We all want to be happy, and there are plenty of people telling us how it can be achieved. The positive psychology movement, indeed, has established happiness as a scientific concept within everyone's grasp. But is happiness really something we can actively aim for, or is it simply a by-product of how we live our lives more widely? Dr. Mick Power, Professor of Clinical Psychology and Director of Clinical Programmes at the National University of Singapore, provides a critical assessment (...) of what happiness really means, and the evidence for how it can be increased. This research is conducted by the Intellectual Property and Policy Research Group at the W. Maurice Young Centre for Applied Ethics at the University of British Columbia. It is part of the GE3LS component of the Genome Canada Project "Dissecting Gene Expression Networks in Mammalian Organogenesis," MORGEN, which is located principally at the British Columbia Cancer Agency, Vancouver, British Columbia, Canada. The project is involved in upstream, basic genomic research. Part of this work includes the characterization of gene regulatory mechanisms (...) governing organogenesis with a special focus on the heart, liver and pancreas. This paper serves as an introduction to both the MORGEN case study and the role of alternative mechanisms, such as open source. We discuss interim research results as they relate to our broader study of the relationship between open science, commercialization and technology transfer offices. The role of technology transfer offices is central to our analysis and is viewed as a key factor in implementing Genome Canada policies and principles associated with IP and commercialization. This paper develops a framework for establishing rigour for a discourse analysis of professional transition in midwifery, theorised as a ‘female professional project’. Discourse analysis has gained recognition as a useful approach in nursing and midwifery research. It provides an alternative to those qualitative approaches that propose to reveal a ‘reality’ from the perspective of the individual experience, and that this lived experience can be directly represented in language. There are multiple discourse analytic approaches, and often researchers are not explicit (...) about what type they are employing. Furthermore, to date there are few clear guidelines for what constitutes rigour in a discourse analytic study. Rigour in qualitative research broadly falls into two categories: the replication perspective that argues for the maintenance of criteria of validity and reliability, usually with an underpinning assumption (often unquestioned) that a ‘truth’ can be revealed. The second is the parallel perspective that questions the ontological and epistemological assumptions of the replication perspective and argues for the development of criteria that reflect the assumed questionable nature of truth and reality. Transferring these criteria to a discourse analytic study revealed some problems. A common challenge identified in achieving rigour in discourse analysis is the maintenance of congruity between the epistemological and ontological basis of a piece of research and the actual analysis conducted or reported. A framework is proposed to address these incongruities and includes six elements. As nurses and midwives increasingly employ discourse analysis in their research, attempts to clarify how rigour will be determined are important if the outcomes of such research are to be seriously considered for their implications for theory, policy and practice. In three experiments, the relation between different modes of thought and the generation of “creative” and original ideas was investigated. Participants were asked to generate items according to a specific instruction . They either did so immediately after receiving the instruction, or after a few minutes of conscious thought, or after a few minutes of distraction during which “unconscious thought” was hypothesized to take place. Throughout the experiments, the items participants listed under “unconscious thought” conditions were more original. Much recent scholarly treatment of the theoretical and practical underpinnings of biological taxonomy from the 16 th to the 18 th centuries has failed to adequately consider the importance of the mode of generation of some living entity in the determination of its species membership, as well as in the determination of the ontological profile of the species itself. In this article, I show how a unique set of considerations was brought to bear in the classification of creatures whose species (...) membership was thought to be entirely determined by descent from parents of the same kind, in contrast with creatures whose generation could proceed spontaneously or through budding. Concretely, the relevance of mode of generation to the practice of taxonomy means that we must rethink the role of the early modern botanists in the development of a universal science of applied taxonomy. I argue that the task of classifying ‘higher’ biological kinds—those united, in Kant’s language, through their generative power—is one with its unique set of problems, arising as much from classical anthropology as from natural philosophy, and that the conception of zoological species that emerged in the early modern period was a consequence of these problems, and not primarily of the ‘applied metaphysics’ of classificatory practice. Words come into existence through a number of distinct