The aim of this study was to understand how incivility is viewed across multiple academic programs and respondent subgroups where different institutional and cultural power dynamics may influence the way students and faculty perceive uncivil behaviors. This study used the Conceptual Model for Fostering Civility in Nursing Education as its guiding framework. The Incivility in Higher Education Revised (IHE-R) Survey and a detailed demographic questionnaire were used to gather self-assessment and personal perspective data regarding incivility in the higher education setting. (...) This approach aspired to collect a comprehensive perspective of incivility in higher education. With data from 400 students and 69 faculty, there was limited agreement between faculty and student participants about perceptions and experiences with incivility. Faculty and students did agree that the solution to incivility may be found with the creation of a code of conduct that defines acceptable and unacceptable behavior, role-modeling professionalism and civility, and taking personal responsibility and standing accountable for actions. Despite significant differences in participants’ perceptions of incivility, they shared common solutions. With a shared goal, faculty and students can work toward cultivating civility in higher education. (shrink)

Since the 1980s, microenterprise development programs have proliferated in the United States, where they are widely praised as strategies for economic development and poverty alleviation, especially for low-income women and welfare mothers. Based on research in a highly respected urban center for women, this article argues that microenterprise development is more detrimental and problematic than it is purported to be. Two reasons are isolated. First, gender constraints mean women tend to choose small-scale, undercapitalized, and barely profitable “pink-collar” businesses, largely home-based (...) operations based on work women are already doing as part of their gender-specific role. Second, microenterprise training programs reinforce this business segregation by discounting the sociocultural conditions women bring with them to business and instead emphasizing the personal growth of individuals. The result is that women are encouraged to maintain their economic vulnerability and social peripheralization rather than become part of the mainstream business world. (shrink)

This paper is an exploration of evolving ideas, urgencies, and actions that we have experimented with in our teaching of an environmental sustainability subject with pre-service teachers at an Australian university. It is a work in progress. Through this shared educator-student teaching and learning process we feel the tensions of contradictory forces that disrupt the flow of prior teaching as we all become unsettled by hope and reality, grief, and loss, all mixed in with a sense of urgency and tempered (...) by a set of often unimaginative contemporary pedagogical practices. These tensions often resort educators like us, to perpetuate well-worn and critiqued tropes such as how to ‘care for the planet’ through ‘greening’ practices in schools such as recycling and energy conservation. Always inadequate and limited we are experimenting in our pedagogical repertoire with new ways to teach as we could no longer keep up the charade of agitating for change in the same way. In this paper we explore some of the opening and closures that effect environmental sustainability teaching. We consider how through a reimagining of sustainability education with new pedagogical openings of ‘making kin’ we first attend to these emotional tensions as a means of waking up to who we are in the Anthropocene and then find ways to identify relational ethico-onto-epistemologies in our teaching. By disrupting humanist paradigms and embracing critical posthumanist sensitivities the educators and students nuzzle into new ways of knowing and being in the world. (shrink)

“Reasonable hostility” is a norm of communicative conduct initially developed by studying public exchanges in education governance meetings in local U.S. communities. In this paper I consider the norm’s usefulness for and applicability to a U.S. state-level public hearing about a bill to legalize civil unions. Following an explication of reasonable hostility and grounded practical theory, the approach to inquiry that guides my work, I de-scribe Hawaii’s 2009, 18-hour pub-lic hearing and analyze selected segments of it. I show that this (...) par-ticular public hearing raised de-mands for testifiers on the anti-civil union side of the argument that rea-sonable hostility does not do a good job of addressing. Development of a norm of communication conduct for this practice, as well as others, must engage with the culture and time-specific beliefs that a society holds, beliefs that will shape not only how to argue but what may be argued and what must be assumed about particular categories of persons. Outside Waco, Texas, on 19 April 1993, a 51-day standoff between the Federal Bureau of Investigation and David Koresh and the Branch Davidians concluded with a devastating fire. Despite the fact that FBI negotiators talked on the telephone with Koresh or his main spokesman almost every day, the negotiators were unable to bring the standoff to a peaceful end. A frustrating yet persistent aspect for the FBI negotiators was the Davidians' talk about the Bible and their religious beliefs, what agents (...) dismissively described as `Bible babble'. In this study, we analyze several exchanges between Koresh and one of the FBI agents. The analysis shows how the FBI's identifying their problem as `Bible babble' contributed to the negotiation failure. Through their talk, Koresh was positioned as a biblical expert and the FBI agent as a novice. The FBI's talk also supported Koresh's face. These two conversational patterns, we argue, legitimated God as a key party and Koresh as the person who could best speak for him. In the conclusion, we suggest how a renaming of the problem might have reshaped the FBI's moves. (shrink)

