Advances in medical technology inevitably bring about different kinds of ethical challenges for practising doctors. The following hypothetical case of assisted reproduction is presented as an example. A boy is born with Edward's syndrome following assisted reproduction. The parents suspect that there has been an error of embryo mix-up. They challenge the parenthood and request a genetic test to determine the biological parentage of the neonate. Should the attending paediatrician in this case accede to the request? We argue that the (...) paediatrician has no legal obligation to offer the test, although it might be lawful and ethical to provide the test subject to the outcome of our proposed three-step risk assessment. COVID-19 deeply affects many spheres of life. Lockdown measures implemented worldwide have accentuated mental wellbeing changes in the population from the perspectives of space and social relations. These changes leave lasting imprints on individuals and communities. This article draws upon solidarity and care ethics in exploring their role in rebuilding mental wellbeing in the light of constraints arising from lockdown. The counseling process involves attention, emotional perception, cognitive appraisal, and decision-making. This study aimed to investigate cognitive appraisal and the associated emotional processes when reading short therapists' statements of motivational interviewing (MI). Thirty participants with work injuries were classified into the pre-contemplation (PC,n= 15) or readiness stage of the change group (RD,n= 15). The participants viewed MI congruent (MI-C), MI incongruent (MI-INC), or control phrases during which their electroencephalograms were captured. The results indicated significant Group × Condition effects in the (...) frontally oriented late positive complex (P600/LPC). The P600/LPC's amplitudes were more positive-going in the PC than in the RD group for the MI congruent statements. Within the PC group, the amplitudes of the N400 were significantly correlated (r= 0.607–0.649) with the participants' level of negative affect. Our findings suggest that the brief contents of MI statements alone can elicit late cognitive and emotional appraisal processes beyond semantic processing. (shrink)

One of the core goals of Digital Health Technologies (DHT) is to transform healthcare services and delivery by shifting primary care from hospitals into the community. However, achieving this goal will rely on the collection, use and storage of large datasets. Some of these datasets will be linked to multiple sources, and may include highly sensitive health information that needs to be transferred across institutional and jurisdictional boundaries. The growth of DHT has outpaced the establishment of clear legal pathways to (...) facilitate the collection, use and transfer of potentially sensitive health data. Our study aimed to address this gap with an ethical code to guide researchers developing DHT with international collaborative partners in Singapore. We generated this code using a modified Policy Delphi process designed to engage stakeholders in the deliberation of health data ethics and governance. Organ donation has gained much attention as the need for transplant exceeds the supply of organs. Various proposals have been put forward to address the organ shortage challenge, ranging from offering incentives to donors, addressing family refusals to donations and instituting presumed consent laws. Presumed consent as the favoured approach has not been universally effective in increasing actual transplants despite its appeal. Few considerations have been given to the broader ethical climate influencing the organ donation debate. This paper examines the (...) ethical climate surrounding organ donation and identifies the challenges existing within such environments. It explores care ethics and its application to the donation system, demonstrating how it can influence the organ donation phases. The conclusion drawn from the analysis is that a caring ethical climate in the pre, during and post-transplant system respects donor autonomy, addresses family reluctance to agree to donation, facilitates the needs of the donee and creates an environment that promotes non-maleficence for all stakeholders. Post COVID-19 infections resulting in long COVID symptoms remain persistent yet neglected in healthcare priorities. Although long COVID symptoms are expected to decline after some time, many people continue to endure its debilitating effects affecting their daily lives. The diversity of characteristics amongst long COVID patients adds to the complexity of communicating personal health predicaments to healthcare providers. Recent research towards building an evidence base for long COVID with the aim of delivering responsive healthcare interventions for long COVID patients has (...) utilised datasets generated from wearable devices. This paper examines the prospects presented by wearable devices for long COVID patients and physicians. It highlights distinct ethical and legal challenges arising from their use in practice. Ageing populations are increasing across the world. Many countries are exploring new ways to provide care for the elderly in hospitals, community care and family household settings. Scientific progress in robotics, artificial intelligence integrated systems and increasingly sophisticated software engineering have contributed to innovative developments in care robots in the Asia Pacific regions, Europe and the US. Whilst the use of care robots is not widespread, research is already occurring to integrate wider use of care robots in the elderly population (...) towards improving their quality of life. Developments in care robots for the elderly are valuable yet they give rise to special concerns as they affect peoples’ health and safety. This chapter identifies key ethical and legal issues arising from the use of care robots in the ageing population. Ethical aspects such as deception and trust from care robots are highlighted, which implicate governance concerns ranging from balancing innovations and ensuring user safety to determining the appropriate levels of regulatory oversight and support for developers and market strategies. An examination of these issues provides some guidance for law makers and policy developers in these areas of concern in establishing applicable regulatory direction, responses and governance framework. Large data-intensive health research programmes benefit from collaboration amongst researchers who may be located in different institutions and international contexts. However, complexities in navigating privacy frameworks and data protection laws across various jurisdictions pose significant challenges to researchers seeking to share or transfer data outside of institutional boundaries. Research on the awareness of data protection and privacy laws amongst stakeholders is limited. Our qualitative study, drawn from a larger project in Singapore, revealed insights into stakeholders’ perceptions of the role of (...) law in cross-national health data research. Stakeholders in our study demonstrated a range of perceptions regarding the role of data protection law in governing the collection and transfer of health data for research. The main criticisms included inadequate legal protection to data and lack of uniformed data protection standards. Despite these criticisms, participants recognised the importance of data protection law in supporting cross-border data transfers and proposed measures to improve perceived limitations of existing laws. These measures include strengthening existing legal framework, establishing contractual agreements and imposing severe punishments for data misuse. (shrink)