processes including naming, semantic shifts, morphological productivity, and compounding. In accounting for the instantiation and individuation of word-types, two diachronic proposals termed Originalism and History are considered, which view word-types as emerging through a tokening act after which they are subsequently distinguished from others on the basis of having a unique event-like origin. In the following paper I elucidate two central tenets of Originalism and History, which I name essentialism and propagation. (...) Next, I demonstrate that each suffer considerable challenges from evidence pertaining to the systematic generativity of words grounded in universal features of human lexical cognition. A third diachronic theory named Originalism-Plus-Transfer (OPT) is then outlined. I argue that this more nuanced version of Originalism, in its present form, still lacks a thorough explanation of pivotal features of word generativity, word instantiation, and word individuation. A number of ‘synchronic’ constraints on word-hood—phonological, phonotactic, morpho-syntactic, and semantic—are put forward to ground the possible space for word generation. I conclude by exploring the viability of supplementing OPT with synchronic constraints and propose that a union between the two has the potential to provide OPT with greater empirical strength and predictive power. The upshot of this analysis is that there exists great programmatic value for diachronic theories in drawing on synchronic data and that the latter must feature as central to the philosophy of words if such work is to anticipate achieving explanatory adequacy. What does Descartes's embryology look, if related to the Scholastic theories of his time? In order to reply to this question, the present chapter aims at sketching a portrait of the embryological epigenetics Descartes could find in his recognized Scholastic sources (the Commentaries on Aristotle by Toledo, the Coimbra Jesuits, Suárez, and Rubio, as well as the Summae by Eustachius a Sancto Paulo and Abra de Raçonis), a tradition that received and incorporated in the Aristotelian-Galenic body many novelties from Renaissance (...) medicine, especially Fernel, Paré, and Vallès. It being impossible to deal extensively with the whole of the contents of these works, I picked up three issues in particular, corresponding to the first three paragraphs of this paper: 1) the nature of the semen, and the action of the vis formativa, as well as its relationship with vital heat and temperaments; 2) the problem of the real and/or rational distinction(s) between the generative, the nutritive, and the augmentative powers; 3) the epigenetic order of generation of vital organs, i.e. the right sequence over which the fundamental organs of a living body are generated and then ensouled. In the last paragraph I integrate these reconstructions with some conclusions about Descartes' own theory. (shrink)

Imāmiyya holds that the theory of imāmate must rely on scriptural evidence and designation and that the Imām, the successor to Muḥammad, is in charge of all political and religious issues. The authority of the Imām includes some religious and social duties such as executing the legal punishments, collecting almsgiving, sustaining social order and declaring holy war. The fulfillment of these duties requires actual leadership of the Imām or his deputy. With the beginning of the great occultation in 329/941, there (...) was an uncertainty among the Imāmiyya followers about who would uphold these responsibilities. In this period, Shīʿī ʿulamā began to undertake the duties of the Imām in order to overcome this uncertainty and to avoid the possible schism. In the beginning, this delegation of authority was limited to the religious sphere; but, later, its scope gradually became wider. This process of delegation of power, which covers a long process, needs to be examined in its various periods. In this study, this subject will be considered with special reference to the scholars of the fifth century of hijra (hijrī). An effort is made in this article to reveal how the issues of the Imām’s powers are discussed in the context of the problem of expanding or narrowing the authority of the scholars who played significant roles in systemization of Uṣūlī (rationalist) thought in the period after Shaykh al-Mufīd.Summary: In the issues of Imām/Caliphate which led to political division among Muslims after the Prophet Muḥammad, Imāmī Shīʿa opines that the Imāmate theory relies on scriptural evidence and designation. According to this theory, apart from scriptural evidence and designation, personal qualities such as immaculacy, knowledge, bravery, and vantage are found in Ali, Ḥasan, Ḥusayn and nine people from the lineage of Ḥusayn. The Imām as a successor to the Prophet Muḥammad is a person who has both religious and political power which includes implementation of punishments, collecting alms, ensuring justice, declaring holy war. For the Imāmī Shīʿa, there is a need for imām or his deputy who has absolute power to fulfill these duties.Imāmī Shīʿa, who held that the disappeared twelfth Imām would return back to restore justice in the world, had to confront various problems in finding solutions to some issues related to the existence of Imām himself, as well as theological issues during the period of great occultation. Particularly, the period of great occultation (329/941), in which the link with the Imām was severed completely, the