A correct understanding of Hart’s idea of justice and a detailed assessment of the connection between justice and law contributes to a better understanding of his legal-philosophical project. Always consistent with his argument on the separability between law and morality, Hart endorses an account of formal intralegal justice that is intimately connected to law, but not necessarily dependent upon non-legal principles of substantive justice. Hart’s theoretical commitment to a composite concept of formal justice encompasses two elements: first, the imperative to (...) treat like cases alike and different cases differently, and second, the underlying legal criteria that specify the relevant measure of likeness and difference. These elements of Hart’s theory of justice can be traced back to their doctrinal precedents in the texts of Aristotle, Sidgwick, Perelman, Ross, and Del Vecchio. Commentators and critics of Hart’s account of justice seem to agree that this account ought to be expanded by exploring its full effects on the foundations of Hart’s concept of law. When this is achieved, a third element of Hart’s intralegal justice emerges, namely, its rights-allocating function, which is deeply embedded in his account of the rule of recognition, his concept of a legal system, and his idea of law. This book proposes a new approach to the question of the juridical domain of natural law with reference to the classical tools of Thomistic formulation. This book adds something new to the intersection between the normative status of natural law and the essence of the juridical domain.

Over the past 10 years, Cognitive Linguistics has taken a quantitative turn. Yet, concerns have been raised that this preoccupation with quantification and modelling may not bring us any closer to understanding how language works. We show that this objection is unfounded, especially if we rely on modelling techniques based on biologically and psychologically plausible learning algorithms. These make it possible to take a quantitative approach, while generating and testing specific hypotheses that will advance our understanding of how knowledge of (...) language emerges from exposure to usage. This paper explores relationships between environment and education after the Covid-19 pandemic through the lens of philosophy of education in a new key developed by Michael Peters and the Philosophy of Education Society of Australasia. The paper is collectively written by 15 authors who responded to the question: Who remembers Greta Thunberg? Their answers are classified into four main themes and corresponding sections. The first section, ‘As we bake the earth, let's try and bake it from scratch’, gathers wider philosophical (...) considerations about the intersection between environment, education, and the pandemic. The second section, ‘Bump in the road or a catalyst for structural change?’, looks more closely into issues pertaining to education. The third section, ‘If you choose to fail us, we will never forgive you’, focuses to Greta Thunberg’s messages and their responses. The last section, ‘Towards a new normal’, explores future scenarios and develops recommendations for critical emancipatory action. The concluding part brings these insights together, showing that resulting synergy between the answers offers much more then the sum of articles’ parts. With its ethos of collectivity, interconnectedness, and solidarity, philosophy of education in a new key is a crucial tool for development of post-pandemic education. (shrink)

Purpose. The research is aimed at understanding the philosophical and journalistic heritage of M. Scheler during 1914-1919. "The philosophy of war" is regarded as the middle link between the phenomenological and anthropological stages of its philosophical evolution. The theoretical and methodological basis of the study is the philosophical legacy of Max Scheler, as well as the work of domestic and Western researchers devoted to this issue. Problems of Weltkriegsphilosophie become comprehensible based on the historical, logical and comparative principles of historical (...) and philosophical analysis, which allowed to theoretically reconstruct the cultural and historical context, philosophical sources and ideological intentions of the German philosopher. Originality. For the first time in domestic historical and philosophical thought, it proved that the works by Max Scheler of the First World War played an outstanding role in the formation of philosophical anthropology as a separate philosophical trend. Conclusions. The basis of the Weltkriegsphilosophie by Max Scheler is the philosophical comprehension of the war in which the thinker tries to see the high sacral meaning, where the sacrifices that the nation brings to the altar of victory are not in vain: the nation is rallying this sacrifice, its readiness for it. According to Scheler, war is the most effective means of forming the so-called "love communities", to which he refers combat brotherhood, family and nation as a "collective personality", which recognizes itself through war. The philosopher is disappointed to some part with militaristic enthusiasm in his later military journalistic works and calls for a spiritual and moral renewal of Europe, fed from Christian roots. At the heart of this renewal should be the principle of personal solidarity, based on the Christian idea of love. However, Catholic universalism is an insufficient means for the formation of a "love community" and a new man who is co-creator of God that constitutes the main core of the philosophical anthropology of Max Scheler, which emerges in the 20s of the twentieth century. Based on this, the article affirms the existence in Sheler’s works of an intermediate stage between his phenomenology and philosophical anthropology – Weltkriegsphilosophie. (shrink)

