A theory is presented which proposes that knowledge acquisition involves direct perception of schematic information in the form of structural and transformational invariances. Individual components with salient verbal descriptions are considered conscious place-holders for non-conscious invariant schemes. It is speculated that theories positing mental construction have three related causes: The first is a lack of consciousness of the schema processing capacities of the right hemisphere; the second is the paucity of adequate words to express schematic relationships; and the last involves (...) the dominance of verbal processes in consciousness. Philosophical theories are reviewed and schematic data relevant to biological survival is offered. Applications to education are suggested. (shrink)

A number of late Stoic sources describe either ethical concepts or a supposed universal belief in gods as being innate in the human animal. Though Chrysippus himself is known to have spoken of "implanted preconceptions" (ἔμφυτοι προλήψεις) of good and bad, scholars have typically argued that the notion of innate concepts of any kind would have been entirely incompatible with his theory of knowledge. Both Epictetus' notion of innate concepts of good and bad and the references to an innate belief (...) in gods by other philosophers of the Roman era are thus generally held to be later developments, probably owing to a Platonist-Stoic syncretism. Review of the evidence, however, shows that Chrysippus, like Epictetus, held ethical concepts to represent a special category of conception in that their formation was guaranteed by oikeiôsis. Unlike other concepts, that is, these represent a formal conceptualization of an innate tendency to distinguish between things fitting for one's constitution and things not fitting that all animals, according to the Stoics, bring to their empirical experiences. While the notion that human belief in gods is similarly innate does seem to have been a later development, it too was explained with reference to oikeiôsis rather than resulting from a simple "syncretism.". The policy of earmarked paternity leave aims to promote mothers’ position in the labor market and fathers’ relationship with their child. Critics argue that the policy prevents parents from pursuing their own ideas about what is best for them. This provides reason to consider whether the policy is paternalistic or, in other ways, disrespectful of parental autonomy. I argue that the state implicates itself in the gender inequalities that result from parents’ unequal parental leave agreements when the state financially facilitates (...) such agreements. This argument for earmarked paternity leave is not disrespectful of parental autonomy. (shrink)

Unethical decision-making behavior within organizations has received increasing attention over the past ten years. As a result, a plethora of studies have examined the relationship between gender and business ethics. However, these studies report conflicting results as to whether or not men and women differ with regards to business ethics. In this article, we propose that gender identity theory [Spence: 1993, Journal of Personality and Social Psychology64, 624–635], provides both the theory and empirical measures to explore the influence of psychological (...) gender traits and gender-role attitudes on ethical perceptions of workplace behaviors. Statistical analyses of the data reveal that based on sex alone, no differences occur between men and women in their ethical perceptions. Yet, when a multidimensional approach to gender is applied, results show that expressive traits and egalitarian gender-role attitudes contribute to both men’s and women’s propensity to perceive unethical workplace behaviors as unethical. The implications of these findings and suggestions for future research are presented. (shrink)

This article investigates the hitherto under-examined relations between affirmative action, paternalism and respect. We provide three main arguments. First, we argue that affirmative action initiatives are typically paternalistic and thus disrespectful towards those intended beneficiaries who oppose the initiatives in question. Second, we argue that not introducing affirmative action can also be disrespectful towards these potential beneficiaries because such inaction involves a failure to adequately recognize their moral worth. Third, we argue that the paternalistic disrespect involved in affirmative action is (...) alleviated when the potential beneficiaries’ preferences against such initiatives are adaptive. We conclude that although there is a relevant sense in which paternalistic affirmative action is disrespectful, it may well be more disrespectful not to pursue such policies. (shrink)

What is ethics all about? In this book Herbert McCabe suggests that it is about loving, obeying laws, and talking to people.

