For the theoretical construction that will allow the analysis to News of a Kidnapping (1996), I rely on the establishment of the sociological character of the disciplines of Literature and Criminology (the way of organizing society, through certain laws and regulations), besides having other similarities (artistic, interpretative and written dimensions), as pointed out by Perez (2006). The way of articulating these proposals is somewhat problematic, because there is no interdisciplinary link that is fully and intellectually elaborated, according to (...) Nelson, Treichler and Grossberg: difficulty that would not allow contextualizing, theorizing and questioning the bases with which we work. For this reason, Cultural Studies would have a necessary functionality: its methodology does not have guarantees on the privilege that is granted to the internal structures of the interdisciplinary. For this, I have developed two guidelines by which that phenomenon could be explained: the literary and criminological approaches. (shrink)

Dr Moriarty shows that far from being timeless and universal, the term 'taste' is culture-specific, shifting according to the needs of a writer and his social group. The notion of (...) 'taste' not only helped to shape a new dominant culture, but also registered the conflicts within that culture between a view of taste that presupposted the values of 'polite society' as an exclusive (though not necessarily aristocratic) group, and a view that stressed the value of the classical-humanist tradition as a source of standards ratified by a broader public. this study sheds light not only on the central concept, but also on the individual authors discussed and on the norms of French classical literature in general. Though not as widely studied as the Research Article, the abstract has attracted increasing interest among researchers over last decades. A number of contrastive or comparative studies of abstracts in English and other languages have already been carried out considering mainly the hard sciences and some soft sciences such as linguistics and history, however no cross-cultural analyses have been conducted so far between RA abstracts in English and RA abstracts in French published in the legal field. This paper seeks to (...) investigate genre variation and changes in frame sequences comparatively in English and French RA abstracts from criminology journals. Using a genre analytical approach to qualitative and quantitative data, the paper reports on two comparable corpora, i.e. English and French, of electronically retrieved abstracts from Criminology Journals published in 2014. The two corpora are composed of three journals per language, namely Criminology, Journal of Criminal Justice, Journal of Criminal Law and Criminology for the English corpus, and Champ Pénal, Criminologie, Revue Canadienne de Droit Pénal et Criminologie for the French corpus. The analysis will be carried out following two main steps, i.e. a macro-analysis and a micro-analysis. In the former step, the corpora are compared by the analysis and discussion of the basic IMRD rhetorical move structure for the RA often proposed in the literature and the additional five moves model postulated by Dos Santos with the aim of investigating the linguistic and rhetorical variation in the abstract genre from a cross-cultural perspective. In the latter, we look at frame sequences combining forms of self-mentions and frame markers, i.e. personal patterns, impersonal patterns and locational patterns. Provisional results show that the abstracts under investigation largely follow the international conventions based on the norms established by the English-speaking international academic community. However, variation across the two cultures emerged from the linguistic realizations of framework sequences. Cross-cultural implications are discussed at the close. (shrink)

