No ancient authority has left us a clear account of how the judges at the Athenian dramatic festivals operated. We can therefore never know for certain what happened. But it may be possible to improve the reconstruction normally given, which does not look as if it could ever have yielded acceptable results. One thing that is very clear is that the choice of judges was taken seriously. Not only did it involve the Council, the Prytanies, and the Treasurers, but any (...) tampering with the panel from which the judges were eventually selected seems to have been punishable with death. Even the physical arrangements were quite complicated. Names approved by the Council were deposited in ten jars, one jar for each tribe but each jar containing several names, sealed by the Prytanies, held in safe-keeping on the Acropolis, and eventually brought down to the theatre, where the archon publicly broke the seals and drew out one name from each jar. At this stage of the process there emerged ten judges, one from each tribe. Their quality had been guaranteed by the Council's prior vetting of the panel, but their actual names were unpredictable because randomly selected from it. All had been done democratically and with equal representation of tribes, in perfect accord with normal Athenian practice. But now comes the difficulty. The paroemiographers record a proverb about judgement being in the lap of five judges — ν πντε κριτν γούνασι κεται; Lysias tells us of a judge whose vote was not counted; and Lucian, who likes to disguise a very careful antiquarianism behind an apparent casualness of style, says that at festival competitions the many know how to clap and hiss but that judgement is in the hands of seven or five or however many. ‘My own father’, Achilles says to Priam in the last book of the Iliad, ‘was a rich man and a powerful one. He was king of the Myrmidons, and he had a divine wife. But even so the gods gave him evils too. He had no family, only one son, and that son a παναώριος one. I do not look after him in his old age, but am far away, sitting here in Troy, inflicting misery on you and your children.’The (...) problem I propose to discuss is the meaning of παναώριος. The word is unique to this passage, and the standard translation ‘of all-untimely fate’ or ‘doomed to die young’ is open to many objections. I shall argue that by describing himself as ‘untimely’ what Achilles means is that he is someone who is always doing the wrong thing at the wrong time, a misfit. It may seem a petty point, hardly worth the long argument that will be needed to establish it. But it has consequences for our judgement of the Iliad as a whole. If the one interpretation is correct, then Homer is content to repeat his effects without regard to the situation of his characters, which in any other author we would call careless writing. On the other interpretation he is capable of focusing down to quite detailed nuances. The question is not therefore one of lexicology alone but also of literary criticism.The translation ‘all-untimely doomed’ has warrant from antiquity. Leaf quotes a scholium παντελ⋯ς ἄωρον ⋯ποθανούμενον, and the word ⋯ωρία is used by a scholiast at 1.505 to refer to the fate by which Achilles was to die early. (shrink)

For 150 years after Galileo’s condemnation in 1633, there were many references to the trial, but no sustained, heated or polarized discussions. Then came the thesis that Galileo was condemned not for being a good astronomer but for being a bad theologian ; it began in 1784–1785 with an apology of the Inquisition by Mallet du Pan in the Mercure de France and the printing in Tiraboschi’s Storia della letteratura italiana of an apocryphal letter attributed to Galileo but forged by (...) Onorato Gaetani. This thesis is not only untenable and false but inverts and subverts the truth; it proved to be long-lasting and widely accepted; so it may be labeled a myth. It was held by such writers as Bergier; Bergier; B; Feller; Cooper; Purcell; Marini; Reumont; Madden and Duhem. Afterwards, it was generally abandoned, its death knell being pope John Paul II’s speeches in 1979–1992. The newsletters appeared to be concocted from malicious gossip. 1The newspapers seemed to be published at the bidding of powerful political interests with little inclination to tell the (...) truth, 2and histories of recent events seemed to be based on faulty sources even when the writers endeavored to procure faithful accounts. “Truth is by nature elusive and slippery,” history theorist Agostino Mascardi admitted. All he could recommend as a defense for the inaccurate historian was the injunction against throwing the first stone: “Omnis homo mendax,” said David the holy king; and those who are such harsh critics of historians’ involuntary lies may well be astute trammelers of perfidy and deceit in their own lives.” 3He had no answer about historians who deliberately distorted the truth. In fact just when readers might have desired it most, from the earliest episodes of the Thirty-Years War to the last episodes of the Turkish Wars at the end of the century, the possibility of [End Page 487]gaining a realistic picture of the contemporary world seemed to be getting more and more remote.The argument of this article centers around a discussion of the cultural consequences of this late seventeenth-century trend. To some of the readers, writers, thinkers, and theorists in this period, the unreliability of information about their own time or about the past, however compounded by contemporary political and social circumstances, was nothing but a minor nuisance. To others it was a hint about the bad faith of the governments who influenced writers. To still others, this same unreliability raised deeply troubling questions about human nature and existence. It provided social and political reasons for historical skepticism, quite apart from one’s familiarity with Sextus Empiricus or the elite intellectual trends of the time. It placed everyday social and political reality in a new light, thus adding a more mundane element to the uneasy feeling produced by the new science and cosmology—the feeling, that is, of being borne along in uncontrollable currents whose exact nature the best minds nonetheless seemed incapable of understanding. On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

