This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one (...) hand, on the relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". Each essay of this volume not only undertakes a careful and original interpretation of Kant's theses, but also offers a critical assessment. (shrink)

Simple type theory is a higher-order predicate logic for reasoning about truth values, individuals, and simply typed total functions. We present in this paper a version of simple type theory, called PF*, in which functions may be partial and types may have subtypes. We define both a Henkin-style general models semantics and an axiomatic system for PF*, and we prove that the axiomatic system is complete with respect to the general models semantics. We also define a notion of (...) an interpretation of one PF* theory in another. PF* is intended as a foundation for mechanized mathematics. It is the basis for the logic of , an Interactive Mathematical Proof System developed at The MITRE Corporation. (shrink)

This collection of 38 papers gives a cross-section of ongoing research in philosophy of science and philosophical logic. The papers, written by active researchers in the field and published here for the first time, are drawn from around 650 papers that were contributed to the 9th International Congress of Logic, Methodology and Philosophy of Science in Uppsala, Sweden, 1991. Some of the speakers whose contributions attracted special interest were invited to contribute their papers to this volume. A few (...) papers appear here more or less as they were presented at the Congress, whereas others are expansions or elaborations of the talks given. There is one section with five papers on philosophical logic. The other papers deal with many different aspects of philosophy of science, including general methodological questions, problems of probability, induction and decision theory, and ethics of science and technology, as well as foundational problems about particular sciences. Five special sections are concerned with logic, mathematics and computer science, the physical sciences, the biological sciences, cognitive science, and linguistics, respectively. Finally, there is one section on the history of logic, methodology and philosophy of science. The book will be of interest to philosophers of science and logicians, as well as to all researchers interested in the foundations of their disciplines. (shrink)

The paper shows epistemological, methodological and ontological peculiarities of chemistry taken as a classificatory science of materials using experimental methods. Without succumbing to standard interpretations of physical science, chemical methods of experimental investigation, classification, reference, theorizing, prediction and production of new entities are developed one by one as first steps towards a philosophy of chemistry. Chemistry challenges traditional concepts of empirical object, empirical predicate, reference frame and theory, but also the distinction commonly drawn between natural science and technology. (...) Toulmin, Hull, Campbell, and Popper have defended an "Evolutionary-Analogy" view of scientific evaluative practice. In this view, competing concepts, theories and methods of inquiry engage in a competitive struggle from which the "best adapted" emerge victorious. Whether applications of this analogy contribute to our understanding of science depends on the importance accorded the disanalogies between natural selection theory and scientific inquiry. Michael Ruse has suggested instead an "Evolutionary-Origins" view of scientific evaluative practices in which scientific inquiry is directed by (...) application of epigenetic rules that have become encoded in homo sapiens in the course of evolutionary adaptation. Among these rules are "formulative theories that are internally consistent," "seek severe tests of theories," and "achieve a consilience of inductions". As a descriptive theory of science, the "Evolutionary-Origins" view is prima facie inconsistent with evidence that human beings often make decisions that violate the "genetically-hard-wired rules." As a normative-prescriptive philosophy of science, the "Evolutionary-Origins" view is limited by the fact that in biological evolution, adaptation to present pressures may be achieved at the expense of a loss of adaptability. The International Union of History and Philosophy of Science organizing the 10th International Congress of Logic, Methodology and Philosophy of Science is at its cross-road: the alternative is mass-performance or creative exchange of ideas. The program is criticized because the thematic center in History and Philosophy of Science has been shifted too far into the realm of micro-fields of Logic and the time reduction for presentation and discussion of papers to 20 minutes should be reconsidered. Several outstanding (...) papers are shortly discussed: Martin-Löw on "Formalized Tarski-Semantics of Type Theory", Hoyningen-Huene on "Feyerabend and Kuhn", Leroux on "Helmholtz and Hertz", and Muller on "Bell meets Dirac". Dewey blurs the distinction between poetry and philosophy. This is clearest in his aesthetics where he affirms Matthew Arnold’s dictum that “poetry is criticism of life.” The maxim, though, fails to say “how poetry is a criticism.” The role of art in general is imagining and creating images of the actual beyond the possible that (from a moral perspective) ought to exist. One can derive an ought from an is if one understands the is of poetic possibility. Dewey asserts (...) that “poetry teaches us as friends and life teach, by being, and not by express intent.” He affirms that it is “by way of communication that art becomes the incomparable organ of instruction.” Blurring the distinction between poetry and philosophy requires reconsidering the character—especially the moral character—of education as cultural criticism. Logic, Methodology, and the Philosophy of Science, the Proceedings of the 1960 International Congress at Stanford, is heavily weighted towards technical problems of logic, foundations of mathematics, and the special sciences, especially psychology, economic models, and structural linguistics, with little discussion of general problems of the philosophy of science. Problems about the idealization involved in the relation of theories to the world become problems about probabilistic models at various levels of abstraction ; induction becomes a problem in decision (...) theory ; language becomes the subject-matter of formalized syntactics, and so on. There is nothing in the least undesirable about these inquiries in a Philosophy of Science Congress, but there is a danger that, if they are not balanced by more informal discussions, real points of dispute are missed, or decided over-hastily in the brief preliminaries of formalization. The philosopher's job ought sometimes to be the more irritating one of returning to these points of dispute; a job which is well done in some of the contributions to this volume, but one could wish to find it being done in more. In what follows I shall have to restrict myself to commenting on only a handful of these more philosophical papers. (shrink)