This article explores contemporary approaches to the understanding and interpretation of the formation of inclusive society. The focus is on the investigation of the everyday experiences of individuals who face various limitations in their living conditions such as limited opportunities, special needs, and disabilities. The paper highlights the importance of considering the unique aspects of subjective time when systematically analyzing the functional characteristics and existential mechanisms of an inclusive society, which constitutes the living environment for people with disabilities. It points (...) out that the temporal intentionality of a mentally challenged individual manifests in a unique form of ordering, synchronization, and existence within various phenomena and events within the individual's mental imagery and inner experiences. The authors emphasize the necessity to differentiate two primary stages in an individual's perception and understanding of their actual existence—the evaluation stage and the stage of identifying prospects. The study shows how intentional temporality inherently transforms into individual time, revealing the peculiarities of internal experiences and the unique aspects of an individual's mental imagery. These are integral steps in the formation of a system of social events that are marked within the individual consciousness. The novelty of this study lies in the examination of intentionality within the framework of a disabled person's subjective time, a characteristic that is fundamentally individual yet resonates with the collective daily consciousness of disabled individuals within an inclusive micro-society. My intention in this text is to present the most significant contribution of some French philosophers and anthropologists to the notion of reconstruction and advancement of institutions. The paradox of change, reform or transformation of the institution – is an entirely new institution possible? How do institutions die? – lies in the difficulty or even impossibility to change something that manifests what we are as a group. If institutions really present or represent the relations among all of us, how can (...) they be changed in the first place? Whence the capacity for change? What allows for the idea of the “new”? This work analyzes the problem of the development of John Locke’s ideas on toleration, in particular the grounds of separation of church and state. The first part examines Locke’s arguments regarding the prerogatives of the magistrate towards ‘indifferent things’ and the religious sphere. I distinguish between three stages in the development of Locke’s view on toleration: a suspicion toward the plea for it (the Two Tracts); an implicit non-verbalized distinction between church and state, and support for toleration (An Essay on (...) Toleration); and toleration as a political right (A Letter Concerning Toleration, the Two Treatises and the later letters). The second part focuses on the definition of ‘commonwealth’ in A Letter Concerning Toleration. I outline two fundamental sets of interdependent arguments that Locke uses for the separation of church and state. The third part is dedicated to the sphere of the church and the dimensions of the duty of toleration. The relation between Locke’s views on toleration and political practice explains the shift between the three stages, and is explored throughout the paper. (shrink)

In this paper we give sufficient and necessary conditions for a one-element set of propositional connectives to be functionally complete. These conditions provide a simple and elegant characterization of functionally complete one-element sets of propositional connectives.

