A minimal theorem in a logic L is an L-theorem which is not a non-trivial substitution instance of another L-theorem. Komori (1987) raised the question whether every minimal implicational theorem in intuitionistic logic has a unique normal proof in the natural deduction system NJ. The answer has been known to be partially positive and generally negative. It is shown here that a minimal implicational theorem A in intuitionistic logic has a unique -normal proof in NJ whenever A is provable without (...) non-prime contraction. The non-prime contraction rule in NJ is the implication introduction rule whose cancelled assumption differs from a propositional variable and appears more than once in the proof. Our result improves the known partial positive solutions to Komori's problem. Also, we present another simple example of a minimal implicational theorem in intuitionistic logic which does not have a unique -normal proof in NJ. (shrink)

We present a logic of evidence that reduces agents’ epistemic idealisations by combining classical propositional logic with substructural modal logic for formulas in the scope of epistemic modalities. To this aim, we provide a neighborhood semantics of evidence, which provides a modal extension of Fine’s semantics for relevant propositional logic. Possible worlds semantics for classical propositional logic is then obtained by defining the set of possible worlds as a special subset of information states in Fine’s semantics. Finally, we prove that (...) evidence is a hyperintensional and non-prime notion in our logic, and provide a sound and complete axiomatisation of our evidence logic. (shrink)

It is often argued that fully structural theories of truth and related notions are incapable of expressing a nonstratified notion of defectiveness. We argue that recently much-discussed non-contractive theories suffer from the same expressive limitation, provided they identify the defective sentences with the sentences that yield triviality if they are assumed to satisfy structural contraction.

Various writers point out that accepting the terms of a contract does not imply consent to the background conditions of this contract. This is an important critical insight allowing for a critical perspective on the principle of free contract, according to which the state should not interfere with what adult agents contractually agree upon. In this paper I argue that the practical relevance of this critical insight depends on the availability of answers to three questions: (1) Which are the core (...) features of baseline background conditions supporting a well-ordered labor market enhancing economic welfare? (2) In which cases and for which reasons are non-market institutions needed in order to support these features? (3) Under which conditions and at which levels can collective mechanisms be expected to support adequate non-market institutions ‘curing market failure’? Some of the core properties of labor markets and labor contracts are discussed which need to be taken into account in attempts to answer these questions, most notably problems of contract enforcement, market failure and collective action. On October 5th, 2017, the New York Times published an article that would establish the #MeToo movement and help millions of women across the globe to raise their voice and share their stories of sexual harassment, aggression and/or violence. If Harvey Weinstein was the main accused, he was, actually, the epitome of a systemic, as well as an endemic, issue that didn’t stop at the studios’ doors and was made possible thanks to a rather surprising and quite unexpected accomplice. In (...) fact, “Hollywood’s open secret” has been well-guarded by, among other things, the contract and its law. In the eyes of a contract law specialist, whether it be a man or a woman, the major highlight of Jodi Kantor and Megan Twohey’s article rests in their ability to have brought to light contracts—the, now, infamous and highly criticised “NDAs” (non-disclosure agreements)—that ensured Weinstein the freedom to buy his victims’ silence. The first goal of this essay is trying to understand, on the one hand, how could that be possible and, on the other hand, explain to a larger audience how a tool usually used for economic and commercial purposes could have been diverted from its traditional use. It also aims to present measures that have been adopted in the United States to fight these agreements, and imagine what could they be in a country such as France. Although these types of “NDAs” don’t seem to find their equivalent in the French public sphere, it is still helpful to ponder over remedies offered by the new French law of contract shall these contracts ever come to exist… or arise. This article makes a comparative examination of the widening spectrum of cases in which both tort law and contract law are employed, jointly or separately, to impose non-consensual liability on a contracting party. The article focuses on liability imposed on a contracting party either toward another contracting party or toward a third party for failure to perform an obligation that, on the one hand, is predicated on and arises from the contract, but, on the other hand, does not genuinely originate (...) in the consent of the liable party because it is external to her genuine intention. The primary objective of this article is to propose general guidelines for either choosing between tort law and contract law when imposing non-consensual liability on a contracting party or else allowing liability under both headings. These guidelines for the classification of non-consensual liability also bear on the preliminary question of whether to impose non-consensual liability at all and on the delicate interplay between contract and tort in general and particularly when the two lead to conflicting legal outcomes. In a recent book and article, James Sterba has argued that there is no free will defense. It is the purpose of this article to show that, in the most technical sense, he is wrong. There is a version of the free will defense that can solve what Sterba (rightly) takes to be the most interesting and severe version of the logical problem of moral evil. However, I will also argue that, in effect (or, we might say, in practice), Sterba (...) is correct. The only working version of the free will defense requires embracing a view that entails consequences theists traditionally have not and cannot accept. Consequently, the one and only free will solution is not viable. Unless some other solution can be found (Sterba argues there is none), the logical problem of evil, as Sterba understands it, either commits one to atheism, or a version of theism that practically all theists would regard as a heresy. Gaze cueing effect (GCE) refers to attention orienting towards the gazed-at location, characterised by faster responses to gazed-at than non-gazed-at stimuli. A previous study investigated the effects of affective priming on GCE and reported that threatening primes enhanced GCE. However, it remains unknown whether the threat or heightened arousal potentiated GCE. We investigated how highly arousing threatening and positive primes, compared to low arousing neutral primes modulate GCE. After a brief exposure to an affective prime (pictures of threat or (...) erotica) or a neutral prime, participants detected an asterisk validly or invalidly cued by the gaze direction of a neutral face. The results showed that the threatening primes diminished the magnitude of GCE. The highly arousing positive primes did not have an effect on GCE. Further analyses showed that, as compared to neutral priming, the reaction times after threatening primes were shortened on invalid trials. This finding was interpreted to suggest that the threatening primes enhanced goal-directed target detection and attenuated attention orienting by irrelevant gaze cues via improving executive control. In sum, the present findings indicate that threat priming modulates GCE, not because of heightened arousal but because of the threat. (shrink)

