This essay interprets John Locke's teachings about private societies, or free private associations. The essay proceeds by interpreting Locke's mature writings on ethics, politics, and philosophy, and then by illustrating Locke's teachings as they apply to two contemporary problems in associational freedom. Although Locke wrote about private societies primarily in the course of arguing for religious toleration, throughout his mature corpus he develops an internally consistent general theory of associational freedom. At first glance, Locke seems to suggest that all citizens (...) are entitled to associate for any end of their choosing, to control admission into and expulsion from their membership, and to enforce their own internal rules of governance. However, Locke qualifies this broad right to bar societies from organizing around ends inconsistent with the minimal moral and political conditions of liberalism. Ultimately, Locke suggests, citizens deserve a broad right of private society only to the extent that they are well enough formed by their regime and its private institutions to be capable of governing themselves in both private and public life.In contrast with contemporary practice, Locke's justification is broader in some respects and narrower in others. The essay illustrates the implications by considering how Locke's teachings justify limiting the scope of anti-discrimination laws and enlarging the scope of government efforts to dissolve seditious associations. ABSTRACTIn scholarship on intellectual property, nonconsequentialist justifications for IP rights seem to suffer from one of two flaws. To some, such justifications seem indeterminate; they seem not to offer concrete guidance about how rights should be structured in practice. To others, such justifications seem dogmatic; they seem to mandate certain conclusions without letting decision makers consider the relevant context or consequences of different proposals to regulate IP. Both impressions neglect an important dimension of reasoning about rights—practical reason. In perfectionist theories (...) of law, ‘practical reason’ describes the principles by which general justifications for rights are implemented in specific decisions in politics and ethics. This article introduces practical reason to IP scholarship, and it shows how practical reason facilitates reasoning about the design of different legal IP rights. Natural Property Rights presents a novel theory of property based on individual, pre-political rights. The book argues that a just system of property protects people's rights to use resources and also orders those rights consistent with natural law and the public welfare. Here I consider the two most venerated arguments about the existence of God: the Ontological Argument and the Argument from Evil. The Ontological Argument purports to show that God’s nature guarantees that God exists. The Argument from Evil purports to show that God’s nature, combined with some plausible facts about the way the world is, guarantees (or is very compelling grounds for thinking) that God does not exist. R. Malthus's Essay on Population (1798), which he later claimed first suggested to him the idea that "on the whole the best fitted live." This idea Darwin would popularize through the notion of the "struggle for existence," a phrase which he famously claimed to use as a "metaphor" but which meant simply "the doctrine of Malthus applied with manifold force to the whole animal and vegetable kingdoms." 2 That application resulted in the publication [End Page 223] of the Origin of Species in 1859, an occasion hailed as "the greatest event of Queen Victoria's reign," 3 even "by far the most important... in the history of the modern West." 4 It is well known, too, that Darwin's appreciation of Malthus was not unique even among naturalists. There are many alleged problems with trusting another person’s moral testimony, perhaps the most prominent of which is that it fails to deliver moral understanding. Without moral understanding, one cannot do the right thing for the right reason, and so acting on trusted moral testimony lacks moral worth. This chapter, however, argues that moral advice differs from moral testimony, differs from it in a way that enables a defender of moral advice to parry this worry about moral worth. The basic (...) idea is that an advisor and an advisee can together constitute a joint agent, and that this joint agent’s action can indeed have moral worth. So while the advisee himself might not do the right thing for the right reason (this because all alone he lacks the right reason), and while the advisor herself might not do the right thing for the right reason (this because all alone she does not do the right thing), they together do the right for the right reason. This paper argues that the classification of propositional attitudes into the de re, de dicto, and de se is incomplete. De se attitudes are widely agreed to be closely connected to de re attitudes. But there is a species of belief that is linked to agent-centered action in the way that de se beliefs are, but is also associated with entities, places, and especially times, under a description. These mark out a fourth kind. One way to think about what makes (...) them distinctive is that, despite being ‘essentially indexical’ they can be retained across different contexts of evaluation without having diagonal content. The paper also discusses the connection between such beliefs and the kinds of utterances (like ‘Don't put off for tomorrow what you can do today’) that are contested as examples of what David Kaplan called ‘monsters.’