The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. O ponto de partida são as reflexões teóricas de Jurgen Habermas e nesse sentido pretende ser uma contribuição para a elaboração de uma noção emancipatória de Modernidade podendo também servir como contribuição para o debate entorno dos rumos de uma reconstrução do país também emancipadora.

O objetivo deste trabalho é o de examinar processos de exclusão e expulsão que vem se ampliando nos diversos aspectos da vida sob as condições atuais do neoliberalismo e como se manifesta na ocupação/desocupação do território, no papel da informação nesse processo e como as alterações das condições tanto da ocupação da terra quanto de produção e uso da informação impostas podem resultar na expulsão de moradores e na exclusão de usuários. Este trabalho também aponta possibilidades de surgimento de condições (...) alternativas por meio da construção de contraracionalidades na constituição de uma esfera pública política e democrática. No livro dois da Ética Nicomaqueia, Aristóteles afirma com clareza que a prática reiterada de ações virtuosas leva à constituição de uma determinada disposição de caráter, ou seja, o hábito funcionaria como uma segunda natureza, em função da fixidez e estabilidade da disposição por ele constituída, o que aparentemente impediria qualquer modificação no que concerne ao caráter. O problema é que várias passagens do Corpus Aristotelicum parecem contradizer esta asserção, permitindo uma leitura diferente daquela que sugeriria a ideia do hábito (...) como algo que operasse de modo similar à natureza. Este artigo propõe-se investigar se é possível uma leitura que permita, nas Éticas, bem como em outras obras do Corpus Aristotelicum, a possibilidade da mudança de caráter, da decadência ou da reforma moral, bem como sua implicação na investigação sobre o problema do determinismo e da responsabilidade moral. In this paper, we intend to discuss how, according to Peirce’s semiotics, gestures can be conceptualized and described as diagrams. We are not concerned with answering when, why or how gestures emerged as semiotic motor activities. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the theoretical conditions which should be fulflled for gestures to be characterized as iconic processes - and more specifcally as diagrammatic processes. The frst step is to summarize a (...) systematic analysis of the variety of iconic signs, elaborated by Peirce, followed by his typology of hypoicons in order to describe the hypoiconic class of diagrams. Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