The rationalization of a choice function, in terms of assumptions that involve expansion or contraction properties of the feasible set, over non-finite sets is analyzed. Schwartz's results, stated in the finite case, are extended to this more general framework. Moreover, a characterization result when continuity conditions are imposed on the choice function, as well as on the binary relation that rationalizes it, is presented.

The anchoring heuristic refers to phenomena when an arbitrary number affects subsequent numerical estimations. Oppenheimer, LeBoeuf and Brewer showed that it is not necessary for the anchor to be a numerical value, yet current models describing the anchoring heuristic do not fully account for the mechanism of non-numerical anchoring. However, this effect shows similarity to the basic anchoring effect - obtained without the comparative question and based on the availability of the given number in working memory. In this study, we (...) attempt to verify whether those two effect share the same psychological mechanism. In Experiment 1, we show that non-numerical anchoring based on magnitude priming cannot be obtained when the lines are just observed. The examined mechanism proves to be dependent on the act of drawing, displaying limitations similar to the basic anchoring effect, previously pointed out by Brewer and Chapman. By using the same numerical anchors in different size formats, in Experiment 2 we showed that anchoring based on magnitude priming occurs even when the numerical values do not affect the estimations. The results are discussed in the light of a possible mechanism that underlies the investigated effect. (shrink)

This article explores the extent to which it is or may be possible to have a claim both in contract and in restitution. Restitution will almost never be appropriate before a valid contract has been discharged but after it has been discharged a restitutionary claim may be available as well as a contractual one. A restitutionary claim cannot, however, be used to set aside the contractual allocation of risks. It is argued that while in the past English courts may have (...) been too willing to conclude that restitution would be inconsistent with the allocation of risks, the view of those striving to show the independence of restitution that there will always be a restitutionary claim unless the contract, construed strictly against the party resisting restitution, has excluded it, goes too far in the opposite direction. We investigate the effect of priming on pro-social behaviour in a setting where there is a clear financial incentive to free ride. By activating the concept of cooperation among randomly selected individuals, we explore whether it is possible to positively influence people’s voluntary contributions to the public good. Our findings indicate that cooperative priming increases contributions in a one-shot public goods game from approximately 25–36 % compared with the non-primed group. The results call for further explorations of the role of (...) priming in economic behaviours in general. (shrink)

An important question for proponents of non-contractive approaches to paradox is why contraction fails. Zardini offers an answer, namely that paradoxical sentences exhibit a kind of instability. I elaborate this idea using revision theory, and I argue that while instability does motivate failures of contraction, it equally motivates failure of many principles that non-contractive theorists want to maintain.

