This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

This paper concentrates on the way Kant's distinction between duties of right and duties of virtue operates at the interstate level. I argue that his Right of Nations (V ölkerrecht) can be interpreted as a duty to establish a kind of interstate distributive justice (that is, as a duty to secure states in their independence and territorial possessions), which is called for to secure domestic distributive justice and to protect individuals' freedom and private property. Or at least this is 'ideal (...) theory' for, as I specify, this cosmopolitan linkage is compromised by Kant's endeavour to accomodate the existence of non-republican states. (shrink)

The internet is a major part of our lives today. This applies to politics as well, and accordingly, the question of whether it is possible to realize democracy on the internet has arisen. Using the arguments of Hannah Arendt, the paper aims to determine what online democracy should look like. It is argued that the internet's decentralized structure is advantageous because it facilitates the implementation of the Arendtian system of political councils. Due to the character of online political platforms – (...) mainly social media – these political councils should ideally revolve around shared issues that simultaneously create the common world on the internet. At the same time, clear rules need to be laid down for the functioning of these online political councils. Based on Arendt's arguments, it is claimed in the paper that these rules include the principles of mutual promises and covenants on the issues themselves. It is also argued that because Arendt emphasizes the role of appearing in the public sphere, the process of authentication – that is, verifying that there is a concrete person with a physical body behind each online account that wants to actively participate in a particular online political council – is required. Some studies report that the sport context increases the risk of exposure to sexual violence for athletes. In contrast, others indicate a protective effect of sport participation against sexual violence, particularly among varsity athletes. Studies of sexual violence towards varsity athletes are limited by their failure to include control groups and various known risk factors such as age, graduate level, gender and sexual identity, disability status, international and Indigenous student status, and childhood sexual abuse. The purpose of the present study (...) is to fill in these gaps to determine whether varsity athletes are at greater risk than non-athletes of sexual violence towards them or whether, on the contrary, involvement in a varsity sport is coherent with the Sport Protection Hypothesis. Data for this article come from the ESSIMU study, a broad survey of students, professors, and other employees at six francophone universities regarding sexual violence on university campuses. A total of 6,485 students with complete data on sexual violence, athlete status, and gender were included in the study. From this total, 267 participants identified themselves as varsity athletes. Data were analyzed using a series of logistic regressions on each form of violence using athlete status as a predictor and characteristics associated with sexual violence victimization or distinguishing between varsity athletes and non-athletes as confounding variables. When considering all confounding variables in the regression analyses on four yearly incidence rates of sexual violence, the results revealed that being a varsity athlete did not significantly increase the risk of exposure to sexual violence at university. All considered other variables were more significant predictors of the past year’s risk of sexual violence victimization than athlete status was. (shrink)

In this article we address the question of individual identity and its place – or rather omission – in contemporary discussions about the cosmopolitan extension of liberalism as the dominant political theory. The article is divided into two parts. In the first part we show that if we consistently emphasise the complementarity of the “inner” and “outer” identity of a person, which is essential to liberalism from its very beginnings, then a fundamental flaw in the liberal cosmopolitan project becomes apparent. (...) This is the underestimation of the indispensability of an unambiguously determined public framework which will fix and enforce liberal principles and values in a comprehensible way. Such a framework for liberalism was always the political community and then, above all, the modern state, in which the liberal identity could then be realised. The discussion in this part of the article prepares the ground for an examination, in the second part, of a dilemma which cosmopolitan liberalism must face. In the second part we argue that the attempt to tackle the given problem presents liberals with the following dilemma: either it is necessary to plead for the institution of a global political authority (a “world state”), or to give up the belief that fundamental liberal principles and values can be realised to a global extent. We show, at the same time, that because of the character and ambitions of the cosmopolitan project, the promise of plural identities and multi­centred law cannot be relied upon. By way of conclusion we then ask what is the price of the realisation of cosmopolitan liberal ideals. -/- NOTE: This is a two-part article (in Czech). Néanmoins, s’agissant d’un principe aussi novateur que le principe de précaution, l’impact de celui-ci a véritablement peiné à émerger et l’on pouvait donc s’attendre à ce que la Charte de l’environnement lui donne une impulsion décisive. Toutefois, plus de quinze ans après l’entrée en vigueur de ce texte, le constat est celui d’une influence qui reste à la marge du droit de (...) l’urbanisme. Le droit écrit, tout d’abord, est resté singulièrement imperméable à ce principe, que ce soit sous forme d’une consécration officielle ou au travers de règles et mécanismes d’application. Du côté de la jurisprudence administrative, ensuite, on constate que si la nouvelle Charte a conduit à un spectaculaire revirement de jurisprudence, le Conseil d’État a fixé des conditions d’application telles que le principe reste encore à l’état virtuel. The objective of the present study was to show that the use of adversative and conclusive connectives to mark off the prototypical schema of argumentative text begins to set in at approximately the age of 10 or 11. Based on Adam's (1992) proposals, we constituted an argumentative text with two blocks of arguments separated by an adversative instruction (the connective but or an equivalent) and followed by a conclusion introduced by a conclusive instruction (the connective thus or an equivalent). Four (...) revising tasks (insertion or substitution with or without five connectives) have been used to asses children's knowledge of the argumentative schema and the use of connectives that punctuate them. The study of good and erroneous locations (concerning the placement of but and thus) showed that there was some regularity in the choices made by the children. The main result of this study shows that argumentative connectives are used differently by children aged 9 and children aged 10 or 11. The argumentative schema is used more consciously by 11-year-olds to guide revising tasks than by 10-year-olds. (shrink)