The article deals with “bedrock” of criminology (and comparative criminology) as interdisciplinary science. In this article, the systems approach to comparative criminological studies has been defined. The author argues that practically all modern sciences are designed according to systems approach. Analysis of scientific literature enabled the author to state that systems approach was/is applied to the studies of political systems, legal (...) systems, criminal legal systems, criminal justice systems, penitentiary systems, and other systems. Standing out that “systems theory” as one of scientific approaches has made a considerable influence on criminology, the author considers the systems approach in criminology to be hosted and necessary. Considering three basic assumptions of systems approach, the author believes in the existence of “criminological systems”. The author has conducted a profound analysis of “criminological system” from the point of view of “systems theory”. He argues that the definition of criminological system and its features allow getting a general conception of system and the definition of such features on the level of a country allows getting the idea of its “national criminological system”. Also, the author supports the idea of existence of “criminological system” elements, such as “criminological outlook”, “criminological legislation”, “criminological practice”, “criminological security”. The interrelation between the elements of “criminological system” and other systems (and their elements) is discovered. Following linked references across various sites is an electronic version of browsing library stacks, and the serendipitous discoveries made while "surfing the Net" recall the wonders of physically going "book-to-book." Although many of the Internet's best aspects augment library strengths by eliminating physical distance from sources, Net resources pose unique problems for researchers. It is not always clear who is responsible for the content of Web documents, when the document was produced, or how often (if ever) it is updated. Perceptual experience is one of our fundamental sources of epistemic justification—roughly, justification for believing that a proposition is true. The ability of perceptual experience to justify beliefs can nevertheless be questioned. This article focuses on an important challenge that arises from countenancing that perceptual experience is cognitively penetrable. -/- The thesis of cognitive penetrability of perception states that the content of perceptual experience can be influenced by prior or concurrent psychological factors, such as beliefs, fears and desires. Advocates of this (...) thesis could for instance claim that your desire of having a tall daughter might influence your perception, so that she appears to you to be taller than she is. Although cognitive penetrability of perception is a controversial empirical hypothesis, it does not appear implausible. Organised crime is chameleonic in nature. It is transnational, dynamic, overlapped criminal activities and pervasive in nature. In the same way, money laundering is the predicate offence and it is naturally linked to other organised crimes. After the cold war, this nexus culminated during the occurrence of 9/11 in particular which was a lethal combination of money laundering and terrorist financing. This combination is currently being experienced by Pakistan; where various terrorist groups are involved with direct and indirect support of (...) proceeds from drug trafficking, assassination, land grabbing, arms smuggling and various other organised crimes routing through the abusage of financial and non-financial channels and support to terrorism. This has left serious socio-politico and economic consequences in the south Asian region and global as well. The researcher found very limited evidence of money laundering characteristics in the existing research literature on Pakistan. Thus to carry out research work on the subject was need of the hour in Pakistan. In about 700, a century after his death, the Life of Columba was written by Adomnán, ninth abbot of Iona. The 1961 edition of the Life, by Alan and Marjorie Anderson, has long been unavailable. Marjorie Anderson has now revised both the Latin text and the English translation, provided new historical notes, and rewritten the Introduction to take account of recent work in the area. ArgumentIn calling psychoanalysis a “school of suspicion”, Ricoeur marks at once its use in a disposition characteristic of modernity: the disposition of suspicion. Modernity gives rise to various forms of suspicion, to modern forms of ressentiment and practices of disciplining oneself as well as to an epistemology of suspicion. In this essay, I shall analyze the epistemological function of suspicion – which as the “paradigm of clues” becomes the leading paradigm of the human sciences in the last third of the (...) nineteenth century – and its close interrelationship with the techniques of power. As I shall demonstrate through a comparative reading of psychoanalytical, literary, and criminological texts, the modern production of knowledge in the human sciences cannot be separated from the modern “micro-physics of power,” which for Foucault was established in the eighteenth century, and the technologies of the self. I shall situate the paradigm of clues within the framework of the modern disposition of suspicion in order to combine the epistemological reflections with an analysis of cultural history. Thus I will first examine the paradigm of clues from the perspectives of cultural theory and semiotics, in order to illuminate the structural unreliability of the episteme as well as the way it is closely linked to the techniques of power. In what follows, I will apply this view to Bertillon's photographic identification system, the psychoanalytical concept of the trace, and Kafka's short story The Burrow. (shrink)

Freedom of information requests are increasingly used in sociology, criminology and other social science disciplines to examine government practices and processes. University ethical review boards in Canada have not typically subjected researchers’ FOI requests to independent review, although this may be changing in the United Kingdom and Australia, reflective of what Haggerty calls ‘ethics creep’. Here we present four arguments for why FOI requests in the social sciences should not be subject to formal ethical review by ERBs. These four (...) arguments are: existing, rigorous bureaucratic vetting; double jeopardy; infringement of citizenship rights; and unsuitable ethics paradigm. In the discussion, we reflect on the implications of our analysis for literature on ethical review and qualitative research, and for literature on FOI and government transparency. (shrink)

