In recent years, preimplantation genetic testing (PGT) of IVF embryos have gained much traction in clinical assisted reproduction for preventing various genetic defects, including Down syndrome. However, such genetic tests inevitably reveal the sex of IVF embryos by identifying the sex (X and Y) chromosomes. In many countries with less stringent IVF regulations, information on the sex of embryos that are tested to be genetically normal is readily shared with patients. This would thus present Muslim patients with unintended opportunities for (...) sex selection based on personal or social biases without any pressing need or valid medical reason. Additionally, there are other patients who claim using PGT for preventing genetic defects as a pretext or “convenient excuse,” with a secret intention to do sex selection when it is banned in their home country. Currently, non-medical sex selection is a highly-controversial and hotly debated issue in Islam, because there is generally a strong preference for having sons over daughters due to widespread cultural norms of elderly parents depending on their sons for financial support, as well as the need for male heirs to continue the family lineage within the backdrop of local patriarchal cultures. There is a risk of gender imbalance and social disequilibrium occurring in Islamic societies due to prevalent sex selection. Hence, the question is whether opportunistic sex selection with PGT would contravene Islamic ethics and principles, which will thus be discussed here. (shrink)

The purpose of the present paper is to discuss the metaphor system for conceptualizing the Self in Arabic. A comparison of structural means for conceptualizing inner life in Arabic and English leads to the conclusion that although on the structural (‘grammatical’) level the differences between the two languages are indeed considerable, they become far less radical on the conceptual (‘semantic’) level. More specifically, it is argued here that in Arabic, as in English, inner experiences are for the (...) most part conceptualized metaphorically and that Arabs seem to conceptualize their inner lives in a way similar, or at least comparable, to the speakers of English. While the article shows that on the conceptual level there are several important correspondences between Arabic and English, it hypothesizes that they reflect some fundamental and presumably universal human experiences and cognitive abilities. Finally, the linguistic material analyzed here provides a point of departure for touching upon the relativism-universalism debate. The paper argues that the controversy depends, at least to some extent, on whether one chooses to focus on potentially universal conceptualizations (and their underlying cognitive mechanisms) or more culture-specific structural relations (the contingent and historical conventions). Thus, while it seems to be a matter of one's personal decision whether to place the potentially universal in the foreground and the more idiosyncratic in the background, or the other way round, the article emphasizes the usefulness of explaining certain striking conceptual similarities in terms of their bodily basis. : A rich array of twelfth to fifteenth century Arabic texts captures the advent of a supererogatory prayer known as ṣalāt al-raghā’ib, on the eve of the first Friday of the month of Rajab in late eleventh-century Jerusalem, and its wide dissemination. This corpus offers an unusually vivid picture of the formation and the transformation of a medieval bid’a, or, of an ‘invention of tradition’. Combining our expertise in Islamic law and in Ayyūbid and Mamluk era history, we use (...) this corpus for an in-depth study of popular piety, power politics, scholarly polemics and legal discourse. Twenty eight translated excerpts of various texts are presented in this paper, preceded by a detailed introduction. Exploring legal reasoning in its concrete political and social context provides a nuanced understanding of the development, mass proliferation and ensuing debate over a highly controversial and extraordinary potent religious practice. This article examines an innovative experiment in democratizing international broadcasting through embracing a participatory model of production. In spring 2010, a political debate television series was co-created by BBC Arabic and citizen producers, using social media tools. Based around interviews with prominent political and controversial public figures, the programme (G710) was broadcast weekly on satellite TV across the Middle East and the Arabic-speaking world. Combining collaborative ethnography with corporate ‘big data’ analysis, the research team followed the experiment from (...) conception to premature closure. The article argues that the kinds of digital tools deployed in producing the programme, and used by BBC audience research to monitor user practices in real time, have become essential to corporate processes of BBC World Service governance and management procedures, business strategy, accountability measures, marketing practices and editorial decision-making. They act as change agents, presenting methodological problems and opportunities for the BBC’s audience researchers and academic researchers, as well as symbolizing the contradictory logic of empowerment and surveillance. The goal of this study is to explore the cultural worldview of the prominent contemporary Arab poet and critic, Adonis (b. 1935). Adonis was one of the first thinkers to question the notion of tura>th (cultural heritage) and to consider it the main cause behind the backwardness of the Arab people of today. Better known as a poet, Adonis’s role as a cultural critic deserves to be highlighted. The present study aims to remedy this by analyzing and criticizing his position (...) on tura>th which was based on a deconstructive reading of foundational texts. His goal was to prove that tura>th was illogical and a hindrance to modernity or creativity. To better understand Adonis’s view on tura>th , this study investigates it against his intellectual and ideological background, and analyzes it in the light of primary texts. It concludes that, as a secular deconstructionist, Adonis sees inherited tura>th as a “text” retaining a static/dynamic dualism, and tries to show that the static elements of tura>th , which always appear stable, logical and capable of achieving progress, actually make it otherwise. He argues that divine revelation is responsible for the predominance of the static aspect of tura>th and hence represents an obstacle to human creativity and progress. For this reason, it must be deconstructed, paving the way for replacement of the static, i.e., religious elements, with dynamic or secular elements, which alone can enable the reconstruction of civilization. But, in the process, Adonis may, by replacing the religious with the secular, merely be setting in place a new static dimension. (shrink)

This paper focuses on the description and analysis of three codices from Biblioteca Nacional in Madrid with the aim of redefining their origin, dating, authorship, and content. Connecting their production to the environment of the Sacromonte affair and identifying Pedro de Castro’s hand allows to expand what was known so far about his attempts to learn Arabic and delve into the most controversial aspects of the Lead Books. The grammatical and religious contents, in addition to the copious marginal notes (...) linked to the sources he used, provide valuable information on his selection of works. Grammatical materials such as al-Āŷurrūmiyya, of which different versions are preserved in these codices, were being published in Rome and Leiden and would be widely disseminated. The building up of his library, to which these codices must have belonged, runs in parallel to the construction of an orientalist knowledge in modern Europe. (shrink)

Few would contest the fact that Arabs and Aramaeans share a long cultural history. Nor is it controversial to say that there has been contact-based influence between the two languages. However, what is missing until today is the recognition of how pervasive this contact-based influence has been. In this paper I present 24 detailed structural arguments from the basic domains of phonology, morphophonology, morphology and syntax for widespread pre- and early Islamic influence from Aramaic on Arabic. Precisely because the (...) contact lasted for such a long time, equilibrium effects as per Dixon introduce a mosaic of Aramaic linguistic traits into Arabic. These are modelled in terms of “dia-planar diffusion”, the spread of different features among different speech communities at different times. (shrink)

It is known that the relationship between word and meaning is one of the most controversial topics of ancient Greek philosophers such as Aristotle, Plato and Indian linguists. In fact, this issue has continued to be discussed with its definition and scope, and opinions about it have been expressed until today. When we review the subject in the Arabic language, we see that Arabic is a rich language with its words and meanings. Also, changes and developments in (...) class='Hi'>Arabic, which is a deep-rooted language, has undergone in the historical process have brought changes of meaning in its words. Thus, it can be said that the Arabic language, that includes many branches of linguistics such as morphology, syntax and rhetoric, is also interrelated with semantics, what focuses on the relationship between word and meaning. Although semantics has emerged as a new branch of linguistics, many of today's semantic issues have been discussed in many classical sources and different disciplines, especially in the Arab world. In this study, semantics in general and the emergence of Arabic semantics as a science, its scope, description and its relations with other languages have been investigated. In addition, the works of Ahmed Muhtar Omar (1933-2003) who made great effort especially in the field of Arabic language and the modern Arab world, in the domain of Arabic and his contributions to this field, those include the main issue of this study, have been addressed. The general content of his book "Ilmu'd-dalâla", which includes almost all the topics related to semantics, and the important issues and views those it contains are also mentioned. Besides, presenting important issues in the work, especially Ahmed Muhtar Omar's prominent views and explanations are also mentioned. In the study, prominent works about semantics and Arabic semantics, written from the past to the present, were used. In particular, the life and scientific personality of Ahmed Muhtar has been tried to be presented on the basis of a few works written in the contemporary period. (shrink)

Although Sibawayh dealt with it in a scattered manner under different headings there have been different views on na't (adjective), which is gene-rally included in the tawabi group in Arabic syntax, and there have been debates around these views. Na't, which is categorized as a proper adjective and qualifies the meaning of man'ut (mawsuf), has different characteristics from the sentence elements that indicate the subject. Nahiv scholars have mostly divided na't into two parts: real and causal na't, and they (...) have formulated certain rules for these two parts in accordance with the structure of the Arabic language. Since na't and man'ut are accepted as nouns, the i'rab of na't is subject to men'ut. However, some examples in the Qur'an and some expressions used by the Arabs caused objections to the i'rab of na't being the same as men'ut. It is observed that these objected examples are the cases where men'ut is known and the exceptional cases of madih, zam and jarri jivar. It is also obligatory for the na't to conform to the man'ut in terms of ma'rifiyyah, nekiriyyah, custom and gender. While Sibawayh (d. 180/796) considered it qabh (ugly) for non-propositional words to be na't, scholars such as Ibn Hisham (d. 218/833), Ibn al-Ḥajib (d. 646/1249), and Abd ar-Rahman Jami (d. 898/1492) accepted that na't could be either propositional or non-propositional and cited many examples of na't in the case of non-propositional words. Scholars such as Ibn Jinni (d. 392/1002) and Ibn al-Hajib gave an explanation of the causative na't without naming it, scholars such as Ebu’l-Bekā al-Ukbari (d. 616/1219) analyzed the subject under the title of causative adjective or causative na't, and Halid b. Abdullah al-Azhari discussed it under the title of al-wasf al-majazi. The subject of our study is to examine the handling of na't, which is one of the sentence elements in the Arabic language, in the works written on the field, its parts, the dimension that affects the meaning and the controversial aspects. The aim of the research is to examine the rules that Sibawayh deals with in his al-Kitâb on na'ta and the objections of later Arab linguists to these rules, and to contribute to the field by revealing different views on the subject. According to the majority of linguists, case markers at the end of a declinable word, which could be of vowel, letter or elision type, are indicators of meaning. In other words according to the general acceptance, the iʿrāb signs at the end of words help one to understand the function of a given word in a sentence. Knowing the functions of the words of a sentence in turn enables the sentence to be understood correctly. Although there are those who say (...) that iʿrāb signs at the end of the words do not have anything to do with the function of words in a sentence, and that they only function to facilitate the transition between words, this view was not accepted by the majority. For this reason, thisarticle examines the iʿrāb-meaning within the scope of the prevailing attitude of naḥw scholars and Quranic exegetes. The majority of linguists accept that iʿrāb is an indicator of meaning. For this reason, explanations of iʿrāb, which are frequently used in Quranic commentaries, are aimed at understanding the sentences in the verses more accurately. The fact that Abū al-Aswad al-Duʾalīput vowel marks on certain words of the Quran was to facilitate the correct reading of the Quran and prevent a wrong vowel mark from causing any misunderstanding. Therefore, the close relationship between iʿrāb and meaning is clearly emphasized in naḥw books. Although it is stated as a general rule that iʿrāb is key in desciphering the meaning, there are cases where this general rule does not hold. This happens when there is a discrepancy between an iʿrāb sign at the end of a givenword and its meaning. Such situations are considered by naḥw scholars as qurb al-jiwār. According to this exception, a word does not take the iʿrāb indicator appropriate to its position in sentence and instead takes the same iʿrāb indicator of the previous word so as to be in harmony with it. The purpose of this is to prevent any disruption to the phonetic flow of the sentence rather than to function as an indicator of meaning. In fact, this phonetic harmony is not only limited to the iʿrāb at the end of words. In order to ensure harmony within a word, changes can be made in morphology of the word in question. This stems from the importance Arabs attach to the harmony of both intra-word and inter-word vowels, despite its contradiction to the rules of morphology and syntax. As a matter of fact, this kind of reading provides a sense of cohesion in terms of both ease of pronunciation and correspondence. In this article, I claim that the iʿrāb signs is not always a sign that reveals the meanings in the verses of the Qurʾān. In the light of this view, some of the verses of the Qurʾān comprise case endings that are contrary to the meaning for the sake of phonetic harmony, just as is the case in the current usage in Arabic language. This situation shows that besides the literary arts related tomeaning, those which are related to phonetic arts also constitute important literary aspects of the Qurʾān. The approaches of the Qurʾānic commentators towards the verses in which this feature, which is expressed as qurb al-jiwār in Naḥw, is found differ from each other. On the basis of these different approaches, the relevant narrations, syntax school, etc. that the commentators have generally considered matters are included. In fact, given that they lead to no confusion, irregularities contrary to the established grammar rules are tolerated. For this reason, qurb al-jiwār is used in the absence of ambiguity even though it is contrary to iʿrāb al-naḥwī. Unlike the Basran Grammarians, who regard qurb al-jiwār as a mere use, the Kufan Grammarians made the issue a regular grammar rule and used it as the basis for the jussiveness of apodosis of conditional clauses. Although qurb al-jiwār is accepted as a usage both in the Arabic language and the Quran by the majority of grammarians, there are differences of opinion in terms of the place of its use. While there is no clarity on this subject among the early grammarians, according to the general of late naḥw scholars, the issue of qurb al-jiwār is reserved for noun-adjective, corroborating-corroborated and connective explanation. However, it is controversial whether or not the qurb al-jiwār can be used in connectives. While in the early periods when controversies arose for the first time, qurb al-jiwār was generally unacceptable, in later periods it started to became more widely accepted. Extrapolating a theoretical framework for the issue based on primary classical sources on Naḥw constitutes a core methodology used in this work. According to the theoretical framework thus put forward, the discussions about the verses that are the subject of the iʿrāb of vicinity in the primary tafsīr sources from the first period to the present have been examined from an analysis-semantic perspective. Devotion to the Prophet Muḥammad was a major feature of late medieval and early modern Islamic religious life across much of the Islamic world. The history of this devotion remains understudied in relation to its importance and pervasiveness. This study takes as its locus of analysis a particular instance of early modern devotion: a weekly, public all-night session of ṣalawāt upon the Prophet that would become known as the maḥyā. Developed by the peasant-turned-shaykh Nūr al-Dīn al-Shūnī in late Mamluk Egypt, (...) performance of the maḥyā would spread over the following century throughout the Arab Ottoman world, undergoing changes, provoking controversy, and becoming embedded in the sacred spaces and ritual life of one city after another. I approach the history of the maḥyā as a discrete and legible instance of ritual change in an Islamic context, exploring this instance of communal devotion to the Prophet through such lenses as ritual studies and the spatial turn, examining the intersection of this devotional ritual with practices of subjectivity, the use and contestation of ritual space, and the meaning, regulation, and experience of the night. ACCORDING TO HUME, the "religious hypothesis" is "a particular method of accounting for the visible phenomena of the universe''1 that is "mere conjecture and hypothesis," (Enquiry, 145) and "both uncertain and useless" (Enquiry, 142). But there was one version of this hypothesis that seemed to pose particular difficulties for him in making these claims convincing. This was Shaftesbury 's (...) view of the world as the object of "divine passion." Besides Shaftesbury's massive influence at the time, Hume was wrestling with the peculiar disadvantage of having agreed with him on so many points, particularly in the attempt to solve the problem of personal identity. He attempted to discredit Shaftesbury's "particular method" on several levels: viz., it cannot be rationally justified, deductively or inductively ; it is not really a belief, so afortiori it is not a natural belief; to the extent it is confused with a genuine belief, its effects are very rare and transitory unless it degenerates into superstition or enthusiasm, which are demonstrably pernicious. 2 These attacks were frequently reinforced with arguments ad hominem. Shaftesbury's theism is extremely ambiguous. In the Essay Concerning Virtue or Merit he pronounced, "to believe therefore that everything is governed, ordered, or regulated for the best, by a designing principle or mind, necessarily good or permanent, is to be a perfect theist" (CH I:240). This is merely the least common denominator of what all eighteenth-century natural theologians agreed could be inferred a posteriori from some form of design argument. Shaftesbury used several analogies to support this view, each based upon a comparison of a part of the universe to the whole:(l) an artifact, for example, a watch (CH I: 190), a ship (CH i Enquiry Concerning Human Understanding, ed. L'objectif de cet article est de contester le bien-fondé d'une telle orientation, et de dégager en même temps le statut spécifique de ce genre de récit biographique.