Shīʿī community were uncertain on how to fulfill the responsibilities of the Imām probably due to the lack of religious sources. Shaykh al-Mufīd draws attention to the issue of khums (a one-fifth share of the spoils of war and of other specified forms of income). In this period of uncertainty, the Shiite scholars came into prominence in order to fill the gap and to prevent the social disorder. Referring to a tawqī‘ (rescript) from the Twelfth Imām, they claimed that they would take responsibility for the Twelfth Imām on his behalf. In the beginning, the delegation of the power was limited to the religious sphere. It was gradually extended to other spheres by the contribution of some scholars. It reached the largest dimension with the implementation of “wilāyat al-faqīh” theory.From that period until our times, the era when Sharīf al-Murtaḍā and his disciples lived can be considered as the beginning of this period. In the fifth century when Sharīf al-Murtaḍā and his disciples lived the delegation of power was limited to the religious sphere. In this article, how the scholars who played a role in the systematization of Uṣūlī thought dealt with the issue of the limits of the authority of Imām and how they defined the role of the Imāmī jurists (faqīh) will be examined.Sharīf al-Murtaḍā and his disciples were sometimes cautious on the issue of the delegation of the power of Imām. They, however, pointed out the role of the faqīh in the occultation period in order to overcome the uncertainty. As a matter of fact, Shaykh al-Ṭūsī and al-Qādī Ibn al-Barrāj made significant contributions to the issues of collection and distribution of khums. However, Sallār al-Daylamī’s contribution to the subject is more crucial. He considered khums as the grace of God and believed that it can be allocated by taking into account the share of the Imām. They put forward the views that explained in details the role of the faqīh in the collection and distribution of alms. Even Ibn al-Barrāj opined that in the absence of Imām and his deputy alms are to be allocated to the Faqihs on the ground that they know better how to distribute it. Therefore, in the absence of Imām and his deputy, by suggesting that faqīh must be in charge of collecting and distributing alms, they proposed a remedy in an early period.On the issue of leading the Friday prayer (ṣalāt al-jum‘a), which is one of the social duties of Imām, Sharīf al-Murtaḍā and his disciples considered the presence of the Imām or his deputy as a condition for a valid Friday prayer. In addition to this condition, Al-Ḥalabī, also added that a person who meets the necessary conditions can be also considered in leading Friday prayer. This addition by Ḥalabī was an important contribution to the solution of the problems encountered during the period of great occultation on both Friday prayer and delegation of Imām religious and political authorities to faqīh. On the other hand, Sallār, another disciple of Sharīf al-Murtaḍā, opposed the idea of the faqīh leading the Friday prayer in the absence of the Imām even when the necessary conditions are met. It can be said that this approach of Sallār led to the opinion of some Imāmis which considered Friday prayer unlawful in the absence of Imām. In the occultation period, Sharīf al-Murtaḍā and his disciples showed a cautious attitude about the implementation of the punishments. They argued that only Imām could implement the punishments. However, the major step was taken by Shaykh Ṭūsī on the issue of who implements the punishments in the occultation period. He argued that the Imām’s designated the faqihs to implement the punishments. In addition to this subject, Shiite scholars discussed the issue of whether a Shiite officer under the reigning rule in the occultation period implemented the punishments. On this issue, Sharīf al-Murtaḍā compiled a treaty untitled Mas’ala fi’l-‘amal ma‘a’al-sulṭan. For him, the main criteria are whether such person has necessary responsibilities and qualifications. Sharīf al-Murtaḍā and his disciples also continued their master’s conciliatory attitude. In the final analysis, the contribution of Sharīf al-Murtaḍā and his disciples on the issue of who will undertake the duties and responsibilities of the Imām is crucial in the systematization of the idea of transferal of the power of the Imām to faqīh including political one. In fact, Sharīf al-Murtaḍā’s advice to take part in the existing administrations has been considered a way out for the scholars who want to establish relations with the authorities in the later periods. It has largely been assumed that when an intentional community loses its charismatic leader for one reason or another, the group will most likely disband unless that individual’s charisma has become routinized. The Kashi Ashram in Sebastian, Florida, is a spiritual community that was established, thanks to the vision of their Guru, Ma Jaya Sati Bhagavati. Her students were so devoted to her that her physical death in 2012 could have initiated a crisis in the community. Although bureaucratic offices had (...) been established to carry out some of the necessary functions of the Ashram, no one came close to filling her role as a spiritual teacher. And yet, more than 6 years later, new members are still joining the community and the way they describe Ma’s presence in their lives is little different from how older members that knew Ma in this lifetime talk about her. While I do not disagree that the routinization