1. In ‘A problem for expressivism’ Frank Jackson and Philip Pettit argue ‘that expressivists do not have a persuasive story to tell about how ethical sentences can express attitudes without reporting them and, in particular, without being true or false’ (1998: 240). Briefly: expressivists say that ethical sentences serve to express non-cognitive attitudes, but that these sentences do not report non-cognitive attitudes. The view that ethical sentences do report non-cognitive attitudes is not Expressivism (and not non-cognitivism), but rather a version (...) of cognitivism. According to (what we’ll call) Subjectivism, a typical ethical sentence like ‘Abortion is wrong’ reports the speaker’s non-cognitive attitude toward abortion; it says, in effect, that abortion is the object of some attitude of the speaker’s. Expressivists, by contrast, say that the sentence expresses a non-cognitive attitude toward abortion, but does not say that the speaker has it. Ayer put it this way: I can say that I am bored by uttering the sentence ‘I am bored’, but I can express boredom, without saying that I am bored, by yawning (Ayer 1952: 109). (shrink)

Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Ethical realists hold that our ethical concepts, thoughts, and claims are in the business of representing ethical reality, by representing evaluative or normative properties and facts as aspects of reality, and that such representations are at least sometimes accurate. Non-naturalist realists add the further claim that ethical properties and facts are ultimately non-natural, though they are nonetheless worldly. My aim is threefold: to elucidate the sort of representation involved in ethical evaluation on realist views; to clarify what exactly is represented (...) and how non-naturalism comes into the picture for non-naturalists; and to defend worldly non-naturalism against some objections. The first question addressed is how we should model evaluation on any realist view, which should in turn guide the identification of which properties and facts are credibly regarded as ‘evaluative’ ones. Then the question is: what role might non-natural properties and facts play, and how are they related to what is represented in ethical evaluation? Once that is clear, we will be in a position to answer certain objections to non-naturalist realism from Jackson, Gibbard, Bedke, and Dreier. I argue that the objections all mischaracterize the role played by non-natural properties and facts on plausible versions of non-naturalist realism. (shrink)

Für die Moralphilosophie ist eine Theorie praktischer Gründe von zentraler Bedeutung. Ein zentraler Streitpunkt ist dabei die Verbindung zwischen Normativität und Motivation. Endres rekonstruiert kritisch die bedeutenden Positionen von B. Williams, J. McDowell und C. Korsgaard. Die Positionen lassen sich als humesch, aristotelisch und kantisch kennzeichnen, so dass ihre Behandlung zugleich auch als eine Auseinandersetzung mit exemplarischen Beispielen der wichtigsten Ansätze der Philosophiegeschichte zu verstehen ist. Kernthese ist, dass es einen signifikanten Aspekt praktischer Gründe gibt, der in der gegenwärtigen Debatte (...) übersehen worden ist: praktische Gründe müssen Personen zugänglich sein. English summary: The relationship between science and politics can hardly be reduced to a simple formula. On one hand they appear to be completely separate systems that follow only their own internal logic. On the other hand, mutual references can be identified. It is quite possible to consistently align political decisions to scientific evidence, whereby the autonomy and the legitimacy of democratic policy would however inevitably be affected. In four sections the relationship between science and politics are analyzed under the (...) viewpoint of a specific key question: Does true policy require powerful decision and therefor specifically the absence of science? And is science not conversely determined by it being free of value and policy? What about concepts that tend to want to replace policy with science? Finally, there is the question of what legitimate role science can play in today's politics, and whether this can be in the form of policy advice. Court cases involving sexual assault and police violence rely heavily on victim testimony. We consider what we call the “Traumatic Untrustworthiness Argument (TUA)” according to which we should be skeptical about victim testimony because people are particularly liable to misremember traumatic events. The TUA is not obviously based in mere distrust of women, people of color, disabled people, poor people, etc. Rather, it seeks to justify skepticism on epistemic and empirical grounds. We consider how the TUA might appeal to the (...) psychology and neuroscience of memory for empirical support. However, we argue that neither support the TUA. (shrink)

In this article I set out a reason for believing in a form of metaethical relativism. In rough terms, the reason is this: a widely held thesis, internalism, tells us that to accept (sincerely assert, believe, etc.) a moral judgment logically requires having a motivating reason. Since the connection is logical, or conceptual, it must be explained by a theory of what it is to accept a moral claim. I argue that the internalist feature of moral expressions can best be (...) explained by my version of moral relativism, which I call "speaker relativism.". (shrink)

The net structure of the spatial theory of elections is investigated and described in the format of structuralism. Three new kinds of intertheoretical relations typical for social theory are identified and defined. The historical development of spatial theory as expressed by specializations and other intertheoretic relations is found to be in a sense 'inverse' to that of theories in the natural sciences. The development begins with a 'most special' case.