Medieval interpretations of hylomorphism, in which substances are conceived as metaphysical composites of prime matter and substantial form, are receiving attention in contemporary philosophy. It has even been suggested that a recovery of Aquinas's conception of prime matter as a ‘pure potentiality’, lacking any actuality apart from substantial form, may be expedient in hylomorphic interpretations of quantum mechanics. In this paper, we consider a recent hylomorphic interpretation of non-relativistic quantum mechanics, the theory of Cosmic Hylomorphism, which does not (...) explicitly invoke any notion of prime matter in its original formulation. We argue that prime matter does in fact play a role in constituting and individuating particles in this theory. However, we demonstrate that the notion of prime matter which features in the extended version of Cosmic Hylomorphism that we propose here is distinct from Aquinas's conception of prime matter, inasmuch as it has discrete metaphysical parts. This study investigates priming in an implicit Word Stem Completion (WSC) task. A total of 305 participants performed a WSC task in two phases (study and test). The test phase included 63 unique-solution stems and 63 multiple-solution stems. After confirming the presence of priming (mean = 0.22), analysis revealed that it was stronger in the case of multiple-solution stems, indicating that the stems were not a homogeneous group of stimuli. Thus, further analyses were performed only for the data of the (...) unique-solution stems. The correlations between priming and a set of conceptual (familiarity, frequency of use, number of meanings) and non-conceptual (letters/blanks ratio and difficulty of completed) variables showed significant relationships between two conceptual variables (familiarity and frequency) and priming. Difficulty was also significantly correlated with priming. The most familiar and frequent words were those that produced a greater magnitude of priming. At the same time, the most difficult stems were those generating more priming. A regression analysis showed that the difficulty of completing a stem was the strongest predictor of priming. When difficulty was the dependent variable in the regression analysis, the significant variables in the regression were familiarity and letters-blanks ratio. Finally, a comparison was made between these results and those obtained in a previous study of WFC by Soler et al. (2009) in which the same words and procedure were employed. A comparison of results from these two sets of data suggested that the only relevant difference between the two tasks was the influence of the variable letters-blanks ratio. This perceptual variable had a significant correlation with priming only in the WFC task. These results highlight the importance of controlling the characteristics (conceptual and non-conceptual) of stimuli used in WFC and WSC tasks when exploring the nature of priming. (shrink)

It has been argued that numbers are spatially organized along a "mental number line" that facilitates left-hand responses to small numbers, and right-hand responses to large numbers. We hypothesized that whenever the representations of visual and numerical space are concurrently activated, interactions can occur between them, before response selection. A spatial prime is processed faster than a numerical target, and consistent with our hypothesis, we found that such a spatial prime affects non-spatial, verbal responses more when the (...) class='Hi'>prime follows a numerical target (backward priming) then when it precedes it (forward priming). This finding emerged both in a number-comparison and a parity judgment task, and cannot be ascribed to a "Spatial-Numerical Association of Response Codes" (SNARC). Contrary to some earlier claims, we therefore conclude that visuospatial-numerical interactions do occur, even before response selection. (shrink)

In this article I take up John Rawls's invitation to investigate the capacity of a given comprehensive ethical doctrine to endorse on principled grounds the liberal terms of social cooperation. In the case of Islamic political ethics, however, far more is at stake in affirming citizenship in a (non-Muslim) liberal democracy than state neutrality and individual autonomy. Islamic legal and political traditions have traditionally held that submission to non-Muslim political authority and bonds of loyalty and solidarity with non-Muslim societies are (...) to be avoided. In this article, I examine the Islamic foundations for affirming on principled grounds residence, political obligation and loyalty to a non-Muslim state. My research shows not only that such grounds exist even in classical Islamic legal discourses, but also that the concerns of Islamic scholars vindicate political liberalism's claim to successfully accommodate the adherents of certain non-liberal doctrines by refraining from proclaiming controversial metaphysical truth-claims. The postulate of recovery is commonly regarded to be the intuitively least compelling of the six basic Gärdenfors postulates for belief contraction. We replace recovery by the seemingly much weaker postulate of core-retainment, which ensures that if x is excluded from K when p is contracted, then x plays some role for the fact that K implies p. Surprisingly enough, core-retainment together with four of the other Gärdenfors postulates implies recovery for logically closed belief sets. Reasonable contraction operators (...) without recovery do not seem to be possible for such sets. Instead, however, they can be obtained for non-closed belief bases. Some results on partial meet contractions on belief bases are given, including an axiomatic characterization and a non-vacuous extension of the AGM closure condition. (shrink)

The leading current conceptions of rationality begin with assumptions that human beings are independent, self-interested or mutually disinterested, individuals; they then typically argue that it is often rational for human beings to enter into contractual relationships with each other.

