This article explores contrasting strategies in feminist critical theory in order to interrogate divergent fictional representations of women's spiri tual power. The first critical strategy uses the resources of gynocriticism to present a positive view of women's authorship, agency and ability to revi sion religious forms. The second demonstrates poststructuralist concerns with the repressed other/ s of dominant cultural forms and the power these possess to provoke political change and new visions of the divine. In this article we distinguish between philosophical bioethics (PB), descriptive policy orientated bioethics (DPOB) and normative policy oriented bioethics (NPOB). We argue that finding an appropriate methodology for combining empirical data and moral theory depends on what the aims of the research endeavour are, and that, for the most part, this combination is only required for NPOB. After briefly discussing the debate around the is/ought problem, and suggesting that both sides of this debate are misunderstanding one another (i.e. one side (...) treats it as a conceptual problem, whilst the other treats it as an empirical claim), we outline and defend a methodological approach to NPOB based on work we have carried out on a project exploring the normative foundations of paternal rights and responsibilities. We suggest that given the prominent role already played by moral intuition in moral theory, one appropriate way to integrate empirical data and philosophical bioethics is to utilize empirically gathered lay intuition as the foundation for ethical reasoning in NPOB. The method we propose involves a modification of a long-established tradition on non-intervention in qualitative data gathering, combined with a form of reflective equilibrium where the demands of theory and data are given equal weight and a pragmatic compromise reached. Suppose that you are engaging with someone who is your oppressor, or someone who espouses a heinous view like Nazism or a ridiculous view like flat-earthism. In contexts like these, there is a disparity between you and your interlocutor, a dramatic normative difference across which you are in the right and they are in the wrong. As theorists of humility, we find these contexts puzzling. Humility seems like the *last* thing oppressed people need and the *last* thing we need in (...) dealing with those whose views are heinous or ridiculous. Responding to such people via humility seems uncalled for, even inappropriate. But how could this be, given that humility is a *virtue*? The purpose of the paper is to explore this puzzle. We explain what the puzzle is and then attempt to draw some lessons from it: first, the lesson that the importance of humility is limited in several ways, and second, the lesson that humility nonetheless has several important roles to play, even for people who are in the right in contexts of disparity. In this article we explore some of the ethical dimensions of using social media to increase the number of living kidney donors. Social media provides a platform for changing non-identifiable ‘statistical victims’ into ‘real people’ with whom we can identify and feel empathy: the so-called ‘identifiable victim effect’, which prompts charitable action. We examine three approaches to promoting kidney donation using social media which could take advantages of the identifiable victim effect: institutionally organized campaigns based on historical cases aimed at (...) promoting non-directed altruistic donation; personal case-based campaigns organized by individuals aimed at promoting themselves/or someone with whom they are in a relationship as a recipient of directed donation; institutionally organized personal case-based campaigns aimed at promoting specific recipients for directed donation. We will highlight the key ethical issues raised by these approaches, and will argue that the third option, despite raising ethical concerns, is preferable to the other two. (shrink)

IT is strange that the informal fallacies should strike us as such obvious breaches of thinking and advocacy, yet should have met with such little success in finding a respectable home within mature logical theory. It might seem that respectable and mature logical theory is most mature and most respectable in the theory of propositions, and that its maturity and respectability in the other logical domains rapidly diminish in inverse proportion to the susceptibility of those domains to be reduced to (...) the logic of propositions. But we are not anxious to promote so severe a view of theoretical accomplishment, and we shall suppose that, at the very least, the informal fallacies have a degree of systematicity that will at once advance our understanding of them nicely beyond the level of intuitive impressions, and also place into retirement the hopelessly inadequate accounts that litter too many otherwise admirable textbooks. :A common goal of ethics education is to equip students who later become health practitioners to not only know about the ethical principles guiding their practice, but to also autonomously recognize when and how these principles might apply and assist these future practitioners in providing care for patients and families. This article aims to contribute to discussions about ethics education pedagogy and