The papers deal with diverse but correlated issues such as the search for truth in and through legal argumentation; the intelligible character of rules inside theories of interpretation which guarantee the coherence and the integrity of law; the role of hermeneutic analysis in the construction of the objectivity of law; the procedural and (...) contextual aspects of objectivity in legal reasoning; the role of objectivity in the distinction between the context of justification and the context of discovery; the problem about truth of normative propositions and legal statements; the incompatibility of non factualism with the traditional account of validity and legality; as well as the possibility of objectivity in morals. At this stage of evolution of our discipline, philosophy of science, there seems no single great theme that has attracted the attention of most practitioners in the field. Rather, scholarly works in the field are quite diffused. Traditional topics, such as reductionism and the unity of science, remain to be carefully examined from various perspectives. The debate over realism versus instrumentalism, although dismissed by some as uninteresting and unproductive, is still taken by many active scholars as vital in our (...) understanding of the nature of scientific theories and in our appraisal of scientific enterprise. Of course, the new spirit of our times has also shown itself, sometimes in the discussion of some major theses in the post-empiricist philosophy of science, such as incommensurability, underdetermination and constructivism, on the basis of detailed examination of scientific materials, other times in the shift of the attention from static aspects of science, such as theory justification and the nature of explanation, to more dynamic aspects, such as negotiations within a scientific community and its function and role in the development of science. Even more to the point in this regard is the great attention paid to the place science has occupied in modernity, the defect of modernist understanding of science and its possible remedy. Not surprisingly, this current state of affairs in our field has also manifested in the essays collected in this volume of contributions to the Twentieth World Congress of Philosophy. Thus, an inspection of these essays, although it will not provide us with a focus of the discipline, may give us some sense as to what is going on in the field. (shrink)

The emphasis in this collection is clearly on logic, and this is one reason why it lacks the overall diversity and richness of the 1960 Stanford volume. However, the eight sections do contain much interesting material; in the mathematical logic section Kochen and Specker continue their study of logics appropriate for quantum theory, Vaught presents several new results about the Löwenheim-Skolem theorem, and Büchi studies second-order ordinal theory from the viewpoint of automata theory; the section on foundations (...) of mathematical theories contains papers on higher-order logic by Kaplan and Montague, model theory and ultra-products by Keisler, definability in set theory by Lévy. The topic of the justification of formal theories was the essential topic of the philosophy of logic section: an especially interesting paper is that of A. Robinson in which the present state of Hilbertean Formalism is analyzed, and in which the notion of potential truth is formalized. The section on the philosophy of science contains a single paper, by Hesse, on metaphor and explanation; Braithwaite, Hintikka, Jeffrey, and Kyburg contribute to a lively section on probability and induction; the section on methodology in physical science takes as topics the theory of relativity, causality, and irreversibility. The last two sections, on the philosophy of the life sciences, and on history of logic and philosophy of science, contain, respectively, papers by Davidson and Suppes on meaning and concept formation, and essays by Church and Geach on existential import historically considered and intentionality among the medievals. The collection would have been better if more of the contributed papers had been included.—P. J. M. (shrink)

The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds particularly relevant (...) in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. It is divided into four parts: "Law and Practical Reason", "Conceptual Approaches on Law and Morals", "Legal versus Moral Normativity", and "Morals and Legal Positivism". (shrink)

It has been argued that philosophical theories in the philosophy of mind necessarily require empirical theories in cognitive science or cognitive neuroscience to be validated. This is indeed an unexpected relation between philosophy and science, since it is widely assumed nowadays – quite apart from Quinean qualms – that philosophical claims are largely a priori just in that their justification proceeds along paths which are independent of empirical investigations. I will defend that the case of attention provides further (...) confirmation of a position which is similar to Davies’s, but it shows at the same time that we should subscribe to a weaker version that has to do with the possibility of an eliminativist attitude towards the philosophical theory and the entities postulated in it. However, I will try to show that the case studies concerning attention show that this possibility, though it should not be excluded, is rather remote due to the fact that philosophical theories of mental phenomena are typically related to one in a set of different possible empirical theories. I will also try to show that this relation arises in at least one rather interestingly different way, in addition to the one involved in the case studies discussed by Davies. (shrink)

