The paper investigates how formal/informal networks of scientists, while facilitating the scientific West-East transfer in the Cold War context, shaped the scientific field of sexology by imposing personal scientific credos, in a particular national context. The paper shows that in the Cold War context, sexual science was present in Communist Romania, but neither as imitation of the regional scholarship, nor as a simple reproduction of western advancements in the field. The post-war Romanian scholarship in the field of sexology was the (...) result of scientific interests of Stefan Milcu – long time party protégée and respected member of the international scientific community – and of its personal circle that included remarkable personalities such as Victor Săhleanu or Tudor Stoica. Presenting the public with information about sexual and re­productive functions, and sometimes even elaborated descriptions of sexual techniques, certainly was never meant to enhance the individual gratification or provoke any form of sexual revolution. The Romanian production of sex/educational manuals and of sexology works was part of a state policy towards a better, stable, family life, aiming for collective and social happiness. (shrink)

This book offers a critical examination of those theories and advances a new argument for punishment's justification, calling it the 'duty view'.

A widespread view in moral, legal, and political philosophy, as well as in public discourse, is that responsibility makes a difference to the fair allocation or distribution of things that are valuable or disvaluable independently of responsibility. For example, the fairness of punishing a person for wrongdoing varies with her responsibility for wrongdoing; the fairness of requiring a person to pay compensation varies with her responsibility for the harm that she caused; the fairness of one person being worse off than (...) another varies with her responsibility for being worse off; the fairness of inflicting defensive harm on a person to avert a threat varies with her responsibility for causing or posing the threat; and so on. This article explores the moral significance of consent in an unjust world by developing the view that the validity of consent depends on its causes. It defends the view that the causes of consent make it valid or invalid. It then shows how this idea helps us to distinguish different ways in which consent might matter morally where it has problematic causes. Finally, it uses this analysis to explore the moral significance of a range of problematic causes of consent, including (...) objectification, arranged marriage, and third-party threats of violence. This article explores the extent to which the magnitude of harm that a person is liable to suffer to avert a threat depends on the magnitude of her causal contribution to the threat. Several different versions of this view are considered. The conclusions are mostly skeptical—facts that may determine how large of a causal contribution a person makes to a threat are not morally significant, or not sufficiently significant to make an important difference to liability. However, understanding ways in which (...) causation may be scalar helps to deepen our understanding of other morally significant facts, such as responsibility. (shrink)

In his recent book, Killing in War, Jeff McMahan sets out a number of conditions for a person to be liable to attack, provided the attack is used to avert an objectively unjust threat: (1) The threat, if realized, will wrongfully harm another; (2) the person is responsible for creating the threat; (3) killing the person is necessary to avert the threat, and (4) killing the person is a proportionate response to the threat. The present article focuses on McMahan's second (...) condition, which links liability with responsibility. McMahan's use of the responsibility criterion, the article contends, is too restrictive as an account of liability in general and an account of liability to be killed in particular. In order to defend this claim, the article disambiguates the concept of liability and explores its role in the philosophical analysis of the permission to cause harm to others. (shrink)

A normative power is a power to alter rights and duties directly. This paper explores what it means to alter rights and duties directly. In the light of that, it examines the kind of argument that might support the existence of normative powers. Both simple and complex instrumentalist accounts of such powers are rejected, as is an approach to normative powers that is based on the existence of normative interests. An alternative is sketched, where normative powers arise based on the (...) appropriateness of a person responding to a decision by limiting their freedom. (shrink)

In the fall semester of 1772/73 at the Albertus University of Königsberg, Immanuel Kant, metaphysician and professor of logic and metaphysics, began lectures on anthropology, which he continued until 1776, shortly before his retirement from public life. His lecture notes and papers were first published in 1798, eight years after the publication of the _Critique of Judgment, _the third of his famous _Critiques. _The present edition of the _Anthropology _is a translation of the text found in volume 7 of _Kants (...) gesammelte Schriften, _edited by Oswald Külpe. Kant describes the _Anthropology _as a systematic doctrine of the knowledge of humankind. Kant’s lectures stressed the "pragmatic" approach to the subject because he intended to establish pragmatic anthropology as a regular academic discipline. He differentiates the physiological knowledge of the human race—the investigation of "what Nature makes of man"—from the pragmatic—"what man as a free being makes of himself, what he can make of himself, and what he ought to make of himself." Kant believed that anthropology teaches the knowledge of humankind and makes us familiar with what is pragmatic, not speculative, in relation to humanity. He shows us as world citizens within the context of the cosmos. Summarizing the cloth edition of the _Anthropology, Library Journal _concludes: "Kant’s allusions to such issues as sensation, imagination, judgment, taste, emotion, passion, moral character, and the character of the human species in regard to the ideal of a cosmopolitan society make this work an important resource for English readers who seek to grasp the connections among Kant’s metaphysics of nature, metaphysics of morals, and political theory. The notes of the editor and translator, which incorporate material from Ernst Cassirer’s edition and from Kant’s _marginalia _in the original manuscript, shed considerable light on the text.". This essay argues that culpability and responsibility are independent notions, even though some of the same facts make us both responsible and culpable. Responsibility for one’s conduct is grounded in the strength of the agential connection between oneself and one’s conduct. Culpability for one’s conduct is the vices that give rise to that conduct. It then argues that responsibility and culpability for causing a threat are each grounds of liability to defensive harm independent of the other.