of charisma is an important step in ensuring the longevity of new religious movements, in this paper, I argue that an individual’s charisma may be transferred to a geographic place such that the Ashram becomes an active agent in the attraction and retention of new members. Over the last several years, a number of philosophers have advanced formal versions of certain traditional arguments for the incompatibility of human freedom with causal determinism and for the incompatibility of human freedom with infallible divine foreknowledge. Common to all of these is some form of a principle governing the transfer of a species of alethic necessity (TPN). More recently, a few clear and compelling counterexamples to TNP (and a variant of it) have begun to surface in the literature. (...) These attacks on TNP are developed along somewhat different lines (and were apparently worked out independently of each other). I will show that despite the differences in presentation, however, all of the compelling counterexamples that have been offered turn on a common (and overlooked) basic feature. Once this feature is recognized, I suggest, one is naturally led to restrict the principle in a way that renders it immune to these counterexamples. (I further argue that the restriction I suggest has independent justification.) I then go on to consider two further attempts to show the invalidity of TNP for power necessity, ones that would not be forestalled by my restriction on TNP, and I argue that they are unsuccessful. In a final section, I compare my modified version of TNP for power necessity with a principle suggested in Ginet (1990). (shrink)

Various restrictions on transformational grammars have been investigated in order to reduce their generative power from recursively enumerable languages to recursive languages.It will be shown that any restriction on transformational grammars defining a recursively enumerable subset of the set of all transformational grammars, is either too weak (in the sense that there does not exist a general decision procedure for all languages generated under such a restriction) or too strong (in the sense that there exists a recursive language (...) that cannot be generated by any transformational grammar thus restricted). This article examines the meaning and significance of the concept of constituent power in constitutional thought by showing how it acts as a boundary concept with respect to three types of legal thought: normativism, decisionism and relationalism. The concept can be fully appreciated, it suggests, only by adopting a relationalist method. This relationalist method permits us to deal with the paradoxical aspects of constitutional founding creatively and to grasp how constituent power, as the generative aspect of the (...) political power relationship, works not only at founding moments but also within the dynamics of constitutional development. Relationalism realizes this ambition by exposing the tension between unity and hierarchy in constitutional foundation and the tension between the people-as-one and the people-as-the governed in the course of constitutional development. It contends, contrary to normativist claims, that constituent power remains a central concept of constitutional thought. (shrink)

The relocation of two Metropolitan Metropolitan Kirill II and Maxim to the North, to Vladimir above Klyazma, put the Galicia-Volyn state and the Ukrainian Church in a difficult position. While Kiev remained the actual Metropolitan Chair, the latter could stay in the northern Russian cities for a long time, without causing much anxiety or dissatisfaction in the South. However, with the relocation of Metropolitan Maxim to permanent residence in the capital of the North-Russian Grand Duke, the rulers of the southwestern (...) region of Russia realized that in this way they were losing significant spiritual and political power, which henceforth gave the North the advantage of the All-Russian genius. The focus of this paper is on a variety of practices associated with the transfer of educational policy and practice from one national education system to another – practices sometimes referred to as ‘policy borrowing’. Its concern is with the ethical and political issues raised by these practices. In particular, it discusses concerns that these practices might be practically inappropriate, that they might be culturally insensitive or inappropriate, and that they might be impositional, exploitative perhaps or even oppressive. Such (...) concerns arise particularly in contexts in which the transfer is from relatively rich and powerful countries to relatively poor and less powerful countries. But policy transfer is a feature of relations between the rich and powerful too, and to some extent the issues are then turned on their head. Those engaged in the business of transfer become more clearly identified as service providers and they have to ask questions about to whom and under what conditions they might provide this service. Finally, the paper considers policy transfer as a form of pedagogy and asks whether the kind of ethical considerations which underpin any properly educational transaction might not provide a guide to behaviour by the agents of policy transfer. The article deals with the criteria upon which the powers of the Seimas (the Parliament of the Republic of Lithuania) and the Government are delimited in the constitutional jurisprudence of Lithuania. It analyses how the Constitutional