In 2008, a group of researchers publicly released profile data collected from the Facebook accounts of an entire cohort of college students from a US university. While good-faith attempts were made to hide the identity of the institution and protect the privacy of the data subjects, the source of the data was quickly identified, placing the privacy of the students at risk. Using this incident as a case study, this paper articulates a set of ethical concerns that must be addressed (...) before embarking on future research in social networking sites, including the nature of consent, properly identifying and respecting expectations of privacy on social network sites, strategies for data anonymization prior to public release, and the relative expertise of institutional review boards when confronted with research projects based on data gleaned from social media. ZusammenfassungDie Geschichte der genetischen Pränataldiagnostik ist bislang als Teil der Geschichte der Humangenetik und deren Neuorientierung als klinisch-laborwissenschaftliche Disziplin in der zweiten Hälfte des 20. Jahrhunderts betrachtet worden. Anhand neuen Quellenmaterials soll in diesem Beitrag gezeigt werden, dass das Interesse an der Pränataldiagnostik in Westdeutschland auch im Kontext von Forschungen entstand, die sich mit Gefahren für den Menschen in der Umwelt befassten. Anhand der Debatten um die Einrichtung des DFG-Schwerpunktprogramms „Pränatale Diagnostik genetischer Defekte“ 1970 untersuchen wir, wie die Technik der (...) Amniozentese in Westdeutschland von einer interdisziplinären Forschungsgruppe eingeführt wurde, die sich mit Schädigungen des Organismus durch Strahlen, Arzneimittel und andere Gebrauchsstoffe und Konsumgüter befasste. In einer als ökologische Wende bezeichneten Zeit wachsenden Umweltbewusstseins, so unsere These, sollte durch die Förderung der Pränataldiagnostik eine wahrgenommene Lücke in der Prävention umweltbedingt auftretender genetischer Anomalien geschlossen werden. Für die Pränataldiagnostik als „Schutzmaßnahme“ sprach unter anderem ihre erwartete Finanzierung als Krankenkassenleistung im Zuge der Reform des Abtreibungsrechts. Erst in einem zweiten Schritt führten Veränderungen von Strukturen der Forschung, vor allem aber Erfahrungen in der gynäkologischen Praxis zu einer Neuausrichtung auf die Diagnostik und Prävention mehrheitlich erblicher oder spontan auftretender Anomalien. Die Pränataldiagnostik, so wie sie schließlich in Westdeutschland ab den frühen 1980er Jahren routinemäßig Einsatz fand, hatte mit Fragen der „Umwelt“ kaum noch zu tun. Diese Fallstudie zur Frühgeschichte der genetischen Pränataldiagnostik handelt von dem noch wenig untersuchten Verhältnis von humangenetischer Forschung, klinischer Praxis und Umweltforschung und hat zum weiteren Ziel, den bisher in anderen Kontexten beschriebenen Wandel von Perspektiven in der Vorsorge um 1970 zu beleuchten. A general consensus has been reached in health care organizations that the disclosure of medical errors can be a very powerful way to improve patients and physicians well-being and serves as a core component to high quality health care. This practice strongly encourages transparent communication with patients after medical errors or unanticipated outcomes. However, many countries, such as Brazil, do not have a culture of disclosing harmful errors to patients or standards emphasizing the importance of disclosing, taking responsibility, apologizing, and (...) discussing the prevention of recurrences. Medical error is not discussed or approached during medical school. The stigma of error has a strong connection with value judgments, and emotional support for physicians does not exist. This paper suggests that open communication with the patient is essential. Guidance about error disclosure from health care organizations would be helpful for quality and patient safety and for health care professionals in countries like Brazil. (shrink)

