Di fronte al timore degli Spartani di un loro possibile tradimento a favore dei Persiani, essi rispondono che non farebbero mai una cosa simile perché i Greci hanno lo stesso sangue, parlano la stessa lingua e venerano gli stessi dèi. Siamo di fronte ad una delle più antiche ed efficaci definizioni di comunità dal punto di vista identitario che presenta però al (...) contempo alcune tracce di ambiguità. Erodoto fornisce, infatti, un quadro molto problematico del mondo greco del V secolo in cui spesso le città appaiono interessate maggiormente alla difesa dei loro interessi, piuttosto che al sostegno degli alleati. Lo scopo di questo contributo è comprendere fino a che punto per Erodoto, che visse almeno in parte la violenza fratricida della Guerra del Peloponneso, esistesse la ‘Grecità’ e quanto questa idea fosse rilevante in un periodo di così grave divisione per il mondo ellenico. Risk and crisis communication (RCC) is a current ethical issue subject to controversy, mainly due to the tension between individual liberty (a core component of fairness) and effectiveness. In this paper we propose a consistent definition of the RCC process in public health emergencies (PHERCC), which comprises six key elements: evidence, initiator, channel, publics, message, and feedback. Based on these elements and on a detailed analysis of their role in PHERCC, we present an ethical framework to help design, govern and (...) evaluate PHERCC strategies. The framework aims to facilitate RCC, incorporating effectiveness, autonomy, and fairness. It comprises five operational ethical principles: openness, transparency, inclusivity, understandability, and privacy. The resulting matrix helps understanding the interplay between the PHERCC process and the principles of the framework. The paper includes suggestions and recommendations for the implementation of the PHERCC matrix. (shrink)

In recent years, the biomedical field has witnessed the emergence of novel tools and modelling techniques driven by the rise of the so-called Big Data. In this paper, we address the issue of predictability in biomedical Big Data models of cancer patients, with the aim of determining the extent to which computationally driven predictions can be implemented by medical doctors in their clinical practice. We show that for a specific class of approaches, called k-Nearest Neighbour algorithms, the ability to draw (...) predictive inferences relies on a geometrical, or topological, notion of similarity encoded in a well-defined metric, which determines how close the characteristics of distinct patients are on average. We then discuss the conditions under which the relevant models can yield reliable and trustworthy predictive outcomes. (shrink)

This article argues that Robert Alexy's influential theory of balancing is affected by a contradiction that makes it unfeasible as an instrument by which to explain some aspects of law and legal reasoning it aims to clarify. In particular, I will show that one of the premises of Alexy's theory of balancing is incompatible with its conclusion. Alexy's theory is based upon a sharp distinction between rules and principles. However, as my analysis will demonstrate, its conclusion implies that it is (...) impossible to distinguish between rules and principles. This is because the so‐called weight formula and the law of colliding principles (i.e., the two main notions used by Alexy to explain balancing) cancel out any difference between these two types of norms. _Philosophy of Molecular Medicine: Foundational Issues in Theory and Practice_ aims at a systematic investigation of a number of foundational issues in the field of molecular medicine. The volume is organized around four broad modules focusing, respectively, on the following key aspects: What are the nature, scope, and limits of molecular medicine? How does it provide explanations? How does it represent and model phenomena of interest? How does it infer new knowledge from data and experiments? A significant cluster of complaints of persons affected by schizophrenia, for example, their feeling ephemeral, lacking core identity, being affected by a diminished sense of existing as a self-present subject, point to the disruptions of structural aspects of the core self. These and similar disturbances aggregate significantly and selectively in the schizophrenia spectrum disorders, occur and are detectable in adolescents at risk of future schizophrenic disorder, and have a tendency to persist. The notion of being a burden to others is mostly discussed in the context of care‐intensive diseases or end‐of‐life decisions. But the notion is also crucial in decision‐making at the beginning of life, namely regarding prenatal testing. Ever more sophisticated testing methods, especially non‐invasive prenatal testing (NIPT), allow the detection of genetic traits in the unborn child that may cause disabilities. A positive result often influences the decision of the pregnant women towards a termination of the pregnancy. Thus, critics claim (...) that these testing methods send a negative message to people with disabilities. At the core of this is what we call the burden assumption. This assumption claims that children with disabilities are necessarily a burden to others, especially to their parents and other family members. In this paper, we discuss what being a burden to others means in this context and how such an attitude can be avoided without restraining reproductive autonomy. A closer examination shows that the burden assumption is mostly based on misinformation and a false model of disability. Empirical studies as well as narrative evidence from parents who raise a child with disabilities show that the burden assumption is wrong. Raising a child with disabilities does not necessarily mean a decrease in the quality of life. We show how the burden assumption can be challenged through an advanced genetic counselling that combines empirical evidence with narratives from a first‐person perspective. (shrink)