This is a paper about the problem of realism in meta-ethics (and, I hope, also in other areas, but that hope is so far pretty speculative). But it is not about the problem of whether realism is true. It is about the problem of what realism is. More specifically, it is about the question of what divides meta-ethical realists from irrealists. I start with a potted history of the Good Old Days.

The first part of this article contains (i) considerations as to the relationship between jurisprudence and legal dogmatics, legal philosophy, and sociology of law; (ii) considerations about the status of jurisprudence both as a meta‐ and an object‐theory. These lead to the suggestion that jurisprudence should be defined as a general juristic theory of law and legal science. In the second part, the character and elements of this definition are explained systematically. The article's main thesis is that jurisprudence is not (...) distinguished from legal philosophy and sociology of law by its subject or its method, but by the specifically juristic research aspect or perspective it is based upon. Many philosophers, in different areas, are tempted by what variously goes under the name of Contextualism, Speaker Relativism, Indexical Relativism. (I’ll just use Indexical Relativism in this paper.) Thinking of certain problematic expressions as deriving their content from elements of the context of use solves some problems. But it faces some problems of its own, and in this paper I’m interested in one in particular, namely, the problem of disagreement. Two alternative theories, tempting for just the same kinds of expressions (...) as Indexical Relativism is meant to handle, promise to solve the problem of disagreement. I’ll argue that they do not live up to their promise. At the end of the paper, I’ll ask what exactly disagreement amounts to, and I’ll canvass some purported solutions. (shrink)

Normative theorists like to divide normative theories into classes. One special point of focus has been to place utilitarianism into a larger class of theories which do not necessarily share its view about what is alone of impersonal intrinsic value, namely, individual human well-being, but do share another structural feature, roughly its demand that each person seek to maximize the realization of what is of impersonal intrinsic value. Recent studies indicate that mammalian chromosomes contain discretecis‐acting loci that control replication timing, mitotic condensation, and stability of entire chromosomes. Disruption of the large non‐coding RNA gene ASAR6 results in late replication, an under‐condensed appearance during mitosis, and structural instability of human chromosome 6. Similarly, disruption of the mouse Xist gene in adult somatic cells results in a late replication and instability phenotype on the X chromosome. ASAR6 shares many characteristics with Xist, including random mono‐allelic expression and asynchronous replication timing. (...) Additional “chromosome engineering” studies indicate that certain chromosome rearrangements affecting many different chromosomes display this abnormal replication and instability phenotype. These observations suggest that all mammalian chromosomes contain “inactivation/stability centers” that control proper replication, condensation, and stability of individual chromosomes. Therefore, mammalian chromosomes contain four types ofcis‐acting elements, origins, telomeres, centromeres, and “inactivation/stability centers”, all functioning to ensure proper replication, condensation, segregation, and stability of individual chromosomes. This paper surveys some ways of distinguishing Quasi-Realism in metaethics from Non-naturalist Realism, including ‘Explanationist’ methods of distinguishing, which characterize the Real by its explanatory role, and Inferentialist methods. Rather than seeking the One True Distinction, the paper adopts an irenic and pragmatist perspective, allowing that different ways of drawing the line are best for different purposes.

Internalism says that if an agent judges that it is right for her to φ, then she is motivated to φ. The disagreement between Internalists and Externalists runs deep, and it lingers even in the face of clever intuition pumps. An argument in Michael Smith’s The Moral Problem seeks some leverage against Externalism from a point within normative theory. Smith argues by dilemma: Externalists either fail to explain why motivation tracks moral judgment in a good moral agent or they attribute (...) a kind of fetishism to good moral agents. I argue that there are alternative models of moral motivation available to Externalists, in particular a model according to which a good moral agent is one who is effectively regulated by a second order desire to desire to do what is right. The paper describes the problem for robust moral realism of explaining the supervenience of the moral on the non-moral, and examines five objections to the argument: The moral does not supervene on the descriptive, because we may owe different obligations to duplicates. If the supervenience thesis is repaired to block, it becomes trivial and easy to explain. Supervenience is a moral doctrine and should get an explanation from within normative ethics rather than metaethics. Supervenience is a conceptual truth and should (...) be explained by the nature of our concepts rather than by a metaphysical theory. The moral does not supervene on the descriptive, because moral principles are not metaphysically necessary. It concludes that none of these objections is successful, so Robust Realists do have an explanatory debt to worry about. (shrink)

This paper is about Truth Minimalism, Norm Expressivism, and the relation between them. In particular, it is about whether Truth Minimalism can help to solve a problem thought to plague Norm Expressivism. To start with, let me explain what I mean by 'Truth Minimalism' and 'Norm Expressivism.'.