Knowledge was a major issue in science and philosophy in the twentieth century. Its first irruption was in the heated controversy concerning the foundations of mathematics. To justify his rejection of the use of the actual infinite in mathematical reasoning, Brouwer has made the construction of mathematical objects dependent on the knowing subject. This approach was rejected by the mainstream of analytical philosophers who feared a fall into pyschologism. Several years later, the question of the progress of scientific knowledge was (...) put forward in the thirties by the post-positivist philosophers to fill the vacuum in the philosophy of science following the demise of the logical positivism programme. The answers given to these questions have deepened the already existing gap between philosophy and the history and practice of science. While the positivists argued for a spontaneous, steady and continuous growth of scientific knowledge the post-positivists make a strong case for a fundamental discontinuity in the development of science which can only be explained by extrascientific factors. The political, social and cultural environment, the argument goes on, determine both the questions and the terms in which they should be answered. Accordingly, the sociological and historical interpretation involves in fact two kinds of discontinuity which are closely related: the discontinuity of science as such and the discontinuity of the more inclusive political and social context of its development. More precisely it explains the discontinuity of the former by the discontinuity of the latter subordinating in effect the history of science to the wider political and social history. The underlying idea is that each historical and social context generates scientific and philosophical questions of its own. From this point of view the question surrounding the nature of knowledge and its development are entirely new topics typical of the twentieth century social context reflecting both the level and the scale of the development of science. To the surprise of modern historians of science and philosophy, the same kind of questions, which would allegedly be new topics specific to the twentieth century concerning the nature of knowledge and its progress, were already raised more than eleven centuries earlier in the context of the Arabic tradition which, as we discuss further on, developed a trans-cultural and trans-national concept of the unity of science (see the contributions of Deborah Black and Jon McGinnis which tackle the issue of the nature of knowledge). The neglect of the Arabic tradition in philosophy of science is a major a gap not only in the development of science but a fundamental flaw in the writing of its history and philosophy caused by the total reduction of epistemology to political and social history of science. How has this period of the history of science and philosophy come to be ignored? In what circumstances were the questions akin to the nature of knowledge raised in the first place? What is the relation between on the one hand the questions of knowledge and its growth and on the other hand the unity of science in the Arabic tradition? The answers to some of these questions are the aim of the present volume, the first of the series Logic, Epistemology and the Unity of Science to be devoted to a so-called non-western tradition. Let us first highlight in a kind of overview some landmarks concerning the timing of the emergence of the Arabic tradition and its significance for the history of science. (shrink)

Some controversies occurred among exegetes in determining the exact meaning of polysemic words, among which are the word al-jin in the Qur’ān. Disagreements in this regard occurred in some verses where the word al-jin or al-jinnat were placed without collocations, but there had not been any room for discussion when the use of this word was juxtaposed with the word al-ins or al-nās due to the reason that this situation unveiled the specific context of related phrases. But the use of (...) this word without collocations includes different possibilities of contextual approaches, which resulted in ascribing different meanings like the jinn, angels, the Devil, and satans. This situation triggered the discussions about the issue of whether a distinction between the jinns and angels could be made or the angels are sinless and innocent. The majority of exegetes acted more or less following the context when they analyzed this polysemic word. They observed the phrases that precede and follow the word concerned as well as narratives related to the historical and cultural context. Also, it should be noted that the relevant meaning of the etymology is one of the essentials in specifying the exact meaning of the word. In this study, we firstly dealt with the perception of the jinn and angel among the Arabs of Jāhiliyyah. Then we mentioned related narratives and linguistic basis of the word depending on the classical Arabic dictionaries. Through this, we aimed for emphasizing that there was a correlation between the meaning of al-jinn in the semantics of the Qur’ān and the use of Arabs in the time of Jāhiliyyah. The only way to determine the specific meaning of this word is knowing the historical background. Thus, we analyzed in this article the approaches by exegetes about the related verses by making comparisons. (shrink)

Recent developments in the Arab world reopen one of the most fertile debate topics in international relations theory: the universal nature of the concept “fundamental human rights” and their content. The perspectives are different, being influenced by an ideological background, especially theological, apparently contradictory, affecting the positions of major international actors, stimulating the revival of controversies on major differences between Western world and the developing societies. Through a balanced analysis, specific to critical postmodernism, of the way each civilization (according to (...) Samuel Huntington) relates to the human being and to its place within its own legal architecture, one can notice that, beyond any differences, joint elements can be identified for further integration into a common fundamental text conferring the consensual universality indispensable to such an important principle. The luxury-versus-necessity controversy is primarily concerned with the importance of civil and political rights vis-à-vis economic and social rights. The viewpoint of political leaders of many developing and newly industrialized countries, especially China, Singapore, Hong Kong, Malaysia and Indonesia is that civil and political rights are luxuries that only rich nations can afford. The United Nations, transnational civil society and the Western advanced countries oppose this viewpoint on normative and empirical grounds. While this controversy is far from over, new challenges (...) of “evidence” and “marketization” are emerging. The first calls for a narrative on the history of civil and political rights in the West in the comparative context of the Industrial Revolution and the East Asian Miracle and China’s economic growth. The effects of the recent financial crisis and insulation of China from the Arab Spring further deepen this challenge. The marketization challenge looks at this controversy from the social exclusion angle. It argues that the basic needs covered by the minimum human rights agenda are becoming luxuries in a real sense for those who do not have the power to purchase these needs from the market. (shrink)

Killing the Arab Spring tells the stories of the Arab Spring uprising in 15 Middle East states, from the point of view of a secular Middle Eastern political analyst familiar with the politics, the culture of the people and the history of the area. Dr. Hasan views the vast majority of the Arab rulers deriving their absolute authority from inheritance or military coups, or in the case of the Saudis from conquest, not at the pleasure of the governed. Arab leaders (...) do not believe that government is a trust on behalf of the people. They believe that if there is democracy and their societies are composed of equal and competing individuals, there will be a tendency towards anarchy. People involved in the Arab Spring uprisings demanded inclusive and equitable democracy, social justice and economic development. There were no civil society institutions strong enough to challenge the weapons of authoritarianism that included ideology, repression, payoffs and the solidarity of the crony capitalists. The author argues that Saddam Hussein’s 1980 war on Iran was the spark that started a chain of bloody wars and events which eventually led to the US invasion of Iraq and the Arab Spring uprisings. The revolts and the counter revolts took different forms in each country based on its history, the type of government and the economy. The author argues that the Arab Spring is a step of a long process toward democracy rather than an aberration between periods of authoritarian regimes. To understand the Arab Spring causes and its aftermath, the book provides the reader with a review of the Middle East common culture that includes the history of Islamic religion, Islamic-sects and Arab tribalism, and brief history of each country. There are few activities more controversial than writing history of a nation involved in a conflict. Even while witnessing history unfolding in a country, different historians provide different narratives, different causes and different conclusions. This becomes more obvious when the history of the conflicts is viewed through the prism of the politics of sectarianism ethnicity and tribalism. The author strives for an objective view, but he does not hide his strong support to liberal democracy and human rights. (shrink)

