The American tort system regularly conducts a sort of lottery in which plaintiffs try to name as many defendants in a tort action as they can in order to collect a large judgment from at least one of them. This procedure is encouraged under strict joint and several liability, which permits plaintiffs to recover greater damages from defendants - usually businesses - with less moral culpability for the tort than poorer defendants, who bear greater culpability. In a (...) case involving the Disney Corporation and a negligent amusement park rider, for instance, Disney was forced to pay 86% of the court award to the plaintiff, even though the jury found the company to be only 1% liable for the injury. The legal principle of joint and several liability violates morality in several different ways. Even though the principle appears to be better in the short run for plaintiffs, I will show that it fails not only to satisfy utilitarianism, but compensatory justice as well. Hence, the legal principle of joint and several liability should be eliminated in favor of a better, fairer law, which I will briefly sketch at the end. (shrink)

This article grapples with the causes of India’s microfinance crisis. By contrasting Bangladesh’s highly successful Grameen model with the allegedly “universalizable” version of India’s SKS Microfinance, trust or social capital is isolated—not just narrowly interpreted within standard economic theory, but more broadly construed—as the essential element accounting for the early success of microfinance. It is argued that the microfinance experience has been widely misinterpreted, in both analytical and policy terms. In recent years, several remarkable results have shown that certain theorems of finite combinatorics are unprovable in certain logical systems. These developments have been instrumental in stimulating research in both areas, with the interface between logic and combinatorics being especially important because of its relation to crucial issues in the foundations of mathematics which were raised by the work of Kurt Godel. Because of the diversity of the lines of research that have begun to shed light on these issues, (...) there was a need for a comprehensive overview which would tie the lines together. This volume fills that need by presenting a balanced mixture of high quality expository and research articles that were presented at the August 1985 AMS-IMS-SIAM Joint Summer Research Conference, held at Humboldt State University in Arcata, California.With an introductory survey to put the works into an appropriate context, the collection consists of papers dealing with various aspects of 'unprovable theorems and fast-growing functions'. Among the topics addressed are: ordinal notations, the dynamical systems approach to Ramsey theory, Hindman's finite sums theorem and related ultrafilters, well quasiordering theory, uncountable combinatorics, nonstandard models of set theory, and a length-of-proof analysis of Godel's incompleteness theorem. Many of the articles bring the reader to the frontiers of research in this area, and most assume familiarity with combinatorics and/or mathematical logic only at the senior undergraduate or first-year graduate level. Recently, several scholars have argued that scientists can accept scientific claims in a collective process, and that the capacity of scientific groups to form joint acceptances is linked to a functional division of labor between the group members. However, these accounts reveal little about how the cognitive content of the jointly accepted claim is formed, and how group members depend on each other in this process. In this paper, I shall therefore argue that we need to link analyses (...) of joint acceptance with analyses of distributed cognition. To sketch how this can be done, I shall present a detailed case study, and on the basis of the case, analyze the process through which a group of scientists jointly accept a new scientific claim and at a later stage jointly accept to revise previously accepted claims. I shall argue that joint acceptance in science can be established in situations where an overall conceptual structure is jointly accepted by a group of scientists while detailed parts of it are distributed among group members with different areas of expertise, a condition that I shall call a heterogeneous conceptual consensus. Finally, I shall show how a heterogeneous conceptual consensus can work as a constraint against scientific change and address the question how changes may nevertheless occur. (shrink)

