Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. O objetivo deste artigo é mostrar a semântica da palavra Eros dentro da tradição cristã. Limita-se a algumas dessas significações. A reflexão mostra a limitação dessa expressão na língua portuguesa. Seu significado é muito mais rico na língua grega. Se a tradição cristã carregou esta palavra de forma negativa, outros Padres leram-na em sintonia com Ágape e com outros significados. A relação mística a interpreta como uma relação “erótica” entre homem e Deus. Esta intimidade procura explicar o aspecto do (...) desejo de Deus e da relação mútua entre aquele que ama e o amado, que tem sua raiz na busca mais íntima da humanidade. Negar por preconceitos palavras carregadas de desejos não divinos e nem dignos da humanidade, como na Antigüidade, é reduzir demais seu campo semântico na história. Esta palavra reflete o amor da alma para com Deus numa perspectiva mística, assume variações significativas, dentre tantas, como o amor de Jesus Cristo, como sinônimas de Ágape, do amor de Deus para com os homens, como amor individual ligado a Deus, o Eros como virtude e como castidade. A compreensão das dimensões do amor se realiza na capacidade de ver que todas elas são positivas e importantes para obtermos o equilíbrio da vida humana, numa harmonia destas dimensões constitutivas e importantes para a vida. ABSTRACT This article aims at demonstrating the semantics of the term Eros in Christian tradition, pointing out the limitations of the term in Portuguese. The scope of its meaning is much wider in Greek. If Christian tradition has charged the word with a negative feature, other priests have read it in tune with Agape and other meanings. The mystical perspective interprets it as an ‘erotic’ relationship between man and God. Such intimacy attempts to explain God’s desire and the mutual relation between the one who loves and the beloved, rooted in mankind’s most intimate longing. To deny, on account of prejudice, words charged with non-divine desires unworthy of humanity, as happened in antiquity, is to reduce their semantic field in history. That word reflects the soul’s love for God in a mystical perspective and assumes meaningful variations, among which Christ’s love, ‘Agape’ or God’s love for men, and individual love connected with God: ‘Eros’ as virtue and chastity. The comprehension of the dimensions of love takes place in the capacity to realize that they are all positive and relevant to human life’s balance, in the harmony of those dimensions that constitute life. Na "filosofia cristã" agostiniana a fé é condição primeira do conhecimento da verdade, entretanto, dá-se capital importância à razão no processo do conhecimento humano que está dividido em três níveis: conhecimento sensível, sensação e razão ou ciência. A magisterial study of the philosophy of physics that both introduces the subject to the non-specialist and contains many original and important contributions for professionals in the area. Modern physics was born as a part of philosophy and has retained to this day a properly philosophical concern for the clarity and coherence of ideas. Any introduction to the philosophy of physics must therefore focus on the conceptual development of physics itself. This book pursues that development from Galileo and Newton through (...) Maxwell and Boltzmann to Einstein and the founders of quantum mechanics. There is also discussion of important philosophers of physics in the eighteenth and nineteenth centuries and of twentieth-century debates. A unique and interdisciplinary collection in which scholars from Philosophy join those from Film Studies, English, and Comparative Literature to explore the nature and limits of love through in-depth reflection on particular works of literature and film.

This paper provides a philosophical assessment of leading theory-based, evidence-based and coherentist approaches to the definition and the measurement of well-being. It then builds on this assessment to articulate a reformed division of labor for the science of well-being and argues that this reformed division of labor can improve on the proffered approaches by combining the most plausible tenets of theory-based approaches with the most plausible tenets of coherentist approaches. This result does not per se exclude the possibility that theory-based (...) and coherentist approaches may be independently improved or amended in the years to come. Still, together with the challenges that affect these approaches, it strengthens the case for combining the most plausible tenets of those approaches. (shrink)

Although Volk may be considered as a central concept in the work of Carl Schmitt, and one to which the German jurist dedicated a sizable amount of writing, a remarkably limited number of publications have so far provided an analytical study of how Schmitt conceptualised Volk, particularly in English-language secondary literature. This article intends to address this gap by systematically reviewing how the concept of Volk appears in the Schmitt’s theoretical effort, with a particular focus on his publications from the (...) late 1920s to 1945, and how it relates to his main legal-theoretical and political claims, both in his constitutional doctrine (Staatsrechtslehre) as well as in international law. It sketches some interpretive pathways to locate Volk in a broader historical and theoretical context, and it offers a conceptualisation of the relation between Schmitt and existentialist nationalism. According to Composition is Identity, a whole is literally identical to the plurality of its parts. According to Mereological Nihilism, nothing has proper parts. In this note, it is argued that Composition is Identity can be shown to entail Mereological Nihilism in a much more simple and direct way than the one recently proposed by Claudio Calosi.

