Oakeshott, Hayek and Schmitt are associated with a conservative reaction to the 'progressive' forces of the twentieth century. Each was an acute analyst of the juristic form of the modern state and the relationship of that form to the idea of liberty under a system of public, general law. Hayek had the highest regard for Schmitt's understanding of the rule of law state despite Schmitt's hostility to it, and he owed the distinction he drew in his own work between a (...) purpose-governed form of state and a law-governed form to Oakeshott. However, the three have until now rarely been considered together, something which will be ever more apparent as political theorists, lawyers and theorists of international relations turn to the foundational texts of twentieth-century thought at a time when debate about liberal democratic theory might appear to have run out of steam. This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Koonin argues that CRISPR-Cas systems present the best-known case in point for Lamarckian evolution because they satisfy his proposed criteria for the specific inheritance of acquired adaptive characteristics. We see two interrelated issues with Koonin’s characterization of CRISPR-Cas systems as Lamarckian. First, at times he appears to confuse an account of the CRISPR-Cas system with an account of the mechanism it employs. We argue there is no evidence for the CRISPR-Cas system being “Lamarckian” in any sense. Second, it is unclear (...) whether the mechanism is more “Lamarckian” than many other forms of genetic change already well-characterized in Darwinian terms. We present three conceptually distinct senses in which the mechanism of IAC may be considered Lamarckian and argue that only the strongest sense of goal-directed IAC would be difficult to accommodate in a Darwinian account. As the CRISPR-Cas mechanism does not qualify as “Lamarckian” in this strong sense, we argue there is no conceptual value in calling it “Lamarckian”. Finally, we suggest that CRISPR-Cas systems do hold the potential for genuinely non-Darwinian, directed evolution in a way that Koonin did not discuss, involving their potential use as a human gene-editing tool. Numerous scenarios explain the origin of the eukaryote cell by fusion or endosymbiosis between an archaeon and a bacterium (and sometimes a third partner). We evaluate these hypotheses using the following three criteria. Can the data be explained by the null hypothesis that new features arise sequentially along a stem lineage? Second, hypotheses involving an archaeon and a bacterium should undergo standard phylogenetic tests of gene distribution. Third, accounting for past events by processes observed in modern cells is preferable to (...) postulating unknown processes that have never been observed. For example, there are many eukaryote examples of bacteria as endosymbionts or endoparasites, but none known in archaea. Strictly post‐hoc hypotheses that ignore this third criterion should be avoided. Applying these three criteria significantly narrows the number of plausible hypotheses. Given current knowledge, our conclusion is that the eukaryote lineage must have diverged from an ancestor of archaea well prior to the origin of the mitochondrion. Significantly, the absence of ancestrally amitochondriate eukaryotes (archezoa) among extant eukaryotes is neither evidence for an archaeal host for the ancestor of mitochondria, nor evidence against a eukaryotic host. Prokaryotes are generally assumed to be the oldest existing form of life on earth. This assumption, however, makes it difficult to understand certain aspects of the transition from earlier stages in the origin of life to more complex ones, and it does not account for many apparently ancient features in the eukaryotes. From a model of the RNA world, based on relic RNA species in modern organisms, one can infer that there was an absolute requirement for a high-accuracy RNA replicase (...) even before proteins evolved. In addition, we argue here that the ribosome (together with the RNAs involved in its assembly) is so large that it must have had a prior function before protein synthesis. A model that connects and equates these two requirements (high-accuracy RNA replicase and prior function of the ribosome) can explain many steps in the origin of life while accounting for the observation that eukaryotes have retained more vestiges of the RNA world. The later derivation of prokaryote RNA metabolism and genome structure can be accounted for by the two complementary mechanisms of r-selection and thermoreduction. This paper discusses the idea of forming a patent pool in order to address some of the licensing problems in the biotechnology industry. The pool would be an independent, non-profit corporation that would manage patents and have the authority to grant licenses. The patent pool would not be a purely altruistic venture, since it would charge licensing fees. The pool would charge the market price for licensing services and reimburse patent holders for licensing activities. The pool would also provide patent (...) holders with a minimum income based on a percentage of royalties generated from the pool. The pool would include patents on a variety of materials and methods that play an important role in biotechnology. The persistent pervasiveness of inappropriately small studies in empirical fields is regu-larly deplored in scientific discussions. Consensually, taken individually, higher-powered studies are more likely to be truth-conducive. However, are they also beneficial for the wider performance of truth-seeking communities? We study the impact of sample sizes on collective exploration dynamics under ordinary conditions of resource limita-tion. We find that large collaborative studies, because they decrease diversity, can have detrimental effects in certain realistic circumstances that we characterize precisely. We show how (...) limited inertia mechanisms may partially solve this pooling dilemma and dis-cuss our findings briefly in terms of editorial policies. (shrink)