How patients and nurses experience the acute care psychiatric environment The concept of the therapeutic milieu was developed when patients’ hospitalizations were long, medications were few, and one‐to‐one nurse–patient interactions were the norm. However, it is not clear how the notion of ‘therapeutic milieu’ is experienced in American acute psychiatric environments today. This phenomenological study explored the experience of patients and nurses in an acute care psychiatric unit in the USA, by asking them, ‘What stands out to you about this (...) psychiatric hospital environment?’ Three figural themes emerged, contextualized by time, which was a source of stress to both groups: for patients there was boredom, and for nurses, pressure and chaos. Although they shared some themes, nurses and patients experienced them differently. For instance, nurses felt caged‐in by the Plexiglas‐enclosed nursing station, and patients felt caged‐in by the locked doors of the unit. The findings from this US study do not support the existence of the therapeutic milieu as described in the literature. Furthermore, although the nurse–patient relationship was yearned for by nurses, it was nearly absent from patients’ descriptions. The caring experienced by patients was mainly derived from interactions with other patients. (shrink)

Throughout his mature writings, Berkeley speaks of minds as substances that underlie or support ideas. After initially flirting with a Humean account, according to which minds are nothing but ‘congeries of Perceptions’, Berkeley went on to claim that a mind is a ‘perceiving, active being... entirely distinct’ from its ideas. Despite his immaterialism, Berkeley retains the traditional category of substance and gives it pride of place in his ontology. Ideas, by contrast, are ‘fleeting and dependent beings’ that must be supported (...) by a mental substance. There is no doubt that Berkeley’s conception of the relationship between minds and ideas is non-traditional, but that fact does not undercut his commitment to the traditional conception of substance. A robust literature has grown up around the thorny issue of reconciling Berkeley’s endorsement of mental substance with his rejection of its material counterpart. (shrink)

We aimed to identify the critical insights from empirical peer-reviewed studies on online romance fraud published between 2000 and 2021 through a systematic literature review using the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) protocol. The corpus of studies that met our inclusion criteria comprised twenty-six studies employing qualitative (n = 13), quantitative (n = 11), and mixed (n = 2) methods. Most studies focused on victims, with eight focusing on offenders and fewer investigating public perspectives. All (...) the victim-focused studies relied on data from the Global North, except for Malaysia. Five offender-focused studies used online data available in the public domain, and three derived their data from West Africa. Our review highlights offenders' techniques to deceive and manipulate victims, as revealed in these studies, and highlights some limitations of offender- and victim-focused studies. The dominant framework used across the studies was found to be the “Scammers Persuasive Techniques Model.” While this framework provides a helpful way of considering the stages of victim involvement, it also faces some limitations, which we highlight. Our study reviews the current state of empirical knowledge on romance fraud and identifies certain gaps and biases in the literature. We argue there is a need for further research into online romance fraud to enhance our understanding of it both from the perspective of the offender as well as the experience of the victim. We also highlight the need for a more inclusive and greater range of regional and global diverse range of data sources and perspectives. Given the scale and impact of online romance fraud, we conclude that its study would benefit from a richer empirical engagement that recognizes it as both a regional and global phenomenon. (shrink)

Public criminology is concerned with public understandings of crime and policing and public discussions of such matters by criminologists and allied social scientists. For the purposes of this paper, these professionals are individuals identified by journalists on the basis of academic credentials or university affiliation as those who can speak to crime matters. This qualitative study investigates media statements made by criminologists and allied social scientists following the 2020 murder of George Floyd with two questions in mind: How have (...) they responded to debates over reforming, defunding, and abolishing police? What insight can these responses provide about public criminology more generally? I analyze statements offered by criminologists in news reports and on Twitter using Qualitative Media Analysis, an approach that emphasizes the processes through which discourse is presented to audiences. I argue that recent criminological debates in the media concerning the future of policing have exposed unresolvable tensions among scholars who engage in the practice of public criminology, suggesting that the public is not receiving coherent, authoritative messages about these issues. The findings also raise questions about public criminology and illuminate new concerns regarding scholarly expertise related to knowledge claims and credibility relative to social justice. (shrink)