ABSTRACT Between the first two Critiques, Kant wrote what he called a “conjectural history” of the development of human freedom through a reading of Genesis. In the essay, reason itself is conceived of in terms of its “genesis,” and Kant primarily reads “Genesis” as an account of reason’s ascension or becoming. Just as humankind becomes itself through the Fall, so too does reason simultaneously come into its own. Adam indeed acts as a template for the conception of moral agency that (...) Kant will go on to develop in much more detail in the second critique. More significantly, however, as I argue below, the “genesis” and ascension of reason is only made possible through Eve’s covering up of herself. I argue that the act naturalizes both shame and clothing onto a feminine body conceived as un-reasonable. It is against this foil of unreason that reason is able to reach its own heights. I argue that Kant’s reading of Genesis in the “Conjectures” naturalizes women and clothing as superfluous: to humankind and to the ascent of reason alike. However, their function as the condition of possibility for Kant’s own system will show that they are anything but superfluous. Rather, they are essential. (shrink)

RESUMO O artigo examina algumas influências teóricas de Freud para recuperar os valores epistemológicos que subjazem à composição de sua concepção de ciência da natureza. Se, por um lado, Freud teve acesso ao pensamento de autores específicos que participaram efetivamente dos caminhos percorridos pela psicologia em sua reivindicação de uma identidade científica, por meio de entrelaçamentos com a física e a fisiologia, por outro lado, ele também teve contato com certos filósofos que lhe permitiram uma aproximação a alguns defensores da (...) cientificidade da psicologia que não abandonam o naturalismo, nem recorrem ao solo fisiológico. Nossa avaliação histórica constituiu-se como uma defesa de que Freud sofreu diversas influências no tocante ao status da psicologia no campo das ciências da natureza. A pluralidade dessas influências evoca uma necessidade de abertura para a avaliação do modo pelo qual podemos colocar em perspectiva a epistemologia e a concepção do naturalismo de Freud. ABSTRACT This article examines some of the theoretical outlooks Freud used to acquire the epistemological values that underlie the foundation of his notion of natural science. On the one hand Freud was familiar with the ideas of specific authors, who had made major contributions that support of psychology's status as a science by appealing to physics and physiology. On the other hand, his contact with certain philosophers allowed him to use their defenses of psychology's scientific status without abandoning naturalism and without recourse to physiology. Our historical evaluation of these struggles supports that Freud was affected by various points of view concerning psychology's standing within the natural sciences. Owing to the diverse influences on Freud, we need to figure out how we can put his epistemology and his concept of naturalism into perspective. (shrink)

Our core hypothesis is that the emergence of human language arose very rapidly from the linking of two pre-adapted systems found elsewhere in the animal world—an expression system, found, for example, in birdsong, and a lexical system, suggestively found in non-human primate calls (Miyagawa et al., 2013, 2014 ). We challenge the view that language has undergone a series of gradual changes—or a single preliminary protolinguistic stage—before achieving its full character. We argue that a full-fledged combinatorial operation Merge triggered the (...) integration of these two pre-adapted systems, giving rise to a fully developed language. This goes against the gradualist view that there existed a structureless, protolinguistic stage, in which a rudimentary proto-Merge operation generated internally flat words. It is argued that compounds in present-day language are a fossilized form of this prior stage, a point which we will question. (shrink)

Frequent public uproar over forms of data science that rely on information about people demonstrates the challenges of defining and demonstrating trustworthy digital data research practices. This paper reviews problems of trustworthiness in what we term pervasive data research: scholarship that relies on the rich information generated about people through digital interaction. We highlight the entwined problems of participant unawareness of such research and the relationship of pervasive data research to corporate datafication and surveillance. We suggest a way forward by (...) drawing from the history of a different methodological approach in which researchers have struggled with trustworthy practice: ethnography. To grapple with the colonial legacy of their methods, ethnographers have developed analytic lenses and researcher practices that foreground relations of awareness and power. These lenses are inspiring but also challenging for pervasive data research, given the flattening of contexts inherent in digital data collection. We propose ways that pervasive data researchers can incorporate reflection on awareness and power within their research to support the development of trustworthy data science. (shrink)