In a previous paper we developed a general theory of input/output logics. These are operations resembling inference, but where inputs need not be included among outputs, and outputs need not be reusable as inputs. In the present paper we study what happens when they are constrained to render output consistent with input. This is of interest for deontic logic, where it provides a manner of handling contrary-to-duty obligations. Our procedure is to constrain the set of generators of the input/output system, (...) considering only the maximal subsets that do not yield output conflicting with a given input. When inputs are authorised to reappear as outputs, both maxichoice revision in the sense of Alchourr6n/Makinson and the default logic of Poole emerge as special cases, and there is a close relation with Reiter default logic. However, our focus is on the general case where inputs need not be outputs. We show in what contexts the consistency of input with output may be reduced to its consistency with a truth-functional combination of components of generators, and under what conditions constrained output may be obtained by a derivation that is constrained at every step. For centuries, the processes of social differentiation associated with Modernity have often been thought to intensify the need for site-specific forms of role training and knowledge production, threatening the university’s survival either through fragmentation or through failure to adapt. Other lines of argument emphasize the extent to which the Modern system creates and relies on an integrated knowledge system, but most of the literature stresses functional differentiation and putative threats to the university. And yet over this period the university has (...) flourished. In our view, this seeming paradox is explained by the fact that modern society rests as much on universalistic cosmological bases as it does on differentiation. The university expands over recent centuries because – as it has from its religious origins – it casts cultural and human materials in universalistic terms. Our view helps explain empirical phenomena that confound standard accounts: the university’s extraordinary expansion and global diffusion, its curricular and structural isomorphism, and its relatively unified structure. All of this holds increasingly true after World War II, as national state societies made up of citizens are increasingly embedded in a world society constituted of empowered individuals. The redefinition of society in global and individual terms reduces nationally bounded models of nature and culture, extends the pool of university beneficiaries and investigators, and empowers the human persons who are understood to root it all. The changes intensify universalization and the university’s rate of worldwide growth. For the university’s knowledge and “knowers,” and for the pedagogy that joins them together, the implications are many. The emerging societal context intensifies longstanding processes of cultural rationalization and ontological elaboration, yielding great expansions in what can and should be known, and in who can and should know. These changes in turn alter the menu of approved techniques for joining knowledge and knower as one. The “knowledge society” that results is distinguished by the extraordinary degree to which the university is linked to society. But it is also distinguished by the degree to which society is organized around the university’s abstracted and universalized understandings of the world and its degree-certified graduates. (shrink)

Existing accounts of shared intention (by Bratman, Searle, and others) do not claim that a single token of intention can be jointly framed and executed by multiple agents; rather, they claim that multiple agents can frame distinct, individual intentions in such a way as to qualify as jointly intending something. In this respect, the existing accounts do not show that intentions can be shared in any literal sense. This article argues that, in failing to show how intentions can be literally (...) shared, these accounts fail to resolve what seems problematic in the notion of shared intention. It then offers an account in which the problem of shared intention is resolved, because intention can indeed be literally shared. This account is derived from Margaret Gilbert’s notion of a “pool of wills,” to which it applies Searle’s definition of intention. (shrink)