Emotional AI is an emerging technology used to make probabilistic predictions about the emotional states of people using data sources, such as facial (micro)-movements, body language, vocal tone or the choice of words. The performance of such systems is heavily debated and so are the underlying scientific methods that serve as the basis for many such technologies. In this article I will engage with this new technology, and with the debates and literature that surround it. Working at the intersection (...) of criminology, policing, surveillance and the study of emotional AI this paper explores and offers a framework of understanding the various issues that these technologies present particularly to liberal democracies. I argue that these technologies should not be deployed within public spaces because there is only a very weak evidence-base as to their effectiveness in a policing and security context, and even more importantly represent a major intrusion to people’s private lives and also represent a worrying extension of policing power because of the possibility that intentions and attitudes may be inferred. Further to this, the danger in the use of such invasive surveillance for the purpose of policing and crime prevention in urban spaces is that it potentially leads to a highly regulated and control-oriented society. I argue that emotion recognition has severe impacts on the right to the city by not only undertaking surveillance of existing situations but also making inferences and probabilistic predictions about future events as well as emotions and intentions. How did the events of the early modern period affect the way gender and the self were represented? This article is a theoretical treatment of feminist epistemology of crime, which advocates the centrality of gender as a theoretical starting point for the investigating of digital crimes. It does so by exploring the synergy between the feminist perspectives and the Tripartite Cybercrime Framework (TCF) (which argues that three possible factors motivate cybercrimes – socioeconomic, psychosocial, and geopolitical) to critique mainstream criminology and the meaning of the term “cybercrime”. Additionally, the article examines gender gaps in online harassment, cyber‐bullying, cyber‐fraud, (...) revenge porn, and cyber‐stalking to demonstrate that who is victimised, why, and to what effect are the critical starting points for the analysis of the connections between gender and crimes. In turn, it uses the lens of intersectionality to acknowledge that, while conceptions of gender and crime interact, they intersect with other categories (e.g., sexuality) to provide additional layers of explanation. To nuance the utilitarian value of the synergy between the TCF and the feminist perspectives, the focus shifts to a recent case study (which compared socioeconomic and psychosocial cybercrimes). The article concludes that, while online and offline lives are inextricably intertwined, the victimisations in psychosocial cybercrimes may be more gendered than in socioeconomic cybercrimes. These contributions align the TCF to the feminist epistemology of crime in their attempt to move gender analysis of digital crimes “from margin to centre”. (shrink)

Abstract:In the spirit of green cultural criminology, which considers the way(s) in which environmental crime, harm, and disaster are constructed, represented, and envisioned by the news media and in popular cultural forms, and narrative criminology, which explores how stories can influence (promote, curb, prevent, or resist) action, including harmful action, this provisional article seeks to intercede (although, perhaps, “intervene,” in the McGregorian sense, is more accurate) in the debate, of sorts, between the Indian writer Amitav Ghosh and the (...) British critic, editor, and theorist Mark Bould. Whereas Ghosh, in The Great Derangement: Climate Change and the Unthinkable (2016), laments the failure of contemporary literature to engage with climate change, Bould, in The Anthropocene Unconscious: Climate Catastrophe Culture (2021), considers whether all stories might be stories about climate change. Taking Salman Rush-die’s Haroun and the Sea of Stories (1990) as an example, this article argues that this phantasmagorical tale about the problems of censorship could be applied to and analyzed in the context of climate change. The article considers how we might tell (more, better) stories of climate change and concludes by calling for a marshalling of diverse stories to reflect the most pressing issue of our time. Since antiquity two different negations in natural languages have been noted: predicate negation (not honest) and predicate term negation (dishonest). The extensive literature offers no models. We propose category-theoretic models with two distinct negation operators, neither of them in general Boolean. We study combinations of the two (not dishonest) and sentential counterparts of each. We emphasize the relevance of our work for the theory of cognition.

