This book is an inquiry into the philosophical concern with truth as one joint subject in philosophy of language and metaphysics and presents a theory of truth, substantive perspectivism (SP). Emphasizing our basic pre-theoretic understanding of truth (i.e., what is captured by the axiomatic thesis of truth that the nature of truth consists in capturing the way things are), and in the deflationism vs. substantivism debate background, SP argues for the substantive nature of non-linguistic truth and its notion’s (...) indispensable substantive explanatory role, both of which are not only intrinsically beyond what the linguistic function of the truth predicate can tell but are fundamentally related to the raison d’être of the truth predicate. Taking a holistic approach, SP endeavors to do justice to various reasonable perspectives, which are somehow contained in many competing accounts of truth, through a coordinate system: SP interprets such perspectives as distinct but related perspective-elaboration principles that distinctively (regarding distinct dimensions of the truth concern and/or for the sake of distinct purposes) elaborate, but are also unified by, the truth axiom thesis. To look at the issue from a broader vision, the book also takes a cross-tradition approach exploring the relationship between Daoist thinking of truth and thinking about truth in analytic philosophy.This book will enhance our systematic understanding of the issue through its holistic approach, broaden our vision on the issue via its cross-tradition approach, and enrich the conceptual and explanatory resources in treating the issue. In this paper we study substantive assumptions in social interaction. By substantive assumptions we mean contingent assumptions about what the players know and believe about each other’s choices and information. We first explain why substantive assumptions are fundamental for the analysis of games and, more generally, social interaction. Then we show that they can be compared formally, and that there exist contexts where no substantive assumptions are being made. One of the many ways that ‘deflationary’ and ‘inflationary’ theories of truth are said to differ is in their attitude towards truth qua property. This difference used to be very easy to delineate, with deflationists denying, and inflationists asserting, that truth is a property, but more recently the debate has become a lot more complicated, owing primarily to the fact that many contemporary deflationists often do allow for truth to be considered a property. Anxious to avoid inflation, however, these deflationists (...) are at pains to point out that the truth property, on their view, is not a property of any significant interest. Correspondingly, inflationists have seen this as an opportunity to refine what kind of property they think truth is, which—according to them—moves their views beyond deflationism. The upshot of this is that there are number of different accounts in the literature of what distinguishes an inflationary truth property from a deflationary one, or—as it is sometimes put—what distinguishes a ‘substantive’ property from an ‘insubstantive’ one. This has made it hard to pin down exactly what is at issue at the metaphysical level between deflationists and inflationists, which makes it increasingly hard to see how debates between them are properly phrased. Given that these positions represent the two central attitudes towards truth in contemporary debates, this makes for a serious obstacle for the project of discerning the correct theory of truth. The aim of this paper is to discern the best way to distinguish between substantive and insubstantive properties, and thus to restore some focus to these debates. I argue that the three central distinctions in the literature fail, and offer what I take to be a more promising distinction in terms of a graded distinction between abundant and sparse properties. This article seeks to establish that the social sciences have an important contribution to make to the study of ethics. The discussion is framed around three questions: (i) what theoretical work can the social sciences contribute to the understanding of ethics? (ii) what empirical work can the social sciences contribute to the understanding of ethics? And (iii) how does this theoretical and empirical work combine, to enhance the understanding of how ethics, as a field of analysis and debate, is socially (...) constituted and situated? Through these questions the argument goes beyond the now commonly cited objection to the over‐simplistic division between normative and descriptive ethics (that assigns the social sciences the ‘handmaiden’ role of simply providing the ‘facts’). In extending this argument, this article seeks to establish, more firmly and in more detail, that: (a) the social sciences have a longstanding theoretical interest analysing the role that a concern with ethics plays in explanations of social change, social organisation and social action; (b) the explanations that are based on the empirical investigations conducted by social scientists exemplify the interplay of epistemological and methodological analyses so that our understanding of particular substantive issues is extended beyond the conventional questions raised by ethicists, and (c) through this combination of theoretical and empirical work, social scientists go beyond the specific ethical questions of particular practices to enquire further into the social processes that lie behind the very designation of certain matters as being ‘ethical issues’. The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. John Earman's recent proposal that a substantive version of general covariance consists in the requirement that diffeomorphism invariance be a gauge symmetry is critically assessed. I argue that such a principle does not serve to differentiate general relativity from pre-relativistic theories. A model-theoretic characterization of two formulations of specially-relativistic theories is suggested. Diffeomorphisms are symmetries of only one such style of formulation and, I argue, Earman's proposal does not provide a reason to deny diffeomorphisms the status of gauge transformations (...) relative to this formulation. Carlo Rovelli's distinction between "passive" and "active" diffeomorphism invariance is also clarified. (shrink)