The right to refuse treatment is generally accepted in the legal and bioethics discourses; however, the use of advance directives remains contentious. Some jurisdictions have introduced statutory frameworks to govern the creation and implementation of advance directives, underpinned primarily by the recognition of respect for personal autonomy. Although there are no legislation and judicial decisions on advance decision-making in Malaysia, the considered view is that healthcare practitioners perceived its utility in managing patient care. This paper examines the potential and challenges (...) of applying a statutory framework in Malaysia, drawing from relevant regulatory examples. It argues for greater public awareness within the healthcare discourse and knowledge dissemination regarding the availability, usage and clinical guidance on advance decision-making. The main conclusion drawn from this exploratory analysis is that further understanding of and education about advance decision-making within the population and healthcare practitioners should precede the implementation of a statutory regime in Malaysia. The COVID-19 pandemic has generated a range of responses from countries across the globe in managing and containing infections. Considerable research has highlighted the importance of trust in ethically and effectively managing infectious diseases in the population; however, considerations of reciprocal trust remain limited in debates on pandemic response. This paper aims to broaden the perspective of good ethical practices in managing an infectious disease outbreak by including the role of reciprocal trust. A synthesis of the approaches drawn from South (...) Korea and Taiwan reveals reciprocal trust as an important ethical response to the COVID-19 pandemic. Reciprocal trust offers the opportunity to reconcile the difficulties arising from restrictive measures for protecting population health and individual rights. (shrink)

Facing the possibility of a surge of COVID-19-infected patients requiring ventilatory support in Intensive Care Units, the Singapore Hospice Council and the Chapter of Palliative Medicine Physicians forward its position on the guiding principles that ought to drive the allocation of ICU beds and its role in care of these patients and their families.

Background Supporting physicians in Intensive Care Units s as they face dying patients at unprecedented levels due to the COVID-19 pandemic is critical. Amidst a dearth of such data and guided by evidence that nurses in ICUs experience personal, professional and existential issues in similar conditions, a systematic scoping review is proposed to evaluate prevailing accounts of physicians facing dying patients in ICUs through the lens of Personhood. Such data would enhance understanding and guide the provision of better support for (...) ICU physicians. Methods An SSR adopts the Systematic Evidenced Based Approach to map prevailing accounts of caring for dying patients in ICUs. To enhance the transparency and reproducibility of this process, concurrent and independent use of tabulated summaries, thematic analysis and directed content analysis is adopted. Results Eight thousand three hundred fifty-eight abstracts were reviewed from four databases, 474 full-text articles were evaluated, 58 articles were included, and the Split Approach revealed six categories/themes centered around the Innate, Individual, Relational and Societal Rings of Personhood, conflicts in providing end of life care and coping mechanisms employed. Conclusion This SSR suggests that caring for dying patients in ICU impacts how physicians view their personhood. To resolve conflicts within individual concepts of personhood, physicians use prioritization, reframing and rely on accessible, personalized support from colleagues to steer coping strategies. An adapted form of the Ring Theory of Personhood is proposed to direct timely personalized, appropriate and holistic support. (shrink)

