In this essay, I draw the discourses around bestiality/zoophilia into the realm of queer theory in order to point to a new form of animal advocacy, something that might be called, in shorthand, loving animals. My argument is quite simple: if all interdicts against bestiality depend on a firm notion of exactly what sex is (and they do), and if queer theory disrupts that firm foundation by arguing that sexuality is impossible to define beforehand and pervades many different kinds of (...) relations (and it does), then viewing bestiality in the frame of queer theory can give us another way to conceptualize the limitations of human exceptionalism. By focusing on transformative connections between humans and animals, a new form of animal advocacy emerges through the revolutionary power of love. (shrink)

Erkennen wir die Welt so, wie sie wirklich ist oder konstruieren wir die Wirklichkeit, in der wir leben? Der einführende Artikel vom Herausgeber und der Beitrag von E. von Glasersfeld wollen zeigen, dass diese Streitfrage sich durch die ganze abendländische Philosophiegeschichte zieht. In dem Sammelband wird der Streit auf der Grundlage alter und neuer Argumente noch einmal ausgefochten. Stützen sich die einen auf die wissenschaftliche Erforschung unseres Gehirns und unserer kognitiven Fähigkeiten, um ihre These der Nichterkennbarkeit einer von uns unabhängig (...) existierenden Welt zu untermauern, so meinen die anderen, diese Argumentation sei zirkulär, ja, habe der radikale Konstruktivismus recht, so sei er widersprüchlich und damit falsch. Hinter dem konstruktivistischen Paradigma verberge sich zudem letztlich ein naiver Naturalismus, der glaubt, mit Hilfe wissenschaftlicher Forschungen allein erkenntnistheoretische Aussagen machen zu können, so die Argumentation von H.J. Wendel. Hingegen sind es vor allem Literatur- und Sozialwissenschaftler, die in etwas abgewandelter Form den Konstruktivismus durchaus als wissenschaftliches Paradigma akzeptieren. So verteidigt Wolfgang Frindte einen Sozialen Konstruktivismus, der die Auffassung vertritt, wir erzeugten unsere Wirklichkeit zusammen im Diskurs. S.J. Schmidt geht davon aus, dass soziale Systeme über Wirklichkeitsmodelle verfügen, die in der gesellschaftlichen Evolution über die Konstitution und Thematisierung für essentiell gehaltener Unterscheidungen entstehen. Verschiedene Beiträge beziehen sich explizit auf die Theorie von Humberto Maturana. Busse, Locker und Nüse erörtern in ihren Aufsätzen besonders die Problematik, die sich aus dem Konzept der Autopoiese und der daraus resultierenden Geschlossenheit des zentralen Nervensystems ergeben. O. Breidbach nimmt auf die biologische Forschung Bezug und zieht den es noch viel zu verfrüht ist, um auf dem heutigen Kenntnisstand bereits Aussagen über unsere Erkenntnisfähigkeit zu machen. Einige Beiträge befassen sich mehr mit den praktischen Auswirkungen konstruktivistischer Annahmen z.B. in der Familientherapie (Stierlin) oder in der Lerntheorie (Simon). In public communication contexts, such as when a company announces the proposal for an important organizational change, argumentation typically involves multiple audiences, rather than a single and homogenous group, let alone an individual interlocutor. In such cases, an exhaustive and precise characterization of the audience structure is crucial both for the arguer, who needs to design an effective argumentative strategy, and for the external analyst, who aims at reconstructing such a strategic discourse. While the peculiar relevance of multiple audience is (...) often emphasized in the argumentation literature and in rhetorical studies, proposals for modelling multi-audience argumentative situations remain scarce and unsystematic. To address this gap, we propose an analytical framework which integrates three conceptual constructs: Rigotti and Rocci’s notion of communicative activity type, understood as the implementation of an interaction scheme into a piece of institutional reality, named interaction field; the stakeholder concept, originally developed in strategic management and public relations studies to refer to any actor who affects and/or is affected by the organizational actions and who, accordingly, carries an interest in them; the concept of participant role as it emerges from Goffman’s theory of conversation analysis and related linguistic and media studies. From this integration, we derive the notion of text stakeholder for referring to any organizational actor whose interest becomes an argumentative issue which the organizational text must account for in order to effectively achieve its communicative aim. The text stakeholder notion enables a more comprehensive reconstruction and characterization of multiple audience by eliciting the relevant participants staged in a text and identifying, for each of them, the interactional role they have, the peculiar interest they bear and the related argumentative issue they create. Considering as an illustrative case the defense document issued by a corporation against a hostile takeover attempt made by another corporation, we show how this framework can support the analysis of strategic maneuvering by better defining the audience demand and, so, better explaining how real arguers design and adapt their topical and presentational choices. The article explores similarities between the philosophies of Zhuangzi and Aristippus, focusing in particular on play and eudaimonism. The main thesis is that both authors encourage the cultivation of a playful mindset, defined in the paper as the “ludic self”, which operates as a strategy for leading a flourishing life. By shaping a fluid, unstructured identity, the ludic self promotes negative subtraction from the structuring power of social nexus and proactive adaptation to shifting circumstances. Furthermore, some aspects of these philosophies (...) present an inter-disciplinary convergence with scientific findings from the psycho-biology of play, concerned with the mobilization of cathected energies and the prevention, or resolution, of addictive states. These promising connections with the fields of psychology and biology also represent an original contribution in respect to the existing debates within Zhuangzi studies, and scholarship on the Cyrenaics. From a methodological point of view, the article pursues what Rorty defines as a “rational reconstruction”, which involves a re-interpretation of past philosophies in light of present debates, ideas and vocabularies with the aim of engaging a trans-cultural, trans-historical dialogue. The value of this operation relies upon the universality of human experience, which always allows re-interpretation and re-actualization of past philosophies as a dialogical exercise of questioning otherness within a hermeneutic framework. Stress-induced brain-mediated immunoregulation is effected by two pathways: autonomic outflow and (neuro)endocrine outflow. Particular attention is given to the interaction-effects of chronic an acute stress. Recent data have established that cells of the immune system produce neuro-peptides and hormones. In concert with cytokines released by these immune cells the brain can be informed on the nature of ongoing immune activity. The significance of conditioning of immune responses is discussed.