One way to challenge the substantiveness of a particular philosophical issue is to argue that those who debate the issue are engaged in a merely verbal dispute. For example, it has been maintained that the apparent disagreement over the mind/brain identity thesis is a merely verbal dispute, and thus that there is no substantive question of whether or not mental properties are identical to neurological properties. The goal of this paper is to help clarify the relationship between mere verbalness (...) and substantiveness. I first argue that we should see mere verbalness as a certain kind of discourse defect that arises when the parties differ as to what each takes to be the immediate question under discussion. I then argue that mere verbalness, so understood, does not imply that the question either party is attempting to address is a non-substantive one. Even if it turns out that the parties to the mind/brain dispute are addressing subtly different questions, these might both be substantive questions to which their respective metaphysical views provide substantive answers. One reason it is tempting to reach deflationary conclusions from the charge of mere verbalness is that we fail to distinguish it from the claim that a sentence under dispute is, in a certain sense, indisputable. Another reason is that we fail to distinguish mere verbalness from a certain sort of indeterminacy. While indisputability and indeterminacy plausibly capture forms of nonsubstantiveness, I argue that mere verbalness is insufficient to establish either indisputability or indeterminacy. (shrink)

The accounting profession’s image and reputation is built upon the members of the profession acting with the “highest sense of integrity” in “the public interest” (AICPA, 2003, www.aicpa.org/about). The Enron debacle initiated the latest crisis facing the profession regarding its image and reputation. The American Institute of Certified Public Accountants (AICPA) is the largest professional body representing the accounting profession and the one to which regulators have looked in establishing and upholding professional standards relating to the public practice of (...) accounting and auditing. One of the AICPA’s responsibilities is to “promote public awareness and confidence in the integrity, objectivity, competence and professionalism of CPAs ....” (AICPA, 2003, www.aicpa.org/about). We analyze the public statements issued by the AICPA (i.e., press releases, speeches of officers, testimony, published articles) during this ethical and identity crisis beginning with the AICPA’s first public statement on the Enron debâcle (AIPCA 2001) and concluding with the AICPA recognizing the need for a “new accounting culture” (Melancon 2002). In order to better understand the public discourse, we use image restoration theory (Benoit, 1995), because it provides a typology of strategies for dealing with the public face of crises. We identify the three most common strategies the AICPA employs during this period. Proposals for taking corrective action represent the most commonly employed strategy, but the analysis also indicates an attempt to evade responsibility by claiming defeasibility and to reduce the offensiveness of the situation by employing a bolstering strategy. A second analysis using DICTION, a software package useful in revealing latent dimensions in a text, indicates that early statements tend to use language related to accomplishing specific action while the later statements tend more toward general language that relates to peoples’ everyday lives. The findings raise questions as to substantive nature of the changes proposed by the AICPA, and thus, the extent to which the public interest is being served by them. (shrink)

Philosophy can serve two roles in relation to moral thinking: first, to provide a meta-ethical commentary on the nature of moral thought, as the methodology or the philosophy of science provides a commentary on the nature of scientific thought; and second, to build on the common presumptions deployed in people's moral thinking about moral issues, looking for a substantive moral theory that they might support. The present essay addresses the nature of this second role; illustrates it with (...) class='Hi'>substantive theories that equate moral obligations respectively with requirements of nature, self-interest, benevolence, reason and justifiability; and outlines a novel competitor in which the focus is shifted to requirements of co-reasoning and respect. The aim of this study is to determine to what extent the tense markers of tense logic represent what is represented by the tense forms of natural language. To achieve this, it will be necessary to report the findings of linguistics on what the tense forms of natural languages do represent. The justification for this study lies in a fundamental difference between natural and logical languages. Where natural languages develop to meet the needs of their speakers, logical language is used (...) for testing the validity of argument of a certain kind. Tense logic has been used to examine philosophical issues, and in linguistics to examine how tenses describe many different possible structures of time. (shrink)

Truth is a fundamental objective of adjudicative processes; ideally, ‘substantive’ as distinct from ‘formal legal’ truth. But problems of evidence, for example, may frustrate finding of substantive truth; other values may lead to exclusions of probative evidence, e.g., for the sake of fairness. ‘Jury nullification’ and ‘jury equity’. Limits of time, and definitiveness of decision, require allocation of burden of proof. Degree of truth-formality is variable within a system and across systems.