BackgroundCommentators believe that the ethical decision-making climate is instrumental in enhancing interprofessional collaboration in intensive care units. Our aim was twofold: to determine the perception of the ethical climate, levels of moral distress, and intention to leave one's job among nurses and physicians, and between the different ICU types and determine the association between the ethical climate, moral distress, and intention to leave.MethodsWe performed a cross-sectional questionnaire study between May 2021 and August 2021 involving 206 nurses and physicians in a (...) large urban academic hospital. We used the validated Ethical Decision-Making Climate Questionnaire and the Measure of Moral Distress for Healthcare Professionals tools and asked respondents their intention to leave their jobs. We also made comparisons between the different ICU types. We used Pearson's correlation coefficient to identify statistically significant associations between the Ethical Climate, Moral Distress, and Intention to Leave.ResultsNurses perceived the ethical climate for decision-making as less favorable than physicians. They also had significantly greater levels of moral distress and higher intention to leave their job rates than physicians. Regarding the ICU types, the Neonatal/pediatric unit had a significantly higher overall ethical climate score than the Medical and Surgical units and also demonstrated lower moral distress scores and lower “intention to leave” scores compared with both the Medical and Surgical units. The ethical climate and moral distress scores were negatively correlated ; moral distress and "intention to leave" was positively correlated ; and ethical climate and “intention to leave” were negatively correlated.ConclusionsSignificant differences exist in the perception of the ethical climate, levels of moral distress, and intention to leave between nurses and physicians and between the different ICU types. Inspecting the individual factors of the ethical climate and moral distress tools can help hospital leadership target organizational factors that improve interprofessional collaboration, lessening moral distress, decreasing turnover, and improved patient care. Recent advances in wireless technologies have led to the development of intelligent, in-vehicle safety applications designed to share information about the actions of nearby vehicles, potential road hazards, and ultimately predict dangerous scenarios or imminent collisions. These vehicle safety communication (VSC) technologies rely on the creation of autonomous, self-organizing, wireless communication networks connecting vehicles with roadside infrastructure and with each other. As the technical standards and communication protocols for VSC technologies are still being developed, certain ethical implications of these new (...) information technologies emerge: Coupled with the predicted safety benefits of VSC applications is a potential rise in the ability to surveil a driver engaging in her everyday activities on the public roads. This paper will explore how the introduction of VSC technologies might disrupt the “contextual integrity” of personal information flows in the context of highway travel and threaten one’s “privacy in public.” Since VSC technologies and their related protocols and standards are still in the developmental stage, the paper will conclude by revealing how close attention to the ethical implications of the remaining design decisions can inform and guide designers of VSC technologies to create innovate safety applications that increase public safety, but without compromising the value of one’s privacy in public. A country‘s development is bound to be influenced by external occurrences. This article analyses two astronomical examples in which Portuguese nationals used high visibility events in the international scientific community to press their own scientific interests upon the government, whether these interests were, or were not, directly linked to the events themselves.During the 1840s and 1850s the parallax, i.e. the distance, of Groombridge’s star 1830 was hotly debated. The astronomer Hervé Faye‘s suggestion at the Académie des Sciences de Paris that (...) observations be made in Lisbon due to its privileged location and the inadequacy of the Lisbon Navy Observatory to perform them rekindled the efforts to improve the Portuguese Navy observatory.In the 1850s and 1860s other Portuguese higher education institutions also wanted to upgrade their facilities or build new ones. Following accepted traditions, scientific field trips were considered a useful part of the acquisition planning for larger instruments, and therefore an important part of regeneration and renewal projects. The Portuguese scientists were, however, limited in their travels by government imposed budget constraints. The total solar eclipse of 18 July 1860 provided an extra argument to send Portuguese scientists abroad. The government support of the eclipse expedition led to an opportunity to travel through other countries and view their observatories and equipment.In the end, neither the Navy astronomers nor those from the Coimbra Astronomical observatory, the other significant site of Portuguese astronomical research, managed to fulfil their objectives, but the contacts initiated by some of the Portuguese travellers were important for the development of the Portuguese national Meteorological and Magnetic Observatories. A pesquisa desenvolve o tema das agências reguladoras que são órgãos públicos submetidos a um regime jurídico especial. Este indica a independência de sua composição e de atuação como condição de legalidade e de legitimidade. Aponta-se o fenômeno da captura, que poderá ocorrer naqueles dois momentos, como sendo uma forma de corrupção a desestabilizar o modelo das agências implementado no Brasil a partir de 1997. O percurso dos estudos considera método qualitativo a partir da doutrina e da legislação em vigor.