Whilst it may seem strange to ask to whom “I” refers, we show that there are occasionswhen it is not always obvious. In demonstratingthis we challenge Kaplan's assumptionthat the utterer, agent and referent of “I” arealways the same person.We begin by presenting what weregard to be the received view about indexicalreference popularized by David Kaplan in hisinfluential 1972 “Demonstratives” before goingon, in section 2, to discuss Sidelle'sanswering machine paradox which may be thoughtto threaten this view, and his deferredutterance method of (...) resolving this puzzle. Insection 3 we introduce a novel version of theanswering machine paradox which suggests that,in certain cases, Kaplan's identification ofutterer, agent and referent of “I” breaks down.In the fourth section we go on to consider arecent revision of Kaplan's picture by Predelliwhich appeals to the intentions of the utterer,before arguing that this picture is committedto unacceptable consequences and, therefore,should be avoided if possible. Finally, insection 5, we present a new revision ofKaplan's account which retains much of thespirit of his original proposal whilst offeringa intuitively acceptable way to explain all ofthe apparently problematic data. This paper reclaims the concept of solidarity for democratic theory. It does this by proposing a theory of solidarity as social involvement that is construed through the integration of three better known conceptions of solidarity that have played an influential role in the political thought of the last two centuries. The paper begins by explaining why solidarity should receive more sustained attention from political theorists with an interest in democracy, and proceeds by presenting two indispensability arguments. Section three outlines the (...) three rival conceptions of solidarity and contends that whilst individually incomplete, each provides an important insight, so that a fuller and more satisfying conception of solidarity can be developed by weaving together some features of these three conceptions. This task is undertaken in section four, which introduces the theory of solidarity as social involvement, defining solidarity in terms of acting-for and acting-with. Section five briefly discusses some of its potential implications for democratic theory, before bringing the article to a close. (shrink)

Several authors have recently advocated a so-called new case for paternalism, according to which empirical findings from distinct decision sciences provide compelling reasons in favour of paternalistic interference. In their view, the available behavioural and neuro-psychological findings enable paternalists to address traditional anti-paternalistic objections and reliably enhance the well-being of their target agents. In this paper, I combine insights from decision-making research, moral philosophy and evidence-based policy evaluation to assess the merits of this case. In particular, I articulate and defend (...) three complementary arguments that, I claim, challenge even the best available calls for such case. In doing so, I identify the main justificatory challenges faced by the new paternalists and explicate the implications of these challenges for the ongoing philosophical debate about the justifiability of paternalistic interference. This article argues for the elimination of the concept of life worth living from philosophical vocabulary on three complementary grounds. First, the basic components of this concept suffer from multiple ambiguities, which hamper attempts to ground informative evaluative and classificatory judgments about the worth of life. Second, the criteria proposed to track the extension of the concept of life worth living rest on unsupported axiological assumptions and fail to identify precise and plausible referents for this concept. And third, the concept (...) of life worth living is not shown to serve any major evaluative or classificatory purpose besides those served by already available axiological concepts. By eliminating the concept of life worth living, philosophers will free themselves of the task of addressing ill-posed axiological questions and ground reflection about the worth of life on more rigorous conceptual foundations. In this essay we will argue for the following theses: 1- know-how is not a form of practical knowledge devoid of propositional sense; 2- the relationship between each perception and the body itself is metaphysically contingent (organisms and bodies can vary, as can even the spaces they occupy in the same experience vary), 3- it is up to the brain to configure or to shape a physical body (Körper) into a living body (Leib) and not the other way around; 4- (...) phenomenal externalism of enactivist nature, even in its mild form, is empirically implausible: the correlation between the conscious character of sensory experience with spatiotemporal neuronal patterns is much more systematic and regular than with anything outside the brain. But in its radical form is entirely implausible and contra-intuitive: phenomenal duplicates are not necessarily duplicates of agency; in short, 5-we are our own brain that has a body, avatars, and artifacts, properly configured, and molded by the brain, and not a body that has a brain among other essential organs. This article reviews those claims and argues that Großraum has little to offer in analytical terms to enhance our understanding of the international political situation in this early twenty-first century. Those authors who wish to revive Großraum for the sake of their theoretical work overlook vitally important components of this concept. Proponents of neuroeconomics often argue that better knowledge of the human neural architecture enables economists to improve standard models of choice. In their view, these improvements provide compelling reasons to use neural findings in constructing and evaluating economic models. In a recent article, I criticized this view by pointing to the trade-offs between the modeling desiderata valued by neuroeconomists and other economists, respectively. The present article complements my earlier critique by focusing on three modeling desiderata that figure prominently in economic (...) and neuroeconomic modeling. For each desideratum, I examine findings that neuroeconomists deem to be especially relevant for economists and argue that neuroeconomists have failed to substantiate their calls to use these findings in constructing and evaluating economic models. In doing so, I identify methodological and evidential constraints that will continue to hinder neuroeconomists’ attempts to improve such models. Moreover, I draw on the literature on scientific modeling to advance the ongoing philosophical discussion regarding the prospects of interdisciplinary models of choice. (shrink)