Numerous accounting and economics research studies employ an experimental research method requiring student participants to make representations about an individual characteristic (e.g., ability, cost) that provides a basis for payment of cash rewards. In response, many participants intentionally misrepresent the nature of that characteristic to receive a greater reward. Typically, such studies are deemed to be either exempt from review by institutional review boards (IRBs) or subject only to an expedited review. Moreover, investigators seldom debrief participants, purportedly to avoid contamination (...) of the participant pool. The authors question the ethics of inducing strategic misrepresentation and rewarding fraudulent behavior without appropriate debriefing. A theoretical framework of cognitive ethical development indicates that such research methods can be harmful to student participants. Furthermore, principles of operant conditioning suggest that the rewards reinforce fraudulent behavior. It is recommended that research studies inducing strategic misrepresentation should not be exempt from IRB review and should be required to include desensitization procedures for debriefing participants. We present an abstract social aggregation theorem. Society, and each individual, has a preorder that may be interpreted as expressing values or beliefs. The preorders are allowed to violate both completeness and continuity, and the population is allowed to be infinite. The preorders are only assumed to be represented by functions with values in partially ordered vector spaces, and whose product has convex range. This includes all preorders that satisfy strong independence. Any Pareto indifferent social preorder is then shown to (...) be represented by a linear transformation of the representations of the individual preorders. Further Pareto conditions on the social preorder correspond to positivity conditions on the transformation. When all the Pareto conditions hold and the population is finite, the social preorder is represented by a sum of individual preorder representations. We provide two applications. Certainly, whatever the other reasons, it was the availability of the latter that allowed us to give a particularly prominent representation of Puerto Ricans in the 1994 Latin American Writers on Gay and Lesbian Themes: A Bio-Critical Sourcebook.Let me underscore from the outset that La Fountain-Stokes's point of reference is the extensive representation of Puerto Rican queers in American society, a large majority of whom write in English, work with U.S.-based institutions, and publish in English-language and U.S.-based forums. While some may move back and forth between the mainland and the island and publish in Spanish outside the mainland (in Puerto Rico or elsewhere), the emphasis of his study is on Puerto Rican queers in the U.S. Indeed, as La Fountain-Stokes articulates at the outset of his study, his purpose is to overcome the elision of sexuality in examinations of mainland-island patterns of migration [End Page 66] and to "transform Puerto Rican migration studies paradigms by showing how attitudes toward stigmatized forms of same-sex sexuality and gender variance provoke and affect migration, and how artists, writers, filmmakers, dancers, choreographers, and performers have documented and discussed this fact" (ix).La Fountain-Stokes, who is himself a highly accomplished queer Puerto Rican writer and a scholar with well-established credentials in the field, makes use of a range of three theoretical perspectives in organizing this study: (1) the sociohistorical question of migratory patterns between the U.S. mainland and the island of Puerto Rico, a question that has mostly been cast in political and economic terms, but which the author insists must be revised in terms of an inventory of sexualities and sexual identities that are exercised and performed in terms of the differences between life in one or another locale and, one might add, in terms of the experience of life in the United States in differing locales; (2) the question of theorizing sexuality, particularly the axis/continuum between heterosexual and nonheterosexual and the continuum between different and differing instantiations of the nonheterosexual, but primarily between gay and queer; and (3) theoretical postulates relating to queerness that may or may not intersect and collide with matters of national and/or ethnic identity. The very phrase "queer [Puerto] Ricans" is structurally ambiguous: are we talking about Puerto Ricans who are queer (as opposed to Puerto Ricans who are not queer, a restrictive qualification), or are we talking about all Puerto Ricans, one of whose characteristics is that they are queer, an extensive qualification)? Commentaries on our target article raise further questions about the validity of an undifferentiated central executive that supplies resources to all verbal tasks. Working memory tasks are more likely to measure divided attention capacities and the efficiency of performing tasks within specific domains than a shared resource pool. In our response to the commentaries, we review and further expand upon empirical findings that relate performance on working memory tasks to sentence processing, concluding that our view that the two are not (...) strongly related remains viable in light of the material presented in the commentaries. We suggest that a productive research enterprise would be to develop the concept of working memory as a pool of resources in relation to specific tasks. (shrink)

USING QUALITATIVE INTERVIEWS AT CATHOLIC AND JEWISH HOSPITAL organizations, this essay contrasts the market-driven reforms of consumer-directed health care and physician entrepreneurship with the mission-driven structures of religious nonprofits. A structural analysis of values in health care makes a convoluted system more transparent. It also demonstrates the limitations of market reforms to the extent that they erode organizational structures of solidarity, which are needed to pool risks, shift costs, and maintain safety nets in a complex and expensive health economy.