In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings (...) of Hannah Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. How music and speech evolved is a mystery. Several hypotheses on their origins, including one on their joint origins, have been put forward but rarely tested. Here we report and comment on the first experiment testing the hypothesis that speech and music bifurcated from a common system. We highlight strengths of the reported experiment, point out its relatedness to animal work, and suggest three alternative interpretations of its results. The paper discussed and analyzes collective and joint intentions of various strength. Thus there are subjectively shared collective intentions and intersubjectively shared collective intentions as well as collective intentions which are objectively and intersubjectively shared. The distinction between collective and private intentions is considered from several points of view. Especially, it is emphasized that collective intentions in the full sense are in the “we-mode”, whereas private intentions are in the “I-mode”. Legal acts of the Republic of Lithuania establish several types of material liability of workers engaged in labour (professional) relations: material liability applied pursuant to the Labour Code of the Republic of Lithuania (hereinafter referred to as the LC) and material liability applied pursuant to the Law on Public Service of the Republic of Lithuania (hereinafter referred to as the LPC). In the present article, theoretical and practical aspects of material liability of Lithuanian public servants (...) for material damage caused are analysed. The authors of the article study the conditions for the application of the material liability and identify the main circumstances that must be determined in applying this type of legal compulsion. Furthermore, the authors investigate the relation between the material and disciplinary liabilities, study the limits of the application of labour law norms (that regulate material liability of employees) and civil law norms (regulating personal civil liability) in professional legal relations, identify the means and procedure for solving disputes arising in the application of the material liability. Practical mistakes in the application of the material liability of public servants and violations are analysed on the basis of a rather sparse case-law of the Supreme Administrative Court of Lithuania related to the material liability. The vast expansion of research in human-robot interactions (HRI) these last decades has been accompanied by the design of increasingly skilled robots for engaging in joint actions with humans. However, these advances have encountered significant challenges to ensure fluent interactions and sustain human motivation through the different steps of joint action. After exploring current literature on joint action in HRI, leading to a more precise definition of these challenges, the present article proposes some perspectives borrowed from psychology (...) and philosophy showing the key role of communication in human interactions. From mutual recognition between individuals to the expression of commitment and social expectations, we argue that communicative cues can facilitate coordination, prediction, and motivation in the context of joint action. The description of several notions thus suggests that some communicative capacities can be implemented in the context of joint action for HRI, leading to an integrated perspective of robotic communication. This paper introduces freely improvised joint actions, a class of joint actions characterized by highly unspecific goals and the unavailability of shared plans. For example, walking together just for the sake of walking together with no specific destination or path in mind provides an ordinary example of FIJAs, along with examples in the arts, e.g., collective free improvisation in music, improv theater, or contact improvisation in dance. We argue that classic philosophical accounts of joint action such as (...) Bratman’s rule them out because the latter require a capacity for planning that is idle in the case of FIJAs. This argument is structurally similar to arguments for minimalist accounts of joint action, and this invites a parallel minimalist account, which we provide in terms of a specific kind of shared intentions that do not require plan states. We further argue that the resulting minimalist account is different in kind from the sort of minimalism suggested by developmental considerations and conclude in favor of a pluralistic minimalism, according to which there are several ways for an account of joint action to be minimal. : When suggesting that we—the affluent in the developed world—are legitimate targets of defensive force due to our contribution to global poverty one is likely to be countered by one of two strategies. The first denies that we contribute to global poverty. The second seems to affirm that we contribute, and even that we have stringent contribution-based duties to address this poverty, but denies that such contribution makes forcible resistance permissible. Those in this second group employ several argumentative strategies. (...) In this paper I investigate these strategies for denying the force-related implication of contribution to poverty. I do not argue for political violence or for the permissibility of targeting the affluent, I merely investigate a conditional: if contribution to global poverty generates stringent duties to address it, then this contribution implies permission on the part of the victims to defend themselves with force, or for third parties to use force on their behalf. According to Margaret Gilbert, two or more people collectively believe that p if and only if they are jointly committed to believe that p as a body. But the way she construes joint commitment in her account – as a commitment of and by the several parties to “doing something as a body” – encourages the thought that the phenomenon accounted for is not that of genuine belief. I explain why this concern arises and explore a different way (...) of construing joint commitment, in order to avoid the concern. This leads me to propose a revised Gilbertian account of collective belief, according to which two or more people collectively believe that p if and only if they are jointly committed to p as true. This article examines the impact of the prevailing state ownership in the Chinese stock market on corporate governance and the financial regulatory system, respectively, as the internal and external monitoring mechanisms to deter corporate fraud and protect investors. In line with the literature that state ownership exaggerates the agency problem, we find that the retained state ownership in privatised firms increases the incidence of regulatory enforcements against fraud. For the state-owned enterprises (SOEs), however, larger state ownership is associated with a (...) lower incidence of enforcement actions. This is attributed to the mutual political affiliation of the fraudulent SOEs and the regulatory commission. A new regulation "Solutions for Listed Firm Checks" promulgated in March 2001 has mitigated this effect by empowering the regulatory commission to increase the severity of regulatory conditions. Our evidence confirms the improvement in the regulatory environment and investor protection in the Chinese stock market brought about by the regulatory reform and development. (shrink)

