In light of developments within the field of media theory, a certain consensus has evolved in favour of approaches like mediatization and mediation. While these approaches above all focus on societal change from a media-dependent point of view, this article addresses the reverse side of these processes, asking about media users' appropriation of media in order to experience sociality that has only just been enabled by media-use. This awareness of medial terms and conditions is characterized as recipients' acknowledgment as well (...) as utilization of medial constraints, which is subsequently referred to as mediality. Zusammenfassung Demosthenes, Aristoteles und Pausanias berichten von dem Dikasterion in Phreatto, zu dem ein außer Landes gegangener Athener auf einem Boot heranfährt, dieses unmittelbar an der Küste festmacht und sich dann in einem Prozess verteidigt. Er betritt zu keinem Zeitpunkt athenischen Boden, sondern bleibt auf dem Boot und vernimmt dort das Urteil, ob er vorsätzlich getötet hat oder nicht. Diese Verhandlungsform zwischen Land und Meer kann – so aufwendig und eigentümlich sie auch anmutet – durchaus historisch sein, ist aber nur (...) zu begreifen, wenn man von Drakons Gesetz über die Tötung ausgeht. Der Gesetzgeber hat 621/620 v. Chr. den Vollzug der Blutrache unter die Kontrolle der athenischen Gemeinschaft gestellt und damit einen wichtigen Schritt zur Eindämmung von Konflikten in der Polis geleistet. The increasing use of Artificial Intelligence for making decisions in public affairs has sparked a lively debate on the benefits and potential harms of self-learning technologies, ranging from the hopes of fully informed and objectively taken decisions to fear for the destruction of mankind. To prevent the negative outcomes and to achieve accountable systems, many have argued that we need to open up the “black box” of AI decision-making and make it more transparent. Whereas this debate has primarily focused on (...) how transparency can secure high-quality, fair, and reliable decisions, far less attention has been devoted to the role of transparency when it comes to how the general public come to perceive AI decision-making as legitimate and worthy of acceptance. Since relying on coercion is not only normatively problematic but also costly and highly inefficient, perceived legitimacy is fundamental to the democratic system. This paper discusses how transparency in and about AI decision-making can affect the public’s perception of the legitimacy of decisions and decision-makers and produce a framework for analyzing these questions. We argue that a limited form of transparency that focuses on providing justifications for decisions has the potential to provide sufficient ground for perceived legitimacy without producing the harms full transparency would bring. School physical education has the potential to contribute to public-health promotion and well-being, but oftentimes students' lack of motivation toward PE or physical activity in general, especially during adolescence, diminishes, or eradicates the positive effects associated with PE. Therefore, practical approaches are required that help teachers to increase or awake students intrinsic motivation toward PE, for which self-determination theory may provide the conceptual framework. In that regard, the purpose of the present study was to examine whether the use of real-time, (...) heart rate feedback during regular PE lessons has the potential to increase students' autonomous motivation and physical effort. To achieve this, we had forty healthy adolescents between 16 and 17 years of age run for 30 min either with or without real-time, individualized heart rate feedback during a regular PE class and compared physical and perceived exertion as well as joy of running between the two groups. Participants were randomly assigned to the groups. Our data revealed that participants in the EG enjoyed running more than participants in the CG despite a higher physical and perceived exertion. That means, running with real-time, individualized heart rate feedback apparently increased participants' motivation to run and to enjoy running at higher levels of exertion. In that regard, real-time, individualized activity feedback should be implemented in regular PE classes systematically and repeatedly to create a controllable and attainable situation that allows students to actively adjust their own behavior to achieve appealing and realistic goals. The RNA editing enzyme ADAR1 seemingly has more functions besides RNA editing. Mouse models lacking ADAR1 and sensors of foreign RNA show that RNA editing by ADAR1 plays a crucial role in the innate immune response. Still, RNA editing alone cannot explain all observed phenotypes. Thus, additional roles for ADAR1 must exist. Binding of ADAR1 to RNA is independent of its RNA editing function. Thus, ADAR1 may compete with other RNA-binding proteins. A very recent manuscript elaborates on this and reports (...) competition of ADAR1 with STAUFEN1, thereby modulating RNA-degradation. ADAR1 is also known to recruit proteins such as DROSHA to nascent transcripts. Still, many open questions remain. For instance, the biological role of the Z-DNA binding domains in ADAR1 is not defined. Moreover, the impact of ADAR1 on the RNA-folding landscape is unclear. In sum, moonlighting functions of ADAR1 may be manifold and have a great impact on the transcriptome. Adenosine to inosine RNA editing by ADAR1 is mostly known for its role in the innate immune response to help discriminate self from non-self RNA. Here we discuss the other face of ADAR1 that impacts on cellular processes independent of its editing function. These include Staufen-mediated-decay, mRNA processing, or miRNA maturation. (shrink)