. No citizen should be denied the right to vote due solely to her age. We can see this by showing that all objections to it fail. It might be objected that it is not unjust to so deprive children because children as a group are unintelligent or irrational, have their interests already represented by the parents, or are justly deprived of many other rights, among other reasons. But all these objections fail because there is no evidence to support it, even (...) if true, this would not justify disenfranchisement, or, most prominently argued here, they deprive individuals of political rights based upon their membership in a group. The debate over the influence of American culture upon Europe and the rest of the world is hardly new. Discussions about the cultural effects of video recorders, satellite broadcasting, cable television and their likely content are only the latest episode in a long-running drama in which the young and aggressive culture of America bludgeons the elderly culture of old Europe (or correspondingly overruns and wipes out the quaint but ill-armed ethnic cultures of the less-developed world, dragging the natives from coconuts (...) to Coca-Cola in a generation of identity crisis). But though there has been much written about some aspects of this issue, and most non-Americans who have come into contact with American culture have some awareness of its dimensions, there is also much which remains unclear, and ill- or misunderstood. In this essay two aspects of this large and complex problem will be examined. Firstly, the problem of how the “Americanisation of world culture” has been understood until now will be outlined, by looking at its background in the mass culture critique of the 19th and 20th centuries, with some current notions of what American culture is, and some accounts of how it has been internationalized. My aim in this first section is in particular to try to isolate “American culture” from commercial and industrial culture more generally, for a conflation of these phenomena is widespread and very misleading. Secondly, a normative argument will be outlined from the premises that a “superculture” is indeed developing and that, though it is less threatening than many suspect, it requires a vital measure of resistance if many valuable elements of human experience are not to be relegated to anthropology museums. The central value which will be defended here, however, is not “Europeanism” or “Americanism”, but rather the central liberal virtue of diversity, of which cultural expression is an extremely important form. My attempt to develop a politics of cultural protectionism, then, represents a wish to surpass simplistic rejections of American culture and to come to terms with the confrontation of culture with industrial society itself. This involves going beyond the traditional discussion of culture in one country, however, and trying to extend the mass culture debate to the international arena, where the present debate on this problem is far more complex but often less sophisticated. This Element introduces the philosophical literature on models, with an emphasis on normative considerations relevant to models for decision-making. Chapter 1 gives an overview of core questions in the philosophy of modeling. Chapter 2 examines the concept of model adequacy for purpose, using three examples of models from the atmospheric sciences to describe how this sort of adequacy is determined in practice. Chapter 3 explores the significance of using models that are not adequate for purpose, including the purpose of informing (...) public decisions. Chapter 4 provides a basic framework for values in modelling, using a case study to highlight the ethical challenges in building models for decision making. We review and present a new meta‐analysis of research suggesting that ethicists in the United States appear to behave no morally better overall than do non‐ethicist professors. Measures include: returning library books, peer evaluation of overall moral behavior, voting participation, courteous and discourteous behavior at conferences, replying to student emails, paying conference registration fees and disciplinary society dues, staying in touch with one's mother, charitable giving, organ and blood donation, vegetarianism, and honesty in responding to survey questions. One multi‐measure study (...) found ethicists tending to embrace more stringent moral views, especially about meat eating and charitable donation. The same multi‐measure study found ethicists and other professors to show similarly small‐to‐medium correlations between their expressed normative attitudes and their self‐reported or directly measured behavior. According to the analysis of concessive conditionals suggested by Crupi and Iacona, a concessive conditional $$p{{\,\mathrm{\hookrightarrow }\,}}q$$ p ↪ q is adequately formalized as a conjunction of conditionals. This paper presents a sound and complete axiomatic system for concessive conditionals so understood. The soundness and completeness proofs that will be provided rely on a method that has been employed by Raidl, Iacona, and Crupi to prove the soundness and completeness of an analogous system for evidential conditionals.