In some applications, researchers using the synthetic control method (SCM) to evaluate the effect of a policy may struggle to determine whether they have identified a “good match” between the control group and treated group. In this paper, we demonstrate the utility of the mean and maximum Absolute Standardized Mean Difference (ASMD) as a test of balance between a synthetic control unit and treated unit, and provide guidance on what constitutes a poor fit when using a synthetic control. We explore (...) and compare other potential metrics using a simulation study. We provide an application of our proposed balance metric to the 2013 Los Angeles (LA) Firearm Study [9]. Using Uniform Crime Report data, we apply the SCM to obtain a counterfactual for the LA firearm-related crime rate based on a weighted combination of control units in a donor pool of cities. We use this counterfactual to estimate the effect of the LA Firearm Study intervention and explore the impact of changing the donor pool and pre-intervention duration period on resulting matches and estimated effects. We demonstrate how decision-making about the quality of a synthetic control can be improved by using ASMD. The mean and max ASMD clearly differentiate between poor matches and good matches. Researchers need better guidance on what is a meaningful imbalance between synthetic control and treated groups. In addition to the use of gap plots, the proposed balance metric can provide an objective way of determining fit. (shrink)

Data Transfer Service (DTS) is an open-source project that is developing a document-centric message model for describing a bulk data transfer activity, with an accompanying set of loosely coupled and platform-independent components for brokering the transfer of data between a wide range of (potentially incompatible) storage resources as scheduled, fault-tolerant batch jobs. The architecture scales from small embedded deployments on a single computer to large distributed deployments through an expandable ‘worker-node pool’ controlled through message-orientated middleware. Data access and transfer efficiency (...) are maximized through the strategic placement of worker nodes at or between particular data sources/sinks. The design is inherently asynchronous, and, when third-party transfer is not available, it side-steps the bandwidth, concurrency and scalability limitations associated with buffering bytes directly through intermediary client applications. It aims to address geographical–topological deployment concerns by allowing service hosting to be either centralized (as part of a shared service) or confined to a single institution or domain. Established design patterns and open-source components are coupled with a proposal for a document-centric and open-standards-based messaging protocol. As part of the development of the message protocol, a bulk data copy activity document is proposed for the first time. (shrink)

The levels of selection problem is no easier to handle at the gene-organism interface than at the organism-society interface. The unity of the genotype is just as problematic as the cohesiveness of the gene pool. One distinction which helps to reduce confusion is between replicators and interactors. On the one hand those who dream the dream of unencumbered selfhood are said to be locked in a bitter struggle with those who long for the rebirth (...) of encumbering community. On the other hand and in a not wholly unrelated way, Kantians are supposedly and forever beating back the phoenix of consequentialism. In short, the tyrannizing dualisms of individualism vs. communitarianism and Kantianism vs. consequentialism allegedly and detrimentally channel much modern liberal theorizing.But such rivalries, however real or fanciful, need not be philosophical liberalism’s singular fate. Nor do these rivalries exclusively characterize its variegated past. My aim is to challenge the cogency and expose the historical limitations of one of these tyrannizing dualisms, namely that between Kantianism and consequentialism, by way of examining L. T. Hobhouses’s new liberalism. In my view this seeming rivalry within liberalism is a convenient straw man readily weakened by more scrupulous attention to liberalism’s new liberal past. 1 [End Page 487]Principally, I hope to show that Hobhouse’s rendering of liberalism privileged good but not at the price of stultifying welfare pooling, individuality but not at the cost of pitiless individualism. Hobhouse’s version of new liberalism may not have been quite utilitarian, but it nevertheless took maximizing good seriously while retaining a firm commitment to strong moral rights and the flourishing of individuals as ends. Hobhouse’s new liberalism, then, was as robustly juridical and as authentically liberal as it was fundamentally consequentialist.The Rational Good and Moral PersonalitySelf-realization was the normative hinge of Hobhouse’s new liberalism. Self-realization, in turn, can not be understood without examining Hobhouse’s notion of the rational good. Hence, The Rational Good, published later in his life in 1921, occupies a vital position in his thought though recent scholarship has all but ignored this work. 2In this work Hobhouse begins by asking “whether there is a Rational, and therefore demonstrable, standard of values to which the actions of man and the institutions of society may be referred for judgment.” 