This is the first book in recent years to reconsider the shape and details of the English law of homicide, a topic avoided by governments in their plans for law reform. It discusses how the law should define murder, how it should respond to provoked killings, how it should deal with mentally abnormal killers, etc.

This paper describes a network of three interconnected, multidisciplinary research projects designed to investigate environmental health issues faced by First Nations in Canada. These projects, developed in collaboration with academia, used a participatory approach meant to build capacity, raise awareness, and initiate change. The first project, which began in British Columbia in 2008, gathered information on the traditional diet; for example, its composition, nutritional quality, and potential for chemical exposure. This 10-year, Canada-wide project served as a model for two follow-up (...) projects: one on biomonitoring and another on indoor air quality. All three projects provided community ownership over the data and communicated results in a culturally sensitive manner to encourage interest in research and initiate risk reduction activities. The Assembly of First Nations, a national advocacy organization representing over 630 First Nations communities across Canada, participated in all aspects of the research while coordinating communications and arranging timely dissemination of results. These projects showed how properly executed, community-based research can be a valuable tool for stimulating interest in scientific studies while promoting self-reliance, components often missing from academic research. In this paper we describe a few interrelated issues for validating theories that posit levels of consciousness. First, validating levels of consciousness requires consensus about the ordering of conscious states, which cannot be easily achieved. This problem is particularly severe if we believe conscious states can be irreducibly smeared over time. Second, the relationship between conscious states is probably sometimes intransitive, which means levels of consciousness will not be amenable to a single continuous measure. Finally, even if a multidimensional approach (...) to levels of consciousness is adopted, we argue that there are further problems for its validation. (shrink)

Future-bias is the preference, all else being equal, for negatively valenced events be located in the past rather than the future, and positively valenced ones to be located in the future rather than the past. Strong risk aversion is the preference to pay some cost to mitigate the badness of the worst outcome. People who are both strongly risk averse and future-biased can face a series of choices that will guarantee them more pain, for no compensating benefit: they will be (...) pain pumped. Thus, combining these preferences is rationally impermissible. Dougherty (2011) argues that this gives us reason to think that future-bias is rationally impermissible. This argument, and a similar one presented by Greene and Sullivan (2015), relies on the idea that if several preferences are not rationally combinable, then in the absence of some explanation of why they are not combinable, we should conclude that (at least) one of them is rationally impermissible. We take up this question by, inter alia, reflecting on the empirical results of a study we ran that probes people’s risk averse and future-biased preferences. We argue that the data, in conjunction with other considerations, suggests that we should not infer from the irrationality of the combination of these preferences to the irrationality of one of the preferences singly. We also argue that given the descriptive data about these preferences, there is no reason to think that, if one of them is rationally impermissible, then it is future-bias. (shrink)

Preston Greene (2020) argues that we should not conduct simulation investigations because of the risk that we might be terminated if our world is a simulation designed to research various counterfactuals about the world of the simulators. In response, we propose a sequence of arguments, most of which have the form of an "even if” response to anyone unmoved by our previous arguments. It runs thus: (i) if simulation is possible, then simulators are as likely to care about simulating simulations (...) as they are likely to care about simulating basement (i.e. non-simulated) worlds. But (ii) even if simulations are interested only in simulating basement worlds the discovery that we are in a simulation will have little or no impact on the evolution of ordinary events. But (iii) even if discovering that we are in a simulation impacts the evolution of ordinary events, the effects of seeming to do so could also happen in a basement world, and might be the subject of interesting counterfactuals in the basement world Finally, (iv) there is little reason to think that there is a catastrophic effect from successful simulation probes, and no argument from the precautionary principle can be used to leverage the negligible credence one ought have in this. Thus, if we do develop a simulation probe, then let’s do it. (shrink)

This book brings together an international group of scholars to discuss the ramifications of Heidegger's Black Notebooks for philosophy and the humanities. In contrast to both those who seek to exonerate Heidegger and those who simply condemn him, they urge careful reading and rereading of his work to turn Heideggerian thought against itself.

Heidegger's later thought is a thinking of things, so argues Andrew J. Mitchell in The Fourfold. Heidegger understands these things in terms of what he names "the fourfold"--a convergence of relationships bringing together the earth, the sky, divinities, and mortals--and Mitchell's book is the first detailed exegesis of this neglected aspect of Heidegger's later thought. As such it provides entré to the full landscape of Heidegger's postwar thinking, offering striking new interpretations of the atomic bomb, technology, plants, (...) animals, weather, time, language, the holy, mortality, dwelling, and more. What results is a conception of things as ecstatic, relational, singular, and, most provocatively, as intrinsically tied to their own technological commodification. A major new work that resonates beyond the confines of Heidegger scholarship, The Fourfold proposes nothing less than a new phenomenological thinking of relationality and mediation for understanding the things around us. Cultural concepts of distress are a recent attempt to understand psychological distress influenced by culture, separate from biomedical diagnoses that require equal attention and support for individuals and their families, both physically and emotionally. [1].