An important but unstudied event in US legal institutions is when judges question plaintiff and defense attorneys about the issue that brings them to an appeals hearing before a state supreme court. In this article I analyze judges' questioning during the oral argument phase of the New York Court of Appeals' hearing of Hernandez v. Robles, a case concerning whether the state was violating same-sex couples' constitutional rights by denying them access to marriage. The article's purpose is to show how (...) the content, format, and language style of judges' questioning turns constructs the judges as persons possessing particular attitudes, judicial philosophies, political leanings, and personalities. The article provides a quantitative overview of the 186 questioning turns and analyzes the discourse in selected episodes to evidence how features of questioning generate identity inferences. The conclusion considers how the oral argument phase of Appeals Court proceedings contributes to larger discourses of the law. (shrink)

This study examines the relationship between person-referencing terms and attorney and judges’ stances during oral argument in three US state supreme courts as each considered whether its existing state law could restrict marriage to one man and one woman. After reviewing past work on stancetaking and person referencing, I provide background on appellate oral argument and the three cases. Combining discourse analysis with simple quantitative coding, the study shows that attorneys’ and judges’ choices of terms for gay parties and the (...) frequency of their use marked the stance of appellate parties toward same-sex marriage. Then, I describe how person-referencing terms for gays, both in the larger society and in appellate courts, changed in the 20 years preceding the cases. The article concludes by arguing for the value of studying state appellate court discourse; I also reflect about the complexities in linking changes in usage of person-referencing terms with attitudinal stance changes. This study aims to better understand the perceptions and experiences related to incivility by students and faculty across multiple academic programs and respondent subgroups at a regional university in the southern United States. The study used a thematic analysis to examine student and faculty responses to three qualitative questions that focused on their perceptions of recent experiences and primary causes of incivility in higher education. Clark’s ( 2007, revised 2020) Conceptual Model for Fostering Civility in Nursing Education and Daniel Goleman’s (...) ( 1995 ) Emotional Intelligence domains were used to give meaning and context to the study findings. For this group of respondents, the study found that incivility in higher education between faculty, students, and faculty and student relationships remain pervasive. Despite the global pandemic and social unrest occurring during the study period, these behaviors did not coalesce around a specific subgroup. Both faculty and students agreed that relationship management with a keen focus on communication could mitigate academic incivility. These findings can inform educators, students, and future researchers in planning meaningful interventions that address incivility in higher education. A relational approach centered on communication skill-building is needed to combat the persistent issue of incivility in higher education. (shrink)

This article introduces the special issue on questions, questioning, and institutional practices. We begin by considering how questioning as a discursive practice is a central vehicle for constructing social worlds and reflecting existing ones. Then we describe the different ways questions and question have been defined, typologized, and critiqued, in general and within seven institutions including policing, the courts, medicine, therapy, research interviews, education, and mediated political exchanges. The introduction concludes with a preview of the articles in the special issue.

For this group of respondents, the study found that seventy percent of faculty and students agree that incivility has the largest impact on the emotional intelligence domain of self-management, which includes negative emotional outcomes, loss of respect, negative professional and student outcomes, poor academic outcomes, attrition, and less success. Leadership in higher education will strengthen their institutions by using a relational approach centered on communication skill-building to ensure that faculty have been socialized to the importance of civil professional behavior and that stakeholders collectively explore and agree on the meaning and organizational integration of civility. A high level of citizen involvement in civic life is presumed crucial to the well-being of democracy, but the actual discourse of citizen involvement has rarely been analyzed. This article analyzes citizen participation in the school board meetings of one US community that was in the midst of conflict. After providing background on education governance practices and the community that was studied, citizen participation is examined. Citizen commentaries at school board meetings are shown to be a distinct speech genre and (...) the genre is described. Then, we characterize the discourse practices used to express negative sentiment. Feeling-limned description, avowal of feelings, rhetorical questions, reported speech, use of god and devil terms, and using meeting rules as weapons were the main negative sentiment strategies. In the conclusion we suggest when low levels of citizen involvement should be acceptable, and why `reasonable hostility' is a desirable form of citizen expression. (shrink)

When citizens call the police to report a problem with another, they need to not only characterize the problematic action/event, but they must position themselves in relation to the complained-about person. This conversational work of positioning self, and describing the other's actions, is delicate business when the complained-about person is connected to the caller. Different constructions of the other and the problem affect whether callers get the help they are seeking. At the same time, alternate constructions offer different pictures of (...) the other's blameworthiness and self's contribution to the problem. In this study we analyze citizen calls to the police in which callers have a dilemma: they have a problem with another that they want remedied but the problem occurs in a situation where involving the police is regarded as unreasonable. Past research on calls to the police, and studies about how people position their own and others' actions in sensitive situations are described. Then the materials and interpretive method are explained. The heart of the article is a description of four relational positioning strategies. Strategies include: generic reference terms; `friend' to imply a non-sexual relationship; ex-prefaces; and agent-less problems. The conclusion considers where else the dilemma will be found and highlights distinctive features of the rhetorical discursive perspective developed in the article. (shrink)