3 For Hobhouse, such a standard exits and the remainder of the book endeavors to persuade us accordingly.In a chapter entitled “The Good,” Hobhouse claims that the proposition that something is good expresses a “disposition” and asserts a “fact.” The disposition consists of a favorable “practical attitude” towards pleasurable feelings, which certain (self-realizing) experiences invariably entail. In Hobhouse’s words “the judgment ‘This is good’ is not only the expression of an attitude but also the assertion of a fact, and the fact which it asserts is a harmony between an experience and a feeling.” 4 Hence, we deem good only those self-realizing experiences that are harmonious in the sense that they generate feelings of pleasure. A pleasure-producing experience is a harmonious experience and, assuming that it is also self-realizing, we are disposed to pronounce it “good.”Now separate harmonious experiences, unless rationally coordinated, will likely clash, thereby generating overall disharmony or pain. Experiences which we separately judge as good may turn out to be bad on the whole. A good life, therefore, is a satisfying coherent life. Only a rationally coherent life is fully self-realizing and constitutes the rational good. In short “that what we reasonably call good or what is really good must be a harmony of the [End Page 488] totality of feeling with the totality of experience so far as it affects feeling. This is a response essay to Donald Hatcher’s, “Critical Thinking Instruction: A Realistic Evaluation: The Dream vs. Reality.” Hatcher argues that critical thinking instruction seriously falls short of the ideal of honestly evaluating alternative evidence and arguments. This failure is apparent, he argues, when one surveys student performance on a variety of CT assessment tests. Hatcher reviews the current CT assessment data, which includes an extensive pool of results collected from Baker University where Hatcher oversaw a sophisticated and well-funded CT (...) program for about two decades. Hatcher also argues that evidence from the philosophical and psychological literatures on disagreement and judgment suggests even CT experts fail to model the ideal and that CT has suffered from an unrealistic conception of rationality and human decision-making. I reply by arguing that, by putting the CT assessment data in a different context and asking an alternative set of questions, one can justifiably derive a more positive evaluation of the future of CT instruction in light of the CT ideal. Instead of focusing on whether students are achieving the CT ideal by the time of the post-test, instructors should ask whether they are making the kind of progress that there is good reason to expect. I close by challenging the soundness of the proposed implications of Hatcher’s arguments. (shrink)

Leibniz’s De incerti aestimatione, which contains his solution to the division problem, has not received much attention, let alone much appreciation. This is surprising because it is in this work that the definition of probability in terms of equally possible cases appears for the first time. The division problem is used to establish and test probability theory; it can be stated as follows: if two players agree to play a game in which one has to win a certain number of (...) rounds in order to win the pool, but if they break the game off before either of them has won the required number of rounds, how should the pool be distributed?Our article has two aims: it provides the readers with the first published English translation of De incerti aestimatione, and it also gives them a brief commentary that explains Leibniz’s philosophical and mathematical concepts necessary in order to understand this work. The translation is as literal as possible throughout; it shows how Leibniz struggled at times to find a solution to the division problem and how he approached it from different angles. The commentary discusses Leibniz’s views on four key concepts: fairness, hope, authority and possibility. The commentary then outlines how Leibniz attempted to solve the problem of division. Entrepreneurs of contested commodities often face stakeholders engaged in market excluding boundary work driven by ethical considerations. For example, the conversion of academic scientific knowledge into technologies that can be owned and sold is a growing global trend and key stakeholders have different ethical responses to this contested commodity. Commercialization of science can be viewed as a good thing because people believe it bolsters economic growth and broadly benefits society. Others view it as bad because they believe it discourages basic (...) research that ought to be freely shared without concern for profit. Taking a descriptive sociological approach, we posit that the stance of a religious tradition toward capitalism will help shape individual scientists’ views on science commercialization and test whether the religious tradition of scientists correlates with their attitude toward the commercialization of science. To maximize variance on the religious tradition dimension, we analyze pooled data from a cross-national survey of university biologists and physicists encompassing France, Hong Kong, India, Italy, Taiwan, Turkey, UK and the USA. We indeed find religious tradition differences. Hindus and scientists with no religious tradition are more likely to agree that commercialization of science “harms a university’s commitment to knowledge production” than Protestants. We end with a discussion on business ethics and the moral limits of the market as well as implications for entrepreneurs of contested commodities. (shrink)