The book reconstructs the history of Western ethics. The approach chosen focuses the endless dialectic of moral codes, or different kinds of ethos, moral doctrines that are preached in order to bring about a reform of existing ethos, and ethical theories that have taken shape in the context of controversies about the ethos and moral doctrines as means of justifying or reforming moral doctrines. Such dialectic is what is meant here by the phrase ‘moral traditions’, taken as a name for (...) threads of moral discourse, made in turn of other interwoven threads, including transmission of shared codes, appeals to reform of prevailing custom, rational argument about the justification of some precept on the basis of some shared general teaching or principle, and rational argument about the ultimate basis for principles and justification of authoritative teaching. That is, the approach adopted to the reading of ethical texts depends on a firm belief in the fact that philosophers hardly created any ethical doctrine out of nothing. The main point this book tries to highlight is how different philosophical theories emerged and followed each other as a result of attempts at accounting for what was going on in the world of moral traditions. Changes were propelled by controversies between different schools, and highly abstract arguments were the unintended effects of moves made by controversialists forced to transform (and occasionally to turn upside down) their own doctrines in order to face the challenge posed by other arguments. This is the reason why the book examines not only texts that already enjoy pride of place in the history of philosophy (Aristotle, Kant, Hegel), but also other texts usually treated in the histories of religions (the Bible, the Talmud, the Quran), and others considered to be much less philosophical (Plutarchus, Pufendorf). -/- 1. Plato and a response to ethical scepticism. Two different traditions of morality in VI-V century Greece are described. The birth of philosophical questioning of traditional morality and temporal and spatial variation of custom is described within the context of the v century crisis, the demise of traditional aristocratic and tyrannical rule and the birth of democracy. Two conflicting answers to the challenge are reconstructed, namely conventionalist or immoralist theories formulated by the Sophists and the eudemonist and intellectualist Socratic theory. Plato’s own reformulation of Socrates answer to the Sophists is reconstructed. His psychological views, his classification of the four cardinal virtues and his political theory are described as parts of a unitary system, culminating in an extremely realist moral ontology identifying the idea of the good with the essence of the (moral and extra-moral) world itself. -/- 2. Aristotle and the invention of practical philosophy. Aristotle’s invention of practical philosophy as a field separated from first philosophy is shown to be an implication of his break with Plato moral ultra-realism. Aristotle’s agenda in his moral works is arguably dependent on a polemical intention, namely dismantling Socratic intellectualism. The semi-inductive or virtuously circular method of practical philosophy is illustrated, starting with the received opinions of the better and wiser individuals and trying dialectically to sift what is left of mistake and inconsistence in such opinions, finally trying to correct mistakes and make the overall practical science more consistent. The chapter illustrates then the relationship of individual ethics, or ‘monastics’, with the art and the science of the pater familias, or ‘economics’, and the science of the ruler and citizen, or politics. The nature of virtues, or better, excellences of character, is discussed, highlighting the basic role of hexis, or ‘disposition’. Prudence, or better practical wisdom, is the focus of the chapter. Its relationship with bouleusis or deliberation is examined, and its autonomous status vis-à-vis theoretical knowledge is stressed. -/- 3. Diogenes and philosophy as a way of life. The chapter provides an overview of Hellenistic ethics, which almost amounts to Hellenistic schools of philosophy, in so far as ‘philosophy’ became in these centuries primarily the name for a way of life. The typical character of the Cynical movement is highlighted, that of a school of life, not a school aimed at providing any kind of intellectual training was to be provided. -/- 4. Epicurus and ethics as self-care. The peculiar character of the Epicurean school is described, a combination of a science of well-being aiming, more than at pleasure as in the popular view, at reduction of useless suffering, of unnecessary needs, and at a balanced selection of pleasures of the best and most durable kind. -/- 5. Epictetus and ethics as therapy of the passions. The various phases of Stoicism are described, and the shifting place given to ethics in the Stoic system of idea, culminating in the paradoxical view of ethics, its impossibility in principle notwithstanding, as the only truly significant and necessary part of philosophy. Cicero is treated, showing how his own synthesis of various Hellenistic trends is as a truly philosophical enterprise, deserving serious consideration after one or two centuries when he was confined to the role of literate. Epictetus is chosen as the best example of what the Stoic tradition could yield, an art of living based on sophisticated introspection, in turn aimed at making a kind of cognitive therapy possible, dismantling obnoxious passions at their root by systematically correcting false representations. -/- 6. Philo and the reconciliation of Torah and Platonism. A reconstruction of basic ideas from a few books of the Hebrew Bible is provided, starting with the Prophetic tradition and the focus on God’s mercy as the source of motivation and standard for human behaviour. Then a comparative analysis is undertaken of a parallel tradition, namely the three codifications of the Torā (Law or, better, Instruction), highlighting how a core of moral ideas may be recognized as a basis and preamble of codification of civil law, cultural practice, and regulation of ritual purity. The importance of Leviticus is stressed as the turning point when emphasis mercy, typical of the Prophetic tradition, is combined with the legal tradition, yielding the change in sensibility of the Second Temple time. Philo of Alexandria is described as one of the three leading figures – together with Rabbi Hillel and Rabbi Yeshua – at the apex the emergence of the mentioned new sensibility, gradually including mercy as an essential part of justice and establishing the starting point of both the Rabbinic and the Christian tradition. This consists precisely in the precept of one’s neighbour’s love or of the golden rule, two eventually identical precepts whose meaning is arguably more sober and sensible than the long-lasting Christian tradition deriving from John and Augustine has made us believe and no novelty vis-à-vis so-called Ancient-Testament teachings. -/- 7. Augustine and Christianity as Neo-Platonism. The first section examines the moral doctrines of so-called 'ethical Treaties' from the Talmud, a group of treaties, among which the best known is Pirqé Avot, that were left out of the six "orders" of the canon as they did not fit in any of the six groups of issues ritual or legal on which the division was based. According to Maimonides, their peculiar theme is provided by the Deòt, 'opinions', i.e., mental dispositions, that is, the translation of the Greek term hexeis and Arab akhlak (in turn providing in this language the name for ethics as such). The three topics I reconstruct are: i) the notion of Torah: The Torah is understood as the world order itself, or as the ‘Wisdom’ that existed even before creation and was ‘the tool by which the world was built’; however, the Torah is an earthly and human entity, as it was "received" by humans, and from that very moment belongs to them; ii) the relationship between love of God and love of neighbour; the treaties require us to study and practice the Torah ‘for its own sake’, that is, require us to act out of love, not out of fear or hope of reward; iii) the idea of sanctification of daily life: having disappeared with the destruction of the Temple the possibility of any conflict between liturgical service and everyday life, the latter is assumed to be in itself divine service: to give food to the poor has the same value as sacrifices in the Temple, and as an implication, the insistence become recurrent on the goodness of created things in themselves along with a polemic against ascetic currents. The conclusions drawn are: i) the moral teachings of the Talmud and those of Yeshua are, rather than similar, virtually identical; one may safely say that the precept of love and the golden rule are central ones for all Talmudic rabbis, that mercy plays an indispensable role alongside with justice, and the latter is not a different thing from one’s neighbour’s love; ii) a peculiarity of Talmud rabbis facing Yeshua is the idea of study as worship, and knowledge as a source of justice; but this is an idea of Judaism after the Temple's destruction that cannot be attributed to the Pharisees of Yeshua’s time; iii) the relation of study and practice in the Talmud parallels that between faith and deeds in Paul's epistles, that is, respectively faith or learning are a necessary and sufficient condition to be recognized as righteous , but deeds are the inevitable effect of either faith or learning. The sayings ascribed to Yeshua are examined first, yielding the conclusion that a close equivalent may be found for every saying in Talmudic literature and yet the whole is ascribed to one rabbi, with rather consistent stress on God’s mercy and unconditional forgiving as the mark of true imitation of God. Thus, Yeshua’s teaching is pure Judaism. The third section describes briefly the galaxy of Gnostic currents and Manichaeism, trying to sketch the profile of moral teachings resulting from an encounter of Asian spiritual traditions, Hellenistic lore and sparks of teachings from apocalyptic Jewish currents. The last section summarizes the turbulent history of several encounters between Christian currents and Hellenistic philosophical schools. The first one was with late Cynicism. Recent, rather controversial, literature discovered the jargon and a few topics from the Stoic-Cynical popular philosophy in a few books from the New Testament itself. This, far from proving that Rabbi Yeshua had been influenced by cynic preachers, is a proof of the necessity felt by Christian preachers to translate the original ‘Christian’ teaching into a Greek lexicon deeply impregnated with cynic terminology. The second was with Platonism, yielding the mild and temperate moral teaching of Clemens of Alexandria, teaching the sanctity of nature and the human body, the joy of moderate fruition of ‘natural’ kinds of pleasures, and the beauty of the marital life – in short, the opposite of the standard picture of Medieval Christianity. Ambrose of Milan brings about a different kind of synthesis, namely with Middle Platonism, where Stoic themes prevail. The most shocking case is Augustine, where an early Manichean education is overcome in a former phase by a synthesis of Plotinian Neo-Platonism and Christian preaching, yielding a sustained polemic with the Manicheans and rather optimistic views on life and Creation, the body and sexuality, and Hebrew-Judaic tradition not far from Clemens of Alexandria. In a later phase, occasioned by controversy on the opposite front, with such Christian currents as the Pelagians and Donatists, Augustine comes back to heavily anti-Judaic and world-denying ascetic attitudes where is earlier Manichean upbringing seems to emerge again. The tragedy of medieval Christianity will be the later Augustine’s overwhelming influence. A final section is dedicated to the monastic tradition where a curious mixture of world-denying asceticism with an astonishingly penetrating ‘science’ of introspection emerges. -/- 8. Al Farabi and the reconciliation of Islam and Platonism. The Qurān and the qadit, that is, collections of sayings ascribed to the prophet Muhammad contain a wealth of precepts and catalogues of virtues mirroring moral contents from the Jewish and the Christian traditions, among them the basic notion of imitation of the Deity, where mercy is assumed to be its basic trait. An important tradition within Islam, namely Sufism, stressed to the utmost degree the role of mercy, turning Islam into a mystic doctrine centred on retreat from the world, abandonment to God’s will, and a peaceful and fraternal attitude to our fellow-beings. A secular literary tradition originating in the Sassanid Empire, the literature of advice to the Prince had for a time a widespread influence in the newly constituted Arabic-Islamic commonwealth. In a later phase, the legacy of Hellenic philosophy made its way into the intellectual elite of the Islamic world. The first important legacy was Platonic, and the Republic became the main text for Islamic Platonism. Al-Farabi wrote an enjoyable remake of the Platonic Republic, arguing that the citizen’s virtues were the basis on which the political building needs to rest. The secular lawgiver is enlightened by the light of reason in his everyday practice of governance, but room is made for the Prophet as the voice of revealed truth that confirms and completes the rational truth that philosophy may afford. In a second phase also Aristotelian and Stoic influence were assimilated. Miskawayh’s treatise was the masterwork at the time Arabic philosophy reached its Zenith. It is a treatment of the soul’s diseases and their remedies, combining the Aristotelian doctrine of the golden mean with the Stoic doctrine of the passions and elements of Galenic medicine. Towards the eleventh-twelve centuries a war raged among theologians and philosophers, finally won by the former with disappearance of philosophy as such. The newly established mainstream, yet, was no kind of intolerant fanaticism. It drew from the work of mystic theologian Al-Ghazālī, the best heir of Sufism, teaching a tolerant and peaceful attitude to our fellow-beings and a passive attitude to destiny as an expression of the Divine will. -/- 9. Moshe ben Maimon and the reconciliation of Torah and Aristotelian ethics. The encounter between the Talmudic tradition and Hellenic philosophy had taken place a first time in Alexandria at the time of Philo but the two traditions had parted way again. In fact, the kind of Platonic Judaism founded by Philo survived only within Christianity, in the fourth Gospel and then in writings by Clemens of Alexandria. The Talmudic literature had absorbed just less striking traits from the Hellenic Philosophy, namely an idea of ethics as care of the self and a role for the education of character as propaedeutic to theoretical knowledge. In the Arabic-Islamic world, a second round started when Jewish authors writing in Arabic undertook the task to prove the full compatibility of the tradition deriving from Torah and Platonic philosophy. The culmination of this attempt is provided by Moshe ben Maimon who tried to use Aristotelian ethics as a language into which the teaching from the Pirké Avot could be translated. -/- 10. Thomas Aquinas and the reconciliation of Christian morality and Aristotelian ethics. In the first section the fresh start is described of philosophical ethics in Latin Europe at the turn of the Millennium. In a first phase, Anselm and Peter Abelard built on a Platonic and Augustinian legacy. In this phase. remarkable innovations are introduced, including Abelard’s claim of the obliging character of erring consciousness. In a second phase, the rediscovery of Nicomachean Ethics thanks to Latin translation of Arabic versions gives birth to a new wave of ethical studies, recovering the very idea of Aristotelian practical philosophy, with the potential implication of full legitimization of natural morality, i.e. ethics without Revelation. Aquinas’s ethics is a theological ethics out of which it would be vain to try to extract a self-contained philosophical ethics. His treatment of topics in philosophical ethics, yet, does not boil down to repetition of Aristotelian arguments but is rather a creative reshaping of such arguments. For example, he introduces also in the practical philosophy a first principle parallel to the principle of non-contradiction; and he also carries out a synthesis of Aristotelianism, Stoicism, and neo-Platonism. Even though it is essentially moral theology, Aquinas’s doctrine - unlike Augustine – grants full citizenship to "natural" morality, firstly by rejecting the claim that the corruption of human nature due to the original sin is so radical as to leave "pure nature" incapable of moral goodness. The doctrine is presented in a more sophisticated formulation in a few of the Quaestiones, such as De Malo and De Veritate, in the Summa contra Gentes and in the commentaries to Aristotle than in the famous Summa Theologica, but the latter work includes the only or the largest exposition of some decisive part of the theory. Thus, the Summa Theologica should be read for what it is more than criticized for not being what it was not meant to be. It was not meant to be the brilliant synthesis of all that Reason he had been able to produce with what Revelation had added about which the Neo-Thomists used to dream, but rather a manual for the training of preachers and confessors, where theoretical claims are not too demanding and a few serious tensions are left. Besides a jump between the Prima Secundae and the Secunda Secundae, being the former an essay in virtue theory and the latter a handbook for confessors, the most serious tension is perhaps the one between the ethics of right reason presented in most of Ia-IIae and the eudemonistic ethics developed in quaestiones 1-5 of the same part; the alternative ethical theory which also may be found in Augustine, the Stoic view of a cosmic reason eventually coincident with the moral law, was believed by Anselm (followed by John Duns Scotus and William of Ockham) to be incompatible with eudemonism. It is questionable whether Thomas could reduce the tension proving that it is just an apparent tension, in so far as the right reason and bliss derived from knowledge of God tend to coincide, but this is just a conjecture. Thomas’s ethics is a virtue ethic, not a law-based one, and moral judgment focuses on the virtues, particularly charity, not on the commandments and even less on absolute prohibitions; Thomas, however, would not have considered a drastic alternative between law and the virtues such as the one which has been advanced in late twentieth-century philosophy to be justified. Nonetheless, when it discusses ‘special’ virtues, it ceases to be an ethics of virtue and becomes a disappointing and often contradictory discussion of legal and illegal acts. Such a discussion takes most of the time ‘reasonable’ middle positions on controversial issues but not the alternative approach that Aristotelianism would have made possible; even when some occasional Aristotelian claim shows up, such as money’s barrenness as a reason against usury, this seems to be made by an author who apparently ignores the Aristotelian Thomas of the Prima Secundae. It is an ethic of human autonomy which recognizes the binding character of the individual conscience and, potentially, even a duty to disobey unjust laws. It is true that what Thomas writes in his discussion of death penalty and persecution of heretics is simply disgusting, and yet we should blame Thomas the man, not Thomist ethical theory. Finally, Thomas’s ethics is not ethical ‘absolutism’, as both traditionalist Catholic theologians and secularist enemies of dogmatic morality tend to believe. It is instead an ethic of prudential judgment. Exceptions to this approach – or better results of logical fallacies – are such claims as the absolute character of negative precepts and of the existence of "intrinsically evil acts", claims that simply cease to make sense in the light of Thomas’s own distinction between human act and natural act, carrying consequences Thomas did not live long enough to draw or was not consistent enough to dare to draw. -/- 11. Francisco de Vitoria and casuistry. The first topic illustrated is the discussion about the notion of pura natura, namely the human condition after the original sin and before divine revelation. The core notion was already there in Aquinas but was later developed by Caietanus (Thomas de Vio) with a number of interesting implications: firstly a view of human nature as such much more positive than Augustine’s and his followers’ view, including both Calvinists and Jansenists; secondly, the implication that the philosopher’s morality, as opposed to the Christian’s morality, is a quite respectable kind of morality; thirdly, that theocracy and prosecution of the unfaithful lacked justification, with more far-fetching consequences than Aquinas himself had dared to draw. The second topic is casuistry, a new name for a comparatively older way of thinking, which was already there in late Stoicism and Cicero as well as in the Talmudic literature. This is an approach aimed at yielding probable enough solutions for doubtful cases even in absence of completely safe staring points. The genre developed from medieval reference books for confessors and became by the sixteenth-century a sophisticated tool-box for dealing with various fields of applied ethics. Francisco Vitoria, the main authority of Baroque Scholasticism, was a controversial figure, among the proponents of the new discipline of casuistry and a consistent proponent of more separation between the religious and the civil authority, stricter limits to the legitimacy of war, innate rights of non-Christian nations in the New World based on the notion of pura natura, providing a standard of ‘natural’ goodness, previous to revelation, on which the Indian nations were judged to live in a naturally good condition, provided with the institutions of family, justice, and religion had accordingly a right to full respect by Christian sovereigns. Bartolomé de Las Casas, arguing along similar lines, was the leader of a historical battle in defence of the rights of the Indios. -/- 12. Michel de Montaigne and the art of living. A short description of one of the Renaissance Phyrronism, one of the classical philosophies revived in the fifteenth and sixteenth century. Montaigne combines the sceptical epistemology with an understanding of ethics – indeed of philosophy as a whole – in terms of an art of living inspired by two basic ideas, sagesse, that is, practical wisdom as the only kind of rationality available after theology, science, and tradition have declared bankrupt, and an aesthetic ideal of self-transformation through the art of writing and introspection. -/- 13. Pierre Nicole and neo-Augustinianism. The chapter illustrates first the vicissitudes of Augustinianism newly born after the late medieval triumph of Thomist Aristotelianism in the alternative Protestant and Catholic versions processed by the Calvinists and the Jansenists. Then it illustrates the doctrines of Pierre Nicole, Blaise Pascal’s best disciple, on the impossibility of introspection, on the ubiquity of self-deception, on the incurably evil character of the passion of love, and on the two moralities, the one of the man of the world, the morality of honesty which is indispensable for granting peace and order but devoid of any true value for eternal salvation, since the same external behaviour may be prompted by opposite motivations, and the morality of charity, the only true one but also useless to society. The third topic is Pierre Malebranche’s view of self-deception as a ubiquitous phenomenon accounting for human action and responsibility and his reformulated theory of self-love, no less ubiquitous than for Nicole and yet not as incurably evil, given the distinction between morally indifferent and even necessary amour de soi and vicious amour proper, a distinction on which the whole of Rousseau’s moral and political theory rests. -/- 14. Samuel von Pufendorf and the new science of morality. The chapter is dedicated to the discovery of the idea of a ‘new moral science’. Hugo Grotius is discussed first highlighting the real character of his project, much closer to the Thomist idea of a natural law accessible to non-corrupted human reason when human beings are living in a state of pura natura. Then Hobbes’s combination of scepticism, voluntarism, and conventionalism is described and both the continuity with Grotius’s new science, in the search for non-revealed rational morality, and the break with him, in the adoption of voluntarism and refusal of an intellectualist view of natural law, are illustrated. Pufendorf’s work is illustrated as a synthesis of the two previous attempts and the – up to Schneewind underestimated – paradigmatic example of the new science of morality. -/- 15. Richard Cumberland and consequentialist voluntarism. The chapter gives an overview of eighteenth-century Anglican ethics, noticing how the Cambridge tradition gave special weight to natural theology as opposed to positive or revealed theology – and how two Cambridge fellows, John Gay and Thomas Brown, elaborated on Cumberland’s (and Malebranche’s, as well as Leibniz’s) strategy for finding a third way between intellectualist view and voluntarist view of the laws of nature. The result of their elaboration was a kind of a rational-choice account of the origins of natural laws, where a law-giver God chooses among a number possible sets of laws on a maximizing criterion, and God’s maximandum is happiness for his creatures. The chapter notices also how such a solution aimed at solving at once the problem of evil and that of the foundation of moral obligation by proving how God’s choice was justified as far as it was the one minimising the amount of suffering in the world. 16. Richard Price and intuitionism. The chapter describes first the doctrines of the Cambridge Platonists, an example of hyper-rationalist reaction to Calvinism. Secondly it describes the sophisticated and universally ignored – from Sidgwick to Anscombe –version of what was later labelled ‘ethical intuitionism’ – showing how it escapes familiar objections and misrepresentations of intuitionism – from Mill to Rawls – in grounding its argument on transcendental arguments while carefully avoiding recourse to introspection and psychological evidence, which has been taken as a too easy target by critics of intuitionism. Thirdly, the chapter discusses Whewell’s ‘philosophy of morality’, as opposed to ‘systematic morality’, not unlike Kant’s distinction between a pure and an empirical moral philosophy. Whewell worked out a systematization of traditional normative ethics as a first step before its rational justification; he believed that the point in the philosophy of morality is justifying a few rational truths about the structure of morality such as to rule hedonism, eudemonism, and consequentialism; yet a system of positive morality cannot be derived solely from such rational truths but requires consideration of the ongoing dialectics between idea and fact in historically given moralities. Whewell’s intuitionism turns out closer to Kantian ethics than commentators have made us believe until now, and quite different from what Sidgwick meant by intuitionism. -/- 17. Adam Smith and the morality of role-switch. The chapter describes first, Hutcheson’s attempt at basing the ‘new science’ of natural law on different bedrock than Pufendorf and the English Platonists, namely a moral sense, a faculty whose existence is assumed to be proved on an empirical basis. The second step is a reconstruction of Hume’s rejoinder in terms of a new science of man including morality on an ‘experimental’ basis, that is, a ‘Newtonian’ hypothetical-deductive approach, distinguished from Hutcheson’s allegedly uncritical descriptive approach to human nature. The third step is a reconstruction of Adam Smith theory of morality understood as emerging from a spontaneous interplay of exchanges of situations (the most basic meaning of the word ‘sympathy’ as construed by this author). -/- 18. Jeremy Bentham and utilitarianism. The bulk of the chapter is dedicated to the doctrines of Jeremy Bentham. The Enlightenment spirit that suggested the idea of a new morality, free from religion, is illustrated. The notion of utility is illustrated as well as the subsequent formulations of the principle of utility. The idea of felicific calculus is discussed, showing how its inner difficulties prompted several reformulations of the principle of utility in order to avoid undesirable implications of proposed formulations. The role of the thesis of spontaneous convergence between interest and duty is discussed, showing how it left numberless questions open, and the distinction between the virtues of prudence, justice and beneficence is described as a way out of the deadlocks of classical utilitarianism. After Bentham, Mill’s reformed utilitarianism is reconstructed, showing how it is a kind of mixed system – as closer to common sense as it gives up Bentham’s claims to consistency and simplicity – resulting as unintended consequences from the controversies in which Mill was too keen to engage. The hidden agenda of the controversy between Utilitarianism and Intuitionism, going beyond the image of the battle between Prejudice and Reason, is described, showing how both competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. -/- 19. Immanuel Kant, practical reason and judgment. The chapter argues that Kant took from Moses Mendelssohn the idea of a distinction between geometry of morals and a practical ethic. He was drastically misunderstood by his followers precisely on this point. He had learned from the sceptics and the Jansenists the lesson that men are prompted to act by deceptive ends, and he was aware that human actions are also empirical phenomena, where laws like the laws of Nature may be detected. His practical ethics made room for judgment as a holistic procedure for assessing the saliency of relevant moral qualities in one given situation; this procedure yields the same results as the geometry of morals does for abstract cases but does so immediately and without balancing conflicting duties with each other, since what makes for the salient quality of a situation is perceived from the very beginning. Kant's practical philosophy is richer than the received image, making room for an ‘empirical moral philosophy’ or moral anthropology including treatment of commerce, needs, value and price, happiness and well-being; the overall social theory and philosophy of history is less different from Adam Smith's than the received image makes believe; the paradox of happiness is central to Kant's philosophy; a distinction between happiness and well-being is clearly drawn; the distinction plays a basic role in establishing a link between the economic and the moral life. -/- 20. Georg Wilhelm Friedrich Hegel and the critique of abstract universalism. The chapter describes first the Romantic movement and the implications some of its concerns, rescuing passions, community, tradition, the individual as the bearer of a unique destiny, and the longing for organic unity between the individual, mankind and nature. Hegel’s contribution is discussed then, highlighting how, on the one hand, he shared a number of these concerns and on the other he had more rationalist leanings. The notion of morality is the pivotal point of the reconstruction, highlighting how Hegel construes this notion as a key to his own diagnosis of the malaise of modernity – the separation of individual and Gemeinschaft – and how his attack on Kant turns around this very idea. -/- 21. Friedrich Nietzsche against Christianity and the Enlightenment. The chapter illustrates first the idea of deconstruction of the back-world of values. Nietzsche claims to be legitimate heir of the French moralists, Leibniz, Kant and Hegel, in so far as he allegedly carries out to its deepest implications their discovery of what lies behind traditional naïve belief in the existence of an objective realm of values just waiting for description by the philosopher. The two exemplars form which genealogy draws inspiration are the classical philologist’s historical reconstructions of lost meanings and the chemist’s decomposition of elements. Then the genealogy of the notions of good and evil carried out in the first dissertation of Genealogy of morals is illustrated with its paradoxical conclusion that will to power is in fact the only ‘genuine’ kind of goodness. The third point illustrated is the dialectic of ascetism and self-realization with its ambiguous outcome. The suggested interpretation of such outcome is that Nietzsche’s normative ethics is a kind of virtue ethics taking an aesthetic ideal as a normative standard -/- 22. George Edward Moore and ideal utilitarianism. The chapter discusses the ideas of common sense and common-sense morality in Sidgwick. I argue that, far from aiming at overcoming common-sense morality, Sidgwick aimed purposely at grounding a consist code of morality by methods allegedly taken from the natural sciences to reach, also in ethics, the same kind of “mature” knowledge as in the natural sciences. His whole polemics with intuitionism was vitiated by the a priori assumption that the widespread ethos of the educated part of humankind, not the theories of the intuitionist philosophers, was what was worth considering as the expression of intuitionist ethics. In spite of a naïve positivist starting-point, Sidgwick was encouraged by his own approach in exploring the fruitfulness of coherentist methods for normative ethics. Thus, Sidgwick left an ambivalent legacy to twentieth-century ethics: the dogmatic idea of a “new” morality of a consequentialist kind, and the fruitful idea that we can argue rationally in normative ethics albeit without shared foundations. Then it reconstructs the background of ideas, concerns and intentions out of which Moore’s early essays, the preliminary version, and then the final version of Principia Ethica originated. I stress the role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of rather diverging contributions than a unitary work, not to say the paradigm of a new school in Ethics. I add a comparison with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different way, one that manages to pave decisive objections in a more plausible way. I end by suggesting that the emergence of Analytic Ethics was a more ambiguous phenomenon than the received view would make us believe, and that the wheat (or some other gluten-free grain) of this tradition, that is, what logic can do for philosophy, should be separated from the chaff, that is, the confused and mutually incompatible legacies of Utilitarianism and Idealism. -/- 23. Edmund Husserl and the a-priori of action. The chapter illustrates first the idea of phenomenology and the Husserl’s project of a phenomenological ethic as illustrated in his 1908-1914 lectures. The key idea is dismissing psychology and trying to ground a new science of the a priori of action, within which a more restricted field of inquiry will be the science of right actions. Then the chapter illustrates the criticism of modern moral philosophy carried out in the 1920 lectures, where the main target is naturalism, understood in the Kantian meaning of primacy of common sense. The third point illustrate is Adolph Reinach’s theory of social acts as a key the grounding of norms, a view that basically sketches the very ideas ‘discovered’ later by Clarence I. Lewis, John Searle, Karl-Otto Apel and Jürgen Habermas. A final section is dedicated to Nicolai Hartman, who always refused to define himself a phenomenologist and yet developed a more articulated and detailed theory of ‘values’ – with surprising affinities with George E. Moore - than philosophers such as Max Scheler who claimed to Husserl’s legitimate heirs. -/- 24. Bertrand Russell and non-cognitivism. The chapter reconstructs first the discussion after Moore. The naturalistic-fallacy argument was widely accepted but twisted to prove instead that the intuitive character of the definition of ‘good’, its non-cognitive meaning, in a first phase identified with ‘emotive’ meaning. Alfred Julius Ayer is indicated as a typical proponent of such non-cognitivist meta-ethics. More detailed discussion is dedicated to Bertrand Russell’s ethics, a more nuanced and sophisticated doctrine, arguing that non-cognitivism does not condemn morality to arbitrariness and that the project of a rational normative ethics is still possible, heading finally to the justification of a kind of non-hedonist utilitarianism. Stevenson’s theory, another moderate version of emotivism is discussed at some length, showing how the author comes close to the discovery of the role of a pragmatic dimension of language as a basis for ethical argument. Last of all, the discussion from the Forties about Hume’s law is described, mentioning Karl Popper’s argument and Richard Hare’s early non-cognitivist but non-emotivist doctrine named prescriptivism. -/- 25. Elizabeth Anscombe and the revival of virtue ethics. The chapter discusses the three theses defended by Anscombe in 'Modern Moral Philosophy'. I argue that: a) her answer to the question "why should I be moral?" requires a solution of the problem of theodicy, and ignores any attempts to save the moral point of view without recourse to divine retribution; b) her notion of divine law is an odd one more neo-Augustinian than Biblical or Scholastic; c) her image of Kantian ethics and intuitionism is the impoverished image manufactured by consequentialist opponents for polemical purposes and that she seems strangely accept it; d) the difficulty of identifying the "relevant descriptions" of acts is not an argument in favour of an ethics of virtue and against consequentialism or Kantian ethics, and indeed the role of judgment in the latter is a response to the difficulties raised by the case of judgment concerning future action. A short look at further developments in the neo-naturalist current is given trough a reconstruction of Philippa Foot’s and Peter Geach’s critiques to the naturalist-fallacy argument and Alasdair MacIntyre’s grand reconstruction of the origins and allegedly unavoidable failure of the Enlightenment project of an autonomous ethic. -/- 26. Richard Hare and neo-Utilitarianism. The chapter addresses the issue of the complex process of self-transformation Utilitarianism underwent after Sidgwick’s and Moore’s fatal criticism and the unexpected Phoenix-like process of rebirth of a doctrine definitely refuted. A glimpse at this uproarious process is given through two examples. The first is Roy Harrod Wittgensteinian transformation of Utilitarianism in pure normative ethics depurated from hedonism as well as from whatsoever theory of the good. This results in preference utilitarianism combined with a ‘Kantian’ version of rule utilitarianism. The second is Richard Hare’s two-level preference utilitarianism where act utilitarianism plays the function of eventual rational justification of moral judgments and rule-utilitarianism that of action-guiding practical device. -/- 27. Hans-Georg Gadamer and rehabilitation of practical philosophy. The post-war rediscovery of ethics by many German thinkers and its culmination in the Sixties in the movement named ‘Rehabilitation of practical philosophy’ is described. Among the actors of such rehabilitation there were a few of Heidegger’s most brilliant disciples, and Hans-Georg Gadamer is chosen as a paradigmatic example. His reading of Aristotle’s lesson I reconstructed, starting with Heidegger’s lesson but then subtly subverting its outcome thanks to the recovery of the central role of the notion of phronesis. -/- 28. Karl-Otto Apel and the revival of Kantian ethics. Parallel to the neo-Aristotelian trend, there was in the Rehabilitation of practical philosophy a Kantian current. This started, instead than the rehabilitation of prudence, with the discovery of the pragmatic dimension of language carried out by Charles Peirce and the Oxford linguistic philosophy. On this basis, Karl-Otto Apel singled out as the decisive proponent of the linguistic and Kantian turn in German-speaking ethics, worked out the performative-contradiction argument while claiming that this was able to provide a new rational and universal basis for normative ethics. An examination of his argument is some detail is offered, followed by a more cursory reconstruction of Jürgen Habermas’s elaboration on Apel’s theory. -/- 29. John Rawls and public ethics as applied ethics. Rawls’s distinction between a “political” and a “metaphysical” approach to one central part of ethical theory, namely the theory of justice, is interpreted as a formulation of the same basic idea at the root of both the principles approach and neo-casuistry, both discussed in the following chapter, namely that it is possible to reach an agreement concerning positive moral judgments even though the discussion is still open – and in Rawls’ view never will be close – on the basic criteria for judgment. -/- 30. Beauchamp and Childress and bioethics as applied ethics. The chapter presents the revolution of applied ethics while stressing its methodological novelty, exemplified primarily by Beauchamp and Childress principles approach and then by Jonsen and Toulmin’s new casuistry. -/- . The concept of ‘‘certitude” is central in Arabic discussions of the theory of demonstration advanced by Aristotle in the Posterior Analytics. In the Arabic tradition it is ‘‘certitude,” rather than ‘‘knowledge”, that is usually identified as the end sought by demonstrations. Al-Fārābī himself devotes a short treatise, known as the Conditions of Certitude, to determining the criteria according to which a subject can claim to have absolute certitude of any proposition. In this article the author traces the roots (...) of the concept of certitude to the Arabic translation of the Posterior Analytics. She then offers a close reading of the text of al-Fārābī's Conditions and its parallels in his Epitome of the Posterior Analytics. She argues that the identification of certitude as a cognitive state distinct from knowledge enabled al-Fārābī to introduce a number of interesting and sometimes problematic innovations into Arabic epistemology. Foremost amongst his positive innovations is the recognition that contingent as well as necessary propositions allow for an attenuated form of certitude, and the introduction of reliabilism into the justification of claims to certitude. But al-Fārābī is also one of the first philosophers to articulate explicitly the idea that certitude must include an element of ‘‘knowing that one knows,” a controversial principle that tends to undermine both al-Fārābī’s reliabilism and his efforts to loosen some of the strictures in traditional Aristotelian epistemology. This paper discusses some aspects of the controversies regarding the operation of the agent intellect on sensory images. I selectively consider views developed between the 13th century and the beginning of the 17th century, focusing on positions which question the need for a (distinct) agent intellect or argue for its essential "inactivity" with respect to phantasms. My aim is to reveal limitations of the Peripatetical framework for analyzing and explaining the mechanisms involved in conceptual abstraction. The first section surveys developments (...) of Aristotelian noetics and abstraction in Ancient and Arabic philosophy. Nel 1949 lo studioso di lingue semitiche Enrico Cerulli pubblicò un volume, intitolato Il “Libro della scala” e la questione delle fonti arabo-spagnole della Divina Commedia, che segnò gli studi danteschi, per lo meno per quanto riguarda il dibattito sulle fonti arabo-islamiche del medioevo europeo. Le ricerche di Cerulli su Dante si presentavano come una analisi di fatti di trasmissione culturale. Ma l’autore si era già affermato, nella prima parte della sua carriera, in un più controverso ambito di competenze: alto (...) funzionario dell’amministrazione coloniale italiana e vice-governatore dell’Africa Orientale Italiana, è stato rilevante studioso di lingue del Corno d’Africa, cioè le lingue delle colonie italiane. Questo saggio vuole connettere gli studi danteschi di Cerulli alle responsabilità coloniali e post-coloniali dell’autore, attraverso la ricostruzione della sua biografia intellettuale. Difatti, da queste ricerche Cerulli ricavò il concetto di unità della civiltà mediterranea, formula di evidente valore politico in rapporto all’Italia del secondo dopoguerra. Il saggio prova a offrire anche uno stato dell’arte del dibattito attuale sulle fonti arabe di Dante. In 1949, Enrico Cerulli, an Italian scholar of Ethiopic-Semitic languages, published a volume entitled The “Book of the Ladder” and the Problem of Divine Comedy’s Arabic-Spanish Sources, which was to become a landmark in the discussion on the knowledge held by medieval Europe of Arabic-Islamic culture. His investigation was an analysis of cases of cultural transmission. However, Cerulli had established himself during the first half of his career in a more controversial domain: he was a senior official of Italian colonial administration and he was already well known as an expert of Italian colonies’ languages and traditions. This essay, through a survey of Cerulli’s intellectual biography, aims to bridge his research on Dante and his involvement in colonial and post-colonial governmental decisions. In fact, Cerulli summarised the outcomes of his studies in the concept of unity of Mediterranean Civilisation: such a formula has undeniable political meaning in Italian secondo dopoguerra. The essay also offers a short state-of-the-art regarding current discussions on Arabic sources of Dante’s Middle Ages. (shrink)