This chapter examines the order/justice issue within the institutionalized context of the UN. It asks whether the UN and its members have achieved a substantive consensus on the content of international justice, and concludes that the underlying tension evident in the UN Charter between rules designed to bolster interstate stability and those aimed at the promotion of justice still persist. Nevertheless, it also argues that the pursuit of various justice issues has long been seen as a legitimate part (...) of UN activities; thus, despite the controversies such activities generate, the UN's interest in justice issues will continue. So-called grand or paradigmatic theories—structural functionalism, psychoanalysis, Marxism, rational-choice theory—provide their proponents with a conceptual vocabulary and syntax that allows for the classification and configuring of wide ranges of phenomena. Advocates for any particular “analytical grammar” are accordingly prone to conflating the internal coherence of their paradigm—its integrated complex of definitions, axioms, and inferences—with a corresponding capacity for representational verisimilitude. The distinction between Theory-as-heuristic and Theory-as-imposition is of course difficult to negotiate in practice, given that empirical observation and measurement are (...) not entirely “theory neutral” or independent of prior analytical conceptualization. Nonetheless, the scientific cogency of any theory is ultimately evaluated by the substantive realism of its foundational assumptions and categorical designations; that is, the accuracy with which it identifies and tracks the determinant properties and processes of the phenomena to be explicated. The paradigm of sociocultural evolutionism—despite extensive revamping by contemporary proponents—does not carry warrant in this regard, as its recourse to an analytical grammar fashioned and derived from another discipline raises doubts about its empirical veridicality. This article revisits the contentious issue of remodeling social phenomena in accordance with biological categories and offers both a theoretical and a substantive critique of the “selectionist” paradigm. The Pittsburgh protocol is ethically and legally acceptable as written, but more research is needed to determine if it can be implemented in ways that will observe the procedures that make it ethically acceptable. If so, its desirability as public policy will depend on the number of organs it is likely to generate and its effects on public attitudes toward organ donation generally. In the final analysis, the controversial aspects of this protocol concern symbolic issues about respect for the (...) dead and near dead, rather than substantive concerns that real patient interests will be harmed. Statistical model specification and validation raise crucial foundational problems whose pertinent resolution holds the key to learning from data by securing the reliability of frequentist inference. The paper questions the judiciousness of several current practices, including the theory-driven approach, and the Akaike-type model selection procedures, arguing that they often lead to unreliable inferences. This is primarily due to the fact that goodness-of-fit/prediction measures and other substantive and pragmatic criteria are of questionable value when the estimated model is statistically misspecified. Foisting one's favorite model on the data often yields estimated models which are both statistically and substantively misspecified, but one has no way to delineate between the two sources of error and apportion blame. The paper argues that the error statistical approach can address this Duhemian ambiguity by distinguishing between statistical and substantive premises and viewing empirical modeling in a piecemeal way with a view to delineate the various issues more effectively. It is also argued that Hendry's general to specific procedures does a much better job in model selection than the theory-driven and the Akaike-type procedures primary because of its error statistical underpinnings. Notions of space and place are often used interchangeably in everyday speech, but they are distinguished both conceptually and historically. When put in relation to space and place, beauty reveals all its vitality and ties to socio-political issues, like: why do we consider a place beautiful and another place ugly? How do taste judgments about places influence planning, tourism, heritage policies, urban, and landscape architecture? I will develop my argument in four points. First, I will shortly pin down the (...) main tenets of a concept of beauty that is inherently spatial, by rephrasing Roger Scruton’s insights on the beautiful and Ed Casey’s notion of ‘implacement’. Second, I will address the interconnection between the modern emergence of a quantitative and objectivist concept of space and a non-relational idea of beauty. Third, I will expose the relationship between the concept of place, idiographic and qualitative, and the emergence of a site-specific, phenomenologically based concept of beauty. In conclusion, I will show how non-relational conceptions of beauty risk to colonize aesthetic experience and I will take a stand for a relational conception of beauty against the risk of standardization of both landscape appreciation and planning. The article examines the provisions of the catechisms of the Ukrainian Greek Catholic Church regarding the war and its challenges, as well as the defense of the Motherland. A comparative analysis of relevant thematic instructions in the Catechism “Christ is our Easter” (published in 