In her book Liberty of Conscience: In Defense of America's Tradition of Religious Equality the American philosopher Martha Nussbaum joins a chorus of American intellectuals who have criticized France and other European nations for their failure to embrace the concept of cultural pluralism. In Nussbaum's opinion, the meaning that the French attach to egalité has remained stuck in circumstances peculiar to the eighteenth century. The concept is outdated and has not in the contemporary world been able to protect cultural diversity (...) in general and religious diversity in particular. Her book takes to task what she terms “the French tradition of “coercive assimilation” that is insensitive to what George Washington stressed as the “‘delicacy and tenderness’ that is owed to other people's ‘conscientious scruples.’” The French refusal to allow Muslim schoolgirls to cover their heads with a foulard, however stylish it might be, is linked back to the French emancipation of Jews that required, in Nussbaum's analysis, a heavy requirement of cultural erasure. The French, like most Europeans, grew used to the idea “that citizens are all alike,” an idea that now haunts France as it tries to figure out what to do with its Muslim population. (shrink)

Academics are falsely rumored to have a low regard for religion. Although Richard Dawkins and Christopher Hitchens, authors of The God Delusion and God Is Not Great , respectively, made atheism a best-selling subject in the United States, it is not coincidental that Hitchens and Dawkins are English. They were educated in a country where a strident antipathy toward religion is not unpatriotic. American atheists with as much brass are rare. Kicking religion around cannot be an American sport because, from (...) colonial to contemporary times, religion has been a central component of American culture. To be sure, a lot of scholarly criticism has been directed at right-wing Christian and Islamic movements. But scholars whose personal views on faith incline them to echo Hitchens's mordant formula that “religion poisons everything” should probably look for a country other than the United States to study. Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. Pharmacogenomics is a quickly evolving field of research that increasingly impacts individuals and society. As some innovations in biotechnology have experienced strong public opposition during the 1990s, interaction between producers and users of these innovations may help in increasing their success in social and economic terms. However, conditions for effective interaction have so far remained under-explored. This paper explores user-producer interactions in pharmacogenomics from an innovation and science communication perspective in the Netherlands. To find possible ways of engaging stakeholders in (...) an early stage of technology development, ie, when science policy is in the making, we present communication activities derived from the field of policy analysis. To articulate motives for two-way public participation in genomics innovation processes, we describe two levels at which pharmacogenomics developments will have an input:1) at the meso-level of medical practice with already established medical technologies, values and routines, suppliers and health professionals (general practitioners, pharmacists), and 2) at the macro-level of society at large, with established institutions, infrastructures, and broadly shared values and beliefs among citizens in general. Thereby we offer a starting point for optimising decision-making processes in the field of pharmacogenomics innovations, including important aims to be reached, stakeholders to be involved, and some criteria for designing interactive communication activities. Members of a National Health Service, or other recognised Research Ethics Committee, in deciding whether or not to withhold their assent for a clinical trial, must obey the law. If they do not do so, then they may become liable to pay personally negligence claims made by injured trials subjects. It could be no defence to say that members had consulted their own lower ethical standards; or merely that they had acted in good faith; or that they had followed Department (...) of Health guidelines, which do not have the force of law. The law requires that the rights, safety, and well-being of clinical trial subjects shall prevail over other interests. REC favourable opinion is a powerful endorsement of a trial, and prospective subjects are invited to rely upon it. REC members are legally bound to exercise their power to withhold assent to any clinical trial which does not give subjects the protection the law requires. (shrink)

Concerning this example, he suggested the following account: When someone, by using the form of expression an JQ implicates that the X does not belong to or is not otherwise closely connected (...) with some identifiable person, the implicature is present because the speaker has failed to be specific in a way in which he might have been expected to be specific. The results of empirical research in psychology and psychiatry are increasingly being used to formulate as well as understand problems at the interface of law and psychiatry. There has been a proliferation of studies, such as the determinants of individual competence or threat to self or others, the results of which are influencing policy and legislative decisions as well as buttressing holdings in court cases. In this article, I explore the issues of interpretation of epidemiological studies, particularly the role of (...) ideological positions on the design and results of empirical findings, the importance of the way data are interpreted, and the role of ideologies in the way research findings are presented to provide support for policy positions. Two levels of analysis are involved in determining the validity of a study. The first addresses the questions of whether the study meets the statistical and epidemiological requirements for reliable results. These include considerations such as the appropriateness of the study design and methods for gathering and interpreting data. The second focuses on the underlying framework of the study. This involves factors such as the perspectives and values of those conducting the study, the explicit and implicit dominating ideologies where they operate, and the extent to which the study is constructed to reaffirm specific ideologies. This level of analysis is essential for disclosing the influences of ideologies on the results of studies and the way in which data are interpreted. In this article, I try to demonstrate through critiques of selected studies that the first stage of analysis is insufficient without an examination of underlying preconceived values to establish the meaningfulness of results. While experience often affords important knowledge and insight that is difficult to garner through observation or testimony alone, it also has the potential to generate conflicts of interest and unrepresentative perspectives. We call this tension the paradox of experience. In this paper, we first outline appeals to experience made in debates about access to unproven medical products and disability bioethics, as examples of how experience claims arise in bioethics and some of the challenges raised by these claims. We then motivate (...) the idea that experience can be an asset by appealing to themes in feminist and moral epistemology, distinguishing between epistemic and justice-based appeals. Next, we explain the concern that experience may be a liability by appealing to empirical work on cognitive biases and theoretical work about the problem of partial representation. We conclude with preliminary recommendations for addressing the paradox and offer several questions for future discussion. (shrink)