The majority of world religions have developed in the course of overcoming tribal and clan identity. The rise of world religions was associated with rise of huge empires and states where various ethnic groups coexisted, not only on the basis of force alone, but also on basis of common religious belief and value systems imposed by religious ideology. Governing polyethnic territories, developments (...) in economy and trade and consistent humanization of human spirit resulted in the development of common human values.Mankind started perceiving itself as a single species sharing a common world history. The concept of 'mankind' came to unite people irrespective of their race, religion and nationality. Objective of our study was cross-confessional investigation of value systems in religions spread in Russia and establishing to what extent they are spiritually acceptable to Russians. This chapter critically examines various proposals for liability of a person to defensive harm. Drawing on the idea that there is an important relationship between a person’s liability to be harmed and the enforceable duties that she incurs as a result of posing a threat to others, it demonstrates that no simple account of liability will be successful. As there are many considerations that bear on the duties that a person has, there are many considerations which bear on a person’s (...) liability to be harmed. This general claim is supported through a demonstration both that culpability without causation can ground liability, and that causal contribution without culpability can ground liability. (shrink)

The central Fodorian objections to Inferential Role Semantics (IRS) can be taken to include an ‘Analyticity Challenge’ and a ‘Circularity Challenge’, which are ultimately challenges to IRS explanations of concept possession. In this paper I present inferential role theories, critically examine those two challenges and point out two misunderstandings to which the challenges are exposed. I then state in detail a rationalist version of IRS and argue that this version meets the Fodorian challenges head on. If sound, this line of (...) argument shows that there is no problem of principle in the consideration of IRS as a good candidate for a theory of concepts.Las objeciones fodorianas en contra de una Semántica del Papel Inferencial (SPI) pueden concebirse como incluyendo un ‘Reto de la Analiticidad’ y un ‘Reto de la Circularidad’, los cuales son principalmente retos a las explicaciones que SPI proporciona sobre la posesión de conceptos. En este artículo presento las teorías del papel inferencial, examino críticamente estos retos y señalo dos malentendidos a los cuales están expuestos. A continuación, presento con detalle una versión racionalista de SPI y defiendo que esta versión supera los retos fodorianos directamente. Si es correcta, esta línea argumentativa muestra que no hay un problema de principio en la consideración de SPI como una buena candidata para una teoría de los conceptos. (shrink)

Or to put it simply: The game is over. Is it true? Then some physicists began to ask: can go beyond the Standard Model? Because the supersymmetric extension of the Standard Model has failed. If you feel that theoretical physics is becoming boring, you are not alone. Fortunately, there is good (...) news: a new generation of physicists are doing table-top experiments in their basements. Can we expect new results later? If so, what will the future of physics look like? This article discusses this question, starting with a blunt look at the relationship between mathematics and physical reality, written from the perspectives of a mathematician and a cosmologist. One of the most interesting questions raised in Cecile Fabre’s Cosmopolitan War concerns war for the sake of resources. Fabre argues that it is sometimes permissible to go to war for the sake of resources that the poor are entitled to. I agree with this, but I think it is true only in very restricted circumstances. I consider a number of arguments in favour of resource wars, showing many of them to fail. The most promising argument, I suggest, is that (...) those who possess resources that have unjustly been secured are complicit in posing future threats by contributing to a market for unjustly secured resources. Whilst this argument has some promise, even it, I suggest, is in no way decisive. (shrink)

This essay is a response to the excellent contributions to the double special issue of Law and Philosophy on my book The Ends of Harm. I further defend the Duty View of punishment outlined in the book, responding to criticisms of that view. I also challenge the plausibility of retributivist accounts offered in response to the challenges to that view developed in The Ends of Harm.

This review article discusses Arthur Ripstein’s Kantian account of rights. Our most important rights, Ripstein argues, are determined by our independence rather than our interests. And a significant group of these rights—our rights over external things—is enforceable only in virtue of state membership. I argue that whilst independence is an important source of rights, we cannot exclude interests from an adequate account of rights, and that once this is acknowledged we will conclude that the state is less important than Ripstein (...) believes in rendering our rights enforceable. Husserl's two notions of "definiteness" enabled him to clarify the problem of imaginary numbers. The exact meaning of these notions is a topic of much controversy. A "definite" axiom system has been interpreted as a syntactically complete theory, and also as a categorical one. I discuss whether and how far these readings manage to capture Husserl's goal of elucidating the problem of imaginary numbers, raising objections to both positions. Then, I suggest an interpretation of "absolute definiteness" as semantic completeness and (...) argue that this notion does not suffice to explain Husserl's solution to the problem of imaginary numbers. A vinculação entre teologia e dogmática católica e sua relação com o pensamento conservador pretendem assegurar o retorno a um ideal da cristandade através de uma oposição cerrada com uma filosofia combativa e uma teologia dogmática “antimodernista”. Por um lado, o pensamento conservador alcança seu (...) declínio e permanece a margem diante do surgimento do novo proporcionado pelo Concilio e por outro lado, a desconexão da teologia de toda a cristandade, permite uma renovação da metodologia dogmática católica. In this paper I explore Antony Duff’s claim that there are categorical constraints on the scope of the criminal law that are set by its internal standards. I argue against his view that such constraints are categorical, and I suggest that his account of the nature of the criminal law is partial, and narrows the focus of our enquiry into the scope of the criminal law too much.