Theories of Theories of Mind brings together contributions by a distinguished international team of philosophers, psychologists, and primatologists, who between them address such questions as: what is it to understand the thoughts, feelings, and intentions of other people? How does such an understanding develop in the normal child? Why, unusually, does it fail to develop? And is any such mentalistic understanding shared by members of other species? The volume's four parts together offer a state of the art survey of the (...) major topics in the theory-theory/simulationism debate within philosophy of mind, developmental psychology, the aetiology of autism and primatology. In a response to John Rawls’s 1993 article entitled, “The Law of Peoples,” Karl-Otto Apel argues that the concept of “overlapping consensus” is not sufficient for a basis or foundation for global justice. Apel makes the claim that when Rawls transfers the problem of justification from a general moral conception of justice to overlapping consensus the “weight of justification” is transferred to a “freestanding” conception of justice. To the extent that it does this, Rawls’s theory fails to show why (...) a freestanding conception of justice ought to be acceptable. In order to do so, Apel believes that, since citizens’ reason must be addressed, the weight of justification for a freestanding view must be based on a philosophical consensus theory. This would not mean that the need of a factual consensus would be dispensed with. Rather, it would mean that a freestanding view would be grounded philosophically “by a conception of an ideal consensus that serves as a regulative principle for searching and also for questioning an overlapping consensus.”. The theory of half- education was presented at first on the congress of German sociologists (1959). The tendencies regarded in this theory are really taking place in the contemporary education and have determining its crises, which becomes more evidence in the social and cultural contexts of the later capitalism. The theory of half-education is rethinking and actualizing of the conceptualizations of education and culture in the German idealism, Marxism and Freudianism, explicating the dialectic of Enlightenment through diagnostics (...) of its degenerations and deformations in the options of the alien spirit, what has a very dangerous consequence of the liquidation of culture that is converting into the mas one. Half-education is parasitizing on the idea of education which has intrinsic contradictions: its conditions are the individual autonomy and social freedom, but it is depending on society. Id demands both: the individual autonomy and social adaptation. These contradictions can be overcame by the application of the negative dialectic, which joins complementary the critic of education and the critic of society opening new perspectives for them. This paper concerns broadly with the works of such ethical postmodern theorists as Jacques Derrida, Emmanuel Levinas, Giles Deleuze, focusing on how we can contribute to the development of their ideas by discussing Laozi and Zhuanzi’s Taoism, Buddhism, and modern Korean Neo-Confucianism of Toe-gae Lee. I claim that for criticism and art, literature, film and culture as well as philosophy itself, we are now facing this new need of another notion of subjectivity that not only accepts difference but takes (...) the position of whole positivity toward the Other. This different view of subjectivity that can be called "the sublime subjectivity" or the sublime totality of a human being or a society is essentially an aesthetic one, rather than one that depends upon logic, and it is vital to take advantage of Oriental ideas. From the perspective of the ethics of Levinas, I first place the sublime, jouissance, or pure enjoyment, at the heart of literary criticism. The pure sensibility of the sublime, or jouissance, unlike the raw feelings of pleasure, is an aesthetic sensibility beyond the ontological unity of feelings of pleasures and pains. Then with the Oriental thought, I make an attempt to contribute to the development of the ideas on the ethics of the relation of the reader and the literary text’s language. Laozi’s Taote Ching, Chuanzi, Diamond Sutra, and Toe-gae Lee’s notion of Taeguk are briefly explored in view of the aesthetic transphenomenal dimension and the sublime totality. (shrink)

Political conspiracy theorists have done a lot of good in the past; undoubtedly they will do a lot of good in the future too. However, it is important to point out that conspiracy theories may have adverse consequences too. Political conspiracy theorizing, as a public activity, may lead to harmful scapegoating and its implications may be racist and fascist rather than democratic. Conspiracy theories may undermine trust in political institutions. Certain conspiracy theories are kept artificially alive, because of their political (...) effects; “conspiracy theorists” do not always believe in their theories, but repeat them in public because of politicalreasons. Conspiracy theories have close connections to populism, and when theories are accepted widely enough, they remind harmful rumors. Sometimes conspiracy theories are designed and disclosed to make political decision-making more difficult and to create an impression that certain questions are still “open”. Certain conspiracy theories are disguised libels: they place individual persons in a “false light” in the public eye. In my presentation, I aim to discuss the ethics of political conspiracy theorizing and conditions for ethically acceptable conspiracy theorizing. (shrink)

Presented here are translations of two essays of the Austrian logician, philosopher and experimental psychologist Ernst Mally, originally delivered at the Third International Congress of Philosophy in Heidelberg, Germany. Both essays conclude with discussion between Mally and Kurt Grelling. Mally was a student of Alexius Meinong and a contributor to logical investigations in the field of object theory (Gegenstandstheorie). In these essays, Mally introduces a vital distinction between formal and extra-formal ?determinations? (Bestimmungen), and he argues that formal determinations (...) are not part of the identity conditions for intended objects, but provide the basis for a theory of pure logical and mathematical relations. Mally then proceeds to develop a formal logic of formal and extra-formal determinations, whose interrelations of ontic and modal predications provide an analysis of fundamental object theory concepts.