This essay is unique in putting intersubjectivity front and center. It is an attempt to provide a clinical method to re-establish the fragile dialogue of the soul with oneself and with others. Throughout, the book builds on the assumption that to be human means to be in dialogue. It uses dialogue as a unitary concept to address three essential issues for clinical practice: 'What is a human being?', 'What is mental pathology'?, and 'What is care?'. To be human - it (...) is argued - means to be in dialogue with oneself and with other persons. Thus, mental pathology is the interruption of this dialogue - of the person with the alterity that inhabits them, and with the alterity incarnated in other persons. Therefore, therapy is a dialogue with a method whose aim is to re-enact one's interrupted dialogue with alterity. Lost in Dialogue provides a method to approximate the Other, to understand its experiences, actions, and in general, understand the world in which it lives. (shrink)

We propose here the first translation into Portuguese of Giovanni Pico della Mirandola’s small treatise De Ente et Uno (1491). The translation is preceded by a brief presentation in which the work is contextualized within the scope of the thought of its young author and in the Florentine philosophical environment of the end of the Quattrocento. In the aftermath of the controversies between defenders of Plato and defenders of Aristotle, a quarrel brought by Greek and Byzantine intellectuals into Italy, (...) who exacerbated the differences between the two philosophers, there were also others who tried to show the essential concord between them, a purpose of which Pico’s treatise is one of the most expressive and relevant documents, seeking to prove the equivalence between Plato’s One and Aristotle’s Being. The concept of living has changed in time along the history of biology and its specificity has been associated or to a particular matter, active such as the chemical one, or was considered as a product of the spatial organization of a passive matter. Today, these two paths can be merged in the chemical perspective that takes account of the general reflections on the complexity and on the systemic, in the “systemic complexity” approach.

Richard Owen has been condemned by Darwinians as an anti-evolutionist and an essentialist. In recent years he has been the object of a revisionist analysis intended to uncover evolutionary elements in his scientific enterprise. In this paper I will examine Owen's evolutionary hypothesis and its connections with von Baer's idea of divergent development. To give appropriate importance to Owen's evolutionism is the first condition to develop an up-to-date understanding of his scientific enterprise, that is to disentagle Owen's contribution to the (...) modernization of typology and morphology. I will argue that Owen's Platonic essentialism is rhetorical and incongruous. On the contrary, an interpretation of the archetype based on Aristotle's biological works makes possible a new conception of type, based on a homeostatic mechanism of stability. The renewal of morphology hinges on homological correspondences and a homeostatic process is also the origin of serial and special homology. I will argue that special homology shows an evolutionary orientation insofar as it is a typically inter-specific character while serial homology is determined through an elementary usage of the categories of developmental morphology. Two problems related to the biological identity of living beings are faced: the who-problem (which are the biological properties making that living being unique and different from the others?); the persistence-problem (what does it take for a living being to persist from a time to another?). They are discussed inside a molecular biology framework, which shows how epigenetics can be a good ground to provide plausible answers. That is, we propose an empirical solution to the who-problem and to the persistence-problem (...) on the basis of the new perspectives opened by a molecular understanding of epigenetic processes. In particular, concerning the former, we argue that any living being is the result of the epigenetic processes that have regulated the expression of its genome; concerning the latter, we defend the idea that the criterion for the persistence of its identity is to be indicated in the continuity of those epigenetic processes. We also counteract possible objections, in particular (1) whether our approach has something to say at a metaphysical level; (2) how it could account for the passage from the two phenotypes of the parental gametes to the single phenotype of the zygote; (3) how it could account for the identity of derivatives of one living being that continue to live disjoined from that original living being; (4) how it could account for higher mental functions. In this commentary, I focus on Jones' suggestion of a close connection between the domain of space and that of kinship. I expand on that suggestion by introducing the concept of frame of reference and show how it can possibly participate to the generation of kinship systems.