In the 1950s and 60s, Martin Heidegger turned to sculpture to rethink the relationship between bodies and space and the role of art in our lives. In his texts on the subject—a catalog contribution for an Ernst Barlach exhibition, a speech at a gallery opening for Bernhard Heiliger, a lecture on bas-relief depictions of Athena, and a collaboration with Eduardo Chillida—he formulates his later aesthetic theory, a thinking of relationality. Against a traditional view of space as an empty container for (...) discrete bodies, these writings understand the body as already beyond itself in a world of relations and conceive of space as a material medium of relational contact. Sculpture shows us how we belong to the world, a world in the midst of a technological process of uprooting and homelessness. Heidegger suggests how we can still find room to dwell therein. Filled with illustrations of works that Heidegger encountered or considered, _Heidegger Among the Sculptors_ makes a singular contribution to the philosophy of sculpture. (shrink)

Monism is our name for a range of views according to which the connection between dispositions and their categorical bases is intimate and necessary, or on which there are no categorical bases at all. In contrast, Dualist views hold that the connection between dispositions and their categorical bases is distant and contingent. This paper is a defence of Monism against an influential conceivability argument in favour of Dualism. The argument suggests that the apparent possibility of causal behaviour coming apart from (...) categorical bases is best explained by Dualism. We argue that Monism can explain the apparent possibility as well, if we take metaphysically alien laws — namely, laws whose metaphysical nature is alien to the actual world — into account. (shrink)

I explore the themes of health and help in Heidegger’s work before and after his treatment. I begin with Heidegger’s views on health while Rector in 1933–34 and his abandonment of these views by war’s end. A short while later, Heidegger’s breakdown occurs and the treatment under Gebsattel begins. Soon after his treatment, Heidegger (...) lauds what he terms a “broken-down” thinking, and I examine his contribution to a 1958 _Festschrift_ for Gebsattel to better articulate such a thinking. Lastly, I take up Heidegger’s remarks on the role of the medical profession in a technological age from a 1962 speech. In presenting this material, I hope to shed new light on a little known aspect of Heidegger’s career and biography and to situate philosophically his relationship with Dr. Gebsattel. (shrink)

Despite the importance of effective observational analysis in the technical aspects of climbing performance, limited research informs this aspect of climbing coach education. Thus, the purpose of the present research was to explore cognitive-perceptual mechanisms underpinning visual search strategies of expert and novice climbing coaches through the novel combination of eye-tracking technology and retrospective think-aloud methodology. Analysis of gaze data revealed expert climbing coaches to demonstrate fewer fixations of greater duration, and fixate on distinctly different areas of the visual display, (...) than their novice counterparts. Retrospective think-aloud interviews further demonstrated differences in the cognitive-perceptual mechanisms underpinning these visual search strategies, with expert coaches more cognisant of their visual search strategy. To expand, the gaze behaviour of expert climbing coaches was underpinned by hierarchical and complex knowledge structures relating to principles of climbing movement. This enabled expert coaches to actively focus on the most relevant aspects of a climber’s performance for analysis. Findings demonstrate the utility of combining eye tracking and retrospective think-aloud interviewing as a new, efficient methodology of capturing the cognitive-perceptual processes of climbing coaches to inform coaching education/strategies. "A new framework has been established across the United Kingdom with four key priorities. These priorities include helping patients receive a final diagnosis quickly, increasing rare disease awareness among healthcare professionals, better coordination of care, and improving access to specialist care, treatments, and drugs (DHSC, 2021).".

In order to improve our understanding of the components that reflect functionally important processes during reward anticipation and consumption, we used principle components analyses (PCA) to separate and quantify averaged ERP data obtained from each stage of a modified monetary incentive delay (MID) task. Although a small number of recent ERP studies have reported that reward and loss cues potentiate ERPs during anticipation, action preparation, and consummatory stages of reward processing, these findings are inconsistent due to temporal and spatial overlap (...) between the relevant electrophysiological components. Our results show three components following cue presentation are sensitive to incentive cues (N1, P3a, P3b). In contrast to previous research, reward‐related enhancement occurred only in the P3b, with earlier components more sensitive to break‐even and loss cues. During feedback anticipation, we observed a lateralized centroparietal negativity that was sensitive to response hand but not cue type. We also show that use of PCA on ERPs reflecting reward consumption successfully separates the reward positivity from the independently modulated feedback‐P3. Last, we observe for the first time a new reward consumption component: a late negativity distributed over the left frontal pole. This component appears to be sensitive to response hand, especially in the context of monetary gain. These results illustrate that the time course and sensitivities of electrophysiological activity that follows incentive cues do not follow a simple heuristic in which reward incentive cues produce enhanced activity at all stages and substages. Heidegger's reflections on grace culminate in the years 1949-54 where grace names a figure for the ineluctable exposure of existence. Heidegger rethinks the relationship between what exists and the world in which it is found as one that is always open to grace. For Heidegger, this world is what he terms the “dimension” between earth and sky. The relationship is only possible where existence is no longer construed as a self-contained presence but instead is thought as something between presence and (...) absence. In this essay, Heidegger's references to grace in five contexts are considered: the 1949 Bremen lectures, the 1951 essay “... Poetically Dwells Man...,” the 1953 “Dialogue on Language,” the 1951 lecture on “Language,” and the 1954 speech at his nephew's ordination. (shrink)