In the fifth century A.D., Proclus served as head of the Academy in Athens that had been founded 900 years earlier by Plato. Proclus was the last great systematizer of Greek philosophy, and his work exerted a powerful influence in late antiquity, in the Arab world, and in the Renaissance. His treatise_ On the Eternity of the World _formed the basis for virtually all later arguments for the eternity of the world and for the existence of God; consequently, it lies (...) at the heart of neoplatonic philosophy and the controversy between pagans and Christians at the end of antiquity. Proclus’s eighteen Arguments were quoted within John Philoponus’ polemic against him, written in the sixth century; but the opening pages of the sole extant manuscript, which contained the first Argument, have been lost. In this book, Helen Lang and A.D. Macro present the seventeen Arguments preserved by Philoponus and translate them as an independent work. The first Argument, which survives in Arabic, is also included and makes this the only complete edition of _On the Eternity of the World_ since antiquity. This bilingual edition comprises the seventeen Arguments in Greek and English, along with an introduction, synopses, and detailed notes which help readers with or without Greek to understand them philosophically and historically. Two appendices complete the volume: the Arabic text of the first Argument, also with English translation and notes, and the first modern edition of an important Latin translation from the Renaissance. In a valuable introduction, Lang and Macro examine the complex history of these Arguments. Together with its excellent annotations, and English and Greek texts en face, the publication of Proclus’s _On the Eternity of the World_makes available an influential work by a major figure in the history of late Greek philosophy. The Liber de causis, a monotheistic reworking of Proclus' Elements of Theology, was translated from Arabic into Latin in the twelfth century, with an attribution to Aristotle. Considering this Neoplatonic text a product of Aristotle's school and even the completion of Aristotle's Metaphysics, Albert the Great concluded his series of Aristotelian paraphrases by commenting on it. To do so was to invite controversy, since accidents of translation had made many readers think that the Liber de causis taught that God (...) made only the first creature, which in turn created the diverse multitude of lesser things. Thus, Albert's contemporaries in the Christian West took the text to uphold the supposedly Aristotelian doctrine that from the One only one thing can emanate--a doctrine they rejected, believing as they did that God freely determined the number and kinds of creatures. Albert, however, defended the philosophers against the theologians of his day, denying that the thesis "from the One only one proceeds" removed God's causality from the diversity and multiplicity of our world. This Albert did by appealing to a greater theologian, Pseudo-Dionysius the Areopagite, and equating the being that is the subject of metaphysics with the procession of Being from God's intellect, a procession Dionysius described in On the Divine Names. Creation as Emanation examines Albert's reading of the Liber de causis with an eye toward two questions: First, how does Albert view the relation between faith and reason, so that he can identify creation from nothing with emanation from God? And second, how does he understand Platonism and Aristotelianism, so that he can avoid the misreadings of his fellow theologians by finding in a late-fifth-century Neoplatonist the key to Aristotle's meaning? Thomas Wylton's Quaestio de anima intellectiva presents a controversial defence of Averroes' interpretation of Aristotelian psychology. The detailed introduction guides the reader through the transmission of the text, as well as the philosophical contents of one of the most significant medieval treatments of the nature of the soul.