Digital technologies have become a crucial factor in nursing. Given the fact that many tasks could also be done by robots or AI systems, the place for the nurse in this scenario is unclear. In what way and to what extent will the implementation of ever more sophisticated technology affect nursing practice? It is the aim of this paper to analyse the potential challenges of nursing practice in the digital age. The analysis is conducted through the lens of new materialism, (...) a set of theoretical models that understand the relationship between humans and technology as dynamic and performative. According to this view, there is no prefixed essence of technology. Rather, the meaning of technology is enacted in concrete practice. The analysis shows that in past debates on technology use in nursing, the nurses’ role has been defined as guardians of humanity, defending the patient against the dehumanizing effects of technology. This role has been transferred to the digital age, where it is the duty of nurses to cushion the negative effects of digital technology. As an alternative to this outdated role, nurses should be included in processes of technology design and policymaking. Enabling nursing professionals to shape the circumstances of a digitally enhanced holistic practice may empower their status within the healthcare system and also benefit the patient by contributing to a more person‐centred care. This article offers a comparative exploration of the practices of resistance Theodor Adorno and Michel Foucault champion against the structures of modern power their enquiries have the merit to illuminate and contest. After a preliminary examination of their views about the relationship between theory and praxis, I shall pursue two goals: first, I shall illustrate the limitations of Adorno’s negativist portrait of an ethics of resistance and contrast it with Foucault’s more promising notion of resistance as strategic counter-conduct, which in (...) his late ethico-political writings becomes the heart of a distinctive politics of the governed. Second, despite their dissimilarities, I shall argue that their ideas can be brought together to elaborate a ‘compounded’ account of resistance, where Adorno’s politics of suffering figures as the necessary pre-condition for the creative practices of freedom Foucault seeks to encourage. The paper provides a conceptual distinction between evidence assessment criteria and standards of proof. Evidence must be assessed in order to check whether it satisfies a relevant standard of proof, and the assessment is operated with some criterion; so both criteria and standards are necessary for fact-finding. In addition to this conceptual point, the article addresses three main questions: Why do some scholars and decision-makers take assessment criteria as standards of proof and vice versa? Why do systems differ as to (...) criteria and standards? How can a system work if it neglects one of these things? The answers to the first and second question come from the historical and procedural differences between the systems. The answer to the third focuses on the functional connection between criteria and standards. (shrink)

This article models legal interpretation through argumentation and provides a logical analysis of interpretive arguments, their conflicts, and the resulting indeterminacies. Interpretive arguments are modelled as defeasible inferences, which can be challenged and defeated by counterarguments and be reinstated through further arguments. It is shown what claims are possibly (defensibly) or necessarily (justifiably) supported by the arguments constructible from a given interpretive basis, i.e., a set of interpretive canons coupled with reasons for their application. It is finally established under what (...) conditions such arguments provide single outcomes or rather support alternative interpretive conclusions, thus leading to propositions of law whose truth‐value is undetermined. Scientific concepts, laws, theories, models and thought experiments are representations but uniquely different. In On Scientific Representation each is given a full philosophical exploration within an original, coherent philosophical framework that is strongly rooted in the Kantian tradition (Kant, Hertz, Vaihinger, Cassirer). Through a revisionist historical approach, Boniolo shows how the Kantian tradition can help us renew and rethink contemporary issues in epistemology and the philosophy of science.

The purpose of this paper is methodological. I begin by showing the methodological frailties of both the heart and brain approach to the criteria of death used in connection with organ transplantation. I then clarify what a definition is. Finally, I propose to abandon the definition of death, and suggest a pragmatic definition of ‘explantability window’.

In March 2019, the German Gemeinsamer Bundesausschuss (G‑BA; Federal Joint Committee) presented the result of the method assessment process on non-invasive prenatal testing (NIPT). The aim of this method assessment process was to decide whether NIPT should become a publicly funded procedure of routine prenatal care. The G‑BA decided in favor of NIPT, making the implementation of NIPT very likely, provided that other healthcare and political institutions also agree. This development could be interpreted as empowering from the perspective of reproductive (...) autonomy, since NIPT allows pregnant women to obtain valuable information on the health of the fetus in a fast and easy manner and without the risks of invasive methods. However, the routinization of NIPT also implies ethical challenges. Will the routinization lead to a normalization of prenatal quality control? Will it lead to an expansion to women outside the high-risk group? What would be the ethical implications of such a development? How should physicians, geneticists, and patients deal with the increased amount of obtainable information? What are the implications for choice and decision-making in the prenatal care context? In this paper, we analyze the ethical aspects of the routinization of NIPT, focusing on information and the counseling process, the burden of choice, and the threats to reproductive autonomy by societal interests linked to NIPT. This work aims to scrutiny the concept of “taste” as developed by David Hume. Firstly, it will be highlighted the impossibility of thinking taste neither as a sub- jectivist nor objectivist aesthetic theory; on the contrary, it will be shown, through Agamben’s work, its underlying radical dialectical structure that seeks to unite subject and object. Furthermore, thanks to Deleuze’s enquiry in Hume’s thought, it will be possible to argue that Hume’s theory of art, rather than being a simple consequence of (...) his theory of mind, plays a fundamental role in the whole Humean system, especially in the accounts on history, civilization, and the role of philosophy. We argue that, in the case of research biobanks, there is a need to replace the currently used informed consent with trusted consent. Accordingly, we introduce a proposal for the structure of the latter. Further, we discuss some of the issues that can be addressed effectively through our proposal. In particular, we illustrate: i) which research should be authorized by donors; ii) how to regulate access to information; iii) the fundamental role played by a Third Party Authority in assuring compliance (...) with the reciprocal expectations and obligations of donors and scientists. Finally, we briefly analyse two issues that might represent important elements of a ‘new alliance’ between researchers and donors to which the trusted consent could pave the way: i) the correlations between needs and rights of the two parties, and ii) possible economic transactions.