The subject of this study is materialism, understood in the broadest sense of this concept: both as a philosophical doctrine and as a way of life corresponding to a certain worldview position. The aim is to clarify the objective role of this worldview position in various fields of human activity. At the center of the research is the question of the essence of materialistic ideas about the world hiding behind the sensually given reality to man. The study consists of two (...) parts, published in separate articles. The first part is devoted to the origins of the materialistic worldview and the main question of philosophy, and in this, its second part, the question of the philosophical problems of non-classical physics is considered, the root of these problems is revealed, a comparative worldview analysis of the basic concepts of classical and non-classical physics is carried out and the overall result of the research is summarized. The methodology of this research is the principle of materialistic monism, according to which absolutely all phenomena of the human-cognizable world can be based only on something material, "influencing". The general conclusions of this study are as follows: the roots of the materialistic worldview go back to the origins of life, to such a condition of successful vital activity of living beings, which is inherently ideological; this condition, called by the author the Main Question of Life, is the historical forerunner of the Main Question of Philosophy; the worldview position, equivalent to the materialistic solution of the OVF, is inherent in the vital activity of absolutely all living beings; all people in their daily and practical activities are born materialists. In addition, this study clarifies the idea of the essence of materialistic teaching; shows the exclusivity of the materialistic worldview as the only true worldview; provides a refined definition of the concept of matter; proves the need to shift the "center of gravity" of modern materialistic teaching from dialectics to the principle of materialistic monism; formulates the missing requirement for scientific theories to ensure their ideological viability; shows the ideological inconsistency the main ideas of the new, non-classical physics. We discuss a number of fundamental aspects of modern cosmological concepts, from the phenomenological, observational, theoretical and epistemic points of view. We argue that the modern cosmology, despite a great advent, in particular in the observational sector, is yet to solve important problems, posed already by the classical times. In particular the stress is put on discerning the scientific features of modern cosmological paradigms from the more speculative ones, with the latter immersed in some aspects deeply into mythological world picture. [UE]For Teresa BrennanWhile waiting to leave Vienna in May of 1938, Sigmund Freud writes a letter to his son Ernst. “Two prospects,” he says, “keep me going in these grim times: to rejoin you all and—to die in freedom.” Almost sixty years later, Cathy Caruth comments (...) upon this letter, emphasizing that the last four words—“to die in freedom”—were written in English. It is here, Caruth suggests,in the movement from German to English, in the rewriting of the departure within the languages of Freud’s text, that we participate most fully in Freud’s central insight, in Moses and Monotheism, that history, like trauma, is never simply one’s own, that history is precisely the way we are implicated in each other’s traumas.[UE 23–24]And she concludes: “In this departure, in the leave-taking of our hearing, we are first fully addressed by Freud’s text, in ways we perhaps cannot yet fully understand” [UE 24].In this text I argue that Caruth’s understanding of trauma as “deeply tied to our own historical realities” [UE 12] offers a possibility to think anew our involvement in each other’s histories, as we examine what we mean by history, writing, and community. They rather suggest a different, aporetic understanding of the relation between history and reference, experience and writing.I will try to show that Caruth’s notion of trauma as unclaimed experience, together with our entanglement in each other’s histories, chart a history of the modern subject as a history of implication. This subject is recognized by its inextricable ties to what cannot be experienced or subjectivized fully. And this unfinished becoming, surviving and being with others, is the form of its being and its history. The subject in or of trauma is thus, for Caruth, culturally and politically a diasporic subject, en route toward subjectivity.DiasporaFreud—the one who wants to die in freedom—is running away from a genocide, just ahead of it, so to speak. The diaspora toward which he is going is a place where one simultaneously speaks English and another language. _Purpose._ The authors aim to reveal the influence of philosophical and esoteric principles on the formation and further development of Roberto Assagioli’s concept of psychosynthesis. _The theoretical basis_ of the study is determined by the latest methodological approaches in the study of the relationship between philosophical, psychological, and esoteric approaches in the study of the unconscious and the formation of a harmonious personality. _Originality._ For the first time, a systematic analysis of the anthropological foundations of Roberto Assagioli’s work has been (...) carried out in Ukrainian philosophical literature, the specificity of the connection between esoteric teachings and psychosynthesis has been revealed on the basis of a thorough study of primary sources and biographical evidence of the life and work of the famous Italian thinker. _Conclusions._ Psychosynthesis, which is one of the leading directions of modern psychology, has a rather multicultural philosophical and methodological basis. Its founder Roberto Assagioli, while developing his concept, was influenced by theosophical-esoteric, pragmatic kabbalistic, and Eastern religious concepts and practices. Unlike psychoanalysis, which saw the unconscious as physiological-naturalistic determinants of the human psyche and behavior, psychosynthesis considers the unconscious as a hidden potential for self-development of the individual. Roberto Assagioli went through a long and difficult way to finally form his own concept, which became the basis of the psycho-techniques of disidentification and work with subpersonalities, which help to discover the true transpersonal self, which is the source of human self-improvement. Modern discussions about the relationship between psychosynthesis and various forms of parapsychology once again testify to the synthetic nature of Assagioli’s teaching, which combines various psychotherapeutic practices. This is what gives psychosynthesis a new push for development in the conditions of wars, disasters, loneliness, and related psychological disorders. (shrink)