Recent theorists have suggested that human altruism toward non-family members evolved because of the tremendous benefits of reciprocity. Developing further the notion that evolutionary theory can help to explain moral sentiments, Howard Kahane proposes that a sense of fair play is essential to ethics and argues that moral obligation, too narrowly construed, prevents us from living rationally. I investigate the problem of contracting a dependency-network with respect to any of its nodes. The resulting contraction must not contain the node in question, but must also be a minimal mutilation of the original network. Identifying successful and minimally mutilating contractions of dependency-networks is non-trivial, especially when non-well-founded networks are to be taken into account. I prove that the contraction problem is NP-complete.1.

Modern belief revision theory is based to a large extent on partial meet contraction that was introduced in the seminal article by Carlos Alchourrón, Peter Gärdenfors, and David Makinson that appeared in 1985. In the same year, Alchourrón and Makinson published a significantly different approach to the same problem, called safe contraction. Since then, safe contraction has received much less attention than partial meet contraction. The present paper summarizes the current state of knowledge on safe (...) class='Hi'>contraction, provides some new results and offers a list of unsolved problems that are in need of investigation. For native English readers, masked presentations of past-tense verb primes produce faster lexical decision latencies to their present-tense targets than orthographically related or unrelated primes. This facilitation observed with morphologically related prime-target pairs is generally taken as evidence for strong connections based on morphological relationships in the L1 lexicon. It is unclear, however, if similar, morphologically based, connections develop in non-native lexicons. Several earlier studies with L2 English readers have reported mixed results. The present experiments examine whether past-tense verb (...) primes significantly facilitate target lexical decisions for Japanese-English bilinguals beyond any facilitation provided by prime-target orthographic similarity. Overall, past-tense verb primes facilitated lexical decisions to their present-tense targets relative to both orthographically related and unrelated primes. Replicating previous masked priming experiments with L2 readers, orthographically related primes also facilitated target recognition relative to unrelated primes, confirming that orthographic similarity facilitates L2 target recognition. The additional facilitation from past-tense verb primes beyond that provided by orthographic primes suggests that, in the L2 English lexicon, connections based on morphological relationships develop in a way that is similar to how they develop in the L1 English lexicon even though the connections and processing of lower level, lexical/orthographic information may differ. Further analyses involving L2 proficiency revealed that as L2 proficiency increased, orthographic facilitation was reduced, indicating that there is a decrease in the fuzziness in orthographic representations in the L2 lexicon with increased proficiency. Cognitive-linguistic theories commonly model speakers’ grammatical knowledge as a network of constructions related by a variety of associative links. The present study proposes that structural priming can provide psycholinguistic evidence of such links, and crucially, that the method can be extended to non-alternating constructions. In a comprehension priming experiment using the “maze” variant of self-paced reading, English caused-motion sentences were found to have an inhibitory effect by slowing down participants’ subsequent processing of resultatives, and vice versa, providing evidence that speakers (...) store distinct but related representations for the constructions. Priming effects of a similar magnitude emerged in both directions, suggesting that the constructions are bidirectionally related, while not supporting previous claims about a metaphorical asymmetry between the patterns. Moreover, priming was only marginally affected when prime and target contained the same rather than different verbs, demonstrating that cross-constructional priming in comprehension can be observed in the absence of a “lexical boost”. The results raise questions for follow-up research on the role of inhibition in the grammatical network and the extension of structural priming to other types of constructional links. (shrink)