This article examines the discourses of the Indian state and of community élites during battles for the custody of a young Muslim girl, Ameena, who was ‘rescued’ from a marriage with an elderly Arab. The battles for Ameena's custody were fought as much in news reports, opinion columns, and letters to the editor of metropolitan and vernacular newspapers, as in courts. Questions were raised about Ameena's age, the viability of her marriage, the applicability of secular laws to Muslim communities, and (...) the political economy of the sexuality of girl-children. In these representations, Ameena became a symbol of minority identity, and was transformed into an unwilling and unwitting object of protection. Why did Ameena's story attract so much attention? What were the different positions underlying the arguments made for Ameena's ‘protection’? Without dismissing the protection of children and the advocacy of their rights, this article analyses the agendas shaping the discourses of the Indian state and national and community élites during the battles for Ameena's custody. The article situates the controversies surrounding Ameena in the wider context of the increasing polarization between Hindu and Muslim communities in India in the early 1990s, and focuses on the relationship between notions of childhood and discourses of community, gender and nation. The article argues that there was a synecdochic relationship between the purity of girl-children and the purity of the Indian nation: far from being ‘pre-cultural’ or apolitical, discourses of childhood were profoundly implicated in the politics of gender, sexuality, community and nation. What are the implications of Ameena's predicament for feminist epistemology and praxis? In pointing to the ways in which feminist critiques of modernist regimes of power and knowledge can enable us to understand the multiple positionalities of children in the contemporary world, the article explores the spaces available for feminist theorists and activists to engage in a politics of vigilance and intervention with regard to the state's positions towards children. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