How do we use our mental images of the present to reconstruct our past? Maurice Halbwachs addressed this question for the first time in his work on collective memory, which established him as a major figure in the history of sociology. This volume, the first comprehensive English-language translation of Halbwach's writings on the social construction of memory, fills a major gap in the literature on the sociology of knowledge. Halbwachs' primary thesis is that human memory can only function within (...) a collective context. Collective memory, Halbwachs asserts, is always selective; various groups of people have different collective memories, which in turn give rise to different modes of behavior. Halbwachs shows, for example, how pilgrims to the Holy Land over the centuries evoked very different images of the events of Jesus' life; how wealthy old families in France have a memory of the past that diverges sharply from that of the nouveaux riches; and how working class construction of reality differ from those of their middle-class counterparts. With a detailed introduction by Lewis A. Coser, this translation will be an indispensable source for new research in historical sociology and cultural memory. Lewis A. In this article, we describe the influence of violations of community standards of fairness on subsequent ethical decision-making and emotions. Across two studies, we manipulated explanations for a common action, and we find that explanations that violate community standards of fairness lead to greater intentions to behave unethically than explanations that are consistent with community standards of fairness. We find that perceptions of justifiability mediate this relationship. We also find that individuals derive significant psychological benefits from engaging in unethical behavior (...) following perceived violations of fairness. (shrink)

Digital phenotyping is the term given to the capturing and use of user log data from health and wellbeing technologies used in apps and cloud-based services. This paper explores ethical issues in making use of digital phenotype data in the arena of digital health interventions. Products and services based on digital wellbeing technologies typically include mobile device apps as well as browser-based apps to a lesser extent, and can include telephony-based services, text-based chatbots, and voice-activated chatbots. Many of these digital (...) products and services are simultaneously available across many channels in order to maximize availability for users. Digital wellbeing technologies offer useful methods for real-time data capture of the interactions of users with the products and services. It is possible to design what data are recorded, how and where it may be stored, and, crucially, how it can be analyzed to reveal individual or collective usage patterns. The paper also examines digital phenotyping workflows, before enumerating the ethical concerns pertaining to different types of digital phenotype data, highlighting ethical considerations for collection, storage, and use of the data. A case study of a digital health app is used to illustrate the ethical issues. The case study explores the issues from a perspective of data prospecting and subsequent machine learning. The ethical use of machine learning and artificial intelligence on digital phenotype data and the broader issues in democratizing machine learning and artificial intelligence for digital phenotype data are then explored in detail. We argue in this paper that so-called new wave reductionism fails to capture the nature of the interlevel relations between psychology and neuroscience. Bickle (1995, Psychoneural reduction of the genuinely cognitive: some accomplished facts, Philosophical Psychology, 8, 265-285; 1998, Psychoneural reduction: the new wave, Cambridge, MA: MIT Press) has claimed that a (bottom-up) reduction of the psychological concepts of learning and memory to the concepts of neuroscience has in fact already been accomplished. An investigation of current research on the phenomenon (...) of long-term potentiation reveals that this claim overstates the facts. Both the psychological and the neural concepts involved have not yet stabilized and face further correction under the influence of both bottom-up and top-down selection pressures. In addition, psychological concepts often refer to functions, and functions are indispensable and irreducible. Function ascriptions pick out objective patterns involving historical factors and distal goals. This view of functions implies that psychological facts cannot be simply read off from the neurophysiological facts. Although psychological theorizing is constrained by neurophysiology (and vice versa), psychology remains distinct at least to some degree. (shrink)