A common objection to paternalism concerns its expressive content. Many reject paternalistic policies and actions on the ground that they arguably involve insulting expressions of disrespect toward those subjected to them. The paper challenges this view. It argues that refraining from acting paternalistically can be disrespectful. Specifically, the paper argues that there is a relevant way in which A disregards the moral worth of B if A stands idly by when B is about to act very imprudently. If true, treating (...) others with equal respect and concern, as relational egalitarians and others rightly ask us to do, will somewhat surprisingly sometimes involve treating them paternalistically. In defense of nudging policies, proponents have pointed out that choice architecture is inevitable. However, critics have objected that shaping people’s choices in an intentional way is not inevitable and involves an objectionable substitution of judgment, with the choice architect imposing his will on others. Accordingly, the inevitability of choice architecture in general does not provide reason to accept intentional nudges. In contrast to this view, the paper argues that precisely because the choice architects will unavoidably contribute to people’s choices, (...) it is permissible for them to consider the content of the choices that their choice architecture promotes. Specifically, I argue that it is often within choice architects’, including states’, own legitimate sphere of control whether they want to contribute to other people’s behaviors through their organization of the choice architecture. Even after two millennia, through her adherence to the Hegelian/sartrean model of transcendence versus immanence, Simone de Beauvoir perpetuated the valorization of male risk-taking over the creation and nurture of life, obligations she assigned solely to the female. Nonetheless, her dispassionate, meticulous, phenomenological description of women's lived experience in The Second Sex, combined with her insistence that women, in spite of their oppression, must choose to become subjects, to `engage in freely chosen projects', has spurred contemporary feminist theorists to expand (...) the definition of the ethical and the moral to value female experience. The emancipatory discourse, therefore, has been extended by the work of feminists such as Martha Nussbaum, Luce Irigaray and Carol Gilligan, who insist upon the inclusion of marginalized `others' in the definition of `human being' and `ethical activity'. What justifies differences in the acceptance of paternalism towards competent minors and older people? I propose two arguments. The first argument draws on the widely accepted view that paternalism is easier to justify the more good it promotes for the paternalizee. It argues that paternalism targeting young people generally promotes more good for the people interfered with than similar paternalism targeting older people. While promoting people's interests or well-being is essential to the justification of paternalism, the first argument has certain (...) unfair implications in that it disfavours paternalism towards the worse off. The second argument caters to such fairness concerns. It argues that priority or inequality aversion supports age-differentiated paternalism because young people, who act imprudently and thereby risk their interests or well-being, are worse off than older people who act in similar ways. I suggest that both arguments are pertinent in evaluating specific paternalistic acts and policies. (shrink)

People often discriminate based on negative or positive stereotypes about others. Important examples of this are highlighted by the theory of ambivalent sexism. This theory distinguishes sexist stereotypes that are negative (hostile sexism) from those that are positive (benevolent sexism). While both forms of sexism are considered wrong towards women, hostile sexism seems intuitively worse than benevolent sexism. In this article, we ask whether the difference between discriminating based on positive vs. negative stereotypes in itself makes a morally relevant difference. (...) We suggest that it does not. By examining a number of prominent accounts of what makes discrimination wrong, we defend the Moral Irrelevance View according to which stereotype valence is irrelevant to the moral evaluation of discrimination, all else equal. The remember–know paradigm is one of the most widely used procedures to examine the subjective experience associated with memory retrieval. We examined how the terminology and instructions used to describe the experiences of remembering and knowing affected remember–know judgments. In Experiment 1 we found that using neutral terms, i.e., Type A memory and Type B memory, to describe the experiences of remembering and knowing reduced remember false alarms for younger and older adults as compared to using the terms Remember and (...) Know, thereby increasing overall memory accuracy in the neutral terminology condition. In Experiment 2 we found that using what we call source-specific remember–know instructions, which were intended to constrain remember judgments to recollective experiences arising only from the study context, reduced remember hits and false alarms, and increased know hits and false alarms. Based on these data and other considerations, we conclude that researchers should use neutral terminology and source-specific instructions to collect the most accurate reports of the experiences of remembering and knowing arising from the study context. The sheer gamut of issues impacting transgender health equity may seem overwhelming. This article seeks to introduce readers to the breadth of topics addressed in this symposium edition, exemplifying that transgender health equity is a global issue that demands an interdisciplinary approach.