This article proposes a more culturalist and variegated conception of the individual than that presented by individualization theorists. Inspired by the approach of the individual advocated by Émile Durkheim, Talcott Parsons and John Meyers, it first outlines the general script of the individual-as-actor that informs modern individualism as well as the generic characteristics that are routinely attributed to persons such as agency and free will. It subsequently reconstructs three predominant interpretations of this general script, i.e. utilitarian, moral and expressive individualism. (...) For each variant, the intellectual genesis and overall definition of the institutionalization in specific societal domains and the dominant articulations in social theory are briefly presented. With this threefold distinction, the aim is to synthesize the extensive literature on individualism and to show the sociological strengths of approaching subjectivity in terms of institutionalized scripts. The interactive nature of the Internet is seen by some as a technological innovation that might boost participation in politics and civic affairs. That potential, however, is clouded by imprecise definitions of interactivity found among scholars and practitioners alike. Evaluation of state legislature Web sites found them to not be very interactive under most definitions of the term. Chief technology officers of the legislatures appear to differ as to which site features promote interactivity. In this paper I sketch a socially situated account of responsible agency, the main tenet of which is that the powers that constitute responsible agency are themselves socially constituted. I explain in detail the constitution relation between responsibility-relevant powers and social context and provide detailed examples of how it is realized by focusing on what I call ‘expectations-generating social factors’ such as social practices, cultural scripts, social roles, socially available self-conceptions, and political and legal institutions. I then bring my account (...) to bear on the debate about the exculpatory potential of moral ignorance. I show that a prominent position in this debate – the position that denies that moral ignorance exculpates – is grounded on an individualistic and acontextualist conception of moral capacities, moral cognition, and blameworthiness, and that this conception leads those philosophers who endorse it to make a number of questionable claims regarding the ability of ordinary agents to overcome their moral ignorance and the culpability they bear for the latter. I conclude by indicating how my socially situated account addresses the issue of moral ignorance. (shrink)