In some of the Aristotelian accounts, Parmenides’ thesis is construed in opposition to the philosophy of nature; on the other hand, he is also depicted, in a different context, as a cosmologist, to whom the Stagirite (and a long tradition afterwards, ending with Simplicius) ascribes a theory of becoming and its principles. In this paper, I exhibit and analyse the relevant passages from Physics I 1-3, Metaphysics I 3 and 5 and On generation and corruption I 3, providing an interpretation (...) that aims to solve the apparent paradox, making sense of the information we can gather from Aristotle’s and Simplicius’ testimonies. Eventually, I propose a construal of the Two Ways of fr. 2 with an emphasis on the predicative reading of einai, which could hint at the Parmenidean approach to cosmology that runs in parallel with the argument on Being. The chapter shows how the recognition of reflexivity of emotions is crucial for understanding the role of emotions in reasoning because it highlights the regulatory role of emotion in emotional experience. The chapter begins by showing that to attain a conception of rationality that incorporates feelings, emotions, and sentiments as parts of the reasoning processes requires capturing the emotional landscape in all its complexity, and that integrating the role of meta-emotions is a contribution in that direction. Then introducing the notion (...) of meta-emotions and showing how emotional reflexivity modifies the nature of our emotional world, it is shown how emotions also have a regulatory mechanism that can either be maladaptive or at the center of emotional health. In addition, because meta-emotions provide a test for the more general assumptions of theories of emotions, the chapter ends by showing how adopting a Situated Approach to Emotions is well-suited for explaining the refinement and complexity of emotion regulation. The final reflection of the chapter explains why adopting such theoretical frame of work makes it possible to use the term situation in a technical manner, which then reveals that emotions sometimes are described as causes while other times as reasons in connection to their regulative mechanisms. Error-related electroencephalographic signals have been widely studied concerning the human cognitive capability of differentiating between erroneous and correct actions. Midfrontal error-related negativity and theta band oscillations are believed to underlie post-action error monitoring. However, it remains elusive how early monitoring activity is trackable and what are the pre-response brain mechanisms related to performance monitoring. Moreover, it is still unclear how task-specific parameters, such as cognitive demand or motor control, influence these processes. Here, we aimed to test pre- and post-error EEG (...) patterns for different types of motor responses and investigate the neuronal mechanisms leading to erroneous actions. We implemented a go/no-go paradigm based on keypresses and saccades. Participants received an initial instruction about the direction of response to be given based on a facial cue and a subsequent one about the type of action to be performed based on an object cue. The paradigm was tested in 20 healthy volunteers combining EEG and eye tracking. We found significant differences in reaction time, number, and type of errors between the two actions. Saccadic responses reflected a higher number of premature responses and errors compared to the keypress ones. Nevertheless, both led to similar EEG patterns, supporting previous evidence for increased ERN amplitude and midfrontal theta power during error commission. Moreover, we found pre-error decreased theta activity independent of the type of action. Source analysis suggested different origin for such pre- and post-error neuronal patterns, matching the anterior insular cortex and the anterior cingulate cortex, respectively. This opposite pattern supports previous evidence of midfrontal theta not only as a neuronal marker of error commission but also as a predictor of action performance. Midfrontal theta, mostly associated with alert mechanisms triggering behavioral adjustments, also seems to reflect pre-response attentional mechanisms independently of the action to be performed. Our findings also add to the discussion regarding how salience network nodes interact during performance monitoring by suggesting that pre- and post-error patterns have different neuronal sources within this network. The perception involves a lot of enigmas, the unity between its content and form not always looking to be assured. Such enigmas are exemplified by the optical illusions, by Molyneux’s famous problem and also, as it interests us here, by the problem of the expression of colors in chromatic models, which express logical incompatibilities, but which refer to the territory of experience itself with colors and pigments. In this paper, we will distinguish two uses of Farbenoktaeder by Wittgenstein by registering (...) the difference, which we consider relevant, between ample incompatibility and restrict incompatibility among colors. O presente artigo abordará a construção do conhecimento em Giambattista Vico embasando-se no discurso De Nostri Temporis Studiorum. Com a troca da “imaginação” pela “racionalidade”, colocou-se de lado a engenhosidade humana, anulando assim a verossimilhança que fora negada por não apresentar verdades factuais levando à atrofia do engenho. O intuito aqui é analisar o desenvolvimento imaginativo proposto por Vico, gerando uma nova crítica. Conclui-se sobre uma possível epistemologia das humanidades, na qual cada sujeito possa, com seus próprios instrumentos, desenvolver um (...) conhecimento menos “dogmático” e mais humano, partindo de um solo estável, qual seja, a história. Este artigo interpreta a quarta conferência de uma série de seis pronunciadas por Foucault em Berkeley (Universidade da Califórnia) de outubro a novembro de 1983. A problemática da parrhesia retomada pelo filósofo francês do diálogo Laques, de Platão, suscita uma discussão sobre os sentidos de democracia, sistema político em baixa na Atenas do final do século V a.C. Articulando os discursos cômico e filosófico, evidenciam-se, ao mesmo tempo, a força e as lacunas do texto de Foucault. Se, por um lado, (...) o interesse foucaultiano pela verdade força um retorno ao “falar franco”, por outro, falta, nesta conferência, um olhar de conjunto mais amplo que dê conta da parrhesia como sintoma de uma falta e da decadência do espírito democrático ateniense nos termos propostos no Laques. We analyze axioms and postulates as speech acts. After a brief historical appraisal of the concept of axiom in Euclid, Frege, and Hilbert, we evaluate contemporary axiomatics from a linguistic perspective. Our reading is inspired by Hilbert and is meant to account for the assertive, directive, and declarative components of modern axiomatics. We will do this by describing the constitutive and regulative roles that axioms possess with respect to the linguistic practice of mathematics.

We attempt to offer a new interpretation of Schlegel’s original solution for the problem of the new mythology. We claim that, while grasping the problem of the missing center as the structure of modern thought, Schlegel develops a theory of literature which implies an ontology of time. We advance that, by identifying myth with romantic literature, Schlegel’s argumentative economy leads him to apply the metaphysical predicates of myth to romantic literature as such. We propose then to read the status of (...) literary forms as constituting the substance which precedes them but, paradoxically, only exists through them. (shrink)