2011), the Catechism for youth “We walk with Christ” (published in 2021) and the “Catechism of the Christian Warrior” (published in 2022) was carried out. It was determined that the provisions of the UGCC's own fundamental doctrinal (...) documents, its Catechisms, regarding the problems of war and defense of the Motherland, were formed, clarified and supplemented according to the circumstances and needs of the time. The catechism of the UGCC “Christ is our Easter” contains general Christian considerations on the subject under consideration, which are principled, establishing, and refer to how civilized peoples should conduct themselves. The catechism for youth, created in the previous years of the undeclared Russian Federation's “hybrid” war against Ukraine, covers the issues related to the war and the defense of the Motherland in a substantive way and closer to current Ukrainian realities, although it still has some idealistic approach. The Catechism of the Christian Warrior, the preparation of which was completed and the publication was carried out during the full-scale military offensive of the aggressor, is a set of thorough and competent advises for Ukrainian soldiers, where things are called by their names, and there are no provisions that can cause doubts due to experience and be problematically achievable for implementation. Therefore, it is concluded that especially this Catechism, together with and in addition to the two previous ones, is a useful and timely contribution of the UGCC to the instruction of Ukrainians during the war, and therefore to Ukraine's victory over the enemy. The study focuses on the links between gender and national security in the legislative arena in Israel, considering whether men and women legislators prioritize security differently, alongside other thematic policy areas. The centrality of national security issues in Israeli politics makes it a good case study for these questions, as it enhances existing gendered stereotypes. The article examines two competing hypotheses. The first suggests that Israeli female legislators will mostly refrain from addressing national security policy issues, focusing instead (...) on softer policy issues, such as gender equality, education, health, and welfare. The second suggests the opposite, claiming that women legislators in Israel will align themselves with their male counterparts’ set of priorities, focusing heavily on issues related to national security. The study finds support mostly for the former: Israeli female legislators are especially active in policy areas relating to women’s issues and children/family and are less active in regard to national security, a policy area heavily dominated by male legislators. Although significant literature and jurisprudence has amassed on rights-based climate litigation over recent years, less research and case law has emerged on poverty-related court cases and the fulfilment of economic, social, and cultural rights (ESCR) in Canada. Fewer still are studies exploring the interlinkages between these areas of inquiry. The purpose of this paper is to explore, using Canada as a case study, rights-based developments in climate litigation cases and how these could impact the innovative advancement of ESCR (e.g. to (...) food, housing and water). Typically, issues of justiciability and standing emerge, impeding the realization of such rights. Given the grave threats we now face, climate cases and social movements must be brought together to better hold state actors accountable for their rights obligations. We implore the legal community to explore ways to traverse juridical obstacles to realize the interdependencies of human rights and protect the planet from calamitous climate change. (shrink)

This article takes stock of recent efforts to implement controversy analysis as a digital method in the study of science, technology, and society and beyond and outlines a distinctive approach to address the problem of digital bias. Digital media technologies exert significant influence on the enactment of controversy in online settings, and this risks undermining the substantive focus of controversy analysis conducted by digital means. To address this problem, I propose a shift in thematic focus from controversy analysis to (...) issue mapping. The article begins by distinguishing between three broad frameworks that currently guide the development of controversy analysis as a digital method, namely, demarcationist, discursive, and empiricist. Each has been adopted in STS, but only the last one offers a digital “move beyond impartiality.” I demonstrate this approach by analyzing issues of Internet governance with the aid of the social media platform Twitter. The relationship between descriptive representation and substantive representation is an issue that has been widely discussed by women’s studies scholars. In general, it is assumed that there exists a positive relationship between the two, but the literature and empirical analysis show that substantive representation also depends on the action of other critical actors, such as gender agencies and the women’s social movement. Comparative research has shown the existence of a common pattern in post-industrial democracies: the development of women-friendly (...) policies depends on the existence of coalitions between these critical actors. However, the analysis usually focuses on the national or regional level, and there is very little analysis at the local level, despite this being a political arena in which these processes can be developed. The aim of this article is to analyse the effect of coalitions of critical actors on the responsiveness to the demands of women’s groups in the case of Spanish municipalities using a representative survey. The objective, therefore, is to apply advances in the women’s substantive representation literature to the local level in Spain. Main results show that responsiveness is higher in municipalities where women’s coalitions exist. (shrink)

