatory, preparatory, and conciliar drafting history. He shows convincingly that many of the chief drafters of the final formula—"Our Lord, who did not diminish his mother's virginal integrity but sanctified it..." (Lumen Gentium §57)—saw it as excluding Rahner's and Mitterer's minimalizing interpretations. Drawing on material from the Vatican Apostolic Archives, Fr. Is there a pro tanto moral reason to create a life merely because it would be good for the person living it? Proponents of the procreation asymmetry claim there is not. Defending this controversial no reason claim, some have suggested that it is well in line with other phenomena in the moral realm: there is no reason to give a promise merely because one would keep it, and there is no reason to procreate merely to increase the extent of justice (...) in the world. Allegedly, some analogs extend so far as to support a unified theory of the no reason claim and the nonidentity thesis, that is, the view that of two persons leading lives of positive wellbeing, there is a reason to create the person with higher wellbeing. I dismantle the proposed analogs and show that they fail to meet various desiderata. Moreover, I refute Johann Frick's argument that the no reason claim follows from the assumption that reasons of beneficence are reasons to act for the sake of people. By criticizing attractive defenses for the no reason claim, I weaken its plausibility. (shrink)

In their recent article, Glannon and Ross remind us that family members have obligations to help each other that strangers do not have. They argue, I believe correctly, that what creates moral obligations within families is not genetic relationship but rather a sharing of intimacy. For no one are these obligations stronger than they are for parents of young children. This observation leads the authors to the logical conclusion that organ donation by a parent to her child is not optional (...) but rather a prima facie duty. However, Glannon and Ross go a step further by suggesting that because parent-to-child organ donation is a duty, it cannot be altruistic. They assert that “altruistic acts are optional, nonobligatory…supererogatory…. Given that altruism consists in purely optional actions presupposing no duty to aid others, any parental act that counts as meeting a child's needs cannot be altruistic.” Here I think the authors go too far. The careful historical and metaphilosophical attention recently bestowed upon analytic philosophy has revealed that traditional ways of defining it are inadequate. In the face of this inadequacy, contemporary authors have proposed new definitions that detach analytic philosophy from its turn of the twentieth century origins. I argue that this contemporary trend in defining analytic philosophy is misguided, and that it diminishes the likelihood of our coming to an accurate historical and metaphilosophical understanding of it. This is especially unsatisfactory since such (...) understanding is essential to finding an adequate remedy for the widely perceived ills of contemporary analytic philosophy. I suggest that a more fruitful approach to developing such understanding might begin with treating the unity of analytic philosophy as illusory. (shrink)

The contrast between my experience at a well-funded health unit and the Lev El Lev (“heart to heart”) African Refugee Clinic in Tel Aviv, Israel, is staggering. The complex personal, social, health, psychological, educational, and economic difficulties create a unique ethical environment for the health care provider.