Total knee arthroplasty (TKA) is a commonly implemented elective surgical treatment for end-stage osteoarthritis of the knee, demonstrating high success rates when assessed by objective medical outcomes. However, a considerable proportion of TKA patients report significant dissatisfaction postoperatively, related to enduring pain, functional limitations, and diminished quality of life. In this conceptual analysis, we highlight the importance of assessing patient-centred outcomes routinely in clinical practice, as these measures provide important information regarding whether surgery and postoperative rehabilitation interventions have effectively remediated (...) patients’ real-world “quality of life” experiences. We propose a novel precision medicine approach to improving patient-centred TKA outcomes through the development of a multivariate machine-learning model. The primary aim of this model is to predict individual postoperative recovery trajectories. Uniquely, this model will be developed using an interdisciplinary methodology involving non-linear analysis of the unique contributions of a range of preoperative risk and resilience factors to patient-centred TKA outcomes. Of particular importance to the model’s predictive power is the inclusion of a comprehensive assessment of modifiable psychological risk and resilience factors that have demonstrated relationships with TKA and other conditions in some studies. Despite the potential for patient psychological factors to limit recovery, they are typically not routinely assessed preoperatively in this patient group, and thus can be overlooked in rehabilitative referral and intervention decision-making. This represents a research-to-practice gap that may contribute to adverse patient-centred outcomes. Incorporating psychological risk and resilience factors into a multivariate prediction model could improve the detection of patients at risk of sub-optimal outcomes following TKA. This could provide surgeons and rehabilitation providers with a simplified tool to inform postoperative referral and intervention decision-making related to a range of interdisciplinary domains outside their usual purview. The proposed approach could facilitate the development and provision of more targeted rehabilitative interventions on the basis of identified individual needs. The roles of several modifiable psychological risk and resilience factors in recovery are summarised, and intervention options are briefly presented. While focusing on rehabilitation following TKA, we advocate for the broader utilisation of multivariate prediction models to inform individually-tailored interventions targeting a range of health conditions. This article explores the role of limit experiences (Tracy) and linguistic relativity (Whorf) in shaping our ontological and epistemological understandings of the world. Specifically, I trace the transformations in embodied understanding I have undergone in three situations across my life course–in Hawai'i, Solomon Islands, and as an acutely ill and disabled patient in a live-in clinic in Dallas, Texas. I give examples of how our perceptions, conceptions, and proprioceptions are positioned, constrained, opened to interpretation, and even denied by our (...) culture and language. A theoretical physicist and feminist theorist, Karen Barad elaborates her theory of agential realism, a schema that is at once a new epistemology, ontology, and ethics.

We frequently speak of certain things or phenomena being built out of or based in others. Making Things Up concerns these relations, which connect more fundamental things to less fundamental things: Karen Bennett calls these 'building relations'. She aims to illuminate what it means to say that one thing is more fundamental than another.

In this article, I explore the role of affective feedback loops in creating and sustaining trust and distrust. Some emotions, such as fear and contempt, drive out trust; others, such as esteem and empathy, drive out distrust. The mechanism here is causal, but not merely causal: affective looping works through changing how the agent interprets the words, deeds, and motives of the other, thus making trust or distrust appear justified. Looping influences not only dyadic trust, but also climates, and networks (...) of trust and distrust. Not all trust-entrenching looping is virtuous, nor all distrust-entrenching looping vicious, but distrust looping is a powerful way to justify xenophobic public policy. I explore options for remedy. This book examines both the personal and the political sides of Nietzsche's writings to show how his writings can expand notions of democratic politics and democratic understanding.