Likert scales are useful for collecting data on attitudes and perceptions from large samples of people. In particular, they have become a well-established tool in soundscape studies for conducting in situ surveys to determine how people experience urban public spaces. However, it is still unclear whether the metrics of the scales are consistently interpreted during a typical assessment task. The current work aims at identifying some general trends in the interpretation of Likert scale metrics and introducing a procedure for the (...) derivation of metric corrections by analyzing a case study dataset of 984 soundscape assessments across 11 urban locations in London. According to ISO/TS 12913-2:2018, soundscapes can be assessed through the scaling of 8 dimensions: pleasant, annoying, vibrant, monotonous, eventful, uneventful, calm, and chaotic. The hypothesis underlying this study is that a link exists between correlations across the percentage of assessments falling in each Likert scale category and a dilation/compression factor affecting the interpretation of the scales metric. The outcome of this metric correction value derivation is introduced for soundscape, and a new projection of the London soundscapes according to the corrected circumplex space is compared with the initial ISO circumplex space. The overall results show a general non-equidistant interpretation of the scales, particularly on the vibrant-monotonous direction. The implications of this correction have been demonstrated through a Linear Ridge Classifier task for predicting the London soundscape responses using objective acoustic parameters, which shows significant improvement when applied to the corrected data. The results suggest that the corrected values account for the non-equidistant interpretation of the Likert metrics, thereby allowing mathematical operations to be viable when applied to the data. This volume consists of two lecture series given by Heidegger in the 1940s and 1950s. The lectures given in Bremen constitute the first public lectures Heidegger delivered after World War II, when he was officially banned from teaching. Here, Heidegger openly resumes thinking that deeply engaged him with Hölderlin's poetry and themes developed in his earlier works. In the Freiburg lectures Heidegger ponders thought itself and freely engages with the German idealists and Greek thinkers who had provoked him in the (...) past. Andrew J. Purpose The purpose of this paper is to investigate perceived stressors and coping behaviours in student nurses on a pre-registration programme of study. Stress in student nurses has been identified with decreased emotional well-being and poor academic achievement. The significance of stress and coping behaviours in students during training has implications for education and practice. Design/methodology/approach The present study recruited 87 pre-registration student nurses in a cross-sectional design. Bivariate and multivariate analyses assessed the differences in field and year of study (...) and the students’ perceived stress and coping behaviours. Findings The findings showed that stress is a significant issue in nurse training. Fifty-three per cent of the participants had levels higher than the mean. Interestingly, the present study found that high-perceived stress was associated with avoidance behaviours. The most common type of perceived stress and ranked by highest factor were from written assignments and a lack of professional skills and knowledge. Their peer group and everyday life activities were shown as potential ways of coping with stressors. Thus, it seems reasonable to focus support on decreasing avoidant and enhancing stress-reducing behaviours. Practical implications Psychological stress and coping behaviours must be considered together, as perceived stress is bound by the ability to ameliorate stress by managing helpful and unhelpful behaviours. Originality/value The findings may suggest that a potential benefit could come from the provision of helpful strategies such as peer group support and reduction of avoidant behaviours. Also, there seems to be a need for greater mental health literacy in dealing with stress during training. (shrink)

Terrorism is a metaphysical problem that concerns the presence of beings today. Heidegger's own thinking of being makes possible a confrontation with terrorism on four fronts: 1) Heidegger's conception of war in the age of technological replacement goes beyond the Clausewitzian model of war and all its modernist-subjectivist presuppositions, 2) Heidegger thinks "terror" (Erschrecken) as the fundamental mood of our time, 3) Heideggerian thinking is attuned to the nature of the terrorist "threat" and the "danger" that we face today, 4) (...) Heidegger rethinks the notion of "security" in a manner that alerts us to the oxymoronic character of "homeland security." The epoch of terrorism is likewise the era of political transformation that Heidegger identifies with "Americanism." In this essay an effort is made to think terrorism qua metaphysical problem and to inquire into the perhaps privileged role of America for the thinking of terrorism today. (shrink)

