Ethical training in graduate programs is an important part of the professional development process. Such training has taken a position of prominence in both counseling and clinical psychology but seems to be lagging behind in the field of sport psychology. A debate exists about whether such training is necessary and, if so, how it should be provided. An important step in better understanding these issues is to identify how such training is currently taking place. This study surveyed the program directors (...) of sport psychology programs listed in the Directory of Graduate Programs in Applied Sport Psychology (Burke, Sachs, & Schrader, 2002) about the ethical training that takes place in their programs and their perceptions of the preparedness of the students in their programs. Of those contacted, 54% (n = 47) responded to the e-mail based survey. The results from these respondents indicated that 64.4% of programs require training in ethics and that the training was most commonly integrated into other nonethics courses. Overall, respondents did not feel as if students were completely prepared for either the ethical or legal issues that they will face in their professional careers. The importance of ethical training and suggestions for improving ethical training are discussed. (shrink)

The potential for the occurrence of multiple-role relationships is increased when professors also consult with athletic teams on their campuses. Such multiple-role relationships have potential ethical implications that are unclear and largely unexplored, and consultants may find multiple-role relationships both difficult to deal with and unavoidable. Therefore, the purpose of this study was to explore the nature of teacher–practitioner multiple-role relationships. Participants (N = 35) were recruited from Association for the Advancement of Applied Sport Psychology (AAASP) certified consultants (CCs) who (...) were also affiliated with a university (N = 68). All participants completed a 28-item survey exploring the incidence and relevant issues pertaining to multiple-role relationships. Chi-square analyses revealed that licensed mental health practitioners (i.e., psychologists and counselors) were more likely than nonlicensed AAASP CCs to believe that multiple-role relationships were never appropriate in sport psychology, χ2(1, N = 30) = 12.80, p <.001, and to have never taken part in a multiple-role relationship, χ2(1, N = 33) = 12.44, p <.001. Independent samples t tests revealed that mental health practitioners also reported that they would have higher levels of concern for both the practitioner, t(30) = –2.77, p =.009, and the client, t(30) = –2.50, p =.018, in such a relationship. Postcolonial science studies entails ostensibly contradictory critical and empirical commitments. Science studies scholars influenced by Bruno Latour and Isabelle Stengers embrace forms of realist, radical empiricism, while postcolonial studies scholars influenced by Jacques Derrida trace the limits of the knowable. This essay takes their common use of the term cosmopolitics as an unexpected point of departure for reconciling Derrida’s program with Stengers’s and Latour’s. I read Derrida’s critique of hospitality and Stengers’s and Latour’s ontological politics as necessary complements for conceiving (...) a care-oriented subalternist cosmopolitics, a process of composing common worlds that remains attentive to the limits of representation. Abstract:By combining normative philosophy and empirical social science, we craft a research framework for assessing differential expectations embodied in normative conceptions of the economic social contract in the United States. We argue that there are distinct views of such a contract grounded in individualist and communitarian philosophical ideologies. We apply this framework to organizational downsizing, postulating that certain human resource practices, in combination with the respective ideological orientations, will affect perceptions of the justice of downsizing policies.