Even though researchers regularly use neutral affect induction procedures as a control condition in their work, there is little consensus on what is neutral affect. This article reviews five approaches that researchers have used to operationalize neutral AIPs: to produce a minimal affective state, in-the-middle state, deactivated state, typical state, or indifferent state. For each view, the article delineates the theoretical basis for the neutral AIP, how to assess it, and provides recommendations for when and how to use it. Recent defenses of shaming as an effective tool for identifying bad practice and provoking social change appear compatible with feminism. I complicate this picture by examining two instances of online feminist shaming that resulted in shame backlashes. Shaming requires the assertion of social and epistemic authority on behalf of a larger community, and is dependent upon an audience that will be receptive to the shaming testimony. Definition of the problem Death and suicide wishes of older people represent a relevant and morally challenging issue for nurses. Especially in the context of wishes for assisted suicide, the risk for the development of moral uncertainty or even moral distress grows. As suicide rates and requests for assisted suicide are particularly high among people 65 years of age or older, the topic proves to be particularly relevant to the settings of long-term community and nursing home care. At the same (...) time, this fact underlines the importance of suicide prevention, which has recently been strengthened by the federal government, with the intention of launching a national strategy and a corresponding law. Arguments According to our hypothesis, the situational confrontation of nursing professionals with death and suicide wishes may cause an ethical field of tension between an unprejudiced, open, empathetic and respectful acceptance of death and suicide wishes on the one hand and the goal of suicide prevention on the other. The legal uncertainties in regards to the practice of assisted suicide, which currently prevails in practice, may intensify this risk. International studies point to the potential of moral distress of nurses when confronted with death and suicide wishes. Conclusion These findings and the reference to the current legal uncertainties and framework conditions in the national (German) context underpin the importance of the professional discussion about the topic, the need to sensitise (future) nursing professionals to potential ethical tensions and to enable them to deal with the accompanying moral uncertainty in a professional and competent manner. Empirical work on and common observation of the emotions tells us that our emotions sometimes key us to the presence of real and important reason-giving considerations without necessarily presenting that information to us in a way susceptible of conscious articulation and, sometimes, even despite our consciously held and internally justified judgment that the situation contains no such reasons. In this paper, I want to explore the implications of the fact that emotions show varying degrees of integration with our conscious agency—from (...) none at all to quite substantial—for our understanding of our rationality, and in particular for the traditional assumption that weakness of the will is necessarily irrational. The concept of phronesis is venerable and is experiencing a resurgence in contemporary discourses on professional life. Aristotle’s notion of phronesis involves reasoning and action based on ethical ideals oriented towards the human good. For Aristotle, humans possess the desire to do what is best for human flourishing, and to do so according to the application of virtues. Within health care, the pervasiveness of economic agendas, technological approaches and managerialism create conditions in which human relationships and moral reasoning are becoming (...) increasingly de‐valued. This creates a tension for nurses, and nursing leaders, as the desire to do what is morally right is often in conflict with contextual demands. In this paper, Aristotle’s writing on phronesis is examined with a focus on his classic conceptions of eudaimonia, the virtues, deliberation, judgement, and praxis. Building on Aristotle’s work, a number of contemporary views are explored with a focus on what various conceptualizations offer for the discipline of nursing. These expanded conceptions of phronesis include attention to: embodiment in practice; open‐mindedness including the capacity to stay curious and open to recognizing what we do not know; perceptiveness as a disposition towards insight and aesthetic understanding; and reflexivity as an ongoing process of interrogation and inquiry into ourselves and our actions. Drawing on these concepts, we discuss the affordances of phronesis as a morally informed guiding force to attend to modern‐day challenges in nursing practice and nursing leadership. (shrink)

Empirically-informed philosophy of mind (EIPM) has become a dominant research style in the twenty-first century. EIPM relies on empirical results in various ways. However, the extant literature lacks an empirical description of how EIPM philosophers rely on empirical results. Moreover, though EIPM is essentially a form of cross-disciplinary research, it has not been analyzed as cross-disciplinary research so far. We aim to fill the above two gaps in the literature by producing quantitative and qualitative descriptions of EIPM as a kind (...) of cross-disciplinary research. Our descriptions aim to enable metaphilosophers to evaluate EIPM methodologically and epistemically. Our analyses use co-citation and categorization analyses informed by the literature on interdisciplinarity. We present five sets of descriptions and identify the three most common types of cross-disciplinary interactions in EIPM. The resulting descriptions enable us to locate two metaphilosophical challenges for EIPM philosophers. One concerns how they should incorporate empirical results in different disciplinary contexts, and the other concerns which theoretical virtue(s) they should aim for when tinkering with scientific theories. This paper surveys recent work on moral expertise. Much of that work defends an asymmetry thesis according to which the cognitive deference to expertise that characterizes other areas of inquiry is out of place in morality. There are two reasons why you might think asymmetry holds. The problem might lie in the existence of expertise or in deferring to it. We argue that both types of arguments for asymmetry fail. They appear to be stronger than they are because of their (...) focus on moral expertise regarding all-in judgments about rightness. We reject this emphasis on all-in judgment in favor of an account of moral expertise as typically multi-stranded and domain limited. This account of moral expertise is better able to address the problem of how to identify those who have expertise. It also offers a more nuanced picture of the contrast between accepting a moral claim on one's own and accepting it on testimony. (shrink)