In diesem Aufsatz wird Schellings Begriff der Zeugung in der ersten Fassung seines Werkes Die Weltalter thematisiert. Mehrere Fassungen dieser unvollendeten Schrift lassen die Grundlage von den Schellings Überlegungen im Versuch erkennen, den Zeitbegriff von der mechanistischen Konzeption der verketteten Aufeinanderfolge zu befreien und die Zeit im Punkt des Unterschieds – der „Zeugung“ – zwischen der Vergangenheit, der Gegenwart und der Zukunft zu erfassen. In diesem Sinne wird der Ursprung der Zeit im breiteren Kontext der Entwicklung eines „Urwesens“, d.h. seiner (...) Selbstoffenbarung in der lebendigen Wirklichkeit interpretiert. Diese Selbstoffenbarung wird von Schelling als eine Differenzierung der ursprünglich potentiellen und unwirklichen Indifferenz von Subjekt und Objekt aufgefasst. Der entscheidende Punkt dieser Differenzierung liegt aber darin, dass die Indifferenz sich selbst von sich selbst scheidet und als der objektive Grund der eigenen lebendigen Subjektivität berwunden und hinter sich selbst zurückgelassen wird. Dieser Grund ist die Natur im Ganzen, die für das Subjektive sein immer schon vergangenes Sein darstellt. (shrink)

L e savoir théorique, d’après Oakeshott, ne peut absorber la diversité du monde étant donné qu’il fonctionne avec des catégories différentes de celles de la réalité qu’il cherche à saisir. Par conséquent, le rationalisme réduit la politique à la résolution de problèmes. Ce que recommande Oakeshott pour un retour à l’autonomie de la politique est l’émancipation dans l’association civile. (...) Cette dernière est constituée sur la reconnaissance commune des règles générales dans le cadre desquelles la politique devrait s’exercer sous forme de dialogue. Michael Oakeshott criticises rationalism in politics because it excludes everything that is not grounded in and justified by theory. Theoretical knowledge, according to Oakeshott, isn’t capable of absorbing the given diversity because it operates in different categories than the reality it seeks to grasp. As a consequence, rationalism reduces politics to problem- solving activity. Oakeshott’s formula for the return to autonomous politics is its emancipation in civil association, a framework constituted in terms of common recognition of general rules within which (...) politics in the form of conversation is to be exercised. Corrective to Oakeshott’s utopian project is given by Michel Foucault’s thought where it is best shown how common institutions, norms and laws are a result of very complex power relations. (shrink)

Teoretsko znanje, prema Oakeshottu, ne može apsorbirati raznolikost svijeta jer rukuje drugačijim kategorijama od onih koje pripadaju realnom svijetu. Posljedično, racionalizam svodi politiku na djelatnost rješavanja problema. Oakeshottova formula za povratak autonomiji političke djelatnosti jest njezina emancipacija u civilnom udruživanju, okviru koji se temelji na priznavanju općih pravila kao takvih, unutar kojeg politička djelatnost zauzima oblik razgovora. Korektiv Oakeshottovu utopijskom projektu nadaje se (...) u misli Michela Foucaulta gdje je najbolje demonstrirana ovisnost zajedničkih institucija, normi i zakona o vrlo kompleksnim odnosima moći. Michael Oakeshott kritisiert den Rationalismus in der Politik, da er im Vorhinein alles ausschließe, das einer theoretischen Grundlage bzw. Rechtfertigung entbehre. Theoretisches Wissen könne jedoch nicht, so Oakeshott, alle Mannigfaltigkeit der Welt in sich aufnehmen, denn es operiere mit anderen Kategorien, als in der realen Welt vorzufinden seien. Folglich werde nach rationalistischen Gesichtspunkten die Politik auf das L ösen von Problemen reduziert. Oakeshotts Formel für eine Rückkehr zur Autonomie politischen Handelns ist dessen Emanzipierung innerhalb der bürgerlichen Vereinigung als eines Rahmens, (...) dessen Grundlage die Anerkennung allgemein verbindlicher Regeln bildet und in dem das politische Handeln in Form von Unterhandlungen vor sich geht. Ein Korrektiv zu Oakeshotts utopischem Projekt ist das Denken Michel Foucaults, das am besten demonstriert, inwiefern gesellschaftliche Institutionen, Normen und Gesetze von äußerst komplexen Machtverhältnissen abhängig sind.