Medical ethics in Buddhism involves essentially the application of the wider principles of religious ethics to problems in a more specialized field. The “Four Principles” approach can be only partially successful in the context of Buddhism. This chapter considers Buddhist view on substantive biomedical issues. The topics discussed include abortion, death and dying, brain death and organ donation, and cloning. Buddhism has had a particular interest in the analysis of stem cell research, psychology and neuroscience. Caution must be (...) exercised when drawing conclusions about Buddhist perspectives on bioethics, as there is a risk of inadvertently superimposing Western categories on the discussion. The doctrine of karma and the belief in rebirth make Buddhism distinctive from an ethical perspective, and it is also renowned for its emphasis on benevolence and compassion and a scrupulous respect for living beings. The article focuses on stories and storytelling practices as explanatory resources in standardization processes. It draws upon an ethnographic study of the development of a technical standard for data sharing in an ecological research community, where participants struggle to articulate the difficulties encountered in implementing the standard. Building from C. Wright Mills’ classic distinction between private troubles and public issues, the authors follow the development of a story as it comes to assist in transforming individual troubles in standard implementation (...) into an institutional issue for the ecological scientific community. The authors present the “hands-on” social science collaboration in this study as an example of a mechanism for supporting institutionalization of issues. Finally, the authors argue that narratives can serve as effective organizing principles within institutional settings, thereby providing an approach to understand the practical, substantive difficulties that occur in work with data in the sciences. The aim of this study was to reflect on the origins and meanings of names describing investment practices that integrate a consideration of environmental, social and corporate governance issues in the academic literature. A review of 190 academic papers spanning the period from 1975 to mid-2009 was conducted. This exploratory study evaluated the associations and disassociations of the primary name assigned to this genre of investment with variables grouped into five domains, namely Primary Ethical Position, Investment Strategy, Publication Date, (...) Regions Covered and Periodical Type. The study indicated that papers coded as expressing a deontological ethical position were more frequently associated with the name Ethical Investment , whereas those with an ambiguous ethical position were less frequently associated with Ethical Investment . Three investment strategies (positive screening, best-in-class and cause-based investing) were unusually associated with the primary name Responsible Investment . A strong preference for the name Ethical Investment was noted in the United Kingdom, and contrasted starkly with an apparent aversion for this name in the United States. The name Ethical Investment is significantly more frequently used in journals dealing with ethics, business ethics and philosophy than in finance, economic and investment journals. Finally, the study yielded some weak hints that the name Responsible Investment might perhaps be linked to an egoist ethical position. On the basis of this, and because these have already been substantively linked through the Principles for Responsible Investment in the popular discourse, we follow the heuristic tradition set by Sparkes (Business Ethics Eur Rev 10:194–201, 2001 ), and propose that Responsible Investment be defined as ‘Investment practices that integrate a consideration of ESG issues with the primary purpose of delivering higher-risk-adjusted financial returns’. We argue that actualism makes a morally irrelevant distinction between certain counterfactuals, given that an agent sometimes has the same kind of control over their truth-value. We then offer a substantive revision to actualism that avoids this morally irrelevant distinction by focusing on a certain kind of control that is (...) available to an agent. Most countries promote mass immunisation programmes. The varying policy details raise a raft of philosophical issues. I have two broad aims in this paper. First, I hope to begin to remedy a rather curious philosophical neglect of immunisation. With this in mind, I take a broad approach to the topic hoping to introduce rather than settle a range of philosophical issues. My second aim has two aspects: I argue that the states should have pro‐immunisation policies, and I advance (...) a view on the subsequent and more specific question as to which sorts of pro‐immunisation policies they should prefer. I use the immunisation policies of the United States and New Zealand to frame my discussion of these substantive questions. Immunisation is effectively compulsory in the United States. New Zealand, by contrast, requires evidence not of immunisation but of immunisation status upon school enrolment: New Zealand's policy effectively makes immunisation choice compulsory. I argue that, as between the pro‐immunisation policies of the United States and New Zealand, the latter should be preferred. Though the threshold question as to whether states should have pro‐immunisation policies should be answered affirmatively, the move to compulsory immunisation cannot be justified. (shrink)