Hui Shi (370-310B.C.E.?) is a unique one among the pre-Qin scholars. He shows a tendency of tolerating and advocating diversity and variety, and intentionally pursuing new and unusual ideas. In certain degree he judges the value of knowledge by its truthfulness rather than its usefulness. As pointed out by Wing-tsit Chan, Hui shi represents a “tendency in ancient (...) The Shao Lin Chronicles: The Wisdom of Bodhidharma is a fictional book based on the pseudo-historical account of Bodhidharma, who brought Chan Buddhism to China, and his student Hui-k'o, nicknamed "Te" in this book. Specifically, Bodhidharma takes up residence in a cave near the famous Shao Lin Monastery. Te finds Bodhidharma and begins to visit him on a regular basis, along with maintaining his regular duties as a monk, including teaching the local students about the life of Buddha. Eventually (...) Bodhidharma sends Te on a quest to retrieve living water flowing from the Mt. Niu-t'ou. On three separate ventures, young Te returns, only to have Bodhidharma scold him for not fulfilling his request, yet instruct him on the finer points of Buddhist philosophy and practice. However, on his adventures, Te encounters a young lady whose town is being controlled by an evil tyrant, a wizard and an eight-headed dragon, and a peaceful hermit. Eventually, Te must face the fact that even after learning so much and growing spiritually, he has not fulfilled Bodhidharma's request, and as a result, he has not attained enlightenment. The way in which Te's quest finally reaches its climactic conclusion is recognized in the Buddhist tradition as one of the most desperate, yet selfless acts on record. Eventually, Te paves the way for Bodhidharma to be introduced to the masters at Shao Lin. And Shao Lin, based on the teachings of Bodhidharma, eventually becomes the birthplace of martial arts and chi kung. (shrink)

This article examines the relevance and value of Confucian Ethics to contemporary Business Ethics by comparing their respective perspectives and approaches towards business activities within the modern capitalist framework, the principle of reciprocity and the concept of human virtues. Confucian Ethics provides interesting parallels with contemporary Western-oriented Business Ethics. At the same, it diverges from contemporary Business Ethics in some significant ways. Upon an examination of philosophical texts as well as empirical studies, it is argued that Confucian Ethics is able (...) to provide some unique philosophical and intellectual perspectives in order to forge a richer understanding and analysis of the field of contemporary Business Ethics. Twiss London: Routledge, 2015. 320pp. $160.00As Ping-Cheung Lo notes, Western stereotypes of Chinese culture and particularly of Confucian ethics have led many to describe ancient China as a place of peace and cooperation—a picture that is contrary (...) to historical evidence (249). This new volume, edited by Lo and Sumner Twiss, offers an important corrective to that image. The contributing authors describe the moral attitudes toward war and peace taken by Chinese thinkers in several schools during the Warring States Period of 475–221 BCE (along with one later figure, the sixteenth-century neo-Confucian Wang Yangming). In particular, they focus on five traditions: military strategy, Confucianism, Daoism, Mohism, and legalism. The authors collectively demonstrate that ancient Chinese thought was marked by an intense interest in both peace and war, and that these topics were approached from moral as well as strategic and prudential perspectives. Moreover, in their historical contextualization of these materials, the authors emphasize the significance of the reality of war in shaping the arguments discussed. This attention to interpretation and real-life applications of these arguments, in both the ancient world and the contemporary activities of the People’s Liberation Army, is a particular strength of the book.This volume will be of special interest to comparative religious ethicists as well as to those interested in just war reasoning. As the inclusion of the phrase “just war” in the book’s title suggests, the identification of parallels to Western just war thinking in ancient Chinese thought is a major emphasis. Lo argues that although the Seven Military Classics are often read simply as strategy manuals, their discussions of strategy are complemented by concepts similar to the just war criteria of just cause, last resort, and discrimination. Twiss and Jonathan Chan suggest that the Confucian “true king” who is to oversee war [End Page 226] virtuously and with the goal of maintaining an ordered, humane society represents a requirement similar to the just war criterion of right authority; importantly, however, “right” in the Confucian tradition comes from the ruler’s virtue rather than his sovereignty. Hui-chieh Loy’s study of the Mohist tradition identifies concepts similar to six different jus ad bellum criteria while also revealing a lack of jus in bello criteria. Finally, Lo argues for the similarities between ancient legalism and contemporary Western realism as an alternative to just war thinking.Future scholarly development in this area should include a more robust articulation of the purpose of taking this comparative approach. Some reasons are implied in the book. For instance, Twiss and Chan argue for the overlap of Confucian punitive expeditions with the contemporary model of responsibility to protect, suggesting the possibility of international consensus on that norm. On the other hand, comparative work always runs the risk of distorting or overlooking material as a result of the desire to identify similarities or differences to a particular framework. Aaron Stalnaker, for example, points out that while Confucian thinker Xunzi may have embraced some concepts similar to those of jus ad bellum and jus in bello, he did not structure his own writing in those terms (135). Similarly, Ellen Zhang argues that the Daodejing differs from just war texts in that it approaches the question of war from the perspective of a particular conception of peace as an absence of coercion; the text thus takes the avoidance of war as its moral ideal. She also suggests that Confucian punitive expeditions may be better understood as domestic criminal discipline than as acts of war or humanitarian intervention (220).