Given that recent studies in Economic History pay attention to certain accounting tools, such as costs accounting, this work focuses on the prices of commodities and, specially, the conditions of sale of the meat and its price, according to the data provided by the ḥisba Andalusi treatises. The study of these (...) class='Hi'>Arabic texts shows a complex and controversial price system, which reflects Islamic law and customs, but also the existence of fraud. Ex interiore ipso exeas. Preface. This book reconstructs the history of a still open dialectics between several ethoi, that is, shared codes of unwritten rules, moral traditions, or self-aware attempts at reforming such codes, and ethical theories discussing the nature and justification of such codes and doctrines. Its main claim is that this history neither amounts to a triumphal march of reason dispelling the mist of myth and bigotry nor to some other one-way process heading to some pre-established goal, but (...) instead to a chain of controversies where the partners’ will to win unintentionally yields a wealth of insights on human existence that has still something to teach us. -/- 1. The Hellenic moral tradition. -/- Two different traditions of morality in vi-v century Greece are described. The birth of philosophical questioning of traditional morality and temporal and spatial variation of custom is described within the context of the v century crisis, the demise of traditional aristocratic and tyrannical rule and the birth of democracy. Two conflicting answers to the challenge are reconstructed, namely conventionalist or immoralist theories formulated by the Sophists and the eudemonist and intellectualist Socratic theory. -/- 2. Plato and the Good. -/- Plato’s own reformulation of Socrates rejoinder to the Sophists is reconstructed. His psychological views, his classification of the four cardinal virtues and his political theory are described as parts of a unitary system, culminating in an extremely realist moral ontology identifying the idea of the good with the essence of the (moral and extra-moral) world itself. -/- 3. Aristotle and practical philosophy. -/- Aristotle’s invention of practical philosophy as a field separated from first philosophy is shown to be an implication of his break with Plato moral ultra-realism. Aristotle’s agenda in his moral works is arguably dependent on a polemical intention, namely dismantling Socratic intellectualism. The semi-inductive or virtuously circular method of practical philosophy is illustrated, starting with the received opinions of the better and wiser individuals and trying dialectically to sift what is left of mistake and inconsistency in such opinions, finally trying to correct mistakes and make the overall practical science more consistent. The relationship of individual ethics, or ‘monastics’, with the art and the science of the pater families, or ‘economics’, and the science of the ruler and citizen, or politics, is illustrated. The nature of virtues, or better, excellences of character, is discussed, highlighting the basic role of hexes, or ‘dispositions’. Prudence, or better, practical wisdom, is the focus of the chapter. Its relationship with boùleusis or deliberation is discussed, and its autonomous status vis-à-vis theoretical knowledge is stressed. -/- 4. Cynics and Stoics: ethics as therapy. -/- The chapter provides an overview of Hellenistic ethics, which almost amounts to Hellenistic schools of philosophy, in so far as ‘philosophy’ became in these centuries primarily the name for a way of life. The typical character of the Cynical movement is highlighted, that of a school of life, not a school aimed at providing any kind of intellectual training was to be provided. The various phases of Stoicism are described, and the shifting place that was given to ethics in the Stoic system of idea, culminating in the paradoxical view of ethics, its impossibility in principle notwithstanding, as the only truly significant and necessary part of philosophy. The peculiar character of the Epicurean school is described, a combination of the science of well-being aiming, more than pleasure understood as in the popular view, the reduction of useless suffering, of unnecessary needs, and at a balanced selection of pleasures of the best and most durable kind. -/- 5. Roman and Imperial Moralists. -/- The chapter is dedicated to the reconstruction of a particular kind of literature, whose specific features have long been under-stressed, namely the Roman and Imperial moral literature. Cicero is treated at some length, showing how his own synthesis of various Hellenistic trends is as a truly philosophical enterprise, deserving serious consideration after one or two centuries when he was confined to the role of literate. Epictetus is given pride of place, stressing the novelty of his approach to ethics as cognitive therapy, in this case just following an already existing new wave of interest after nineteenth-century oblivion justified by alleged lack of authentic ‘philosophical’ character. -/- 6. The Hebrew moral tradition. -/- A reconstruction of basic ideas from a few books of the Hebrew Bible is provided, starting with the Prophetic tradition and the focus on God’s mercy as the source of motivation and standard for human behaviour. Then a comparative analysis is undertaken of a parallel tradition, namely the three codifications of the Torah (Law or, better, Instruction), highlighting how a core of moral ideas may be recognized as a basis and preamble of codification of civil law, cultural practice, and regulation of ritual purity. The importance of Levitic is stressed as the turning point when the stress on mercy, typical of the Prophetic tradition, starts being combined with legal tradition yielding the change in the sensibility of the Second Temple time. -/- 7. Second Temple Judaism. -/- This chapter describes the Long March leading from the post-exile Zadokite restoration to the first-century aevi vulgaris. The first topic reconstructed is the Zadokite theology of the double retribution. The second is the alternative Enochic tradition consistently rejecting the central role of the Temple, the Priesthood and worship as atonement for sins and offering as an alternative God’s unlimited mercy and preaching mercy, not sacrifice as the way of behaving requested by God. Wisdom literature, the third subject discusses, is a kind of third way, on the one hand increasingly critical towards the double retribution and ruling theology’s optimism facing the world as it is and on the other mocking at the Enochic current as a band of dreamers and visionaries. The third way consists in disenchantment facing the word as it is combined with a refusal of vain and childish hope of prizes for the righteous, suggesting instead the leading idea of right deeds for righteousness’s sake. Rabbi Hillel, Rabbi Yeshua and Philo of Alexandria are described as the three leading figures at the culminating point of such process of emergence of a new sensibility, gradually including mercy as an essential part of justice and establishing the starting point of both the Rabbinic and the Christian tradition. This starting point consists precisely in the precept of one’s neighbour’s love or of the golden rule, whose meaning is, arguably, more consistent than a long-lasting Christian tradition deriving from John and Augustine made us believe. And Christian morality, vis-à-vis allegedly legalist ‘Ancient Testament’ teachings, is less of a novelty than most early Christian writers announced. -/- 8. Talmudic moral doctrines and proto-Christian paraenesis. -/- The first three sections examine the moral doctrines of so-called 'ethical Treaties' from the Talmud, a group of treaties, among which the best known is Pirke Avot, that were left out of the six "orders" of the canon as they did not fit in any of the six groups of issues ritual or legal on which the division was based. According to Maimonides, their peculiar theme is provided by the Deot, 'opinions', i.e., mental dispositions, that is, the translation of the Greek term hexes and Arab akhlak (in turn providing in this language the name for ethics as such). The three topics I reconstruct are: i) the notion of Torah: The Torah is understood as the world order itself, or as the ‘Wisdom’ that existed even before creation and was "the tool by which the world was built"; however, the Torah is an earthly and human entity, as it was "received" by humans, and from that very moment belongs to them; ii) the relationship between love of God and love of neighbour; the treaties require us to study and practice the Torah ‘for its own sake’, that is, require us to act out of love, not out of fear or hope of reward; iii) the idea of sanctification of daily life: having disappeared with the destruction of the Temple the possibility of any conflict between liturgical service and everyday life, the latter is assumed to be in itself divine service: to give food to the poor has the same value as sacrifices in the Temple, and as an implication, the insistence become recurrent on the goodness of created things in themselves along with a polemic against ascetic currents. The conclusions drawn are: i) the moral teachings of the Talmud and those of Yeshua are, rather than similar, virtually identical; one may safely say that the precept of love and the golden rule are central ones for all Talmudic rabbis, that mercy plays an indispensable role alongside with justice, and the latter is not a different thing from one’s neighbour’s love; ii) a peculiarity of Talmud rabbis facing Yeshua is the idea of study as worship, and knowledge as a source of justice; but this is an idea of Judaism after the Temple's destruction that cannot be attributed to the Pharisees of Yeshua’s time; iii) the relation of study and practice in the Talmud parallels that between faith and deeds in Paul's epistles, that is, respectively faith or learning are a necessary and sufficient condition to be recognized as righteous, but deeds are the inevitable effect of either faith or learning. The last two sections examine first the various Christian currents and then Gnostic para-Christian or non-Christian currents as well as Manicheism. The sayings ascribed to Yeshua are examined first, yielding the conclusion that a close equivalent may be found for every saying in Talmudic literature and yet the whole is ascribed to one rabbi, with rather consistent stress on God’s mercy and unconditional forgiving as the mark of true imitation of God. Thus, Yeshua’s teaching is pure, purest Judaism. The last section describes briefly the galaxy of Gnostic currents and Manicheism, trying to sketch the profile of moral teachings resulting from an encounter of Asian spiritual traditions, Hellenistic lore and sparks of teachings from apocalyptic Jewish currents. -/- 9. Christianity as “philosophy”. -/- The chapter reconstructs the stormy story of several encounters between Christian currents and Hellenistic philosophical schools. The first one was with late Cynicism. Recent, rather controversial, literature discovered the jargon and several rhetorical topics from the Stoic and Cynical popular philosophy in a few books from the New Testament itself. This, far from proving that Rabbi Yeshua himself had been influenced by cynical preachers, is a proof of the necessity to translate the original Christian message in a Greek lexicon deeply impregnated with cynic terminology. The second was with Platonism, yielding the mild and temperate moral teaching of Clemens of Alexandria, teaching the sanctity of nature and the human body, the joy of moderate fruition of ‘natural’ kinds of pleasures, and the beauty of the marital life – in short, the opposite of the standard picture of Medieval Christianity. Ambrose of Milan brings about a different kind of synthesis, namely with Middle Platonism, where Stoic themes prevail. The most shocking case is Augustine, where early Manichean education is overcome in a former phase by a synthesis of Plotinian Neo-Platonism and Christian preaching, yielding a sustained polemic with the Manicheans and rather optimistic views on life and Creation, the body and sexuality, and Hebrew-Judaic tradition not far from Clemens of Alexandria. In a later phase, occasioned by controversy on the opposite front, with such Christian currents as the Pelagians and Donatists, Augustine comes back to heavily anti-Judaic and world-denying ascetic attitudes where is earlier Manichean upbringing seems to emerge again. The tragedy of medieval Christianity will be the later Augustine’s overwhelming influence. A final section is dedicated to the monastic tradition where a curious mixture of world-denying asceticism with an astonishingly penetrating ‘science’ of introspection emerges. -/- 10. Ethics in the Arabic-Islamic Philosophy. -/- The Qurān and the qadit, that is, collections of sayings ascribed to the prophet Muhammad contain a wealth of precepts and catalogues of virtues mirroring moral contents from the Jewish and the Christian traditions, among them the basic notion of imitation of the Deity, where mercy is assumed to be its basic trait. An important tradition within Islam, namely Sufism, stressed to the utmost degree the role of mercy, turning Islam into a mystic doctrine centred on the retreat from the world, abandonment to God’s will, and a peaceful and fraternal attitude to our fellow-beings. A secular literary tradition originating in the Sassanid Empire, the literature of advice to the Prince, had for a time a widespread influence in the newly constituted Arabic-Islamic commonwealth. In a later phase, the legacy of Hellenic philosophy made its way into the intellectual elite of the Islamic world. The first important legacy was Platonic, and the Republic became the main text for Islamic Platonism. In a second phase also Aristotelian and Stoic influence were assimilated. Miskawayh’s treatise was the masterwork at the time Arabic philosophy reached its Zenith. It is a treatment of the soul’s diseases and their remedies, combining the Aristotelian doctrine of the golden mean with the Stoic doctrine of the passions and elements of Galenic medicine. Towards the eleventh-twelve centuries, a war raged among theologians and philosophers, finally won by the former with the disappearance of philosophy as such. The newly established mainstream, yet, was no kind of intolerant fanaticism. It drew from the work of mystic theologian Al-Ghazālī, the best heir of Sufism, teaching a tolerant and peaceful attitude to our fellow-beings and a passive attitude to destiny as an expression of the Divine will. -/- 11. Ethics in the Jewish philosophy. -/- The encounter between the Talmudic tradition and Hellenic philosophy had taken place for the first time in Alexandria at the time of Philo but the two traditions had parted way again. In fact, the kind of Platonic Judaism founded by Philo survived only within Christianity, in the fourth Gospel and then in writings by Clemens of Alexandria. The Talmudic literature had absorbed too a few traits from the Hellenic Philosophy, namely an idea of ethics as care of the self and a role for the education of character as propaedeutic to theoretical knowledge. In the Arabic-Islamic world, a second round started when Jewish authors writing in Arabic undertook the task to prove the full compatibility of the tradition deriving from Tora and Platonic philosophy. The culmination of this attempt is provided by Moshe ben Maimon who tried to use Aristotelian ethics as a language into which the teaching from the Pirke Avot could be translated. -/- 12. The practical philosophy revival in Latin Europe. -/- A reconstruction is carried out of a fresh start of philosophical ethics in Latin Europe at the turn of the Millennium rescuing a Platonic and Augustinian legacy, with Anselm and Peter Abelard. In this phase remarkable innovations are introduced, including Abelard’s claim of the obliging character of erring consciousness. In a second phase, the rediscovery of Nicomachean Ethics thanks to Latin translation of Arabic versions, gives birth to a new wave of ethical studies, recovering the very idea of Aristotelian practical philosophy, with the potential implication of a full legitimization of natural morality, i.e. ethics without Revelation. -/- 13. Scholastic practical philosophy: Thomas Aquinas. -/- Aquinas’s ethics is theological ethics out of which it would be vain to try to extract self-contained philosophical ethics. His treatment of topics in philosophical ethics, yet, does not boil down to the repetition of Aristotelian arguments but is rather a creative reshaping of such arguments. For example, he introduces also in the practical philosophy a first principle parallel to the principle of non-contradiction; and he also carries out a synthesis of Aristotelianism, Stoicism, neo-Platonism. Even though it is essentially moral theology, Aquinas’s doctrine - unlike Augustine – grants full citizenship to "natural" morality, firstly by rejecting the claim that the corruption of human nature due to the original sin is so radical as to leave pure nature incapable of moral goodness. The doctrine is presented in a more sophisticated formulation in a few of the Quaestiones such as De Malo and De Veritate, in the Summa contra Gentes and in the commentaries to Aristotle than in the famous Summa Theologica, but the latter work includes the only or the largest exposition of some decisive part of the theory. Thus, the Summa Theologica should be read for what it is more than criticized for not being what it was not meant to be. It was not meant to be the brilliant synthesis of all that Reason he had been able to produce with what Revelation had added about which the Neo-Thomists used to dream, but rather a manual for the training of preachers and confessors, where theoretical claims are not too ambitious, and a few serious tensions are left. Besides a jump between the Prima Secundae and the Secunda Secundae, being the former an essay in virtue theory and the latter a handbook for confessors, the most serious tension is perhaps the one between the ethics of right reason presented in most of Prima Secundae and the eudemonistic ethics developed in quaestiones 1-5 of the same part; the alternative ethical theory which also may be found in Augustine, the Stoic view of a cosmic reason eventually coincident with the moral law, was believed by Anselm (followed by John Duns Scotus and William of Ockham) to be incompatible with eudemonism. It is questionable whether Thomas was able to solve the tension proving that it is just an apparent tension, in so far as the right reason and bliss derived from the knowledge of God tend to coincide, but this is just a conjecture. Thomas’s ethics is a virtue ethics, not a law-based one, and moral judgment focuses on the virtues, particularly charity, not on the commandments and even less on absolute prohibitions; Thomas, however, would not have considered a drastic alternative between law and the virtues such as the one which has been advanced in late twentieth-century philosophy to be justified. Nonetheless, when it discusses ‘special’ virtues, it ceases to be an ethics of virtue and becomes a disappointing and often contradictory discussion of legal and illegal acts. Such a discussion takes most of the time ‘reasonable’ middle positions on controversial issues but not the alternative approach that Aristotelianism would have made possible; even when some occasional Aristotelian claim shows up, such as money’s barrenness as a reason against usury, this seems to be made by an author who apparently ignores the Aristotelian Thomas of the Prima Secundae. It is an ethic of human autonomy which recognizes the binding character of the individual conscience and, potentially, even a duty to disobey unjust laws. It is true that what Thomas writes in his discussion of the death penalty and persecution of heretics is simply disgusting, and yet we should blame Thomas the man, not the Thomist ethical theory. Finally, Thomas’s ethics is no way an ethical ‘absolutism’, as both the traditionalist Catholic theologians and secularists tend to believe, but rather an ethic of prudential judgment on the individual case. Exceptions to this approach – or better the result of logical fallacies – are provided by the thesis of the absolute character of negative precepts and of the existence of so-called intrinsically evil acts, a thesis that would simply cease to make sense in the light of Thomas’s own distinction between human act and natural act, carrying consequences that Thomas did not live long enough to draw. -/- 14. Scholastic practical philosophy: John Duns Scotus and William of Ockham. A reconstruction is carried out of the ethical doctrines by both most authoritative Franciscan doctors. Their continuity with Aquinas is vindicated against prejudice carried by centuries of polemics within the Catholic Church and tendentious disparaging of both as forerunners of execrable Reformation. Besides aspects of continuity, also the important novelties are illustrated, first John’s abandonment of Aquinas’s and Augustine’s eudemonism, asserting righteousness for righteousness’s sake, and then William’s explicit defence of the philosopher’s virtues, that is, natural morality, and his solution to the dilemma of God’s omnipotence and the universal validity of natural law extending to God himself. -/- 15. Aristotelianism interpreted by the Magistri Artium. -/- A reconstruction of the until recently forgotten ethical doctrines by the Parisian Magistri Artium, falsely depicted as ‘Averroists’ and either deprecated as heretics or mistaken for predecessors of modern secularism. In fact, they illustrate a view of ‘natural’ virtue as may be understood by human reason without the assistance by Revelation. -/- Etiamsi daremus Deum non esse. Intermediate considerations. Three considerations may be suggested by the story told in the book. The first one is that intellectual histories have been mounted in the past with the same state of mind as one may mount a war chariot. Such constructions are not very helpful as tools for understanding the past. Wars waged in the past have left the field obstructed by ruins not easy to remove even by those historians who have animated by an impartial academic motivation. They have been influenced too by consequences of past emphasis on some authors and damnatio capitis suffered by others, by stratifications left on sources by secondary literature and translations, by allotment of originally close sources to different literary genres, by the monopolization of religious texts by churches with full cooperation by secular scholars who still fear contamination. The second one is that aware or unaware ethnocentrism has carried various calamities to our comprehension of the past. Their last vestiges have surfaced again in the semi-scholarly discussion on the idea of Europe occasioned by the debate on a project of a European Constitution. Mention of Europe’s Christian roots has been the clumsiest move. Proclamations of such roots were so obvious in what they affirmed as they were totally off-path concerning what they omitted, namely that he modern European moral tradition included legacies from Middle-Eastern wisdom, Hellenic philosophy, Roman Imperial legal literature, and, besides, a Jewish legacy in turn incorporating other more ancient Middle-Eastern legacies and which has been partly conveyed by Christianity. And the Islamic-Arabic philosophy too, in so far it made the Nicomachean Ethics available to Latin Christian scholars, is one more of Europe’s roots. The third is that religious traditionalists and secularist fundamentalists have gone hand in hand for a couple of centuries in either extolling or deprecating the allegedly Modern idea of Ethics without God, first formulated by Hugo Grotius with the claim that natural law would still be valid ‘etiamsi daremus – quod sine summo scelere dari potest – Deum non esse’. The facts are, firstly, that this is not an irreligious claim and Grotius was just a pious and meek Christian and, secondly, that it is not a ‘modern’ claim but rather one more formulation of the claim that there is a natural morality, independent of divine revelation, a claim shared by Moshe ben Maimon, Aquinas and William of Ockham. -/- . continent. 1.4 (2011): 253—278. A Sense of French Politics Politics itself is not the exercise of power or struggle for power. Politics is first of all the configuration of a space as political, the framing of a specific sphere of experience, the setting of objects posed as "common" and of subjects to whom the capacity is recognized to designate these objects and discuss about them.