Numerous accounting and economics research studies employ an experimental research method requiring student participants to make representations about an individual characteristic (e.g., ability, cost) that provides a basis for payment of cash rewards. In response, many participants intentionally misrepresent the nature of that characteristic to receive a greater reward. Typically, such studies are deemed to be either exempt from review by institutional review boards (IRBs) or subject only to an expedited review. Moreover, investigators seldom debrief participants, purportedly to avoid contamination (...) of the participant pool. The authors question the ethics of inducing strategic misrepresentation and rewarding fraudulent behavior without appropriate debriefing. A theoretical framework of cognitive ethical development indicates that such research methods can be harmful to student participants. Furthermore, principles of operant conditioning suggest that the rewards reinforce fraudulent behavior. It is recommended that research studies inducing strategic misrepresentation should not be exempt from IRB review and should be required to include desensitization procedures for debriefing participants. The Dimensions of Spirituality Inventory (DSI) is a 50-item quantitative assessment of spirituality. Whereas “spirituality” has seemed to some to be too vague for research purposes, the DSI follows earlier qualitative research in showing that usage of the word points to an intelligible conceptual structure. Instead of defining spirituality and then operationalizing it, as most extant instruments do, the DSI defines and operationalizes 21 relatively uncontroversial elemental components of spirituality, so the overall interpretation of spirituality can only emerge after factor (...) analysis. Just as an alphabet flexibly expresses words and sentences, so the 21 DSI dimensions permit the discovery of latent constructs corresponding to cultural packages of spirituality at the present time. The DSI avoids culturally parochial formulations of items, thanks to intense multidisciplinary engagement among social scientists, scholars of religion, and psychologists of religion, and thus is suitable for cross-cultural application. This paper reports on a study based on a participant pool recruited for ExploringMyReligion.org, in part from Prolific (N = 820, after culling unreliable responses). The DSI is interpreted and validated in relation to several other relevant measures, and the factor analysis is strongly resonant with prior qualitative studies. The psychometric properties of the DSI make it usable as an overall spirituality scale as well as a sensitive inventory of types and configurations of spirituality. (shrink)

Background Non-adherence to medication is associated with increased risk of relapse in patients with bipolar disorder. Objectives To validate patient-evaluated adherence to medication measured via smartphones against validated adherence questionnaire; and investigate characteristics for adherence to medication measured via smartphones. Methods Patients with BD evaluated adherence to medication daily for 6–9 months via smartphones. The Medication Adherence Rating Scale and the Rogers’ Empowerment questionnaires were filled out. The 17-item Hamilton Depression Rating Scale, the Young Mania Rating Scale and the Functional (...) Assessment Short Test were clinically rated. Data were collected multiple times per patient. The present study represents exploratory pooled reanalyses of data collected as part of two randomised controlled trials. Findings During the study 90.50% of the days were evaluated as ‘medication taken’, 6.91% as ‘medication taken with changes’ and 2.59% as ‘medication not taken’. Adherence to medication measured via smartphones was valid compared with the MARS. Younger age and longer illness duration were significant predictors for non-adherence to medication. Decreased affective symptoms measured with smartphone-based patient-reported mood and clinical ratings as well as decreased empowerment were associated with non-adherence. Conclusions Smartphone-based monitoring of adherence to medication was valid compared with validated adherence questionnaire. Younger age and longer illness duration were predictors for non-adherence. Increased empowerment was associated with adherence. Clinical implications Using smartphones for empowerment of adherence using patient-reported measures may be helpful in everyday clinical settings. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Due to constraints on institutional capacity and financial resources, the road to universal health coverage (UHC) involves difficult policy choices. To assist with these choices, scholars and policy makers have done extensive work on criteria to assess the substantive fairness of health financing policies: their impact on the distribution of rights, duties, benefits and burdens on the path towards UHC. However, less attention has been paid to the procedural fairness of health financing decisions. The Accountability for Reasonableness Framework (A4R), which (...) is widely applied to assess procedural fairness, has primarily been used in priority-setting for purchasing decisions, with revenue mobilization and pooling receiving limited attention. Furthermore, the sufficiency of the A4R framework’s four criteria (publicity, relevance, revisions and appeals, and enforcement) has been questioned. Moreover, research in political theory and public administration (including deliberative democracy), public finance, environmental management, psychology, and health financing has examined the key features of procedural fairness, but these insights have not been synthesized into a comprehensive set of criteria for fair decision-making processes in health financing. A systematic study of how these criteria have been applied in decision-making situations related to health financing and in other areas is also lacking. This paper addresses these gaps through a scoping review. It argues that the literature across many disciplines can be synthesized into 10 core criteria with common philosophical foundations. These go beyond A4R and encompass equality, impartiality, consistency over time, reason-giving, transparency, accuracy of information, participation, inclusiveness, revisability and enforcement. These criteria can be used to evaluate and guide decision-making processes for financing UHC across different country income levels and health financing arrangements. The review also presents examples of how these criteria have been applied to decisions in health financing and other sectors. (shrink)