The purpose of this paper is to provide an account of the epistemology and metaphysics of universe creation on a computer. The paper begins with F.J.Tipler's argument that our experience is indistinguishable from the experience of someone embedded in a perfect computer simulation of our own universe, hence we cannot know whether or not we are part of such a computer program ourselves. Tipler's argument is treated as a special case of epistemological scepticism, in a similar vein to `brain-in-a-vat' arguments. (...) It is argued that the hypothesis that our universe is a program running on a digital computer in another universe generates empirical predictions, and is therefore a falsifiable hypothesis. The computer program hypothesis is also treated as a hypothesis about what exists beyond the physical world, and is compared with Kant's metaphysics of noumena. It is proposed that a theory about what exists beyond the physical world should be formulated with the precise concepts of mathematics, and should generate physical predictions. It is argued that if our universe is a program running on a digital computer, then our universe must have compact spatial topology, and the possibilities of observationally testing this prediction are considered. The possibility of testing the computer program hypothesis with the value of the density parameter Omega_0 is also analysed. The informational requirements for a computer to represent a universeexactly and completely are considered. Consequent doubt is thrown upon Tipler's claim that if a hierarchy of computer universes exists, we would not be able to know which `level of implementation' our universe exists at. It is then argued that a digital computer simulation of a universe cannot exist as a universe. However, the paper concludes with the acknowledgement that an analog computer simulation can be objectively related to the thing it represents, hence an analog computer simulation of a universe could, in principle, exist as a universe. The discussion on mandatory turnout, which controversially introduces coercion at the heart of the electoral process, illustrates a dilemma between increasing voter turnout on the one hand and avoiding coercion on the other. If successful, a recent proposal by Elliott solves this dilemma as it removes the compulsory element of mandatory turnout. Specifically, Elliot reinterprets the policy’s purpose as (a) a pre-commitment device for those who believe that they have a duty to vote and (b) a nudge to the surveillance (...) of politics for those who do not believe this. We critically evaluate Elliott’s novel intervention in the debate and argue that it is ultimately unsuccessful. Mandatory turnout can be interpreted as neither a pre-commitment device nor a nudge. Moreover, we present a more promising and novel solution to the dilemma: a genuine state-administered pre-commitment device with respect to voting that also nudges citizens to vote and seems _prima facie_ attractive. The purpose of this paper is to discuss the various types of physical universe which could exist according to modern mathematical physics. The paper begins with an introduction that approaches the question from the viewpoint of ontic structural realism. Section 2 takes the case of the `multiverse' of spatially homogeneous universes, and analyses the famous Collins-Hawking argument, which purports to show that our own universe is a very special member of this collection. Section 3 considers the multiverse of all solutions (...) to the Einstein field equations, and continues the discussion of whether the notions of special and typical can be defined within such a collection. This title represents, I suppose, a kind of challenge; for there seems at first sight some incompatibility between the practice of logic and mysticism, a contrast between the rational and the intuitive, the tough minded and the tender-minded. In taking up this challenge, I propose to argue with the help of two thinkers commonly admired for their attention to logic and its rights. I shall refer for the most part to St Thomas Aquinas but with occasional reference to Wittgenstein. Whatever (...) may be said of the latter, it seems to me quite clear that St Thomas was a mystical thinker in that he was centrally concerned with the unknown and, in one sense, ineffable mystery of God and that he devoted a great deal of thought and writing to the problems associated with speaking of what is, in this sense, ineffable. I want to argue that in what is sometimes misunderstood as his dryly rational approach, even in his arguments for the existence of God, he is in fact engaged in, and inviting the reader to be engaged in, a mystical exploration, which is not at all the same thing as a mystical experience. Here the key notion is that of what he refers to as esse. (shrink)

