One approach to the analysis of ethical dilemmas in medical practice uses the “four principles plus scope” approach. These principles are: respect for autonomy, beneficence, non-maleficence and justice, along with concern for their scope of application. However, conflicts between the different principles are commonplace in psychiatric practice, especially in forensic psychiatry, where duties to patients often conflict with duties to third parties such as the public. This article seeks to highlight some of the specific ethical dilemmas encountered in forensic psychiatry: (...) the excessive use of segregation for the protection of others, the ethics of using mechanical restraint when clinically beneficial and the use of physical treatment without consent. We argue that justice, as a principle, should be paramount in forensic psychiatry, and that there is a need for a more specific code of ethics to cover specialised areas of medicine like forensic psychiatry. This code should specify that in cases of conflict between different principles, justice should gain precedence over the other principles. (shrink)

This book discusses the study and analysis of the physical aspects of social systems and models, inspired by the analogy with familiar models of physical systems and possible applications of statistical physics tools. Unlike the traditional analysis of the physics of macroscopic many-body or condensed matter systems, which is now an established and mature subject, the upsurge in the physical analysis and modelling of social systems, which are clearly many-body dynamical systems, is a recent phenomenon. Though the major developments in (...) sociophysics have taken place only recently, the earliest attempts of proposing "Social Physics" as a discipline are more than one and a half centuries old. Various developments in the mainstream physics of condensed matter systems have inspired and induced the recent growth of sociophysical analysis and models. In spite of the tremendous efforts of many scientists in recent years, the subject is still in its infancy and major challenges are yet to be taken up. The progress of electronic health technologies and biobanks holds enormous promise for efficient research. Evidence shows that studies based on sharing and secondary use of data/samples have the potential to significantly advance medical knowledge. However, sharing of such resources for international collaboration is hampered by the lack of clarity about ethical and legal requirements for transfer of data and samples across international borders. Here, the International Clinical Trial Center Network reports the legal and ethical requirements governing data and sample exchange (...) across four continents. The most recurring requirement is ethical approval, whereas only in specific conditions approval of national health authorities is required. Informed consent is not required in all sharing situations. However, waiver of informed consent is only allowed in certain countries/regions and under certain circumstances. The current legal and ethical landscape appears to be very complex and under constant evolution. Regulations differ between countries/regions and are often incomplete, leading to uncertainty. With this work, ICN illuminates the unmet need for a single international collaborative framework to facilitate DSE. Harmonising requirements for global DSE will reduce inefficiency and waste in research. There are many challenges to realising this ambitious vision, including inconsistent terminology and definitions, and heterogeneous and dynamic legal constraints. Here, we identify areas of agreement and significant difference as a necessary first step towards facilitating international collaboration. We propose the establishment of a working group to continue the comparison across jurisdictions, create a standardised glossary and define a set of basic principles and fundamental requirements for DSE. Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. La question ne porte pas sur le sens du mot Dieu ni sur la connaissance de Dieu, mais sur le sens du parler de Dieu : elle se situe donc sur le terrain de l’herméneutique , celui de l’analyse du langage.« (...) Il veut dire qu’on ne peut parler de Dieu qu’à partir de l’expérience personnelle de l’avoir rencontré, d’avoir été rencontré par sa Parole. Il n’interdit donc pas d’introduire le nom de Dieu dans le langage ; mais pas dans le langage objectivant propre à la condition spatio-temporelle, mais dans le parler existentiel, dont Heidegger a fait la théorie, qui est celui de l’expérience humaine et interpersonnelle, en tant que Dieu donne sens à ma vie. Il est alors possible de parler de lui avec sens, dans la mesure où Dieu se fait appréhender comme le Tout-Autre par l’obéissance de la foi.Following Ebeling, René Marlé became interested in the principal question of Bultmann “What meaning does talk about God have ?”, to the extent that the title of his book on Ebeling came from there, Speaking about God Today. The question is not about the meaning of the word God, not about knowledge of God, but about the sense in talking about God : it is situated, therefore, in the field of hermeneutics , that of the analysis of language.