En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. This paper proposes freedom as the condition of possibility for the construction of trust in human relationships. The methodology used is a review of the scientific literature of the most recent moral and political philosophy. As a result of the dialogue between different positions, it is discovered that freedom, despite being present in the act of trust, is forgotten in the discussion around trust, a forgetfulness that has as its main causes the assumption that trust is natural and the confusion (...) between the propensity to trust and the act of trusting. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. Esta investigación pone en diálogo las posiciones de Hobbes y de Spaemann respecto a la naturaleza de la confianza, para lo cual se asume una postura hermenéutica. Los principales resultados de esta arrojan que para Hobbes la confianza ha de ser aprendida, pues la desconfianza es lo primero con lo que se encuentra el ser humano; mientras que, para Spaemann, el hombre es un ser confiado y aprende a desconfiar. Como efecto de este diálogo se descubre que ambos autores tienen (...) como base para la confianza la sociabilidad humana, por lo cual se concluye que la disposición de la confianza se da en la naturaleza humana como condición de posibilidad para el acto de confiar. The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

Patrimônio de Fé e Religiosidade: os Bens Culturais inseridos na Festa do Senhor dos Passos em São Cristóvão, Sergipe, Brasil. (Heritage of Faith and Religiosity: Cultural Objects inserted on the Festival of Senhor dos Passos in São Cristóvão) - DOI: 10.5752/P.2175-5841.2013v11n31p1018 O conceito de Bens Culturais de uma localidade vem passando por novos paradigmas quanto à abrangência e relevância. Nesse âmbito, além do Patrimônio Material de ruas, praças, igrejas, objetos artísticos e históricos, o discurso e ações dos órgãos oficiais e (...) da comunidade, devem também se pautar pela valorização das produções imateriais da cultura. Esses elementos envolvem os sujeitos e os sons produzidos por eles, seus ofícios, memórias, festas e religiosidade. Nesse sentido, o presente artigo visa analisar os Bens Culturais que compõem o cenário da celebração do Senhor dos Passos e descrever os seus valores histórico, religioso e artístico. A metodologia utilizada foi: pesquisa bibliográfica, documental e de campo. Após as três etapas da pesquisa e observação no local, constatado que a Festa do Senhor dos Passos em São Cristóvão possui elementos patrimoniais conectados que a transforma em um evento vinculado à identidade cultural-religiosa da região. Alguns desses elementos já são tombados nos níveis estadual, nacional e mundial, enquanto que outros, embora não reconhecidos pelos órgãos oficiais de salvaguarda do Patrimônio, são valorizados pela comunidade no que concerne a afetividade, memória, dádiva e pertencimento: Patrimônios de Fé, Religiosidade e Culto em Sergipe. Such elements involve the subjects and the sounds produced by them, their crafts, memories, parties and religiosity. In this way, this article aims at analyzing the aspects that make up the scene of the festivities of Senhor dos Passos as a Cultural object and describes its historical, religious and artistic values. The methodology used was the bibliographic, documental and field research. After the three stages of research and on-site observation, it was found that the Festival of Senhor dos Passos in São Cristóvão owns connected heritage elements which turn it into an event linked to the religious-cultural identity of the region. Some of these elements are already safeguarded statewide and at national and global levels, while others, though not recognized by the official bodies of safeguarding of heritage are valued by the local community by affection, memory, donation and belongingness: Heritage of Faith, Religiosity and cult in Sergipe. The moral presentation: an essay on Merleau-Ponty's notion of time in the Phenomenology of Perception: The purpose of this essay is to investigate the notion of memory in Merleau-Ponty, suggesting a possible interpretation of the time and memory within Merleau-Ponty’s genetic phenomenological analysis. Ultimately, our hypothesis is that Merleau-Ponty’s understanding of the problem of representation and perception - particularly the problem of retention - places an ethical ground in perception. We will suggest that the phenomenological approach to memory might pave (...) a different undertaking of morals as constructed in the living-present. Our objective is then to point a moral dimension to the process of presentation-representation that happens in consciousness, and establish that our way into the comprehension of values has both a passive and active dimension that is often underdeveloped in studies of how we establish moral and political convictions. Esse presente artigo tem por finalidade abordar aspectos da Procissão ao Nosso Senhor dos Passos na cidade sergipana de São Cristóvão. A metodologia utilizada foi a pesquisa bibliográfica, com discussão no campo teórico sobre Barroco, Festa Devocional, Tradição, Religiosidade, Procissão, Turismo Religioso, Cultura e Identidade. Também foi realizada a pesquisa de campo, com observação direta. Com esse estudo, ficou perceptível que, como território distante de Portugal, as festas religiosas do Brasil tomaram uma dinâmica própria, absorvendo elementos profanos e se resignificando através do apelo popular. Apart from tourist attractions, religious celebrations in the country are also intangible heritage and culture are embedded within "the feast" of Brazilians. This present article seeks to address aspects of the Procession of " Nosso Senhor dos Passos " the city of São Cristóvão state of Sergipe. The methodology used was literature, with discussion in the theoretical field of Baroque, Devotional Feast, Tradition, Religion, Procession, Religious