This book concerns the soul/body problem in Plato and Aristotle. Established as well as early career scholars actually working on Plato and Aristotle explore - under different points of view as well as through original readings and interpretations - the manifold dimensions involved in the conception of the soul/body relation articulated by the two greatest founders of Western Thought. The book starts with an exploration of the relation between cause and matter in Plato and Aristotle, then some papers on Plato's (...) theory of soul and body are presented, which involve new advancements in the research about Platonic epistemology, moral and political theory, metaphysics of mind, even about his religious and 'theological' view. Some papers on Aristotle's model follow, which are focused on his so-called "hylomorphism" as an alternative view to Plato's alleged "dualism": the ontology of the soul/body relation in Aristotle is explored, as well as the implications of this theoretical framework for his theory of knowledge, his moral theory, his cognitive psychology. Finally, two papers critically assess the philosophical connections between Aristotle's hylomorphism and its modern and contemporary Wirkungsgeschichte. (shrink)

This article articulates and defends a dissolution of the so-called repugnant conclusion, which focuses on the notion of life worth living figuring both in Parfit's formulation of the repugnant conclusion and in most responses to such a conclusion. The proposed dissolution demonstrates that the notion of life worth living is plagued by multiple ambiguities and that these ambiguities, in turn, hamper meaningful debate about both the issue of whether the repugnant conclusion can be avoided and the issue of whether the (...) repugnant conclusion is actually repugnant. This result does not exclude that some modified versions of the repugnant conclusion may yield valuable insights about the value of populations and the tenability of different axiological/ethical theories. Still, if the proposed dissolution is correct, then the repugnant conclusion rests on an ill-defined notion and we lack the information required to assess the merits of the repugnant conclusion. Normative welfare economics commonly assumes that individuals’ preferences can be reliably inferred from their choices and relies on preference satisfaction as the normative standard for welfare. In recent years, several authors have criticized welfare economists’ reliance on preference satisfaction as the normative standard for welfare and have advocated grounding normative welfare economics on opportunities rather than preferences. In this paper, I argue that although preference-based approaches to normative welfare economics face significant conceptual and practical challenges, opportunity-based approaches fail to provide (...) a more reliable and informative foundation for normative welfare economics than preference-based approaches. I then identify and rebut various influential calls to ground normative welfare economics on opportunities rather than preferences to support my qualified defence of preference-based approaches. According to Hans Jonas (1903–1993), the modern technological progress endowed humanity with wondrous power, which in the long run risks altering the nature of human action. This is especially true for the realm of collective action, the effects of which evidence an unpredicted issue: the ecological crisis, which is the “critical vulnerability” of nature to technological intervention. This discovery brings to light that the whole biosphere of the planet has been added to that which human beings must be responsible for (...) because of their power over it. There is, however, a further dimension of vulnerability (and responsibility) to be considered, namely the one which characterizes organic life as such. Indeed, the essence of all living organisms–human beings included–is characterized by vulnerability, given their precarious and unstable condition of “needful freedom” towards the environment. Nevertheless, terrestrial life fl ourished through a multifaceted and unplanned (thus, again, vulnerable) evolution of living forms, ranging from bacteria to human beings – these evidencing a unique degree of freedom, which Jonas refers to as a “metaphysical gap” towards other living beings. The problem is that the present-day technology provides the possibility to manipulate the very essence of life and human nature. Is this process to be accepted and accomplished? And what about the related risks? Indeed, according to Jonas, issues such as genetic manipulation, euthanasia, organ transplantation, assisted reproduction, exploitation of other living beings etc., raise ethical dilemmas which can be addressed thanks to the idea of vulnerability.