teaching, by presenting and evaluating the use of the visual arts as an educational approach designed to facilitate students’ (...) moral imagination and independent critical thinking about ethics in clinical practice. We describe a sequence of ethics education strategies over a 3 year Doctor of Physiotherapy program, focusing on the final year professional ethics assessment task, which involved the use of visual arts to stimulate the exploration of ethics in healthcare. The data were analyzed using both thematic and content analysis. Two key themes centered on emotional responses and lateral thinking. The use of artwork appeared to facilitate imaginative, emotional, and conceptual thinking about ethics and clinical experience. This study provides some evidence to support the effectiveness of the use of the visual arts in promoting students’ recognition of ethical dimensions within their clinical experience and reflection on their emerging professional identity. Judges are typically tasked to consider sentencing benefits but not costs. Previous research finds that both laypeople and prosecutors discount the costs of incarceration when forming sentencing attitudes, raising important questions about whether professional judges show the same bias during sentencing. To test this, we used a vignette-based experiment in which Minnesota state judges reviewed a case summary about an aggravated robbery and imposed a hypothetical sentence. Using random assignment, half the participants received additional information about plausible negative consequences of (...) incarceration. As predicted, our results revealed a mitigating effect of cost exposure on prison sentence term lengths. Critically, these findings support the conclusion that policies that increase transparency in sentencing costs could reduce sentence lengths, which has important economic and social ramifications. We argue that common knowledge, of the kind used in reasoning in law and computing is best analyzed using a dialogue model of argumentation (Walton & Krabbe 1995). In this model, implicit premises resting on common knowledge are analyzed as endoxa or widely accepted opinions and generalizations (Tardini 2005). We argue that, in this sense, common knowledge is not really knowledge of the kind represent by belief and/or knowledge of the epistemic kind studied in current epistemology. This paper takes (...) a different approach, defining it in relation to a common commitment store of two participants in a rule-governed dialogue in which two parties engage in rational argumentation (Jackson & Jacobs 1980; van Eemeren & Grootendorst 2004). A theme of the paper is how arguments containing common knowledge premises can be studied with the help of argumentation schemes for arguments from generally accepted opinion and expert opinion. It is argued that common knowledge is a species of provi- sional acceptance of a premise that is not in dispute at a given point in a dia- logue, but may later be defeated as the discussion proceeds . In this paper, we present the first stage of an empirical bioethics project exploring the moral sources of paternal responsibilities and rights. In doing so, we present both (1) data on men's normative constructions of fatherhood and (2) the first of a two-stage methodological approach to empirical bioethics. Using data gathered from 12 focus groups run with UK men who have had a variety of different fathering experiences (n = 50), we examine men's perspectives on how paternal responsibilities and rights (...) are generated and the significance of the genetic connection within the father–child relationship. We do not attempt to explore men's experiences of fatherhood or their fathering practices; and neither is the analysis driven from a particular sociological perspective. Rather, we explore men's normative constructions of fatherhood in order to present accessible data that might be of significance to the philosophical/moral debate on the sources of paternal rights and responsibilities. Hollywood films partially construct how Americans think about education. Recent work on the representation of schools in American cinema has highlighted the role of class difference in shaping school film genres. It has also advanced the idea that a nuanced understanding of American individualism helps to explain why the different class genres are shaped as they are. This article attempts to refine this theoretical approach by focusing on the paradox of individualism, which suggests that individualism must always be dependent on (...) community. We examine 5 films (Rushmore 1988, The Breakfast Club 1985, Mona Lisa Smile 2003, School of Rock 2003, and Stand and Deliver 1988) and argue that, although the values of individualism are certainly celebrated, these films also show, perhaps unwittingly, that the achievements of individualism require robust student communities. We describe how student communities function in these films, what achievements they make possible, and what obstacles they face. (shrink)