This Article analyzes the composition of the board of directors as a vehicle for state intervention in corporate governance. Such intervention is ubiquitous and often motivated by goals that stray from shareholder wealth maximization, or corporate governance more generally, to promote other national interests such as diversity. Regulating board composition thus is merely the continuation of politics by other means. After briefly discussing direct state ownership in business firms as a way to advance policy goals, the Article explicates the tensions (...) between boards’ dual responsibilities of monitoring and strategy-setting. These oftentimes conflicting missions curb the law’s ability to guide board members’ conduct through the conventional legal duties of loyalty and care or other injunctions. Although the two roles also may entail conflicting implications for board composition, regulation of board composition nonetheless may prove a superior means for promoting policy goals, especially with regard to the objective of the corporation. Composition regulation harnesses board members’ personal attributes — specifically, their values — to facilitate the attainment of these goals. Instead of telling board members what to do, the state may fare better by regulating who they are. (shrink)

This type of architecture is called “defensive” or “hostile” architecture and includes benches that cannot be slept on, spikes in the ground that cannot be stood on, and pieces of metal that hinder one’s ability to skateboard. These defensive measures have sparked public outrage, with many thinking such measures lead to suffering, are disrespectful, and violate people’s rights. In lieu of an abstract, here is a brief excerpt of the content:A Milanese Quartet FRED LICHT Milan, so often thought of as the heartless capital of grinding industry and heedless hedonism, is nevertheless home to at least four of the highest achievements of western art. Considered as a quartet, they represent both the greatness and the equivocal nature of human endeavor. Two of them, Raphael’s Sposalizio and Bramante’s Church of Santa Maria presso San Satiro, deal with the harmonious (...) congruence of human aspirations and human achievement attained by the grace of Providence. The limitations of human experience are accepted not as a curse but as a blessing because they are imposed by Divine Will. For Raphael as for Bramante, the artist’s obligation is to penetrate to the uttermost limits that circumscribe human existence. Having reached those limits he transmits to us the assurance that supreme fulfillment and serenity lie within and not beyond our grasp. The other two works, Leonardo’s Last Supper and Michelangelo’s Pietà Rondanini, conceive of the limits so gratefully acknowledged by Raphael and Bramante as nothing but the tragic starting point for their art. We can assume that all four artists had read Eccclesiastes and knew that “All is Vanity!” and consequently knew of the inevitable ruination that befalls everything terrestrial. Bramante and Raphael never mentioned the knowledge they had acquired from Ecclesiastes. Leonardo and Michelangelo made their recognition of Vanitas the very essence of their art. i. of this quartet, Raphael’s Marriage of the Virgin is by far the least popular today (fig. 1). The most obvious factor that arion 27.2 fall 2019 tends to make us wary of Raphael’s early work is its criminal overuse by religious as well as profane publicity. It has been massively reproduced in edulcorated colors, fragmented to yield sentimental details, visually bowdlerized. We cannot help but be heartily sick of Raphael Madonne on those hideous little catechism-class handouts and on expensive as well as cheap bonbonnières. We have become wary of seductive paintings and Raphael’s Sposalizio is eminently seductive. We may have sloughed off nearly all the Victorian hypocrisies and strictures, but in art we continue to be stoutly puritanical. We are more than a little convinced that seduction must necessarily be the result of a false or calculating appeal for our sympathies which we should resist. And there can be no doubt about it, Raphael, especially during his youth and early maturity, seduces and intends to seduce. Since we have little reason for self-esteem, we dismiss out of hand the possibility that Raphael might genuinely love us sight unseen. Indeed, who are we that he should want to seduce us? The love he bears us is a nuisance because it is hard to deserve or live up to such affection. So it is natural to suspect him of ulterior motives that might demean or disappoint us were we to fall victim to his seduction. Yet love is one of Raphael’s great gifts. If we feel unworthy of what he offers us, if we have been conditioned to distrust anyone who courts us without an