(1) On April 14, 2011, France implemented its controversial ban of the niqab and burqa , commonly (...) referred to as the Islamic veil, in public places. On the coattails of the 2004 prohibition of religious artifacts, including the less concealing hijab or Islamic headscarves, in schools, the veil ban sparked equal outrage across both political and theological spectra, and many on both sides of the debate were quick to inquire about enforcement. As Steven Erlanger reports, “The police do not have the authority under the law to remove full veils, only to fine or require citizenship lessons for those who violate the new law.”(2) While the legal and social implications of this interdiction are ripe for study, the reprisals for breaking the law, notably compulsory citizenship classes, illuminate the strategic governmentality underlying the French government's targeting of the Muslim community, particularly those elements it considers affiliated with fundamentalist factions and/or terrorist organizations, if only through fashion—an integral component of French citizenship. Indeed, in allowing the (fashion) police to mandate instructional courses in citizenship for offenders, France implies that any Muslim choosing to wear the niqab or burqa , perhaps even for those who are already citizens, must not be aware of the subtle nuances of dress indicative of the French citizenry within public space. Furthermore, the degree of instruction requisite to citizenship, which clearly can and must be updated as the state sees fit, cements the imagined relation between citizens and states within the discourses on the veil ban. As Sharma contends, “Concepts of citizenship are the ideological glue that bonds the nation to the state. Citizenship provides the legal framework through which the state performs its role as ruler for the nation.”(3) Speaking for/as the state, French President Nicolas Sarkozy declared in a 2009 presentation before members of the government and other citizens that the burqa “is not welcome on the territory of France.”(4) Although there is nothing unique, especially recently, about a nation-state taking extreme measures to guard itself against what it deems to be threats to its sovereignty, the way in which the ongoing discourses on hijab have (d)evolved, which coincide with recent pronouncements by governmental leaders in Germany, Britain, and France that policies of multiculturalism have “failed,”(5) points toward nationalist reterritorializations, which is also to say physical and ideological re-appropriations, of public space within democratic milieux, which remain predicated upon the mediation of spaces. As Panagia deduces from Rancière, “Democracy […] is not an institutional form of government […], but an appearance whose visibilities and audibilites arise out of the dissonant blur of the everyday.”(6) Ultimately, the veil ban represents a calculated move to regulate the every day, which is to say the micropolitics of, that which is visible and invisible within French society, which makes it nothing short of a struggle to manage (the sensation of) bodies. Re-situating the political within the context of sense, Rancière argues that the fundamental essence of politics lies within the distinction between consensus and dissensus , and whereas most consider politics proper as fundamentally concerned with the fluid operations of the state— consensus , Rancière actually locates the political within events that disrupt the normative sensory order of things— dissensus . He explains, “Politics revolves around what is seen and what can be said about it, around who has the ability to see and the talent to speak, around the properties of spaces and the possibilities of time.”(7) This reformulation of politics centers on agency and, albeit perhaps unintended, representationality and offers a useful formulation for spatializing the discourses surrounding the Islamic veil, which are mired within seemingly senseless policies and practices of objectification. Instituting a normative “regime of visibility,” the French veil ban encapsulates the political economy of agency, now both mediated and representational, under the rule of nationalist governmentalities in increasingly transnational contexts.(8) Adjudicating presence within public space signals a concern with the sensory aspects of agency itself—what Rancière terms the “distribution of the sensible,” which is “a matrix that defines a set of relations between sense and sense: that is, between a form of sensory experience and an interpretation which makes sense of it.”(9) To be concerned with sense is to focus upon the body, and this somatic repositioning of the (fashionable) citizen within the territory of the state augurs the resurgence of nationalist bio-politics within Europe, since, as Hage explicates, “Nationalism, before being an explicit practice or a mode of classification, is a state of the body. It is a way of imagining one's position within the nation and what one can aspire to as a national.”(10) The French government's attempt to make (bodily) sense of public space for its citizens by and through policies aimed against a burqa-clad Muslim minority, which might only apply to “less then 400 to fewer than 2,000” women(11), reveals the necessary, yet mercurial, transmutation of public space into national space through bio-political strategies of sense-making, which, as Hage observes, denotes that “nationalists perceive themselves as spatial managers.”(12) At the center of this concern over public space is the equally contentious dimension of governing female Islamic identity, which has become one of the main critiques levied against Islam from outsiders who view the veil in its various forms as a clear sign of the religion's actual and symbolic violence against women, even if such critiques remain ensconced within nationalist discourses. As Halim and Meyers argue, “Although Western news media may focus their coverage of Muslim women on the debate over whether and the extent to which the veil may by oppressive to the women who wear it, they have exhibited little interest in the physical oppression of violence against women in Islamic countries.”(13) While it falls outside of the scope of this analysis to arbitrate all of the dimensions of this debate, understanding some of the issues related to female identity and hijab within public space are crucial to this study. As these topics are extraordinarily complex, even and perhaps especially within the Muslim community, it is necessary to provide some context concerning the value, purpose, and meaning of the Islamic veil, which has a rich and arduous history. The Art of the Veil At present, there are only two countries, Iran and Saudi Arabia, that require women to wear hijab , which is a decidedly problematic term and concept whose locus is itself caught within a struggle of sensation. Noting the strategic reterritorialization of the term, Berger explains: The choice of the name, hijab , now widely adopted to designate the “Islamic veil,” it itself interesting, although the semantic shift it operates is not directly commented upon by its users. Although the design (both the cut and the symbolic function) of the hijab and the Iranian chador are indeed the same, as opposed, for instance, to the traditional Algerian haik , the word hijab has come to replace the term chador popularized by the Iranian revolution, as a properly Arabic (hence Koranic) designation. This discursive shift points to the successful reclaiming of the national revolution in Iran by a transnational pan-Islamic movement, whose language of reference can only be Koranic Arabic.(14) While the hijab is certainly a point of contention within various countries dealing with immigrant Islamic populations (of which France has the largest in Europe as part of its colonial legacy in Algeria), it is clear that the veil is a historically contextualized artifact of Muslim identity with a variety of manifestations, even as forces outside of and within Islam seek to codify its actual and symbolic value. Ultimately, the varieties of hijab , including the full-faced burqa and niqab , are complex assemblages of meaning that speak to the multitudinous flows of Islamic identities over time and space. As Gökariksel and McLarney observe, “Wearing a certain style of veil may simultaneously be a disciplinary practice crucial to the cultivation of piety (Mahmood 2005; Gokariksel 2009) and a gendered performance of social distinction in terms of class, taste, and urbanity (White 1999; Navaro-Yashin 2002; Gokariksel and Secor 2009) or of ethnicity and race (Dwyer 1999).”(15) The ideological marketplace from which the varieties of hijab ebb and flow serves both as a reflection of the ever-present materiality and dynamic functionality of spiritual economies, which are derivative of the equally ubiquitous flows of transnational capital driving agency and representationality within our historical moment. Keeping these dual, yet deeply interconnected, capital ecologies as the site of exploration for how the veil is represented within public space, one might begin to sense what lurks behind such veiled agendas. Examining the symbolic and representational nature of the Islamic “veil” in its various forms, this project situates the decidedly political contestations of public space at stake in the French ban alongside recent condemnations of multiculturalism as calculated efforts to re-distribute the sensible so as to valorize national identity within increasingly transnational and globalized socio-economic spaces, which collapse exchange values between distinct, yet interwoven, economies of (cultural/material/spiritual) capital. As the discourses on the veil rely upon representational imag(in)ings, it seems fitting to explore the political economy and art of the veil through the phenomenon of street art, which, much like hijab , is a complex assemblage of meaning of sensation mired in representationality and capital exchange. As street artists have taken up hijab in various forms, the movement offers a lens with which to situate critical responses to the veil debate across both spiritual and material economies. Situating this street art both aesthetically and historically, Lewisohn explains, “'Street art' is a sub-genre of graffiti writing and owes much to its predecessor. Though there is a good deal of crossover between the genres, they are distinct and separate in their own right.”(16) Evolving out of the graffiti explosion of the late 1970's and 1980's, street art broke the unspoken rules of the artistic underground by challenging and re-examining one's sensory experience of art in public space by experimenting with both content and form in ways that harken back to the Situationist International, which as a collective challenged one's experience of urban space through various media and experiential phenomena. Again, Lewisohn observes, “It's important to note street art's break with the tradition of the tag, and its focus on visual symbols that embrace a much wider range of media than graffiti writers would use.”(17) From stencils to prints and murals to one-liners, street artists developed a reputation for critical social and political commentary, and while it is certainly the case that not all street art is intentionally political, in challenging the normative “regime of visibility,” as Rancière puts it, of public space, street artists—even if unconsciously—call into question the common sensory experience of the politics underlying the formation of (nationalist) space.(18) Indeed, Rancière refers to the partisan sensory managers as “police,” who ultimately forge “the rules governing the circulation of appearances, of their visibility and audibility, and the proper distribution of bodies therein.”(19) As such, one can sense that street art's relationship with the police is tenous for a variety of reasons. Writing about his own experience as a street artist, Shepard Fairey observes, “With street art, there's no committee deciding whether I can put my work up on the street, there's no censorship, and I have total freedom of expression, and that concept of freedom is expressed just by using the street as a medium.”(20) As Fairey and other street artists demonstrate, the medium, to paraphrase Marshall McLuhan, is the most glaring aspect of street art's message, and even as it now finds itself in galleries and usurped by private collectors, the ethos of the movement remains relavent to politics as it is, first and foremost, concerned with the configuration and experience of space. Just as examining the punishments for breaking the veil ban can map the terrain of French politics, a representational genealogy of street artist's deployment of hijab and female Muslim identity can assist in mining the depths of public space as a site of bio-political control and contestation in light of recent events in France and the rising tide of anti-multiculturalist rhetoric across Europe, even though the Islamic presence there is radically heterogenous. Using the work of Shepard Fairey, Princess Hijab, br1, and Banksy, this paper sets out to answer a number of key questions concerning the deployment of hijab, and female Islamic identity in particular, within street art as a movement now integral to and critical of the economies of exchange underlying global capitalism, which as a force of influence cannot be underestimated as a driver in the resurgence of nationalist biopolitical governmentalities. Although there exists a litany of artists to choose from, the aforementioned quartet of designers integrate hijab into their work in a seminal and critical fashion, and all have been working with the veil in some way prior to the French ban, which grants some additional context to their usage of it as a symbol in regards to the breakdown of multiculturalism across Europe, even if unconsciously. Although each artist depicts various amalgamations of hijab in their respective corpus, they share common tropes that raise significant questions concerning the veil debate, namely: what are the conditions of possibility for hijab to become a marker of Islamic identity within public space? How can we make sense of the representational topologies within street art's utilization of the hijab and female Islamic identity in light of the French ban? How might these aesthetic imag(in)ings simultaneously inhabit and combat normative discourses concerning hijab , multiculturalism, female Islamic identity, and public space? : The question as to whether or not it was allowed to dye one’s hair, became heavily discussed in early Islam. So we find controversial traditions on this problem. Dyeing the hair however, was not only under discussion in religious circles, but also in topics taken by poets. In Arabic poetry, grey hair meant old age. As a consequence, it was the end of love and youthful life. Dyeing the hair therefore, was a means to cheat the ladies about (...) the real age of the poet. The poets did not have so much religious scruples, since for them the effectiveness of dyeing was the point. On this however, some poets had their doubts. The idea of “promoting democracy” is one that goes in and out of favor. With the advent of the so-called “Arab Spring”, the idea of promoting democracy abroad has come up for discussion once again. Yet an important recent line of thinking about human rights, starting with John Rawls’s book The Law of Peoples, has held that there is no human right to democracy, and that nondemocratic states that respect human rights should be “beyond reproach” in the realm of international (...) relations. This is, for obvious reasons, a controversial view, especially given the powerful and important arguments purporting to show that democracies do significantly better than nondemocracies in promoting internal peace and equality, and in engaging in peaceful international cooperation. Both proponents and opponents of the Rawlsian view of human rights have argued that the view implies that democracies may not “promote democracy” in nondemocratic societies. But, given that all parties to this dispute agree that democracy is necessary for justice, and given the important instrumental goods provided by democracy, the Rawlsian view has seemed deeply implausible to many. -/- In this paper I blunt this challenge to the Rawlsian view by showing how, even if there is no human right to democracy, we may still rightfully promote democracy in a number of ways and cases. Showing this requires investigation of what it means to “promote democracy”, and a more careful inspection of when various methods of promoting democracy are appropriate than has been done by most political theorists working on human rights. When we look carefully, we can see that in some instances acceptable forms of promoting democracy are compatible with the Rawlsian view of human rights, and that this view is therefore not vulnerable to the “instrumentalist” challenge. The concept of ‘‘certitude” is central in Arabic discussions of the theory of demonstration advanced by Aristotle in the Posterior Analytics. In the Arabic tradition it is ‘‘certitude,” rather than ‘‘knowledge”, that is usually identified as the end sought by demonstrations. Al-Fārābī himself devotes a short treatise, known as the Conditions of Certitude, to determining the criteria according to which a subject can claim to have absolute certitude of any proposition. In this article the author traces the roots (...) of the concept of certitude to the Arabic translation of the Posterior Analytics. She then offers a close reading of the text of al-Fārābī's Conditions and its parallels in his Epitome of the Posterior Analytics. She argues that the identification of certitude as a cognitive state distinct from knowledge enabled al-Fārābī to introduce a number of interesting and sometimes problematic innovations into Arabic epistemology. Foremost amongst his positive innovations is the recognition that contingent as well as necessary propositions allow for an attenuated form of certitude, and the introduction of reliabilism into the justification of claims to certitude. But al-Fārābī is also one of the first philosophers to articulate explicitly the idea that certitude must include an element of ‘‘knowing that one knows,” a controversial principle that tends to undermine both al-Fārābī’s reliabilism and his efforts to loosen some of the strictures in traditional Aristotelian epistemology. The Kitāb Takrīm al-ma‛īsha bi-taḥrīm al-ḥashīsha and the Kitāb Tatmīm al-Takrīm li-mā fi l-ḥashīsh min al-taḥrīm by Quṭb al-dīn al-Qasṭallānī occupy a prominent place in the Arabic literature scene on drugs in general and on hashish in particular. Its relevance is due to the fact that most of the Arab authors of subsequent centuries made use of these two epistles in drafting their treatises. That is why al-Qasṭallānī is the most frequently quoted authority in the aforementioned treatises. A close (...) look at both epistles reveals a considerable amount of historiographic unknown data to date on Arabic writing devoted to hashish and prompts us to question other generally accepted data. Futhermore, the characterisation of al-Qasṭallānī's historic personality perfectly illustrates the arrangement of orthodox sufi stratum who were the most important defenders of the ideological fight against hashish consumption during the 13th century. At the same time, the study of the contents of their epistles offers us a clear image of the general ideological context in which the controversy among those Sufis who were against and those who were for the ritual consumption for hashish took place. When the Qur’ān was revealed, it primarily used the language of the first addressees, Arabic, in the most impressive and understandable way to convey its message. In doing so, it used all the possibilities allowed by the range of meanings and rules of the language. While the Qur’ān conveys its message to its addressees, it sometimes uses long expressions, sometimes quite concise ones, and even a word or preposition in some places. Due to the structure of the language, the (...) words, the smallest component of the language, and, peculiar to it, even the prepositions and letters, due to the morphological structure of Arabic, are the elements that completely affect the meaning. Like many other letters and prepositions in Arabic, the preposition “إنْ” handled in this study undoubtedly has an important effect on the meaning. We generally encounter, in many verses of the Qur’ān, the use of this preposition in the sense of condition, which is the most basic meaning in the language. In addition to this meaning, the negative, emphasis, and causal meanings are also the other uses of this preposition according to the integrity of Qur’ān and the context of the verses. Apart from the meaning of condition as the basic meaning of the preposition “إنْ” in the Qur’ān, whether the meaning of cause/ta‘līl exists in the language and this meaning is used in the Qur’ān is basically an issue discussed by the Basra and Kūfa language schools, the issue has still been discussed by the exegetes as well due to its effects on the meaning. It is quite important for correctly understanding the Qur’ān to determine the effect of the preposition “إنْ” on the meaning when it is mentioned in the Qur’ān and to give the appropriate meaning to the context. This paper is also important in that it aims to deal with the effect of the preposition in question on the meaning in the verses where there are controversial approaches and in the example of the use of the verb form “إِنْ كُنْتُمْ". In the study, the approaches of the exegetes to the verses on which there are problematic approaches are transferred from the major interpretations written from the early period to the modern period and some evaluations are included with an analytical view. Although the Basra language school and some exegetes following them say that “إنْ”does not mean causation, the linguists of Kūfa and the exegetes following the same line have stated that it also means that, and they showed examples from the āyāt (verses) and hadiths that it is not correct to use this preposition in the meaning of condition in some contexts in the Qur’ān. For example, they argued that the use of the expression “إِنْ كُنْتُمْ”used about angels in a verse in Sūrat al-Baqara 2/31, as “if you are of the truthful” would raise doubts as to whether they were truthful or not and this would contradict their qualifications as angels. On the other hand, they argued that giving a conditional meaning to “إِنْ كُنْتُمْ”at the end of the verses starting as “if you are believers” or the ones in which the believers is directly addressed as in al-Baqara, 2/278 and Āl ‘Imrān 3/139, would cause a contradiction between the beginning and the end of the verse, and that this style would cause a problem on the ground of belief about Allah. In the same way, some linguists argue that giving the meaning of conditions to some verses poses a problem in terms of the context and the style of the Qur’ān, and they explain this situation through al-Baqara 2/23 and similar verses. For, although it is certain that the polytheists doubted about the Qur’ān in the verse in question according to them, the statement “If you are in doubt about the Qur’ān, bring a sūra (chapter) like it” fits neither context nor fact. The Basra language school who constitutes the majority and think that the expression “إِنْ كُنْتُمْ”mostly found at the end of the verses in the Qur’ān includes the meaning of condition, and the other exegetes following them have systematically added the meaning of condition to all of the verses in which the aforementioned preposition is used, and in cases where the meaning of condition is problematic or subject to some objections in terms of context, they have resorted to various linguistic explanations such as omission (hazf), precedence-postponement (taqdīm-ta’khīr) and metaphor. As far as it can be determined in this study, except for some scholars of wujūh and naẓā’ir, there was no one who constantly gave the meaning of cause in the verses where the meaning of condition is open to discussion, whereas some exegetes gave the meaning of condition or cause/ta‘līl depending on the context and used all the possibilities of the language by acting more freely. However, it has not gone unnoticed that they present a problematic interpretation style by displaying different approaches in similar āyāt (verses) that come in the same context. (shrink)