The ICD-11 personality disorder model is the first fully dimensional assessment of personality pathology. It consists of a personality disorder dysfunction-severity dimension, which encompasses both self- and interpersonal dysfunction, and six optional qualifiers for five prominent personality traits—Negative Affectivity, Detachment, Dissociality, Disinhibition, and Anankastia —plus a borderline pattern that is defined by the criteria of DSM-IV borderline PD. This article reports on the development of a new self-report measure to assess self- and interpersonal dysfunction and the five trait qualifiers. It (...) is the first comprehensive measure of the ICD-11 PD model in that it is the only one to include both PD dysfunction-severity as well as trait scales and because it is based on the Clinical Description and Diagnostic Guidelines, which are more detailed than the “statistical” model description that is currently on the ICD-11 website. The authors wrote 992 items and then reduced the pool to 300 items by eliminating redundancy and selecting the consensus best few items for each subconstruct. Data were collected using an online sample of 383 Prolific workers. Using exploratory factor analysis, seven domain scales were developed, each of which contained two to four scales assessing components of the domain. These preliminary scales’ psychometrics were excellent, as were the domains’ and their components’ convergent and discriminant validity, with a few generally minor exceptions. Structural analyses at the component level revealed a three-factor structure consisting of two moderately correlated Internalizing factors, one centered on Self Dysfunction with two NA components and a DSN component and the other on Interpersonal Dysfunction with DET and ANK components; as well as an Externalizing factor with DSL and a DSN component that was uncorrelated with the other two factors. Two aspects of the results in particular are striking: ANK was not the opposite end of a DSN dimension, but rather contributed to an Internalizing Interpersonal Dysfunction dimension and DSN had both an Internalizing and an Externalizing component. We propose an alternative resolution of Simpson's paradox in multiple classification experiments, using a different maximum likelihood estimator. In the center of our analysis is a formal representation of free choice and randomization that is based on the notion of incompatible measurements.We first introduce a representation of incompatible measurements as a collection of sets of outcomes. This leads to a natural generalization of Kolmogoroff's axioms of probability. We then discuss the existence and uniqueness of the maximum likelihood estimator for a (...) probability weight on such a generalized sample space, given absolute frequency data.As a first example, we discuss an estimation problem with censured data that classically admits only biased ad hoc estimators.Next, we derive an explicit solution of the maximum likelihood estimation problem for a large class of experiments that arise from various kids of compositions of sample spaces. We identify the (categorical) direct sum of sample spaces as a representation of “free choice,” and the (categorical) direct product as a representation of “randomization.”Finally, we apply the foregoing discussion to the case of multiple classification experiments in order to show that there is no Simpson's paradox if the difference between free choice and randomization is recognized in the structure of the experiment.A comparison between our new estimator and the “usual” calculation can be summarized as follows: Pooling the data over one classification factor in the “usual” way in fact destroys or ignores the information contained in it, whereas our proposed maximum likelihood estimator is a proper marginal over this factor that “averages out” the information contained in it. There is a growing recognition, stemming from work with both vertebrates and invertebrates, that the capacity for neuronal regeneration is critically dependent on the local microenvironment. That environment is largely created by the non‐neuronal elements of the nervous system, the neuroglia. Therefore an understanding of how glial cells respond to injury is crucial to understanding neuronal regeneration. Here we examine the process of repair in a relatively simple nervous system, that of the insect, in which it is possible to define (...) precisely the cellular events of the repair process. This repair is rapid and well organised; it involves the recruitment of blood cells, the division of endogenous glial elements and, possibly, migration from pre‐existing glial pools in adjacent ganglia. There are clear parallels between the events of repair and those of normal glial development. It seems likely that the ability of the insect central nervous system to repair resides in the retention of developmental capacities throughout its life and that damage results in the activation of this potential.
