What place does freedom have in Confucianism? We find a wide spectrum of views on the matter: some deny that Confucians value or even conceive of freedom, while others celebrate uniquely exalted forms of Confucian freedom. This paper examines the range of proposals, finding consensus among these diverse views in that all identify distinctive Confucian emphases on (i) subjective affirmation of the good and (ii) the cultivation of desires and intentions to align with that good. The variation among views of (...) Confucian freedom does not result from disparate interpretations of Confucian teachings. Rather, their divergence lies in affirming or denying that these core aspects of Confucian thought should be seen as ‘freedom.’ This reveals an undiscussed, fundamental question regarding Confucian freedom: Can and should we see the traditional Confucian moral ideal—that is, Confucian goodness and sagely virtue—as versions of freedom? Opening Democracy in Contemporary Confucian Philosophy, David Elstein identifies himself, correctly, to be filling a gap in English-language scholarship. This manual is the product of a normative research program carried out over four years with Spanish-speaking populations in two geographically distinct regions: Madrid, Spain and the USA/Mexico border region. The manual describes a comprehensive system of procedures and normative data designed to assist the clinical researcher and the clinical practitioner in the neuropsychological assessment and diagnosis of adults whose main language is Spanish. Together the procedures comprise a brief and practical battery of eight tests for a basic examination of (...) attention, learning and memory, and executive function. The level of performance on these tests is assessed according to normative data. This is accomplished by adjusting test scores according to demographic criteria that simultaneously take into account the traditional factors of age and education, as well as the patient's place of origin. Sungmoon Kim finds the grounds of Robert A. Carleo III’s criticism too narrow, and argues that it fails to take into account his theory’s central aim: relevance to actual East Asian societies. Kim revises public reason as a means of public justification in a manner that is deliberately and explicitly non-Rawlsian-liberal—an instrument of democratic perfectionism for the East Asian societies that are sufficiently liberal, increasingly pluralist, and characteristically Confucian. That Carleo measures it by Rawlsian-liberal standards suggests his (...) philosophical commitments have led him to overlook the value of revising public reason in this way. Moreover, the stipulation of basic liberties as constitutional rights along with the democratic version of Confucianism that Kim’s theory endorses—which respects important forms of equality and freedom—are intended to allay the concerns raised. Kim also clarifies that there is no dilemma between East Asian liberal democratic institutions and Confucian culture. Addressing Carleo’s proposed alternatives, he suggests one is subject to the very criticism levied at his own theory while the other adopts problematic Rawlsian presumptions. Kim’s own Confucian public reason is a matter of actual public deliberation, not first principles, making it more democratic and meaningfully “liberal” for East Asian citizens. (shrink)

Since the 1909 work of Carathéodory, formulations of thermodynamics have gained ground which highlight the role of the the binary relation of adiabatic accessibility between equilibrium states. A feature of Carathéodory's system is that the version therein of the second law contains an ambiguity about the nature of irreversible adiabatic processes, making it weaker than the traditional Kelvin-Planck statement of the law. This paper attempts first to clarify the nature of this ambiguity, by defining the arrow of time in thermodynamics (...) by way of the Equilibrium Principle. In lieu of an abstract, here is a brief excerpt of the content:207 THE CARELESS SKEPTIC THE 'PAMPHILIAN' IRONIES IN HUME'S DIALOGUES In "Hume and the Legacy of the Dialogues" E. C. Mossner sets out a widely accepted interpretation of one of Hume's major intentions in that great work. He argues that Hume's main use of irony therein is to dissimulate with respect to his true religious convictions. The purpose is to provide Hume with a defense against the expected negative (...) reaction to the powerful attack on religion mounted 2 in the Dialogues. The attack, as is well known, is set out in the arguments of Philo against natural and revealed religion as espoused by Cleanthes and Demea, and Philo's views are taken to be those of Hume. It is argued or assumed that since such attacks were in Hume's day imprudent, they must be made by indirection, that is, by a device such as irony. Thus the Dialogues have surface meanings in which the religious views under attack are said (by Pamphilus) to win out; they also have other meanings, underlying or implicit, in which the religious views are conclusively refuted. That they are refuted is a conclusion drawn by the interpreters, in the present case Mossner and those who share his views. These destructive refutations are derived from explication and assessment of the ongoing argument as embodied in the explicit statements of the contestants, and are thus not explicitly linked to Hume. In consequence, quite often from one standpoint (a trivial one of external comment by an immature and prejudiced onlooker) the design argument wins; and from another, more sophisticated one, it loses. The upshot is that "Philo, who as Hume's spokesman for mitigated 208 skepticism will perforce be the victor in the philosophic debate, will nevertheless be 'artfully' depicted as being vanquished by the antagonist." The strategy Mossner finds in the Dialogues thus has the youthful Pamphilus, a ward of Cleanthes, and one who takes no actual part in the adversarial discussions, interposing (in brief asides) comments that superficially but subtly belittle Philo's philosophical position. Philo is characterized, for instance, as having a "careless scepticism," in contrast with Cleanthes, who has an "accurate philosophical turn [of mind]" (D 128). Similarly, at the end of the Dialogues, Pamphilus awards the victory to Cleanthes. In support of his thesis that Philo is a devious Hume's mouthpiece, Mossner brings forth two kinds of evidence, roughly characterizable as external and internal. One kind of external evidence is exemplified in Hume's correspondence with Gilbert 4 5 Elliot of Minto, and Adam Smith; the letters involved are interpreted as showing that Philo represents Hume. Another kind involves comparing the amount of space devoted to the arguments of the three adversaries. The internal evidence is derived from the explication and appraisal of the explicit statements of the contestants; and it is essentially identified with the arguments and conclusions of Philo, except where Cleanthes can be said to make claims which square with those made by Hume in other works such as the Treatise. Thus Hume's views and the related arguments are interpreted as those of Philo, in part because they are considered to be more valid and sound than those of Cleanthes, and in part because they are held to square with the views and arguments affirmed in Hume's other writings. Hume's views, as indicated above, are taken to be those of 209 Philo except where Philo appears to agree with Cleanthes and to accept a form of the design argument. Hume is Cleanthes when Cleanthes sets forth doctrines of the Treatise and the Enquiry that are in accordance with the received (more or less) positivistic interpretation of Hume's skepticism. It is this view that requires that in those places in Parts III, X, and XII, where Philo appears to avow a form of the design argument or to let it stand unrefuted, he be (ironically) dissimulating. Thus the surface victories of Cleanthes and natural religion, which the adversarial flow of the statements of Philo and Cleanthes exhibits, are refuted by the propositions derived from the assessed form and content of the philosophical debate. At a minimum, a fiduciary is one who is entrusted to act for the benefit of others. But as the essays in this volume indicate, fiduciary relationships can be conceived or argued to be thicker and/or more robust. In addition to a relation of trust and action on behalf of another, fiduciary relationships are often thought to include some or all of the following additions: asymmetries of power, knowledge, skill or ability; discretion or reasonable judgment on the part of the (...) fiduciary; loyalty of the fiduciary to the interests of the trustor, or potential beneficiary; and the ethical obligation to act in good faith, with due care, or with professional or special knowledge in advancing the interests of the trustor. Due to the vulnerability of dependents, their trust in fiduciaries, and ethical obligations of trustees to act beneficently, fiduciary relationships lie at the heart of much ethical reflection, discourse and argumentation. This is especially so for professional fields in which fiduciaries have special knowledge and skill, and consequently special powers. Yet, apart from the specialized sub-disciplines of business ethics, legal ethics and medical ethics, fiduciary roles and relationships have not received much scrutiny and discussion in philosophy. In our view, this deficiency is best remedied by treating fiduciary ethics as a more general sub-field within ethics and deserving of attention in its own right. (shrink)