obvious motive, then that’s our loss, not his. Perhaps if we look a little more closely at this particular seducer’s methods, we will find that they are practiced in good faith. He loves us because he sees the world sub specie amoris. The particular task he sets himself is not an easy one. The narrative, the wedding of the Virgin, is both intimate in spirit and minuscule in action. It hardly seems suitable for an altar that has to have an immediate effect on the faithful who approach it. It is a story that has been illustrated by many artists before Raphael—Perugino’s painting of the same subject is rightly and frequently cited—but it was Raphael who gave it its ideal and definitive representation. Using the American poverty threshold as a fixed measure, though, Western Europe has a poverty rate of 18 percent, higher than that of the United States. Moreover, Brady's thesis that welfare-state spending explains cross-country differences in inequality does not take account of the problem of reverse (...) causality. Historically, welfare states developed in homogeneous nations that started out with higher levels of social capital and lower inequality. Scandinavia, for example, had unusually low poverty rates a century ago, and even today Americans with Scandinavian ancestry exhibit a poverty rate no higher than that in Scandinavia. Since poverty, social capital, population homogeneity, and the size of the welfare state relate in multiple ways to each other, we cannot rely on cross-country correlations to isolate the causal effect of the welfare state on poverty rates. Nicht nur die Grenzen von Kunst und Leben sind in Bewegung, auch diejenigen zwischen den Einzelkünsten selbst verflüchtigen sich, sodass die kunstwissenschaftlichen Einzeldisziplinen den Arbeiten kaum mehr gerecht werden. Die Interart Studies spüren an Beispielen aus Film, Theater, bildender Kunst, Musik, in Ästhetik und Medientheorie Phänomene der Überschreitung auf, um zu erproben, wie diese mit neuen Mitteln methodisch und theoretisch adäquat zu fassen sind.

A filosofia crítica apoia-se na noção de representação, de ponta a ponta, como fundamento de sua investigação. Essa noção, contudo, acaba por tornar-se um problema na Dedução Transcendental da Crítica da razão pura, ponto de partida de pelo menos duas tradições distintas de apropriação da filosofia kantiana: a epistemologia e o idealism absoluto. ZusammenfassungVerbundmodelle von Schule und Spitzensport wie die NRW-Sportschule sind als Netzwerke mit vielfältigen Akteuren und Erwartungen zu beobachten, in denen programmatische Zielvorstellungen in die Gestaltung und Durchführung von Maßnahmen und die Arbeit diverser Organisationen und Personen übertragen werden sollen. Die Herausforderung für eine zielgerichtete Steuerung des Netzwerks liegt deshalb in der Koordination des Handelns einzelner Personen und der Entwicklung systemischen Wissens sowie der Ermöglichung des Lernens des Netzwerks. Der Beitrag präzisiert das Problem der Steuerung im Verbund aus der Perspektive von (...) Netzwerktheorie und Wissensmanagement. Empirische Erkenntnisse aus der Evaluation der NRW-Sportschule dienen als Anwendungsbeispiele der Bearbeitung dieser Herausforderung. ObjectiveTo assess the impact of the closure of group-based cardiac rehabilitation training during the first COVID-19 lockdown in spring 2020 on patients’ physical activity, cardiorespiratory fitness, and cardiovascular risk, and to describe the patient experience of lockdown and home-based exercise training during lockdown.DesignMixed methods study. Prospectively collected post-lockdown measurements were compared to pre-lockdown medical record data. Quantitative measurements were supplemented with qualitative interviews about the patient experience during lockdown.SettingOutpatient CR centre in Salzburg, Austria.ParticipantsTwenty-seven patients [six female, mean age 69 years] (...) who attended weekly CR training sessions until the first COVID-19 lockdown in March 2020.Outcome MeasureQuantitative: exercise capacity, cardiovascular risk. Qualitative: individual semi-structured interviews.ResultsExercise capacity had significantly reduced from pre- to post-lockdown: mean power in maximal ergometry 165 vs. 151, p < 0.001; submaximal ergometer training 99 vs. 97, p = 0.038. There was no significant difference in Framingham risk score and other cardiovascular risk factors. Qualitative data showed that almost all patients had kept physically active during lockdown, but 17 said they had been unable to maintain their exercise levels, and 15 felt their cardiorespiratory fitness had deteriorated. Many patients missed the weekly CR training and the motivation and sense of community from training together with others. Several patients stated that without professional supervision they had felt less confident to carry out home-based exercise training at high intensity.ConclusionThis study highlights the importance of group-based supervised exercise training for patients who engage well in such a setting, and the detrimental impact of disruption to this type of CR service on physical activity levels and exercise capacity. Additionally, learning from the COVID-19 pandemic may inform the development and implementation of remote CR modalities going forward. (shrink)