In 1970 a coalition of student activists opposing the Vietnam War circulated documents revealing the involvement of several prominent social scientists in U.S. counterinsurgency activities in Thailand--activities that could cause harm to the people who were the subject of the scholars' research. The disclosure of these materials, which detailed meetings with the Agency for International Development and the Defense Department, prompted two members of the Ethics Committee of the American Anthropological Association to issue an unauthorized rebuke of the accused. Over (...) the next two years, the AAA agonized over the allegations and the appropriate response to them. Within an academic community already polarized by the war, political and professional acrimony reached unprecedented levels. Although the association ultimately passed a code of ethics, the key issues raised in the process were never fully resolved. Now back in print, Eric Wakin's Anthropology Goes to War is the first comprehensive study of what became known as the Thailand Controversy--and a timely reminder of a debate whose echoes may be heard in our own time. Are philosophical arguments as effective as narratives in influencing charitable giving and attitudes toward it? In four experiments, we exposed online research participants to either philosophical arguments in favor of charitable giving, a narrative about a child whose life was improved by charitable donations, both the narrative and the argument, or a control text (a passage from a middle school physics text or a description of charitable organizations). Participants then expressed their attitudes toward charitable giving and were either asked how (...) much they would hypothetically donate if given $10 (Experiment 1) or told they had a 10% chance of winning $10 and given the opportunity to donate from their potential winnings (Experiments 2–4). Across the four experiments, participants in all of the narrative conditions and in some of the argument conditions tended to express more positive attitudes toward charitable giving and donated about $1 more on average than did participants in the control conditions. These effects appear to have been mediated by the “narrative transportation” scale, which suggests that appeals to donate can be effective if they engage participants’ emotions, imagery, and interest. Markel's absurd claims have engendered many reflections on the nature of suffering and what it means to be responsible for someone else's suffering. The world has no shortage (...) of pain and evil; what exactly is the relationship between suffering and responsibility? Markel's declarations press forward a question that drives this essay collection: how responsible should we consider ourselves for the suffering of the world? This volume is a collection of essays that struggle in various ways to understand and respond to several philosophical, theological and practical problems. In each case the authors grapple with issues surrounding suffering, immorality, evil, exploitation and oppression. The contributors share a clear concern for the ways that philosophers and theologians should respond to the problems of suffering and evil. Even though Kant’s theory of cognition (Erkenntnis) is central to his Critique of Pure Reason, it has rarely been asked what exactly Kant means by the term “cognition”. Against the widespread assumption that cognition (in the most relevant sense of that term) can be identified with knowledge or if not, that knowledge is at least a species of cognition, we argue that the concepts of cognition and knowledge in Kant are not only distinct, but even disjunct. To show this, we (...) first (I) investigate Kant’s explicit characterizations of the nature of cognition. As it turns out, he introduces several different notions that must be carefully distinguished before identifying the one that is central to his project in the first Critique. We then (II) consider the basic features of Kant’s conception of knowledge, indicating both how it involves assent and objective justification and how it relates to our contemporary conception. Next (III), we compare and contrast Kant’s understanding of cognition and his conception of knowledge in a way that allows us to present their fundamental differences and connections. We argue that while cognition, in the most relevant sense, is a species of representation that differs from other representations in that it involves the conceptual determination of a sensibly given object, knowledge (for Kant) is a kind of assent to a judgment that requires consciousness of a sufficient epistemic ground. Finally (IV), by appreciating the differences between cognition and knowledge, we explain several of the implications this conception of cognition has for some of Kant’s main claims in the Critique of Pure Reason as a whole. Among other things, we show how Kant can deny cognition of specific things in themselves while allowing philosophical knowledge about things in themselves in general (e.g. that they exist, are not in space and time, etc.). Standard animalists are committed to a stringent form of restricted composition, thereby denying the existence of brains, hands, and other proper parts of an organism . One reason for positing this near-nihilistic ontology comes from various challenges to animalism such as the Thinking Parts Argument, the Unity Argument, and the Argument from the Problem of the Many. In this paper, I show that these putatively distinct arguments are all instances of a more general problem, which I call the ‘Too Many (...) Candidates Problem’ . Given my formulation of the problem, it is evident that standard animalists are mistaken in believing that restricting composition is the only solution. I show that there is another option for solving the TMC. The advantage of such a position, which I call ‘unrestricted animalism’, is that it is compatible with unrestricted composition and the existence of brains and other proper parts of an organism. I conclude by sketching several strategies one can take regarding this latter solution to the TMC. (shrink)