A linguagem de comunicabilidade da imagética barroca expressa-se com inesperado ênfase no caso de uma desconhecida tela que representa Jesus Cristo perante Caifás e a negação de S. Pedro, num altar do Convento dos frades eremitas paulistas da vila de Portel. Pintada cerca de 1660, essa tela, que se inspira numa estampa nórdica de Schelte a Bolswert segundo modelo caravagesco de Gerard Seghers, leva a colocar a questão do papel assumido pela gravura italo­flamenga (a estampa solta e a estampa de (...) livro) na construção de uma imagética contra-reformista ao serviço da militância católica e do convencimento das populações em larga escala. A peça, que é devida, segundo se crê, a um secundário pintor proto-barroco de nome João da Cunha, morador em Beja, reforça a ideia do interesse da nossa pintura regional por cânones de influência caravagesca, uma tendência quase ignorada na arte portuguesa do século XVII. A pintura de Portel mostra uma narração para serviço do convencimento e revela-se um qualifi­cado painel de devoção, inspirado em modelo tenebrista de Seghers, com o seu dinâmico grupo de figuras a la candela que assiste ao trecho bíblico. Testemunha-se um caso de encomenda religiosa periférica que, apesar do seu grau aparente de vulgaridade, assume, através da utiliza­ção de uma estampa de sinal erudito, a experiência da inovação possível e as possibilidades da reconversão imagética do modelo, a fim de melhor servir o rigorismo do seu impacto visual. A transposição desse modelo militar hierárquico confere à estrutura do Estado persa um caráter racional que visa, do ponto de vista econômico, a eficiência na produção de recursos e o equilíbrio fiscal; e, do ponto de (...) vista político, a eliminação de conflitos internos e da anarquia, bem como a rapidez na transmissão das ordens e a eficácia na execução de tarefas burocráticas, na medida em que cada um conhece o seu lugar e as suas funções nesse sistema hierárquico, que se mantém através do poder do soberano disseminado em todas as instâncias do governo. A partir da correlação existente entre a forma-mercadoria e a forma jurídica do contrato, analisaremos o tratamento marxiano do Direito. Procuramos demonstrar que essa ligação mencionada está presente no autor, mas não basta para a crítica marxiana. São essenciais ao tratamento de Marx sobre a esfera jurídica a relação existente entre as formas econômicas da mercadoria, do dinheiro e do capital, bem como seus respectivos fetichismos. Também se tem que a análise, principalmente no livro III de O capital, das figuras (...) econômicas, como a renda e os juros, e de seu papel na distribuição do mais-valor. Nesse momento, aparecem menções às formas jurídicas, que somente podem ser compreendidas ao se trazer a ligação entre o processo imediato de produção e as figuras que aparecem no tratamento marxiano do processo global de produção. Desse modo, pode-se dizer que o tratamento clássico da crítica marxista ao Direito, aquele de Pachukanis, é, no mínimo, insuficiente quando se trata da compreensão da obra de Marx. (shrink)

Modern science is one form of knowledge, demarcated by its time (modernity) and by other “knowledges.” There is a fair amount of clarity as to what does not count as scientific, but there is a twilight zone of knowledges whose scientific status is ambivalent. In this zone the encounter between science and religion takes place. The particular contribution of religion and theology in this encounter is to call for an ethics of knowledge in the epistemological endeavors of science.

