Although the principle of informed consent is well established and its importance widely acknowledged, it has met with criticism for decades. Doubts have been raised for a number of different reasons. In particular, empirical data show that people regularly fail to reproduce the information provided to them. Many critics agree, therefore, that the received concept of informed consent is no more than a myth. Strategies to overcome this problem often rest on a flawed concept of informed consent. In this paper, (...) it is suggested that informed consent is a communicative act between two persons. The challenge is to elucidate the norms and constraints for successfully performing such a communicative act. The view developed here has major consequences with regard to the standards for information disclosure as well as for the general scope of informed consent. (shrink)

In this paper we re-examine Hugh LaFollette's proposal that the state carefully determine the eligibility and suitability of prospective parents before granting them a ?license to parent?. Assuming a prima facie case for licensing parents grounded in our duty to promote the welfare of the child, we offer several considerations that complicate LaFollette's radical proposal. We suggest that LaFollette can only escape these problems by revising his proposal in a way that renders the license effectively obsolete, a route he implicitly (...) adopts in his recent revisiting of the licensing proposal. We conclude that there is little merit in the idea of licensing ?natural? parents as a practical policy proposal, and raise some questions about its continued use in relation to adoptive and foster parents. ABSTRACT Recent writings by philosophers such as David Miller and Yael Tamir have undertaken to provide nationalism with a normative foundation, a task which has been all but ignored by post‐War English‐language political philosophy. I identify and criticise three lines of argument which have been deployed in their writings. First, it is argued by Miller that the universalism and abstraction of rationalist moral theories have made them suspicious of ‘particularisms’ such as nationalism, but that they stem from a faulty metaethics. (...) Against this I argue that abstraction and universality need not be grounded in a universalist metaethics, but can be derived pragmatically from the ethical needs of multicultural societies. Second, it is argued that liberal policies such as taxation and material redistribution, restrictions on immigration, as well as liberal concepts such as political obligation, presuppose the validity of the nationalist point of view. Against this I hold that nationalism never provides the strongest moral grounds for these policies and concepts, and that, in the specific case of distributive justice, it can even undermine them. And third, I examine the argument that the historical excesses of which nationalists have been guilty are actually the product of a narrow, ‘ethnic’nationalism, in contrast to which we can articulate a categorically distinct, open, ‘civic’nationalism, which would be broadly compatible with liberal political morality. I argue that the concept of civic nationalism is unstable, and that under fairly plausible and widespread empirical conditions, it either collapses back into a form of ethnic nationalism, or else becomes devoid of any recognisably nationalist content. Language is central to political philosophy, yet until now there has been little in the way of a common framework capable of bridging disciplines that share an interest in language, power, and ethics. Studies are predominantly carried out in isolated disciplinary silos - notably linguistics, philosophy, political science, public administration, and education. The aim of the present paper is to analyse compactness properties of nonmonotonic inference operations within the framework of model theory. For this purpose the concepts of a deductive frame and its semantical counterpart, a semantical frame are introduced. Compactness properties play a fundamental in the study of non-monotonic inference, and in the paper several new versions of compactness are studied.

There are few philosophical questions to which Charles Taylor has not devoted his attention. His work has made powerful contributions to our understanding of action, language, and mind. He has had a lasting impact on our understanding of the way in which the social sciences should be practised, taking an interpretive stance in opposition to dominant positivist methodologies. Taylor's powerful critiques of atomist versions of liberalism have redefined the agenda of political philosophers. He has produced prodigious intellectual histories aiming to (...) excavate the origins of the way in which we have construed the modern self, and of the complex intellectual and spiritual trajectories that have culminated in modern secularism. Despite the apparent diversity of Taylor's work, it is driven by a unified vision. Throughout his writings, Taylor opposes reductive conceptions of the human and of human societies that empiricist and positivist thinkers from David Hume to B.F. Skinner believed would lend rigour to the human sciences. In their place, Taylor has articulated a vision of humans as interpretive beings who can be understood neither individually nor collectively without reference to the fundamental goods and values through which they make sense of their lives. The contributors to this volume, all distinguished philosophers and social theorists in their own right, offer critical assessments of Taylor's writings. Ausgehend von den Marburger Philosophen Hermann Cohen und Paul Natorp, vertieft Barth deren transzendentalen Systemgedanken zu einem radikalen Prinzip, das die Wirklichkeitsfrage neu aufwirft. Letztere wird zwar auch in Kants zweiter Kritik gestellt, doch nicht im Sinne einer Handlungstheorie, sondern mit der (...) Absicht aufzuweisen, dass es so etwas wie praktische Vernunft überhaupt «gibt». Genau darin aber erkennt Barth den Kern der Philosophie der Existenz, wodurch sich seine Philosophie der Praktischen Vernunft ' wie Sein und Zeit 1927 erschienen ' in einer noch zu erhellenden Verwandtschaft zu Martin Heidegger befindet. Dennoch könnte die Ausgangslage beider Philosophen verschiedener nicht sein. Weder Sein noch Tod geben die Leitlinien von Barths Interpretation vor, vielmehr die transzendental verstandene Vernunft und der Mensch, der wesensmässig vom Anspruch praktischer Verwirklichung herausgefordert ist. Grundsätzlicher als ethische Normen und Regeln werden hier die Grundlagen der praktischen Vernunft erachtet, die im Horizont von Platons «Idee des Guten» und Kants Begriff der «Pflicht» eine eigenständige Wirklichkeit beansprucht. Dass der Philosoph Barth auch offen ist für die Dimension der Glaubenswahrheiten zeigte sich schon bei seiner Mitarbeit an der «Dialektischen Theologie» in den frühen Zwanzigerjahren des 20. In democratic theory, “legitimacy” refers to the set of conditions that must be in place in order for the claims to authority of somebody to be deemed appropriate, and for their claims to compliance to be warranted. Though criteria of legitimacy have been elaborated in the context of democratic states, there is no reason for them not to be drawn up, with appropriate amendments, for other kinds of authority structures. This paper examines the claims to authority made over researchers by (...) international bodies governing research ethics, who exercise their authority by the research ethics guidelines they produce (including recent revisions to the Declaration of Helsinki and CIOMS Guidelines). We argue that discussions of such bodies and sets of guidelines often elide questions of justification and questions of legitimacy, and that the grounds that might allow us to mount a strong case for the latter are at present sorely underdeveloped.
