Œuvre de maturité de François Suarez (1548-1617), Des lois et du Dieu législateur a été publié en latin en 1612. Parmi les dix livres que comprend cet ouvrage, nous avons choisi de présenter pour la première fois les deux premiers en langue française. À partir de l'héritage retravaillé de la philosophie politique antique et médiévale, Suarez élabore une théorie originale de la loi et de la communauté en renouvelant leur rapport à l'éthique et à la jurisprudence. Dans une période marquée (...) notamment par la controverse de Valladolid (1550) et la Contre-Réforme, l'auteur redéfinit le contenu et la finalité des concepts fondamentaux de la théorie politique (l'état de nature, le droit naturel, le droit subjectif, la loi naturelle, le pacte social, la souveraineté, l'État et le droit des gens) en les articulant à une compréhension historique de l'homme conçu comme être libre, raisonnable et fini. Suarez instaure ainsi les conditions d'un basculement du théologico-politique dans la modernité dont les effets se feront sentir, entre autres, chez Grotius et l'École du droit naturel. Les conséquences de ce mouvement seront perceptibles jusqu'au XVIIIe siècle avec Wolf. Des lois et du Dieu législateur permet précisément d'apprécier à sa juste mesure la place privilégiée qu'il convient de redonner à la théorie suarézienne de la loi dans l'histoire de la pensée politique. Francisco Suarez (1548-1617) jesuite, juriste et theologien espagnol est un representant emblematique de la seconde scolastique. Sa reflexion se deploie dans le cadre bouillonnant de l'Universite de Salamanque qui voit la theologie se renover profondement. Considere comme un des plus grands theoriciens des questions juridiques et politiques, son maitre ouvrage, le De Legibus, a marque une etape essentielle de la reflexion anthropologique sur la nature politique de l'individu, mais est surtout remarquable pour le role qu'il a joue dans le long (...) processus de reflexion et de modernisation de la conception antique du pouvoir politique. Les reflexions et orientations qu'il propose sont, pour un certain nombre, a l'origine des outils et conceptions modernes de la politique en general et de la loi en particulier. Jean-Paul Coujou est professeur a la faculte de philosophie de l'Institut catholique de Toulouse et membre de l'Institut Michel Villey. La philosophie de Suárez dans sa confrontation implicite à l’héritage de Thomas More (1478−1535) et de Madrigal (1410?−1455), permet de dégager une double orientation au cœur de la constitution de la théorie politique : celle de la recherche du meilleur régime, du gouvernement idéal, de la meilleure des républiques qui l’emporterait dans l’ordre du bien vivre et que rien ne surpasserait en son genre, espace privilégié où s’exercerait sans contraintes l’imagination sociale ; et celle qui viserait à établir, non la (...) meilleure forme de gouvernement mais qui, en accord avec ce que les hommes sont, créerait les conditions de leur perfectionnement. Il ne s’agirait pas tant de théoriser le meilleur système de gouvernement que de se donner les moyens de poser les fondements du gouvernement le plus adéquat eu égard à la nature humaine. Le pouvoir est au coeur du questionnement politique. L'émergence de l'Etot, au sens moderne, s'appuie sur différentes conceptions du pouvoir, qui évoluent au cours des siècles. L'intérêt de cet ouvrage collectif réside dans la diversité des auteurs étudiés, de Thomas d'Aquin à Hobbes, en passant par Vitorio, jusqu'aux très contemporaines analyses de Claude Lefort.

Cet ouvrage se propose d'examiner chez Suárez (1548-1617), comment la théorie du droit et de la loi prolonge la pensée de l'étant élaborée par la métaphysique en une compréhension ontologique du politique. Il s'agit précisément de mener à son terme, dans un système unifié du savoir, la détermination de l'étant en procédant à son extension à la question de l'être de l'homme et de l'être-en-commun propre à la société politique. Au commencement du XVII° siècle, une autre direction pour l'accomplissement du (...) projet ontologique non identifiable à celle d'une science mathématique de la nature se profile et préfigure une récurrence persistante des origines de la philosophie. L'index detaille de la Metaphysique d'Aristote publie en 1597 par Suarez, constitue une introduction aux Disputes metaphysiques. Il a pour objectif de produire les conditions d'un renouvellement de l'heritage de la Metaphysique d'Aristote en redefinissant le contenu et les limites d'une science de l'etant.Le projet de refondation de la metaphysique comme ontologie s'effectue dans cet ouvrage de presentation en quatre moments:1) L'exposition du probleme de la nature de la connaissance qui implique le depassement de l'equivocite de la notion de sagesse.2) (...) La determination de l'objet, des proprietes et des principes veritables de la metaphysique en tant que science de l'universel, c'est a dire de l'etantite de l'etant selon son abstraction la plus extreme.3) La redefinition du statut de la realite a partir d'une theorie de la representation de l'objet qui fasse abstraction de l'objet, c'est a dire qui procede a l'indifferenciation des etants afin d'en donner une representation universelle et abstraite; ainsi est affirme le primat d'une ontologie de l'essence sur toute ontotheologie.4) Enfin, la mise en place d'un systeme de reference transcendantal rendant possible une fondation universelle de la comprehension de l'etant par la mediation d'une theorie du concept.L'index prefigure ainsi, par son ambition et sa demarche, ce que Heidegger nommera, en evoquant la philosophie de Suarez, l'avenement du "caractere fondamental de la metaphysique moderne". El presente artículo analiza el enfrentamiento entre la obra de Suárez y la de Berkeley. Suárez es un representante de la corriente jesuita de la Contrarreforma comprometida en una polémica con Jaime I de Inglaterra sobre la fundación y la legitimidad del poder de derecho divino en la _Defensio __fidei catholicae adversus de anglicana secta_. La teoría de Berkeley, obispo anglicano ortodoxo y conservador que se ocupa de la obediencia pasiva fiel al imperativo paulino según el cual « el que (...) resiste a la autoridad civil resiste al orden que Dios ha establecido» está desarrollada en _Sobre la obediencia pasiva_. Tal enfrentamiento permite reformular la cuestión de la base del consentimiento a la ley, así como la de los límites que le corresponde o no al ser razonable y libre, poder aplicarlo. La comparación se realiza a partir del análisis de 1) Los límites del poder transferido por la comunidad política al soberano; 2) las condiciones para la desobediencia y 3) la necesidad ontológica de la resistencia. In this chapter, the possibility of experiments in mathematics is examined. A general scheme is proposed as a tool to handle the different forms of experiments that are being used in mathematical practices: computations, “experimental mathematics” as a new research domain in mathematics and computer science, real-world experiments, and thought experiments. In a final section, extensions of the scheme are proposed that further support the conclusion that mathematical experiments are indeed facts and the future.

Sartre asserted that existentialism was essentially a doctrine for philosophers, though, ironically, he (...) was about to make it accessible to a general audience. The published text of his lecture quickly became one of the bibles of existentialism and made Sartre an international celebrity. The idea of freedom occupies the center of Sartre’s doctrine. Man, born into an empty, godless universe, is nothing to begin with. He creates his essence—his self, his being—through the choices he freely makes (“existence precedes essence”). Were it not for the contingency of his death, he would never end. Choosing to be this or that is to affirm the value of what we choose. In choosing, therefore, we commit not only ourselves but all of mankind. The Transcendence of the Ego may be regarded as a turning-point in the philosophical development of Jean-Paul Sartre. Prior to the writing of this essay, published in France in 1937, Sartre had been intimately acquainted with the phenomenological movement which originated in Germany with Edmund Husserl. It is a fundamental tenet of Husserl, the notion of a transcendent ego, which is here attacked by Sartre.