Hart's and Kelsen's respective outlooks on the concept of normativity not only differ by the way they explain this concept but also, more importantly, in what they seek to achieve when endeavouring to account for the normative dimension of law. By examining Hart's and Kelsen's models in the light of Korsgaard's understanding of the “normativity problem,” my aim is to emphasise not only their contrasted perspectives, but also the common limit they impose on their theories by dismissing as inappropriate any (...) question regarding the emergence of legal normativity. On the basis of my previous arguments, I shall explain why I deem Raz's analysis of the contrast between Hart's and Kelsen's conceptions of normativity to be misleading. (shrink)

In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...) bald naturalist premise, Hart could not conceive of moral objectivity except in terms presupposing an order of Reason resolutely distinct from the 'natural' world. This paper seeks to debunk this dualist outlook by engaging with the kind of 'non-bald' naturalism advocated in different ways by both McDowell and Blackburn. In considering contemporary efforts to draw a middle way between ethical scepticism and metaphysical rationalism, the paper draws on the pragmatic elements emerging from the confrontation between Habermas and Rawls. The objective of this study was to explore the participants’ processing strategies on the mere exposure effect, object decision priming and explicit recognition. In Experiments 1, we observed that recognition and the mere exposure effect for unfamiliar three-dimensional objects were not dissociated by plane rotations in the same way as recognition and object decision priming. However, we showed that, under identical conditions, prompting analytic processing at testing produced a large plane rotation effect on recognition and the mere exposure effect similar (...) to that observed for object decision priming . Furthermore, inducing a non-analytic processing strategy at testing produced a reduced plane rotation effect on recognition and object decision , similar to that observed for the mere exposure effect. These findings suggest that participants’ processing strategies influence performance on the three tasks. (shrink)

In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. ZusammenfassungIn diesem Artikel vertrete ich die These, dass die christliche spirituelle Theologie das Potenzial hat, die Theologie eines mündigen Christentums zu sein. Um meine These zu belegen, stelle ich das theologische Denken des libanesisch-orthodoxen Bischofs George Khodr vor, der neben den theologischen Beiträgen der frühen griechischen Kirchenväter und auch Gedanken vieler westlicher und östlicher Denker und Theologen, deren Beiträge im Laufe der Geschichte für Spiritualität stehen, in sein Denken integriert hat. Die christliche spirituelle Theologie ist also eine Theologie, die auf (...) einer Einsicht und Erkenntnis beruht, die das Ergebnis eines originellen, kreativen Denkens ist, dessen Grund im Menschen selbst liegt. Die spirituelle Theologie ist auch existentiell und kann als anthropologische Theologie wahrgenommen werden, da sie das ganze Engagement der Person erfordert und die menschliche Suche nach dem Göttlichen zum Ausgangspunkt hat. Und schließlich hat die spirituelle Theologie das Kreuz in ihrem Zentrum, was bedeutet, dass ihr Endziel auch der Geist ist, in dem und durch den die Einheit des Menschlichen und des Göttlichen möglich wird. Depuis 1893 jusqu’à la fin de sa vie, la question de l’individualisme des sociétés modernes n’a cessé de hanter Durkheim. Dès De la division du travail social, il fait en effet le constat que la montée de l’individualisme, en faisant éclater les structures du monde traditionnel, a conduit à une profonde crise sociale qu’il interprète avant tout comme une crise morale. Dès lors, il s’agira pour lui de repenser les conditions d’un consensus renouvelé adapté à la dynamique de la modernité. (...) Dans cette étude, nous montrerons que la réponse apportée par Durkheim à cette crise des sociétés modernes n’a cependant pas été univoque. Si en 1893, il pensait pouvoir fonder la cohésion sociale sur la solidarité fonctionnelle liée à la division du travail, c’est un tout autre modèle qu’il mobilisera à partir de 1898 et de son célèbre texte sur L’individualisme et les intellectuels. Cet article veut mettre en évidence la logique de ces deux modèles en montrant que c’est seulement à partir d’une réflexion sur la double nature de l’individualisme moderne que Durkheim trouvera le fondement d’une nouvelle et authentique solidarité. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

In particular, we are focusing on how computational and Big Data approaches can help to provide a better understanding of the ongoing COVID-19 infodemic and to develop effective strategies to combat it.