To give oneself over to the essence of pain is to give oneself over to the world. Pain is a fact of the world and in accepting this fact, in entering that world, we break with the tradition of metaphysical subjectivity that dates back to the Greek determination of the human as zôon logon echon. For Heidegger, pain is the surest sign that we wholly belong to this world; in fact, pain is nothing other than our contact with the world (...) and our “openness” to it. In Four Seminars, Heidegger reviews the entire trajectory of his thought and offers unique perspectives on fundamental aspects of his work. "Torture and Photography: Abu Ghraib" attempts to think the mutual relationships between torture and photography, addressingissues of objectivity, publicity, and distance. In a world where bodies have been divested of human rights, the objectification of the camera seems the perfect complement. Exploring the "prophylactic" character of film, the author proposes human "touch" as always in excess of this objectified state of affairs. Along with memoranda from the Bush administration on the issues of detainee rights and the role of torture in (...) interrogation, the essay engages with the theoretical work of Susan Sontag, Elaine Scarry, Michel Foucault, Georges Bataille, Erwin Straus, and Giorgio Agamben in staking out the intersection of torture and photography. German Romanticism is a thinking of life as exposed. Philosophical conceptions of botanical life are paradigmatic of this. Goethe, Schelling, and Hegel each address the plant in their respective philosophies of nature. This article traces the connections and divergences in their thinking of plants, focusing on the role of love, lack, and exposure in order to present the plant as a peculiarly apt figure for considerations of life as exposed.

In this work, I attempt a four-part task: to explicate Heidegger's notion of the Fourfold, to show its necessary relation to technology, to think the limit that separates these, and to show how this constellation of the Fourfold and technology escapes from the "metaphysics of presence" with which Heidegger has been charged. ;1. The Fourfold is the belonging together of Earth, Sky, Mortals, and Divinities. Heidegger inherits the components from Holderlin, but transforms then in his thought. The gathering of these (...) four goes to make up the presencing of a singular and delimited entity . Such a thing exists as unique and irreplaceable. ;2. This singular mode of presence is only understandable against the background of limitless technological circulation. Influenced by Ernst Junger, Heidegger sees technology as setting into place a world of instantaneous replacement and sameness. The name for this manner of replaceable presence is "Bestand ." ;3. The unworld of technology is no simple "opposite" to the Fourfold, however. Rather the two modes of presence belong together. Heidegger repeatedly emphasizes how there can never be a complete loss of world in the enframing of technology. Conversely, the Fourfold is never free of the Bestand. A play of revelation and concealment is operative here and intimately related to Heidegger's new notion of essence. I examine this intricate and intimate co-belonging of technology and the Fourfold. ;4. This interpretation is used to counter the charge that Heidegger would think in terms of metaphysical presence, i.e., in terms of complete, self-present, and pure presence. Such a charge is leveled in the early work of Jacques Derrida. I show that Heidegger's thinking is already a thought of the trace. Since there is consequently no total presence or absence for Heidegger , there can be no simple overcoming of metaphysics either. Metaphysics cannot be so easily left behind, but must undergo a transformation . This is nothing more than a recognition of the trace and its place at the limit of singular, finite existence. ;The first chapter treats the circulation of technology, the remaining four address in series the elements of the Fourfold. Heidegger’s 1938–1939 seminar on Nietzsche ’s On the Utility and Liability of History for Life continues Heidegger’s grand interpretation of Nietzsche as a metaphysical thinker of presence. Nietzsche ’s conceptions forgetting, memory, and even life itself, according to Heidegger, are all complicit in the privileging of presence. Simultaneous with his seminar, Heidegger is also compiling the notebook, Die Geschichte des Seyns, 1938–1940, wherein he sketches his own conception of history. Examining Heidegger’s criticisms of Nietzsche in the light of his contemporaneous (...) notebook allows us to articulate Heidegger’s concern for history and for “what has-been” as a thinking of the “coming” of being. For Heidegger, to exist historically is to exist as something sent, something arriving, as something that “comes” to us. This coming of history is an ontological determination of all that is, no longer construed as present-at-hand objects, but as always arriving, relational beings. After presenting Heidegger’s view of the coming of history, I return to Nietzsche ’s Utility and Liability of History to draw attention to an aspect of his text that is neglected by Heidegger, that of the political. The concluding sections of Nietzsche ’s text confront the politics of the present, in both senses of the genitive, in order to rally against the closure of society. In the conclusion to the paper, I turn to the political dimension of Nietzsche ’s thinking of history with an eye to how it might elude Heidegger’s interpretation. (shrink)