“If you want to talk about God“, Bultmann said, “you must necessarily talk about yourself”. He means that one cannot speak of God except from personal experience of having encountered Him, of having encountered Him through his Word. He does not, then, forbid introducing the name of God in language ; but not in the objectivizing language that belongs to the space-time condition, but rather in existential speech, about which Heidegger theorized. It is that of human and interpersonal experience, in so far as God gives meaning to my life. Then it is possible to speak of Him meaningfully, to the extent that God makes Himself understood as the Wholly Other by the obedience of faith. (shrink)

Güzellik ve sanat iç içe geçmiş iki kavramdır. Bir bakıma güzellik, sanatın özüdür denilebilir. Her sanat dalında olduğu gibi hat sanatında da güzeli arama arzusu ve eşsiz eserler ortaya koyma çabası, hattatları sabırla çalışmaya ve kendi sınırlarını zorlamaya sevk etmiştir. Bir kitap sanatı olan hüsn-i hattın kelime manasının “güzel yazı” olmasına mukabil, daha iyisini yazmak uğruna harcanan çaba yorucu ve zahmetlidir, ancak sabırla çalışan elbette ki karşılığını alır. Başka bir deyişle “Muhakkak ki Allah güzeldir, güzeli sever!” hadis-i şerifi ışığında bu (...) sanata gönül verenler, yazıyı daha muntazam yazma hususunda büyük ölçüde gayret gösterirler. Kişinin muntazam yazmayı başarması ise, sistematik çalışmasına bağlıdır. Yazıyı kaidelerine uygun ve ölçülü yazabilmek bıkmadan usanmadan, karamsarlığa kapılmadan çalışmakla mümkündür. Bu sebeple gerek öğrenme aşamasında ve gerekse sonrasında, harfler defalarca çalışma kâğıdına yazılarak el melekesi artırılır. Kelimeler ve harfler kâğıda kimi zaman noktalanıp ölçülendirilerek, kimi zaman da noktalanmadan yazılır. Talim amaçlı yapılan bu çalışmalar, başka bir deyişle karalamalar, hat sanatının temeli niteliğindedir. Arap alfabesiyle yazılan ve “karalama” adı verilen el alıştırmaları yazıyla uğraşan kişinin o an irticalen elinden çıkan harf veya kelimelerden oluşur ve çoğu zaman bir anlam ifade etmez. Bu çalışmanın amacı, karalamaların estetik unsurlarını ele almak ve zaman içerisinde uğradığı değişime mercek tutmaktır. Hattatların bu özgür yorumları gün geçtikçe daha fazla önemsenmekte ve hayranlık uyandırmaktadır. Harf bünyesini oluşturan kaidelerin dışında satır ve sınırlara bağlı kalmadan yazılan bu yazılar kendi içinde bir kompozisyon oluşturmakta ve çoğu zaman yazan kişiyi dahi hayrete düşürecek özgün çalışmalar ortaya çıkabilmektedir. The emergence of the two great late modern crises—economic and environmental—has prompted calls for a return to Marx. This article describes a Marxian account of the 2008 economic crisis relating it to the phenomena of job polarization, de-industrialization, the decline of the middle class, and political populism in Europe and elsewhere. These are argued to spring from political mobilization due to certain kinds of capability deprivations as understood in Amartya Sen’s capability approach. The article demonstrates the continued relevance of Marx (...) for philosophy of the social sciences as well as for a better understanding of the future challenge of maintaining societal stability in the West. Sen’s capabilities approach offers a radical generalisation of the conventional approach to welfare economics. It has been highly influential in development and many researchers are now beginning to explore its implications for health care. This paper contributes to the emerging debate by discussing two examples of such applications: first, at the individual decision making level, namely the right to die, and second, at the social choice level. For the first application, which draws on Nussbaum’s list of capabilities, it is argued (...) that many capabilities are ambiguously or indirectly related to the right to die, but the ability to form a concept of the good life and plan one’s own life provides a direct justification for such a right. In the second application, the focus is specifically on healthcare rationing and it is argued that, although not committed to age based rationing, the capabilities approach provides a more natural justification of age related access to health care than the fair innings argument, which is often used to justify the alleged ageism inherent in quality adjusted life years maximisation.