Lady Lovelace’s notes on Babbage’s Analytical Engine never refer to the concept of surprise. Having some pretension to ‘originate’ something—unlike the Analytical Engine—is neither necessary nor sufficient to being able to surprise someone. Turing nevertheless translates Lovelace’s ‘this machine is incapable of originating something’ in terms of a hypothetical ‘computers cannot take us by surprise’ objection to the idea that machines may be deemed capable of thinking. To understand the contemporary significance of what is missed in Turing’s ‘surprise’ translation of (...) Lovelace’s insight, one needs to distinguish between trivial surprises and those events, propositions or encounters that lead us to question our understanding of ourselves or what surrounds us. Only some of these non-trivial surprises are the product of originality endeavours. Not only is it uncommon for surprises to track such endeavours, the type of autonomy that would be required on the part of ‘digital computers’ for originality and surprise to intersect in that way goes far beyond the operational autonomy that can be achieved by ‘learning machines’. This paper argues that a salient translation of Lovelace’s originality insight—for contemporary and future ‘learning machines’—is an upside-down version of Turing’s surprise question: can computers be surprised by us in a non-trivial, ‘co-produced’ way? Dans son inventaire des « lieux théologiques », Melchior Cano ne faisait aucune place à l’expérience spirituelle, les « spirituels » ne paraissant même pas comme théologiens… La frontière qui, relayant une distinction paisible, s’était élevée entre théologie et spiritualité, sur la base d’une évolution de la théologie vers une scientificité et sous l’effet des interrogations du nominalisme, semble être devenue poreuse, sinon avoir disparu. De fait, la théologie contemporaine pense l’expérience croyante. La question pourrait se formuler ainsi : où (...) et comment peut se faire la prise en charge théologique de la vie spirituelle, du capital chrétien d’expérience spirituelle ? Est-ce par une discipline propre, la théologie spirituelle ? Qu’est-ce qui la caractériserait ? Pour réfléchir ainsi au devenir de la théologie spirituelle, on commencera par observer, avec quelques exemples d’élaborations théologiques significatives, comment la théologie contemporaine prend en compte la dimension expérientielle de la foi chrétienne. Mais prendre en compte cette part constitutive d’expérience, est-ce pour autant prendre en charge l’expérience spirituelle ? Si oui, une théologie spirituelle n’aurait plus de raison d’être ; si non, quelle est la vocation d’une telle théologie ?In his inventory of “theological loci”, Melchior Cano did not at all include spiritual experience and “spirituals” do not even appear in his listing as theologians… Following after a period of peaceful distinction, the border that has arisen between theology and spirituality - on the basis of an evolution of theology towards scientificity and under the influence of the questions raised by nominalism – seems now to have become porous, if not to have altogether vanished. In fact, contemporary theology reflects on believing experience. We could put the question this way: where and how can theology take charge of spiritual life, valorizing the Christian capital of spiritual experience ? Is it through a specific discipline, spiritual theology? What would characterize it ? In order to think through the way spiritual theology is developing, we shall begin by observing, thanks to a few examples of significant theological texts, how contemporary theology takes into account the experiential dimension of Christian faith. However, is taking into account this constitutive part of experience the same as taking charge of spiritual experience ? If so, a spiritual theology would no longer have a raison d’être; if not, what then is the task of such a theology ? (shrink)

The present work finds in Heidegger's 'being towards death' the basis for theological-philosophical thinking. Only the one who embraces 'being towards death' has the courage to think and poetize. This thinking, in turn, makes 'being towards death' possible, and in this circular movement of thinking and being the mystery of being reveals itself and yet remains hidden. In other words, the work describes the human response to the divine gift that precedes every human initiation.

This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. The general aim of this paper is to elucidate Kant's juridical understanding of the duty not to lie and to situate it within his account of ‘The right of a state’ and of ‘The right of nations’. The first section will introduce the distinction Kant draws between two senses in which a liar can be said to wrong another, namely, ‘materially’ and ‘formally’. The second section will be devoted to clarifying what Kant means by a ‘formal wrong’ (or a ‘wrong (...) in general’), by focusing on his use of this concept in the context of international relations. The third section will examine why a liar can be said to always do wrong ‘formally’. And the fourth section will show that what holds for individuals also holds for states in their mutual relationships: they are never to deceive one another, not even when innocent lives are at stake, because doing so would ‘subvert the right of human beings as such.'.