Few issues bedevil criminology and criminal justice as much as free will versus determinism. It goes to the heart of the character of the people they deal with and how we should respond to them. People are held morally responsible for what they do only if we believe that they have the ability to make reasoned choices to act morally. Liberals tend to hold an external locus of control and are skeptical of free will, and conservatives tend to favor (...) an internal locus of control and embrace free will. This liberal-conservative divide reveals itself in the theories they favor as the best explanations of criminal behavior. Liberals favor explanations external to criminals such as an unfair economic system or criminal justice bias; conservatives tend to favor internal explanations such as low self-control or lack of empathy. In terms of responding to criminal behavior, there have been calls to abandon the idea of punishment and abolish prisons. Liberals may tend to view this as humanitarian while conservatives will tend to view them as incredibly naïve. The greater tendency of liberals to hold an external locus of control and their skepticism about free will lead them to view people's behavior as largely beyond their control, which accounts for their punishment abolitionist stance. The greater tendency of conservatives to believe in free will and an internal locus of control leads to a more punitive stance toward criminals. Many issues that divide liberals and conservatives in criminology-criminal justice may be traced to their beliefs about free will and determinism. (shrink)

In this article we describe our approach to understanding wrongdoing in medical research and practice, which involves the statistical analysis of coded data from a large set of published cases. We focus on understanding the environmental factors that predict the kind and the severity of wrongdoing in medicine. Through review of empirical and theoretical literature, consultation with experts, the application of criminological theory, and ongoing analysis of our first 60 cases, we hypothesize that 10 contextual features of the medical (...) environment (including financial rewards, oversight failures, and patients belonging to vulnerable groups) may contribute to professional wrongdoing. We define each variable, examine data supporting our hypothesis, and present a brief case synopsis from our study that illustrates the potential influence of the variable. Finally, we discuss limitations of the resulting framework and directions for future research. (shrink)

Plato's rhetorical gesture invoking a 'quarrel' between philosophy and poetry points to a deep problem in our conception of rational discourse, often obscured or displaced in the history of philosophy's relations with imaginative literature, especially with respect to analytic philosophy in the first half of the twentieth century. Recent developments have helped focus attention on the overlap between philosophy and literature, which the contemporary retreat from philosophy's 'narrative turn' does little to undermine. Further work in the philosophy of (...) language, the logic of the imagination, and the relations between dialectic and rhetoric promise to throw light on that ancient problem. (shrink)

Resumen La literatura universal, se encuentra poblada de arquetípicos que comparten una condición de desamparo y marginalidad, siendo la literatura realista de la segunda mitad del siglo XIX la que constata y da cuenta de su condición. En un mismo sentido, también la Biblia presenta un sinnúmero de personajes similares, marcando un punto de inflexión al llamarlo bienaventurados. Así pues, el presente estudio bíblico-literario, se centra en el arquetipo de la “viuda pobre”, sosteniendo dicha ficción literaria es una clave interpretativa (...) de la realidad, a la luz de la teoría literaria de la Estética de la Recepción. El articulo estudia la “viuda pobre” como un imaginario cultural y estableciendo la recepción de dicho imaginario en los cuentos “El Chiflón del diablo” y “El pago” del escritor chileno Baldomero Lillo, demostrando cómo el dialogo entre cultura y Biblia representa un aporte a la comprensión de determinadas ficciones literarias como categorías antropológicas.Universal literature is crowded by archetypical characters who share abandonment and marginalization conditions, being second half 19,h century realistic literature that confirms and exposes those conditions. In that sense, The Holy Bible presents a number of those characters. Resides, it highlights a turning point, hence, The Beatitudes point out: “Blessed are the poor in spirit, for theirs is the kingdom of heaven”. Thus, the following biblical-literary study, centered in the “Poor widow” archetype, aims to the establishment of literary fiction as interpretative key of reality, under Wolfgang Iser Aesthetics Reception's theory as its methodology. The objective aims to postulate “Poor Widow” as a Cultural imaginary, and finally to establish the reception of that imaginary within the stories “El Chiflón del Diablo” and “El Pago” by the chilean writer Baldomero Lillo, demonstrating that the dialog between culture and The Holy Bible represents a contribution to some literary fiction s as anthropological categories.