In general, the technical apparatus of decision theory is well developed. It has loads of theorems, and they can be proved from axioms. Many of the theorems are interesting, and useful both from a philosophical and a practical perspective. But decision theory does not have a well agreed upon interpretation. Its technical terms, in particular, ‘utility’ and ‘preference’ do not have a single clear and uncontroversial meaning. How to interpret these terms depends, of course, on what purposes in pursuit of (...) which one wants to put decision theory to use. One might want to use it as a model of economic decision-making, in order to predict the behavior of corporations or of the stock market. In that case, it might be useful to interpret the technical term ‘utility’ as meaning money profit. Decision theory would then be an empirical theory. I want to look into the question of what ‘utility’ could mean, if we want decision theory to function as a theory of practical rationality. I want to know whether it makes good sense to think of practical rationality as fully or even partly accounted for by decision theory. I shall lay my cards on the table: I hope it does make good sense to think of it that way. For, I think, if Humeans are right about practical rationality, then decision theory must play a very large part in their account. And I think Humeanism has very strong attractions. (shrink)

In 1971, Simon Blackburn worked out an argument against moral realism appealing to the supervenience of the moral realm on the natural realm.1 He has since revised the argument, in part to take account of objections,2 but the basic structure remains intact. While commentators3 seem to agree that the argument is not successful, they have not agreed upon what goes wrong. I believe this is because no attempt has been made to see what happens when Blackburn's argument is addressed to (...) particular varieties of moral realism. As I see it, we must look to these various brands if we want to understand just where the concept of supervenience can be usefully employed. (shrink)

In chapter five of Wise Choices, Apt Feelings Allan Gibbard develops what he calls a ‘normative logic’ intended to solve some problems that face an expressivist theory of norms like his. The first is “the problem of embedding: The analysis applies to simple contexts, in which it is simply asserted or denied that such-and-such is rational. It says nothing about more complex normative assertions.”1 That is the problem with which I will be concerned. Though he doesn’t list it as one (...) of the problems to be solved, Gibbard’s devices also explain what it means to say that a certain normative argument is ‘valid’, that one normative statement follows from some others. Both of these questions arise because of the ways we ordinarily think and speak, ways which on a simplistic version of expressivism appear not to make any sense. An expressivist committed to making sense of the way we ordinarily think and speak in normative language owes some account of embeddings and of logic. Gibbard’s device seems to me the clearest and most systematic of any expressivist attempt to meet these challenges. (shrink)

The metaethics and metametaethics of Scanlon's "Reasons Fundamentalism".

This chapter discusses whether Quasi-Realism gains any advantage over Robust Realism with respect to the problem of explaining supervenience. The chapter starts with a summary of what the supervenience problem is and recounts the history of expressivist thinking about supervenience: the supervenience problem was a challenge raised by expressivist Robust Realists, with the idea that expressivism had an excellent explanation of the phenomenon and realism had none. The chapter then contrasts Quasi-Realism and Robust Realism in order to bring the big (...) problem out in the open, namely that Quasi-Realists have not provided any explanation at all for the phenomenon of supervenience. In this respect they are, it appears, in the same boat as Robust Realists. The chapter maps out the possible paths for Quasi-Realists to travel in pursuit of Quasi-Explananda, and gives some reasons to be optimistic. The chapter ends with a suggestive analogy and a synopsis of the state of the dialectic. (shrink)

Amie Thomasson's Norms and Necessity offers a non-factualist theory of the language of metaphysical necessity, centering on the idea that statements of necessity express semantic norms. This article identifies a potential problem for the view by distinguishing two kinds of conditional necessity, investigates a solution derived from a well-known parallel pair of conditional necessities in deontic logic, but finds it is not up to the job. The last part of the paper suggests a different route, largely in keeping with the (...) underlying ideas behind Thomasson's approach. (shrink)

Non-cognitivists claim to be able to represent normative judgment, and especially moral judgment, as an expression of a non-cognitive attitude. There is some reason to worry whether their treatment can incorporate agent centred theories, including much of common sense morality. In this paper I investigate the prospects for a non-cognitivist explanation of what is going on when we subscribe to agent centred theories or norms. The first section frames the issue by focusing on a particularly simple and clear agent centred (...) theory, egoism. The second section poses the difficulty faced by non-cognitivist analyses of such theories and norms, and runs briefly through a couple of abortive attempts to solve it. The third section offers a solution and explains it. The fourth section uses the account developed in the third section to show in what way agent centred judgments are universalizable and in what way they are not. (shrink)

In discussion about basic theoretical approaches in a non-Cartesian psychology several candidates for a key concept were proposed, such as action, activity, relation, dialogue and discourse. None of these concepts, however, sufficiently grounds psychological theories of individual psychology in social practice. To accomplish this we need to conceptualize subjects as participants in structures of ongoing social practice. In this paper I argue why and address issues of subjectivity as encountered by persons in their participation in complex structures of social practice. (...) I introduce the concept of personal conduct of life and life-trajectory as elaborations of my theory. And I discuss this theoretical approach and show what is at stake in developing it by comparing it to similar approaches in the current literature on the person, self, and identity. (shrink)