The United Nations Convention on the Rights of the Child (UNCRC) is presented and understood as the primary reference point regarding questions of children’s rights. However, the UNCRC is not a neutral instrument deployed to meet the rights of children: it embodies a specific perception of the child, childhood and citizenship. The interpretation of the UNCRC from the point of view of children’s legal status emphasises the autonomy of children; the focus is on the rights that children possess. Conversely, the (...) social-political interpretation of the UNCRC addresses the question of how the rights of children can be realised. The Internet, not unlike previous communication technologies, has been predicted to dramatically change the nature of democracy. The interactive nature of Web sites, in particular, is seen as the basis for a new cyberdemocracy. Although the definition of interactivity is less than precise, an evaluation of state legislature Web sites finds them lacking many features that could be considered interactive. Furthermore, the degree of a site’s interactivity was not strongly correlated to a site’s use. Web sites can also foster interaction, (...) both on- and off-site, through interactive and noninteractive features. When sites were examined for their potential to foster interaction, there was a strong relationship with site use. The current focus on interactivity may obscure the potential to promote interaction and lead to an overemphasis on interactive features that are sometimes nothing more than high-tech gimmicks. Web sites of the 50 state legislatures are evaluated on five criteria: content, usability, interactivity, transparency, and audience. An overall quality score for each site was computed. The evaluation revealed a wide range of quality in the sites, including that of features or aspects that could possibly foster citizen participation. The higher rated sites help define “best practices” in this regard and provide suggestions as to how other states' sites might make improvements and possibly increase participation.

The pedagogy of Chan Buddhism relies on a binary trend: on the one hand, it requires careful study and active participation in formalized rituals and ceremonies; on the other hand, it requires the simultaneous emancipation from such means and practices, since the transmission of the truth has the character of suddenness and immediacy. In other words, the subversion of standard doctrinal interpretations and ordinary pedagogical strategies is itself an essential part of Chan training. This chapter analyzes the fourth Case of (...) the Blue Cliff Record, which exemplifies in a bright fashion the self-negating dialectics of Chan pedagogy. First, the analysis focuses on the narrated event; second, it moves at the level of meta-narrative, focusing on glosses and commentary. The purpose is to show that the subversive hermeneutics of Chan take place at both levels, narrative and meta-narrative, demanding (and favoring) a proactive and critical progression toward understanding. The present study consists of a cross-cultural analysis of the role of irony in the Blue Cliff Record. The analysis is structured in four chapters, one devoted to methodological concerns and three to equivalent types and functions of irony within the text, a pivotal literary work of the Chan Buddhist tradition. In relation to Chan studies, a discussion of irony is particularly important since the wide corpus of Chan literature includes a significant number and a consistent variety of ironic features (...) such as puns, wordplay, extravagant acts, and so forth. The idea of the present paper is that the ironic temperament of Chan is not a contingent circumstance, but a functional strategy purposely employed in textual compositions and oral communication with soteriological purposes. In Being and Time the broken piece of equipment (§ 16) or the dead body of an Other (§ 47) were seen as resulting from a process of transition (Übergang) between an original state and a position not so removed from it that one had to do with something entirely different. ‚The Origin of the Work of Art‘ takes a more radical approach: rather than leading toward a ‚no longer, but not yet‘, the movement here is toward a ‚no longer, (...) but already‘. Hence its famous thesis: either art is at work, or it is no longer art and already a mere object of art, a piece of art. Contrary to those of Heidegger’s readers who have suggested that his earlier views on transition would have saved him some of the (i.e. political) trouble the art essay runs into, the present paper aims to show that both the earlier and the later view fail to come to terms with what happens in transition as such. This is illustrated by an analysis of the corpse (ad BT § 47), and of junk (ad BT § 16) and leads us to a different approach to what is at stake in art and in the kind of Darstellung exemplified by it. The present article plays off two conceptions of the public sphere against one another. The first one sees in it a sign of what is already present in the private sphere, whereas the second regards it as a symbol that has to inscribe its own symbolic force into the private realm. That this is by no means a mere academic question becomes obvious by way of several examples analyzed at great length: the institution of mourning and the discussion about the (...) presence of religious symbols in the public sphere. An argument for considering the Muslim veil as a protection against the divine is put forward in an attempt to clarify the presuppositions of our current predisposal against it. Ultimately, pluralism should perhaps not just be taken to refer only to the presence of others outside of us who we are able to numerically count, but might be the more difficult plight of having to cope with an otherness within each of us. Should the latter be the case, then we are in need of a public sphere where we can leave behind and thus honor what is not only differentiating us from others but also from ourselves. (shrink)