Introduction:Episodic memory is a cognitive process that allows the recall of experiences, learning, and the pursuit of future goals. During the aging process, episodic memory declines negatively, impacting social and psychological aspects in the elderly. Such intervention strategies as cognitive training are non-pharmacological ways of reducing these losses.ObjectiveWe systematically reviewed studies of the cognitive training of episodic memory in healthy elderly individuals and elderly individuals with clinical conditions.MethodWe systematically searched the PubMed, PsycNET, Web of Science, and SciELO databases using the (...) descriptors “Episodic Memory” AND “Training” AND “Elderly” OR “Aging” OR “Dementia” in English and translated into Portuguese.ResultsOf the 572 articles that were identified by the search, 23 were included in the final analysis. The main variables that comprised the intervention protocols were investigated, as well as the outcome variables, efficacy, and risk of bias. The main results indicated effectiveness with regard to different forms of the cognitive training of episodic memory.ConclusionEpisodic memory training among the elderly can mitigate the negative effects of cognitive decline in dementia and healthy subjects promoting impacts at social, psychological, and economic levels. Although it is a widely studied topic, further empirical studies on the utility of episodic memory training in healthy elderly individuals and elderly individuals with clinical conditions are still needed. O artigo tenta reconstruir alguns elementos acerca da passagem da Lógica da essência para a Lógica do conceito, da necessidade para a liberdade, na Ciência da Lógica hegeliana. No contexto da publicação dos duzentos anos dessa obra filosófica, a explicitação dessa passagem é referencial para a compreensão da Ciência da Lógica e de todo o pensamento hegeliano. O artigo procura sustentar que o binômio necessidade/contingência, um dos pares categoriais da Lógica da essência, não é adequado para a articulação da filosofia (...) hegeliana. Como Hegel afirma reiteradas vezes, é preciso superar a dura necessidade para dar lugar à lógica da liberdade. Para a discussão da problemática, a confrontação entre algumas categorias da essência, tais como substancialidade, necessidade, contingência e causalidade, e algumas categorias do conceito, tais como universalidade, particularidade e singularidade é o foco da exposição. Dessa discussão brota a noção hegeliana de liberdade e a sua relação com o sistema. (shrink)

In this paper, we intend to discuss if and in what sense semiosis (meaning process, cf. C. S. Peirce) can be regarded as an "emergent" process in semiotic systems. It is not our problem here to answer when or how semiosis emerged in nature. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the conditions which should be fulfilled for semiosis to be characterized as an emergent process. The first step in this work (...) is to summarize a systematic analysis of the variety of emergence theories and concepts, elaborated by Achim Stephan. Along the summary of this analysis, we pose fundamental questions that have to be answered in order to ascribe a precise meaning to the term "emergence" in the context of an understanding of semiosis. After discussing a model for explaining emergence based on Salthe's hierarchical structuralism, which considers three levels at a time in a semiotic system, we present some tentative answers to those questions. Our world is faced with complex challenges that include poverty, hunger, lack of education, gender inequality, sustainability, and climate change. These issues cannot be addressed by government action alone and requires the business world play an important role. Despite the many effort of companies to address social responsibility in the last decade however, capitalism continues to suffer a crisis of trust. Many organizations lack the awareness, mindset, frameworks, and knowledge to efficiently and effectively make progress in providing solutions to these (...) systemic challenges, while also ensuring business performance. The authors argue that business schools are uniquely positioned and have a responsibility to contribute to this cause as educators of the business leaders of tomorrow. A landscape survey of social entrepreneurship / social innovation education with 66 institutions of higher education and in-depth interviews with 8 social intrapreneurs from diverse career tracks reveals significant challenges as well as opportunities for creating this paradigm shift in business schools. This research uses insights from these two studies to provide an overview of the current state of SE/SI in business education and provides recommendations for institutions of higher education to pave a pathway forward for future leaders who will use business to create positive social change. Este artigo tem como objetivo analisar o filme Equilibrium de Kurt Wimmer em que a técnica surge como única possibilidade de fundamentação do desenvolvimento da humanidade. No filme os sentimentos são identificados como fonte do sofrimento e das desgraças humanas, sendo então estabelecido que devem ser exterminados com o uso de uma droga. A técnica se apresenta no filme como fim para a história da humanidade, tal qual teme Heidegger. A fim de mostrar as conseqüências ultimas do domínio da técnica (...) sobre o sentir e sobre o próprio ser se discorrerá esse artigo, sempre fazendo uma alusão ao filme Equilibrium. (shrink)

O trabalho analisa, por meio da cobertura do diário A Tarde, de Salvador, a convivência entre a delegação alemã de futebol e a população local de Santa Cruz Cabrália, no sul da Bahia, que serviu de base para a seleção que conquistou a Copa do Mundo de futebol em 2014. A partir dos critérios de identidade cultural, globalização e seleção jornalística, mostra que a estratégia de aproximação com os moradores marcou a cobertura de A Tarde e criou um clima simpático (...) à seleção alemã. O objetivo deste trabalho é a analisar a utilização e impacto das fake news nos últimos anos da vida política brasileira enquanto propulsão ao esvaziamento do pensamento e uma zona de anomia entre democracia e totalitarismo que captura e sacraliza a vida biológica humana ao mesmo tempo que a abandona, reconhecida como estado de exceção permanente. Para tanto, abordamos as obras de Hannah Arendt e Giorgio Agamben, bem como analisamos fenomenologicamente algumas das fake news mais divulgadas entre a população brasileira (...) no período das eleições presidenciais de 2018. Por fim, entendemos que a verdade factual, resguardada pelas humanidades e transmitida pela mídia é capaz de levar a população novamente à percepção da realidade e ao resgate do sentido da política pela ação.