The relationship between individuals' creativity and their ethical ideologies appears to be complex. Applying Forsyth's (1980, 1992) personal moral philosophy model which consists of two independent ethical ideology dimensions, idealism and relativism, we hypothesized and found support for a positive relationship between creativity and relativism. It appears that creative people are less likely than non-creative people to follow universal rules in their moral decision making. However, contrary to our hypothesis and the general stereotype that creative people are less caring about (...) others, we found a positive relationship between creativity and idealism. These findings indicate that highly creative people are likely to be what Forsyth called "situationists," individuals with both an ethic of caring and a pragmatic moral decision-making style. The finding that creative individuals tend to be situationists, and particularly that they tend to be high in idealism, appears to refute the line of reasoning that argues for a "creative personality" characterized in part by social insensitivity. Understanding the relationship between creativity and ethical ideologies has important implications for researchers, managers and teachers. (shrink)

In “Race, Multiculturalism, and Democracy,” Robert Gooding-Williams offers an insight. He writes: “Our sense of ourselves and of the possibilities existing for us is, to a significant degree, a function of the descriptions we have available to us to conceptualize our intended actions and prospective lives. . . . ‘Hence if new modes of description come into being, new possibilities of action come into being in consequence.’” In this article, I discuss the philosopher’s role in the articulation of new (...) descriptions and thus new possibilities. I argue that potential modes of bold and assertive comportment are conjured when new insurrectionist descriptions are articulated within oppressed populations. To bring this to a higher resolution, I discuss the pervasiveness of dialectical conflict, the need to creatively reorient the descriptions of oppressed groups toward liberation, and the need for more than one prescriptive mode of social amelioration. This second companion paper to a logico-mathematic, structural methodology and its findings address theoretical issues underlying sub-literal phenomena. The concept of a “cognitive psycho-dynamics” is introduced. In addition, research on masked priming and automatic activation of “chronic goals and motives” schemata are presented as initial and partial explanatory theoretical bases. Corroborating findings from fMRI and other neurological research suggest that some of the cognitive operations are biologically based. The soul is an explanatory principle of Aristotle’s natural science, accounting both for the fact that living things are alive as well as for the diverse natural attributes that belong to them by virtue of being alive. I argue that the explanatory role of the soul in Aristotle’s natural science must be understood in light of his view, stated in a controversial passage from Parts of Animals (645b14–20), that the soul of a living thing is a “complex activity” of its (...) organic body. This paper explores the role of this “complex activity” model of soul in Aristotle’s study of soul in De Anima. I argue, first, that the model has its origins in De Anima II.4, where Aristotle argues that living things do all they do by nature for the sake of a single, teleologically primary end. I argue further that Aristotle uses this model to account for the psychological attributes naturally present in living things, including their capacities for vital activities like nutrition, reproduction, and perception, and that this is the task to which Aristotle devotes the obscure final chapters of De Anima III. The aim of this paper is to improve our understanding of the category of moral “luck”. In current debate most often only specific cases of moral “luck” are taken into account. Such restrictions, however, involving a fragmentary picture of moral "luck", are introduced without any rationale for them. In this paper I look for a formal comprehensiveness of the category of moral “luck”. I consider three factors each of which is developed in two scenarios. These are (i) whether the agent’s (...) action is nasty or nice, (ii) whether the agent’s intention is confirmed or contradicted by her action, and (iii) whether the agent’s action is preceded by her intention or the lack thereof. I explore eight scenarios which are a mark of the intricacy of the category of moral “luck” otherwise ignored in the literature. After an assessment of their structure I arrive at new distinctions. The upshot is a rather complex set of correlations between several cases of moral “luck” with a variety of kinds and shades. (shrink)