Voltaire (1694-1778), novelist, dramatist, poet, philosopher, historian, and satirist, was one of the most renowned figures of the Age of Enlightenment. Across Europe, countries are reducing CO2 emissions and energy demand by lowering the temperature in public office buildings. These measures affect men and women unequally because the latter prefer and, indeed, perform better under higher temperatures than the standard temperature. Lowering the temperature thus further increases an already existing inequality. We show that the philosophical literature on discrimination provides an interesting theoretical approach to understanding such measures. On prominent understandings of what discrimination is, the policy would be considered direct discrimination (...) against women if it could be shown to reflect a broader inattentiveness to the needs of women in society. Alternatively, and more straightforwardly, the policies can be considered indirect discrimination because of their disparate effects on men and women. The final part of the paper shows that the policies are also wrong for the reasons it is often argued that discrimination is wrong—to wit, that it harms or disrespects those who are discriminated against. The final section suggests a range of measures to offset the discriminatory aspects of the policy. (shrink)

Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

Two experiments investigated the impact of affect on the working self-concept. Following an affect induction, participants completed the Twenty Statements Test (TST) to assess their working self-concepts. Participants in predominantly happy and angry states used more abstract statements to describe themselves than did participants in predominantly sad and fearful states. Evaluations of the statements that participants generated (Experiment 2) demonstrate that these effects are not the result of (1) participants describing positively and negatively valenced information at different levels of abstraction, (...) or (2) valence-based affective priming. Further, half of the participants in Experiment 2 were led to attribute their affect to the manipulation prior to completing the TST. This manipulation eliminated the influence of affect on the working self-concept. Taken together, these results are consistent with theory and research on the informative functions of affect. Plato's Individuals is rich and rewarding. McCabe's reading will compel us to examine anew the presuppositions we bring to the enterprise of understanding Plato. Her devotion to showing that her thesis is found almost everywhere in the corpus is noteworthy. At times she also seems to strain to assimilate modern and Platonic concerns. If one can accept that Plato's tripartite soul goes over into something we might recognize as the problem of personal identity, it can only be because we (...) are writing off his devotion to reincarnation and transmigration. It is, however, McCabe's novel and energetic defense of individuation that deserves closest scrutiny. Here charges of anachronism and projection will be heard. (shrink)