In this paper, we propose a novel approach to permit members of the public opportunity to record more nuanced wishes in relation to organ donation. Recent developments in organ donation and procurement have made the associated processes potentially more multistaged and complex than ever. At the same time, opt-out legislation has led to a more simplistic recording of wishes than ever. We argue that in order to be confident that a patient would really wish to go ahead with the various (...) interventions and procedures that now accompany organ donation, more nuanced information than a simple ‘yes’ or ‘no’ may be required. This is of particular importance for donation after circulatory death, where some interventions to facilitate donation occur when the patient is still alive. We propose the implementation of an online form to allow people to record more nuanced wishes in relation to donation, including an indication of competing wishes and how these should be weighed into decision-making. We argue that this approach will promote autonomous decision-making for the public, potentially reduce difficulties that family members encounter at the time of organ donation, and should make medical staff more confident that they are truly acting according to the wishes and best interests of their patients. The decline in organs donated after brain death has been countered by an increase in organs donated after circulatory death. Organs donated after circulatory death present an increased risk of complications for their eventual recipients when compared with organs donated after brain death, so the likelihood of successful transplantation is decreased. If organ donation is considered to be in the best interests of the patient, interventions that facilitate successful donation and transplantation might be permissible. This paper seeks to establish whether (...) it is ethically permissible to manage the end-of-life care of a dying patient to maximize the chances of successful transplantation, and if so, whether it is permissible to further maximize these chances by managing the potential donor to enable donation after brain death rather than donation after circulatory death. Sobre esta base, este artículo seguirá un camino regresivo a fin de desvelar que el sentido de las equivalencias y transposiciones está latente en (...) "las matrices simbólicas", que ofrecen una clave para comprender que los fenómenos de expresión, que tienen lugar en el mundo a través del cuerpo, del lenguaje, de la historia y del arte, deben ser vistos como nudos, emblemas de sentido en los que se hace visible una dimensión temporal. Las matrices simbólicas son "centros organizadores" y, por lo tanto, "centros de significación" que se retoman una y otra vez. The notion of a system of equivalences comes to have in Merleau-Ponty's phe-nomenology a central place because lying under there is a general function of tacit transposition. It is a principle for understanding without analogical explanation, i.e., a synthesis without analysis, as can be seen, for example, in the plasticity, transferability, and likeliness that characterizes habits. On this basis, the article will follow a regres-sive way in order to show that the meaning of the equivalences and transpositions is latent in "the symbolic matrixes" that offer a clue to understand that the phenomena of expression, which occur in the world by means of the body, language, history, and art, should be seen as nodes or emblems of meaning in which a temporal dimension shows itself. Symbolic matrixes are "organizing centers", and thus "centers of signi-ficance" that are taken up over and over again. (shrink)

Resumen: Siguiendo la inspiración de Merleau-Ponty, B. Waldenfels se ocupa de la corporalidad y pone énfasis en su dimensión responsiva, es decir, en modos de comportamiento y experiencia corporales que responden a interpelaciones de lo extraño. Desde esta perspectiva, este trabajo aspira a elucidar el entrelazamiento cuerpo-Naturaleza con la intención de mostrar que la Naturaleza entendida como otro aspecto del hombre implica una alteridad que no se reduce ni a la lógica de la intencionalidad ni a la lógica de la (...) comunicación. La interpelación que proviene de la Naturaleza tiene, por una parte, el significado de una apelación, comprendida como alocución a alguien, y, por otra, el de una pretensión, en el sentido de una interpelación a algo. Con base en estos presupuestos, la segunda parte de la exposición apunta a ilustrar la manera como a través de la pintura se pone en marcha un actuar responsivo, que se orienta por los caracteres singularidad, ineludibilidad, posterioridad, asimetría e innovación que caracterizan a la lógica de la respuesta.: Following Merleau-Ponty´s inspiration, B. Waldenfels deals with embodiment emphasizing its responsive dimension, i.e., modes of bodily behavior and experience that respond to interpellations of the strange. From this view, the article aims to explaining the intertwining of body and nature with the intention of showing that nature, understood as another side of human being, implies an alterity that cannot be reduced to the logic of intentionality nor to the logic of communication. The interpellation that arises from Nature has, on the one hand, the meaning of appeal in the sense of an address to somebody, and, on the other, of pretention as an interpellation to something. Based on these presuppositions, the second part of the article tries to show how, by means of painting, a responsive action is set in motion. The features of singularity, unavoidableness, subsequence, asymmetry, and innovation that characterize the logic of the answer guiding this action. (shrink)