In AFTERLIVES OF AFFECT, Watson considers the life and work of Mayanist Linda Schele (1942 - 1988) as an entry point to discuss the nature of cultural inquiry and the metaphor of decipherment in anthropology. Watson figures Schele as a trickster guide in his experimental, person-centered ethnography, reanimating the work of decipherment and drawing upon an "affect of discovery" that better expresses the affective engagement of anthropologists and their subject of study. Through her archive, Watson finds an (...) archaeologist wholly animated by her fieldsite and immersed in a more "spiritual science," though nonetheless still imbricated in a system of settler-colonial knowledge production. By holding Schele's work in conversation with both her own interlocutors and prominent voices in the field today, Watson refocuses on anthropologists who are engaged as individuals; carrying their own attachments with them as they describe, interpret, and decipher what they observe, and in doing so, positions affective engagement as a constitutive element in a more reflexive anthropology. The book is organized into six chapters that progress thematically through Schele's life and Watson's autoethnographic reflections on his own research. In Sacrilege (chapter 1), Watson draws together moments throughout his research where he felt his exhumation of Schele's work veered too closely to disturbing what was laid to rest-much like Schele's own work, which relied on the unearthing of sites long laid to rest, reanimating long-dead Mayan rulers and artists. The chapter sets the tone of the work as always toeing the line and risking the introduction of the mystical and affective into scientific interpretation-edgewalking with Schele. In Animals (chapter 2), Watson draws upon metaphors in the animal world, as did Schele when she sought inspiration for her next moment of insight; spider webs present a Geertzian metaphor for webs of signification, while rabbits are trickster guides, a transtemporalizing technology, drawing Schele (and Watson) forward and back through time. Through these reflections, Watson builds iteratively on arguments throughout the book that return to themes more recognizable in contemporary theory conversations: more-than-human worlds, the question of modernity, and the social conditions of knowledge production. This book will be of interest to readers in anthropology, especially those engaged in the ontological turn and more-than-human worlds, as well as the history of anthropology and anthropology theory more broadly. We argue that the American Society for Bioethics and Humanities has endorsed a facilitation approach to clinical ethics consultation that asserts that bioethicists can offer moral recommendations that are well-grounded in bioethical consensus. We claim that the closest thing the field currently has to a citable, nationally endorsed bioethical consensus are the 22 Core References used to construct the questions for the Healthcare Ethics Consultant-Certified (HEC-C) exam. We acknowledge that the Core References reflect some important points of bioethical consensus, but (...) note they are unwieldy, repetitive, and sometimes inconsistent on important issues faced by clinical ethicists. In this article, we draw carefully qualified inspiration from the Ethical and Religious Directives for Catholic Health Care Services (ERDs) to argue for the creation of a concise, nationally endorsed bioethical consensus document on moral issues commonly faced in clinical ethics, what we call the Standardized Ethical Guidelines for Secular Health Care Services (SEGs). We observe that such a document would better meet the expectations of stakeholders, clinical ethicists, and their trainees who desire moral recommendations grounded in a clearly articulated bioethical consensus, and we defend the SEGs from some common objections. In Civil Rights and the Paradox of Liberal Democracy, Bradley Watson demonstrates the paradox of liberal democracy: that its cornerstone principles of equality and freedom are principles inherently directed toward undermining it. Modernity, beyond bringing definition to political equality, unleashed a whirlwind of individualism, which feeds the soul's basic impulse to rule without limitationincluding the limitation of consent. Here Watson begins his analysis of the foundations of liberalism, looking carefully and critically at the moral and political philosophies that (...) justify modern civil rights litigation. He goes on to examine the judicial manifestations of the paradox of liberal democracy, seeking to bring a broad philosophical coherence to legal decision making in the United States and Canada. We respond to Autumn Fiester’s critique that our proposed bioethical consensus project amounts to “ethical hegemony,” and evaluate her claim that ethicists should restrict themselves to “mere process” recommendations. We argue that content recommendations are an inescapable aspect of clinical ethics consultation, and our primary concern is that, without standardization of bioethical consensus, our field will vacillate among appeals to the disparate claims in the 22 “Core References,” unsustainable efforts to defend value-neutral process recommendations, or become a practice of Lone (...) Ranger clinical ethicists. We contend that a consensus document that captures the basic moral commitments of patients and careproviders is the next step in the professional evolution of our field. Successful behavior requires actively acquiring and representing information about the environment and people, and manipulating and using those acquired representations flexibly to optimally act in and on the world. The frontal lobes have figured prominently in most accounts of flexible or goal-directed behavior, as evidenced by often-reported behavioral inflexibility in individuals with frontal lobe dysfunction. Here, we propose that the hippocampus also plays a critical role by forming and reconstructing relational memory representations that underlie flexible cognition and social behavior. There (...) is mounting evidence that damage to the hippocampus can produce inflexible and maladaptive behavior when such behavior places high demands on the generation, recombination, and flexible use of information. This is seen in abilities as diverse as memory, navigation, exploration, imagination, creativity, decision-making, character judgments, establishing and maintaining social bonds, empathy, social discourse, and language use. Thus, the hippocampus, together with its extensive interconnections with other neural systems, supports the flexible use of information in general. Further, we suggest that this understanding has important clinical implications. Hippocampal abnormalities can produce profound deficits in real-world situations, which typically place high demands on the flexible use of information, but are not always obvious on diagnostic tools tuned to frontal lobe function. This review documents the role of the hippocampus in supporting flexible representations and aims to expand our understanding of the dynamic networks that operate as we move through and create meaning of our world. This essay traces the ontological and political limits of Bruno Latour’s conceptualization of the ‘common world’. Latour formulates this concept in explicating how modernist scientific and political institutions require a metaphysical foundation that is anti-democratic in rigidly partitioning nature from society. In the stead of nature/society, Latour proposes a ‘cosmopolitics’ in which we recognize our embroilment in systems comprised of heterogeneous human and nonhuman actors, and seek to innovate appropriate procedures for governing such systems and composing a more peaceful common (...) world. However, feminist and postcolonialist science studies scholars have argued that Latour’s project fails to apprehend the experiences of subjects marginalized by scientific and political structures of representation. Thus, science studies scholars seem to be faced with a problem; to avoid ontological dissonance and contradiction in integrating Latour’s program with feminist and postcolonialist critiques we must defer his claims that the cosmopolitical program entirely supersedes contemporary social movements and oppositional politics. I offer an alternative. Namely, I argue that Latour’s formulations of cosmopolitics’ procedures and the common world’s boundaries actually require an incipient model of the limits of democratic representation. I modify Latour’s proposed system of representation by reading it against Dipesh Chakrabarty’s concept of ‘subaltern pasts’, which are unassimilable to academic historical narratives (in their attribution of agency to nonhuman gods, for example). This reading emphasizes how Latour does not adequately theorize and politicize the partially autonomous reality of those excluded from the common world and thus fails to attend to how this externalization replicates the violence of modernist representational institutions. Freedom and the Rule of Law takes a critical look at the historical beginnings of law in the United States, and how that history has influenced current trends regarding law and freedom. Anthony Peacock has compiled articles that examine the relationship between freedom and the rule of law in America. The rule of law is fundamental to all liberal constitutional regimes whose political orders recognize the equal natural rights of all.