In healthcare, a tension sometimes arises between the injunction to do as much good as possible with scarce resources and the injunction to rescue identifiable individuals in immediate peril, regardless of cost (the “Rule of Rescue”). This tension can generate serious ethical and political difficulties for public policy makers faced with making explicit decisions about the public funding of controversial health technologies, such as costly new cancer drugs. In this paper we explore the appropriate role of the Rule of Rescue (...) in public resource allocation decisions by health technology funding advisory bodies such as the National Institute for Health and Clinical Excellence. We consider practical approaches to operationalising the Rule of Rescue from Australia and the UK before examining the relevance of individual moral imperatives to public policy making. We conclude that that whilst public policy makers in a humane society should facilitate exceptional departures from a cost effectiveness norm in clinical decisions about identified individuals, it is not so obvious that they should, as a matter of national public policy, exempt any one group of unidentified individuals within society from the rules of opportunity cost at the expense of all others. Two experiments were designed to test the hypothesis that the nature of the remember–know instructions given to participants influences whether these responses reflect different memory states or different degrees of memory confidence. Participants studied words and nonwords, a variable that has been shown to dissociate confidence from remember–know judgments and were given a set of published remember–know instructions that either emphasized know judgments as highly confident or as less confident states of recognition. Experiment 1 replicated the standard finding showing that (...) remembering and knowing were differently influenced by the word–nonword variable, whereas confidence responses were not. By contrast, Experiment 2 showed a similar pattern of data for remember–know and sure–unsure responses, thus demonstrating the importance of the instructions for interpreting the relationship between remembering and knowing and confidence. This volume seeks to remedy this situation by highlighting the theological consideration of disability in Christian thinkers from the patristic era to the present. Against tendencies to treat disability as a “special case” for thinking about humanity, this volume seeks to show the often overlooked presence of reflection on disability throughout the tradition.The volume pairs introductory and interpretive essays from contemporary scholars with primary source selections from each historical thinker. Essays on Augustine, Aquinas, and Luther help to correct the historical record, which often remembers these theologians as advocating rationalist or exclusionary anthropologies that marginalize or significantly compromise the humanity of persons with disabilities. These thinkers prove to be more nuanced and insightful than is often thought. However, as Brian Brock points out with respect to Augustine, and as Stefan Heuser points out with respect to Luther, [End Page 238] these figures are often ambivalent or at odds with themselves on the practical and theological significance of disability. Following the work started here, further interpretation and analysis will be needed in order to assess the legacies of these figures and to discern their usefulness for thinking about disability today. In this respect the reader serves as a helpful invitation for further historical and constructive work.Some of the finest essays in the volume focus on disability in order to illuminate the theologians under consideration in surprising ways. Christopher Craig Brittain’s essay on Kierkegaard appeals to his letters and manuscripts in order to show how questions of suffering, marginalization, and self-acceptance are crucial aspects of Kierkegaard’s understanding of being human and being Christian—and how his work might contribute to current debates in disability theory and theology. Bernd Wannenwetsch shows how Dietrich Bonhoeffer’s visit to a community for persons with disabilities in 1933 was a pivotal experience in the formation of his anthropology. Wannenwetsch compellingly argues that Bonhoeffer’s advocacy on behalf of the weak and disabled is integrally connected to his opposition to the destructive rival anthropology advocated under Nazi rule. These essays make important contributions both to our reflection on disability as well as to our understanding of Kierkegaard and Bonhoeffer’s wider thought.A variety of perspectives on the meaning of disability are on display in this volume. One comes away with the impression that the “dialogue with the communion of saints” (3) called for in the introduction might be more of a debate than a harmonious discourse. The historical thinkers featured here do not offer one Christian account of disability that might be set against modern and secular perspectives on disability, but they do offer much that is productive for ethicists and theologians today.This volume is important for anyone concerned with theological reflection on disability, but it would be a shame if the book’s readership were limited to such a group. Historical theologians and readers interested in the theological and ethical issues pertaining to Christian anthropology and questions of embodiment, suffering, and vulnerability will find much that is of value. Indeed, it is one of the lessons of the volume that disability is not just a marginal or trendy topic in the contemporary theological scene but a central aspect of human personhood that has played an important if complex role in the understanding of what it means to be human throughout the Christian tradition. Individuals and businesses make numerous payments every day. They sometimes have choices about what forms of payment to make or accept, and at other times are effectively forced to use a particular form. Often there is an asymmetric power relationship between payer and payee that raises the issue of whether one side unfairly exploits the other. Is it unethical exploitation for an employer to pay employees with a fee-laden payroll card over other more convenient forms of payment? Does the fee (...) structure of payment networks such as Visa and MasterCard unfairly exploit merchants? The bitcoin payment system is an ethical as well as technological evolution as it was designed to be an electronic payment system that does not rely upon trust. Can an entire payment system like bitcoin be “evil,” as charged by Krugman? Payment tools as such are ethically neutral, but can be used in an ethical or unethical manner. (shrink)

Academic integrity policies at 200 institutions of higher education were examined for the presence of academic prohibitions against the nonmedical use of prescription stimulants or any other cognitive enhancing drug. Researchers used online search tools to locate policy handbooks in a stratified random sample of IHE’s drawn from the Integrated Postsecondary Education Data System database, searching for NMUPS/CED use as violations of either academic integrity or alcohol and other drug policies. Of 191 academic integrity policies found online, NMUPS/CED prohibitions were (...) present in only one. However, NMUPS was addressed in all but two of the 200 IHE AOD policies, often with language referencing IHE adherence to federal or state law. NMUPS/CED prohibitions are predominantly absent in IHE academic integrity policies, raising questions about whether colleges and universities are concerned about the use of enhancement drugs as a form of cheating. Implications for fairness, health promotion, and future research are discussed. (shrink)