The healing power of just forgiveness, without excusing injustice. Justice is closely related to forgiveness and the extent of the injustice gap experienced depends on how much or how little personal justice a wounded person desires. The experience of forgiveness includes two diverse forms of forgiveness: decisional and emotional forgiveness. Decisional forgiveness is controlling humans’ behavioural intentions, while emotional forgiveness replaces negative, unforgiving emotions with positive, other-orientated emotions. A victim may make a decision to forgive, but never feels emotional peace (...) about the decision to forgive. Both decisional and emotional forgiveness are experienced internally within a wounded person and depends on the social context of the transgression and the response to it. Justice can narrow the injustice gap, but rarely closes it, while forgiveness can heal the pain within the injustice gap. The sense of desired justice is to some degree justifiable, but by granting decisional forgiveness and experiencing emotional forgiveness a wounded person can slow down if not stop ruminating vengeful thoughts. Christians can forgive transgression and wrongdoing because they are responding in gratitude to God’s mercy, loving-kindness and forgiveness through Jesus’ death on the cross. God guides Christian believers through the example of Jesus’s humility to forgive wrongdoing and ultimately grow spiritually when Jesus requires decisional forgiveness and desires emotional forgiveness between victim and offender. Forgiveness is based on God’s forgiveness, while humans tend to both forgive and also pursue justice without excusing injustice. Humans are in their own power incapable of justly forgiving transgression, but God can guide people through the Holy Spirit to just forgiveness. (shrink)

In this article I discuss David Shoemaker’s recently published piece “Responsibility: The State of the Question. Fault Lines in the Foundations.” While agreeing with Shoemaker on many points, I argue for a more unified diagnosis of the seemingly intractable debates that plague (what I call) “responsibility studies.” I claim that, of the five fault lines Shoemaker identifies, the most basic one is about the role that the notion of deserved harm should play in the theory of moral responsibility. I argue (...) that the deep divide between those theorists who affirm and those who deny that moral responsibility is essentially about the justification of desert thus understood can be traced to the disagreement about whether the focus on the reactive attitudes by itself entails that moral responsibility has nothing to do with traditional questions about desert and free will. I then show that the seeming intractableness of the other four fault lines Shoemaker identifies is expectable and explicable in light of this more basic disagreement. After this diagnostic work, I conclude by suggesting a solution to the “morass” that has taken over responsibility studies: theorists working in the field should acknowledge that it has effectively bifurcated into two discrete subareas, which I suggest calling “retribution studies” and “interpersonal studies.” -/- . Many philosophers think that a necessary condition on moral blameworthiness is that the wrongdoer can reasonably be expected to avoid the action for which she is blamed. Those who think so assume as a matter of course that the expectations at issue here are normative expectations that contrast with the non-normative or predictive expectations we form concerning the probable conduct of others, and they believe, or at least assume, that there is a clear-cut distinction between the two. In this paper (...) I put this widespread assumption under scrutiny and argue that it’s mistaken: although predictive and normative expectations are indeed distinct, there is no sharp separation between them. On the contrary, predictive expectations can have a substantial bearing on normative expectations in two related ways: they can recalibrate what is reasonable to expect of agents when responsibility attributions are at stake and they can help to uncover previously undetected excusing conditions. I illustrate my claims with the famous bystander effect from social psychology and show that it yields predictive expectations that affect normative expectations in these two ways. (shrink)

Previous studies have consistently argued that employees' perception of their leaders as charismatic will positively influence their willingness to commit themselves to the ethical and philanthropic objectives of the organization. However, the empirical relationship between charisma and employee work effort is only modestly explored. This study hypothesizes that in decentralized, professional, and normative organizations characterized by demanding and philanthropic tasks, group belonging, in its capacity to socially and professionally support employees, is better suited to explain employee work effort than leadership (...) charisma. Hierarchical regression analyses based on data from a bishopric supported this assumption. Practical and theoretical consequences are discussed. (shrink)