In this article I argue against the arbitrariness of the concept of music and for an essentialist and naturalist framework, according to which music is a cross-cultural human phenomenon, defined by relational properties held together by uniform features of human nature. Building on Dickie’s classification of theories of art in natural kind theories and cultural-kind theories, I argue for an enhanced natural-kind theory (which explains the institutional element), and use some developments in social ontology to show the inadequacy of an (...) institutionalist approach to art and music. Background Teamwork in emergency medical services is a very important factor in efforts to improve patient safety. The potential differences of staff gender on communication, patient safety, and teamwork were omitted. The aim of this study is to evaluate these inadequately examined areas. Methods A descriptive and anonymous study was conducted with an online questionnaire targeting emergency physicians and paramedics. The participants were asked about teamwork, communication, patient safety and handling of errors. Results Seven hundred fourteen prehospital professionals from all (...) over Germany participated. A total of 65.7% of the women harmed a patient (men 72.9%), and 52.6% were ashamed when mistakes were made (men 31.7%). 19.0% of the female participants considered their communication skills to be very good, compared to 81% of the men. More women than men did not want to appear incompetent (28.4%, 15.5%) and therefore did not speak openly about mistakes. Both genders saw the character of their colleagues as a reason for poor team communication (women 89.4%, men 84.9.%). Under high stress, communication decreased (women 35.9%, men 31.0%) and expression became inaccurate (women 18.7%, men 20.1%). Conclusions Team communication problems and teamwork in rescue services are independent of gender. Women seem to have more difficulty with open communication about mistakes because they seem to be subject to higher expectations. Work organization should be adapted to women’s needs to enable more effective error management. We conclude that it is necessary to promote a positive error and communication culture to increase patient safety. (shrink)

This paper is about the dilemma raised against musical ontology by Roger Scruton, in his The Aesthetics of Music: either musical ontology is about certain mind-independent “things” and so music is left out of the picture, or it is about an “intentional object” and so its puzzles are susceptible of an arbitrary answer. I argue the dilemma is merely apparent and deny that musical works can be identified with sound structures, whether or not conceived as abstract entities. The general idea (...) is this: both Platonism and nominalism about musical works are a kind of fetishism: musical works are not “things”, in Danto’s sense of “mere real things”; they rather involve complex relationships between objects, events, and different kinds of functional properties. For this, I draw on Levinson and Howell’s notion of indication, combined with Searle’s approach to institutional reality... with a little twist of my own. (shrink)

DNA and RNA are the only known natural genetic materials. Systematic modification of each of their chemical building blocks (nucleobase, sugar, and phosphate) has enabled the study of the key properties that make those nucleic acids genetic materials. All three moieties contribute to replication and, significantly, all three moieties can be replaced by synthetic analogs without loss of function. Synthetic nucleic acid polymers capable of storing and propagating information not only expand the central dogma, but also highlight that DNA and (...) RNA are not unique chemical solutions for genetic information storage. Soma, Psyche, and social Milieu form a kind of continuum which is artificiallľ dissociated by our one‐sided approaches. Experimentation cannot be fullľ practised on man, nor can its results on animal be extended to man without serious risks of error. Similar limitations appear if, resorting to the pathological method, we (...) try to apply to the normal conclusions arrived at through the Study of the abnormal. Special reference is made here to psychosurgery, a topic quite familiar to Dr Fontes, who is Dr Egas Moniz’ countryman.The author then summarises our present knowledge concerning the structure, connections and functions of encephalic centers, especially; the thalamus, the hypothalamus and the frontal lobes.Finally, he subscribes, though not without serious reservations, to the hierarchical conception of the Nervous Sľstem as well as of the human mind, first suggested by Jouffroy, after him developed by Baillarger, Janet, Wallon in France, by Hughlings Jackson in Great Britain, and recentlľ revived in Europe by von Mona‐kow and Mourgue, Eľ, and Delaľ. This view enables one to consider nervous or psľchic illnesses as various dissolutions, resulting on the one hand from the suppression of higher centers or powers, on the other hand from the liberation of lower ones. It agrees rather well with the informations gathered by the anatomy and the physiology of the nervous sľstem, and with the conclusions suggested by psychosurgical opérations. To the thalamus and hypothalamus correspond the lower and older manifestations of mind: emotion and instinct, to the cortex the higher and more recent adaptive and intellectual processes. The hypothalamus plays a most important role in the nervous machinery as a regulator of vegetative and instinctive life, of wake and sleep, of consciousness, and of the basic biological rhythms. At the cortical level the frontal lobe appears as the structural basis for such psychical functions as Ego‐control, Will, Personality, and succèssfull action on the milieu. (shrink)