This article is in response to Wurr and Cooney’s Case Discussion entitled ‘Ethical dilemmas in population-level treatment of lead poisoning in Zamfara State, Nigeria’. The Case Discussion draws attention to Médecins Sans Frontières’ (MSF’s) remarkable achievement of providing the world’s first population-level treatment for severe lead poisoning. Wurr and Cooney raise two key ethical issues: treatment in the face of ongoing exposure, and withdrawal from program. Having participated in the emergency response to the lead-poisoning outbreak, I reflect on the (...) Case Discussion and how the ethical issues fall within a troubling broader context. I offer a deeper analysis of the ethical issues by raising further substantive and philosophical considerations. I draw attention to social injustice and inequity at the root of the disaster, and link the disaster to neoliberal economic policies that impose public health austerity and then look to private non-governmental organizations for disaster response. A larger ethical concern is how the humanitarian response, in addressing immediate medical needs, can leave unjust political structures intact. Around the world, abject poverty, high gold prices and unviable traditional farming continue to drive families into dangerous artisanal mining. Meanwhile, the longer-term prospects for the severely lead-affected children of northern Nigeria remain grim. (shrink)

The act of “embezzlement” provided for in Article 183 of the Criminal Code of the Republic of Lithuania gives rise to a number of both theoretical and practical problems. First of all, various authors do not agree whether embezzlement constitutes a substantive or formal element. In the author’s opinion, embezzlement is deemed complete when possession of the property of others is taken illegally and there is a real possibility, perceived by the perpetrator, to manage it, to use it or (...) to dispose of it or misappropriation is made of a property right, giving the perpetrator a possibility to receive other persons’ property or property benefit immediately or in the future, to treat the property of others as one’s own. That is, when a real possibility, perceived by the perpetrator, to treat the property of others as one’s own arises but not when the damage is caused. In this case, particular importance is adduced to the condition that the perpetrator must clearly perceive his/her possibility to treat the property of others as one’s own. In case such a possibility has not been perceived by the perpetrator, we cannot state that embezzlement is complete. The moment of completeness and the fact that in practice there may be cases where no real damage is caused to a legal entity when the perpetrator embezzles property of the former (see the example in footnote 15), show that the criminal act provided for in Article 183 of the Criminal Code contains a formal element. When evaluating practical problems, the article overviews two rulings of the Supreme Court of Lithuania that are of particular importance for the formation of the case-law. Before the ruling of the Supreme Court of Lithuania of 8 May 2012, this court used to formulate somewhat erroneous case-law in examining cases concerning accusations raised on the basis of Article 183 of the Criminal Code. In cases where the head (shareholder) of a company was accused of embezzlement and used all the “cashed” funds of the company only for the interests and benefit of the company, the court used to evaluate the factual circumstances of the case not as indicative of the fault of the defendant, but only as indicative of the purpose of his/her act. Even if it was determined that the perpetrator did not perceive the real possibility to treat the company’s property as his/her own and always used to regard the property which came to his/her disposal as the company’s property, the court used to qualify the perpetrator’s act as embezzlement, by reasoning that the purpose of the perpetrator’s act was not a circumstance relevant for such qualification. It can be stated that in such a manner the court failed to distinguish between the concept of purpose and the concept of fault, failed to evaluate the features of the subjective part individually, and assessed them in their entirety. Due to such a mistake, the court created an impression that the concepts of fault and purpose in the case were confused. By its ruling of 8 May 2012 the Supreme Court of Lithuania corrected those mistakes, however, its instruction to investigate whether “cashed” funds were not used “for personal needs” and whether the company suffered damage introduced a confusion into the investigation of cases of this type and their examination in court, as the concept of “personal needs” was not absolutely clear, whereas the fact of suffering damage was not necessary in order to qualify an act under Article 183 of the Criminal Code. In the author’s opinion, the Supreme Court of Lithuania should pronounce clearly that the cases where the head (shareholder) of the company has not perceived the real possibility to treat the other person’s property as his/her own will not be regarded as property embezzlement and there will be no deliberation in the person’s act. The absence of such perception would be confirmed by the fact that the perpetrator has