En este trabajo realizo un examen crítico del reciente libro de Silvana Gabriela Di Camillo sobre la crítica de Aristóteles a la teoría platónica de las Ideas. El libro de Di Camillo es un trabajo muy serio cuya lectura recomiendo ampliamente. Sin embargo, considero que cuatro de las principales tesis que la autora defiende tienen varias dificultades y mi objetivo aquí es presentar argumentos detallados en contra de ellas: la interpretación de la distinción entre argumentos más y menos rigurosos del (...) tratado Sobre las Ideas; la tesis de que la separación es el blanco esencial de las críticas aristotélicas a las Ideas; la interpretación de las opciones que Platón tiene para responder al argumento del tercer hombre, y la tesis de que la separación de las Ideas debe entenderse como homonimia. In this paper I examine Silvana Gabriela Di Camillo's recent book on Aristotle's criticisms of Plato's theory of Ideas. Di Camillo's book is a very serious work that I highly recommend. Nevertheless, I consider that four of the main theses that the author defends face several difficulties and my aim here is to offer detailed arguments against them: the interpretation of the distinction between more and less accurate arguments of the treatise On Ideas; the thesis that separation is the essential target of Aristotle's criticisms against Plato's Ideas; the interpretation of the options available to Plato to reply to the third man argument; and the thesis that the separation of Ideas should be understood as homonymy. El trabajo tiene como hilo conductor la diferenciación efectuada por P. Ricoeur respecto del lenguaje entre la lengua, el discurso oral, la escritura y la lectura. Cada uno de estos modos de lenguaje puede ser examinado según los fenómenos de la temporalidad, la subjetividad, el mundo y la intersubjetividad. Siguiendo a M. Presas, este esquema se aplica al arte y a su función de dejar que las cosas se manifiesten en su plena presencia. Se destaca su énfasis en la liberación (...) efectuada por el arte respecto de la limitación fáctica de nuestra situación finita. Esto se logra mediante la apertura a la verdad de una existencia posible que no se identifica con una evasión de la realidad. Los análisis de Presas se centran en P. Klee y F. Marc, y destacan los rasgos distintivos relacionados con los mencionados fenómenos. En el intento de ofrecer un complemento a este examen, se mencionan las interpretaciones de Merleau-Ponty sobre P. Cézanne, de M. Henry sobre V. Kandinsky y de J.-C. Marion sobre G. Courbet. Se muestra que en ellas también se encuentran explicitaciones de lo que Presas ha afirmado sobre la discordia, el ser insular y la ausencia de apremio. (shrink)

This article is an attempt to clarify the role of pregivenness by drawing on the accounts afforded by Eugen Fink both in the Sixth Cartesian Meditation and in the complementary writings to this study. Pregivenness is first situated, along with givenness and non-givenness, within the framework of the system of transcendental phenomenology. As a second step, an examination is undertaken of the dimensions of pregivenness in the natural attitude. Next, nonpregivenness in the transcendental sphere is examined with a focus upon (...) the way in which indeterminateness does not undermine the possibility of a transcendental foreknowledge in the natural attitude, and on the other hand implies the productive character of phenomenological knowledge. After showing how, with the reduction, the pregivennes of the world turns into the pregivenness of world-constitution, the paper addresses the problems raised by the nonpregivenness both of the depth-levels and the reach of transcendental life. By unfolding these lines of inquiry, transcendental phenomenology surmounts the provisional analysis of constitution at the surface level as well as the limitation of transcendental life to the egological sphere. Finally, it is contended that Fink’s account of pregivenness overstates apperceptive or secondary pregivenenness because is does not deal with the pregivenness that precedes acts and is the condition of possibility for primary passivity. Reasons for the omission of impressional or primary pregivenness are suggested. (shrink)

Cette contribution témoigne de l’importance de la réception de la phénoménologie de langue française en Amérique Latine. En revisitant la thèse de la duplicité de l’apparaître – apparaître de la vie comme affect et comme force, apparaître du monde comme sens et distance –, Roberto J. Walton s’attache au concept fondamental de la phénoménologie de la vie, en mettant en avant des modalités dans lesquelles l’auto-affection opère sans hétéro-affection d’une manière avérée. Il précise d’emblée que cette auto-affection sans hétéro-affection (...) est définie par deux aspects : un premier « aspect de base » – ou rapport de fondation – en vertu duquel l’auto-affection est la condition de possibilité de toute intentionnalité ou ek-stase ; et un deuxième aspect « d’intensification ou d’excédence » qui renvoie à la phénoménologie de l’événement, en ceci que l’auto-affection y apparaît dans une sorte de plus-value, c’est-à-dire dans la condition de l’acte comme accroissement créateur.