Tourism, Culture and Identity. We also carried out field research, with direct observation.With this study, it was noticeable that, as distant territory of Portugal, the religious feasties in Brazil have taken a very dynamic, absorbing the profane elements and reframing through popular appeal. This study investigates the influence of evaluative judgments, specifically regarding an individual's moral character, on judgments of health and disease. Though it might seem that assessments judgments of health and disease should be impervious to evaluative judgments, two hypotheses suggest that health and disease judgments might be influenced by evaluative judgments: the "naturalization hypothesis" which centers on our inclination to assign blame, and the "pathologization hypothesis" rooted in the belief of a just world. These hypotheses lead to opposing predictions about (...) how someone with a perceived negative moral character might have their condition categorized. Employing a fictional vignette and the methodologies of experimental philosophy, our research provides evidence in favor of the "pathologization hypothesis." While this phenomenon likely carries real-world implications, especially in healthcare, it also has potential for offering insights into the dynamics of medicalization and stigma. (shrink)

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. The paper engages Christopher Boorse’s Bio-Statistical Theory. In its current form, BST runs into a significant challenge. For BST to account for its central tenet—that lower-level part-dysfunction is sufficient for higher-level pathology—it must provide criteria for how to decide which lower-level parts are the ones to be analyzed for health or pathology. As BST is a naturalistic theory, such choices must be based solely on naturalistic considerations. An argument is provided to show that, if BST is to be preserved, such (...) parthood choices are based on non-naturalistic considerations. We demonstrate that even when parthood choices are based on the best way to preserve BST, there are counterintuitive results which bring the central tenet of BST into question. (shrink)

We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. The Covid-19 pandemic has brought unexpected changes in important aspects of young people’s lives. The academic literature contains many studies on the risks and adverse effects, while any potential positive aspects have been side-lined. This paper examines quality of life and relationships among young people in emerging and young adulthood in order to identify the negatives and benefits of the pandemic. In this qualitative research a “letter to a friend” free-writing exercise was used as the data collection method on a (...) total sample of 107 young people aged 18-34 years. Using reflective thematic analysis, the statements were then grouped into two themes: “Covid as a misfortune” and “Covid as a benefit”. (shrink)

Authenticity has become a widespread ethical ideal that represents a way of dealing with normative gaps in contemporary life. This ideal suggests that one should be true to oneself and lead a life expressive of what one takes oneself to be. However, many contemporary thinkers have pointed out that the ideal of authenticity has increasingly turned into a kind of aestheticism and egoistic self-indulgence. In his book, Varga systematically constructs a critical concept of authenticity that takes into account the reciprocal (...) shaping of capitalism and the ideal of authenticity. Grief is often described as characterized by a particular emotional response to another person’s death. While this is true of paradigm cases, we argue that a broader notion of grief allows accommodating forms of this emotional experience that deviate from the paradigmatic case. The bulk of the paper explores such a nonparadigmatic form of grief, anticipatory-vicarious grief, which is typically triggered by pondering the inevitability of our own death. We argue that AV-grief is a particular moral emotion that serves a (...) unique function and is indissolubly linked to the practical identities of human agents. How do people understand the concepts of mental health and disorder? The objective of this paper is to examine the impact of several factors on people’s judgments about whether a condition constitutes a mental disorder or a healthy state. Specifically, this study examines the impact of the source of the condition, its outcome, individual valuation (i.e., the value the individual attaches to the condition), and group valuation (i.e., the value the relevant group attaches to the condition). While we find that (...) people’s health and disorder judgments are driven by perceived dysfunction, we also find that health and disorder judgments are impacted differently by these factors. Health judgements are impacted by outcome and individual valuation, and disorder judgments are impacted by condition source. These results suggest that the folk concept of mental health is positive (i.e., mental health is more than the absence of mental disorder) and normativist (i.e., value judgments play a significant role in determining whether a condition counts as healthy), while the concept of mental disorder aligns with a naturalist perspective, at least to the extent that dysfunction plays an important role in categorizing a condition as a disorder. However, our finding that people’s dysfunction judgments are influenced by individual valuation and outcomes poses a strong challenge to naturalist accounts. As the editors of The Philosophies of America Reader, Kim Díaz and Mathew A. Foust, put it, "Just as history has fashioned and popularized distorted accounts of the 'discovery' of America, it has done the same in its presentation of American Philosophy" (p. xv). This exemplary collection of essays from across the Americas allows the readers and instructors to reimagine what we construe as