The Gaza War is a watershed moment not only in the Middle East. It has also increased political divisions in Germany, where Israel’s security and the fight against anti-Semitism are part of its historical legacy and political and moral identity. Incidents of anti-Semitism have increased dramatically, as have overdrawn accusations of it. An analysis of controversies about the definition of anti-Semitism, about the use of the term apartheid for the situation in the West Bank, of the BDS movement (Boycott, Divestment, (...) Sanctions), and particularly the characterization of Israel as a settler-colonial state shows how difficult it has become to maintain a fair, honest, and frank discussion considering different points of view. The current crisis should be used as an opportunity for Germany to, on the one hand, face the unavoidable contradictions in its responsibilities stemming from the crimes of its Nazi past and, on the other hand, come to grips not only with Arab and Iranian terrorism and eliminationist rhetoric but also with the deficiencies in Israel’s policies toward the Palestinians. Germany’s new leitmotiv ought to be: ‘Between the River and the Sea, Jews and Arabs should be free.’. (shrink)

This article addresses Hannah Arendt’s controversial engagement with European imperial ventures in Africa. For many of her critics, Arendt’s description of imperialism either duplicates the ideologically inflected accounts and justifications of mass-murder, or conveys her own personal views of Africans and peoples of African descent. I argue that Arendt’s account in the “Imperialism” chapter of the Origins of Totalitarianism must be read parallel to her discussion of the conflict in Palestine between Jewish settlers and native Arabs. Rather than provide us (...) with an anthropological account of Africans, Arendt provides a political account of the necessity for cooperation in order to blunt imperial power-politics. In a second move, I develop a normative critique from Arendt’s remarks by relying on Heideggerian aspects of “World.” I argue that Arendt’s criticisms are really directed at Europeans who were unable to take the Africans’ point of view. In this study, the words that Abū al-Ṭayyib al-Lughawī did not consider as aḍdādwhile his predecessors accepted the same words as aḍdād(contronym), are examined. These words are examined with the purpose of determining his approach towards contronmy words (aḍdād). There is disagreement about the definition and the number of aḍdāds, which can shortly be defined as the word which has two opposite meanings. In this study, brief information about the definition and limitation of aḍdādand the reasons that produce aḍdādare given, (...) and then the words that Abū al-Ṭayyib does not accept as aḍdād are analysed under the four titles – based on the classification made by himself. The author does not accept the words which have the same ism al-fāʿil(active participle) and ism al-mafʿūl(passive participle) format because of the verb’s being ecwefor the middle letter’s being combined with the final letter of the verb as aḍdād. Besides, he does not accept the words that have two opposite meanings due to their figurative meaning as aḍdād. He also states that he does not take the words included inaḍdādcategory just because their meanings are reversed by Arabs as aḍdād. With this attitude, the author has rendered the concept more comprehensible by showing what is not aḍdād. In this study, Abū al-Tayyib’s work named Kitāb al-aḍdādis taken as the primary text, and the pieces of poetry and prose shown as examples by the author are stated with their primary sources.SummaryThere are many scholars who worked on aḍdād, which is a terminological expression for the words that have two opposite meanings. Abū al-Ṭayyib al-Lughawī is one of the scholars to write a work about this subject. The author had the opportunity to examine most of the studies about aḍdādand making a comparison between these studies, he wrote Kitāb al-Aḍdād fı̄ kalām al-ʿArab. The work was composed by arranging the words, which had been accepted as aḍdādby the former scholars, in an alphabetical order according to their initial letters alone. The author completed his work by using expressions showing his objection or confirmation about the words’ being aḍdādor not while mentioning the words. Abū al-Ṭayyib added an addendum to the end of the work and in this section, he noted some words which the former scholars had accepted as aḍdādbut he did not. Although he explained the reason of adding this addendum as not to be thought of unaware of these words, he aimed to correct a mistake made by the previous linguists by identifying it thanks to the mentioned addendum.The words الجَوْن(used both with the meaning of black and white), النوء(to arise and to set), الصَّرِيم(night and day), جَلَل(big and small) and السُّدْفَة(dark and light) can be given as examples for the concept of aḍdād, which is terminologically used for the words having two opposite meanings. The words such as البَيْع(to sell and to buy), بَصِير(sighted and blind), ثَلَّ(to repair and to bring down), الأخْضَر(green and black), الخَلّ(well- fed calf/camel and undernourished calf/camel, which have two opposite meanings at the same time, are among the words that Abū al-Ṭayyib presents as aḍdādin his work. Although there are various definitions of aḍdād, the clearest and most comprehensive one belongs to Abū al-Ṭayyib. He makes the following definition which distinguishes aḍdādfrom common wording: “Aḍdādis the plural form of didd(antonym). Antonym means the opposite of something, such as black and white, generosity and meanness, courage and cowardice. Everything that is opposite of something is not necessarily the antonym of it. For example, although strength and ignorance are two opposite words, they cannot be taken as antonyms. Because, the antonym of strength is weakness and the antonym of ignorance is knowledge. This difference arises from the fact that the term opposite is more comprehensive than the term antonym. Although all aḍdādwords are opposites, not all the opposite words are antonyms (aḍdād).” The biggest controversy about aḍdādis about the number of the words that are accepted as aḍdād. While some scholars represent the numbers of aḍdādwords in Arabic language as four hundred, they are not more than twenty for some other scholars. In spite of the controversy about the numbers of aḍdādwords in the language, the existence of aḍdādin Arabic language is an accepted situation.There are some reasons leading to aḍdādin Arabic language, one of which is dialect difference. The word السُدْفَةwhich is used for the meaning of “dark” by Temı̄m clan means “light” in Ḳays tribe. Some changes in language are also stated among the reasons causing aḍdād. It is stated that the original meaning of the word الصَّرِيمwas “interrupted,” but then it was used with the meaning of both night and day for the reason that night is interrupted by day and day is interrupted by night. Another reason is purported as being psychological and social factors. Using the term الكَرِيم“generous” to make fun of a mean person is an example for this situation. One of the reasons causing aḍdādis the morphological structures of the words. As it is the case with the word خائِفٌ“frightened/frightening,” the use of ism al-fāʿiland ism al-mafʿūlmodes in the same form has caused to using the same word with two opposite meanings. There are also some scholars who accept the words that gain two opposite meaning to each other because of rhetorical factors like metaphor. Using the word إِرَةٌboth with the meaning of fireand metaphorically the pit where fire is lightedis an example for this sort. The scholars’ acceptance or rejection of the reasons leading to aḍdādhas resulted in their expanding or narrowing the numbers ofaḍdādwords in the language. In this context, the numbers of aḍdādwords are more for a scholar who accepts most of the reasons mentioned. Abū al-Ṭayyib is among the scholars to cast a wide scope for aḍdādwords. Since the author accepts the aḍdādwords arising from dialect and metre difference, the words that he takes as aḍdādare quite many. In Kitāb al-aḍdād, he states that there are total of 320 aḍdādwords and at the same time he collects the words that he does not accept as aḍdād but which were accepted so by the former scholars under four headings. In the first group, there are the words thought as aḍdādbecause of being an ecwefverb. For the author, the reason these words are supposed to be aḍdādis that ism al-fāʿil(active participle) and ism al-mafʿūl(passive participle) modes of these words turn into the same structure as a result of ʿilālrules. The fact thatالمُجْتَابmeans both “the one who wears” and “the thing that is worn”; المُبْتَاعis used as ism al-fāʿilwith the meaning of “the one who buys stuff” and as ism al-mafʿūl with the meaning of “the stuff sold” is an example for this situation. In the second group, there are the words which are taken as aḍdādbecause of merging (idghām) middle letter of the word to its final letter. It is seen that ism al-fāʿiland ism al-mafʿūl forms of these words are the same due to various reasons. The fact that مُكْتَنٌّis used both for disguisedand the place to disguise; مُحْتَشٌّis used for “the one who gathers grass” and “the grass gathered” is of this sort. In the third group, there are words which are assumed to be aḍdādas they are named after their reasons. There is mostly metaphorical meaning in the words that are placed in this group. One of the words that Abū al-Ṭayyib presents as an example to this group is العَقِيقَة. ʿAqı̄qameans the hair on the head of the baby when it is born. An animal is sacrificed when this hair is shaved. In time, the animal sacrificed has begun to be called as ʿaqı̄qa, as well; and so, ʿaqı̄qais used both for the hair and the sacrifice. Abū al-Ṭayyib argues that such words are absolutely not aḍdād. In the fourth group, there are expressions that result from fāʿil’s replacing mafʿūland mafʿūl’s replacing fāʿilor the words that appear in similar ways. For instance, using the expression “the lizard climbed up the tree” not with the common usage اِنْتَصَبَالْحِرْبَاءُفِيالْعُودِbut by changing the places of fāʿiland mafʿūlاِنْتَصَبَالْعُودُفِيالْحِرْبَاءِis an example for this group. Abū al-Ṭayyib objects to the acceptance of the words used in this way as aḍdād, and argues that aforesaid usages do not comply with the definition of aḍdād. (shrink)