Court construes the principle of separation of powers as entrenched in the Constitution and evaluates the meaning of the provision of the Constitution that corresponding ‘relations are regulated by law’. If the Constitution provides that certain relations are regulated by means of a law, such (...) relations may be regulated only by means of a legal act, which takes the form of a law, and it is, therefore, not permissible to regulate such relations by Government resolutions or other acts of the executive. The most important elements of legal relations must be regulated (established) by means of a law, whereas Government resolutions might establish the procedure for the implementation of such laws. Rulings of the Constitutional Court reveal that once the powers of a specific branch of state power have been directly established in the Constitution, an institution of state power may not assume the said powers fr om another state institution. It may not transfer or waive them; and such powers may not be amended or limited by means of a law. The question remains, whether the provision of the Law on the Diplomatic Service wh ereby the candidacy of a diplomatic representative must be reviewed by the Seimas Committee on Foreign Affairs in advance is not in conflict with the Constitution. This paper discusses the social effects resulting from the transfer of knowledge and skill both in the spheres of production and machine design. Relevant design determinants and their impact on technological developments are discussed within the theoretical framework of industrial cultures. Two types of skill transfer are analysed in connection with different production philosophies — one more Tayloristic, the other more workshop-oriented. Finally, the paper discusses the relation of both philosophies to the requirements of future production concepts.

In bioethics, discussions of justice have tended to focus on questions of fairness in access to health care: is there a right to medical treatment, and how should priorities be set when medical resources are scarce. But health care is only one of many factors that determine the extent to which people live healthy lives, and fairness is not the only consideration in determining whether a health policy is just. Using food regime analysis, this paper critically analyzes how corporate actors amass, secure and apply power in the global agrifood system through International Investment Agreements (IIAs). IIAs are a key enabler of increasing corporate power in the agrifood system. We focus on three sets of investment provisions in IIAs: (a) the stringent enforceability mechanism of the investor-state dispute settlement (ISDS) system, (b) the expansion of the concept of expropriation, and (c) limitations or prohibitions on host countries to impose (...) performance requirements on foreign investors. We argue that these provisions compromise fairness in the international economic system. Attracted by promises of technology transfer, economic growth and employment, host states often prioritize policies that favor foreign investors even if such policies compromise domestic policy space. We provide analysis and examples of escalating corporate power at different stages of the industrial and transgenic model of agriculture. (shrink)

This is certainly true for the ships that built empires – the large sailing and later steam ships produced by navies and companies in the process of European expansion. Ships traveled between polities and required repairs overseas, taking the construction knowledge and practices with them. Skilled (...) laborers – experienced shipwrights and increasingly also trained engineers – helped to transfer shipbuilding practices across oceans, and to adapt these practices to local conditions based on forms of “blended know-how.” This article explores how the circulation of shipbuilding knowledge and practices within and between maritime empires changed with the increasing pace of industrialization. It does so on the basis of three moments: the Dutch East India Company’s shipbuilding activities in Asia in the seventeenth and eighteenth centuries; the interaction between private industry and the Dutch state in advancing machine-manufacturing in both the Netherlands and on Java in the 1830s and 1840s; and the aid provided by Dutch engineers in laying the groundwork for Japanese industrial warship-construction in the second half of the nineteenth century. Such transfers put high demands on the capacities of states and naval administrators in controlling the flows of necessary resources and skilled labor, requiring complex arrangements between states and private capital. Industrialization did not change this basic fact, but it did change the nature of these arrangements. Although shipbuilding knowledge always remained practice-driven, highly mobile and susceptible to local adaptation, the increasing technological demands created by the transition from sail to steam and wood to iron, combined with the extension of the power of states and transnationally operating manufacturing companies, considerably changed the institutional embeddings and societal consequences of its circulation. As if 2020 were not a peculiar enough year, its fifth month has seen the relatively quiet publication of a preprint describing the most powerful Natural Language Processing (NLP) system to date, GPT-3 (Generative Pre-trained Transformer-3), by Silicon Valley research firm OpenAI. Though the software