This article provides a critical overview of competing theories of conceptual structure (definitional structure, probabilistic structure, theory structure), including the view that concepts have no structure (atomism). We argue that the explanatory demands that these different theories answer to are best accommodated by an organization in which concepts are taken to have atomic cores that are linked to differing types of conceptual structure.

In trying to establish the view that there are no non-living macrophysical objects, Trenton Merricks has produced an influential argument—the Overdetermination Argument—against the causal efficacy of composite objects. A serious problem for the Overdetermination Argument is the ambiguity in the notion of overdetermination that is being employed, which is due to the fact that Merricks does not provide any theory of causation to support his claims. Once we adopt a plausible theory of causation, viz. interventionism, problems with the Overdetermination will (...) become evident. After laying out the Overdetermination Argument and examining one extant objection to it, I will explicate the relevant aspects of an interventionist theory of causation and provide a characterization of overdetermination that follows from such an account. From this, I will argue that the Causal Principle that undergirds the Overdetermination Argument is false and hence the argument is invalid; and I claim that the only other available characterization of overdetermination would render a key premise in the argument false. Thus, the Overdetermination Argument fails to provide us with any reason to deny the causal efficacy of macrophysical objects, and therefore provides no reason to doubt their existence. (shrink)

Through essays, poetry, dialogues, and anecdotes, the Xunzi articulates a Confucian perspective on ethics, politics, warfare, language, psychology, human nature, ritual, and music, among other topics. Aimed at general readers and students of Chinese thought, Eric Hutton's translation makes the full text of this important work more accessible in English than (...) ever before. Named for its purported author, the Xunzi has long been neglected compared to works such as the Analects of Confucius and the Mencius. Yet interest in the Xunzi has grown in recent decades, and the text presents a much more systematic vision of the Confucian ideal than the fragmented sayings of Confucius and Mencius. In one famous, explicit contrast to them, the Xunzi argues that human nature is bad. However, it also allows that people can become good through rituals and institutions established by earlier sages. Indeed, the main purpose of the Xunzi is to urge people to become as good as possible, both for their own sakes and for the sake of peace and order in the world. Many discussions of J. S. Mill's concept of liberty focus too narrowly on On Liberty and fail to acknowledge that his treatment of related issues elsewhere may modify its leading doctrines. Mill and Paternalism demonstrates how a contextual reading suggests that in Principles of Political Economy, and also his writings on Ireland, India and on domestic issues like land reform, Mill proposed a substantially more interventionist account of the state than On Liberty seems to imply. This helps to explain Mill's (...) sympathies for socialism after 1848, as well as his Malthusianism and feminism, which, in conjunction with Harriet Taylor's views, are central to his later discussions of the family and marriage. Feminism, indeed, is shown to provide the answer to the problem which most agitated Mill, overpopulation. Thus Gregory Claeys sheds new lights on many of Mill's overarching preoccupations, including the theory of liberty at the heart of On Liberty. (shrink)

According to Eric Olson, the Thinking Animal Argument (TAA) is the best reason to accept animalism, the view that we are identical to animals. A novel criticism has been advanced against TAA, suggesting that it implicitly employs a dubious epistemological principle. I will argue that other epistemological principles can do the trick of saving the TAA, principles that appeal to recent issues regarding disagreement with peers and experts. I conclude with some remarks about the consequence of accepting these modified (...) principles, drawing out some general morals in defending animalism. (shrink)

During the last twenty years, Kant's theory of biology has increasingly attracted the attention of scholars and developed into a field which is growing rapidly in importance within Kant studies. The volume presents fifteen interpretative essays written by experts working in the field, covering topics from seventeenth- and eighteenth-century biological theories, the development of the philosophy of biology in Kant's writings, the theory of organisms in Kant's Critique of the Power of Judgment, and current perspectives on the teleology of nature.

There is much to admire in this book. It is written in a pleasingly straightforward style, and offers insight on a wide range of important issues.

Climate change and justice are so closely associated that many people take it for granted that a global climate treaty should--indeed, must--directly address both issues together. But, in fact, this would be a serious mistake, one that, by dooming effective international limits on greenhouse gases, would actually make the world's poor and developing nations far worse off. The historical debate on representation in cognitive science and neuroscience construes representations as theoretical posits and discusses the degree to which we have reason to posit them. We reject the premise of that debate. We argue that experimental neuroscientists routinely observe and manipulate neural representations in their laboratory. Therefore, neural representations are as real as neurons, action potentials, or any other well-established entities in our ontology.