In recent years, several minimalist accounts of joint action have been offered (e.g. Tollefsen Philosophy of the Social Sciences 35:75–97, 2005; Sebanz et al. Journal of Experimental Psychology: Human Perception and Performance, 31(6): 234–1246, 2006; Vesper et al. Neural Networks 23 (8/9): 998–1003, 2010), which seek to address some of the shortcomings of classical accounts. Minimalist accounts seek to reduce the cognitive complexity demanded by classical accounts either by leaving out shared intentions or by characterizing them in a (...) way that does not demand common knowledge of complex, interconnected structures of intentions. Moreover, they propose models of the actual factors facilitating online coordination of movements. The present proposal aims to enrich a minimalist framework by showing how shared emotions can facilitate coordination without presupposing common knowledge of complex, interconnected structures of intentions. Shared emotions are defined for the purposes of this paper as affective states that fulfill two minimal criteria: (a) they are expressed (verbally or otherwise) by one person; and (b) the expression is perceived (consciously or unconsciously) by another person. Various ways in which the fulfillment of (a) and (b) can lead to effects that function as coordinating factors in joint action are distinguished and discussed. (shrink)

Separated decision-making for maintenance and spare ordering is unrealistic in the industry, so this paper aims to optimize them together. A joint policy of inspection-based preventive maintenance and spare ordering considering two modes of spare ordering, namely, a regular order and an emergency order, is proposed for single-unit systems using a three-stage failure process. If the system is recognized to be in the minor defective stage, the original inspection interval is shortened and a regular order is placed. However, replacement (...) is undertaken preventively or correctively if the severe defective stage is identified or a failure occurs. Depending on the system state and the state of the regular ordered spare when replacement is needed, all possible scenarios are considered to construct optimization model I. The decision variables are the optimal inspection interval and the times of shortening the original inspection interval. Additionally, model II on the basis of an assumption that the spare is always ordered at time 0 is also developed. The results from a numerical example illustrated the applicability and the effectiveness of model I compared to model II, and the irregular inspection policy is validated to be cost-saving compared to the regular inspection policy. This article explores the extent to which the magnitude of harm that a person is liable to suffer to avert a threat depends on the magnitude of her causal contribution to the threat. Several different versions of this view are considered. The conclusions are mostly skeptical—facts that may determine how large of a causal contribution a person makes to a threat are not morally significant, or not sufficiently significant to make an important difference to liability. However, understanding ways (...) in which causation may be scalar helps to deepen our understanding of other morally significant facts, such as responsibility. (shrink)

Severian of Gabala’s homilies and Pseudo-Theodoret’s Quaestiones et responsiones ad Orthodoxos exhibit some notable parallels. Such links show that a marginal current of the Antiochene school was still thriving by the end of the 5th century, i.e. the most probable date of QRO.

The earliest instance of φωτιστήριον « baptistery » in Antioch appears in the year 517, in a Syriac gloss to one of Severus’s homilies, perhaps in connectionwith his pastoral policies. Even if φωτιστήριον was formed according to same pattern as βαπτιστήριον, both nouns seem independent. John Chrysostom and an Antiochian Pseudo-Chrysostom do not mention at all the baptistery, but only the font (κολυμβήϑρα). The evidence indicates that during the 5th century φωτιστήριον was almost exclusively used in Constantinople and might have (...) been created there. Some texts indicate that the word might have been the preferred name for the baptistery of a « cathedral » church, at least in Constantinople. (shrink)

According to Cornelis Datema, the still mysterious Leontius of Con-stantinople preached sometime around 557, whereas Michel Asmus places him between the end of the 4th century and the mid-5th century. This paper contends that the memory of a deceased bishop that closes the homily Nat. refers to Theodore I, patriarch of Constantinople, who died on 28 December 687. The article also shows that Leontius cannot possibly have lived earlier than the mid-6th century.