In this article I address the ethical implications of the legal issues the U. S. Supreme Court resolved in New York Times v. Sullivan and its progeny. In a ruling with far-reaching moral implications, the Court addressed truthtelling-journalism's primary ethical directive-and undermined it by favoring other moral principles and social goals. Much of this article focuses on the ethical arguments addressed to the Court in legal briefs that sought rulings that would support fundamental principals of ethical journalism. The creation of (...) actual malice as a legal concept in the Sullivan case owes more to the Court's pursuit of other moral and social values than strict legal reasoning, according to the descriptive theory of pragmatic instrumentalism, which informs this analysis. This article argues that the turn to the animal is a return to mythology. By reading multispecies scholarship as narrativization of contemporary mythology, I claim that the field voices anxieties about human futures through figures of animal others. Multispecies ethnography implicitly grapples with an apocalyptic mythos prevailing in the wake of modernity’s seemingly abandoned dreams. I reconsider the cultural function of multispecies research through two moves. First, I read Thom van Dooren’s Theory, Culture & Society article on ‘Authentic Crows’ as (...) such a quasi-allegorical account. Second, I develop how animal anthropology captures the contemporary mythos in an ‘affirmationist’ register that counters the pessimistic affect of late industrialism. Ultimately, the critical politics of such research may be redeemed through efforts to work closely with scientists and to render explicit the accounts’ situatedness within late-industrial mythology. This paper suggests the utility of studying unconscious cognition from a selectionist perspective, specifically as outlined by theory and research in the field of behavior analysis. Currently, issues surrounding the complexity of the unconscious cognitive behaviors, the number of variables involved, and the multidirectional influences of these variables, are of utmost concern to theories of mind and behavior. Unanswered questions about these factors leave us without the ability to predict outcomes in an individual case or adequately manipulate variables in order (...) to alter outcomes. Multiple examples of current work by behavior analysts are suggested as potentially fruitful ways of addressing some of these concerns. (shrink)

This note revisits the issue of Scipio Aemilianus’ famous prosecution of L. Aurelius Cotta, cos. 144, and argues for a reconstruction and dating that is consistent with both Per. Oxy. 55 and the references in Cicero. The appendix suggests that scholars have misunderstood Appian BC 1.22 and Cicero Font. 38 and that Appian (and perhaps Cicero) refer to another trial, namely that of L. Aurelius Cotta, cos. 119.

Background: The role of nurses as patient advocates is one which is well recognised, supported and the subject of a broad body of literature. One of the key impediments to the role of the nurse as patient advocate is the lack of support and legislative frameworks. Within a broad range of activities constituting advocacy, whistleblowing is currently the subject of much discussion in the light of the Mid Staffordshire inquiry in the United Kingdom and other instances of patient mistreatment. As (...) a result steps to amend existing whistleblowing legislation where it exists or introduce it where it does not are underway. Objective: This paper traces the development of legislation for advocacy.
