A nineteenth-century aristocrat, Nishi Amane (1829-1897) was one of the first Japanese to assert the supremacy of Western culture. He was sent by his government to Leiden to study the European social sciences; on his return to Japan shortly before the climactic Meiji Restoration of 1868 he introduced and adapted European utilitarianism and positivism to his country's intellectual world. To modernize, Nishi held, Japan must cast off the bonds of the Confucian world-view in order to adopt new principles of empirical (...) scholarly investigation and new standards of self-improvement. Though a Confucian by upbringing, Nishi became thoroughly committed to Western intellectual values in his programs for the new Japanese society. In his roles of teacher, writer, and government administrator, he was influential at one of the most critical times in Japan's history. Originally published in 1970. After presenting the major objections raised against standard formulations of the H-D method of theory testing, I identify what seems to be an important element of truth underlying the method. I then draw upon this element in an effort to develop a plausible formulation of the H-D method which avoids the various objections.

The social exchange theory of reasoning, which is championed by Leda Cosmides and John Tooby, falls under the general rubric “evolutionary psychology” and asserts that human reasoning is governed by content-dependent, domain-specific, evolutionarily-derived algorithms. According to Cosmides and Tooby, the presumptive existence of what they call “cheater-detection” algorithms disconfirms the claim that we reason via general-purpose mechanisms or via inductively acquired principles. We contend that the Cosmides/Tooby arguments in favor of domain-specific algorithms or evolutionarily-derived mechanisms fail and that the notion (...) of a social exchange rule, which is central to their theory, is not correctly characterized. As a consequence, whether or not their conclusion is true cannot be established on the basis of the arguments they have presented. (shrink)

This paper discusses the views of 17 healthcare practitioners involved with transplantation on the ethics of live liver donations . Donations between emotionally related donor and recipients increased the acceptability of an LLD compared with those between strangers. Most healthcare professionals disapproved of altruistic stranger donations, considering them to entail an unacceptable degree of risk taking. Participants tended to emphasise the need to balance the harms of proceeding against those of not proceeding, rather than calculating the harm-to-benefits ratio of donor (...) versus recipient. Participants’ views suggested that a complex process of negotiation is required, which respects the autonomy of donor, recipient and HCP. Although they considered that, of the three, donor autonomy is of primary importance, they also placed considerable weight on their own autonomy. Our participants suggest that their opinions about acceptable risk taking were more objective than those of the recipient or donor and were therefore given greater weight. However, it was clear that more subjective values were also influential. Processes used in live kidney donation were thought to be a good model for LLD, but our participants stressed that there is a danger that patients may underestimate the risks involved in LLD if it is too closely associated with LKD. According to Thomas Nagel, morality's authority is determined by the extent to which its way of balancing agent-neutral and agent-relative values resembles reason's. He himself would like to think that the resemblance is close enough to ensure that it will always be reasonable to act as morality demands. But his attempts to establish this never really get off the ground, in large part because he never makes it very clear how these two perspectives on value are to be characterized. (...) My goal in this paper is to show how we might flesh out Nagel's conception of these matters by construing reason as a kind of self-governance and morality as involving a certain kind of cooperation. The challenge will therefore be to determine what self-governance and cooperation require of peoplegiven the assumption that there are objective values and that they take both the agent-neutral and the agent-relative forms. What we shall find is that their requirements differ rather more than Nagel allows, but perhaps not enough to prevent morality from being in some significant sense inescapable. (shrink)

The idea of legal rights today enjoys virtually universal appeal, yet all too often the meaning and significance of rights are poorly understood. The purpose of this volume is to clarify the subject of legal rights by drawing on both historical and philosophical legal scholarship to bridge the gap between these two genres--a gap that has divorced abstract and normative treatments of rights from an understanding of their particular social and cultural contexts. In an introductory sketch of history of scholastic interest in aesthetics, the author notes the reawakening of Thomistic interest in this subject since the last century. He adds, with evidence drawn from nineteenth and twentieth century works, that this interest has been accompanied by methodological confusions and a misunderstanding of the theory of beauty of St. Thomas himself. He seeks to remedy this situation with a scholarly treatment of Aquinas' theory of beauty, divided into two parts; the first a (...) genetic investigation of the development of Thomas's ideas on beauty, the second a systematic account of the mature theory. A notable attempt to develop Aquinas' ideas on this subject from the entire corpus of his writings and not merely from the Summas and one or two other major works.--R. H. K. (shrink)

Many of the papers in this volume originated in a colloquium at the University of Western Ontario in 1967. These include a paper on the logic of norms by G. H. Von Wright, a paper on the logic of questions by L. Åqvist, a paper on the logic of belief by W. Sellars, and a paper on inductive logic by R. Ackermann. The commentaries by Anderson and Sosa have been revised for the volume and a further commentary to Ackermann's paper (...) by Wesley Salmon has been added. In addition to the colloquium papers a number of further papers are published here for the first time: J. Hintikka on the semantics of propositional attitudes, R. Hilpinen on relativized modalities, C. Harrison on the unanticipated examiner and H. Smokler and M. Rohr on confirmation and translation. The volume is completed by two papers published in Synthese and a well-known paper in modal logic by Lemmon, Meredith, Meredith, Prior, and Thomas published complete with a new postscript by Prior. Although the collection is somewhat haphazard and seems to have no unifying theme, philosophers interested in these topics in philosophical logic will be thankful for the availability of the papers, both old and new.--R. Many adoptees face a number of challenges relating to separation from biological parents during the adoption process, including issues concerning identity, intimacy, attachment, and trust, as well as language and other cultural challenges. One common health challenge faced by adoptees involves lack of access to genetic-relative family health history. Lack of GRFHx represents a disadvantage due to a reduced capacity to identify diseases and recommend appropriate screening for conditions for which the adopted person may be at increased risk. In this (...) article, we draw out common features of traditionally understood “health disparities” in order to identify analogous features in the context of adoptees’ lack of GRFHx. (shrink)

While several tests and strategies are recommended for colorectal cancer (CRC) screening, studies suggest that primary care providers often recommend colonoscopy without providing information about its risks or alternatives. These observations raise concerns about the quality of informed consent for screening colonoscopy.