used absolutely all “cashed” money of the legal entity only for the interest and benefit of the company. The tobacco industry has used corporate social responsibility tactics to improve its corporate image with the public, press, and regulators who increasingly have grown to view it as a merchant of death. There is, however, an intractable problem that corporate social responsibility efforts can mask but not resolve: the tobacco industry's products are lethal when used as directed, and no amount of corporate social responsibility activity can reconcile that fundamental contradiction with ethical corporate citizenship. This study's focus is to better (...) understand the tobacco industry's corporate social responsibility efforts and to assess whether there has been any substantive change in the way it does business with regard to the issue of exposure to secondhand smoke. The results show that the industry has made no substantial changes and in fact has continued with business as usual. Although many of the tobacco companies' tactics traditionally had been defensive, they strove for a way to change to a more offensive strategy. Almost without exception, however, their desire to appear to be good corporate citizens clashed with their aversion to further regulation and jeopardizing their legal position, perhaps an irreconcilable conflict. Despite the switch to offense, in 2006 a federal judge found the companies guilty of racketeering. (shrink)

Psychiatric genomics research with African populations comes with a range of practical challenges around translation of psychiatric genomics research concepts, procedures, and nosology. These challenges raise deep ethical issues particularly around legitimacy of informed consent, a core foundation of research ethics. Through a consideration of the constitutive function of language, the paper problematises like‐for‐like, designative translations which often involve the ‘indigenization’ of English terms or use of metaphors which misrepresent the risks and benefits of research. This paper argues that (...) effective translation of psychiatric genomics research terminology in African contexts demands substantive engagement with African conceptual schemas and values. In developing attenuated forms of translational thinking, researchers may recognise the deeper motivational reasons behind participation in research, highlighting the possibility that such reasons may depart from the original meaning implied within informed consent forms. These translational issues might be ameliorated with a critical re‐examination of how researchers develop and present protocols to institutional ethics review boards. (shrink)

Like most philosophers, Laudan [7] believes that by and large science makes cognitive progress and that the development of science is more or less rational. Recent articles on teaching controversial topics in schools have employed Michael Hand's distinction between “directive teaching,” in which teachers attempt to persuade students of correct positions on topics that are not rationally controversial, and “nondirective teaching,” in which teachers avoid persuading students on topics that are rationally controversial. However, the four methods of directive teaching discussed in the literature — explicit directive teaching, “steering,” “soft-directive teaching,” and “school ethos endorsement” — make rational persuasion problematic, if not self-defeating. In this essay, (...) Maughn Rollins Gregory argues that “procedurally directive teaching” offers an alternative to such approaches because it derives from the intention to guide inquiry rather than to persuade. He demonstrates that the conceptual frameworks of perfectionism and antiperfectionism, which have been proposed for directive teaching on same-sex marriage, can instead be used to generate open questions for student inquiry, as can a third, civil rights framework. Given these considerations, Gregory maintains that pedagogical guidance on this topic should be procedurally directive rather than substantively directive. Further, the fact that legal, political, and ethics scholars disagree about which framework is more appropriate to the issue of same-sex marriage indicates that such arguments cannot be dispositive of the pedagogical issue of how to frame classroom discussions about it. Rather, students should inquire into this meta-level framing dispute for themselves. (shrink)

The doctrine of inerrant divine “middle knowledge” of future contingent events, first developed by the sixteenth century Jesuit theologian Luis de Molina, has resurfaced as a prominent position within contemporary debates over divine foreknowledge, creaturely freedom, and the ontological status of possibilities. As yet, the only substantive response to the new Molinism from a process perspective has come in a brief section on “Hartshorne and the Challenge of Molinism,” in an essay on Hartshorne’s view of “The Logic of Future (...) Contingents” by George W. Shields and Donald W. Viney, in Shields’ edited anthology Process and Analysis.Shields and Viney offer an insightful critique of Molinism. However, their use of Hartshorne’s understanding of possibility presents problems for those, like me, who prefer Whitehead’s more robustly realist notion of eternal objects. Here, I defend Whitehead’s Platonism from the main lines of criticism leveled against itby Hartshorne, while demonstrating that a “thick” conception of the objective content of the possible within the context of the divine understanding need not crossover into a deterministic conception of God’s foreknowledge, à la Molina.
