In the mid-1260s in Paris, a dispute raged that concerned the relationship between faith and the Augustinian theological tradition on the one side and secular leaning as represented by the arrival in Latin of Aristotle and various Islamic and Jewish interpreters of Aristotle on the other. Masters of the arts faculty in Paris represented the latter tradition, indicated by the phrase "double truth theory." In 1269, Thomas Aquinas wrote the polemical work On There Being Only One Intellect, Against the Averroists (...) (De unitate intellectus contra averroistas). Thomas is intent on countering two views: first, that intellect is not a faculty of the soul that animates our body, and second, that there is a single intellect existing separately that suffices for all people. Brief as it is, this work puts into play all the significant strands of Thomas's teaching on man - historical doctrinal, philosophical, and theological. It is a valuable source for discussing Thomas's views on the relationship between Aristotle and Christianity and puts to rest the misleading claim that Thomas baptized Aristotle." The introduction places the work historically and sketches the controversy to which it was a contribution. Part 2 includes the Latin Leonine text and McInerny's translation. Part 3 analyzes the basic arguments of Thomas's work and provides a series of interpretive essays meant to make Thomas accessible to today's readers. (shrink)

Corruption within the private sector has often not been dealt with in Brazil. Organizations may find corrupt acts in its operations or practices, but specific concepts and programs to avoid them are neither concrete nor clear. Some Brazilian stockholders have become aware of the risks involved in unethical procedures and are adopting the Best Practices of Corporate Governance initiative. International agencies have intensively supported organizations and governments in an effort to define policies that inhibit illegal or corrupt cultural habits throughout (...) the world, but Brazilian practitioners show insufficient response. Skepticism may indicate a lack of understanding about how an ethical leadership can guide employees, setting high standards for the organizational culture and climate, clearly defining limits of correct behavior, and creating appropriate codes of ethics. Transparency still has to be discovered as a significant tool to encourage professionalism in performance and reporting of data in Brazilian companies. In this article, we analyze the ethical behavior of the purchasing department of a multinational company in its host country, Brazil. It focuses specifically on the supplier–buyer relationship. The results indicate that despite the negative reputation Brazilians have in business ethics, a company can still develop a positive and ethical relationship with its stakeholders. Communication, transparency, compliance with the company’s code of conduct as well as the supplier’s awareness of the buyer’s code of conduct are the factors which influence the supplier–buyer relationship. Transparency can be used as a tool to reduce corruption, thereby increasing ethical behavior and company image. Good ethical behavior can help to build up a company’s image. (shrink)

Le présent article envisage une controverse philosophico-théologique interne à l’Église catholique qui, au milieu du XVIe siècle, précède et annonce les débats qui présideront à la préparation du décret sur les saintes images promulgué lors de la dernière (25e) session du concile de Trente. Il porte en particulier sur l’un des principaux points d’achoppement qui touche à l’interprétation d’une thèse de Thomas d’Aquin, laquelle est une reprise, mais adaptée à un autre contexte, d’un texte d’Aristote. Cette thèse porte sur le (...) type de vénération qui doit être rendu à l’image, et en particulier à celle du Christ. Il s’agit ici de montrer comment ce débat entremêle étroitement des enjeux philosophiques et théologiques qui touchent aussi bien à des questions de perception de l’image que de connaissance par l’image, tout en engageant un délicat questionnement sur les pratiques religieuses. Giorgio Agambens Frage nach dem ethischen und epistemologischen Status des Zeugnisses im Kontext der Shoah, wie er sie in seiner Arbeit Was von Auschwitz bleibt. Das Archiv und der Zeuge aufwirft, konzentriert sich auf die Analyse einer Figur der nationalsozialistischen Vernichtungslager, die Primo Levi ins Spiel gebracht hat, um die Authentizität seines eigenen Zeugnisses als Überlebender in Frage zu stellen: den Muselmann, stummes Opfer auf der untersten Stufe der Lagerhierarchie. Der Artikel unternimmt eine kritische Analyse des Agambenschen Arguments, das Paradox (...) des sprachlosen Zeugnisses, das der Muselmann repräsentiert, sei der unschätzbare Rest, die Lücke, die weder ganz dem Menschlichen noch ganz dem Nicht-Menschlichen zugeschlagen werden kann. Er versucht zu zeigen, dass dieses mit erheblichem rhetorischen Aufwand entwickelte Argument keinen Erkenntnisgewinn im Zusammenhang der Frage nach Authentizität von Zeugnissen erbringt. Ihm gegenüber wäre eine Sichtweise zu favorisieren, die den Plural aller erreichbarer Zeugnisse betont, die die Perspektivität jedes Einzelnen hervorheben kann, ohne seine Einzigartigkeit zu unterschlagen. Dès la Bible, l’oeuvre d’art a souvent été dénoncée comme apparence trompeuse et incitation à l’adoration idolâtrique. S’affranchissant de ses fonctions essentiellement religieuses, elle est ensuite passée des églises aux musées, de l’adoration religieuse à l’admiration esthétique, d’une présence sacrée à l’expression du génie de l’artiste. Aujourd’hui, alors que certains dénoncent la quête de l’art pour l’art et que l’image règne sur les grands et les petits écrans, il demeure toujours aussi difficile d’apprécier l’image à sa juste valeur, de reconnaître (...) sa fonction médiatrice, entre idolâtrie et iconoclasme, entre aveuglement et lucidité désabusée. L’objet de la présente recherche est d’interroger les mérites de la théorie utilitariste relative aux faillites personnelles, qui est dominante dans la littérature juridique depuis que le courant Law and Economics a gagné en importance. Nous démontrons que l’argumentation utilitariste, qui est assignée aux doctrines de l’acquittement des dettes personnelles par les spécialistes de Law and Economics travaillant dans le domaine du droit des faillites, soulève des questions normatives de taille et créée des tensions quand il s’agit de décrire le (...) phénomène. Ces deux problèmes invitent les théoriciens à proposer des modèles alternatifs pour décrire les conditions dans lesquelles nos systèmes juridiques soulagent les dettes des individus qui ne sont pas en mesure de les honorer. Dans notre ouvrage à paraître, The Virtue of Bankruptcy, nous embrassons ce projet. Ici, nous proposons une étape préliminaire à ce projet plus ambitieux en démontrant que les théories utilitaristes sur lesquelles s’appuient les contributions les plus importantes de la littérature sur la question à ce jour sont perfectibles lorsqu’il s’agit de comprendre les raisons et les circonstances dans lesquelles il est possible d’offrir un nouveau départ à ceux qui n’ont pas respecté leurs obligations financières.