With the intensification of COVID-19 epidemic, it becomes prominent to discuss the issue about the influence of psychological contract breach on job performance of new generation of employees. Based on social exchange theory, fairness theory, and conservation of resource theory, this study constructed a relationship model between psychological contract breach and job performance of new generation of employees with considering the mediating effect of job burnout and the moderating effect of past breach experience. Our hypotheses were tested using data from (...) 235 respondents working in Yunnan Province, China. The results were as follows: first, psychological contract breach had a significant negative effect on job performance of new generation of employees, whether in the whole sample or in two grouped samples; second, both in the overall sample and the grouped sample of state-owned enterprises, job burnout partially mediated the negative relationship between psychological contract breach and job performance of new generation of employees, and past experience of breach positively moderated the negative relationship between psychological contract breach and job performance of new generation of employees; third, in the grouped sample of non-state-owned enterprises, job burnout did not play a significant mediating role in the relationship between psychological contract breach and job performance of new generation of employees, and past breach experience did not play a significant moderating role in this relationship. These findings uncover the psychological mechanism underlying work performance of new generation of employees, and also provide useful theoretical reference for management practices of new generation of employees among different natures of enterprises. The potential benefits of priming intermittent theta burst stimulation with continuous theta burst stimulation have not been examined in regard to sensorimotor oscillatory activities recorded in electroencephalography. The objective of this study was to investigate the modulatory effect of priming iTBS delivered to the motor cortex on movement-related and mirror visual feedback -induced sensorimotor event-related desynchronization, compared with iTBS alone, on healthy adults. Twenty participants were randomly allocated into Group 1: priming iTBS—cTBS followed by iTBS, and Group 2: non-priming iTBS—sham (...) cTBS followed by iTBS. The stimulation was delivered to the right primary motor cortex daily for 4 consecutive days. EEG was measured before and after 4 sessions of stimulation. Movement-related ERD was evaluated during left-index finger tapping and MVF-induced sensorimotor ERD was evaluated by comparing the difference between right-index finger tapping with and without MVF. After stimulation, both protocols increased movement-related ERD and MVF-induced sensorimotor ERD in high mu and low beta bands, indicated by significant time effects. A significant interaction effect favoring Group 1 in enhancing movement-related ERD was observed in the high mu band [F = 4.47, p = 0.049], compared with Group 2. Our experiment suggests that among healthy adults priming iTBS with cTBS delivered to the motor cortex yields similar effects with iTBS alone on enhancing ERD induced by MVF-based observation, while movement-related ERD was more enhanced in the priming iTBS condition, specifically in the high mu band. It explains studies on corporate behavior in a threefold order—the first order deals with the gap between formal legal contracts and informal corporate covenants; the second order deals with norms that govern alternative contractual norms; and the third order exclusively deals with the economic aspects of the study. The legal-economic approach tries to identify the gap between actual behavior and ideal behavior. (...) Jehovah’s Witnesses should be required to sign transfusion contracts in order to be eligible for transplant.Human donor organs continue to be in short supply, and many potential transplant recipients die while waiting for an allograft to become available.1 Because the organ supply is so limited and the offering of organs is based on the generosity of patients and families, proper stewardship of these organs is an ethical obligation for transplant teams, as well as organ recipients. Preventable graft loss must be (...) protected against, and factors that foster preventable graft loss—for example, non-compliance must be proactively contemplated when patients are reviewed as potential transplant candidates. Post-transplant treatment refusal is one example of behaviour that can compromise transplant success.JEHOVAH’S WITNESSES AS TRANSPLANT RECIPIENTSIt is widely known that one of the most significant teachings of the Jehovah’s Witness church is abstinence from receiving blood transfusions.2 Believers derive this tenet from the Bible verse: “You are to abstain from …blood”.3 While blood loss is a risk of transplant surgery, some centres do not view patient refusal of blood transfusion as a transplant exclusion criterion. The first published case of transplantation of a Jehovah’s Witness appeared in 1986 from the University of California Los Angeles heart transplant team.4 Since then, numerous other cases have been published, including liver,5 kidney,6 pancreas,6 and lung.7 For experienced centres with superior blood management skills, transplant can indeed be a surgical success; however, optimal blood management before and during surgery are only two thirds of the patient’s clinical time clock. Fragile states and developing countries increasingly contract out health services to non-state providers (NSPs) (such as non-governmental organisations, voluntary sector and private sector). The paper identifies ethical issues when contracts involve devolution of health services to NSPs and proposes procedures to prevent or resolve these ethical dilemmas. Ethical issues were identified by examining processes of contracting out. Health needs could be used to select areas to be contracted out and to identify service needs. Health needs comprise “disease-burden-related needs”, “health-service needs”, (...) and “urgency of health-service needs”. The mix of services should include an analysis of cost-effectiveness. NSPs should be selected fairly, without bias, and conflicts of interest during their work must be avoided. The population’s views must be respected and accountability structures established. Devolved health services should ensure equity of access to healthcare. The services ought to be sustainable and evaluated objectively. Of these issues, conflicts of interest among NSPs and sustainability of health services have not attracted attention in the literature on ethics of health policy. Fair procedures could address these ethical issues—for example, public consultation on issues; decisions based on the public consultation and made on evidence; principles of decisions stated and reasonable; decisions given adequate publicity; a mechanism established to challenge decisions; assurance that mechanisms meet the above conditions; and regular review of the policies. These procedures are complemented by improving self-governance of NSPs, countries’ development of guidelines for devolving health services, and measures to educate the public of the client countries on these issues.
