I argue that the distance between state and citizen gives state paternalism a pro tanto advantage over paternalism between individuals. Pace Jonathan Quong, the state neither denies nor diminishes my moral status by acting on a justified negative judgment about my rational or volitional capacities. Nor does its failure to paternalize on the basis of detailed information about individuals constitute a source of disrespect. Rather, the less discriminating nature of general legislation both reduces the risk of social stigmatization and avoids (...) a problematic dynamic with the paternalizee. But paternalistic policies may give us reason to be concerned about superiority or contempt in policy-makers towards the citizens at whom they are directed. Governments must remain ‘faceless’ enough for paternalism to operate at a distance, but they must reassure the governed that the judgment that they can do better for them does not conceal the attitude that they are better than them. Do the facts of evolution generate an epistemic challenge to moral realism? Some think so, and many “evolutionary debunking arguments” have been discussed in the recent literature. But they are all murky right where it counts most: exactly which epistemic principle is meant to take us from evolutionary considerations to the skeptical conclusion? Here, I will identify several distinct species of evolutionary debunking argument in the literature, each one of which relies on a distinct epistemic principle. Drawing on recent work (...) in epistemology, I will show that most of these initially plausible principles are false, spoiling the arguments that rely on them. And we will see that each argument threatens only one popular view of moral psychology: a “Representationalist” view on which our moral judgments rely crucially on a mental intermediary—e.g. a sentiment, gut reaction, or affect-laden intuition—delivered by our evolved moral faculty. In the end, only one evolutionary debunking argument remains a menace: an “ Argument from Symmetry ” that I will introduce to the literature. But we will see that it should worry only all naturalists, pressuring them into a trilemma: give up moral realism, accept a rationalism that is incongruous with naturalism, or give up naturalism. This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. In A Dentist and a Gentleman the sociologist Tracey Adams retells a familiar professionalization story, this time about elite dental practitioners in nineteenth‐century Ontario who launched a status‐enhancement project to reshape their self‐ and public image into “professional gentlemen” and establish monopoly control over dental practice. Dentists secured legislation in 1868 giving them authority to set entrance requirements, test and license practitioners, and establish a college. In subsequent decades they campaigned against those they called “quacks” who practiced without a license, (...) advertised, charged low fees, maintained dirty offices, misled patients about pain, or brought the gentlemanly status of dentistry into disrepute.Despite early resistance, the project had mostly succeeded by 1918, as dentists skillfully linked their expertise to emerging public health concerns and a professional image subtly reoriented toward an ideal of public service. By 1900 dental rhetoric was warning Canadians of an impending crisis of tooth decay and dental disease that would bring physical deterioration and mass feeblemindedness in its wake. Racial degeneracy, dentists warned, began in the mouth; the advance of civilization produced too much soft food and sugar, too little chewing, and too many high‐strung and overindulgent mothers. Only dentists, as “sentinels at the portal of the alimentary tract” , could stand against this threat to Anglo‐Saxon civilization. Rhetoric like this, combined with doses of guilt heaped on mothers, teachers, school boards, and public health agencies, resulted by 1915 in regular dental inspections of schoolchildren, free dental clinics, and the creation of the army dental corps.Dentistry brought unique twists to this familiar professionalization story. Prior to 1860 dentistry was an especially low‐status craft, associated with uneducated, itinerant tooth‐drawers or craftsmen like blacksmiths and gunsmiths . Professionalizing dentists therefore felt a special imperative to recast themselves as “gentlemen”; this image also reassured the upper‐middle‐class women who were dentists' main clientele. Unexpectedly, as Adams shows in an intriguing analysis, dentists benefited from an invaluable social alliance with physicians, who offered no opposition of the sort they raised against other rival groups of healers to dentists' professional aspirations.The study deals extensively with how gender shapes professions. Dentistry's professionalization, Adams insists, involved the adoption of a new ideal of personal masculinity, as seen in admonitions to dentists to establish firm, courteous, expert authority over their clients and in dentists' efforts to shape the imagined persona of the ideal dental assistant as uniquely female and wifelike. This masculine crafting of the profession notwithstanding, Ontario dentists evinced less overt opposition to women aspirants than did doctors or lawyers. Nevertheless, the proportion of female practitioners was much lower in dentistry than in medicine or law and remains substantially lower today. Adams brings considerable insight to her discussion of these facts and their causes, and she presents useful comparisons among the professions.This study has a few limitations. Perhaps because the author's sources are mainly professional journals, her account mostly mirrors the outlook of the professionalizing elite and her prose occasionally adopts their moralizing and improving tone. Regrettably, the book deals scarcely at all with what dentists actually did. One learns little about how changing scientific and medical ideas affected dentists' work, how dentists utilized anaesthesia and coped with the problem of pain, and what controversies over diagnostics and treatment animated the profession or about dentists' training and income. This is a history of dentistry's professionalization, not of dental medicine per se. But Isis readers impressed by this solid and modest study will hope that a history of dental practice will be Tracey Adams's next project. (shrink)