This paper examines the ethics of using assistive technology such as video surveillance in the homes of people living with dementia. Ideation and concept elaboration around the introduction of a camera-based surveillance service in the homes of people with dementia, typically living alone, is explored. The paper reviews relevant literature on surveillance of people living with dementia, and summarises the findings from ideation and concept elaboration workshops, designed to capture the views of those involved in the care of people living (...) with dementia at home. The research question relates to the ethical considerations of using assistive technologies that include video surveillance in the homes of people living with dementia, and the implications for a person living with dementia whenever video surveillance is used in their home and access to the camera is given to the person’s family. The review of related work indicated that such video surveillance may result in loss of autonomy or freedom for the person with dementia. The workshops reflected the findings from the related work, and revealed useful information to inform the service design, in particular in fine-tuning the service to find the best relationship between privacy and usefulness. Those who took part in the workshops supported the concept of the use of camera in the homes of people living with dementia, with some significant caveats around privacy. The research carried out in this work is small in scale but points towards an acceptance by many caregivers of people living with dementia of surveillance technologies. This paper indicates that those who care for people living with dementia at home are willing to make use of camera technology and therefore the value of this work is to help shed light on the direction for future research. A growing literature has focused on understanding how to detect and deter unethical consumer behavior. In this work, we focus on a particularly important type of unethical consumer behavior, consumer insurance fraud, and we analyze a unique dataset to understand how experts investigate suspicious claims. Two separate but related literatures inform the process of investigating suspicious insurance claims. The first literature is grounded in field research and emphasizes the importance of secondary sources. The second literature is grounded in laboratory studies (...) that emphasize the importance of interpersonal interactions. Here we draw upon both literatures to consider the importance of claimant interviews within the context of many investigative actions and the potential for claimants to avoid interviews. In an empirical study using qualitative and quantitative data from auto insurance claim investigations, we analyze investigative chronologies conducted by skilled experts. In doing so, we find that even when investigators can access information from a variety of sources such as witnesses, databases, and physical evidence, claimant interviews are the most important step in determining whether or not claims are denied or paid. Furthermore, we identify interpersonal avoidance as an important signal of unethical claimant behavior. Our findings inform deception detection theory and practice. We identify implications for deception detection in business, particularly for consumer unethical behavior and insurance fraud investigations. (shrink)

Ethical care is beginning to be recognised as care that accounts for the views of those at the receiving end of care. However, in the context of palliative and supportive district nursing care, the patients’ and their carers’ views are seldom heard. This qualitative research study explores these views. Data were collected through semi-structured interviews with 26 patients with palliative and supportive care needs receiving district nursing care, and 13 of their carers. Participants were recruited via community nurses and hospices (...) between September 2010 and October 2011. Post-structural discourse analysis is used to examine how discourses operate on a moral level. One discourse, ‘busyness’, is argued to preclude a moral form of nursing care. The discourse of friendship is presented to contrast this. Discussion explores Gallagher’s ‘slow ethics’ and challenges the currently accepted ways of measuring to improve quality of care concluding that quality cannot be measured. (shrink)