Em 2012, Alexandre Marques Cabral levantou uma crítica à Psicologia clínica e à psicoterapia. Retomando a discussão de Foucault sobre a confissão, Cabral desdobrou a narrativa de que a Psicologia clínica seria uma herdeira direta do dispositivo confessional católico-cristão, configurando-se, portanto, como uma prática de controle e docilização dos corpos e existências. Em 2014, Ana Maria Lopez Calvo de Feijoo respondeu à crítica de Cabral, argumentando que a Psicologia fenomenológico-existencial é capaz de superar as críticas levantadas por Foucault, pois não (...) se pauta na noção de confissão, já que não qualquer ideia de interioridade ou subjetividade. Nesse artigo, pretendemos retomar essa discussão centrando na polissemia do termo confissão, deslocando o debate para caminhos até então não trilhados. Nosso argumento é de que é possível pensar a confissão de maneira diferenciada a partir do pensamento de Soren Kierkegaard, que concebe a confissão como uma relação imediata consigo mesmo, estabelecida a partir da possibilidade de um diálogo interior. This is a theological response to two programmatic essays, “Science and the Future of Theology: Critical Issues,” by Arthur Peacocke and “What Game is Being Played? The Need for Clarity about theRelationship between Scientific and Theological Understanding,” by David A. Pailin. It argues that the two authors, well informed by the recent developments in science, are reduplicating some methodological and epistemological trends common to nineteenth‐century theology. The feasibility of their project should, therefore, be examined on whether they succeed in answering (...) the questions posed to the liberal project that dominated theological and philosophical scholarship in the last century. They are found to be wanting in their inadequate response to three considerations: (1) the persistence of particular manifestations of religion and theology's enduring refusal to accept thoroughly scientific “enlightened” criteria, (2) the epistemological implications of the eschatological character of the Christianmessage, and (3) the trinitarian paradigm for Christian theology and the life of faith. Based on a mixed-methods study involving triad tasks and ethnobiological models, we analyze local categories and knowledge of key ethnospecies of fish exploring partial overlaps between artisanal fishers’ and academic knowledge in a fishing community in northeast Brazil. We argue that fishers’ and academic knowledge overlaps may provide common ground for transdisciplinary collaboration, while their partiality requires reflection on epistemological and ontological differences. Here, we show how knowledge of artisanal fishers can complement academic knowledge and bring about tensions that need (...) to be addressed through intercultural dialogue. By integrating a general philosophical framework of partial overlaps with a mixed-methods study on fishers’ knowledge, we show how ethnobiology can contribute to reflective and empirically-grounded transdisciplinary practices. Trata-se de um breve e parcial recenseamento do paradigma naturalista em desenvolvimentos clássicos e recentes da filosofia fenomenológica. Em um primeiro momento, tentar-se-á estabelecer elementos mínimos acerca do que pode ser considerado um “paradigma filosófico”. Em seguida, será mostrada uma presença improvável e discreta da física enquanto imaginário privilegiado na ontologia fenomenológica de Jean-Paul Sartre. Também será explorada a resistência de Paul Ricoeur ao reducionismo neurobiológico, bem como uma improvável presença de um enquadramento naturalista na base de sua antropologia filosófica. (...) Por fim, serão apresentados indícios, na literatura recente, da possibilidade de uma relação fecunda e amigável entre a fenomenologia hermenêutica de Heidegger e as ciências naturais.