philosophy and who we imagine an American philosopher to be.The editors offer diverse essays covering an impressive timeframe, ranging from the Popol Vuh, whose oral tradition from Guatemala predates Spanish colonization and was recorded in the mid-1500s, to contemporary philosophers such as Gregory Pappas. The collection excels in offering texts that typical philosophy anthologies are unlikely to include, which the editors call "unusual suspects" that have been historically marginalized, while also maintaining more familiar or "classical" figures (pp. xv–xvi). These "unusual suspects" include women, Latinx, American Indigenous, Black, and Caribbean thinkers.The Philosophies of America Reader offers various resources to enhance the student and instructor's experience. The book is structured into four themes: (1) Selfhood and Identity, (2) Knowing and Learning, (3) Aesthetics and Spirituality, and (5) Violence and Peace. The editors design these themes to fit the traditionally understood areas of philosophy of metaphysics, epistemology, and axiology. Even if the instructor's course description does not specifically target American Philosophy, these thematic categories are valuable for th ose who wish to incorporate a more diverse reading list. For example, these essays could easily apply to courses such as Critical Philosophy of Race, Introduction to Philosophy, or Introduction to Ethics. Each thematic section also features a "For Further Reading" segment, which includes selected secondary sources to broaden research or substitute texts. In addition, the editors provide a detailed [End Page 1] syllabus example, including a Course Description and Outline of the Course for a bi-weekly class, which is neatly divided into a 16-week reading schedule. They also include instructive sections such as a Note to the Teacher to aid in thinking through how to interact with the unfamiliar texts and a Note to the Student to guide their disposition and readings.Moreover, the text presents introductory essays for each thematic section. These essays provide an overview of the content and delve into the author's positionality, such as their geography, context, motivations for writing, race, ethnicity, and native tongue. The introductions are philosophically robust yet accessible to new philosophy students and are not filled with unnecessary philosophical jargon.Due to its large scope of thinkers, this text offers a vibrant opportunity to dialogue with philosophers who share or differ in their perspectives across the major thematic categories. The editors emphasize that although this is not a history of thought, the texts present lineages of progression, elaboration, and disagreement intended to guide instructors in connecting the texts with their students (p. xx). Furthermore, this allows the reader and the instructor to avoid isolating their discourse to a particular time, geography, gender, or race and ethnicity. In addition to the biographical and contextual information given in the introductions, a small yet helpful detail is a timeline of the selections that further contextualizes the readings.I wish to underscore two key clusters of essays amidst the vast array of 50 readings related to Asian-American and Mexican-American discourse for the instructor's consideration, particularly those teaching in the United States. This paper aims to clarify the nature of understanding in medicine. The first part describes in more detail what it means to understand something and links a type of understanding (i.e., objectual understanding) to explanations. The second part proceeds to investigate what objectual understanding of a disease (i.e., biomedical understanding) requires by considering the case of scurvy from the history of medicine. The main hypothesis is that grasping a mechanistic explanation of a condition is necessary for a biomedical understanding of (...) that condition. The third part of the paper argues that biomedical understanding is necessary, but not sufficient for understanding in a clinical context (i.e., clinical understanding). The hypothesis is that clinical understanding combines biomedical understanding of a _disease_ or pathological condition with understanding _illness,_ which involves some degree of personal understanding of the patient. It is argued that, in many cases, clinical understanding necessitates adopting a particular second-personal stance and using cognitive resources _in addition_ to those involved in biomedical understanding. The Philosophy of Psychiatry is a unique area of research because the nature of the subject matter leads to quite distinct methodological issues. Naturalism, Interpretation, and Mental Disorder is an original new work focusing on the challenges we face when trying to interpret and understand mental illness. The book integrates a hermeneutical perspective, and shows how such an approach can reveal important facts about historical sources in psychiatry and the nature of dialogue in the therapeutic encounter. In the research we focus on the construction of the sexual lifestyles of young people—undergraduates—in Slovakia and ask “which cultural sources are used?” and “which cultural demands exert pressures on these constructions?” The analysis was based on the answers respondents provided to a questionnaire relating to the preferences of values, aspirations regarding partner and sexual life as well as the socio-economic background of respondents. On the basis of the factor analysis and other steps, we obtained five groups of respondents with (...) different lifestyles: 1. Liberal—free, 2. Partner—monogamous, 3. Natural—instinctive, 4. Hedonistic—free, 5. Submissive—partner. The research proves that while constructing their sexual lifestyles, young people experience confusion as to their personal interests, preferences, internal orientation of partner relationships, and culturally prescribed norms of monogamous relationships.