Predictive Processing theory, hotly debated in neuroscience, psychology and philosophy, promises to explain a number of perceptual and cognitive phenomena in a simple and elegant manner. In some of its versions, the theory is ambitiously advertised as a new theory of conscious perception. The task of this paper is to assess whether this claim is realistic. We will be arguing that the Predictive Processing theory cannot explain the transition from unconscious to conscious perception in its proprietary terms. Human beings choose rationally according to their own belief systems. Without taking into consideration these belief systems, which do not only contain theoretical assumptions about reality but also practical convictions, emotions, evaluations and preferences, it is not possible to understand how and why they choose and decide as they choose and decide under uncertainty. Belief systems are of great utility for beings whose form of rationality is a limited and bounded one. Due to the qualitative structure of belief systems, the (...) mathematical models develo-ped in the fields of game theory and rational choice theory are not always the adequate instrument to conceptualize them. [Socialism, essentialism and externalism] The paper defends two assumptions in Burge's externalist argument against materialism. One assumption is that the content of a belief is determined by the rules that govern its expression in a shared language. Hence, I call this principle "linguistic socialism." According to the other assumption, a belief survives as long as it keepds its content. Content is regarded hee as essential to a belief, so I call this principle "semantic essentialism." The critics of socialism such as (...) Davidson and Bilgrami reject it in favor of "individualism," claiming that the mental cotnent is idependent of conventionally fixed meaning. The opponents of essentialism such as Gibbons prefer "accidentalism," arguing that content is inessential to a belief. I argue that individualism and accidentalism contradict empirical facts and modal intuitions about belief ascriptions, respectively. (shrink)

The present paper was written as a contribution to ongoing methodological debates within the NCC project. We focus on the neural correlates of conscious perceptual episodes. Our claim is that the NCC notion, as applied to conscious perceptual episodes, needs to be reconceptualized. It mixes together the processing related to the perceived contents and the neural substrate of consciousness proper, i.e. mechanisms making the perceptual contents conscious. We thus propose that the perceptual NCC be divided into two constitutive subnotions. The (...) main theoretical idea that emerges as a consequence of this reconceptualization is that the neural correlate of a perceptual episode is formed in the neural interaction between content-processing and consciousness-conferring mechanisms. Por un lado, mediante la semiótica tensiva que desarrolla Jacques Fontanille, se originan significaciones relevantes desde los campos de la expresión y el contenido, (...) imprescindibles de indagar para comprender la finalidad de las imágenes publicitarias. Asimismo, a través de los regímenes de sentido de Landowski (manipulación y programación), se evidencia cómo se instaura una moda en los consumidores por su pretensión de adquirir los productos que se someten a la compraventa del mercado. This paper addresses Arthur Danto’s claim that contemporary artworks, such as Andy Warhol’s Brillo Box, do not differ perceptually from ordinary objects, and that in order to see contemporary artworks as art the viewer has to move from mere experience to a meaning expressed by the work. I propose to supplement Danto’s thesis. I argue that, while some contemporary artworks may indeed be perceptually indistinguishable from ordinary objects, these works are distinguishable not only by means of meaning but also by (...) means of a non-perceptual aesthetic experience. I then discuss two theories that might provide a model of such an aesthetic experience. First, I focus on James Shelley’s theory of non-perceptual aesthetic experience conceived as a representation of non-perceptual aesthetic properties. Second, I discuss Jérôme Dokic’s adverbialist theory, which sees aesthetic experience as a combination of non-aesthetic attitudes. I argue that the adverbialist model is the most promising candidate for solving our problem. The model must be extended, however, if it is to account for pragmatic attitudes in response to artworks. Mill argues that, apart from the principle of utility, his utilitarianism is incompatible with absolutes. Yet in On Liberty he introduces an exceptionless anti-paternalism principle—his liberty principle. In this paper I address ‘the absolutism problem,’ that is, whether Mill's utilitarianism can accommodate an exceptionless principle. Mill's absolute claim is not a mere bit of rhetoric. But the four main solutions to the absolutism problem are also not supported by the relevant texts. I defend a fifth solution—the competence view—that turns on (...) his attention to decision-making structures and, in particular, on the role of expertise considerations in his account. (shrink)