implementation of GPT-3 is still in its initial Beta release phase, and its full capabilities are still unknown as of the time of this writing, it has been shown that this Artificial Intelligence can comprehend (...) prompts in natural language, on virtually any topic, and generate relevant, original text content that is indistinguishable from human writing. Moreover, access to these capabilities, in a limited yet worrisome enough extent, is available to the general public as of the time of this writing. This paper presents select examples of original content generated by the author using GPT-3. These examples illustrate some of the capabilities of GPT-3 in comprehending prompts in natural language and generating convincing content in response. We use these examples to raise specific, fundamental questions pertaining to the intellectual property of this content and the potential use of GPT-3 to facilitate plagiarism. Our goal is to instigate not just a sense of urgency, but of a present tardiness on the part of the academic community in addressing these questions. (shrink)

Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. As the authors put it: "...we (...) propose an educational renewal of our democratic society.... In this article, we address the relevance of J.S. Mill’s political philosophy for a framework of public health ethics. In contrast to some readings of Mill, we reject the view that in the formulation of public policies liberties of all kinds enjoy an equal presumption in their favor. We argue that Mill also rejects this view and discuss the distinction that Mill makes between three kinds of liberty interests: interests that are immune from state interference; interests that enjoy a presumption (...) in favor of liberty; and interests that enjoy no such presumption. We argue that what is of focal importance for Mill in protecting liberty is captured by the essential role that the value of self-determination plays in human well-being. Finally, we make the case for the plausibility of a more complex and nuanced Millian framework for public health ethics that would modify how the balancing of some liberty and public health interests should proceed by taking the thumb off the liberty end of the scale. Mill’s arguments and the legacy of liberalism support certain forms of state interference with marketplace liberties for the sake of public health objectives without any presumption in favor of liberty. As a growing area of research, the philosophy of time is increasingly relevant to different areas of philosophy and even other disciplines. The ongoing coronavirus 2019 pandemic caused by the severe acute respiratory syndrome coronavirus 2 has resulted in a severe ramification on the global healthcare system, principally because of its easy transmission and the extended period of the virus survival on contaminated surfaces. With the advances in computer-aided diagnosis and artificial intelligence, this paper presents the application of deep learning and adversarial network for the automatic identification of COVID-19 pneumonia in computed tomography scans of the lungs. The complexity and time limitation (...) of the reverse transcription-polymerase chain reaction swab test makes it disadvantageous to depend solely on as COVID-19’s central diagnostic mechanism. Since CT imaging systems are of low cost and widely available, we demonstrate that the drawback of the RT-PCR can be alleviated with a faster, automated, and reduced contact diagnostic process via the use of a neural network model for the classification of infected and noninfected CT scans. In our proposed model, we explore the benefit of transfer learning as a means of resolving the problem of inadequate dataset and the importance of semisupervised generative adversarial network for the extraction of well-mapped features and generation of image data. Our experimental evaluation indicates that the proposed semisupervised model achieves reliable classification, taking advantage of the reflective loss distance between the real data sample space and the generated data. Can computer systems ever be considered moral agents? This paper considers two factors that are explored in the recent philosophical literature. First, there are the important domains in which computers are allowed to act, made possible by their greater functional capacities. Second, there is the claim that these functional capacities appear to embody relevant human abilities, such as autonomy and responsibility. I argue that neither the first (Domain-Function) factor nor the second (Simulacrum) factor gets at the central issue in the (...) case for computer moral agency: whether they can have the kinds of intentional states that cause their decisions and actions. I give an account that builds on traditional action theory and allows us to conceive of computers as genuine moral agents in virtue of their own causally efficacious intentional states. These states can cause harm or benefit to moral patients, but do not depend on computer consciousness or intelligence. (shrink)

The doctrine of the specious present, that we perceive or, at least, seem to perceive a period of time is often taken to be an obvious claim about perception. Yet, it also seems just as commonly rejected as being incoherent. In this paper, following a distinction between three conceptions of the specious present, it is argued that the incoherence is due to hidden metaphysical assumptions about perception and time.