Is it possible to look at schools as spaces for encounters? Could schools contribute to a deliberative mode of communication in a manner better suited to our own time and to areas where different cultures meet? Inspired primarily by classical (Dewey) and modern (Habermas) pragmatists, I turn to Seyla Benhabib, posing the question whether she supports the proposition that schools can be sites for deliberative communication. I argue that a school that engages in deliberative communication, with its stress on mutual (...) communication between different moral perspectives, gives universalism a procedurally oriented meaning, serving as an arena for encounters that represents a weak public sphere. An interactive universalism of this kind attaches importance to developing an ability and willingness to reason on the basis of the views of others and to change perspectives. In that respect, the institutional arrangements of schools are potential parts of the political dimension of cosmopolitanism, as well as its moral dimension, in terms of the obligations and responsibilities we develop through our institutions and in our actions as human beings towards one another. This article examines the possible basis for legal liability of researchers who use the Internet in the collection of research data. In particular, it examines the potential legal issues associated with the protocols of ethnographers who use listserv, discussion board, blog, chat room and other sorts of web or Internet-based postings as the source of their data. The author assumes that the forum for participation is legitimate, in that the list, board, blog, chat, etc. is not created or otherwise concocted (...) by the researcher, but involves situations akin to off-line practices where a researcher would be listening to the conversation or watching the behavior of subjects in a public place. Since these practices do not involve direct interview or interaction with or treatment of "human subjects", much of the precedent involving negligence, informed consent, and related issues is not relevant; however, it is reviewed initially for guidance in suggesting the applicable, legal standards of conduct. This article does not discuss the use of the Internet as a collection device, e.g., in online surveys. Issues of legal harm arising from claims in negligence, privacy, and defamation for subsequent disseimination of such postings are evaluated. Although it is concluded that the likelihood for a success of such claims is small, analysis will include steps that researchers can take to ensure that such risk remains negligible. (shrink)

Muchos de los comentaristas de Gómez Dávila han notado que el carácter de su obra es intertextual, es decir, que no es un sistema cerrado: siempre está conectado implíci-tamente con otros libros y pensadores. El mismo Gómez Dávila nos indica en sus Escolios que Montaigne y Burckhardt tienen un rol central en esta intertextualidad. De tal manera, el siguiente artículo se propone interpretar la conexión entre los dos pen-sadores anteriores y la obra del colombiano. En el caso de Burckhardt, se (...) mostrará có-mo su pesimismo antropológico basado en una idea del pecado original, su escepti-cismo sobre la posibilidad humana de construir utopías, su negación de la idea de progreso y su concepción del tamaño y el papel del Estado aparecen y se desarrollan en el pensamiento del colombiano. En el caso de Montaigne, se mostrará su cercanía con Gómez Dávila a partir de sus similitudes biográficas, su alejamiento del espíritu académico de sus propios tiempos, su concepción de la filosofía, su escepticismo como arma para defender la fe y su fuerte conservatismo. Finalmente, se concluirá que esta intertextualidad que el autor mismo señala en su confesión sobre Montaigne y Bur-ckhardt nos ayuda a darle orden y sentido a sus posiciones políticas en los Escolios. En efecto, se intentará mostrar que Gómez Dávila articula las influencias de sus maestros para concluir en una visión de mundo reaccionaria. (shrink)

BackgroundIn Sweden, individuals with visual field loss have their driving license withdrawn. The literature clearly indicates that individuals with VFL are unsafe drivers on a group level. However, many drivers with VFL can be safe on an individual level. The literature also suggests that self-perception, beliefs, and insights of one’s own capabilities are related to driving performance. This study had three aims: To investigate self-perceived driving capability ratings for individuals with VFL; to compare these ratings between groups with different medical (...) conditions associated with VFL ; and to relate the self-perception ratings to actual driving performance in an advanced driving simulator.MethodsParticipants comprised 723 individuals whose driver’s license had been withdrawn because of VFL and 92 normally sighted elderly individuals. All participants completed a background survey, rated difficulties with different traffic situations, rated their strengths and weaknesses as drivers, and rated aspects that were important for causing traffic accidents. Of the VFL group participants, 264 also completed a simulator-based driving test that they knew could lead to renewal of their driving license. VFL participants and normally sighted was at the same age when they completed the simulator driving test.ResultsOverall, individuals with VFL rated their capabilities as high on all instruments and scales used, even higher than the elderly normally sighted control group. The only VFL etiology group that rated lower than other groups was the diabetes group. Safety orientation and internal control orientation values were best at discriminating between VFL participants in terms of self-perception of driving performance. Participants categorized as “high” in terms of safety skills and internal control were more modest in their ratings. Finally, participants who passed the simulated driving test did not differ from those who failed, in any of the self-perception measures.ConclusionSelf-perception ratings among individuals with VFL were higher than those of normally sighted elderly individuals. Self-assessed skills did not predict driving performance. Groups with different VFL etiologies rated similarly. Self-ratings of driving abilities cannot be used to assess actual driving performance. Actual driving tests are necessary to discriminate between safe and unsafe drivers with VFL. (shrink)

For (finitary) deductive systems, we formulate a signature‐independent abstraction of the weak excluded middle law (WEML), which strengthens the existing general notion of an inconsistency lemma (IL). Of special interest is the case where a quasivariety algebraizes a deductive system ⊢. We prove that, in this case, if ⊢ has a WEML (in the general sense) then every relatively subdirectly irreducible member of has a greatest proper ‐congruence; the converse holds if ⊢ has an inconsistency lemma. The result extends, in (...) a suitable form, to all protoalgebraic logics. A super‐intuitionistic logic possesses a WEML iff it extends. We characterize the IL and the WEML for normal modal logics and for relevance logics. A normal extension of has a global consequence relation with a WEML iff it extends, while every axiomatic extension of with an IL has a WEML. (shrink)

The paper critically examines C.A.J. Coady's analysis of testimony, concentrating on his interpretation of the views of David Hume. The author tries to show that not only is Coady's interpretation of Hume inadequate, but that Hume's conception of testimony is in fact superior to that of Coady. Coady sees Hume as the originator of the individualistic, first-person, view of testimony, according to which the reports of other people must be confirmed on the basis of an individualistically interpreted perception. Coady argues (...) against the first-person view that it undermines the very possibility of communication. Drawing on the ideas of Davidson and Wittgenstein, he argues that a good many beliefs must be true for the communication to be possible. The author provides evidence that Hume was a third-person theorist himself, even if he did not think that the truth of the majority of beliefs must be presupposed. Moreover, Wittgenstein and perhaps Davidson are also Humean in their belief that it suffices for beliefs to be generally correct rather than true. (shrink)

El artículo intenta abordar una evaluación del modelo normativo de relaciones internacionales bosquejado recientemente por John Rawls. Para ello subraya sus virtudes y sus defectos mediante el contraste con la propuesta de otro teórico político contemporáneo que también bebe de las fuentes kantianas del ideal cosmopolita: Jürgen Habermas. El autor concluye con una propuesta en la que la diversidad cultural y los ideales normativos cosmopolitas son integrados más allá de la completa aceptación de la facticidad y de la total abstracción (...) uníversalista insensible al contexto. By considering Davidson’s analysis of prepositions as defining individual events predicates, I argue against his semantics for action sentences and stress some logico-linguistic puzzles concerning both the interpretive pretension and the referential indifference of this proposal. Inspired by Evans as well as by Grice, I advance another interpretive semantics for those cases which does not take as assumption the individual character of events and argue for a constructivist approach to events in action discourse.

V práci sa zaoberám kritickou expozíciou argumentačných schém v kontexte pragma-dialektického prístupu k argumentácii. Nadväzujem pritom na prácu Hitchcocka a Wagemansa (2011), ktorí sa sústredili najmä na problémy súvisiace s typológiou argumentačných schém v pragma-dialektike. Pozorovania Hitchcocka a Wagemansa sú v priebehu výkladu kriticky hodnotené, prípadne upravené. Časť kritiky, ktorú v práci uvádzam, súvisí s tým, že niektoré dôležité aspekty argumentačných schém sú v rôznych pragma-dialektických publikáciách prezentované odlišne bez toho, aby sa odlišnosť akokoľvek komentovala, alebo zdôvodnila. Existencia takýchto zdôvodnení (...) nie je pritom iba znakom, ale aj nevyhnutnou podmienkou toho, aby sme akúkoľvek zmenu mohli nazývať pokrokom v teórii. Posledná časť práce je zameraná na problémy týkajúce sa hodnotenia argumentácie v pragma-dialektickom prístupe. Hoci článok prináša vlastné pozitívne návrhy, dôraz a celkový zámer spočíva predovšetkým na expozícii nedostatkov súčasného stavu pragma-dialektickej koncepcie argumentačných schém. Kľúčové slová: argumentačné schémy, kritické otázky, pragma-dialektický prístup k argumentácii, hodnotenie argumentov. (shrink)
